<section section-type="section-one" id="HBC98BF9D3F9C423C81AABCA8B0E48D09"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ultra-Millionaire Tax Act of 2026</short-title></quote>.</text></section> <section id="H32CA08A453A14DCAB20B7F698BCF2C98"><enum>2.</enum><header>Imposition of wealth tax</header> <subsection id="HA85B595C138A421BA78CC1CA16239D4C"><enum>(a)</enum><header>In general</header><text>The Internal Revenue Code of 1986 is amended by inserting after subtitle B the following new subtitle:</text>

<section section-type="subsequent-section" id="H43FFA7E8548A4EDF8F440E1B667592A4"><enum>2901.</enum><header>Imposition of tax</header>
<subsection id="H8D71D33B500E4C5F88F85DC3666C2F7C"><enum>(a)</enum><header>In general</header><text>In the case of an individual, a tax is hereby imposed on the net value of all taxable assets of the taxpayer on the last day of any calendar year.</text></subsection> <subsection id="HA33E7D8AA1DA4A8B8E5A23C8877A4438"><enum>(b)</enum><header>Computation of tax</header> <paragraph id="H8150893F4A1D44E09B1BD011AF2F991D"><enum>(1)</enum><header>In general</header><text>The tax imposed by this section shall be equal to the sum of—</text>
<subparagraph id="H761AAFE6F7DB48799B79612FE371465F"><enum>(A)</enum><text>0 percent of so much of the net value of all taxable assets of the taxpayer as does not exceed the zero bracket threshold,</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HE6048BC767E045F09F75931DC0051343"><enum>(B)</enum><text display-inline="yes-display-inline">2 percent of so much of the net value of all taxable assets of the taxpayer in excess of the zero bracket threshold but not in excess of the top bracket threshold, plus</text></subparagraph>
<subparagraph id="HF1C870F01B854C2499F081DE5746D46D"><enum>(C)</enum><text>the applicable percentage of so much of the net value of all such taxable assets of the taxpayer in excess of the top bracket threshold.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HCE4CDC67B85B45348E5F922768C78262"><enum>(2)</enum><header>Zero bracket threshold; top bracket threshold</header><text display-inline="yes-display-inline">For purposes of this section—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H8A9FB4925C77416094D298079E493ADE"><enum>(A)</enum><header>Zero bracket threshold</header><text display-inline="yes-display-inline">The zero bracket threshold is $50,000,000.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HE07E7AA720BC410EBA7F1527448DD663"><enum>(B)</enum><header>Top bracket threshold</header><text>The top bracket threshold is $1,000,000,000.</text></subparagraph></paragraph></subsection>
<subsection id="H21986D3EE80F41B1AB6E9B8D8B498990"><enum>(c)</enum><header>Applicable percentage</header>
<paragraph id="HC3038182A8F84159AA949D2BFFE7EBF0"><enum>(1)</enum><header>In general</header><text>For purposes of this section, the applicable percentage is—</text> <subparagraph id="H3984FDD77A9348CF89B6FC21C4CC57E7"><enum>(A)</enum><text>except as provided in subparagraph (B), 3 percent, and</text></subparagraph>
<subparagraph id="H3FF2DFE3312F4EA283FF8BDA89ADFB49"><enum>(B)</enum><text>in the case of any calendar year in which there is in effect legislation which meets the requirements of paragraph (2), 6 percent.</text></subparagraph></paragraph> <paragraph id="H6741E24DD8274156BF8A7A5CB9827E62"><enum>(2)</enum><header>Legislation described</header><text>Legislation meets the requirements of this paragraph if such legislation—</text>
<subparagraph commented="no" id="H1267D3F95DBD4B06B50FDB274204BB89"><enum>(A)</enum><text>establishes a health insurance program that provides to all residents of the United States comprehensive protection against the costs of health care and health-related services, and</text></subparagraph> <subparagraph commented="no" id="HD996AA17F80B4C63A9474DAC82B52712"><enum>(B)</enum><text>prohibits private entities from providing duplicate benefits.</text></subparagraph></paragraph></subsection>
