<section id="HC491AB85E2D148FFA9D7ADA0A95B26E4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>System Integrity through Licensed Vault Expansion and Resilience Act</short-title></quote> or the <quote><short-title>SILVER Act</short-title></quote>.</text></section> <section id="H8C40A6EFB21549D3BDDDA6BC450A050D"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H08FE56988D964DDEA1BC0DF749C243BE"><enum>(1)</enum><text>Precious metals exchanges currently require physically traded metals to be stored within close proximity to New York City.</text></paragraph> <paragraph id="H3DB6CE0B63C64CB896DE888A19E4C61E"><enum>(2)</enum><text>Geographic concentration creates systemic risk vulnerabilities, reduces available liquidity, and increases the cost to market participants.</text></paragraph> 
<paragraph id="HBFF0EB90A4F64FF5A113D435333ECAC2"><enum>(3)</enum><text>Recent liquidity events in global metals markets underscore the need to minimize regulatory barriers that reduce the available supply of metals to the publicly traded marketplace.</text></paragraph> <paragraph id="HB41BBDC694734FB3BE35F3A85AA16E34"><enum>(4)</enum><text>Notwithstanding the current limited supply, the security standards of existing vaults supporting publicly traded exchanges are outstanding and have enhanced the confidence of market participants.</text></paragraph> 
<paragraph id="H361C4E5570C14991A3A9909242F7FD80"><enum>(5)</enum><text>Market liquidity and participant confidence will be enhanced by the addition of storage vaults of relative scale and commercial importance in the marketplace.</text></paragraph> <paragraph id="H2E9812C2515943CDA664B6612A40F0C5"><enum>(6)</enum><text>Additional supply in lower-cost markets, especially markets that are near hubs of precious metals activity and interstate transportation networks, would also reduce storage costs, enhance competition in the storage marketplace, and promote greater market access to investors.</text></paragraph> 
<paragraph id="H202112F8E28C4A8C98AFDCC3476FEAAD"><enum>(7)</enum><text>It is in the public interest for systemically important financial market utilities to provide a clear and transparent selection process for precious metals storage facilities within their network.</text></paragraph></section> <section id="H03F91CCC230B4874A042654DD1D8401A"><enum>3.</enum><header>Precious metals depositories used in connection with futures contracts</header><text display-inline="no-display-inline">Section 5b(c)(2) of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/7a-1">7 U.S.C. 7a–1(c)(2)</external-xref>) is amended—</text> 
<paragraph id="H2DDD670B1BED4229A501D7E375BB0BE8"><enum>(1)</enum><text>in subparagraph (E)(vii), by inserting <quote>, including risks related to the geographic concentration of depositories for the storage of gold, silver, platinum, and palladium (referred to in this paragraph as <quote>precious metals</quote>),</quote> after <quote>clause (vi)</quote>;</text></paragraph> <paragraph id="HC2D56A66821D4009A773C3A74BA42DA9"><enum>(2)</enum><text>in subparagraph (F)—</text> 
<subparagraph id="HC6E1AC31D2A948DEAABA664EB0A25951"><enum>(A)</enum><text>by redesignating clause (iii) as clause (iv); and</text></subparagraph> <subparagraph id="H5FFC246C83924ECF93F672AD5616AC37"><enum>(B)</enum><text>by inserting after clause (ii) the following:</text>

<clause id="H07DDEB6EA6364BDFAFB37082E4A612E0"><enum>(iii)</enum><header>Approval of precious metals depositories</header> 
<subclause id="H6ACE4833CD3049B19A20D029A44A135A"><enum>(I)</enum><header>In general</header><text>A derivatives clearing organization shall—</text> <item id="H3097E1B37E074AA3A0E7DB348204B399"><enum>(aa)</enum><text>develop, publish, and employ objective and transparent criteria in evaluating and selecting depositories for the storage of precious metals used in connection with a contract of sale of a commodity for future delivery; and</text></item> 
