<section id="HC6EE30513079442F997B3FF907FEA1E7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Harm Data Centers Act</short-title></quote>.</text></section> <section id="H9B3184039AAD457CA3A2A3B7C44A053E"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> 
<paragraph id="H9B50458186D644F0BFFE97FEC73C4E6F"><enum>(1)</enum><text display-inline="yes-display-inline">data centers, while creating potentially economically valuable tools, impose costs upon other electricity customers, in the form of higher costs for the generation of electricity, along with necessary investments in electric infrastructure; and</text></paragraph> <paragraph id="H7D9B17E036114BD18500DCCAFC3D7B57"><enum>(2)</enum><text>the costs imposed by data centers upon the bulk-power system should be fully borne by data centers and that other residential and small commercial electricity customers should be economically protected from the impacts of data centers.</text> </paragraph></section> 
<section id="HDF8C82F5971C406893D63B76161A2070"><enum>3.</enum><header>Ensuring data centers pay their fair share</header> 
<subsection id="HEDF99BD9240F489DB4747B4C6BAAF9E7"><enum>(a)</enum><header>Data center defined</header><text display-inline="yes-display-inline">Section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="H88D256C7AB3841A2A1EC29015856C351" display-inline="no-display-inline"> <paragraph id="HF3A4E86FB88A43209AD3F4338D9EA52E"><enum>(30)</enum><header>Data center</header><text>The term <term>data center</term> means—</text> 
<subparagraph id="H511C17E59EFC4021A4CFA4AA3E8B64C6"><enum>(A)</enum><text>any facility that—</text> <clause id="H7CB08445993E40C6AE7E0103CCB414EC"><enum>(i)</enum><text>is behind a single point of interconnection;</text> </clause> 
<clause id="H63A359F8E22A4286A92DD174B53C7C4F" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">primarily contains electronic equipment used to process, store, and transmit digital information; and</text> </clause> <clause id="H64732ED02BF9406BA96858CF98377BE7"><enum>(iii)</enum><text>has a peak electricity demand of greater than 50 megawatts; or</text></clause></subparagraph> 
<subparagraph id="HD550A65B071545FD93FFD805B95A0FF8"><enum>(B)</enum><text display-inline="yes-display-inline">any group of facilities—</text> <clause id="HBF5D7E79B6064DD4ADA300F8172C8747"><enum>(i)</enum><text display-inline="yes-display-inline">that are behind a single point of interconnection;</text></clause> 
<clause id="HAF3E4E7F0FA540D98FF74F515C9FBCDD"><enum>(ii)</enum><text>the majority of which primarily contain electronic equipment used to process, store, and transmit digital information; and</text></clause> <clause id="H6B28CA3BBADB43938675BCF23716EFE3"><enum>(iii)</enum><text display-inline="yes-display-inline">that, in the aggregate, have a peak electricity demand of greater than 50 megawatts.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H8A80AA715C45415E8A80D7B44D2D552F"><enum>(b)</enum><header>Ensuring data centers pay their fair share</header><text display-inline="yes-display-inline">The Federal Power Act is amended by inserting after section 223 (<external-xref legal-doc="usc" parsable-cite="usc/16/824w">16 U.S.C. 824w</external-xref>) the following:</text> <quoted-block style="OLC" id="H8D075F15C6A249CE8FE304380D218CD3" display-inline="no-display-inline"> <section id="H571BC04E34E249B49201CFFACEB32483"><enum>224.</enum><header>Ensuring data centers pay their fair share</header> <subsection id="H911EA4F8CB6640F5AE49CE0AA349BAD1"><enum>(a)</enum><header>Authority</header> <paragraph id="H6CF6AA29ED854C5A8CC3E4340F473A95"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding subsection (a) and subsection (b)(1) of section 201, and subject to subsection (d), the Commission shall, beginning on the date that is 90 days after the date of enactment of this section, have the sole authority to approve rates and charges for the retail sale of electric energy from a covered electric utility to a data center.</text> </paragraph> 