<subsection id="HFE2BEA3117C44DEDB6A188A8D232B8DA"><enum>(d)</enum><header>Treatment of married individuals</header><text>For purposes of this section, individuals who are married (as defined in section 7703) shall be treated as one taxpayer.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="H629C76F5EBA940CE8603D475F0A62510"><enum>(e)</enum><header>Treatment of nongrantor multibeneficiary trusts</header> <paragraph commented="no" display-inline="no-display-inline" id="H209DD341A2F142FBBD6DB36A893B6A98"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Any trust or portion of a trust which is a nongrantor multibeneficiary trust shall be treated as an individual to whom this chapter applies. </text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H2C1846B8E3934DFA8E4BC4F53FCAFF14"><enum>(2)</enum><header>Computation of tax</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H72D0BBEB35F1452BAA3F1F1AE6659E78"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In applying this chapter to a nongrantor multibeneficiary trust—</text> <clause commented="no" display-inline="no-display-inline" id="HA5E633B277FD42EBAD9C47444236756C"><enum>(i)</enum><text display-inline="yes-display-inline">the zero bracket threshold shall be equal to the sum of—</text>
<subclause commented="no" display-inline="no-display-inline" id="H337F3DF119644CF3AE8FD5067366BC7D"><enum>(I)</enum><text display-inline="yes-display-inline">$0, plus</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="HD5D520143E294D7D8D034A701503E89A"><enum>(II)</enum><text display-inline="yes-display-inline">the lowest unused 0 percent bracket amount assigned to the trust by all beneficiaries of the trust, and</text></subclause></clause>
<clause commented="no" display-inline="no-display-inline" id="HFF4832FDF2FD47589009333123F6826D"><enum>(ii)</enum><text display-inline="yes-display-inline">the top bracket threshold shall be equal to the sum of—</text> <subclause commented="no" display-inline="no-display-inline" id="H5C87C2D2563F4BC4B9D649CB9FA8A651"><enum>(I)</enum><text display-inline="yes-display-inline">$0, plus</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H38417B8919964AD19E2CA98951D7D648"><enum>(II)</enum><text display-inline="yes-display-inline">the lowest unused 2 percent bracket amount assigned to the trust by all beneficiaries of the trust.</text></subclause></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HD8FA00EACF2B421FA22A0B2D28DD772E"><enum>(B)</enum><header>Unused 0 percent bracket amount</header><text>For purposes of this paragraph, the term <term>unused 0 percent bracket amount</term> means, with respect to any beneficiary for any calendar year, the lesser of—</text>
<clause commented="no" display-inline="no-display-inline" id="H60518D1345994374A64D39771E997C66"><enum>(i)</enum><text display-inline="yes-display-inline">the excess (if any) of—</text> <subclause commented="no" display-inline="no-display-inline" id="H83C4F95FF2AA4CF6AD4704C96A93A1C7"><enum>(I)</enum><text display-inline="yes-display-inline">the zero bracket threshold, over</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="HE734795E42614D59BE8D5C35C955B13C"><enum>(II)</enum><text>the sum of—</text> <item commented="no" display-inline="no-display-inline" id="HB432F4174CA442D2990265029F9D97AB"><enum>(aa)</enum><text display-inline="yes-display-inline">the net value of all taxable assets of the beneficiary for the calendar year, plus</text></item>
<item commented="no" display-inline="no-display-inline" id="HE1105B9DEFDC44E18C388839332300DE"><enum>(bb)</enum><text display-inline="yes-display-inline">any unused 0 percent bracket amount assigned by the beneficiary to other nongrantor multibeneficiary trusts, or</text></item></subclause></clause> <clause commented="no" display-inline="no-display-inline" id="HAF49F35B380A48469E230DC124681831"><enum>(ii)</enum><text display-inline="yes-display-inline">the portion of the net value of all taxable assets of the trust which such beneficiary is eligible to receive.</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H793E43E5C18A4FB783621111279C2D72"><enum>(C)</enum><header>Unused 2 percent bracket amount</header><text>For purposes of this paragraph, the term <term>unused 2 percent bracket amount</term> means, with respect to any beneficiary for any calendar year, the lesser of—</text> <clause commented="no" display-inline="no-display-inline" id="H2E1450C60902432081F9F62BA253EC80"><enum>(i)</enum><text display-inline="yes-display-inline">the excess (if any) of—</text>
<subclause commented="no" display-inline="no-display-inline" id="H71DE4362EBE14564AC88E1AF16609018"><enum>(I)</enum><text display-inline="yes-display-inline">the top bracket threshold reduced by the zero bracket threshold, over</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="H8038159F37FD450A84A43123C49260C1"><enum>(II)</enum><text>the sum of—</text>
