<section id="HA953B9A7AFD3428FB9591B887936D097" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>PBM Kickback Prohibition Act</short-title></quote>.</text></section> <section id="H0BE4F135DD894D33B7887B56F97A6B13"><enum>2.</enum><header>PBM Kickback prohibition</header> <subsection id="H766788D672DD4D988D8362BE4059B1B9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 408(b)(2)(B) of the Employee Retirement Income Security Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1108">29 U.S.C. 1108(b)(2)(B)</external-xref>) is amended by adding at the end the following:</text>

<clause id="HF5A1129B3D30488185CB69F25617A791" indent="up2"><enum>(x)</enum><text display-inline="yes-display-inline">In the case of a contract or arrangement between a covered plan and a covered service provider for pharmacy benefit management services, no amount of compensation may be paid, directly or indirectly, by such service provider to a brokerage firm, broker, consultant, advisor, or any other individual for the referral of the covered plan’s or health insurance issuer's business to the covered service provider.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HB216A3C0E1C44D8488FFF033C9BD90D8"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply for plan years beginning after the date of enactment of this Act.</text></subsection></section>
