which was referred to the <committee-name committee-id="HED00">Committee on Education and Workforce</committee-name></action-desc></action><action display="yes"><action-date date="20260702">July 2, 2026</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction><action-instruction>For text of introduced bill, see copy of bill as introduced on March 12, 2026</action-instruction><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend section 408 of the Employee Retirement Income Security Act of 1974 to prohibit kickbacks to pharmacy benefit managers.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HED00" reported-display-style="italic" id="H766D5AB97D214FB7B636D343045D17D8"><section id="H7C09FFFF2E174E2C8AA83B49976476FF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>PBM Kickback Prohibition Act</short-title></quote>.</text></section><section id="HB75CAD5DC68D4C2CB8D6207B565D89C4"><enum>2.</enum><header>Prohibition on pharmacy benefit manager kickbacks</header><subsection id="HB12BD71285A74E31A6138874B1CC11A4"><enum>(a)</enum><header>In general</header><text>Section 408(b)(2)(B) of the Employee Retirement Income Security Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1108">29 U.S.C. 1108(b)(2)(B)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H8C37C9C7A6954BFE88390BB73AABAC33" changed="added" reported-display-style="italic" committee-id="HED00"><clause id="H0EDB3B6B532640F882F2CECC07238484" indent="up2"><enum>(xi)</enum><subclause commented="no" display-inline="yes-display-inline" id="H29B07DDE1DA249F6A7B5C01A4607C337"><enum>(I)</enum><text>In the case of a contract or arrangement between a covered plan and a covered service provider for pharmacy benefit management services, no amount of compensation (whether direct compensation or indirect compensation) may be paid by such service provider to any individual or entity for—</text><item id="H67E20B96402C4DDCB611221E59B7E150" indent="up1"><enum>(aa)</enum><text display-inline="yes-display-inline">the referral, recommendation, placement, retention, or renewal of, or access to, the business of the covered plan or the health insurance issuer offering health insurance coverage for the covered plan;</text></item><item id="H19EB369CF38641C2937775C8C7450C83" indent="up1"><enum>(bb)</enum><text display-inline="yes-display-inline">inclusion in, participation in, or the design of—</text><subitem id="HF9945BC8766549C98F19F6EA3DB1FFFE"><enum>(AA)</enum><text>a request for proposal;</text></subitem><subitem id="H50374B8758104E23BF77576FA7CDA300"><enum>(BB)</enum><text>a market check;</text></subitem><subitem id="H8FBD9C05A0084A3E9E1BB63B46A3D3F5"><enum>(CC)</enum><text>an evaluation;</text></subitem><subitem id="H958318D71C1D4AF39AA11C701EB5C827"><enum>(DD)</enum><text display-inline="yes-display-inline">the volume, value, or use of covered plan business; or</text></subitem><subitem id="H254DAC5CF9444B66A454650BB4BB9C91"><enum>(EE)</enum><text>any other contracting process.</text></subitem></item></subclause><subclause id="HE15D21F8FBD941A0B54F72B03A68D808" indent="up1"><enum>(II)</enum><text>For the purposes of this clause, the characterization of compensation shall be based on the economic substance and practical operation of the contract or arrangement, without regard to the characterization or labeling of the compensation by the covered service provider. </text></subclause><subclause id="HF85499946F444DD9890511EB68AD0DAE" indent="up1"><enum>(III)</enum><text display-inline="yes-display-inline">Any compensation paid by a covered service provider to a brokerage firm, broker, consultant, advisor, or related entity shall be presumed to be related to an activity described in item (aa) or (bb) of subclause (I) unless the parties demonstrate through contemporaneous written documentation that such compensation—</text><item id="H08BF315985C4452A8793BB9FEAAC694B"><enum>(aa)</enum><text>reflects fair market value for bona fide services actually rendered; and</text></item><item id="HC821B17E43754D3D9499E5BFEBA44094"><enum>(bb)</enum><text>is not related, directly or indirectly, to any activity described in such items.</text></item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF5AD89D680ED4F9D9F879CFDEE81C481"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply for plan years beginning after the date of enactment of this Act.</text></subsection></section></legis-body><endorsement display="yes"><action-date>July 2, 2026</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
