<section section-type="section-one" id="H9EC74BA842984ECD95F1410C8EC07C15"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening Place-based Access, Resources, and Knowledge Act</short-title></quote> or the <quote><short-title>SPARK Act</short-title></quote>.</text></section> <section id="H6C63CA4F2D8B4E38A53017436BD49352"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
<paragraph id="H6B4DEEEC9FC3435A9C752D1747A4039B"><enum>(1)</enum><text>Studies have found that incubators, accelerators, and other similar models are effective at increasing revenues, the number of employees, and the likelihood that the business venture will be successful for participants.</text></paragraph> <paragraph id="H9802C1312B0E45FA8B2D9ACDC49F4B79"><enum>(2)</enum><text>According to the 2023 Report on Startup Firms Owned by People of Color: Findings from the 2022 Small Business Credit Survey—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HBC24E38F5BFC443491A62FF44B134C27"><enum>(A)</enum><text display-inline="yes-display-inline">startups owned by racial minorities are more than twice as likely to be denied for financing from lenders than non-minority-owned startups; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H6CA9576699FD4AAB910941B02FCE77C3"><enum>(B)</enum><text>mission-oriented financial institutions and community-based lenders, including minority depository institutions and community development financial institutions, are critical in helping minority-owned businesses access capital.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H32FA936F0F99458A92314034F606BAAD"><enum>(3)</enum><text display-inline="yes-display-inline">According to the Kauffman Foundation—</text> <subparagraph id="H7933F1A8E4CE402F99E9F3DC4440376E"><enum>(A)</enum><text>minority-owned and women-owned businesses are half as likely to have workers than non-minority-owned and men-owned businesses; and</text></subparagraph>
<subparagraph id="H306BB593C0A340E1928F73AEA4E22AD9"><enum>(B)</enum><text>if minorities started businesses at the same rate as non-minorities, approximately 9,500,000 jobs would be added to the economy of the United States.</text></subparagraph></paragraph> <paragraph id="HFD8275736DD446439C38D3DA31AF80BB"><enum>(4)</enum><text>According to the Center for Rural Innovation—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H0C45E2BBDE9449939A78D688150CB7F8"><enum>(A)</enum><text display-inline="yes-display-inline">less than 1 percent of all venture capital funding goes to businesses located in rural areas;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H86ED1517A46643B99CB8869E91327765"><enum>(B)</enum><text>rural entrepreneurship rates have fallen from 20 percent in the 1980s to just more than 12 percent in the 2010s; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H6502A06AE5494130860AA8155C495549"><enum>(C)</enum><text>financial barriers in rural areas are especially prominent for minority populations.</text></subparagraph></paragraph> <paragraph id="H932B35771B224EE59E48545E47A4E359"><enum>(5)</enum><text>According to PitchBook, only 2 percent of all venture capital funding goes to businesses with women founders.</text></paragraph>
<paragraph id="HED72212C778540728F8382204B1EADEA"><enum>(6)</enum><text>According to Crunchbase, less than 3 percent of all venture capital funding goes to businesses with Black and Hispanic founders.</text></paragraph></section> <section id="HCEBC7D40E69C4F65AA467857A81E203F"><enum>3.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of the Spark Program established under section 49 of the Small Business Act, as amended by this Act, are to—</text>
<paragraph id="H05757EF028314A5598CD923ADD5F415E"><enum>(1)</enum><text>spur economic growth in underserved communities by creating good paying jobs and increasing access to capital;</text></paragraph> <paragraph id="HCAAAB479596F4B808B36C4195A0E2EDB"><enum>(2)</enum><text>increase prospects for success for small business concerns in underserved communities, which often suffer from higher business failure rates than the national average;</text></paragraph>
<paragraph id="H15A4210DCAD14915882D8E5B8CF6F88E"><enum>(3)</enum><text>create a pipeline for individuals in underserved and rural markets into small business ownership;</text></paragraph> <paragraph id="H1634107AD58443BF8A49F66C645D6173"><enum>(4)</enum><text>close the gaps that underserved small business concerns often have in terms of revenue and number of employees, which represent lost opportunity for the economy of the United States;</text></paragraph>
<paragraph id="H2EAD325DF6F84669AB017C3D9D7499FA"><enum>(5)</enum><text>encourage collaboration between the Small Business Administration and organizations that serve low-income, minority, and rural communities; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HC84A43D640894BE9936A215D81839E82"><enum>(6)</enum><text>grow existing incubators and accelerators that are focused on empowering underserved communities and entrepreneurs.</text></paragraph></section>
<section id="H328EA83D285A4A129229DEF563CFBD2D"><enum>4.</enum><header>Spark Program</header><text display-inline="no-display-inline">The Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631 et seq.</external-xref>) is amended—</text> <paragraph id="HC3D5F8CB8F714C40AAE14709F09060C4"><enum>(1)</enum><text>by redesignating section 49 (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631</external-xref> note) as section 51; and</text></paragraph>
<paragraph id="HD62344D5C66149E5B41244058C6F9C9E"><enum>(2)</enum><text>by inserting after section 48 (<external-xref legal-doc="usc" parsable-cite="usc/15/657u">15 U.S.C. 657u</external-xref>) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H2D27B2268F4B4951943CFF2C9BAB1CA2"> <section id="H33D9AC855E794292BA3FF7DA30CCFA96"><enum>49.</enum><header>Spark Program</header> <subsection id="HD027135B04E64DBBBEFF9BDA553D3368"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
<paragraph id="H3727EE1DD3AB4FBE8CFAF72488BD4A4F"><enum>(1)</enum><header>Accelerator</header><text display-inline="yes-display-inline">The term <term>accelerator</term> means an organization—</text> <subparagraph id="HA2B82026B0F84BDE91230D9F23B4003E"><enum>(A)</enum><text>that—</text>
<clause id="H1D42370C5847477D80F714E5E37FD76B"><enum>(i)</enum><text>works with a startup or growing small business concern for a predetermined period;</text></clause> <clause id="HD3D7156AB37442FEB96E6EC6CBB9230C"><enum>(ii)</enum><text>provides mentorship and instruction to scale businesses; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HB1248E8841A0470BA71E1E1F52C8AB5D"><enum>(iii)</enum><text>increases the investment readiness of small business concerns; and</text></clause></subparagraph> <subparagraph id="HC4C0BCB05543445B8153B7E4A3037CB4"><enum>(B)</enum><text>that may—</text>
<clause id="H051DCF904E784FC58115B068DE547BE1"><enum>(i)</enum><text>provide, but is not exclusively designed to provide, seed investment in exchange for a small amount of equity; and</text></clause> <clause id="H57F1C54C145440C9AC5C810C82ED1303"><enum>(ii)</enum><text>offer startup capital or the opportunity to raise capital from outside investors.</text></clause></subparagraph></paragraph>
<paragraph id="H840458C32CEA4643B66851A542241284"><enum>(2)</enum><header>Eligible entity</header>
