<section id="HF69FFA8848F942FCA6EFC75EA09E72CA" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Respect for Essential Workers Act</short-title></quote>.</text></section> 
<section id="H8C043CAF5C34413B8E806F1F6C99C5CF"><enum>2.</enum><header>Temporary Protected Status for essential workers</header> 
<subsection id="HBA8253CDF5D041F28024EC4B96F77B95"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a covered alien may not be removed from the United States on the basis that the grant of temporary protected status under section 244 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a</external-xref>) has been terminated.</text></subsection> <subsection id="HE72CA23D7F504E2FA2E4A89A8BE8BFBE"><enum>(b)</enum><header>Adjustment of status</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a covered alien may adjust to the status of an alien lawfully admitted for permanent residence under section 245 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255</external-xref>) beginning on the date that is 90 days after the date of enactment of this Act.</text></subsection> 
<subsection id="H256414FC3C6D4DA6851955FE43EDF4DA"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HB6AD459A70254407B48C8A67483F6FFD"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>covered alien</term> means an alien who—</text> 
<subparagraph id="HD9716BAE0C2E4428B3F84F4EB6C4AD3E"><enum>(A)</enum><text display-inline="yes-display-inline">on the date of enactment of this Act, is present in the United States pursuant to a grant of temporary protected status under section 244 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a</external-xref>); and</text></subparagraph> <subparagraph id="HDAA2E95F41F6448D99E45A4F4A9AE57A"><enum>(B)</enum><text>works in or receives training for an occupation in—</text> 
<clause id="HBD0C768026B64AA1B2CE15D51BB80CF7"><enum>(i)</enum><text>an essential industry or in a region with a documented labor shortage, as determined by the Secretary of Labor; or</text></clause> <clause id="HDAD6CE7706864A62B804EFE44DA0FFC5"><enum>(ii)</enum><text display-inline="yes-display-inline">a health care-related profession in a health professional shortage area, as determined by the Administrator of the Health Resources and Services Administration.</text></clause></subparagraph></paragraph> 
<paragraph id="H0A09F2B43C5B464C8CE3D102B7D83C3A"><enum>(2)</enum><text>The term <term>essential industry</term> means any of the following:</text> <subparagraph id="H6295316EF8124E99AF5F191126EFF86C"><enum>(A)</enum><text>Health care.</text></subparagraph> 
<subparagraph id="HD5C43948942142E8B7F2165E7BFED55C"><enum>(B)</enum><text>Emergency response.</text></subparagraph> <subparagraph id="H63AF1899D8484013B83778DF2729096C"><enum>(C)</enum><text display-inline="yes-display-inline">Sanitation.</text></subparagraph> 
<subparagraph id="HD1B742BBAFE14107897DE6BCBC98A67D"><enum>(D)</enum><text>Restaurant ownership, food preparation, vending, catering, food packaging, food services, or food delivery.</text></subparagraph> <subparagraph id="H26E126E1B29743C0811A29CE60782C3F"><enum>(E)</enum><text>Hotel or retail.</text></subparagraph> 
<subparagraph id="H752AFD209D394F50AA7914D187CF0A87"><enum>(F)</enum><text>Fish, poultry, and meat processing.</text></subparagraph> <subparagraph id="HE08454D385E8454592BF261174590202"><enum>(G)</enum><text>Agricultural work, including labor that is seasonal in nature.</text></subparagraph> 
<subparagraph id="H02023E46C4B44F97A5A792541EB169A3"><enum>(H)</enum><text>Housing, residential, or commercial construction-related activities, or public works construction.</text></subparagraph> <subparagraph id="H9F15DE7AED3541D1A160292A4C5B1D05"><enum>(I)</enum><text>Natural disaster recovery, disaster reconstruction, and related construction.</text></subparagraph> 
<subparagraph id="HD8C768C2BF3F47159B648BA20A7FCC1E"><enum>(J)</enum><text>Home and community-based work, including—</text> <clause id="H1864C42D893F48E28BA114E24DE72DD2"><enum>(i)</enum><text>home health care;</text></clause> 
<clause id="H507747B297CA45D591E13D4AED849A38"><enum>(ii)</enum><text>residential care;</text></clause> <clause id="H6E801A37D95841DCB60DA0F1CB9783B6"><enum>(iii)</enum><text>the provision of assistance with activities of daily living;</text></clause> 
<clause id="H5F847FBB944F40ED8AF75A6DFD17293F"><enum>(iv)</enum><text>any service provided by a direct care worker (as such term is defined in section 799B of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/295p">42 U.S.C. 295p</external-xref>)), a personal care aide, job coach, or supported employment provider; and</text></clause> <clause id="H7629EEF8500C4B7ABC7EB4E728EAF781"><enum>(v)</enum><text>the provision of any other type of care to an individual in their home by a direct service provider, personal care attendant, and home health aide.</text></clause></subparagraph> 
<subparagraph id="H0FCCFC24F0D441B78F909906CB4A857A"><enum>(K)</enum><text>Family care, including the provision of child care services, including in-home child care services (such as nanny services), and care services provided by one family member to another family member.</text></subparagraph> <subparagraph id="H0B7CE108D2B24DBF822A0C2A4F3009C0"><enum>(L)</enum><text>Transportation or logistics.</text></subparagraph></paragraph></subsection></section>
