<section id="HA48C4A31911A42AF8C2A3C58919CA384" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Career Criminal Accountability Act of 2026</short-title></quote>.</text></section> <section id="H057F38AC5C9948628B3451E7149B2245"><enum>2.</enum><header>Imposition of a sentence</header><text display-inline="no-display-inline">Section 3553(a) of title 18, United States Code, is amended by striking <quote>The court shall impose</quote> and inserting <quote>Except as otherwise provided in section 3559A, the court shall impose</quote>.</text></section> 
<section id="H091616F6BCC34DA09F0AA80D56C07268"><enum>3.</enum><header>Three strikes offenders</header><text display-inline="no-display-inline">Subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/227">chapter 227</external-xref> of title 18, United States Code, is amended—</text> <paragraph id="HD599ACCAE5D74B7688172F712489A1B9"><enum>(1)</enum><text>by adding at the end the following:</text>

                        <enum>3559A.</enum>
                        <header>Three strikes offenders</header>
                        <subsection id="H00FC332B663A408582FE6C69328F19C1">
                            <enum>(a)</enum>
                            <header>In general</header>
 <text display-inline="yes-display-inline">In determining the appropriate sentence for a defendant, the sentencing judge shall determine whether the defendant is required to be sentenced as a three-strikes offender, as defined in subsection (b), and shall sentence said defendant in accordance with this section.</text>
                        </subsection>
                        <subsection id="HBF8830E4BA044F538CAD6F0F000F53E7">
                            <enum>(b)</enum>
                            <header>Strike counts</header>
 <text display-inline="yes-display-inline">In determining whether the defendant is required to be sentenced as a three-strikes offender, the court shall determine the number of strikes accrued by the defendant according to the following:</text>
                            <paragraph id="HF902BDA67EDE4D54B2B9CF8853A772AA">
                                <enum>(1)</enum>
 <text display-inline="yes-display-inline">Any conviction for a strike-eligible misdemeanor, set forth in subparagraphs (A) through (C) of subsection (e)(2), shall count as one-quarter (¼) strike.</text>
                            </paragraph>
                            <paragraph id="HF22977C6F2C5429CBAF90DFFD59B58E1">
                                <enum>(2)</enum>
 <text display-inline="yes-display-inline">Any conviction for a strike-eligible nonviolent felony, set forth in subparagraphs (D) through (T) of subsection (e)(2), shall count as one-half (½) strike.</text>
                            </paragraph>
                            <paragraph id="HD54AE7084E2249C8982627453752073D">
                                <enum>(3)</enum>
 <text display-inline="yes-display-inline">Any conviction for a strike-eligible firearm-related felony, set forth in subparagraphs (U) through (FF) of subsection (e)(2), shall count as one (1) strike.</text>
                            </paragraph>
                            <paragraph id="HA108B2F295514D0AA342F5C59425F8A6">
                                <enum>(4)</enum>
 <text display-inline="yes-display-inline">Any conviction for a strike-eligible violent felony, set forth in subparagraphs (GG) through (JJJ) of subsection (e)(2), shall count as one (1) strike.</text>
                            </paragraph>
                            <paragraph id="H38800C5A86FA4AFC86ABE2C9F2F7767D">
                                <enum>(5)</enum>
 <text>A defendant shall not accrue any strikes for any misdemeanor convictions for offenses committed while the defendant was a juvenile.</text>
                            </paragraph>
                            <paragraph id="H61B34340EDA74EE79AB599F2414C7177">
                                <enum>(6)</enum>
 <text>Any convictions for strike-eligible nonviolent or firearm-related felony offenses in cases in which the defendant was a juvenile shall result in the accrual of only one-quarter (¼) strike.</text>
                            </paragraph>
                            <paragraph id="H131C24898E19463096CD96D5BEEDB07A">
                                <enum>(7)</enum>
 <text>Any convictions for strike-eligible violent felony offenses in cases in which the defendant was a juvenile shall result in the accrual of only one-half (½) strike.</text>
                            </paragraph>
                        </subsection>
                        <subsection id="H080F5BCEF4B14F26A6F736B9CE12F421">
                            <enum>(c)</enum>
                            <header>Enhanced sentences</header>
 <text display-inline="yes-display-inline">A three-strikes offender shall—</text>
                            <paragraph id="H61FB324ADC6D4EDB8C109FAF419310FB">
                                <enum>(1)</enum>
 <text>have a consecutive sentence of 10 years imprisonment added to the sentence for the offenses of which the defendant was convicted if the most serious underlying offense in the instant case is a nonviolent felony set forth in subparagaphs (D) through (T) of subsection (e)(2);</text>
                            </paragraph>
                            <paragraph id="HE096CA93DD184E28A7A5681B9EF16053">
                                <enum>(2)</enum>
 <text display-inline="yes-display-inline">have a consecutive sentence of 15 years imprisonment added to the sentence for the offenses of which the defendant was convicted if the most serious underlying strike-eligible offense in the instant case is a firearm-related felony set forth in subparagraphs (U) through (FF) of subsection (e)(2); and</text>
                            </paragraph>
                            <paragraph id="H1A1A262716914ABAA46D78F6D73D2382">
