<section id="HAD7BAA1FEE8E4833B7A5DA93E2D203EF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>CFTC Proprietary Information Act of 2026</short-title></quote>.</text> </section> <section commented="no" display-inline="no-display-inline" id="H89570456044E4C93A4E6246F5033D7D2" section-type="subsequent-section"><enum>2.</enum><header>Proprietary information</header><text display-inline="no-display-inline">Section 8 of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/12">7 U.S.C. 12</external-xref>) is amended by adding at the end the following:</text>

<subsection commented="no" id="H6B011C91A417464791DE5F7EB6AC7F1A"><enum>(j)</enum><header>Proprietary information</header>
<paragraph commented="no" id="H203BD717E568409387C46FA67DC21FBB"><enum>(1)</enum><header>In general</header><text>For any proprietary information provided to the Commission, the Commission shall, after notice and comment, adopt rules and regulations to apply the provisions of this section to the proprietary information the Commission obtains or receives, to the extent such information is not already covered by the provisions of this section.</text></paragraph> <paragraph commented="no" id="HDF73E30D7A03441F9739709639F62D6F"><enum>(2)</enum><header>Policies</header><text>With regard to proprietary information the Commission obtains or receives, the Commission shall adopt rules and regulations, to—</text>
<subparagraph commented="no" id="H50869C91022D428996DE6EC5BA2B7912"><enum>(A)</enum><text>address circumstances when the Commission requests proprietary information;</text></subparagraph> <subparagraph commented="no" id="H3CB23B15113F43E7BB129475F4DF0E58"><enum>(B)</enum><text>safeguard the information, taking into consideration the level of sensitivity of the information;</text></subparagraph>
<subparagraph commented="no" id="HC82E2BA01E06420FADC34D57972F33E4"><enum>(C)</enum><text>limit access to the information to appropriate staff, as determined by the Commission; and</text></subparagraph> <subparagraph commented="no" id="H8955EF85F46E4356B7BA7C65BB264FCA"><enum>(D)</enum><text>protect the information from unlawful use or disclosure.</text></subparagraph></paragraph>
<paragraph commented="no" id="HC2A6AF3974224068BD768E96B83521C1"><enum>(3)</enum><header>Sharing</header><text>The Commission shall adopt rules and regulations, pursuant to paragraph (1), regarding the sharing of such proprietary information with other governmental entities. The rules shall require the Commission to receive assurances that such other governmental entity shall maintain sufficient safeguards consistent with—</text> <subparagraph commented="no" id="HE05949ADDE0143088B498118660C20E1"><enum>(A)</enum><text>policies that achieve the objectives of subparagraphs (B), (C), and (D) of paragraph (2) of this subsection; and</text></subparagraph>
<subparagraph commented="no" id="H590DF66B08584AE09ED3DFDA08D4E1E8"><enum>(B)</enum><text display-inline="yes-display-inline">the limitations set forth in paragraphs (2), (3), and (4) of subsection (e) concerning the confidentiality of any such information received.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body></bill>
