<section id="HD8CBE71B19474F47969883F1FAF7AB20" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Real-time Exploitation and Deceptive Insider Congressional Trading Act</short-title></quote> or the <quote><short-title>PREDICT Act</short-title></quote>.</text></section> <section id="H46E1B1EB35D946A2B6AF0AB6DCEE9DFD"><enum>2.</enum><header>Restrictions on trading on prediction markets</header> <subsection id="HAF10FE282C864BD3B06D575DE6FC6414"><enum>(a)</enum><header>Restrictions</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/131">Chapter 131</external-xref> of title 5, United States Code, is amended by adding at the end a new subchapter:</text>

<subchapter id="HB24C3D2C5D1D4A3B800F2789D70EF5E9"><enum>IV</enum><header>Restrictions on trading on prediction markets</header> 
<section id="HBB6E5EB3136045A9A0B4C9A0967F8DB6"><enum>13151.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter:</text> <paragraph id="H2E5DAAC2A7FC49E19F883F395E7DDD59"><enum>(1)</enum><header>Covered individual</header><text display-inline="yes-display-inline">The term <term>covered individual</term> means any of the following:</text> 
<subparagraph id="H9FCBEE3ACE82436F93BE4F5AB1042A79" commented="no"><enum>(A)</enum><text>A Member of Congress as defined in section 13101 of this title.</text></subparagraph> <subparagraph id="HE37DB528D01F42E7B57DC955970CB007" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">A dependent child as defined in such section 13101 or a spouse of a Member of Congress.</text></subparagraph> 
<subparagraph id="HB205F75FD0B646E7877039CDBC20F032"><enum>(C)</enum><text>An individual or entity with fiduciary duties and the authority to enter into or offer to enter into an agreement, contract, or transaction with respect to prediction markets for any individual described in subparagraphs (A) or (B).</text></subparagraph> <subparagraph id="H639EA0F3E6B742D39847045A120AB81F"><enum>(D)</enum><text display-inline="yes-display-inline">An officer or employee of the Congress as defined in such section 13101.</text></subparagraph> 
<subparagraph id="H8A8F3ED4282E46ADA5A1E5204039FDB5"><enum>(E)</enum><text>The President.</text></subparagraph> <subparagraph id="HB1B2876E37914BDA8455B943C53E58FF"> <enum>(F)</enum> <text>The Vice President.</text>
                                </subparagraph> 
<subparagraph id="H0E8F62CFFE4E40FAA8CA34795B85D337">
                                    <enum>(G)</enum>
 <text display-inline="yes-display-inline">A political appointee.</text>
                                </subparagraph> 
<subparagraph id="HE9360B3BAEBE4BE9A07018F60624610B"><enum>(H)</enum><text display-inline="yes-display-inline">Each officer or employee in the executive branch, including a special Government employee, as defined in section 202 of title 18, and any officer or employee of an independent agency, who occupies a position classified above GS–15 of the General Schedule or, in the case of positions not under the General Schedule, for which the rate of basic pay is equal to or greater than 120 percent of the minimum rate of basic pay payable for GS–15 of the General Schedule; each member of a uniformed service whose pay grade is at or in excess of O–7 under section 201 of title 37; and each officer or employee in any other position determined by the Director of the Office of Government Ethics to be of equal classification.</text></subparagraph> <subparagraph id="HA4A0CC0E1B04491A8B060C0D859D4EA1"><enum>(I)</enum><text display-inline="yes-display-inline">A judicial officer as defined in section 13101 of this title.</text></subparagraph> 
<subparagraph id="HDFF7186306B04028B93FDCF002A92607"><enum>(J)</enum><text display-inline="yes-display-inline">A judicial employee as defined in section 13101 of this title.</text></subparagraph></paragraph> <paragraph id="HBFAAA00C6BB54543AFD2BD5D5AA3E0D3"><enum>(2)</enum><header>Independent agency</header><text display-inline="yes-display-inline">The term <term>independent agency</term> has the meaning given the term <term>independent establishment</term> as defined in section 104 of this title. </text></paragraph> 
<paragraph id="HFCC315397EAD43C58E71D0933D6C5C66"><enum>(3)</enum><header>Political appointee</header><text display-inline="yes-display-inline">The term <term>political appointee</term> means an individual—</text> <subparagraph id="HC81645F8B96F4598B6F21BBCC56EC80B"><enum>(A)</enum><text>occupying a position described under sections 5312 through 5316 of this title (relating to the Executive Schedule);</text></subparagraph> 
