<official-title display="yes">To amend the Controlled Substances Act to prevent the misuse of a tableting machine, encapsulating machine, or critical part of a tableting and encapsulating machine for the illicit manufacture of a controlled substance or listed chemical, and for other purposes.</official-title>

<section id="HD943A8AC926A4673A95EDA84D032E55B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Pills That Kill Act</short-title></quote>.</text></section> <section id="H54D3A87FB139461B844E11E49E1A27CF"><enum>2.</enum><header>Regulation of certain machines</header> <subsection id="HDEC6051BA15E428991DB8A607FC8FDFC"><enum>(a)</enum><header>Definitions</header><text>Section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>) is amended—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H958CDF3B5DE94AD089A9FD6FF1163DC3"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraph (38) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HDB27C7907DED4303B2341A8E77CF783E"> <paragraph id="H735BB191BBC04C75A6521940BAAA52CA" indent="up1"><enum>(38)</enum><text>The term <term>regulated person</term> means a person who—</text> 
<subparagraph id="H608FBED085E0446FBD4041067EC2BC97"><enum>(A)</enum><text>manufactures, distributes, imports, or exports a listed chemical;</text></subparagraph> <subparagraph id="H488C777F4E3C482B9D82AC719A882204"><enum>(B)</enum><text display-inline="yes-display-inline">manufactures, distributes, delivers, sells, imports, or exports a tableting machine, encapsulating machine, or critical part of a tableting or encapsulating machine; or</text></subparagraph> 
<subparagraph id="HDFA93B6B6FD44DC6BC6EE480A567496E"><enum>(C)</enum><text>acts as a broker or trader for a regulated transaction involving a listed chemical, tableting machine, encapsulating machine, or critical part of a tableting or encapsulating machine.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H7D3CD2EAEAA54225AD95BBAC31113B9D"><enum>(2)</enum><text>by striking paragraph (39)(B) and inserting the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HDBFA8C30C0DD46DB99A0D0B6BD940EB1"> 
<subparagraph id="H549E468854644BAB95B7F28D6FC80CCB" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">a distribution, delivery, sale, importation, exportation, or international transaction of a tableting machine, encapsulating machine, or critical part of a tableting or encapsulating machine.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="H4F7CDD85F9184438A0A4A8F4069D645E"><enum>(3)</enum><text>in paragraph (42), by inserting <quote>, tableting machine, encapsulating machine, or critical part of a tableting or encapsulating machine</quote> after <quote>listed chemical</quote>;</text></paragraph> 
<paragraph id="HF30D688228F0483B838D8D64FA081E71"><enum>(4)</enum><text display-inline="yes-display-inline">in paragraph (43), in the matter preceding subparagraph (A)—</text> <subparagraph id="H0F3CACA570AF46918456B146C828AB01"><enum>(A)</enum><text>by striking <quote>an international</quote> and inserting <quote>a regulated</quote>; and </text></subparagraph> 
<subparagraph id="HAA1F405D80E84AE98A052B900F5A40F2"><enum>(B)</enum><text>by inserting <quote>, tableting machine, encapsulating machine, or critical part of a tableting or encapsulating machine</quote> after <quote>listed chemical</quote>; and</text></subparagraph></paragraph> <paragraph id="HE0F04AB13BE8413B932796C2DA734FEB"><enum>(5)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HEA918F0C1EDA459FAED97F5A23D5A6A4"> 
<paragraph id="HAE32F38602C84EE1A08E280E98E94120" indent="up1"><enum>(61)</enum><text display-inline="yes-display-inline">The term <term>critical part</term>, when used in reference to a tableting or encapsulating machine, means any of the following integral parts of a tableting or encapsulating machine:</text> <subparagraph id="HB46E5F3158D94FFF9EDF1A435220A22C"><enum>(A)</enum><text>An upper punch.</text></subparagraph> 
<subparagraph id="H05E4AE756F9B4882B27FC3B8F257643B"><enum>(B)</enum><text>A lower punch.</text></subparagraph> <subparagraph id="H4103F66FDF814E9DB261D4DB109ACC05"><enum>(C)</enum><text>A die.</text></subparagraph> 