<item commented="no" display-inline="no-display-inline" id="H21128CCDE6894598AECA9888A084D68A"><enum>(aa)</enum><text display-inline="yes-display-inline">the net value of all taxable assets of the beneficiary for the calendar year in excess of the zero bracket threshold, plus</text></item> <item commented="no" display-inline="no-display-inline" id="H2EB715231B204EB588A1D0A4FF457B5B"><enum>(bb)</enum><text display-inline="yes-display-inline">any unused 2 percent bracket amount assigned by the beneficiary to other nongrantor multibeneficiary trusts, or</text></item></subclause></clause>
<clause commented="no" display-inline="no-display-inline" id="H91EF10AAF6FF42BCB73AB3BBA51EB607"><enum>(ii)</enum><text display-inline="yes-display-inline">the portion of the net value of all taxable assets of the trust which such beneficiary is eligible to receive. </text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H28F06EF0ACAD420E8765504B28FD704B"><enum>(D)</enum><header>Assignment of amounts</header><text>The assignment of any amount of unused 0 percent bracket amount and unused 2 percent bracket amount shall be made at such time and in such manner as specified by the Secretary in regulations. In any case in which no affirmative assignment is made by a beneficiary, the amount assigned shall be $0.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HFDCFA4AA77A647CE9EBA91D7E8F9ECE2"><enum>(3)</enum><header>Nongrantor multibeneficiary trust</header><text display-inline="yes-display-inline">For purposes of this chapter—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HE3C588752EDD41BEBD08DECE89E6D354"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>nongrantor multibeneficiary trust</term> means any trust or portion of a trust—</text>
<clause commented="no" display-inline="no-display-inline" id="H78DCCCD56E2441E798594E73B91FFD73"><enum>(i)</enum><text display-inline="yes-display-inline">with respect to which no person is treated as an owner under subpart E of subchapter J of chapter 1, </text></clause> <clause commented="no" display-inline="no-display-inline" id="H1DCBF1A4C3154998ABDBF7EFEF576B81"><enum>(ii)</enum><text display-inline="yes-display-inline">no property of which is attributable to a gratuitous transfer of assets by a person who is subject to tax under this chapter for the calendar year, and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H2CECEA72FF9F47D88B0B880858373CF7"><enum>(iii)</enum><text display-inline="yes-display-inline">which has more than one beneficiary (determined as of the last day of the calendar year). </text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H17EA634C00E14AB1A53CD8134D73A577"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">Such term shall not include—</text>
<clause commented="no" display-inline="no-display-inline" id="H0353E6EB1ADE484E8C2C456D4841EA6A"><enum>(i)</enum><text display-inline="yes-display-inline">any trust described in section 401(a) and exempt from tax under section 501(a), </text></clause> <clause commented="no" display-inline="no-display-inline" id="H22F26568575C4EE7943890333C786BBA"><enum>(ii)</enum><text>any trust all of the unexpired interests in which are devoted to one or more of the purposes described in section 170(c)(2)(B),</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H9757F7B18E944B638BF0365EDCE16323"><enum>(iii)</enum><text>any charitable lead annuity trust (as defined in section 2642(e)(3)) or charitable lead unitrust, or</text></clause> <clause commented="no" display-inline="no-display-inline" id="HC995751B76104A65915FA29EF27B5764"><enum>(iv)</enum><text>any charitable annuity remainder trust (as defined in section 664(d)(1)) or any charitable remainder unitrust (as defined in section 664(d)(2)).</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HE327AFCFEDF343DB93E7E9B1AB3BD69B"><enum>(C)</enum><header>Beneficiary</header><text>The term <term>beneficiary</term> shall not include any person whose interest in a trust is contingent on the death of another person with an interest in such trust.</text></subparagraph></paragraph></subsection></section> <section id="H7AC49D1D0BF24AE8A00E2B70E2036AEE"><enum>2902.</enum><header>Net value of taxable assets</header> <subsection id="H7B7473FFC2F34E51AC89F592962D3D83"><enum>(a)</enum><header>In general</header><text>For purposes of this subtitle, the term <term>net value of all taxable assets</term> means, as of any date, the value of all property of the taxpayer (other than property excluded under subsection (b)), real or personal, tangible or intangible, wherever situated, reduced by any debts (including any debts secured by property excluded under subsection (b)) owed by the taxpayer. </text></subsection>
