<section id="H27D6B1B48B5E431087C66078335BF117" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Resident Ownership of Manufactured Home Communities Act</short-title></quote>.</text></section> <section id="H661D5D4B6AC742159BB5DF84CA39E84A"><enum>2.</enum><header>State policies enabling resident opportunity to purchase manufactured housing communities</header><text display-inline="no-display-inline">Title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="H8DC67B1C34C54B0794F225BE5FDFDAC5"><enum>123</enum><header>State policies enabling resident opportunity to purchase manufactured housing communities</header> 
<subsection id="HE603E1F586504AB99122E1265C513D07"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this section, the Secretary shall carry out a competitive grant program to award amounts to eligible entities as described in this section.</text></subsection> <subsection id="HA3520D1732D542CE80DD23B3F5B0B6C8"><enum>(b)</enum><header>Eligibility</header> <paragraph id="HC90F62E793CD4F8F8C62C2A0476FA02D"><enum>(1)</enum><header>In general</header><text>To be eligible for a grant under this section, an entity shall—</text> 
<subparagraph id="HB551C96705344F948482B0643C71A413"><enum>(A)</enum><text>be a recipient of assistance under this title;</text></subparagraph> <subparagraph id="H8AFA69FBBC84481A8EB1BE1F127D15BC"><enum>(B)</enum><text display-inline="yes-display-inline">be located within a State or be a State, Indian tribe, or insular area that has—</text> 
<clause id="H5850B68B39B5469E93281612CA9379A0"><enum>(i)</enum><text>adopted the model laws described in subsection (e), submitted to the Secretary by the entity for review; or</text></clause> <clause id="HB2D1E6B7DCE548769962CF10FE9AA84C" commented="no"><enum>(ii)</enum><text>submitted to the Secretary data demonstrating an effective purchase opportunity.</text></clause></subparagraph></paragraph> 
<paragraph id="HE7D9CD32860E48C5BFBD870F11BA10A6"><enum>(2)</enum><header>Determination</header><text>In determining eligibility, the Secretary shall make a determination whether the submissions described in subparagraph (B) meet the requirements of this section.</text></paragraph> <paragraph id="HCEFCFAE71F4E413D92FC1D89E81C5912"><enum>(3)</enum><header>Period of eligibility</header><text>Following a determination that an entity is eligible for a grant under this section, that entity shall retain its eligibility for a 3-year period after such determination.</text></paragraph></subsection> 
<subsection id="HF20FCBDB3808473B964A5F2289A675AB"><enum>(c)</enum><header>Eligible activities</header><text>An eligible entity that is awarded a grant under this section shall use—</text> <paragraph id="HC79B6279BA2B4DC18AD29C3138D40206"><enum>(1)</enum><text display-inline="yes-display-inline">not less than 25 percent of such grant amounts for land and site acquisition and infrastructure for a manufactured housing community owned by an eligible owner; and</text></paragraph> 
<paragraph id="HCA27CE6C04AE4D27B47C48B83FB83DC6"><enum>(2)</enum><text>the remaining grant amounts to carry out any of the eligible activities described in section 105.</text></paragraph></subsection> <subsection id="H331E9D92C128441D9AA24D20422A900A"><enum>(d)</enum><header>Waivers</header><text>The Secretary may waive or specify alternative requirements for any provision of law or regulation that the Secretary administers in connection with use of amounts made available under this section other than requirements related to fair housing, nondiscrimination, labor standards, the environment, and requirements that activities benefit persons of low- and moderate-income, upon a finding that the waiver or alternative requirement is not inconsistent with the overall purposes of this section and that the waiver or alternative requirement is necessary to facilitate the use of amounts made available under this section.</text></subsection> 
<subsection id="H1C99CE6731B243509882372D1ED0AA27"><enum>(e)</enum><header>Model law criteria</header><text display-inline="yes-display-inline">The model law criteria for a State, insular area, and Indian tribe are as follows:</text> <paragraph id="H9859C2DBCABE4557AE6FA265CC3C50D4"><enum>(1)</enum><text display-inline="yes-display-inline">Not later than 60 days before making a final, unconditional acceptance of an offer to sell, lease, or transfer a manufactured housing community, the owner of such community shall provide a written notice to—</text> 
<subparagraph id="H9613FD460D394623A86C2894010FE1C0"><enum>(A)</enum><text display-inline="yes-display-inline">the residents of the manufactured housing community; and</text></subparagraph> <subparagraph id="H985F328BCB734F0B84334687C03A8423"><enum>(B)</enum><text>the housing finance agency of the relevant State, insular area, or Indian tribe.</text></subparagraph></paragraph> 
<paragraph id="H4D766DA6034D46F299FA9E3F04341FA6"><enum>(2)</enum><text>The notice described in paragraph (1) shall—</text> <subparagraph id="H19C809B781C84044954C468F86D34324"><enum>(A)</enum><text>include the price, terms, and conditions of the offer the manufactured housing community owner has conditionally accepted or plans to accept;</text></subparagraph> 
