<section id="HEC89837BA4634C6C810CA89158FC65CC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Public Lands Access Restoration Act</short-title></quote>.</text></section> <section id="H03D84E7D6A094393A1C3EB4028521CAB"><enum>2.</enum><header>Restoration of Historic Access Policy</header> <subsection id="HACDA3DFFE42E479A9C95F4B3F4FA32A9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act—</text> 
<paragraph id="H265C61AF7E164A9FB9476D46F8B11F3E"><enum>(1)</enum><text>a covered road or trail shall be presumed to be open to motorized access unless the Secretary concerned restricts motorized access to the covered road or trail in accordance with subsection (b); and</text></paragraph> <paragraph id="H98838F24A45F4AB9B6F5C381CCC4BC12"><enum>(2)</enum><text>the Secretary concerned shall issue or revise regulations as necessary to implement paragraph (1).</text></paragraph></subsection> 
<subsection id="H1AE2C50FF64342488E4269BCDF84117D"><enum>(b)</enum><header>Standards for restriction</header><text>The Secretary concerned may only restrict motorized access to a covered road or trail if—</text> <paragraph id="H5F2476C18511480893D89F145D0C45AE"><enum>(1)</enum><text display-inline="yes-display-inline">a need for the restriction is identified based on clear and convincing evidence for resource protection or public safety; and</text></paragraph> 
<paragraph id="H8E92E0E8700F44268F651506EF1A9C32"><enum>(2)</enum><text display-inline="yes-display-inline">the restriction is—</text> <subparagraph id="H3FADDB9B387D4E1491AC06E6FCB92E6F"><enum>(A)</enum><text display-inline="yes-display-inline">clearly indicated with signage posted at the points on the covered road or trail at which the restriction begins and ends;</text></subparagraph> 
<subparagraph id="H9642A8CB6D8E4E7B9B91D8D2C4EB18DE"><enum>(B)</enum><text>depicted on updated official maps of the covered road or trail, to be made available in both digital and printed form;</text></subparagraph> <subparagraph id="H233B7BC0EDAA40348B2E7F141BD9D61F"><enum>(C)</enum><text display-inline="yes-display-inline">subject to—</text> 
<clause id="H1C9493FD93184D81AA3A01BFF0C39344"><enum>(i)</enum><text>public notice in the Federal Register and at least one local newspaper; and</text></clause> <clause id="H2E14BDB7FDDF435BB770D02BE7A47E5C"><enum>(ii)</enum><text>a 30-day comment period;</text></clause></subparagraph> 
<subparagraph id="H0BA8CA30B1DC4C05A4050A623E39D16C"><enum>(D)</enum><text>reviewed by the Secretary concerned at least once every 5 years to determine if the restriction is still justified; and</text></subparagraph> <subparagraph id="HB59F40B4393F4A229559C96E5EB1578F"><enum>(E)</enum><text>applied to the smallest area, and for the least amount of time, as is practicable.</text></subparagraph></paragraph></subsection></section> 
<section id="H0058461BFB8647FB8BE0C63454716756"><enum>3.</enum><header>Public nomination of trails</header> 
<subsection id="H205CAB4C5BF441ECB27495EDF09BEFCC"><enum>(a)</enum><header>Public nominations for motorized routes</header><text display-inline="yes-display-inline">The Secretary of the Interior, acting through the Director of the Bureau of Land Management, and the Secretary of Agriculture, acting through the Chief of the Forest Service, shall accept and consider proposals submitted by the public for additions to designated motorized road and trail networks at any time, including during the development or revision of transportation or travel management plans carried out pursuant to the National Forest Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/16/472a">16 U.S.C. 472a et seq.</external-xref>), the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>), and the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></subsection> <subsection id="H2A03D321F59D4C4AAFB1200E2AE7E97B"><enum>(b)</enum><header>Eligible nominations</header><text display-inline="yes-display-inline">Proposals submitted under subsection (a) may include—</text> 
<paragraph id="H5433B86F49474952B2C8267EF5679EBC"><enum>(1)</enum><text display-inline="yes-display-inline">the designation of new motorized roads or trails;</text></paragraph> <paragraph id="H522C7E790B3F4E62B71EF64B912E704E"><enum>(2)</enum><text>the repurposing or conversion of roads or trails; or</text></paragraph> 
<paragraph id="H8B66B558C7B64ABCB0B6E4E92D9D461B"><enum>(3)</enum><text>the inclusion of roads or trails not previously identified in agency transportation or travel inventories.</text></paragraph></subsection> <subsection id="H969F7DC8571440D68D079C23341558C7"><enum>(c)</enum><header>Consideration priority</header><text display-inline="yes-display-inline">In considering proposals under this section, the Secretary of the Interior and the Secretary of Agriculture shall give priority to proposals that—</text> 
<paragraph id="HB4486893BBF046C7857DA56FD72A8387"><enum>(1)</enum><text display-inline="yes-display-inline">improve connectivity within existing road or trail networks;</text></paragraph> <paragraph id="HEE6143CF15BE41FDB8AF77DFE56095A2"><enum>(2)</enum><text>protect natural resources;</text></paragraph> 
<paragraph id="H78DFC541084A49B2B6B3BBADE36EAC1B"><enum>(3)</enum><text>enhance access for fuels reduction, wildfire response, or other land management activities; or</text></paragraph> <paragraph id="HE56FE3E9162D4E3EBBE22EE493F67480"><enum>(4)</enum><text>provide additional or enhanced opportunities for motorized recreation.</text></paragraph></subsection> 
