which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to increase the mens rea requirements for offenses under the Espionage Act.</official-title></form><legis-body id="HD5B1A308FD9D4EA2AC1DB81115B3877D" style="OLC"><section id="H5615E977973F4B41A4B80A07827BFD66" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Daniel Ellsberg Press Freedom and Whistleblower Protection Act of 2026</short-title></quote>.</text></section><section id="H91BF3EC38A68434A98B47EA1BAD7B48B"><enum>2.</enum><header>Espionage Act reform</header><subsection id="H544C9596AFBD482AABBE372DE700124D"><enum>(a)</enum><header>Gathering, transmitting, or losing defense information</header><text display-inline="yes-display-inline">Section 793 of title 18, United States Code, is amended—</text><paragraph id="H0B8472AA80E144388E668B23DB155D29"><enum>(1)</enum><text>in subsection (a), by striking <quote>with intent or reason to believe</quote> and inserting <quote>with specific intent</quote>;</text></paragraph><paragraph id="H20247BB92A7F4D2B933D4B088778279D"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="H707EC1559D6B404EAE49A0CA1EDD91B9"><enum>(A)</enum><text>by striking <quote>or reason to believe</quote>; </text></subparagraph><subparagraph id="HC5DDC1F4F67E40DE975341671BB1DA37"><enum>(B)</enum><text>by inserting <quote>that has been properly classified that is</quote> after <quote>of anything</quote>; and</text></subparagraph><subparagraph id="HE6ADD3AB165449E7A904546C9CAD0694"><enum>(C)</enum><text>by striking <quote>Whoever</quote> and inserting <quote>An individual who, while a covered person</quote>; </text></subparagraph></paragraph><paragraph id="H0639FA5D46B64527B8E7C11C71553845"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph id="H8043CF6F6F294534B94457CAC8A3D579"><enum>(A)</enum><text>by inserting <quote>that has been properly classified that is</quote> after <quote>of anything</quote>; and</text></subparagraph><subparagraph id="HD55B126819A642F48661078EC051DA53"><enum>(B)</enum><text>by striking <quote>Whoever</quote> and inserting <quote>A foreign agent who</quote>; </text></subparagraph></paragraph><paragraph id="H2D3E6D9FCF244586888BF45339443C3C"><enum>(4)</enum><text display-inline="yes-display-inline">in subsection (d)—</text><subparagraph id="HF901811E1AF241AAB9C66B6FA35D12A5"><enum>(A)</enum><text>by inserting after <quote>willfully</quote> each place it appears the following: <quote>, and with specific intent to injure the United States or advantage any foreign nation,</quote>; and</text></subparagraph><subparagraph id="H56E32DB651004430BC7A8D84ECDF58AE"><enum>(B)</enum><text>by striking <quote>Whoever</quote> and inserting <quote>An individual who, while a covered person,</quote>; </text></subparagraph></paragraph><paragraph id="H5C9B0E0EC0AE4DDC9145F7774390DF1D"><enum>(5)</enum><text display-inline="yes-display-inline">in subsection (e)—</text><subparagraph id="HBF32A372BDC74E349660EC9B798CF4F2"><enum>(A)</enum><text>by inserting after <quote>willfully</quote> each place it appears the following: <quote>, and with specific intent to injure the United States or advantage any foreign nation,</quote>; and</text></subparagraph><subparagraph id="H432D34D5B7694A0E9C9B86044CA7139F"><enum>(B)</enum><text>by striking <quote>Whoever</quote> and inserting <quote>An individual who, while a covered person,</quote>; and</text></subparagraph></paragraph><paragraph id="HE38FF8649B5F4892A881E339153758FA"><enum>(6)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" id="H62DD6D69B9E644B8A1A4989636DC8652" display-inline="no-display-inline"><subsection id="H46E726C7A29E460C8EA532E2DBCD5433"><enum>(i)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H85D2D9AA437542C294D0EE6799996694"><enum>(1)</enum><header>Covered person</header><text display-inline="yes-display-inline">The term <quote>covered person</quote> means an individual who—</text><subparagraph id="HAB37E33682814417B85461C3B966DF42"><enum>(A)</enum><text>receives official access to classified information granted by the United States Government;</text></subparagraph><subparagraph id="HE80E0B5C7E6C4D018AE25A0CDFD72EB8"><enum>(B)</enum><text display-inline="yes-display-inline">signs a nondisclosure agreement with regard to such classified information; and</text></subparagraph><subparagraph id="H2058DB19442D4BB89D1DEBC2FE7DEBF6"><enum>(C)</enum><text>is authorized to receive documents, writings, code books, signal books, sketches, photographs, photographic negatives, blue prints, plans, maps, models, instruments, appliances, or notes of anything connected with the national defense by—</text><clause id="H5E8FE7499E30412D9F9EE35299278E5C"><enum>(i)</enum><text>the President; or</text></clause><clause id="H841E635D21FD4EBE94B3FFF144049395"><enum>(ii)</enum><text>the head of a deparment or agency of the United States Government which is expressly designated by the President to engage in activities relating to the national defense.