<subparagraph commented="no" display-inline="no-display-inline" id="HEEBC49F2877A429CB451ED973F9C78F5"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The term <term>eligible entity</term> means an organization operating, or planning to operate—</text> <clause commented="no" display-inline="no-display-inline" id="H99369DF163DF487B9D70FB17F21FE899"><enum>(i)</enum><text display-inline="yes-display-inline">an accelerator;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HED4ABE93275C4744A50DD6E1B97324F3"><enum>(ii)</enum><text display-inline="yes-display-inline">an incubator; or</text></clause> <clause commented="no" display-inline="no-display-inline" id="H70944347DB8A49288757462DA0FFB496"><enum>(iii)</enum><text display-inline="yes-display-inline">any other small business innovation-focused project, as approved by the Administrator.</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H58C423B19BA04BAFB4FCC2665CB3280A"><enum>(B)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> includes any of the following, if the organization is as described in subparagraph (A):</text> <clause commented="no" display-inline="no-display-inline" id="H6219F837946549E0AC85FACF3D033BB1"><enum>(i)</enum><text>An organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986.</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HC8809347078A4B21AD23397D98107DD3"><enum>(ii)</enum><text>A community development financial institution, as defined in section 103 of the Community Development Banking and Financial Institutions Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4702">12 U.S.C. 4702</external-xref>).</text></clause> <clause commented="no" display-inline="no-display-inline" id="H2FE6FB22E17144E3A6E6318832BC4FEE"><enum>(iii)</enum><text>A minority depository institution, as defined in section 308(b) of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 (<external-xref legal-doc="usc" parsable-cite="usc/12/1463">12 U.S.C. 1463</external-xref> note).</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HDE1629038C2244248CEDB12EBB120B1E"><enum>(iv)</enum><text>A lender under the program established under section 7(m).</text></clause> <clause commented="no" display-inline="no-display-inline" id="HF80FE050C9BC4903A51E7F956FE72DAA"><enum>(v)</enum><text>A development company that is certified under title V of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/695">15 U.S.C. 695 et seq.</external-xref>).</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HA59CD0F33C2D4822B9A53A8E74EE3D07"><enum>(vi)</enum><text>A Community Advantage Small Business Lending Company, as defined in section 120.10 of title 13, Code of Federal Regulations, or any successor regulation.</text></clause> <clause id="HC37DF31268BB4D3CB8AFBC77B36BE0FF"><enum>(vii)</enum><text>An institution described in any of paragraphs (1) through (7) of section 371(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>).</text></clause>
<clause id="H8BCF2C3C04FD4BB1A9917D02DA95474E"><enum>(viii)</enum><text>A junior or community college, as defined in section 312 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1058">20 U.S.C. 1058</external-xref>).</text></clause></subparagraph></paragraph> <paragraph id="H2D9D175D006E4F40BAC499658E6605C0"><enum>(3)</enum><header>Federally recognized area of economic distress</header><text>The term <term>federally recognized area of economic distress</term> means—</text>
<subparagraph id="H44CE9708E74C433286EE7A9652FD7340"><enum>(A)</enum><text>a HUBZone, as that term is defined in section 31(b);</text></subparagraph> <subparagraph id="HF59821F1BB4D4B09A0D00C35F66F4581"><enum>(B)</enum><text>an area that has been designated as—</text>
<clause id="H41460C3588094DCDB7FFA749A79DD590"><enum>(i)</enum><text>an empowerment zone or enterprise community under <external-xref legal-doc="usc" parsable-cite="usc/26/1391">section 1391</external-xref> of the Internal Revenue Code of 1986;</text></clause> <clause id="H858FEBA1DA984D978E97C4DB54360C12"><enum>(ii)</enum><text>a Promise Zone by the Secretary of Housing and Urban Development; or</text></clause>
<clause id="H28F5D2F5E6644C9F9B2FD0FF16560D83"><enum>(iii)</enum><text>a low-income neighborhood or moderate-income neighborhood for purposes of the Community Reinvestment Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/12/2901">12 U.S.C. 2901 et seq.</external-xref>); or</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H6875BCF7E6374A36B5FF6A2DD9CAD084"><enum>(C)</enum><text>any area for which a disaster declaration or determination described in subparagraph (A), (B), (C), or (E) of section 7(b)(2) has been made that has not terminated more than 2 years before the date on which an eligible entity enters into a cooperative agreement with the Administration under this section with respect to the area (or later, as determined by the Administrator), except that, in the case of a major disaster described in subparagraph (A) of section 7(b)(2), that period shall be 5 years.</text></subparagraph></paragraph>
<paragraph id="H309736FDB8C34401AF43E17E684E1C00"><enum>(4)</enum><header>Growing; newly established; startup</header><text>The terms <term>growing</term>, <term>newly established</term>, and <term>startup</term>, with respect to a small business concern, mean growing, newly established, and startup, respectively, within the meanings given those terms under section 7(m).</text></paragraph> <paragraph id="H4E4AD2C29A4C45ABB66F373BE37495AA"><enum>(5)</enum><header>Incubator</header><text>The term <term>incubator</term> means an organization—</text>
<subparagraph id="H980116098DB8475E9B09834361C831B0"><enum>(A)</enum><text>that—</text> <clause id="HC6587C692D8B427A8192411D3EFE3E83"><enum>(i)</enum><text>tends to work with startup and newly established small business concerns; and</text></clause>
<clause id="HB8C32B23E3424B3E90A68ED2234A8636"><enum>(ii)</enum><text>provides mentorship to startup and newly established small business concerns; and</text></clause></subparagraph> <subparagraph id="H4E260BA149BB4028BF41658A991C2F5F"><enum>(B)</enum><text>that may—</text>
<clause id="HE348CD03CCE04B88A86CDDDAFE2A6F90"><enum>(i)</enum><text>provide a co-working environment or a month-to-month lease program; and</text></clause> <clause id="H3339443A2F38481CA0E0AEB4E7CE2AAA"><enum>(ii)</enum><text>work with startups or newly established small business concerns for a predetermined period or an open-ended period.</text></clause></subparagraph></paragraph>
<paragraph id="H3C9C53E4A3104F2C808252421C2D9934"><enum>(6)</enum><header>Individuals with a disability</header><text>The term <term>individuals with a disability</term> means more than 1 individual with a disability, as defined in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>).</text></paragraph> <paragraph id="HB33F81D0050F42BF9575B4D17C28F454"><enum>(7)</enum><header>Rural area</header><text>The term <term>rural area</term> has the meaning given the term in section 7(m)(11).</text></paragraph>
<paragraph id="H43D67EEE06DB4FCDA5E4780DE52CFAE7"><enum>(8)</enum><header>Socially and economically disadvantaged individual</header><text>The term <term>socially and economically disadvantaged individual</term> means a socially and economically disadvantaged individual within the meaning given that term in section 8(d)(3)(C).</text></paragraph></subsection> <subsection id="HC2E9BECCE817487DBB59982DFF88F626"><enum>(b)</enum><header>Establishment</header><text>Not later than 1 year after the date of enactment of the <short-title>Strengthening Place-based Access, Resources, and Knowledge Act</short-title>, the Administrator shall develop and begin implementing a program (to be known as the <quote>Spark Program</quote>) to enter into cooperative agreements with eligible entities under this section.</text></subsection>
<subsection id="H7EFBFA583EEA4D2C91915D91612F5269"><enum>(c)</enum><header>Authority</header>
<paragraph id="HF5A104E85C3F4C6BACADC4FB6F3DC6EE"><enum>(1)</enum><header>In general</header><text>The Administrator may—</text> <subparagraph id="HC486CC5D0DD94E1090DB39E5A9CB628F"><enum>(A)</enum><text>with respect to eligible entities that have submitted applications for such purpose, enter into cooperative agreements to provide financial assistance to those eligible entities to conduct 5-year projects for the benefit of startup, newly established, or growing small business concerns, which may include cooperatives and community land trusts; and</text></subparagraph>
<subparagraph id="H17BFCF482EFD4F2F9D202A09E43EB08F"><enum>(B)</enum><text>renew a cooperative agreement entered into under this section for additional 3-year periods, in accordance with paragraph (3).</text></subparagraph></paragraph> <paragraph id="HC6B16E648FCC482CB8D994381D6449EA"><enum>(2)</enum><header>Project requirements</header><text>A project conducted under a cooperative agreement under this section shall—</text>
<subparagraph id="H0E291BD404094ACABC05A9086F8F7D9E"><enum>(A)</enum><text>be carried out in such locations as to provide maximum accessibility and benefits to the small business concerns that the project is intended to serve;</text></subparagraph> <subparagraph id="HDF817DFEBF6E48D59CB3FD7D46C6A15A"><enum>(B)</enum><text>have a full-time staff, including a full-time director who shall—</text>
<clause id="H21C532BB88514C5DBA427834C723DBBD"><enum>(i)</enum><text>have the authority to make expenditures under the budget of the project; and</text></clause> <clause id="H9F018CADA5EC4B95982E17B149E6FADB"><enum>(ii)</enum><text>manage the activities carried out under the project;</text></clause></subparagraph>