<subsection commented="no" id="H33179BB21AA440A299738460BB613FDB"><enum>(b)</enum><header>Exclusion for certain assets</header><text>Property of the taxpayer shall not be taken into account under subsection (a) if such property—</text> <paragraph commented="no" id="H6E7050CFCEFF42C7BD9F811985CE086E"><enum>(1)</enum><text>has a value of $50,000 or less (determined without regard to any debt owed by the taxpayer with respect to such property),</text></paragraph>
<paragraph commented="no" id="H69FD7AC1ADD649E79E8136AFD765198A"><enum>(2)</enum><text>is tangible personal property, and</text></paragraph> <paragraph commented="no" id="H1912624118AF4416A13514F1AEB0C76F"><enum>(3)</enum><text>is not property—</text>
<subparagraph commented="no" id="H69BF3CF8E43D4D0A941F3EE2F301A6C3"><enum>(A)</enum><text>which is used in a trade or business of the taxpayer,</text></subparagraph> <subparagraph commented="no" id="H97D2C73B9D3940DCB9692A1DBF104FF8"><enum>(B)</enum><text>in connection with which a deduction is allowable under section 212, or </text></subparagraph>
<subparagraph commented="no" id="HA87BDA1718274FE9ADF891D5AB5B2D97"><enum>(C)</enum><text>which is a collectible as defined in section 408(m), a boat, an aircraft, a mobile home, a trailer, a vehicle, or an antique or other asset that maintains or increases its value over time (within the meaning of section 5.02(2) of Revenue Procedure 2018–08).</text></subparagraph></paragraph></subsection> <subsection id="H82120D5B6E82403DACF80CB0D5546791"><enum>(c)</enum><header>Rules for determining property of the taxpayer</header><text>For purposes of this subtitle—</text>
<paragraph id="H164C88863EE842EEBFDDDF965180CCF3"><enum>(1)</enum><header>Property included in estate</header><text>Any property that would be included in the estate of the taxpayer if the taxpayer died shall be treated as property of the taxpayer.</text></paragraph> <paragraph commented="no" id="H9C0BE9E1A2E14F6ABA5CB1BC33B1482A"><enum>(2)</enum><header>Inclusion of certain gifts</header><text>Any property transferred by the taxpayer after the date of the enactment of this chapter, to an individual who is a member of the family of the taxpayer (as determined under section 267(c)(4)) and has not attained the age of 18 shall be treated as property of the taxpayer for any calendar year before the year in which such individual attains the age of 18. </text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H942134E3462A49158F17D597859517C7"><enum>(3)</enum><header>Attribution of property held by trusts</header>
<subparagraph id="H41CED233D0B84942B329A5EFB6B0A2CE"><enum>(A)</enum><header>Grantor trusts</header><text>If an individual is treated as the owner of any portion of a trust under subpart E of subchapter J of chapter 1, property attributable to such trust or portion of the trust shall be treated as property of the individual and not as property of the trust.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HDF7FC19DC91F46A48977C442CC98FFE0"><enum>(B)</enum><header>Nongrantor trusts</header> <clause commented="no" display-inline="no-display-inline" id="H167B4685F7AF45C8BDA11E11672948A6"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of a trust or portion of a trust which is not described in subparagraph (A), any property which is attributable to a gratuitous transfer of assets by an individual who is subject to tax under this chapter for the calendar year shall be treated as property of such individual and not as property of the trust.</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H1884BBC6526443C4A726383799FB6A5B"><enum>(ii)</enum><header>Other trusts</header>
<subclause commented="no" display-inline="no-display-inline" id="H2FDA96AD79124498B7DC37FE1810B9F3"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of any trust or portion of a trust which is described in subclause (II), the property of such trust shall be treated as the property of the beneficiary of such trust and not as the property of the trust.</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="HB6186AB72D1D432EB8DB1B627DE183C1"><enum>(II)</enum><header>Trusts to which this subclause applies</header><text display-inline="yes-display-inline">A trust is described in this subclause if such trust not described in subparagraph (A), the assets of such trust are not attributable to a gratuitous transfer of assets by a person who is subject to tax under this chapter for the calendar year, and such trust has a single beneficiary (determined as of the last day of the calendar year).</text></subclause></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H248AD9DBB6D94804A98457CB9DDCF5D8"><enum>(C)</enum><header>Right of recovery</header>