<subparagraph id="H9D6746F831E74824B88D2CE57F6BB148"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a sale of more than 1 manufactured housing community, or a manufactured housing community and 1 or more other non-related properties in a single transaction, state both the aggregate price and the price of the manufactured housing community in which the residents receiving the notice reside; and</text></subparagraph> <subparagraph id="HE9A8509FDCAD4BD197B486785E6F29D6"><enum>(C)</enum><text>describe the residents’ opportunity to purchase the community and the relevant deadlines described in this subsection.</text></subparagraph></paragraph> 
<paragraph id="H4B03E28D3ABD4127AF9F89F7F6D1A074"><enum>(3)</enum><text>If within 60 days of the date of the notice described in paragraph (1), a formal or informal group of resident homeowners that is governed by and open to all resident homeowners in the community, or its designee, presents a proposed agreement to the manufactured housing community owner to purchase the community, along with a statement that the owners of more than 50 percent of the owner-occupied homes in the community have indicated their support for submission of the offer by signing a petition or other document that so states, then—</text> <subparagraph id="HCD55B85167BE45AABBE251E529726714"> <enum>(A)</enum> <text>if the proposed agreement matches the price and substantially the same terms and conditions as the offer the manufactured housing community owner has conditionally accepted or plans to accept, the community owner must sell the community to the homeowners on those prices, terms, and conditions; or</text>
                            </subparagraph> 
<subparagraph id="H393084B189684A2796A63B315D7D8D21"><enum>(B)</enum><text>if the proposed agreement differs from the price or substantially differs from the terms and conditions of the offer the community owner has conditionally accepted or plans to accept, the community owner shall consider the group’s proposed agreement and negotiate with the group in good faith to determine whether a mutual agreement can be reached to enable the group to purchase the community.</text></subparagraph></paragraph> <paragraph id="HB2D47D68454F45CEA312C4DB52EE8CA8"><enum>(4)</enum><text>The community owner may not reject a proposed purchase agreement solely on the basis of its inclusion of a financing contingency.</text></paragraph> 
<paragraph id="H4F4F4D0F75D74A768B991CE286EBCE7C"><enum>(5)</enum><text>If a resident homeowner group and the community owner enter into a purchase agreement for the community, the resident homeowner group shall have 120 days from the date of the agreement to form an appropriate homeowner-governed corporation or co-operative to take title to the community and arrange all necessary financing, and a commercially reasonable time to close on the sale.</text></paragraph> <paragraph id="HD0E17778F95248C8A271BA7DFA5A2B59"><enum>(6)</enum><text>The community owner shall afford the purchase opportunity required by this section separately to each substantially different offer to sell or purchase a manufactured housing community.</text></paragraph> 
<paragraph id="H2B9EB43D04674469978F7697DCDBAF1F"><enum>(7)</enum><text>The manufactured housing community owner may not accept or conditionally accept an offer for the sale, lease, or transfer of the community unless its price, terms, and conditions are universal and applicable to all potential buyers, nor shall such owner accept or conditionally accept an offer that contains any provision penalizing the owner for entering into a purchase agreement with a resident homeowner group.</text></paragraph> <paragraph id="H7C47FD4CD39A45BE85A42490189AF1BF"><enum>(8)</enum><text>The residents of a manufactured housing community shall have the right to meet, form a residents association, use common areas for meetings on the same terms as allowed for other uses, and circulate flyers, petitions, or other documents, and may not be retaliated against for asserting such rights.</text></paragraph> 
<paragraph id="HE81E1E72C60B4C5EB8C081069D3C8324"><enum>(9)</enum><text display-inline="yes-display-inline">The requirements listed in this subsection apply to all sales, leases, or other transfers of manufactured housing communities, except a State, insular area, and Indian tribe may exempt any of the following:</text> <subparagraph id="HC14DA8F151F247BE83F9A4D8786BF4F7"><enum>(A)</enum><text>A sale, lease or transfer to a family member of the community owner or to a trust, the beneficiaries of which are family members of the community owner.</text></subparagraph> 
<subparagraph id="HEE1FE537D4E6415AB3699A0D8B8BC83E"><enum>(B)</enum><text>A transfer by gift, devise or operation of law.</text></subparagraph> <subparagraph id="HC101A931D9A149FE9F86E92B8A27BCEE"><enum>(C)</enum><text>A sale, lease or transfer by a partnership or a limited liability company to 1 or more of its partners or members, between joint tenants or tenants in common, or by a business entity to a subsidiary or affiliate of such entity.</text></subparagraph> 
<subparagraph id="HFDC47619FE454D298D172CF2F409161B"><enum>(D)</enum><text>A lease of a lot within the manufactured housing community to a person who will live in a manufactured home on such lot.</text></subparagraph> <subparagraph id="HEB56B6E0663A4E10BE93BE9AD05D0859"><enum>(E)</enum><text>A conveyance of an interest in the community that is incidental to the financing of such community.</text></subparagraph> 