<subparagraph id="HE47F637EAF7449B99520D0B424A6F974"><enum>(C)</enum><text>include the joint provision of programs and services by the eligible entity and the Administration, which—</text> <clause id="HDE648B973D5045FE89DEFBD9D24CA4FF"><enum>(i)</enum><text>shall be jointly developed, negotiated, and agreed upon, with full participation of both parties, pursuant to an executed cooperative agreement between the eligible entity and the Administration; and</text></clause>
<clause id="HF50A52E247AA4487B805B63F808FB900"><enum>(ii)</enum><text>shall include—</text> <subclause id="H9EA02AACD2E14D19BBAD4A77617FE3BC"><enum>(I)</enum><text>one-to-one individual counseling, as described in section 21(c)(3)(A); and</text></subclause>
<subclause id="H03A68574BBAC4774A089B425855FF3B2"><enum>(II)</enum><text>a formal, structured mentorship program;</text></subclause></clause></subparagraph> <subparagraph id="H93DD291688A84D7F839000513725BD31"><enum>(D)</enum><text>incorporate continuous upgrades and modifications to the services and programs offered under the project, as needed to meet the changing and evolving needs of the business community;</text></subparagraph>
<subparagraph id="H637637E3C622418CBD304BFEBB617331"><enum>(E)</enum><text>involve working with underserved groups, which include—</text> <clause id="H14F8EF92273C49A3937CB9E39D34711B"><enum>(i)</enum><text>women;</text></clause>
<clause id="H89C1F6AB2CF941E4AA9ADE48C08D5B29"><enum>(ii)</enum><text>socially and economically disadvantaged individuals;</text></clause> <clause id="HB6D288F21D2146619C3C59080BA98E1C"><enum>(iii)</enum><text>veterans or spouses of veterans;</text></clause>
<clause id="H853A1F4A7BD44D69BFCC86965C71DD81"><enum>(iv)</enum><text>individuals with disabilities;</text></clause> <clause id="HD51A797846064F40B940C5DA2867D8DA"><enum>(v)</enum><text>small business concerns located in rural areas, including startup, newly established, or growing small business concerns located in rural areas;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H872A49DE37794163B30EBE3D33F6520F"><enum>(vi)</enum><text>members of an Indian Tribe individually identified (including parenthetically) in the most recent list published pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>);</text></clause> <clause id="H53AB5219385A4C07A62164DC293CF9E6"><enum>(vii)</enum><text>individuals who have completed a term of imprisonment in a Federal, State, or local jail or prison; or</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HD42C45BE8A06433D964E7754CFF15B09"><enum>(viii)</enum><text>small business concerns, if not less than 50 percent of the employees of the small business concern reside in a low- or moderate-income community;</text></clause></subparagraph> <subparagraph id="H6B32814DF6B14684B1DDE9E940FB2D03"><enum>(F)</enum><text>not impose or otherwise collect a fee or other compensation in connection with participation in the programs and services described in subparagraph (C)(ii); and</text></subparagraph>
<subparagraph id="HE53C79E6797146E595A6B93228D76E08"><enum>(G)</enum><text>ensure that small business concerns participating in the project have access, including through resource partners, to information concerning Federal, State, and local regulations that affect small business concerns.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H82E85A337F3E4295881D19C22DCEDE4A"><enum>(3)</enum><header display-inline="yes-display-inline">Continued funding</header> <subparagraph commented="no" display-inline="no-display-inline" id="HA1E51A29791C4FBEA9091036666F36D1"><enum>(A)</enum><header>In general</header><text>An eligible entity that enters into an initial cooperative agreement, or a renewal of a cooperative agreement, under paragraph (1) may submit an application for a 3-year renewal of the cooperative agreement at such time, in such manner, and accompanied by such information as the Administrator may establish.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H31014D4350664A83A234C78BECBFB102"><enum>(B)</enum><header>Application and approval criteria</header>
<clause id="H2F53F38E23C94003A4739EB0FCC66679"><enum>(i)</enum><header>Criteria</header><text>The Administrator shall develop and publish criteria for the consideration and approval of applications for renewals of cooperative agreements by eligible entities under this paragraph, which shall take into account the structure and the stated goals of the project.</text></clause> <clause id="HFA7A2439379546A6BB14DD62D259737F"><enum>(ii)</enum><header>Notification</header><text>Not later than 60 days after the date of the deadline to submit applications for each fiscal year, the Administrator shall approve or deny any application under this paragraph and notify the applicant for each such application.</text></clause></subparagraph>
<subparagraph id="HDAC3EE4D8E0744519F6AAE3F6B907C93"><enum>(C)</enum><header>Priority</header><text>In allocating funds made available for cooperative agreements under this section, the Administrator shall give applications under this paragraph priority over first-time applications for cooperative agreements under paragraph (1)(A).</text></subparagraph></paragraph> <paragraph id="HE1C396C6CE604928A3054663E7292B50"><enum>(4)</enum><header>Scope of authority</header> <subparagraph id="HCA3E56F02B3249FAB94669BF1D5A9D99"><enum>(A)</enum><header>Subject to appropriations</header><text>The authority of the Administrator to enter into cooperative agreements under this section shall be in effect for each fiscal year only to the extent and in the amounts as are provided in advance in appropriations Acts.</text></subparagraph>
<subparagraph id="H4917742E3B8F49EFB80ACE06B4F73116"><enum>(B)</enum><header>Suspension, termination, and failure to renew or extend</header><text>After the Administrator has entered into a cooperative agreement with an eligible entity under this section, the Administrator may not suspend, terminate, or fail to renew or extend the cooperative agreement unless the Administrator provides the eligible entity with written notification setting forth the reasons for that suspension, termination, or failure and affords the eligible entity an opportunity for a hearing, appeal, or other administrative proceeding under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H056CCF91846E45A0829AB65F385A497E"><enum>(5)</enum><header>Limitation on use of funds</header><text>An eligible entity that has entered into a cooperative agreement under this section may not use any portion of the financial assistance provided under that cooperative agreement to directly provide capital to any participant in any project that is funded with that financial assistance.</text></paragraph></subsection>
<subsection id="HB180FAF72BC14BA482BA0A72A65EB407"><enum>(d)</enum><header>Criteria</header>
<paragraph id="H09F8C60386214EC8AA8063C0177F33A4"><enum>(1)</enum><header>In general</header><text>The Administrator shall—</text> <subparagraph id="HF71B94F963724D01BBBACCC4CDD4365A"><enum>(A)</enum><text>establish and evaluate in terms of relative importance the criteria the Administrator shall use in awarding cooperative agreements under this section, which shall include—</text>
<clause id="HB1A6B4B5D32C4D1E830002EB40780E36"><enum>(i)</enum><text>whether the proposed project will be located in—</text> <subclause id="HA96EC0280075480484562888D05CACBF"><enum>(I)</enum><text>a federally recognized area of economic distress;</text></subclause>
<subclause id="H0A8761292090486DB40728B0299D90BC"><enum>(II)</enum><text>a rural area; or</text></subclause> <subclause id="HD7162A321D834CDA84A7C3345CE51A11"><enum>(III)</enum><text>an area lacking sufficient entrepreneurial development resources, as determined by the Administrator;</text></subclause></clause>
<clause id="H80A7E488078344B18D46B492289B7EE4"><enum>(ii)</enum><text>whether the proposed project demonstrates a commitment, and details a specific plan, to partner with core stakeholders working with small business concerns in the relevant area, including—</text> <subclause id="HCF5C8007E3DC41818D59CDCD3654850C"><enum>(I)</enum><text>investment and lending organizations;</text></subclause>
<subclause id="H04A23BDF314D4F6FA8B7049901073CB7"><enum>(II)</enum><text>nongovernmental organizations;</text></subclause> <subclause id="H12EED890828C4CD88A7628AC60EB41DE"><enum>(III)</enum><text>programs of State and local governments that are concerned with aiding small business concerns;</text></subclause>