<subsection id="H8B3F89AC9EA24639B396F8EE813EA97A"><enum>(d)</enum><header>Expedited review</header><text display-inline="yes-display-inline">The Secretary of the Interior or the Secretary of Agriculture, as applicable, shall consider a proposal for the conversion of an administrative or currently closed road to a designated motorized trail as expeditiously as practicable, and not later than 90 days after the date of submission of the proposal.</text> </subsection></section> <section id="H936C009615544B5AAC03FB9A359A9C9E"><enum>4.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act shall be construed, with respect to a covered road or trail, to restrict or otherwise limit—</text> 
<paragraph id="H74CE220E361B4C609F456859AB0E2C80"><enum>(1)</enum><text>public access (except as described in subsection (b)); or</text></paragraph> <paragraph id="H7ABEE3E47CFE4E0598904908C485F116"><enum>(2)</enum><text>other uses.</text></paragraph></section> 
<section id="HA29336BAB5A74AD781AC8708E2917C6A"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="HE7DC06572B024AAEBF0D7BFCAF2D2E45" commented="no"><enum>(1)</enum><header>Covered road or trail</header> <subparagraph id="H1C27F1C70E42475394328CB558136675" commented="no"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the term <term>covered road or trail</term> means a road or trail designated for motorized use that is a—</text> 
<clause id="HB26E121FBB684FDF8644A849BEBD1D93" commented="no"><enum>(i)</enum><text>a National Forest System road;</text></clause> <clause id="HD4BAE37BF9B749C38E3584A1CC5828E0" commented="no"><enum>(ii)</enum><text>a National Forest System trail;</text></clause> 
<clause id="H71B4E9A4311D46CE9C7C06A4F7185DF6" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">a Bureau of Land Management road; or</text></clause> <clause id="H8C32D44C948C4146B12A8CBD0F8AB523" commented="no"><enum>(iv)</enum><text>a Bureau of Land Management trail.</text></clause> </subparagraph> 
<subparagraph id="HF9D42AB7ABEC4947999821791E43F0E8" commented="no"><enum>(B)</enum><header>Exception</header><text>The term <term>covered road or trail</term> does not apply to a road or trail within an area within a congressionally designated wilderness area or national park.</text></subparagraph> </paragraph> <paragraph id="HA5888521370A4958A503109F5314BB7A" commented="no"><enum>(2)</enum><header>Motorized access</header><text>The term <term>motorized access</term> means access or use by a motor or self-propelled vehicle capable of off-highway travel during winter or summer including all-terrain vehicles, four-wheelers, three-wheelers, dirt bikes, motorcycles, trail bikes, and snowmobiles.</text></paragraph> 
<paragraph id="HA2260E6A050B430FA2844FEF8E047200"><enum>(3)</enum><header>National Forest System road</header><text display-inline="yes-display-inline">The term <term>National Forest System road</term> means a road within a unit of the National Forest System other than a road which has been authorized by a legally documented right-of-way held by a State, county, or other local public road authority.</text></paragraph> <paragraph id="HF3368CEF6D184C30A2BF860BC7B137AE"><enum>(4)</enum><header>National Forest System trail</header><text display-inline="yes-display-inline">The term <term>National Forest System trail</term> means a trail within a unit of the National Forest System other than a trail which has been authorized by a legally documented right-of-way held by a State, county, or other local public road authority.</text></paragraph> 
<paragraph id="H8B8CF9BD19F747B69C339CFB21FDF9EC"><enum>(5)</enum><header>Bureau of Land Management road</header><text display-inline="yes-display-inline">The term <term>Bureau of Land Management road</term> means a road on public lands other than a road which has been authorized by a legally documented right-of-way held by a State, county, or other local public road authority.</text></paragraph> <paragraph id="H230561871F0D43459D7A4479D1EE68A6"><enum>(6)</enum><header>Bureau of Land Management trail</header><text display-inline="yes-display-inline">The term <term>Bureau of Land Management trail</term> means a trail on public lands other than a trail which has been authorized by a legally documented right-of-way held by a State, county, or other local public road authority.</text></paragraph> 
<paragraph id="H109526BEB7324ED0A0965C93ED21E0C1"><enum>(7)</enum><header>Public lands</header><text>The term <term>public lands</term> has the meaning given such term in section 103 of the Federal Land Policy Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>).</text> </paragraph> <paragraph id="HCA1E1DCF959947CEBAE470F57438B78D"><enum>(8)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text> 
<subparagraph id="HF6554FDECC85455EA79D0BF4E0D62555"><enum>(A)</enum><text>the Secretary of Agriculture, with respect to a National Forest System road or National Forest System trail; and</text></subparagraph> <subparagraph id="H332EBC089C204A6F9D5B9E3498F8CF33"><enum>(B)</enum><text>the Secretary of the Interior, with respect to a Bureau of Land Management road or Bureau of Land Management trail.</text> </subparagraph></paragraph></section>
