<section id="H123721350C234383A3E157A6D87F3E97" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening Tools to Outlaw Poisonous Nitazenes Act</short-title></quote> or the <quote><short-title>STOP Nitazenes Act</short-title></quote>. </text></section> <section id="HEC2400831AE94433B1AA879BA4219270"><enum>2.</enum><header>Class I scheduling of nitazenes</header> <subsection id="H15DBD49EC6DA4D1089CE1941E21B8DC3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 202(c) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/812">21 U.S.C. 812(c)</external-xref>) is amended by adding at the end of Schedule I the following:</text>

<subsection id="H260E68298A8B42F6B68782B48D795AB2"><enum>(f)</enum> 
<paragraph id="H75634A83562945CCBF8C8857AFAF52E8" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">Unless specifically exempted or unless listed in another schedule, any material, compound, mixture, or preparation that contains—</text> <subparagraph id="H41AFF1A43E2D4C91BDC297BAE97ACAE2" indent="up1"><enum>(A)</enum><text>any quantity of a 2-benzylbenzimidazole opioid; or</text></subparagraph> 
<subparagraph id="H7386A70652264224895FB37225746289" indent="up1"><enum>(B)</enum><text>the salts, isomers, and salts of isomers of a 2-benzylbenzimidazole opioid.</text> </subparagraph></paragraph> <paragraph id="H34108755920E45D9A61EDA40FC54402D" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">For purposes of paragraph (1), the term ‘2-benzylbenzimidazole opioid’ includes the following:</text> 
<subparagraph id="H7F637C397FC8415AAFF890F0AFECE6BF"><enum>(A)</enum><text>A substance that is structurally related to 2-benzylbenzimidazole with the following modifications:</text> <clause id="H90C306718B654006B32DE4A89B9BA3D3"><enum>(i)</enum><text>At the 1-position, substitution with an alkyl linker connected to a substituted amine group containing hydrogen, alkyl, alkenyl, or a heteroaryl group, such as a morphilino, pyrrolidino, or piperidinyl group, whether or not further substituted.</text></clause> 
<clause id="H4ABC96DAC1FE48808A8191324134B980"><enum>(ii)</enum><text>At the 2-position—</text> <subclause id="H67D4CB06FB704C0E9C41DEB5EEE5AF92"><enum>(I)</enum><text>replacement of the alkyl portion of the benzyl group with a substituted or unsubstituted alkyl, alkoxy, carbamates group, nitrogen, sulfur, or oxygen atom; or</text></subclause> 
<subclause id="HB6179ED367B5406587579D70CBBE2597"><enum>(II)</enum><text>replacement of the phenyl portion of the benzyl group with an aryl or heteroaryl group.</text></subclause></clause> <clause id="H41C11D04918C4DBCBD6266261D193FAA"><enum>(iii)</enum><text>Substitution on the phenyl portion of the benzimidazole ring with a hydrogen atom, halogen, nitro, cyano, substituted or unsubstituted amide, amine, alkyl, alkoxy, aryl, or heteroaryl group.</text></clause> 
<clause id="HC30540143276414E97A48D09E8700B31"><enum>(iv)</enum><text>At the 6-position, substitution with hydrogen, nitro, trifluoromethyl, methoxy, trifluoromethoxy, cyano, and halogen group.</text></clause></subparagraph> <subparagraph id="HC2000A94AFBB40C9A67E0E7DB3E33605"><enum>(B)</enum><text>A substance that exhibits agonist activity at the mu-opioid receptor.</text></subparagraph> 
<subparagraph id="H07027CC3DF484F3CAD65509FEEF0F235"><enum>(C)</enum><text>Etonitazene, clonitazene, metonitazene, isotonitazene, protonitazene, butonitazene, etodesnitazene, flunitazene, N-pyrrolidino etonitazene, N-desethyl isotonitazene, and N-piperidinyl etonitazene.</text></subparagraph></paragraph> <paragraph id="H0417C75B22974A0B8E82067D7EF5B4E9" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The Attorney General may by order publish in the Federal Register a list of substances that satisfy the definition of the term <term>2-benzyl benzimidazole opioid</term> in paragraph (2).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H98E8B8D1C5AB419386C218075E6F7EC1"><enum>(b)</enum><header>Removal of temporary status</header><text display-inline="yes-display-inline">Any substance included in the amendment made by subsection (a) that was temporarily scheduled under section 201(h) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/811">21 U.S.C. 811(h)</external-xref>) shall be deemed permanently scheduled and subject to the requirements of Schedule I of section 202(c) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/21/812">21 U.S.C. 812(c)</external-xref>) as of the date of enactment of this Act.</text></subsection></section> <section id="HA45C9CC373314C05AD557ED9612FE879"><enum>3.</enum><header>Rulemaking</header> <subsection id="H9495065D9C6E4440AB2B016E8C97411A"><enum>(a)</enum><header>Interim final rule</header><text display-inline="yes-display-inline">The Attorney General—</text> 
<paragraph id="H9E841F2582884015AAA9A0E104AD377D"><enum>(1)</enum><text display-inline="yes-display-inline">shall, not later than 1 year after the date of enactment of this Act, issue rules to implement this Act, including the amendments made by this Act; and</text></paragraph> <paragraph id="HFA2C6F07DA114C6EAB1D9E1B6CD58547"><enum>(2)</enum><text display-inline="yes-display-inline">may issue the rules under paragraph (1) as an interim final rule.</text></paragraph></subsection> 
<subsection id="H1222941CAEC941E89E2FA97152577B48"><enum>(b)</enum><header>Procedure for final rule</header> 
<paragraph id="H1971563243AD4AB0BC14949ECF68BD8F"><enum>(1)</enum><header>Effectiveness of interim final rules</header><text display-inline="yes-display-inline">A rule issued by the Attorney General as an interim final rule under subsection (a) shall become immediately effective as an interim final rule without requiring the Attorney General to demonstrate good cause therefor, notwithstanding subparagraph (B) of section 553(b) of title 5, United States Code.</text></paragraph> <paragraph id="HD434E6B156924450A5BAF17E22E36EC1"><enum>(2)</enum><header>Opportunity for comment and hearing</header><text display-inline="yes-display-inline">An interim final rule issued under subsection (a) shall give interested persons the opportunity to comment and to request a hearing.</text></paragraph> 
<paragraph id="HF04B87C30CF0422682DA32335EE3650F"><enum>(3)</enum><header>Final rule</header><text display-inline="yes-display-inline">After the conclusion of proceedings under paragraph (2), the Attorney General shall issue a final rule to implement this Act, including the amendments made by this Act, in accordance with section 553 of title 5, United States Code. </text> </paragraph></subsection></section> </legis-body></bill>
