R. 7945</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20260316">March 16, 2026</action-date><action-desc><sponsor name-id="M001225">Mr. Mullin</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To ban the sale of nitrous oxide consumer products, and for other purposes.</official-title></form><legis-body id="H4C56BCFA13C54AC8B1109656AEDED466" style="OLC"><section id="HC969E390F8A24EEEB98C51A8D8712156" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nitrous Oxide Safety Act of 2026</short-title></quote>.</text></section><section id="H50CDDA37E2F944E285EE80C3AC1692E3"><enum>2.</enum><header>Nitrous oxide products considered a banned hazardous product</header><subsection id="H6935DB5F5E7344119D12BA7FFEF310D0"><enum>(a)</enum><header>Consideration as banned hazardous product</header><text>Except as provided in subsection (b), on and after the date that is 180 days after the date of the enactment of this Act, a consumer product that contains nitrous oxide shall be considered to be a banned hazardous product under section 8 of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2057">15 U.S.C. 2057</external-xref>).</text></subsection><subsection id="H585D61B2E0E34AE09D648F4DEAF0709D"><enum>(b)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section may be construed to—</text><paragraph id="HAD83B111E8704673B22207CD1B9E50D5"><enum>(1)</enum><text>ban the sale of a product that contains nitrous oxide to be used in the course of—</text><subparagraph id="H5B29FFD2FCD945FEAE6D22F78E14AAC9"><enum>(A)</enum><text>medical or dental treatment;</text></subparagraph><subparagraph id="H45EE70B50BF841C4A83B624A74D3CA90"><enum>(B)</enum><text display-inline="yes-display-inline">commercial production of food or food products, including in a manufacturing setting or commercial kitchen; or</text></subparagraph><subparagraph id="H3BB0998707194B16A762AC1437723692"><enum>(C)</enum><text>research and development; or</text></subparagraph></paragraph><paragraph id="HDADC5788CD194832BF351F9C34A9C0C9"><enum>(2)</enum><text display-inline="yes-display-inline">apply to a consumer product in which nitrous oxide is sold as a component of food and used as a propellant to drive such food out of a pressurized container.</text></paragraph></subsection><subsection id="H877B5ED93F3442D3BE7AF642CDDBB6E9"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H86C12D58FF27402D8B7F02D232146036"><enum>(1)</enum><header>Commercial kitchen</header><text>The term <quote>commercial kitchen</quote> means a commercial restaurant, caterer, or other food preparation business.</text></paragraph><paragraph id="HFEB67FBC8AF442DFBC3DFDEF3A8762C6"><enum>(2)</enum><header>Consumer product</header><text>The term <quote>consumer product</quote> has the meaning given that term under section 3(a)(5) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2052">15 U.S.C. 2052(a)(5)</external-xref>).</text></paragraph><paragraph id="H4EC301074E914785BA9FDB2B9E97BA1A"><enum>(3)</enum><header>Medical or dental treatment</header><text>The term <quote>medical or dental treatment</quote> means care provided by a dentist, doctor, pharmacist, or another professional licensed to dispense medication.</text></paragraph><paragraph id="HF7E12D3FD1F64CC0BE332A4F0A103192"><enum>(4)</enum><header>Nitrous oxide</header><text>The term <quote>nitrous oxide</quote> means the gas chemically known as N<subscript>2</subscript>O, which is also known as <quote>laughing gas</quote> and <quote>whippits</quote>.</text></paragraph><paragraph id="H37F3BD9E54D14846B79F3EB439E2315D"><enum>(5)</enum><header>Research and development</header><text>The term <quote>research and development</quote> means activities conducted by an accredited academic institution, a business, nonprofit entity, or government agency engaged in scientific, engineering, medical, or technological research or the development of products or services.</text></paragraph></subsection></section></legis-body></bill>