<subparagraph id="H07259F85EB214B809A6D915B1BE73291" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">Any additional parts that the Attorney General has determined to be integral to the operation of a tableting or encapsulating machine, provided that such determination—</text> <clause id="H662B0A8F652F45C8B61735B2E0197784" commented="no"><enum>(i)</enum><text>is made through rulemaking; and</text></clause> 
<clause id="HCC2B82522A22437F986C7759AA94E6C4" commented="no"><enum>(ii)</enum><text>does not go into effect until the rulemaking process has been completed.</text></clause></subparagraph></paragraph> <paragraph id="H17BA2A1524764B569EB070A900A88D89" indent="up1"><enum>(62)</enum><text>The term <term>die</term> means a tool that serves as the mold in which a product is compressed to form the desired size and shape of a tablet or capsule.</text></paragraph> 
<paragraph id="HF1EFFE6C9F684D0FB6D19BB1681FD79C" indent="up1"><enum>(63)</enum><text>The term <term>lower punch</term> means the punch inserted into the turret below the die.</text></paragraph> <paragraph id="H3E72E7A665144B7CB46355C48B545D34" indent="up1"><enum>(64)</enum><text>The term <term>punch</term> means a rod-shaped tool used in producing tablets and other products.</text></paragraph> 
<paragraph id="HD07C12CC63FB41D2A9BB949741525E8C" indent="up1"><enum>(65)</enum><text>The term <term>upper punch</term> means the punch inserted into the turret above the die.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H99E559F5003345138B5C7EFB7C5AC303"><enum>(b)</enum><header>Regulation</header> <paragraph id="HF231895CED984066AF8EDA5E9BF256C6"><enum>(1)</enum><header>Records of regulated transactions</header><text>Section 310(a) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/830">21 U.S.C. 830(a)</external-xref>) is amended—</text> 
<subparagraph id="HA27F704A1B5E444D9C0852F882C8DDD1"><enum>(A)</enum><text>in paragraph (1), by striking <quote>or an encapsulating machine</quote> and inserting <quote>, encapsulating machine, or critical part of a tableting or encapsulating machine</quote>; and</text></subparagraph> <subparagraph id="H98ECC7021AA84996B1717615085F46E6"><enum>(B)</enum><text>in paragraph (2)—</text> 
<clause id="HF6148CFCE5FB4A4FA89315BE58A138D0"><enum>(i)</enum><text>by striking <quote>or encapsulating machine</quote> and inserting <quote>, encapsulating machine, or critical part of a tableting or encapsulating machine</quote>; and</text></clause> <clause id="H48F8078737664A24BEDBB069FD0E9F35"><enum>(ii)</enum><text>by inserting before the period at the end the following: <quote>and shall identify the tableting machine, encapsulating machine, or critical part of a tableting or encapsulating machine by means of a serial number that is engraved, cast, or otherwise permanently affixed to a nonremovable part of the tableting machine, encapsulating machine, or critical part of a tableting or encapsulating machine</quote>. </text></clause></subparagraph></paragraph> 
<paragraph id="HA81520110B964FE799702ECD1FF294D8"><enum>(2)</enum><header>Reports to attorney general</header><text>Section 310(b)(1) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/830">21 U.S.C. 830(b)(1)</external-xref>) is amended by striking subparagraph (D) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H15135EA21F5348ADA6DBC1D4B842C14C"> <subparagraph id="H272D04D6CD944A1B8D4F24B06C1052B0" indent="up1" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">any regulated transaction in a tableting machine, encapsulating machine, or critical part of a tableting or encapsulating machine, including the serial number affixed to the tableting machine, encapsulating machine, or critical part of a tableting or encapsulating machine.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H180ABEC07B2B41FB846B72995DDAEFE4"><enum>(3)</enum><header>Regulations</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="HD47AF709E526428EBAFB974E8D3CE747"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Attorney General shall promulgate regulations carrying out the amendments made by paragraphs (1) and (2).</text></subparagraph> <subparagraph id="HB9E8BD1715E9410687C105C8CE666EB2"><enum>(B)</enum><header>Inclusion</header><text>The regulations required under subparagraph (A) shall include requirements regarding serial numbers affixed to tableting machines, encapsulating machines, or critical parts of tableting or encapsulating machines manufactured on or before the date of enactment of this Act.</text></subparagraph></paragraph> 
