<section id="H1CAEC833F54D47ADB55D31EB29FBB25D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Get Justice-Involved Veterans Behavioral Assistance and Care for Key Health Outcomes to Maintain Empowerment Act</short-title></quote> or the <quote><short-title>Get Justice-Involved Veterans BACK HOME Act</short-title></quote>.</text></section> <section id="HC3B8601A00754F7883E58755E5C3B565"><enum>2.</enum><header>Pilot program to provide mental health care to incarcerated veterans</header> <subsection commented="no" display-inline="no-display-inline" id="H1BD8D7EF1BD64AF88D0057ABE073DAD8"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall carry out a pilot program to furnish mental health care to incarcerated veterans (in this section referred to as the <quote>pilot program</quote>), with a priority given to veterans with a service-connected disability relating to—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H0CE5C1ADACA04E3AA43CB2D1529B87F3"><enum>(1)</enum><text display-inline="yes-display-inline">post-traumatic stress disorder;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H2D9694220DC94B8683994E72254332AF"><enum>(2)</enum><text display-inline="yes-display-inline">traumatic brain injury; or</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HE42CCE861C334CE785B12C5900813B14"><enum>(3)</enum><text display-inline="yes-display-inline">military sexual trauma.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H49C7DC581801498EA1BDCB66570B3E21"><enum>(b)</enum><header>Locations</header><text>The Secretary shall carry out the pilot program at not fewer than five facilities, which shall—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H4EE844E89A544B38BFD79247CEED78DA"><enum>(1)</enum><text display-inline="yes-display-inline">represent large and small facilities and urban and rural settings; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H6DD59F4854C0442680917B846805352E"><enum>(2)</enum><text>have separate housing units for veterans that have already been established by the facility.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HDF4F4F685B1F4AA0889260E1B6F08366"><enum>(c)</enum><header>Coordination</header><text display-inline="yes-display-inline">The Secretary shall develop the pilot program in coordination with relevant State or Federal agencies responsible for the incarceration of veterans.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="HE011861057A846EE948C8C6449D43600"><enum>(d)</enum><header>Services To be provided</header> <paragraph commented="no" display-inline="no-display-inline" id="HF62F84ABB43E44439A61F81DA863F71B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In carrying out the pilot program, the Secretary shall provide to incarcerated veterans telemental health services, if the facility at which the veteran is incarcerated has necessary infrastructure for the provision of such services.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H36C06550DEA943B280A494BC76EF3D53"><enum>(2)</enum><header>Other services</header><text>If the provision of telemental health services under paragraph (1) is not feasible, the Secretary shall provide to incarcerated veterans under the pilot program—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HDDEA9D58CB0F40EB986054FC0CE035E2"><enum>(A)</enum><text display-inline="yes-display-inline">mental health services through the use of mobile mental health units close to the facility at which the veteran is incarcerated through the Department of Veterans Affairs or a Vet Center; or</text></subparagraph>
<subparagraph id="H342F8E90F0104923A88DABF4A8640D57"><enum>(B)</enum><text>mental health services through other means, as determined appropriate by the Secretary.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H75778D3602044B84A5F7809BD506F66B"><enum>(3)</enum><header>Copayment</header><text>The Secretary shall not charge a copayment for the receipt of services under the pilot program.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HB1F1F5427BC140E3B496ACA94E5CC761"><enum>(e)</enum><header>Health care providers</header>
<paragraph commented="no" display-inline="no-display-inline" id="HC0B96B8EE62C46379CEF1355419E544B"><enum>(1)</enum><header>Direct care</header><text>The Secretary shall furnish mental health care under the pilot program through the use of health care providers of the Department and may not use non-Department health care providers.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H07D942A02BAC4AA09C4C0B5262030DAA"><enum>(2)</enum><header>Treatment and assessment</header><text display-inline="yes-display-inline">A health care provider providing mental health care under the pilot program shall provide treatment and assessment of medical conditions and is not to provide assessment or evaluation of current or future disability claims.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H806FC753EFE240F5998FC0F5F014AFBF"><enum>(3)</enum><header>Hub</header><text>In carrying out the pilot program, the Secretary shall create a hub of health care providers that—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H2282E324456840BE88D06FD250E84184"><enum>(A)</enum><text display-inline="yes-display-inline">only provide care to incarcerated veterans; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H6E2F97FE4F674EB78881D0CA9F7B84A1"><enum>(B)</enum><text display-inline="yes-display-inline">operate separate from any medical facility or Veterans Integrated Service Network of the Department.</text></subparagraph></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H56F2141EB89A443DAE8F118E9DC537ED"><enum>(f)</enum><header>Furnishing of care</header><text>The Secretary shall carry out the pilot program notwithstanding section 1710(h) of title 38, United States Code.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H3AF656FD54BB4C7D982E1E6788978399"><enum>(g)</enum><header>Definitions</header><text>In this section:</text> <paragraph commented="no" display-inline="no-display-inline" id="H42FDDCE4397C433ABF11E1E935F2AD31"><enum>(1)</enum><header>Incarcerated veteran</header><text>The term <term>incarcerated veteran</term> means a veteran who is incarcerated in a Federal, State, local, or other penal institution or correctional facility.</text></paragraph>
<paragraph id="H96C752DB05BA4B9F8436CA5DC12FDF7D"><enum>(2)</enum><header>Military sexual trauma</header><text>The term <term>military sexual trauma</term> means sexual assault or sexual harassment experienced by an individual during service in the Armed Forces.</text></paragraph> <paragraph id="H97F47DEEF9434445BA0F84825338BC56"><enum>(3)</enum><header>Service-connected; veteran</header><text>The terms <term>service-connected</term> and <term>veteran</term> have the meanings given those terms in section 101 of title 38, United States Code.</text></paragraph>
<paragraph id="H08246818633B47E081536AEBC39D4900"><enum>(4)</enum><header>Vet Center</header><text>The term <term>Vet Center</term> has the meaning given that term in section 1712A(h) of such title.</text></paragraph></subsection></section> <section id="H6B62CD8220EB478FB41CE3CC0A66FBBB"><enum>3.</enum><header>Separate housing units for incarcerated veterans</header> <subsection commented="no" display-inline="no-display-inline" id="H9CFB683A7E2A4DB1862DBDE46F0D6BE4"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/301">Chapter 301</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>