<clause commented="no" display-inline="no-display-inline" id="H7E5E0446EED44DF68D43ADA8A0D22642"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">If any part of the net value of taxable assets of an individual on which tax has been paid consists of the value of property held by a trust which is included in the net value of taxable assets of such individual by reason of subparagraph (B), then such individual shall be entitled to recover from the trust the amount which bears the same ratio to the recoverable amount as—</text> <subclause id="H3FD0EC42D9D947AD828A258C323A7A65"><enum>(I)</enum><text>the value of such property, bears to</text></subclause>
<subclause id="H29A31B04E0F046E59FC8E2A0DEF31934"><enum>(II)</enum><text>the net value of taxable assets of the taxpayer. </text></subclause></clause> <clause commented="no" display-inline="no-display-inline" id="H0216540A3A1F4289B7138BA51BC9C82D"><enum>(ii)</enum><header>Recoverable amount</header><text>For purposes of clause (i), the recoverable amount with respect to any trust is the excess of—</text>
<subclause commented="no" display-inline="no-display-inline" id="HBFF2839684F24F7BB430C788FDC807D7"><enum>(I)</enum><text display-inline="yes-display-inline">the tax imposed under this chapter for the calendar year on the individual, over</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="H82DF6970C4014456959F270ACADDAA29"><enum>(II)</enum><text>the amount of such tax which would be imposed for such calendar year on such individual if no property held by such trust were included in the net value of taxable assets of the individual.</text></subclause></clause>
<clause commented="no" display-inline="no-display-inline" id="H87FF7197260C4B1FA7E620090A9C0B54"><enum>(iii)</enum><header>Treatment where no recovery</header><text>In any case where a trust does not reimburse any taxpayer as provided in clause (i), the taxpayer shall be treated for purposes of this chapter as having made a gratuitous transfer to the trust in an amount equal to the amount determined under clause (i). Such transfer shall be treated as having been made on the last day of the calendar year for which the tax under subsection (a) was due.</text></clause></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HBBD278E27DE649BEA7F0E15AD8505AFB"><enum>(4)</enum><header>Treatment of assets held by certain split-interest trusts</header> <subparagraph commented="no" display-inline="no-display-inline" id="H1E30F14A5C3E4F6D846EBD74F77194A6"><enum>(A)</enum><header>Remainder interests in charitable remainder annuity trusts and charitable remainder unitrusts</header><text display-inline="yes-display-inline">In the case of any charitable remainder annuity trust (as defined in section 664(d)(1)) or of a charitable remainder unitrust (as defined in section 664(d)(2))—</text>
<clause commented="no" display-inline="no-display-inline" id="HA003233D89E64A449DC0F132D952CC6A"><enum>(i)</enum><text display-inline="yes-display-inline">the present value of any remainder interest shall not be taken into account under subsection (a), and</text></clause> <clause commented="no" display-inline="no-display-inline" id="HFDE8869CE3A8444E8F9157EC7AC42787"><enum>(ii)</enum><text>the present value of any other interests shall be taken in account under subsection (a), in accordance with regulations promulgated by the Secretary, as the property of the beneficiaries of such interests.</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H4FD0026DD4C4458EB23A42FA2B8CC6B2"><enum>(B)</enum><header>Charitable lead annuity trusts and charitable lead unitrusts</header><text>In the case of a charitable lead annuity trust (as defined in section 2642(e)(3)) or a charitable lead unitrust—</text> <clause commented="no" display-inline="no-display-inline" id="H17A3B23EB144495F81AF5AEDD6C749DF"><enum>(i)</enum><text display-inline="yes-display-inline">the present value of any interest described in section 2522(c)(2)(B) shall not be taken into account under subsection (a), and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H9B44855D4EF14B6F8A0281101ED094D5"><enum>(ii)</enum><text>notwithstanding paragraphs (A) and (B) of paragraph (3), the present value of any remainder interest shall be taken into account under subsection (a), in accordance with regulations promulgated by the Secretary, as the property of the beneficiaries of such remainder interest. </text></clause></subparagraph></paragraph></subsection> <subsection id="HA80D79B84E7446DB8FCDE0B24CCD4809"><enum>(d)</enum><header>Establishment of valuation rules</header><text>Not later than 12 months after the date of the enactment of this section, the Secretary shall establish rules and methods for determining the value of any asset for purposes of this subtitle, including rules for the valuation of assets that are not publicly traded or that do not have a readily ascertainable value. Such rules and methods—</text>