<paragraph id="H972FCF26251444B0812FD9E9E7B132C6"><enum>(4)</enum><header>Applicability</header> 
<subparagraph id="HCD64406A13EE4137BDA88F8FA7909376"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as specified in subparagraph (B), the amendments made by paragraphs (1) and (2) shall apply only to any tableting machine, encapsulating machine, or critical part of a tableting or encapsulating machine manufactured, distributed, delivered, sold, imported, exported, or included in an international transaction after the effective date of the regulations promulgated under paragraph (3).</text></subparagraph> <subparagraph id="HC99643145ABA4C7398D0AFC048624092"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">Beginning on the date that is 180 days after the date of the enactment of this Act, the amendments made by paragraph (1) of this subsection to paragraphs (1) and (2) of section 310(a) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/830">21 U.S.C. 830(a)</external-xref>) shall apply with respect to a tableting machine, encapsulating machine, or critical part of a tableting or encapsulating machine manufactured on or before the date of enactment of this Act.</text></subparagraph></paragraph></subsection> 
<subsection id="HEB6A2479A7E24A61800B4A3FA297FCF5"><enum>(c)</enum><header>Prohibited acts</header><text>Section 403(a) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/843">21 U.S.C. 843(a)</external-xref>) is amended—</text> <paragraph id="H1E76E2B49E1B474A8017C68D898EB257"><enum>(1)</enum><text>in paragraph (8), by striking <quote>or</quote> at the end;</text></paragraph> 
<paragraph id="HFCD4D9A94AC54E1DBEF884DE787BDCC0"><enum>(2)</enum><text>in paragraph (9), by striking the period at the end and inserting a semicolon; and</text></paragraph> <paragraph id="HBA1B5BCE3AFC4BEFA47D04F401767844"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H95476064EDB048D7887DDDA979058C9D"> 
<paragraph id="H68DC40156A194D5C8B76ED0637705EE3"><enum>(10)</enum><text>to remove, alter, or obliterate any serial number affixed to a tableting machine, encapsulating machine, or critical part of a tableting or encapsulating machine, that is required to have a serial number and with reasonable cause to believe the serial number is so required; or</text></paragraph> <paragraph id="H27D1E47C3CBF4CC0BE34DA5FA3FDDA98"><enum>(11)</enum><text>to transport, ship, receive, possess, distribute, deliver, sell, import, or export a tableting machine, encapsulating machine, or critical part of a tableting or encapsulating machine that is required to have a serial number, knowing that the serial number has been removed, altered, or obliterated, and with reasonable cause to believe the serial number is so required.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="H89CC9EB485D245E38DF5BF97FAE575F4"><enum>3.</enum><header>Providing for extraterritorial jurisdiction</header> 
<subsection id="HF8CABE0635C14CD38F0EAF4C46CE80BB"><enum>(a)</enum><header>Possession, manufacture, or distribution for purposes of unlawful importation</header><text display-inline="yes-display-inline">Section 1009 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/959">21 U.S.C. 959</external-xref>) is amended—</text> <paragraph id="H75FFA97BEED740E7AA1D8B69CE4989D6"><enum>(1)</enum><text>by redesignating subsections (c) and (d) as subsections (d) and (e), respectively;</text></paragraph> 
<paragraph id="H94EBA2A19EAE4A8EB75D97071948F96C"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text> <quoted-block style="OLC" id="HBC96925AAF414F3AAFBB698305083801" display-inline="no-display-inline"> <subsection id="HA034561A637147749B5E6F53E30C4130"><enum>(c)</enum><text display-inline="yes-display-inline">It shall be unlawful for any person to manufacture or distribute a tableting machine, encapsulating machine, or critical part of a tableting or encapsulating machine—</text> 