<paragraph id="HA754D130B09643E785180B78D3EE065F"><enum>(2)</enum><header>Just and reasonable requirement</header><text display-inline="yes-display-inline">All rates and charges approved by the Commission pursuant to paragraph (1) shall be just and reasonable, and not unduly discriminatory or preferential. If the Commission finds, after a hearing held upon its own motion or upon complaint, that any rate or charge approved by the Commission is unjust or unreasonable, or unduly discriminatory or preferential, the Commission shall fix a new rate or charge that is just and reasonable and not unduly discriminatory or preferential.</text></paragraph> </subsection> <subsection id="HFB8590CD40834561BE2507DB9E48FBBC"><enum>(b)</enum><header>Full allocation of costs</header><text display-inline="yes-display-inline">Any rate or charge approved pursuant to subsection (a) shall include—</text> 
<paragraph id="HEA176CB9178D4F6CA72EC13920528BC2"><enum>(1)</enum><text>the full costs of constructing, upgrading, and expanding any transmission or distribution facility to facilitate the interconnection of data centers to the bulk-power system;</text></paragraph> <paragraph id="HBC9B97137A5442C1817707B24C8D0FB2"><enum>(2)</enum><text display-inline="yes-display-inline">the full costs of constructing, upgrading, and expanding any transmission or distribution facility to ensure the reliability of the bulk-power system during periods of increasing demand for electric energy from data centers; and</text> </paragraph> 
<paragraph id="H44B1E9BB6996437A8A7404955E7D7A52" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">the full costs of constructing, upgrading, and expanding any generating facility to facilitate the reliability of the bulk-power system during periods of increasing demand for electric energy from data centers.</text> </paragraph></subsection> <subsection id="H319F0E486CA7407E879EBBABB9593305"><enum>(c)</enum><header>Prohibition on cost-shifting</header><text display-inline="yes-display-inline">No covered electric utility may shift the costs described in paragraphs (1) through (3) of subsection (b) onto their retail rates or charges for any customer other than a data center.</text></subsection> 
<subsection id="H942B7EB313704C3C82DB153E3E0ED87A" commented="no"><enum>(d)</enum><header>Inapplicability</header><text>This section shall not apply within the area referred to in section 212(k)(2)(A).</text> </subsection> <subsection id="HCD5F624B5850466C851F2EBFB138E4A5"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> 
<paragraph id="H072B3F9418F147738C460A261F84EC94"><enum>(1)</enum><header>Commission</header><text display-inline="yes-display-inline">The term <term>Commission</term> means the Federal Energy Regulatory Commission.</text> </paragraph> <paragraph id="H572030118CC24F1182908CD9E0AEC02F"><enum>(2)</enum><header>Covered electric utility</header><text display-inline="yes-display-inline">The term <term>covered electric utility</term> means a person that sells electric energy, except—</text> 
<subparagraph id="H412D0D370D2847B9B5A7E5D570D68C7B"><enum>(A)</enum><text display-inline="yes-display-inline">an electric cooperative described in section 201(f);</text> </subparagraph> <subparagraph id="H19A8F3CD7A54450F93D4CE8AA34993C7"><enum>(B)</enum><text>an electric utility that is owned or operated by a State or political subdivision thereof;</text></subparagraph> 
<subparagraph id="HC0B7C2B476A542F7BF3B2CDA3D9ACDC0"><enum>(C)</enum><text display-inline="yes-display-inline">the Tennessee Valley Authority; and</text></subparagraph> <subparagraph id="H68D82563FBF64A35894D0FDE3547BB8D"><enum>(D)</enum><text>each Federal power marketing administration.</text></subparagraph> </paragraph></subsection></section> <after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H7A644DA2471642428F5CC2A2E5F29E53"><enum>(c)</enum><header>Penalties</header><text display-inline="yes-display-inline">The Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/792">16 U.S.C. 792 et seq.</external-xref>) is amended—</text> <paragraph id="H8B1286ED18D9430C80420F7D857A1E6D"><enum>(1)</enum><text>in section 221, by inserting <quote>, the price of electricity sold to data centers at retail and inputs to such price,</quote> after <quote>sold at wholesale</quote>;</text> </paragraph> 
<paragraph id="H79A0FDE417F3480388816F76B836C4F8"><enum>(2)</enum><text display-inline="yes-display-inline">in section 307(a), by inserting <quote>, the sale of electric energy at retail to data centers,</quote> after <quote>at wholesale in interstate commerce</quote>;</text></paragraph> <paragraph id="H27D2A348AAAD48A4A139C946A1554EA7"><enum>(3)</enum><text>in section 311, by striking <quote>and industrial</quote> and inserting <quote>data center, and industrial</quote>; and</text> </paragraph> 
