<section id="H6ED4CE217D39423698D7ACF7FBB4BF9C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Moral Injury Recognition and Restitution Act</short-title></quote>.</text></section> <section id="HC392BE5E26894E40A1E13C5AA78037C9"><enum>2.</enum><header>Department of Veterans Affairs retroactive benefits payments for veterans with covered health conditions based on military sexual trauma</header> <subsection id="HEF1F1D20A4EA421FBBBB42966D143713"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/51">chapter 51</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text>

<section id="HE544CB18F6AF433799D45075560D1699"><enum>5114.</enum><header>Claims involving military sexual trauma: retroactive benefits payments</header>
<subsection id="H902E96F338044F029079C01A017B0857"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">If the Secretary approves a claim for compensation for a covered health condition based on military sexual trauma experienced by a veteran during active military, naval, or air service, notwithstanding sections 5110 and 5111 of this title—</text> <paragraph id="H22F41924D5C54193B607E4ADCF1A2988"><enum>(1)</enum><text>the effective date of the award of the claim shall be the date of the day after the date on which the veteran is discharged from such service; and</text></paragraph>
<paragraph id="H603F7861E420428FB6AFB04B3F62458C"><enum>(2)</enum><text display-inline="yes-display-inline">payment of monetary benefits based on such award shall be made beginning on such date and shall be payable retroactively.</text></paragraph></subsection> <subsection id="H4E9FCD5F506145108D426273409D0601"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
<paragraph id="H58238E3ADCA54716A646C6B3FCB8ABB9"><enum>(1)</enum><text>The term <term>military sexual trauma</term> has the meaning given such term in section 1166(c)(2) of this title.</text></paragraph> <paragraph id="H77E352C7282D4C83B0E88829FD5D3F57"><enum>(2)</enum><text>The term <term>covered health condition</term> means—</text>
<subparagraph id="HA8D73135CC274A1291D0F53866733302"><enum>(A)</enum><text display-inline="yes-display-inline">a covered mental health condition, as such term is defined in section 1166(c)(1) of this title; or</text></subparagraph> <subparagraph id="HB8FE0C4EE8A64944810415AF846239C7"><enum>(B)</enum><text>any physical injury or disease resulting in disability that was incurred as a result of, or aggravated by, military sexual trauma.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H74087DA6A6BF4AD4828317D3E992385F"><enum>(b)</enum><header>Clerical amendments</header><text display-inline="yes-display-inline">The table of sections at the beginning of chapter 51 of such title is amended by inserting after the item relating to section 5113 the following new item:</text> <quoted-block style="USC" id="H4BCC8DF26AC44CC6ABB207827887661A" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">5114.
