<section id="H1052BC6162C9495C8ECDFD5AA7BF3EAC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preserving Social Security and Medicare for Citizens Act of 2026</short-title></quote>.</text></section> <section id="HE6B3CC6DD62547D1812B2B63AFF402C9"><enum>2.</enum><header>Limiting Medicare eligibility to certain individuals</header> <subsection id="HD023FC24F5F2472DBCC5E9F60A050DF1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1899C of the Social Security Act is amended—</text> 
<paragraph id="H92A0E3DAE49144498062260DB71E9109"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="H186967ED7DD24C5998A29332FB1785E9"><enum>(A)</enum><text>in paragraph (1), by adding <quote>or</quote> at the end;</text></subparagraph> 
<subparagraph id="H682167EA756342C7ABDF79A20307D2B0"><enum>(B)</enum><text>in paragraph (2), by striking the semicolon and inserting a period; and</text></subparagraph> <subparagraph id="H96BEFC27DC094AB3914C9F4EC9BDA6B1"><enum>(C)</enum><text>by striking paragraphs (3) and (4); and</text></subparagraph></paragraph> 
<paragraph id="HD3353FFE4D4D4D759C3EECC9371B3513"><enum>(2)</enum><text>in subsection (b), by striking <quote>in any of paragraphs (1) through (4)</quote> and inserting <quote>in paragraph (1) or (2)</quote>.</text> </paragraph></subsection> <subsection id="H0CA0E4E084C841A89E62E0E2C588972A"><enum>(b)</enum><header>Special application rule for certain individuals</header><text display-inline="yes-display-inline">In the case of an individual who is entitled to benefits under part A or enrolled under part B of title XVIII the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>) as of the date of the enactment of this section but who was not so entitled or enrolled as of the date of the enactment of <external-xref legal-doc="public-law" parsable-cite="pl/119/21">Public Law 119–21</external-xref>, such individual shall be deemed to have been so entitled or enrolled as of the date of the enactment of such Public Law for purposes of section 1899C(b) of such Act.</text></subsection></section> 
<section id="HA4DE9FDE4C0D4ACEAF09570F872F17E3"><enum>3.</enum><header>Limiting Social Security benefits eligibility to certain individuals</header> 
<subsection id="H89C8A18E2CDE4640AD93D4268DA44E60"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 202(y) of the Social Security Act is amended to read as follows:</text> <quoted-block style="OLC" id="H201FA25E2A924D4D8BDC78FF3ABDC62F" display-inline="no-display-inline"> <subsection id="HA04D1E6E999E49E0803DD569F3CA5F3A"><enum>(y)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law, no monthly benefit under this title shall be payable to an individual who is not—</text> 
<paragraph id="H8999FB9D61AA4853A046C7915F9EDE8D"><enum>(1)</enum><text>a citizen or national of the United States; or</text></paragraph> <paragraph id="H929DCBE9A03B4BF1A395E9B25CBECE7D"><enum>(2)</enum><text display-inline="yes-display-inline">an alien who is lawfully admitted for permanent residence under the Immigration and Nationality Act.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HEAC49B40B1834D1FAD385EB39077E2A3"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply with respect to monthly benefits for months beginning after the date of enactment of this Act.</text></subsection></section> <section id="H65D688587E3849C7AB39D1CF45EC138C"><enum>4.</enum><header>Expanding FICA tax to include remuneration paid to certain individuals</header> <subsection id="HAACBC622647745709CD14FCE03F3CD65"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/3121">Section 3121(b)</external-xref> of the Internal Revenue Code of 1986 is amended by striking paragraphs (1), (18), and (19).</text></subsection> 
<subsection id="H9C1402AC6B2C48A58DADBB49B8CA4B19"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply with remuneration paid in taxable years beginning after December 31 of the calendar year in which this Act is enacted.</text></subsection></section> </legis-body></bill>