<paragraph id="H27917DF03AD64F39A046DF0AC5027504"><enum>(1)</enum><text display-inline="yes-display-inline">intending or knowing that the tableting machine, encapsulating machine, or critical part of a tableting or encapsulating machine will be used to illicitly manufacture a controlled substance or listed chemical; and</text></paragraph> <paragraph id="HA91562DC4B6D49758E736BC00DDDFB32"><enum>(2)</enum><text display-inline="yes-display-inline">intending, knowing, or having reasonable cause to believe that the tableting machine, encapsulating machine, or critical part of a tableting or encapsulating machine will be unlawfully imported into the United States.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H499641B3D47B458EA4017832931FC1A1"><enum>(3)</enum><text>in subsection (d), as so redesignated—</text> <subparagraph id="H306A2404B14C4BDF93873DAD7EF605D9"><enum>(A)</enum><text>in paragraph (1), by striking <quote>or</quote> at the end;</text></subparagraph> 
<subparagraph id="H251E48FD2A1A421A99C787EC9560A5C3"><enum>(B)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph> <subparagraph id="HA40370D667B340F78D099AF6365A5864"><enum>(C)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="HC718A4780A424739AE1472A47111C644" display-inline="no-display-inline"> 
<paragraph id="H9129353D76474D838909D2AE993FFB21"><enum>(3)</enum><text display-inline="yes-display-inline">manufacture or distribute a tableting machine, encapsulating machine, or critical part of a tableting or encapsulating machine—</text> <subparagraph id="HD230E26DA12F42FB8D0381BE8DF5E63C" commented="no"><enum>(A)</enum><text>intending or knowing that the tableting machine, encapsulating machine, or critical part of a tableting or encapsulating machine will be used to illicitly manufacture a controlled substance or listed chemical; and</text></subparagraph> 
<subparagraph id="H55FFA5AD0270448F96C4DDD229E8C7EA" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">intending, knowing, or having reasonable cause to believe that the tableting machine, encapsulating machine, or critical part of a tableting or encapsulating machine will be unlawfully imported into the United States.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> <subsection id="H47D01A039874455BA075B961F63F66EB"><enum>(b)</enum><header>Prohibited acts</header><text>Section 1010 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/960">21 U.S.C. 960</external-xref>) is amended—</text> 
<paragraph id="H0DD2ADF976F44112B9E1DE5E162BCE9B"><enum>(1)</enum><text>in subsection (d)—</text> <subparagraph id="HC1DED86D0862458ABBAAD641AF4447B1"><enum>(A)</enum><text>in paragraph (6), by striking <quote>or</quote> at the end;</text></subparagraph> 
<subparagraph id="HE8A80D1C731F48CB93B823FB710589BB"><enum>(B)</enum><text>in paragraph (7)—</text> <clause id="H8C3CBBCBFFFB4C96A85B7450275B8F74"><enum>(i)</enum><text>by striking <quote>section 959 of this title</quote> and inserting <quote>section 1009</quote>; and</text></clause> 
<clause id="H151F48150F9F4ECE8FAC6C2FC4008383"><enum>(ii)</enum><text>by striking the period at the end and inserting <quote>; or</quote>;</text></clause></subparagraph> <subparagraph id="H255629749C794134B5E138AE27F0E5B6"><enum>(C)</enum><text>by inserting after paragraph (7) the following:</text> 
<quoted-block style="OLC" id="H6A853525CE834D97936992E17B76E752" display-inline="no-display-inline"> 
<paragraph id="H67910C8FBECC4F5091265F72B96CDE43"><enum>(8)</enum><text display-inline="yes-display-inline">manufactures or distributes a tableting machine, encapsulating machine, or critical part of a tableting or encapsulating machine in violation of section 1009,</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="HB5A2B57FCB164D398C9297759C586D76"><enum>(D)</enum><text>in the matter following paragraph (8), as so inserted, by striking <quote>shall be fined</quote> and all that follows through <quote>or both</quote> and inserting the following: <quote>shall be fined in accordance with title 18, United States Code, imprisoned for the applicable period described in subsection (e), or both</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H0FB70E6D6C5B4DD6B03F84B8AC875B2C"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="HED9E7EF43F3242328C28304CA5481419" display-inline="no-display-inline"> <subsection id="H7651A6251BDC4868BA47B9C0165E65EA"><enum>(e)</enum><text display-inline="yes-display-inline">The applicable period described in this subsection is the following:</text> 