<subparagraph id="H4BB50C62828D42BA8212747A5ECAF3AD"><enum>(B)</enum><text>serving under a noncareer appointment in the Senior Executive Service, as defined under paragraph (7) of section 3132(a) of this title; or</text></subparagraph> <subparagraph id="H22722803BD864D45A15AE202827A6DE6"><enum>(C)</enum><text>occupying a position in the executive branch of the Government of a confidential or policy-determining character under schedule C of subpart C of part 213 of title 5, Code of Federal Regulations.</text></subparagraph></paragraph> 
<paragraph id="HD1378803D7D14D70B5A6235D0543399E"><enum>(4)</enum><header>Supervising ethics office</header><text>The term <term>supervising ethics office</term>—</text> <subparagraph id="HA5716845FEFE4761830F16A0BF8C61BE"><enum>(A)</enum><text>has the meaning given the term in section 13101 of this title; and</text></subparagraph> 
<subparagraph id="H7A3B7B353B9146D3915F42B55FEC4ECC"><enum>(B)</enum><text>in the case of an independent agency, means the Office of Government Ethics.</text></subparagraph></paragraph></section> <section id="H2FCA12211A3A4FF999140A01B3421C44"><enum>13152.</enum><header>Trading on prediction markets</header> <subsection id="H9E1ACEF3334C44F9A3BB7ED70A95A502" display-inline="no-display-inline"><enum>(a)</enum><header>Conduct during Federal service</header><text display-inline="yes-display-inline">No covered individual may enter into, or offer to enter into an agreement, contract, or transaction that provides for any purchase, sale, payment, or delivery that is dependent on the occurrence, nonoccurrence, or the extent of the occurrence of a specific political event.</text></subsection> 
<subsection id="HE946593B47534A80BED272A31C8A6880"><enum>(b)</enum><header>Interpretative guidance</header><text>The supervising ethics office shall issue interpretive guidance on any relevant term not defined in this subchapter.</text></subsection></section> <section id="H2A4B8DEC180040FBB941F4AAE176208E"><enum>13153.</enum><header>Penalties</header> <subsection id="HEAD9161ADE7C481E904183BD99BBE9CA" commented="no"><enum>(a)</enum><header>In general</header> <paragraph id="H506924F5A8A54DB3A11D8C632EFA8B81"><enum>(1)</enum><header>Penalties</header><text>Any covered individual who violates the restrictions in section 13152 of this title shall, at the direction of the supervising ethics office—</text> 
<subparagraph id="HC4C07B20D71B4755B849EDD8D283D104"><enum>(A)</enum><text display-inline="yes-display-inline">pay a fee equal to ten percent of the value of the agreement, contract, or transaction in violation; and</text> </subparagraph> <subparagraph id="H8D932DF285914735A34FD5EFE5C0EEEA"><enum>(B)</enum><text display-inline="yes-display-inline">disgorge the profits of any agreement, contract, or transaction that violates the provisions of such section 13152.</text></subparagraph></paragraph> 
<paragraph id="H302C0C1E7B2A468BBEDD54552306B5A9"><enum>(2)</enum><header>Payment of penalty to Treasury</header><text display-inline="yes-display-inline">A penalty imposed under paragraph (1)(B) shall be payable into the Treasury.</text></paragraph></subsection> <subsection id="HC0BDDD2886284C5D8C0ED9B3892C1131"><enum>(b)</enum><header>Payment restrictions</header><text display-inline="yes-display-inline">A covered individual may not pay any of the penalties under this section from the following sources:</text> 
<paragraph id="H36E1D569E6814CF2BF8CA8D1BF5CF007"><enum>(1)</enum><text>The Members’ Representational Allowance.</text></paragraph> <paragraph id="H069A2AA9374448D7BC8454A190D55297"><enum>(2)</enum><text display-inline="yes-display-inline">The Senators’ Official Personnel and Office Expense Account.</text></paragraph> 
<paragraph id="H7E0F651CB6194C3E8D7F1D1066EE43EE"><enum>(3)</enum><text display-inline="yes-display-inline">Any contribution (as defined in section 301(8) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30101">52 U.S.C. 30101(8)</external-xref>)) accepted as a candidate, and any other donation received as support for activities of the individual as a holder of Federal office.</text></paragraph> <paragraph id="H5EDBDD2602BE41A5A5CDBBED4E93403E"><enum>(4)</enum><text>Any other source of funds, other than a salary, available to such individual through employment or service in the Federal Government.</text></paragraph></subsection> 
<subsection id="H419E594AB69D4010AD62529F60CC2A63"><enum>(c)</enum><header>Publication</header><text>Each supervising ethics office shall publish on a publicly available website a description of—</text> <paragraph id="HD0DC889A9D604986AD3FDEC2D4E1E7EA"><enum>(1)</enum><text>each fine assessed by the supervising ethics office pursuant to this section;</text></paragraph> 
<paragraph id="H20F9C37F25794F078E4E0C35919FD6FC"><enum>(2)</enum><text>the reason why each such fine was assessed; and</text></paragraph> <paragraph id="H465F65F20A214A669878EC57877ACE98"><enum>(3)</enum><text>the result of each assessment.</text></paragraph></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