</text></clause></subparagraph></paragraph><paragraph id="H3DDDC318387647E183E5ED7A0BBDF639"><enum>(2)</enum><header>Foreign agent</header><text>The term <quote>foreign agent</quote>—</text><subparagraph id="HAB1965F8E64842A89772613259FE75F4"><enum>(A)</enum><text display-inline="yes-display-inline">has the meaning given the term ‘agent of a foreign power’ under section 101 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801</external-xref>); and</text></subparagraph><subparagraph id="H9F8D55918F9E4CA8AF8665C9AC8AB5CA"> <enum>(B)</enum> <text>does not include a person who is an agent of a foreign power (as so defined) with respect to a foreign power described in section 101(a)(5) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801(a)(5)</external-xref>).</text>
 </subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HAC93F0519A94460798D7566BC105C900"><enum>(b)</enum><header>Disclosure of classified information</header><text display-inline="yes-display-inline">Section 798 of title 18, United States Code, is amended—</text><paragraph id="H815AE41B6C1E4CA19C0B2FA23D6527FC"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HC7D28115BA4647A29344889FE595BD27"><enum>(A)</enum><text>by inserting after <quote>knowingly and willfully</quote> the following: <quote>, and with specific intent to injure the United States or advantage any foreign nation,</quote>; and</text></subparagraph><subparagraph id="H1ED568B4F4A9410C970B065F7D2F4F15"><enum>(B)</enum><text>by striking <quote>Whoever</quote> and inserting <quote>Any individual who, while a covered person,</quote>; and</text></subparagraph></paragraph><paragraph id="HC0AF67041F8E430E84BA68BA77F4F214"><enum>(2)</enum><text>in subsection (b), by adding at the end the following: </text><quoted-block style="OLC" id="HB4C90DE4BE6D4CA0ACE44BF2A67D5791" display-inline="no-display-inline"><paragraph id="HC40E21F5DF5048669B94730FD0172E07"><enum/><text display-inline="yes-display-inline">The term <quote>covered person</quote> means an individual who—</text><subparagraph id="H411CB89788C34CFA9E6286A9C23EEC5D"><enum>(A)</enum><text>receives official access to classified information granted by the United States Government;</text></subparagraph><subparagraph id="HEF364E56D43F49689A843D7FAD0B8490"><enum>(B)</enum><text display-inline="yes-display-inline">signs a nondisclosure agreement with regard to such classified information; and</text></subparagraph><subparagraph id="H682C461EC6DD48D3AAB3F9A8681F0CE1"><enum>(C)</enum><text>is authorized to receive documents, writings, code books, signal books, sketches, photographs, photographic negatives, blue prints, plans, maps, models, instruments, appliances, or notes of anything connected with the national defense by—</text><clause id="H79565FC0EA334E2A89C45FC043256214"><enum>(i)</enum><text>the President; or</text></clause><clause id="HC2BA9B8C31F648EC80A93406784AC3A5"><enum>(ii)</enum><text>the head of a deparment or agency of the United States Government which is expressly designated by the President to engage in activities relating to the national defense.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H8C3BAF7784B54447BCEB5BCCFB72504A"><enum>(c)</enum><header>Testimony of purpose</header><paragraph id="HAD76545F903B4D53B928106247CE91F6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/37">Chapter 37</external-xref> of title 18, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="HF61757AA6D3F4C509150488CF7F677BE" display-inline="no-display-inline"><section id="H61E01EFD9BCE43A5B61F42BC94D5F830"><enum>799A.</enum><header>Testimony of purpose</header><text display-inline="no-display-inline">A defendant charged with an offense under section 793 or 798 shall be permitted to testify about their purpose for engaging in the prohibited conduct.</text></section><section id="HCF5F41C358754D949A9C71BFC558E015"><enum>799B.</enum><header>Affirmative defense</header><text display-inline="no-display-inline">It is an affirmative defense to a charge under section 793 or 798 that the defendant engaged in the prohibited conduct for the purpose of disclosing to the public—</text><paragraph id="H0FEA1AA3B9FE4F8ABFA17024878B4DC4"><enum>(1)</enum><text display-inline="yes-display-inline">any violation of any law, rule, or regulation, including any obligation under the Constitution, a treaty or customary international law (including international human rights law and international humanitarian law); or</text></paragraph><paragraph id="H5B2E0559AA71497DAC091BDDA50495D1"><enum>(2)</enum><text>gross mismanagement, a gross waste of funds, an abuse of authority, or a substantial and specific danger to public health or safety.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HFD777A7035344803A75EF30485F39E50"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/37">chapter 37</external-xref> of title 18, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="HDE0EABE4C525469AAB2C2951CB9C67FD" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">799A.