<subclause id="HC4E68EC6161F4F9894600B8540FD8DEC"><enum>(IV)</enum><text>Federal agencies, including the Minority Business Development Agency of the Department of Commerce; and</text></subclause> <subclause id="H1367510B8DB04F7F91BB918CD137091A"><enum>(V)</enum><text>for-profit organizations with an expertise in small business innovation;</text></subclause></clause>
<clause commented="no" display-inline="no-display-inline" id="H9F7B7DF948CC40188D1612E484DDB8BD"><enum>(iii)</enum><text>whether the proposed project will serve underserved groups described in subsection (c)(2)(E);</text></clause> <clause commented="no" display-inline="no-display-inline" id="H9B6F47C1A589462683BFACD5C93F9628"><enum>(iv)</enum><text>whether the proposed project is a local, place-based initiative that seeks to engage local communities and consumers; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HAF134C8B2809417BB2DE3AC43BC8EAC1"><enum>(v)</enum><text>whether the proposed project will provide or connect small business concerns with investment, grant-making, or procurement opportunities;</text></clause></subparagraph> <subparagraph id="H1A48F464F6D142B4923A9DC41208A3BE"><enum>(B)</enum><text>make publicly available, including on the website of the Administration, and state in each solicitation for applications for cooperative agreements under this section, the selection criteria and ranking established under subparagraph (A); and</text></subparagraph>
<subparagraph id="HFD66A4F26BCA48D7B1A39C056E533BE7"><enum>(C)</enum><text>evaluate applicants for cooperative agreements under this section in accordance with the selection criteria and ranking established under subparagraph (A).</text></subparagraph></paragraph> <paragraph id="HA8FFD1ED652E49D2B689183E49CDD718"><enum>(2)</enum><header>Contents</header><text>The selection criteria established under paragraph (1)(A) shall consider—</text>
<subparagraph id="HE48CAC9E327248D68DBE60EFBCC23284"><enum>(A)</enum><text>the record of the applicable eligible entity in assisting growing, newly established, and startup small business concerns, including, for each of the 3 full years before the date on which the eligible entity applies for a cooperative agreement under this section (or, if the eligible entity has been in operation for less than 3 years, for the most recent full year the eligible entity was in operation)—</text> <clause id="H7480DDC59C774ED285B2484A54F3AE08"><enum>(i)</enum><text>the number and retention rate of growing, newly established, and startup business concerns in the program of the eligible entity;</text></clause>
<clause id="HA34920A164ED4514A9A246F183238271"><enum>(ii)</enum><text>the average period of participation by growing, newly established, and startup small business concerns in the program of the eligible entity;</text></clause> <clause id="H1BF26C30361049C9B46CCC36EBC4E080"><enum>(iii)</enum><text>the total and median capital raised by growing, newly established, and startup small business concerns participating in the program of the eligible entity;</text></clause>
<clause id="H24153FBE3A5443DBA5C1D3D6211C6C5F"><enum>(iv)</enum><text>the number of investments, grants, or loans received by growing, newly established, and startup small business concerns participating in the program of the eligible entity; and</text></clause> <clause id="H46167B93D9884AA9A5B299BC3DD67B04"><enum>(v)</enum><text>the total and median number of employees of growing, newly established, and startup small business concerns participating in the program of the eligible entity;</text></clause></subparagraph>
<subparagraph id="H5A8DD68E2E514A6FBC03585DE4CFBDAA"><enum>(B)</enum><text>the structure and goals of the applicable project;</text></subparagraph> <subparagraph id="H0E2B8830E3924D4CB4F3FAB9B07C2C58"><enum>(C)</enum><text>ties that the applicable eligible entity has to the business community;</text></subparagraph>
<subparagraph id="HB54E45E3285645C99131C30C2E65B6AA"><enum>(D)</enum><text>the resources available for the applicable project;</text></subparagraph> <subparagraph id="HF94AF384AAA94996AD5B5D5907B8D463"><enum>(E)</enum><text>the capabilities of the applicable project, including coordination with local resource partners and local or national lending partners of the Administration;</text></subparagraph>
<subparagraph id="H1C6A1A8A3A3D4E2CBBCF304493C0F6EC"><enum>(F)</enum><text>the unique business and economic challenges faced by the community in which the applicable eligible entity is located and businesses in that community;</text></subparagraph> <subparagraph id="HE6FEA42E5C0241BCBAE475037EE57C0C"><enum>(G)</enum><text>the proposed budget and plan for use of funds; and</text></subparagraph>
<subparagraph id="H3FEC75B984944344BC2ED3DF678909F4"><enum>(H)</enum><text>any other criteria determined appropriate by the Administrator.</text></subparagraph></paragraph></subsection> <subsection id="H78DC567C292045BC89DF067A22F078B6"><enum>(e)</enum><header>Program examination</header> <paragraph id="H6F1176A636DD4648B3E55020CC380763"><enum>(1)</enum><header>In general</header><text>The Administrator shall—</text>
<subparagraph id="HA7A75DE410F749FBA4BE2503511E5DC2"><enum>(A)</enum><text>develop and implement an annual programmatic and financial examination of each project carried out with financial assistance provided under this section, under which each eligible entity entering into a cooperative agreement under this section shall provide to the Administrator—</text> <clause id="H2EC07F90B4F94D2F9C4242AA0B45F808"><enum>(i)</enum><text>an itemized cost breakdown of actual expenditures for costs incurred during the preceding year; and</text></clause>
<clause id="HFA8C864D25D74C01AE58E6A4123E3FBE"><enum>(ii)</enum><text>documentation regarding the amount of assistance from non-Federal sources obtained and expended by the eligible entity during the preceding year; and</text></clause></subparagraph> <subparagraph id="H0C939B19ED564276A214637DE1B752E2"><enum>(B)</enum><text>analyze the results of each examination conducted under subparagraph (A) and, based on that analysis, make a determination regarding the programmatic and financial viability of each eligible entity.</text></subparagraph></paragraph>
<paragraph id="H2DAAA7D732F84FD3BAC8A9EC6EED64F1"><enum>(2)</enum><header>Conditions for continued funding</header><text>In determining whether to continue or renew a cooperative agreement under this section, the Administrator—</text> <subparagraph id="H6892224FF69D4E719A32EA41CE6CE0E2"><enum>(A)</enum><text>shall consider the results of the most recent examination of the applicable project under paragraph (1); and</text></subparagraph>
<subparagraph id="H52E4C1F8BB3E4C3380E1B500B4392D02"><enum>(B)</enum><text>may terminate or not renew a cooperative agreement, if—</text> <clause commented="no" display-inline="no-display-inline" id="H560D2E1252B745289650899133DF1A45"><enum>(i)</enum><text display-inline="yes-display-inline">the Administrator determines that the applicable eligible entity has failed to provide information required to be provided (including information provided for purpose of the annual report by the Administrator under subsection (l)); or</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H10683A767DBF44FDB56A47DEA95E8C42"><enum>(ii)</enum><text display-inline="yes-display-inline">the information provided by the applicable eligible entity is inadequate.</text></clause></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H4978C3FD3D294FA0B2E9CA6F31FCD25D"><enum>(3)</enum><header>Study and report</header><text>Not later than 2 years after the date of enactment of the <short-title>Strengthening Place-based Access, Resources, and Knowledge Act</short-title>, the Administrator shall—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H9BF0C53DBCAC49D6A855150F107308BB"><enum>(A)</enum><text display-inline="yes-display-inline">conduct a study to determine whether the program examination criteria under this subsection and the reporting requirements under subsection (l) should vary or include other metrics based on the type and location of a project; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H030D3308387848F5AF7D610EF6DD732B"><enum>(B)</enum><text>submit to Congress a report detailing the results of the study conducted under subparagraph (A).</text></subparagraph></paragraph></subsection>