<paragraph id="HD9C4B5F401324746B2DF0B13AE7A07B8"><enum>(1)</enum><text>In the case of a violation of paragraph (1) or (3) of subsection (d) involving a list I chemical, not more than 20 years.</text></paragraph> <paragraph id="H33CBE6F80A234881878B0820B73FC874"><enum>(2)</enum><text>Subject to paragraph (4), in the case of a violation of paragraph (7) of subsection (d), not more than 10 years.</text></paragraph> 
<paragraph id="H9D01E544BAAD4563B3241181DBAF7CBB"><enum>(3)</enum><text>Subject to paragraph (4), in the case of a violation of paragraph (8) of subsection (d), not more than 8 years.</text></paragraph> <paragraph id="H652859D1F33A459B9676718F852795DA"><enum>(4)</enum><text display-inline="yes-display-inline">In the case of a violation of paragraph (7) or (8) of subsection (d) that involves more than 1,000 kilograms of a chemical or product or more than 100 machines that are tableting machines or encapsulating machines, not more than 15 years.</text></paragraph> 
<paragraph id="H0521C1FDAC374FECB3FC6C0D8B156724"><enum>(5)</enum><text display-inline="yes-display-inline">In the case of any other violation of subsection (d), not more than 10 years.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H5C9045D71F6A46799E74AC147D727920"><enum>(c)</enum><header>United States Sentencing Commission</header><text display-inline="yes-display-inline">Pursuant to its authority under section 994(p) of title 28, United States Code, the United States Sentencing Commission shall review and amend the Federal sentencing guidelines and policy statements of the Commission in accordance with this Act and the amendments made by this Act.</text></subsection></section> 
<section id="HA5AF4B4D82D14115A655FCB9CEF2E7B7"><enum>4.</enum><header>Counterfeit pills containing an illicit synthetic substance</header> 
<subsection id="HEB4C4A4DB34A40B5ABDE32603624912B"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline">In this Act, the term <quote>counterfeit pill containing an illicit synthetic substance</quote> means a substance in pill or tablet form that—</text> <paragraph id="HC5EF0EA257A14F318999F4FE46BB5BCB"><enum>(1)</enum><text>is a counterfeit substance, as defined in section 102(7) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802(7)</external-xref>); and</text></paragraph> 
<paragraph id="H6F4E0341F6EA4397943005553D5A676B"><enum>(2)</enum><text display-inline="yes-display-inline">contains fentanyl, an analogue of fentanyl, a fentanyl-related substance, methamphetamine, an illicit depressant or stimulant substance, an illicit narcotic, or an illicit synthetic opioid.</text></paragraph></subsection> <subsection id="HAAAD839A5B9F42B4878AECEBBD97F96E"><enum>(b)</enum><header>Prohibited acts</header><text>Section 403(d)(2) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/843">21 U.S.C. 843(d)(2)</external-xref>) is amended, in the matter preceding subparagraph (A), by inserting <quote>, fentanyl, an analogue of fentanyl, or a fentanyl-related substance</quote> after <quote>methamphetamine</quote>.</text></subsection> 
<subsection id="HA41AED6CEF86451FBE86B6A365860C3D"><enum>(c)</enum><header>Comprehensive plan</header> 
<paragraph id="H2E44AE503B3D47028FBC22B78A12B1FA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator of the Drug Enforcement Administration shall establish and implement an operation and response plan to address counterfeit pills containing an illicit synthetic substance.</text></paragraph> <paragraph id="HD78FE9A69826483FB9EA8A25CC50B708"><enum>(2)</enum><header>Contents</header><text>The plan required under paragraph (1) shall include—</text> 
<subparagraph id="H5FE9997F64A643A58E6B40CBA6F3AFD0"><enum>(A)</enum><text display-inline="yes-display-inline">strategies to enable and empower Federal law enforcement efforts to investigate and seize counterfeit pills containing an illicit synthetic substance;</text></subparagraph> <subparagraph id="H31FCA4EB483E416C958BDA2A6FA74B9A"><enum>(B)</enum><text display-inline="yes-display-inline">specific ways that education and prevention efforts to stop the use of counterfeit pills containing an illicit synthetic substance will be increased, including—</text> 