                                <enum>(3)</enum>
 <text>have a consecutive sentence of life imprisonment added to the sentence for the offenses of which the defendant was convicted if—</text>
                                <subparagraph id="HE35898D1BFC74260B7B90082B37BCAA0">
                                    <enum>(A)</enum>
 <text display-inline="yes-display-inline">the most serious underlying offense in the instant case is a violent felony set forth in subparagraphs (GG) through (JJJ) of subsection (e)(2);</text>
                                </subparagraph>
                                <subparagraph id="H3D4055FD900340FD900D5401257A6BFD">
                                    <enum>(B)</enum>
 <text>the defendant has been convicted of strike-eligible offenses on at least two prior occasions; </text>
                                </subparagraph>
                                <subparagraph id="HE8C94BC619F1424183CC8EEC70830571">
                                    <enum>(C)</enum>
 <text>at least three of the defendant’s strikes stem from convictions for strike-eligible felony offenses; and</text>
                                </subparagraph>
                                <subparagraph id="H698B01BB26D440939403C66804FF81EB">
                                    <enum>(D)</enum>
 <text display-inline="yes-display-inline">a 20-year consecutive sentence added if the most serious underlying offense in the instant case is a violent felony set forth in subparagraphs (X) through (VV) of subsection (e)(2), and the defendant has been convicted of strike-eligible offenses on at least two prior occasions, but fewer than three of the defendant’s strikes stem from convictions for strike-eligible felony offenses.</text>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                        <subsection id="H04B7EAEBC13B4A7AA29E56C792F6F7CD">
                            <enum>(d)</enum>
                            <header>Prohibition on Misdemeanor-Triggered Enhancements</header>
 <text display-inline="yes-display-inline">A defendant who reaches or surpasses the three-strikes threshold due to an instant conviction of a strike-eligible misdemeanor shall not be eligible for a sentencing enhancement under this section until said defendant is subsequently convicted of a felony, such that no sentencing enhancement shall be applied to sentences for misdemeanor convictions.</text>
                        </subsection>
                        <subsection id="HFBC3335A34DF45E1A05BD640EF063D7E">
                            <enum>(e)</enum>
                            <header>Definitions</header>
 <text>For purposes of this section:</text> <paragraph id="H8D11688AE377441F89140F7C68E7532D"> <enum>(1)</enum> <header>Three-Strikes Offender</header> <text display-inline="yes-display-inline">The term <term>three-strikes offender</term> means a defendant if—</text>
                                <subparagraph id="H17774C78B60F42A0993AB1E370FB6A36">
                                    <enum>(A)</enum>
 <text>the instant strike-eligible offense of which the defendant is convicted constitutes an offense set forth in subparagraphs (D) through (JJJ) of paragraph (2); and</text>
                                </subparagraph>
                                <subparagraph id="H832054E3DA3E409DB617988DC84BCC99">
                                    <enum>(B)</enum>
 <text>the defendant has, inclusive of the conviction for the instant offense and accounting for desistance credits, accrued three (3) or more strikes through prior convictions. </text>
                                </subparagraph>
                                <continuation-text continuation-text-level="paragraph">A defendant
                                    may not be deemed a three-strikes offender if all the
                                    defendant’s strikes are the result of convictions in one or more
                                    cases stemming from a single episode of criminal action. If all
                                    the defendant’s strikes are the result of convictions stemming
                                    from two episodes of criminal action, each episode must include
                                    at least one (1) strike-eligible felony conviction for the
                                    defendant to be deemed a three-strikes
                                    offender.</continuation-text>
                            </paragraph>
                            <paragraph id="H54C4DE0246174475BDDDDB809D06E715">
                                <enum>(2)</enum>
                                <header>Strike-Eligible Offenses</header>
 <text>The term <term>strike eligible offense</term> means any of the following (and includes, with regard to each offense, any attempt or conspiracy to commit the offense):</text>

                                    <enum>(A)</enum>
 <text>Section 404 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/844">21 U.S.C. 844</external-xref>).</text>
                                </subparagraph>
                                <subparagraph id="H5A5A236008A44E36A662331A3A028451">
                                    <enum>(B)</enum>
 <text>Section 873 of title 18, United States Code.</text> </subparagraph> <subparagraph id="H206D244153264F3893913E5049A37496"> <enum>(C)</enum> <text>Any State-level misdemeanor unlawful possession of a firearm offense.</text>
                                </subparagraph>

 <text>The term <term>single episode of criminal action</term> means an event or continuous series of events related to the furtherance of a single criminal act, excluding the defendant’s violent resistance of any law-enforcement officer or citizens acting lawfully in defense of themselves or another that proximately causes death or serious bodily harm to the officer, citizen, or any other person.</text>