<subparagraph id="HA300A311C9AC49D4A0AD91DC411A217B"><enum>(F)</enum><text>A sale or transfer pursuant to eminent domain.</text></subparagraph></paragraph></subsection> <subsection id="H38E230A01E0244E5BC1139C4049B99DF" commented="no"><enum>(f)</enum><header>Implementation</header> <paragraph id="H8447DEA0AC284A8CA61D95BFE88FCDEC" commented="no"><enum>(1)</enum><header>Allocation of CDBG amounts</header><text display-inline="yes-display-inline">Grants awarded under this section shall not adversely affect the amount of any formula assistance received by a jurisdiction under section 106.</text></paragraph> 
<paragraph id="H3CE55CFD79274A1AA64B1A63EB66F013" commented="no"><enum>(2)</enum><header>Definition of data demonstrating an effective purchase opportunity</header><text>The Secretary may adjust the definition of <quote>data demonstrating an effective purchase opportunity</quote> as necessary to respond to market conditions related to resident purchase and operation of manufactured housing communities.</text></paragraph> </subsection> <subsection id="H2B763BF15C6D426FB8A87B1F7106964B"><enum>(g)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HFE0411522FC146C9BB75285CC7EBA0D9">
                            <enum>(1)</enum>
                            <header>Data demonstrating an effective purchase opportunity</header>
 <text>The term <term>data demonstrating an effective purchase opportunity</term> means data showing that, over a 1- to 5-year period, including the most recent year for which data is available, that—</text>
                            <subparagraph id="H5823754B66444C69819D75B48E62E3CB">
                                <enum>(A)</enum>
 <text>residents were given a notice of sale and opportunity to purchase in at least 80 percent of manufactured housing community sales that were completed; and</text>
                            </subparagraph>
                            <subparagraph id="H910FC678319A49148F96E29E22520393">
                                <enum>(B)</enum>
 <text>residents, or a nonprofit organization designated by the residents, successfully purchased the community in at least 1 out of 20 manufactured housing community sales.</text>
                            </subparagraph>
                        </paragraph> 
<paragraph id="H2E5409BA27024428A1FA208805337EE4"><enum>(2)</enum><header>Eligible owner</header><text>The term <quote>eligible owner</quote> means—</text> <subparagraph id="H37A3C8DA0D3347C28C46E735E08963E4"><enum>(A)</enum><text>a unit of general local government;</text></subparagraph> 
<subparagraph id="H3C29913DEC274647AA6062674407BF78"><enum>(B)</enum><text>a housing authority;</text></subparagraph> <subparagraph id="HA7B4DBCA68E34E8498F18589DE4AB725"><enum>(C)</enum><text>a resident-owned community;</text></subparagraph> 
<subparagraph id="H3EF44F74AF864E27A131D77C17964996"><enum>(D)</enum><text>a resident-owned cooperative;</text></subparagraph> <subparagraph id="HB6CE50860AD84C5FA4B1F297F2567363"><enum>(E)</enum><text>a nonprofit entity with housing expertise or a consortia of such entities;</text></subparagraph> 
<subparagraph id="HA3C4E3F739E745E08564BB162324457C"><enum>(F)</enum><text>a community development financial institution;</text></subparagraph> <subparagraph id="H7525569020D8420DA09F31DEE210EF0C"> <enum>(G)</enum> <text>an Indian tribe;</text>
                            </subparagraph> 
<subparagraph id="HD2EF29FD6A2B41E2AE66F1B932A77494"><enum>(H)</enum><text>a tribally designated housing entity; or</text></subparagraph> <subparagraph id="H3E47C90EB03B4901A714B4C06D6F61B1"><enum>(I)</enum><text>a State.</text></subparagraph></paragraph> 
<paragraph id="H0272FDD261624661A4EF6A80368CBD2B"><enum>(3)</enum><header>Manufactured housing community</header><text>The term <term>manufactured housing community</term> means—</text> <subparagraph id="H342B787FCF57430E82FAD224FC6CA829"><enum>(A)</enum><text>any community, court, park, or other land under unified ownership developed and accommodating, or equipped to accommodate, the placement of manufactured homes, where—</text> 
<clause id="H625A226BA84C4D109FB588AC44B98FF4"><enum>(i)</enum><text>spaces within such community are or will be primarily used for residential occupancy; or</text></clause> <clause id="HFF49177504F14F639DE7CD87112BEAA9"><enum>(ii)</enum><text>a majority of such occupied spaces within the community are occupied by manufactured homes, which may include homes constructed prior to the Manufactured Home Construction and Safety Standards established by the Secretary; or</text></clause></subparagraph> 
<subparagraph id="H71F1B015EAFC4F119C5F0412E6AA9F4A"><enum>(B)</enum><text>any community that meets the definition of manufactured housing community used for programs carried out by the Secretary.</text></subparagraph></paragraph></subsection> <subsection id="H6B8A71B6B68642B785AC0313ABDA303C"> <enum>(h)</enum> <header>Authorization of appropriations</header> <text>There is authorized to be appropriated to the Secretary such sums as may be necessary to carry out this section, which shall be in addition to any other funds appropriated pursuant to this title.</text>