<item id="H5D6C6A0BD8EF475CB9CEC0E24D6A0126"><enum>(bb)</enum><text>provide a formal process for those depositories to apply for that selection.</text></item></subclause> <subclause id="H90C14C0819D24DF68FA3F65CB65C9F96"><enum>(II)</enum><header>Selection factors</header><text>In selecting depositories under subclause (I), a derivatives clearing organization shall—</text> 
<item id="H6B85E88D70374102B8E4F4A7AE05A0AD"><enum>(aa)</enum><text>assess and account for, among other factors, geographic diversity, competition, risk management, storage costs to members and participants, and systemic risk implications; and</text></item> <item id="H2C1256ABF0594B33920ECFE918EC7566"><enum>(bb)</enum><text>approve new depositories in the context of a public interest in increased geographic diversity, increased liquidity, market resiliency, market access, competition, and cost efficiency, consistent with appropriate security and quality standards.</text></item></subclause> 
<subclause id="H7B0E95474A9E4AE0A51BC808C8970345"><enum>(III)</enum><header>Geographical requirement</header> 
<item id="HCB48B673146B4FEAA127D68E4AB1084D"><enum>(aa)</enum><header>In general</header><text>A derivatives clearing organization shall select at least 2 depositories described in subclause (I) in each time zone described in item (bb).</text></item> <item id="HABD57C369E6746D58FAF91EDD4929BEA"><enum>(bb)</enum><header>Time zone</header><text>A time zone referred to in item (aa) is each of the following:</text> 
<subitem id="H14B46FA982214877A8CFC1935DFB515A"><enum>(AA)</enum><text>Eastern time.</text></subitem> <subitem id="H79F85F4CB06C4018852294E9A4985802"><enum>(BB)</enum><text>Central time.</text></subitem> 
<subitem id="HB8543CB8976D4755BD977BB1A5AE838B"><enum>(CC)</enum><text>Mountain time.</text></subitem> <subitem id="HCC45C3ADCC3747E58EF2A01936E983CD"><enum>(DD)</enum><text>Pacific time.</text></subitem></item></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HE8E5D98BFBF14C50BDC98D58D558555F"><enum>(3)</enum><text>in subparagraph (I)—</text> <subparagraph id="H2567338E38BA4209B183E1FCEDA72FF9"><enum>(A)</enum><text>in clause (ii)(II), by striking <quote>and</quote> at the end;</text></subparagraph> 
<subparagraph id="HEAA3F8573D24450BB0F4AC7C42CB92F7"><enum>(B)</enum><text>in clause (iii), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph> <subparagraph id="H00029C08D72743F2B74F44EDF12212B3"><enum>(C)</enum><text>by adding at the end the following:</text>

<clause id="HA2404317F7BA43768A16C8F5219B9277"><enum>(iv)</enum><text>periodically assess the ease of access for market participants with respect to the physical settlement of any commodity, regardless of the geographic location within the United States, to ensure system availability and resiliency.</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H4252FF375DD94814BE393268B5763823"><enum>(4)</enum><text>in subparagraph (L)(iii)—</text> 
<subparagraph id="H3B6EB113C6854D4EB0008D1609E6C607"><enum>(A)</enum><text>in subclause (IV), by striking <quote>and</quote> at the end;</text></subparagraph> <subparagraph id="H486019F65330480C96386E48FEAC127D"><enum>(B)</enum><text>by redesignating subclause (V) as subclause (VI); and</text></subparagraph> 
<subparagraph id="H5A7F2C193F36423990D53674A09E1F84"><enum>(C)</enum><text>by inserting after subclause (IV) the following:</text> <quoted-block id="HBFACA40C6A8840D8ACACA3059953C0D4" style="OLC"> <subclause id="H01193D9D15514EE6A0C70F06FE639156"><enum>(V)</enum><text>conditions for applying to, and receiving approval from, the derivatives clearing organization as a metal service provider, such as a depository for the storage of precious metals; and</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HB487865EA0A54237B2A633617ADE0C31"><enum>(5)</enum><text>in subparagraph (N)(i), by inserting <quote>, including with respect to the approval of a metal service provider, such as a depository for the storage of precious metals</quote> after <quote>trade</quote>.</text></paragraph></section> </legis-body></bill>