<paragraph id="HF37354C9C230438BB53029FE7A9DAD2E"><enum>(1)</enum><text>may utilize retrospective and prospective formulaic valuation methods not currently in use by the Secretary, </text></paragraph> <paragraph id="H481172A855DC48B0B6838F2481F4DD8C"><enum>(2)</enum><text>may require the use of formulaic valuation approaches for designated assets, including formulaic approaches based on proxies for determining presumptive valuations, formulaic approaches based on prospective adjustments from purchase prices or other prior events, or formulaic approaches based on retrospectively adding deferral charges based on eventual sale prices or other specified later events indicative of valuation, and</text></paragraph>
<paragraph id="HC6AD97B7F31B4D20B1C3EDD06FD35512"><enum>(3)</enum><text>may address the use of valuation discounts.</text></paragraph></subsection></section> <section id="H4893605B287E4E0692EA2C6E2086439A"><enum>2903.</enum><header>Special rules</header> <subsection id="H0089D8FC6A6047359EADCE10E0F5F1C7"><enum>(a)</enum><header>Deceased individuals</header> <paragraph id="H024A0792A81A4A9BA47F636208740482"><enum>(1)</enum><header>In general</header><text>In the case of any individual who dies during a calendar year and who is not married on the date of such individual's death—</text>
<subparagraph id="H0241F20533C54F83B50688834B6DEB4A"><enum>(A)</enum><text>section 2901(a) shall be applied by substituting <quote>the date of the individual's death</quote> for <quote>the last day of the calendar year</quote>, and</text></subparagraph> <subparagraph id="H32635ABF2FDB4787814DEF71FCB1CAE2"><enum>(B)</enum><text>the amount of the tax imposed under such section shall be reduced by an amount which bears the same ratio to such amount (determined without regard to this subsection) as—</text>
<clause id="H707E8D0536EB45ABBA4B75D62D310CDC"><enum>(i)</enum><text>the number of days in the calendar year after the date of the individual's death, bears to</text></clause> <clause id="HE402ED7C61BF410B831DBA73F28F4B3C"><enum>(ii)</enum><text>365.</text></clause></subparagraph></paragraph>
<paragraph id="H970FD18C965943FFB5A239FC3FC634D7"><enum>(2)</enum><header>Coordination with estate tax</header><text>For purposes of section 2053, the tax imposed by this section for the year of the decedent's death shall be considered to have been imposed before such death.</text></paragraph></subsection> <subsection id="HF320D33EA74D4618BB142B4175F4927A"><enum>(b)</enum><header>Application to non-Residents</header><text display-inline="yes-display-inline">In the case of any individual who is a non-resident and not a citizen of the United States, this subtitle shall apply only to the property of such individual which is situated in the United States (determined under rules similar to the rules under subchapter B of chapter 11).</text></subsection>
<subsection id="H06457710E20E4EDCB06885420E4A15CC"><enum>(c)</enum><header>Application to covered expatriates</header><text display-inline="yes-display-inline">In the case of an individual who is a covered expatriate (as defined in section 877A), section 2901(a) shall be applied—</text> <paragraph id="HA217FD038258484FBA5F5ABDDA3C5661"><enum>(1)</enum><text display-inline="yes-display-inline">as if the calendar year ended on the day before the expatriation, and</text></paragraph>
<paragraph id="H586976CA59ED4EE081ABF3C6245D74A9"><enum>(2)</enum><text>as if the rate of tax under both subparagraphs (A) and (B) of section 2901(b)(1) were 40 percent.</text></paragraph></subsection></section> <section id="HB68EF96D329045D8848DE929B1C35084"><enum>2904.</enum><header>Information reporting</header> <subsection id="H342B4A6F967845E88CBC06CCFA25E1C2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 12 months after the date of the enactment of this section, the Secretary shall by regulations require the reporting of any information concerning the net value of assets appropriate to enforce the tax imposed by this chapter.</text></subsection>
