<section id="H531E79EB03124087AB9AF1FF08D40854" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Banning Event Trading on Sensitive Operations and Federal Functions Act</short-title></quote> or the <quote><short-title>BETS OFF Act</short-title></quote>.</text></section> <section id="HADFF4BD4DCAE4C31BB432C4F11E1BFFE"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H865C7EB7B8B6400CB791DAA8F5453232"><enum>(1)</enum><header>Specified event</header><text>The term <term>specified event</term> means—</text> <subparagraph id="H542E523C07DB4FE3807F40566DD17C19"><enum>(A)</enum><text>an act of terrorism;</text></subparagraph> 
<subparagraph id="HA3C13C43175F4CD285982658037A6FB4"><enum>(B)</enum><text>an assassination;</text></subparagraph> <subparagraph id="H3C033E742D5E4C11ABBFB6CDC0561289"><enum>(C)</enum><text>a war; or</text></subparagraph> 
<subparagraph id="H66791E8F6017407F94125CDACC993436" commented="no"><enum>(D)</enum><text>any event—</text> <clause id="HE05AE39CA74842979B62780DB906983C" commented="no"><enum>(i)</enum><text>the primary underlying characteristic of which is not financial, commercial, or economic; and</text></clause> 
<clause id="H7283E8D405CB48B698F3214B4C86E777" commented="no"><enum>(ii)</enum> 
<subclause id="HACD7DE77C1994436A02261EDA6F13DC1" display-inline="yes-display-inline" commented="no"><enum>(I)</enum><text>that is an action taken by any government, unit of government, intergovernmental organization, or government official;</text></subclause> <subclause id="H8D9A042F90884744BC7AE055DD4F602D" commented="no" indent="up1"><enum>(II)</enum><text>the outcome of which is under the complete control of any person; or</text></subclause> 
<subclause id="HAD484C36254941B6AAC0B98E2FEDB62F" commented="no" indent="up1"><enum>(III)</enum><text>the outcome of which is known by any person in advance.</text></subclause></clause></subparagraph></paragraph> <paragraph id="HE78ED5C2EE184BF889DFCB31171AA388"><enum>(2)</enum><header>Wager</header><text>The term <term>wager</term>—</text> 
<subparagraph id="H31A3264880BD4886BBB07414B6A0F631"><enum>(A)</enum><text>means the staking or risking by any person of something of value upon the outcome of an event, including the outcome of any portion or aspect thereof, upon an agreement or understanding that the person or another person will receive something of value in the event of a certain outcome; and</text></subparagraph> <subparagraph id="HDF1E401B395A4C25B04F8C7A5004E409"><enum>(B)</enum><text display-inline="yes-display-inline">does not include insurance for which the insured holds a lawful insurable interest—</text> 
<clause id="H49AA1EF5B96C4754B5D4473130AF26F8">
            <enum>(i)</enum>
 <text display-inline="yes-display-inline">under State law within the meaning of the Act of March 9, 1945 (<external-xref legal-doc="usc" parsable-cite="usc/15/1011">15 U.S.C. 1011 et seq.</external-xref>), commonly known as the McCarran-Ferguson Act;</text>
          </clause> 
<clause id="HBC4230E1D00B4776B593011F43AEBA3D"><enum>(ii)</enum><text display-inline="yes-display-inline">under foreign law, with respect to—</text> <subclause id="H5EC8DF701D2A48E19B9E1179F58AB769"><enum>(I)</enum><text display-inline="yes-display-inline">risks located outside the United States; or</text></subclause> 
<subclause id="HA582EEF83F6D4EB68199518D2BB5206D"><enum>(II)</enum><text display-inline="yes-display-inline">the reinsurance of risks covered under clause (i); or</text></subclause></clause> <clause id="HC04157C0405F4D5090EC29F3844AD5DD"><enum>(iii)</enum><text display-inline="yes-display-inline">under Federal law, including under the—</text> 
<subclause id="H8D97A012FB844ECA89260B6329BE2272"><enum>(I)</enum><text display-inline="yes-display-inline">Terrorism Insurance Program established under the Terrorism Risk Insurance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/15/6701">15 U.S.C. 6701</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/107/297">Public Law 107–297</external-xref>);</text></subclause> <subclause id="H0B5FB02255784DD08D3C48665A66992F"><enum>(II)</enum><text display-inline="yes-display-inline">National Flood Insurance Program established under the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4001">42 U.S.C. 4001 et seq.</external-xref>); or</text></subclause> 
<subclause id="H1CBDD18133D44311B723F6668AADEB62"><enum>(III)</enum><text display-inline="yes-display-inline">Federal crop insurance program established under the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>).</text></subclause></clause></subparagraph></paragraph></section> <section id="HC80BBFBDD58D4353B867562E50DB75DC"><enum>3.</enum><header>Prohibited conduct</header> <subsection id="H4874D0DEA87244CBB499093291F724DC"><enum>(a)</enum><header>Prohibition</header><text>It shall be unlawful for any person to place, accept, or facilitate the placement or acceptance of a wager regarding a specified event.</text></subsection> 