<paragraph id="H217CEEFB34A64889BE710508392F956B" commented="no"><enum>(4)</enum><text>in section 316A(b)—</text> <subparagraph id="H5AAB327642A64C4884CEB076E44B8498" commented="no"><enum>(A)</enum><text>by striking <quote>Any person who violates any provision of part II</quote> and inserting the following:</text>

<paragraph id="H3006EE0E4D864128B20DC3C700042439" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Any person who violates any provision of part II, except for section 224,</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H4965C04C4C2D465B88F88EC25D070DCE" commented="no"><enum>(B)</enum><text>by striking <quote>Such penalty</quote> and inserting the following:</text> 
<quoted-block style="OLC" id="H0399A8B7E2D54EA685B1B60DC8116E18" display-inline="no-display-inline"> 
<paragraph id="H926F2F0C8E504F7280D55FE6E9BBDEFA" commented="no"><enum>(2)</enum><header>Data center violations</header><text display-inline="yes-display-inline">Any person who violates any provision of section 224 or any provision of any rule or order thereunder shall be subject to a civil penalty of not more than $10,000,000 for each day that such violation continues.</text></paragraph> <paragraph id="H6CF13C593EBE450C91A05E67B455FE9D" commented="no"><enum>(3)</enum><header>Assessment</header><text display-inline="yes-display-inline">A penalty under this subsection</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H0F24C49560D54DAFA5AF2B416F661B8A" commented="no"><enum>(C)</enum><text>by striking <quote>In determining the amount of a proposed penalty,</quote> and inserting the following:</text> <quoted-block style="OLC" id="H06F1CC7C7F7544DCBF14DC491CEB0C7D" display-inline="no-display-inline"> <paragraph id="H99145BA717EA4D4C9868751095663BA3" commented="no"><enum>(4)</enum><header>Penalty amount</header><text display-inline="yes-display-inline">In determining the amount of a proposed penalty under this subsection,</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph></paragraph></subsection> 
<subsection id="H74CE6BB022CF4AC39432E0FDC1A04453"><enum>(d)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 201(e) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824">16 U.S.C. 824(e)</external-xref>) is amended by striking <quote>or 222</quote> and inserting <quote>222, or 224</quote>.</text></subsection></section> <section id="H9AD67E08963F4D02A0953D4B10C613B1"><enum>4.</enum><header>Limitation on judicial enforceability of predispute nondisclosure contract clauses relating to the construction of data centers</header> <subsection id="HAE98237F8DA540648DF50E72AA3358EE"><enum>(a)</enum><header>In general</header> <paragraph id="HBD15AFA0C87C48BE80C9527544CF4745"><enum>(1)</enum><header>Enforceability against public officials</header><text>With respect to the construction of a data center, no predispute nondisclosure clause shall be judicially enforceable against a public official.</text></paragraph> 
<paragraph id="H3AC36445A5FC4BC2ABFD8D23C9F412C4"><enum>(2)</enum><header>Continued applicability of state law</header><text>This section shall not be construed to supersede a provision of State law that establishes, implements, or continues in effect a requirement or prohibition except to the extent that such requirement or prohibition prevents the application of this section.</text></paragraph></subsection> <subsection id="H20C87F04E95E42459DB89343EF966C09"><enum>(b)</enum><header>Applicability</header><text>This section shall apply with respect to a claim that is filed under Federal, State, or Tribal law on or after the date of the enactment of this Act.</text></subsection></section> 
<section id="HE7C1758329E1471DB40E7A77922C5A6B" display-inline="no-display-inline"><enum>5.</enum><header>Assessment of environmental and public health effects of data centers</header> <text display-inline="no-display-inline">The Administrator of the Environmental Protection Agency shall seek to enter into an agreement with the National Academies under which the National Academies shall—</text> <paragraph id="HE415B1843BFD474E8AA1E41BD5E8E0D0"><enum>(1)</enum><text>conduct an assessment of the impacts of data centers on the environment and public health, including with respect to—</text> 