<subsection id="H2B589B4AFD0B4D849DCC61E5D38BCF25"><enum>(b)</enum><header>Method of reporting</header><text>The Secretary shall, where appropriate, require the reporting made under subsection (a) to be made as a part of existing income reporting requirements (including requirements under chapter 4 (relating to taxes to enforce reporting on certain foreign accounts)).</text></subsection> <subsection id="HEEAB919FC33B4306848EFA1DC2CBBA4D"><enum>(c)</enum><header>Responsibility for reporting</header><text>The Secretary may impose reporting obligations by reference to the ownership, control, management, claim to income from, or other relationship to assets and liabilities for purposes of administering the tax imposed by this section and may impose such obligations on financial institutions, business entities, or other persons, including requiring business entities to provide estimates of the value of the entity itself. </text></subsection></section>
<section id="H755F4BF752CD40BBB6F43AEA472B882A"><enum>2905.</enum><header>Enforcement</header><text display-inline="no-display-inline">The Secretary shall annually audit not less than 30 percent of taxpayers required to pay the tax imposed under this chapter.</text></section></chapter></subtitle><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection commented="no" id="H09BA9F0401624B8CBC9495F98E60BCB7"><enum>(b)</enum><header>No deduction from income taxes</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/275">Section 275</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after paragraph (6) the following new paragraph:</text>

<paragraph commented="no" id="H49F44B33D604461FAEA7D44603623C57"><enum>(7)</enum><text>Taxes imposed by chapter 18.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H42B5E2D866ED4B6B9708769C54AE52A8"><enum>(c)</enum><header>Extension of time for payment of tax</header> <paragraph id="HBD3AC3A8F2FB4A8490E6172BBCDAF72A"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/6161">Section 6161(a)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph:</text>

<paragraph id="H6D5D7068C662448BAA4B16F0024C5F2E"><enum>(3)</enum><header>Wealth tax</header>
<subparagraph id="H78083FD06C4E4C85BB8980987A026BF3"><enum>(A)</enum><header>In general</header><text>In the case of taxpayer described in subparagraph (B), the Secretary may extend the time for payment of the tax imposed under chapter 18 for a reasonable period not to exceed 5 years from the date fixed for the payment thereof.</text></subparagraph> <subparagraph id="HF57BBD7B646844459CB87C906E836209"><enum>(B)</enum><header>Taxpayers described</header><text>A taxpayer is described in this subparagraph if such the Secretary determines—</text>
<clause id="H915D6B4F2AEB442188C53D217E7D28C1"><enum>(i)</enum><text>the taxpayer has severe liquidity constraints, or </text></clause> <clause commented="no" display-inline="no-display-inline" id="HB781655B63DD4CDAB1F8D81634FE73E2"><enum>(ii)</enum><text>immediate payment would cause undue hardship on an ongoing enterprise.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>
<paragraph id="H2B207B9C887741678B50FC0F2B51D17C"><enum>(2)</enum><header>Rules</header><text>Not later than 12 months after the date of the enactment of this Act, the Secretary of the Treasury (or the Secretary's delegate) shall establish rules for the application of the amendments made by paragraph (1).</text></paragraph></subsection> <subsection id="HF2DA0068F4D04C1D986A41882251FEEE"><enum>(d)</enum><header>Application of accuracy related penalties</header> <paragraph id="HB7AAD0BA855F419F85118991AF0F79BD"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/6662">Section 6662(b)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph:</text>

<subsection id="H25FB1770E24D482C9D007DBE6B9E372D"><enum>(n)</enum><header>Application to substantial wealth tax valuation understatement</header>
<paragraph id="H359C60EDB50446E89669970E43E24540"><enum>(1)</enum><header>Substantial wealth tax valuation understatement defined</header>
<subparagraph id="H75772B29741E4668AAB1CE82F50941E6"><enum>(A)</enum><header>In general</header><text>For purposes of this section, there is a substantial wealth tax valuation understatement if the value of any property claimed on any return of tax imposed by subtitle B–1 is 65 percent or less of the amount determined to be the correct amount of such valuation.</text></subparagraph> <subparagraph id="H0FD1626100A444D68C78483293FCEF0E"><enum>(B)</enum><header>Limitation</header><text>No penalty shall be imposed by reason of subsection (b)(11) unless the portion of the underpayment attributable to substantial wealth tax valuation understatements for the calendar year exceeds $5,000.</text></subparagraph></paragraph>