<subsection id="H705809403CDA4FFCA5F26D4FF200151B"><enum>(f)</enum><header>Training and technical assistance</header><text>The Administrator—</text> <paragraph id="H7951A14ABD3D4160A4F3D368123C8A23"><enum>(1)</enum><text>shall provide in-person or online training and technical assistance to each eligible entity entering into a cooperative agreement under this section at the beginning of the participation of the eligible entity in the Spark Program in order to build the capacity of the eligible entity and ensure compliance with procedures established by the Administrator;</text></paragraph>
<paragraph id="HA3BB319933C641E6BEF592554F49F289"><enum>(2)</enum><text>shall ensure that the training and technical assistance described in paragraph (1) is provided at no cost or at a low cost; and</text></paragraph> <paragraph id="H9168862ED8C74FFD928D781F20B402EA"><enum>(3)</enum><text>may enter into a contract to provide the training or technical assistance described in paragraph (1) with 1 or more organizations with expertise in the entrepreneurial development programs of the Administration, innovation, and entrepreneurial development.</text></paragraph></subsection>
<subsection id="HC2BE8AE0632D4B4F97F67D170E86268E"><enum>(g)</enum><header>Coordination</header><text>In carrying out a project with financial assistance provided under this section, an eligible entity may coordinate with—</text> <paragraph id="HE299E77AB7554241B8912A538A47DCFC"><enum>(1)</enum><text>resource and lending partners of the Administration;</text></paragraph>
<paragraph id="H937DBEFC4F3C4A1286C3DA2E4C9D2CFE"><enum>(2)</enum><text>programs of State and local governments that are concerned with aiding small business concerns; and</text></paragraph> <paragraph id="HB67ADED55A5A41A88D5D584AB8C7E1E2"><enum>(3)</enum><text>other Federal agencies, including to provide services to and assist small business concerns in participating in the SBIR and STTR programs, as defined in section 9(e).</text></paragraph></subsection>
<subsection id="HBDFE98E152404682AF0E0F6D0076CC43"><enum>(h)</enum><header>Funding limit</header><text>The amount of financial assistance provided to an eligible entity under a cooperative agreement entered into under this section shall be not less than $500,000 during each year.</text></subsection> <subsection id="HF4A467BA3FCE4AC8B41D2A1ED7341355"><enum>(i)</enum><header>Contract authority</header> <paragraph id="HA32C0256AC7C4AB08BBCF6E07AE771C6"><enum>(1)</enum><header>In general</header><text>An eligible entity that has entered into a cooperative agreement under this section may enter into a contract with a Federal department or agency to provide specific assistance to startup, newly established, or growing small business concerns.</text></paragraph>
<paragraph id="H26E95E8E7D7C45F39D3746D63D96D21C"><enum>(2)</enum><header>Performance</header><text>Performance of a contract entered into under paragraph (1) may not hinder the eligible entity in carrying out the terms of the cooperative agreement under this section.</text></paragraph> <paragraph id="HE92C744903254529852D3179DF415170"><enum>(3)</enum><header>Additional provision</header><text>Notwithstanding any other provision of law, a contract for assistance under paragraph (1) shall not be applied to any Federal department or agency's small business, woman-owned business, or socially and economically disadvantaged business contracting goal under section 15(g).</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H259484ECD16D475BB8E49596C1B9A222"><enum>(j)</enum><header display-inline="yes-display-inline">Privacy requirements</header>
<paragraph commented="no" display-inline="no-display-inline" id="H7851766E401A4EE581B7F0EA206EC4BB"><enum>(1)</enum><header>In general</header><text>An eligible entity may not disclose the name, address, or telephone number of any individual or small business concern receiving assistance under this section without the consent of that individual or small business concern, unless—</text> <subparagraph id="H9E561CF8A4A14B47BAF1C3629F730A3A"><enum>(A)</enum><text>the Administrator is ordered to make such a disclosure by a court in any civil or criminal enforcement action initiated by a Federal or State agency; or</text></subparagraph>
<subparagraph id="H548BBFE9236B4CEFBE8BD1525D4B1B24"><enum>(B)</enum><text>the Administrator considers such a disclosure to be necessary for the purpose of conducting a financial audit of an eligible entity, except that a disclosure under this subparagraph shall be limited to the information necessary for that audit.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H6B32BB76488145B7AA0CD66F08F16E79"><enum>(2)</enum><header>Administration use of information</header><text>This subsection shall not—</text>
<subparagraph id="H07708706722A459F9E2940B11FC23CD5"><enum>(A)</enum><text>restrict Administration access to program activity data; or</text></subparagraph> <subparagraph id="HBB8913577CBC45DC91D2995D26C9E622"><enum>(B)</enum><text>prevent the Administration from using client information (other than the information described in subparagraph (A)) to conduct client surveys.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H7D1B3CD83EAF4D3BA212D43FF01B56D9"><enum>(3)</enum><header>Regulations</header><text>The Administrator shall issue regulations to establish standards for requiring disclosures during a financial audit under paragraph (1)(B).</text></paragraph></subsection> <subsection id="HF9D371F84C4C408292AFFE8E9E300CD5"><enum>(k)</enum><header>Publication of information</header><text>The Administrator shall—</text>
<paragraph id="H078AE23C37ED4BACB7FB44DF511E64C9"><enum>(1)</enum><text>publish information about the program carried out under this section online, including—</text> <subparagraph id="H585B3180BC3048C0BDD155E810011E02"><enum>(A)</enum><text>on the website of the Administration; and</text></subparagraph>
<subparagraph id="H578B8262881D47D29EE3DA4D5275DDE4"><enum>(B)</enum><text>on the social media of the Administration; and</text></subparagraph></paragraph> <paragraph id="HF8F72A8AB6C8458E8692A08A1AF19B90"><enum>(2)</enum><text>request that the resource and lending partners of the Administration and the district offices of the Administration publicize the program carried out under this section.</text></paragraph></subsection>
<subsection id="H0A8776712ECD4814B1C9A2842F9A3FD7"><enum>(l)</enum><header>Annual reporting</header><text>Not later than 1 year after the date on which the Administrator establishes the program under this section, and annually thereafter, the Administrator shall submit to Congress a report on the activities under the program, including—</text> <paragraph id="H8EA14096465E4C2EA2493A305AB25EF5"><enum>(1)</enum><text>the number of startup, newly established, and growing small business concerns participating in the project carried out by each eligible entity under a cooperative agreement entered into under this section (referred to in this subsection as <quote>participants</quote>), including a breakdown of the owners of the participants by race, gender, veteran status, and urban versus rural location;</text></paragraph>
<paragraph id="H40ED9814DFA948C091FA666B4073EC9C"><enum>(2)</enum><text>the retention rate for participants;</text></paragraph> <paragraph id="HC2EE5D7EBD9F4597BD36D610CF9B3094"><enum>(3)</enum><text>the total and median amount of capital accessed by participants, including the type of capital accessed;</text></paragraph>
<paragraph id="HE8F98698363C4754BC492E57C5227F70"><enum>(4)</enum><text>the total and median number of employees of participants;</text></paragraph> <paragraph id="H1B465D47C92941338D7DB28B77509712"><enum>(5)</enum><text>the number and median wage of jobs created by participants;</text></paragraph>
<paragraph id="HF5FCC08B7CB74EF59424E49F4A701CFA"><enum>(6)</enum><text>the number of jobs sustained by participants; and</text></paragraph> <paragraph id="HE7517CC07158426D89F7DCD7D925633E"><enum>(7)</enum><text>information regarding such other metrics as the Administrator determines appropriate, including coordination with other private or public small business assistance programs.</text></paragraph></subsection>
<subsection id="H555546CAB5A142F2863BEF8C078721D5"><enum>(m)</enum><header>Funding</header>
