<section id="H82D857DEF3F849DD943D3E32FC94299E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Firefighter Lithium-ion Awareness and Readiness Enhancement Act</short-title></quote> or the <quote><short-title>FLARE Act</short-title></quote>.</text></section> <section id="HFC1546B3E60A4D7F92494224A0CD34E6"><enum>2.</enum><header>Increasing access to thermal runaway suppression tools</header><text display-inline="no-display-inline">Section 33 of the Federal Fire Prevention and Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/15/2229">15 U.S.C. 2229</external-xref>) is amended—</text> 
<paragraph id="H9C60F4B279314293BB805EE37023FC84"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="H9A4B311A5F1C49EC882D15CDFB147DBF"><enum>(A)</enum><text>by redesignating paragraph (9) as paragraph (11);</text></subparagraph> 
<subparagraph id="H1790FEABD7E34269873517A115FF8A40"><enum>(B)</enum><text>by redesignating paragraphs (7) and (8) as paragraphs (8) and (9), respectively;</text></subparagraph> <subparagraph id="H473E5557672745899909B7E5D6E5ACC2"><enum>(C)</enum><text>by inserting after paragraph (6) the following:</text>

<paragraph id="HD31C27EE141742F1B8EA8188FF3F9B94"><enum>(7)</enum><header>Lithium-ion cell or battery</header><text>The term <term>lithium-ion cell or battery</term>—</text> <subparagraph id="H7634E2E11A9140DDA65616D08BE9059C"><enum>(A)</enum><text>means a rechargeable electrochemical cell or battery in which the positive and negative electrodes are both intercalation compounds constructed with no metallic lithium in either electrode; but</text></subparagraph> 
<subparagraph id="H35224513982C49708A99452A7962481E"><enum>(B)</enum><text>does not include a cell or battery described in subsections (c) and (g)(2) of section 173.185 of title 49, Code of Federal Regulations.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H1FE5B6EDF6694A39AB323AF2030FCD99"><enum>(D)</enum><text>by inserting after paragraph (9) (as so redesignated) the following:</text>

<paragraph id="HA5D377040BCD47D09CDA6BFDDC7AF20B"><enum>(10)</enum><header>Thermal runaway</header><text>The term <term>thermal runaway</term> means an uncontrolled increase of cell temperature caused by exothermic reactions inside cells and batteries, including lithium-ion cells or batteries.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H203D7B4F8C9B4C9385393D6821929FD1"><enum>(2)</enum><text>in subsection (c)(3)(A)—</text> 
<subparagraph id="HA1003C2B65684305A6FD844C5B4CDCC2"><enum>(A)</enum><text>in clause (iv) by striking <quote>or</quote> at the end;</text></subparagraph> <subparagraph id="H20D7B256FEFA4796A784608CB882FDCE"><enum>(B)</enum><text>in clause (v) by striking the period at the end and inserting <quote>, including lithium-ion cells or batteries; or</quote>; and</text></subparagraph> 
<subparagraph id="H26121C7938EC47DB9BB80D7A164C2284"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block id="H0E41F4A497004DD8BFEBF7A01A047716" style="OLC"> <clause id="H84920C49D8684730B0A87BD1969472AD"><enum>(vi)</enum><text>suppressing fires resulting from thermal runaway.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H609563E1C1E746719B24356BFD72F017"><enum>(3)</enum><text>in subsection (d)(3)—</text> <subparagraph id="H1745093F2B96496892901A8FBC85C906"><enum>(A)</enum><text>by redesignating subparagraphs (E) as subparagraph (F); and</text></subparagraph> 
<subparagraph id="H86B1C2BA9F8B48308EB17A1C62986434"><enum>(B)</enum><text>by inserting after subparagraph (D) the following:</text> <quoted-block id="H463F78912DC84C92854A9AF6C31469A8" style="OLC"> <subparagraph id="H6380F48D00CF4E11AD79AA6218E391B9"><enum>(E)</enum><text>To fund programs to suppress fires resulting from thermal runaway.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section>