<subparagraph id="H208B4FAFEB234D7296B159B262B80A32" display-inline="no-display-inline"><enum>(A)</enum><text>noise pollution;</text></subparagraph> <subparagraph id="HB8CD769D34184398AF9588A6B926065F"><enum>(B)</enum><text>air pollution;</text></subparagraph> 
<subparagraph id="HEEFDC94961AC4D039FBAD106676DB72E"><enum>(C)</enum><text>water consumption;</text></subparagraph> <subparagraph id="H124F6A4C3EE642DB9D3148FB25181C69"><enum>(D)</enum><text>water supply;</text></subparagraph> 
<subparagraph id="H0A90DA37365842518D852FA842E0D836"><enum>(E)</enum><text>carbon emissions; and</text></subparagraph> <subparagraph id="HC2297006D7D2495BB3F4F383E5D0B536"><enum>(F)</enum><text>waste, including electronic waste;</text> </subparagraph></paragraph> 
<paragraph id="HE78BE1DA08B6422491D24B5A99FA66E4"><enum>(2)</enum><text>develop recommendations to mitigate such impacts; and</text></paragraph> <paragraph id="HF2F2A02936B945099B50D408992161B1"><enum>(3)</enum><text display-inline="yes-display-inline">not later than 180 days after the date of the enactment of this Act, submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Environment and Public Works of the Senate a report containing the results of the assessment conducted under paragraph (1) and the recommendations developed under paragraph (2).</text></paragraph></section> 
<section id="H792A44F29F5B4919A42F4371AE3107AB"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act:</text> <paragraph id="HB8D7317FD0DB42B4B7BC098C6CF2FE48"><enum>(1)</enum><header>Data center</header><text display-inline="yes-display-inline">The term <term>data center</term> means—</text> 
<subparagraph id="H815B2D098AFD4AA3A60A13D4B231AEAA"><enum>(A)</enum><text>any facility that—</text> <clause id="H1277FBA1AF2B4433BDCED170FDC3E755"><enum>(i)</enum><text>is behind a single point of interconnection;</text> </clause> 
<clause id="H8D3A9D1027024C9988D99AE697FF53A9" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">primarily contains electronic equipment used to process, store, and transmit digital information; and</text> </clause> <clause id="H4654300DEC364836A6E3D266F69ED83B"><enum>(iii)</enum><text>has a peak electricity demand of greater than 50 megawatts; or</text></clause></subparagraph> 
<subparagraph id="H906AC6FB775E4C53B84C9D5371F3295A" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">any group of facilities—</text> <clause id="H72BF6EB193CE4B4A88EA29EB59FFC96A"><enum>(i)</enum><text display-inline="yes-display-inline">that are behind a single point of interconnection;</text></clause> 
<clause id="H53AFBF620C304BCAB2CB73A1189B446F"><enum>(ii)</enum><text>the majority of which primarily contain electronic equipment used to process, store, and transmit digital information; and</text></clause> <clause id="HD1A58C90B17B4B66AC537887C1FCB026"><enum>(iii)</enum><text display-inline="yes-display-inline">that, in the aggregate, have a peak electricity demand of greater than 50 megawatts.</text></clause></subparagraph></paragraph> 
<paragraph id="HB49886DAFB7641D48922594AFEFE5566"><enum>(2)</enum><header>National Academies</header><text display-inline="yes-display-inline">The term <term>National Academies</term> means the National Academies of Sciences, Engineering, and Medicine. </text></paragraph> <paragraph id="H6393C75B01A849A4A73F654D38C696A8"><enum>(3)</enum><header>Predispute nondisclosure clause</header><text>The term <term>predispute nondisclosure clause</term> means a provision in a contract or agreement agreed to before a lawsuit is filed under Federal, State, or Tribal law, that requires the parties to the contract or agreement not to disclose or discuss conduct, the existence of a settlement involving conduct, or information covered by the terms and conditions of the contract or agreement.</text></paragraph> 
<paragraph id="H92B13DEA3DA4433C9CD6F942A8E73032"><enum>(4)</enum><header>Public official</header><text display-inline="yes-display-inline">The term <term>public official</term> means an individual who, at the time a contract or agreement was agreed to, was an elected official of a Federal, State, or local unit of government in the United States.</text></paragraph></section> </legis-body></bill>
