<section id="HA996D4849CE849EE855B45F462C5EFA6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Future Vintage Plastic Pipeline Tragedies Act</short-title></quote>.</text></section> <section id="HB7561C08307B4E66BAD447C2CD33D4D1" section-type="subsequent-section"><enum>2.</enum><header>Aldyl–A pipelines</header> <subsection id="H7D90CA0F2DC14EFBB8B2E4A6A0B28DE6"><enum>(a)</enum><header>Assessment of aldyl–a polyethylene piping</header><text>Not later than 3 years after the date of enactment of this Act, each owner or operator of a gas distribution pipeline facility shall assess its system for the presence of Aldyl–A polyethylene.</text></subsection> 
<subsection id="H9CC2C43C2F8D46039B716B59FF098E64"><enum>(b)</enum><header>Limitation</header> 
<paragraph id="HCE994A75B0234C05AE7C49D6CD2F930A"><enum>(1)</enum><header>In general</header><text>The Secretary shall not require owners and operators of gas distribution pipeline facilities to conduct excavation activities for the purpose of the assessment required under subsection (a).</text></paragraph> <paragraph id="HAFE33F3569F04E75896CD14CE7C27893"><enum>(2)</enum><header>Savings provision</header><text>Nothing in this subsection affects the authority of the Secretary under—</text> 
<subparagraph id="H4F35B5C59B504B96A1E111A237813E6E"><enum>(A)</enum><text>section 60112 of title 49, United States Code; or</text></subparagraph> <subparagraph id="HCFB8250872594089B8EECF95DEF4A101"><enum>(B)</enum><text>subsection (m) or (p) of section 60117 of that title.</text></subparagraph></paragraph></subsection> 
<subsection id="HCAF5E08E0A6845C185FEFECCCF3630B1"><enum>(c)</enum><header>Reporting</header><text>Not later than 3 years after the date of enactment of this Act, each owner or operator of a pipeline facility described in subsection (a) shall submit to the Secretary the estimated total pipeline mileage identified by the owner or operator as Aldyl–A polyethylene piping.</text></subsection> <subsection id="HBB0EC47297E74094BBCA1AC092F9C000"><enum>(d)</enum><header>State pipeline safety program certifications</header><text>Section 60105(b)(9)(A) of title 49, United States Code, is amended by striking <quote>of cast iron and bare steel pipelines</quote> and inserting the following: </text> 
<quoted-block id="HFB4DF5A5ADDF4DB0A165738979D674F2" style="OLC" display-inline="yes-display-inline"><text display-inline="yes-display-inline">of—</text> <clause id="HF9C8FD7C255A43DE9B2141BA838D8163"><enum>(i)</enum><text>cast iron and bare steel pipelines; and</text></clause> 
<clause id="H62DC354DDA1C4A63844DAEAA0CC7773F"><enum>(ii)</enum><text>pipelines constructed of historic plastics with known safety issues</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HF6D4DBFA915C495C9081D6638DFCBFCD"><enum>(e)</enum><header>Evaluation of risk in distribution integrity management programs</header><text>Section 60109(e)(7)(A)(i) of title 49, United States Code, is amended by striking <quote>presence of cast iron pipes and mains in the distribution system; and</quote> and inserting the following:</text> 
<quoted-block style="USC" id="H4E409B674B8A45E0887D6B4A5976BC63" display-inline="yes-display-inline"><text display-inline="yes-display-inline">presence, in the distribution system, of pipes and mains made of—</text> <subclause id="H65F81933008C4222AA6FF6DEBA32192A"><enum>(I)</enum><text>cast iron;</text></subclause> 
<subclause id="H64E9B227C2AE4DEE88D8D9A428C6D2F1"><enum>(II)</enum><text>unprotected steel;</text></subclause> <subclause id="H3DAD1528C8D94903A023A72AA5F16578"><enum>(III)</enum><text>wrought iron; or</text></subclause> 
<subclause id="H2B5612174C394EF9BC6A486ACEE1B6E7"><enum>(IV)</enum><text>historic plastics with known safety issues; and</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> </legis-body></bill>
