<section id="H913096AF2A7D4D3D9901913D2FB7B8E1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>DHS Use of Force Transparency Act of 2026</short-title></quote>.</text></section> <section id="H5F0BBCCEB72742E29991F7C20F42E081"><enum>2.</enum><header>Production of documents and materials relating to specified use of force incidents</header> <subsection id="HB3FD8847292D4F5FAB3A74ED1E0C8395"> <enum>(a)</enum> <header>Requirement To produce documents and materials</header> <text display-inline="yes-display-inline">Not later than 30 calendar days after the date of enactment of this Act, the Secretary of Homeland Security shall provide to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Government Reform of the House of Representatives all documents, records, data, and materials in the possession, custody, or control of the Department of Homeland Security (including its components, offices, and subagencies) relating to the following incidents:</text>
        <paragraph id="H08E20353F35F4E4DA8BB179970A1CB73">
          <enum>(1)</enum>
 <text>Each officer or agent involved shooting of the Department of Homeland Security, occurring on or after January 20, 2025, that results in a wound to or death of an individual.</text>
        </paragraph>
        <paragraph id="HD3ACE64EEA8041BDB87D2B6A1B12277A">
          <enum>(2)</enum>
 <text display-inline="yes-display-inline">Any death, occurring on or after January 20, 2025, when in the custody of the Department of Homeland Security.</text>
        </paragraph>
      </subsection> 
<subsection id="H84EA84CFD6D64A1EA0C7152C3DAC7D0D"><enum>(b)</enum><header>Scope of required production</header><text>The materials required under subsection (a) shall include the following:</text> <paragraph id="H8D50377967D443CF8C9AD020A8E84EEF"><enum>(1)</enum><text>All body worn camera footage, dashboard camera footage, surveillance footage, unmanned aerial system footage, or any other video or audio recordings capturing the incidents or events immediately preceding or following the incidents.</text></paragraph> 
<paragraph id="H609BC6F941474DB89952225061FE2FAB"><enum>(2)</enum><text>All written reports, including—</text> <subparagraph id="HBE90403FFCE647E18F7FE26DE5CC70A5"><enum>(A)</enum><text>initial incident reports;</text></subparagraph> 
<subparagraph id="HF5526EDCDFA342C7BAF84CF2BC16120C"><enum>(B)</enum><text>use of force reports;</text></subparagraph> <subparagraph id="H32ECA210F3A04E469E609000F59E9122"><enum>(C)</enum><text>after action reports;</text></subparagraph> 
<subparagraph id="HD4FA3265C3774A37811904A79ED0A2F6"><enum>(D)</enum><text>supervisory reviews;</text></subparagraph> <subparagraph id="H1E1B899D53C9439381FF9DD3F6AAED1A"><enum>(E)</enum><text>internal affairs or investigative files of the Offices of Professional Responsibility of U.S. Immigration and Customs Enforcement and U.S. Customs and Border Protection;</text></subparagraph> 
<subparagraph id="H365BC59BBA83400EBF7E9EDDFDD31528"><enum>(F)</enum><text>witness statements;</text></subparagraph> <subparagraph id="H494DD8E8CC9A456EA2A336CBBD68B79B"><enum>(G)</enum><text>officer statements;</text></subparagraph> 
<subparagraph id="H77AC5853AD1F4693B2A5A795785E3376"><enum>(H)</enum><text>medical response reports; and</text></subparagraph> <subparagraph id="H2DE3D226B27F473FBCF8C59EAF46E6BE"><enum>(I)</enum><text>communications logs, including dispatch records.</text></subparagraph></paragraph> 
<paragraph id="HC65643093B0E4B30B570689C1D4DA49A"><enum>(3)</enum><text>All communications, including—</text> <subparagraph id="H244D77247F134A76BD8E224967929ED4"><enum>(A)</enum><text>emails, text messages, encrypted messaging app communications, or other electronic communications by personnel of the Department of Homeland Security relating to the incidents;</text></subparagraph> 
<subparagraph id="HEC78D79436414E43BC0949EF38D5731C"><enum>(B)</enum><text display-inline="yes-display-inline">communications between the Department of Homeland Security and State or local law enforcement agencies; and</text></subparagraph> <subparagraph id="HE1521A6A0CB54D0194F8AC2E25C65DBD"><enum>(C)</enum><text display-inline="yes-display-inline">communications with Department of Homeland Security leadership regarding the incidents.</text></subparagraph></paragraph> 
<paragraph id="H076090301FF545FE95923243910C3DF8"><enum>(4)</enum><text>All relevant policies and training materials, including—</text> <subparagraph id="HB339D28D3EF9448ABFD10F0AC21A00A6"><enum>(A)</enum><text>use of force policies in effect at the time of the incidents;</text></subparagraph> 
<subparagraph id="H618583DAF5AD42CC85F484BE445E34AB"><enum>(B)</enum><text>training records for the involved officers and agents of the Department of Homeland Security; and</text></subparagraph> <subparagraph id="H7B560417521E40FC96E5B568DCC12591"><enum>(C)</enum><text>any policy deviation reports or waivers.</text></subparagraph></paragraph> 
<paragraph id="HC82E2A991DD1423EA8FA09D137C5B26F"><enum>(5)</enum><text>All photographic evidence, including crime scene photographs, still images extracted from video, and forensic documentation.</text></paragraph> <paragraph id="H7520FF0A18B241DC9368BDDA004FFA0D"><enum>(6)</enum><text display-inline="yes-display-inline">All administrative or disciplinary records relating to the officers and agents of the Department of Homeland Security involved, including any actions taken as a result of the incidents.</text></paragraph> 
<paragraph id="H21B28EC86FC24D83AAED954639298C74"><enum>(7)</enum><text display-inline="yes-display-inline">Any additional materials that the Department of Homeland Security determines to be relevant to congressional oversight of the incidents.</text></paragraph></subsection> <subsection id="HCFF36B75A9344ABBA9C5F903D4EFAEAA"><enum>(c)</enum><header>Form of production</header><text>Materials shall be produced in unredacted form to the maximum extent permitted by law. If redactions are made, the Secretary of Homeland Security shall provide a written justification for each redaction, including citation to the specific legal authority relied upon.</text></subsection></section>