<clause id="H71D118C698044BD7BADBCE6E55D5C40E"><enum>(i)</enum><text>how ongoing efforts, such as Operation Engage, are effective in increasing education and prevention; and</text></clause> <clause id="H7E934A90D9BB4C72BEDF5A5ED5402A82"><enum>(ii)</enum><text display-inline="yes-display-inline">how such ongoing efforts are tailored to youth and teen access; and</text></clause></subparagraph> 
<subparagraph id="H08B7014BA1B442FCADA03F4E8AEA41CA"><enum>(C)</enum><text display-inline="yes-display-inline">an audit of current campaigns on counterfeit pills containing an illicit synthetic substance, including a review of data and other available information on how the campaigns can be tailored, adjusted, or improved to better address the flow of such counterfeit pills.</text></subparagraph></paragraph> <paragraph id="H37549AEB7BA7445BBB3277F48FBDFBD4"><enum>(3)</enum><header>Report to Congress</header> <subparagraph id="H62CA204430714F36863DB6CB217E04B9"><enum>(A)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, and every year thereafter through fiscal year 2031, the Attorney General, in consultation with the Administrator of the Drug Enforcement Administration and the Director of the Office of National Drug Control Policy, shall submit to Congress a report containing information regarding the collection of counterfeit pills containing an illicit synthetic substance and prosecutions undertaken in connection with such counterfeit pills.</text></subparagraph> 
<subparagraph id="H7BA3F7EA794B4A0EAC7777B13B015018"><enum>(B)</enum><header>Contents</header><text>The report required under subparagraph (A) shall include the following:</text> <clause id="HBE4D462AE7E54E4E935C1B2F128350A5"><enum>(i)</enum><text display-inline="yes-display-inline">Data on the aggregate number of counterfeit pills containing an illicit synthetic substance that have been seized and collected by Federal law enforcement agencies.</text></clause> 
<clause id="H04C0004AF0394DAE8A926F89E477CCD0"><enum>(ii)</enum><text display-inline="yes-display-inline">A description of pharmaceutical markings used for counterfeit pills containing an illicit synthetic substance, including how the markings compare to required labeling for products approved by the Food and Drug Administration.</text></clause> <clause id="H70396FE8E04240C988BB66B678E0CD21"><enum>(iii)</enum><text display-inline="yes-display-inline">A breakdown of which illicit substances are present in counterfeit pills containing an illicit synthetic substance.</text></clause> 
<clause id="H89FE2C15FB5C407E93553C1248365738"><enum>(iv)</enum><text display-inline="yes-display-inline">Data outlining the geographic origin and points of seizure of counterfeit pills containing an illicit synthetic substance.</text></clause> <clause id="H82F722F3C0AE4C77A22AEDA713551A8F"><enum>(v)</enum><text display-inline="yes-display-inline">Data on the charges filed pursuant to paragraph (1) or (2) of section 401(a) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841(a)</external-xref>) in relation to counterfeit pills containing an illicit synthetic substance, unless disclosure of the data would—</text> 
<subclause id="H3797761CA9DC407490C522B90D5DA3E8" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">require unsealing an indictment; or</text></subclause> <subclause id="H8F4FF19350804C5B84CC45C8937A2763" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">undermine investigations and charges brought by the Department of Justice.</text></subclause></clause> 
<clause id="H6E8C9AB29D9542B6A7B172A83D89C700"><enum>(vi)</enum><text display-inline="yes-display-inline">Data on the convictions and sentences against those who are found guilty under paragraph (1) or (2) of section 401(a) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841(a)</external-xref>) as it pertains to counterfeit pills containing an illicit synthetic substance.</text></clause> <clause id="HC22810AF3F704E3291B38213F9F28AFF"><enum>(vii)</enum><text display-inline="yes-display-inline">Any prevention measures that the Department of Justice, the Drug Enforcement Administration, or the Office of National Drug Control Policy are undertaking to limit and reduce the spread of counterfeit pills containing an illicit synthetic substance, including ongoing public awareness campaigns.</text></clause></subparagraph></paragraph></subsection></section>