<paragraph id="H3C092E127071473088F0F021ACD6FCB7"><enum>(2)</enum><header>Increased penalty</header>
<subparagraph id="HCA15EEAC1D3B4F47BAD5C6CB65A6C219"><enum>(A)</enum><header>In general</header><text>In the case of any portion of an underpayment which is attributable to one or more substantial wealth tax valuation understatement, subsection (a) shall be applied—</text> <clause id="H90CE3BD0A48B4D878683941D448D3D3E"><enum>(i)</enum><text>in the case of a substantial wealth tax valuation understatement which is a gross wealth tax valuation misstatement, by substituting <quote>50 percent</quote> for <quote>20 percent</quote>, and</text></clause>
<clause id="H038776D192AE474597A9677EC4163092"><enum>(ii)</enum><text>in any other case, by substituting <quote>30 percent</quote> for <quote>20 percent</quote>.</text></clause></subparagraph> <subparagraph id="H4FCC6FD3E02E42BA960EB9CEFCEEC85F"><enum>(B)</enum><header>Gross wealth tax valuation misstatement</header><text>For purposes of subparagraph (A), the term <term>gross wealth tax valuation misstatement</term> means a substantial wealth tax valuation understatement, as determined under paragraph (1) by substituting <quote>40 percent</quote> for <quote>65 percent</quote>.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="HB0F787A88BCA45C3892EEA614B095B91"><enum>(e)</enum><header>Clerical amendment</header><text>The table of subtitles of such Code is amended by inserting after the item relating to subtitle B the following new item:</text> <quoted-block style="OLC" id="H783AE7651A27425BB08A620FF3EB645D"> <toc> <toc-entry level="subtitle">Subtitle B–1—Wealth tax</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H17A0FA592E7F4CAD8A469869080758D7"><enum>(f)</enum><header>Effective date</header><text>The amendments made by this section shall apply to calendar years beginning after December 31, 2026.</text></subsection>
<subsection id="H9C78B78B756C445FBB6805AD677CF376"><enum>(g)</enum><header>Periodic reports</header><text>Not later than January 1, 2029, and every 2 years thereafter, the Secretary of the Treasury (or the Secretary's delegate) shall submit to Congress a report on the tax imposed under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/18">chapter 18</external-xref> of the Internal Revenue Code of 1986 (as added by this Act), including any issues related to the administration and enforcement of such tax.</text></subsection></section> <section id="HEA4718DABD21471EAAC73D52FBD66E4A"><enum>3.</enum><header>Strengthening disclosure requirements</header> <subsection id="HD555A1B97F6640238C7AE983A31E5554"><enum>(a)</enum><header>Regulatory authority</header><text>The Secretary of the Treasury (or the Secretary's delegate) may issue such rules and regulations as necessary to prevent taxpayers from avoiding the purpose of information reporting requirements under the Internal Revenue Code of 1986 by placing assets in any foreign corporation, partnership, or trust in which the taxpayer holds directly or indirectly, a significant interest as the sole or principal owner or the sole or principal beneficial owner. </text></subsection>
<subsection id="H492E305F28F7415A9525D07885C0CD9E"><enum>(b)</enum><header>FATCA enforcement plan</header><text display-inline="yes-display-inline">The Secretary of the Treasury (or the Secretary's delegate) shall develop a comprehensive plan for managing efforts to leverage data collected under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/4">chapter 4</external-xref> of the Internal Revenue Code of 1986 in agency compliance efforts. Such plan shall include an evaluation of the extent to which actions being undertaken as of the date of the enactment of this Act for the enforcement of the requirements of such chapter improve voluntary compliance and address noncompliance with such requirements.</text></subsection></section> <section commented="no" id="HF47117673F4F4FD4992A9A9969F93F01"><enum>4.</enum><header>Internal Revenue Service funding</header> <subsection commented="no" id="HBB965D556B934EC2A10E9747CC454879"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/80">chapter 80</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text>