<paragraph id="H6F408BC3238E4BF4A8DF26C3BC05565C"><enum>(1)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as may be necessary to carry out this section.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H86542865F0E94A92B713959AAB0A3D70"><enum>(2)</enum><header>Administrative expenses</header><text display-inline="yes-display-inline">Of the amount made available to carry out this section for any fiscal year, not more than 10 percent may be used by the Administrator for administrative expenses.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="HAD7A788DFD75419DA11CA35F501FE8D0"><enum>5.</enum><header>Spark Financing Program</header><text display-inline="no-display-inline">The Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631 et seq.</external-xref>), as amended by section 4, is amended by inserting after section 49 the following:</text> <quoted-block style="OLC" id="H239984D18D774887B6720E7A81610E3E" act-name=""> <section section-type="subsequent-section" id="H705552503CC34D68A9100A224DF987A9"><enum>50.</enum><header>Spark Financing Program</header> <subsection commented="no" display-inline="no-display-inline" id="H87F3E4756FF2422C8F53DCDD2A407ECB"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text>
<paragraph commented="no" display-inline="no-display-inline" id="HA33E74CAEFB54E73B57A22B9C27B3823"><enum>(1)</enum><header>Covered entity</header><text>The term <term>covered entity</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H92C640A735CA4825AC8B712241DF373B"><enum>(A)</enum><text display-inline="yes-display-inline">an eligible entity; or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H98602EC418134298B32D1A6C8A856600"><enum>(B)</enum><text>solely for the purposes of making loans under subsection (c)(3)(A)(ii), another lender or organization determined appropriate by the Administrator.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H067D925CA30348ED9674C5D272BB67C1"><enum>(2)</enum><header display-inline="yes-display-inline">Covered small business concern</header><text>The term <term>covered small business concern</term> means a small business concern that is—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HFED4D10BD20B4339A0ED51A3CF7AF94D"><enum>(A)</enum><text display-inline="yes-display-inline">owned by an individual that is a member of an underserved group described in section 49(c)(2)(E); or</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H4EF7EA75A4694A26BC9366D4EE426F2E"><enum>(B)</enum><text>located in a federally recognized area of economic distress.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HC4B562D8649B4965A0240C43370A672B"><enum>(3)</enum><header display-inline="yes-display-inline">Eligible entity; federally recognized area of economic distress; growing; newly established; startup</header><text display-inline="yes-display-inline">The terms <term>eligible entity</term>, <term>federally recognized area of economic distress</term>, <term>growing</term>, <term>newly established</term>, and <term>startup</term> have the meanings given those terms in section 49(a).</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="HDA1E9F0FD90F40A6ADEF25038850C30D"><enum>(b)</enum><header>Establishment of program</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>Strengthening Place-based Access, Resources, and Knowledge Act</short-title>, the Administrator shall establish, and thereafter the Administrator shall carry out, a grant and loan program (to be known as the <quote>Spark Financing Program</quote>), under which, in accordance with the requirements of this section, the Administrator shall provide financial assistance to covered entities, which shall use that financial assistance to make grants or loans to covered small business concerns.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H7503CF372804405F9B7A91E68825020A"><enum>(c)</enum><header>Financial assistance to eligible entities</header>
<paragraph commented="no" display-inline="no-display-inline" id="HC4CC66D21DF5436CBA76E4C3D081027D"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator shall provide financial assistance to covered entities under this section as follows:</text> <subparagraph commented="no" display-inline="no-display-inline" id="H8A65AB87A7024EA4B3C05ACD7F546021"><enum>(A)</enum><text display-inline="yes-display-inline">If the covered entity has entered into a cooperative agreement under section 49—</text>
<clause commented="no" display-inline="no-display-inline" id="H765D5198770C439C8CA2A6D5DC7EF2E3"><enum>(i)</enum><text display-inline="yes-display-inline">the amount of financial assistance provided under this section shall be not more than $1,000,000 per year; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="H55861C7463DF42F1923AA66D84E7334C"><enum>(ii)</enum><text display-inline="yes-display-inline">the entity—</text>
<subclause commented="no" display-inline="no-display-inline" id="H821AF8B3A1FE40CBA440AF7BBD69A115"><enum>(I)</enum><text display-inline="yes-display-inline">shall receive financial assistance under this section at the same time that the covered entity receives financial assistance pursuant to that cooperative agreement under section 49; and</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="H8BAA148E735E4F978A3E030125BC7013"><enum>(II)</enum><text>shall not be required to reapply for funding under this section on an annual basis.</text></subclause></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HBE83755A23F74232823446E413EE6E1E"><enum>(B)</enum><text display-inline="yes-display-inline">If the covered entity has not entered into a cooperative agreement under section 49—</text> <clause commented="no" display-inline="no-display-inline" id="H637D3B3BB77F45049A13540E2CC62719"><enum>(i)</enum><text display-inline="yes-display-inline">the amount of financial assistance provided under this section shall be not more than $500,000 per year; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HE59DE34A7C494BCA9AA47C31EAC744A5"><enum>(ii)</enum><text display-inline="yes-display-inline">the covered entity shall reapply for financial assistance under this section on an annual basis.</text></clause></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H0ECF22E7852445A8AD382C7B9DC5D806"><enum>(2)</enum><header>Application</header> <subparagraph commented="no" display-inline="no-display-inline" id="HA933C6AEB34445A49C59476A2D4DFA0C"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>A covered entity seeking financial assistance under this section—</text>
<clause commented="no" display-inline="no-display-inline" id="H476769BDDE3D44F192733F41420A69FE"><enum>(i)</enum><text display-inline="yes-display-inline">may, if the covered entity seeks to enter into or renew a cooperative agreement under section 49, seek that financial assistance in an application submitted by the covered entity with respect to entering into or renewing that cooperative agreement, as applicable; or</text></clause> <clause commented="no" display-inline="no-display-inline" id="HC4B4DF4471A84813A1F900301D0F590C"><enum>(ii)</enum><text>if the covered entity does not seek to enter into a, or is not seeking to renew an existing, cooperative agreement under section 49, shall submit to the Administrator an application seeking that financial assistance.</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H29F60E0D1B644F6F87C29CDC221AA458"><enum>(B)</enum><header>Contents</header><text>With respect to an application seeking financial assistance under this section, whether or not submitted as part of an application under section 49—</text> <clause commented="no" display-inline="no-display-inline" id="H33034BA8F354431789E1C79CF368ED18"><enum>(i)</enum><text display-inline="yes-display-inline">the application shall detail the proposed use of the financial assistance, as provided under paragraph (3); and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HEDC5DA0839E94695A90F7AAE0549F86E"><enum>(ii)</enum><text>the Administrator shall evaluate the application using the criteria described in paragraphs (1) and (2) of section 49(d), except that, for purposes of this clause, any reference in such paragraph (1) or (2) to a cooperative agreement under section 49 shall be deemed to be a reference to financial assistance provided under this section.</text></clause></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HBCF0BBD2761B4AF0B72A249CA5AC99A7"><enum>(3)</enum><header display-inline="yes-display-inline">Uses of financial assistance</header> <subparagraph commented="no" display-inline="no-display-inline" id="HFC3D249E72174BAFBBA8A79750A7C003"><enum>(A)</enum><header>In general</header> <clause commented="no" display-inline="no-display-inline" id="HB45323A29935473D83652E73BF4C6DC2"><enum>(i)</enum><header display-inline="yes-display-inline">Grants</header> <subclause commented="no" display-inline="no-display-inline" id="HA93B9643D2D54EDEA8B017D72A8F6B94"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to clause (ii), an eligible entity to which financial assistance is provided under this section may use that financial assistance to make grants to covered small business concerns to carry out projects that are directed at the objectives described in section 501(d) of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/695">15 U.S.C. 695(d)</external-xref>).</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H95BD25AB48BB4F349348F9EF6357820C"><enum>(II)</enum><header>Limitation</header><text>A covered small business concern may not receive more than $20,000, in total, in grants made under subclause (I).</text></subclause></clause> <clause commented="no" display-inline="no-display-inline" id="H5580A2AE9D67409281C7665CB509C7AA"><enum>(ii)</enum><header>Loans</header><text>An eligible entity described in any of clauses (ii) through (vi) of section 49(a)(2)(B), or another lender or organization determined appropriate by the Administrator, may use financial assistance provided under this section to make a loan to a covered small business concern with a significantly lower interest rate than is typical, or with a required equity contribution that is lower than is typical, in order to—</text>