<section commented="no" display-inline="no-display-inline" id="HBD97F72865184A9BBBFED47B269FB3D7"><enum>4015.</enum><header>Housing for incarcerated veterans</header>
<subsection commented="no" display-inline="no-display-inline" id="H3A5BFDDC79A24869A7F71052CC1A5D10"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>The Director of the Bureau of Prisons shall, wherever feasible, establish dedicated wards or housing units for incarcerated veterans in Federal correctional institutions, which shall provide an environment conducive to the discipline, structure, and order familiar to veterans in order to facilitate more effective mental health treatment, peer support, and rehabilitation efforts.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="H2B2070137E0A4220989F352D4A71FE36"><enum>(b)</enum><header>Training and resources</header><text>The head of each Federal correctional institution with a veteran housing unit described in subsection (a) shall collaborate with local facilities of the Department of Veterans Affairs to ensure that, with respect to that housing unit, correctional staff are trained regarding, resources are allocated for, and rehabilitation programming is tailored to the needs of veterans.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HF3A499712EE244EB9DBD219EA7B744A3"><enum>(c)</enum><header>Programs</header><text>In the case of a Federal correctional institution lacking the capacity or resources for a housing unit described in subsection (a), the Director of the Bureau of Prisons shall, at a minimum, create structured veteran-focused programs aimed at providing similar benefits, with oversight and support coordinated through the Department of Veterans Affairs.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection commented="no" display-inline="no-display-inline" id="HC2721E13B1844A5C830C55338906C781"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/301">chapter 301</external-xref> of title 18, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/4014">section 4014</external-xref> the following:</text>

<toc-entry level="section">4015. Housing for incarcerated veterans.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="HC853025816144DCD8352218A2118F01F"><enum>4.</enum><header>Automatic resumption of payment of compensation and dependency and indemnity compensation to persons incarcerated for conviction of a felony after period of incarceration ends</header>
<subsection commented="no" display-inline="no-display-inline" id="HA312515E73B843ABAEC61F3077F9BD25"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 5313(a) of title 38, United States Code, is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H5B75C7B86F30421AAE5874D8CE096307"> <paragraph commented="no" display-inline="no-display-inline" id="HD029BC11B4D74BD290DA1CBD2CDC96B2" indent="up1"><enum>(3)</enum><text>The Secretary shall ensure that, for any individual whose receipt of compensation or dependency and indemnity compensation is interrupted pursuant to paragraph (1) for a period of incarceration, resumption of such payments resume automatically on the date on which the individual is released from incarceration.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H34DE7869A90E4B71A37511C53C7625C7"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on the date that is 180 days after the date of the enactment of this Act.</text></subsection></section> <section id="H0B751D57572348BE84DD34EDC2D06739"><enum>5.</enum><header>Survey on incarcerated veterans</header><text display-inline="no-display-inline">Section 302 of part C of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10132">34 U.S.C. 10132</external-xref>) is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H97C4725FA36E4CE9BABDA7A0561448AF"><enum>(1)</enum><text>in subsection (c)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H087F5FF56878470B9050BDA826A86575"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (15) through (23) as paragraphs (16) through (24), respectively; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H9C0CBD73A4D64C9AB1E67779DE4FDEBB"><enum>(B)</enum><text>by inserting after paragraph (14) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H79A9095EC458426FB9C117DE120802FD"> <paragraph commented="no" display-inline="no-display-inline" id="H708AB147C4B2494B8025C2E82BC892DF"><enum>(15)</enum><text>collect and analyze comprehensive information concerning the incarceration of veterans (as defined in section 101 of title 38, United States Code);</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HC2C6A1FDD13843509AA9C8EDFEB406BD"><enum>(2)</enum><text>in subsection (g)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H95BCD18715154AA3969A4FD883C93AE1"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>Not later than</quote> and inserting the following:</text>

<paragraph commented="no" display-inline="no-display-inline" id="H6FDDED52946744BCADE160A1407E7D74"><enum>(1)</enum><header>Crimes in Indian country</header><text>Not later than</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HE854AA2EECF04A15AF24B3CCEAEE1BFC"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

<paragraph id="H1A4A220DB3294CB1AFC465238AE60FE6"><enum>(2)</enum><header>Incarcerated veterans</header><text>Not later than 180 days after the date of enactment of this paragraph, and annually thereafter, the Director shall submit to Congress a report describing the data collected and analyzed under this section relating to veterans (as defined in section 101 of title 38, United States Code) who are incarcerated in State and Federal prisons.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section> </legis-body></bill>