<subsection id="HEC98274693F941BFA01DD4C1C63EDB6D"><enum>(b)</enum><header>Civil action</header><text>The Attorney General may bring a civil action for injunctive relief in an appropriate district court of the United States against any person who violates subsection (a).</text></subsection></section> <section id="H3803BCFE1630439EAF6C2AE5CA588895"><enum>4.</enum><header>Amendments</header> <subsection id="HEF527CC762894100A6635A190FE5C14C"><enum>(a)</enum><header>Interstate and foreign travel or transportation in aid of racketeering enterprises</header><text>Section 1952(b) of title 18, United States Code, is amended by inserting <quote>(including conduct prohibited by section 3(a) of the Banning Event Trading on Sensitive Operations and Federal Functions Act)</quote> after <quote>gambling</quote>.</text></subsection> 
<subsection id="H9F9094B6AC0C45DFA0CD7947C086E611"><enum>(b)</enum><header>Prohibition of illegal gambling businesses</header><text>Section 1955(b) of title 18, United States Code, is amended—</text> <paragraph id="H63150B74DFB94783A657A80720EDA8E5"><enum>(1)</enum><text>in paragraph (1)(i), by inserting <quote>section 3(a) of the Banning Event Trading on Sensitive Operations and Federal Functions Act or</quote> after <quote>is a violation of</quote>; and</text></paragraph> 
<paragraph id="HB7BC040EDF2F43A88D95A1D2A93ACFBA"><enum>(2)</enum><text>in paragraph (4), by inserting <quote>conduct prohibited by section 3(a) of the Banning Event Trading on Sensitive Operations and Federal Functions Act,</quote> after <quote><quote>gambling</quote> includes but is not limited to</quote>.</text></paragraph></subsection> <subsection id="H540BB494BE1144D6932EF9912DBB3ADF"><enum>(c)</enum><header>Prohibition on funding of unlawful internet gambling</header><text>Section 5362(1) of title 31, United States Code, is amended—</text> 
<paragraph id="H384530E5DA0746558CDE207365101190"><enum>(1)</enum><text>in subparagraph (D), by striking <quote>and</quote> at the end;</text></paragraph> <paragraph id="HAED290817F674765B1A2C4E5D8394344"><enum>(2)</enum><text>by redesignating subparagraph (E) as subparagraph (F); and</text></paragraph> 
<paragraph id="HFBB4E7D2945F4239AA5AF50D307D9364"><enum>(3)</enum><text>by inserting after subparagraph (D) the following:</text> <quoted-block id="H5431A591CA0C4CE5BAF22425BE0BF151" style="OLC"> <subparagraph id="HD3D54D96700443A6BBE03F25E0CAC109"><enum>(E)</enum><text display-inline="yes-display-inline">includes conduct prohibited by section 3(a) of the Banning Event Trading on Sensitive Operations and Federal Functions Act, without regard to subparagraph (F) of this paragraph; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HB10D109346CC44FB815C036A64FBA575"><enum>(d)</enum><header>Common provisions applicable to registered entities</header><text>Section 5c(c)(5) of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/7a-2">7 U.S.C. 7a–2(c)(5)</external-xref>) is amended—</text> <paragraph id="H6AF10948F36E4D459FA9955D8DA4621B"><enum>(1)</enum><text>in clause (C)(i)—</text> 
<subparagraph id="HE882320FC97C4B739CBFA0CB5F5185C6">
                        <enum>(A)</enum>
 <text>by striking subclauses (II), (III), and (IV); and</text> </subparagraph> <subparagraph id="HA51CF4F500ED457E8109B373DEB865E5"><enum>(B)</enum><text>by redesignating subclauses (V) and (VI) as subclauses (II) and (III); and</text></subparagraph></paragraph> 
<paragraph id="HD41710AE69094D699FCFB2E3B934DAB1"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block id="HECF5F31BA4FA407C9FD358D4A78B8D82" style="OLC"> <subparagraph id="HD3C082F641A34EE8A277E19F3ADF29E1"><enum>(D)</enum><header>Prohibition relating to specified events</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this section, no agreement, contract, transaction, or swap involving any specified event, as defined in section 2 of the Banning Event Trading on Sensitive Operations and Federal Functions Act (or any index, measure, value, or data related thereto, or occurrence, extent of an occurrence, or contingency based thereon), may be listed or made available for clearing or trading on or through a registered entity.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="HF806323887B748B6915DE08D3000051B"><enum>5.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or amendment made by this Act, or the application of such provision or amendment to any person or circumstance, is held to be unconstitutional, the remainder of this Act and the amendments made by this Act, and the application of the provision or amendment to any other person or circumstance, shall not be affected.</text></section> <section id="HC0FC56BE677349708EACEE771712083A"><enum>6.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act shall take effect on the date that is 30 days after the date of enactment of this Act.</text></section>