<subclause commented="no" display-inline="no-display-inline" id="H204CDD0F966F400AB7D3A7A9B2C58E11"><enum>(I)</enum><text display-inline="yes-display-inline">reduce the number of loan applications that are denied because of insufficient collateral;</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="H0D08A106FB8B4A9791F25FE478B75B5C"><enum>(II)</enum><text display-inline="yes-display-inline">decrease the cost of financing for covered small business concerns;</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H02D51CA4EBF541F5875DE564534A7DE0"><enum>(III)</enum><text>increase the number of covered small business concerns that qualify for financing, in light of—</text> <item commented="no" display-inline="no-display-inline" id="H652336C966A642A891774C6A3ABFF87D"><enum>(aa)</enum><text display-inline="yes-display-inline">the difficulties faced by covered small business concerns in accessing conventional financing; and</text></item>
<item commented="no" display-inline="no-display-inline" id="H2E015EF04CFD495B8FF3980983AB441C"><enum>(bb)</enum><text>the historical exclusion of covered small business concerns from credit markets;</text></item></subclause> <subclause commented="no" display-inline="no-display-inline" id="H51A30827112B46DD82CB7E8FE4D12AAC"><enum>(IV)</enum><text>bring more lenders into areas that suffer from under-investment; and</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H3757B1A28C13483E9D34BB34B1910B1A"><enum>(V)</enum><text display-inline="yes-display-inline">bridge public and private financing programs to provide covered small business concerns with a continuum of support.</text></subclause></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HF7B1E3B0D21C4C57A1D92F4591D37CDE"><enum>(B)</enum><header>No fee or compensation required</header><text display-inline="yes-display-inline">A covered small business concern that receives a grant or loan made under subparagraph (A) shall not be required to pay a fee, or to otherwise pay any compensation, to the applicable covered entity with respect to that grant or loan.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HD26954BD497A4933BA58EB05BE4A77DF"><enum>(4)</enum><header>Verification</header><text display-inline="yes-display-inline">A covered entity that makes a grant or loan to a covered small business concern using financial assistance provided to the covered entity under this section shall verify the legitimacy of that covered small business concern, which may include collecting the following information from the covered small business concern:</text> <subparagraph commented="no" display-inline="no-display-inline" id="H650666D4DEBC44C3A51047BFAA3D18C0"><enum>(A)</enum><text display-inline="yes-display-inline">A description of the history of the covered small business concern and the nature of the business of the covered small business concern.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HAD6FEECD57884636A3F3DF14315439C5"><enum>(B)</enum><text display-inline="yes-display-inline">The amount and purpose of the grant or loan.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H6B7C0F8D09DC4679B34E877ECEEE3D15"><enum>(C)</enum><text display-inline="yes-display-inline">The most recent financial statements of the covered small business concern.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H45725F43BB7D4D4FA72E9690A10647DB"><enum>(D)</enum><text display-inline="yes-display-inline">Past financial statements or tax returns of the covered small business concern, as determined appropriate by the Administrator.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H420A32C5C6004AB582BA060608B70453"><enum>(E)</enum><text display-inline="yes-display-inline">The tax verification described in section 120.191 of title 13, Code of Federal Regulations, or any successor regulation.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H938294D1326C435EACD320E71D5011BF"><enum>(F)</enum><text display-inline="yes-display-inline">A business plan provided by the small business concern.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HB2ADA872D36449968F9E3581005270A7"><enum>(G)</enum><text display-inline="yes-display-inline">Any other material determined appropriate by the Administrator.</text></subparagraph></paragraph></subsection>
<subsection id="H0853FB97DBE1458883E45B1615A8E7D0"><enum>(d)</enum><header>Program examination</header>
<paragraph id="HE5636284B9244770B65C0D4A54B5478C"><enum>(1)</enum><header>In general</header><text>The Administrator shall—</text> <subparagraph id="HBA3C3E90CB704249ADFA96770D4D89D4"><enum>(A)</enum><text>develop and implement an examination of the grants and loans made with financial assistance provided under this section, under which each covered entity to which financial assistance is provided under this section shall provide to the Administrator—</text>
<clause commented="no" display-inline="no-display-inline" id="H2DF340CA44FC4963BC06334DA65D169A"><enum>(i)</enum><text>documentation establishing metrics to measure success on the use of that financial assistance and detailing whether that use satisfied those metrics;</text></clause> <clause commented="no" display-inline="no-display-inline" id="HFAD2C0B35A6A4A67AF9BF4E84249A850"><enum>(ii)</enum><text>if the covered entity has made loans with financial assistance provided under this section, default rates for those loans;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H7E67280610504A7895457313829C2D64"><enum>(iii)</enum><text>if the covered entity has made grants with financial assistance provided under this section, failure rates of the covered small business concerns to which those grants were made; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="H4E180F97F03F48FFB7C94A004216B5A6"><enum>(iv)</enum><text>any other documentation that the Administrator may require; and</text></clause></subparagraph>
<subparagraph id="H3158972A3C504FBBAC014F75F1D22A8C"><enum>(B)</enum><text>analyze the results of the examination conducted under subparagraph (A).</text></subparagraph></paragraph> <paragraph id="HE7E740BA69C145DFBD4F30C648448FF2"><enum>(2)</enum><header>Use of examination</header><text>In determining whether a covered entity described in subsection (c)(1)(A) shall continue to receive financial assistance under this section concurrent with the provision of financial assistance pursuant to a cooperative agreement under section 49, or whether to approve a re-application for financial assistance provided under this section that is submitted by a covered entity described in subsection (c)(1)(B)(ii), the Administrator—</text>
<subparagraph id="HCC553CEAF9B8435196CA615DA0911DDC"><enum>(A)</enum><text>shall consider the results of the most recent examination conducted under paragraph (1); and</text></subparagraph> <subparagraph id="H405944ABD4A24553A6849A497DE9DBA3"><enum>(B)</enum><text>may withdraw financial assistance provided under this section, or reject such a re-application, if—</text>
<clause commented="no" display-inline="no-display-inline" id="H293BD6744CCD44BCBC602ADE26291358"><enum>(i)</enum><text display-inline="yes-display-inline">the Administrator determines that the applicable covered entity has failed to provide information required to be provided (including information provided for purpose of the annual report by the Administrator under subsection (h)); or</text></clause> <clause commented="no" display-inline="no-display-inline" id="H2214400210D84FED9645DAA0A1C74B53"><enum>(ii)</enum><text display-inline="yes-display-inline">the information provided by the applicable covered entity is inadequate.</text></clause></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H99D517295AA3494AAF8B10B37C5DF2F1"><enum>(3)</enum><header>Study and report</header><text>Not later than 2 years after the date of enactment of the <short-title>Strengthening Place-based Access, Resources, and Knowledge Act</short-title>, the Administrator shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HD6CCCABF310749BCB4481A1FBC67B963"><enum>(A)</enum><text display-inline="yes-display-inline">conduct a study to determine whether the program examination criteria under this subsection and the reporting requirements under subsection (h) should vary or include other metrics based on the type and location of a project; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H78C37120AC444735AB1E27C23BB910B9"><enum>(B)</enum><text>submit to Congress a report detailing the results of the study conducted under subparagraph (A).</text></subparagraph></paragraph></subsection> <subsection id="HC6AE13B8E605412686E80EC81D715260"><enum>(e)</enum><header>Training and technical assistance</header><text>The Administrator—</text>
<paragraph id="HF173E175F0A446BA99074D6BD81A27E2"><enum>(1)</enum><text>shall provide in-person or online training and technical assistance to each covered entity to which financial assistance is provided under this section at the beginning of the participation of the covered entity in the program established under this section in order to build the capacity of the covered entity and ensure compliance with procedures established by the Administrator;</text></paragraph> <paragraph id="H3F3407C11E004A419CE6DC02ADFCACFB"><enum>(2)</enum><text>shall ensure that the training and technical assistance described in paragraph (1) is provided at no cost or at a low cost; and</text></paragraph>
<paragraph id="HF223AB026E104C7593178089A36635BD"><enum>(3)</enum><text>may enter into a contract to provide the training or technical assistance described in paragraph (1) with 1 or more organizations with expertise in the entrepreneurial development programs of the Administration, innovation, and entrepreneurial development.</text></paragraph></subsection> <subsection id="H2465C50DF18E42468AC856BEAE28E893"><enum>(f)</enum><header>Coordination</header><text>In making a grant or loan with financial assistance provided under this section, a covered entity may coordinate with—</text>
<paragraph id="HE0F46DECFFE14913A3F951603BF0B008"><enum>(1)</enum><text>resource and lending partners of the Administration;</text></paragraph> <paragraph id="H2DD3895E166941438EDFF9E295F66967"><enum>(2)</enum><text>programs of State and local governments that are concerned with aiding small business concerns; and</text></paragraph>
<paragraph id="H6F0DA2D332434A20907F89EBB4556D35"><enum>(3)</enum><text>other Federal agencies, including to provide services to and assist small business concerns in participating in the SBIR and STTR programs, as defined in section 9(e).</text></paragraph></subsection> <subsection id="HE8DAAEAAFF2C483996B4F4AC00932401"><enum>(g)</enum><header>Publication of information</header><text>The Administrator shall—</text>
<paragraph id="H11580C4CE5C544A28577280138D3F7C2"><enum>(1)</enum><text>publish information about the program carried out under this section online, including—</text> <subparagraph id="H5442EF94F30C4261AFC0BEE9382E7DFA"><enum>(A)</enum><text>on the website of the Administration; and</text></subparagraph>
<subparagraph id="H4E522703B5D84984950778DFDC4320C6"><enum>(B)</enum><text>on the social media of the Administration; and</text></subparagraph></paragraph> <paragraph id="H409ACF3EBBCF46E9801463F0D208F8A5"><enum>(2)</enum><text>request that the resource and lending partners of the Administration and the district offices of the Administration publicize the program carried out under this section.</text></paragraph></subsection>
<subsection id="HCE575BE7E09B4B819356842F40799294"><enum>(h)</enum><header>Annual reporting</header><text>Not later than 1 year after the date on which the Administrator establishes the program under this section, and annually thereafter, the Administrator shall submit to Congress a report on the activities under the program, including—</text> <paragraph commented="no" display-inline="no-display-inline" id="H569D585E7EA44597B9E19CCD2F8BB584"><enum>(1)</enum><text display-inline="yes-display-inline">the number of grants and loans made using the financial assistance provided under this section;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HA04EC335D4D1418F95889699E0739131"><enum>(2)</enum><text display-inline="yes-display-inline">the use of the funds from grants and loans described in subparagraph (A);</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HDBF526A38D65478B92F298D6316C8B2E"><enum>(3)</enum><text display-inline="yes-display-inline">the amount of financial assistance provided under this section that was expended for each job created or retained through the expenditure of that financial assistance;</text></paragraph>
<paragraph id="H3B7C1D794CBF47EA85F19EAE4AEDCEFE"><enum>(4)</enum><text>the number of startup, newly established, and growing covered small business concerns to which grants and loans have been made using financial assistance provided under this section (referred to in this subsection as <quote>participants</quote>), including a breakdown of the owners of the participants by race, gender, veteran status, and urban versus rural location;</text></paragraph> <paragraph id="H48DE910569AB4EE2AFDBBAD7D1310FCF"><enum>(5)</enum><text>the retention rate for participants;</text></paragraph>
<paragraph id="H7E04A9DAB5DD43C68B3CA3DB6464C3B0"><enum>(6)</enum><text>the total and median amount of capital accessed by participants, including the type of capital accessed;</text></paragraph> <paragraph id="H8CC6F0E7A09B400DA508348BFD8E111D"><enum>(7)</enum><text>the total and median number of employees of participants;</text></paragraph>
<paragraph id="H9F8AFF3F38C4412A9E92076DE26C7F5B"><enum>(8)</enum><text>the number and median wage of jobs created by participants;</text></paragraph> <paragraph id="H9A543FB3793D4FE083D444FE3E5BB139"><enum>(9)</enum><text>the number of jobs sustained by participants; and</text></paragraph>
<paragraph id="H616B92942BB441C38D2DC82992BA7A90"><enum>(10)</enum><text>information regarding such other metrics as the Administrator determines appropriate, including coordination with other private or public small business assistance programs.</text></paragraph></subsection> <subsection id="HCA9535970D284E0F824FB8D924DC845E"><enum>(i)</enum><header>Funding</header> <paragraph id="H4FAFFC8A21ED489F9639141D6C4C852A"><enum>(1)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as may be necessary to carry out this section.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H12D9D9A60B2C455EBD7B589AF1C2E604"><enum>(2)</enum><header>Administrative expenses</header><text display-inline="yes-display-inline">Of the amount made available to carry out this section for any fiscal year, not more than 10 percent may be used by the Administrator for administrative expenses.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> <section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H61ADA6FDD8314C7CB3EBD7E9BB1FA1D3"><enum>6.</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator of the Small Business Administration shall promulgate regulations to carry out sections 49 and 50 of the Small Business Act, as amended by this Act, which shall include procedures to—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H5AACEBA63C304DADAABECC436366C944"><enum>(1)</enum><text display-inline="yes-display-inline">verify the proper use of financial assistance provided under each such section, including a grant or loan made under such section 50 with financial assistance provided under that section; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HD0571E7018C147EE9D9CFFB020A46E14"><enum>(2)</enum><text display-inline="yes-display-inline">establish clawback provisions for any instance of fraud committed with respect to any financial assistance, or any grant or loan, described in paragraph (1) of this section.</text></paragraph></section>
