<section id="H79A1B80CD5FB4CB29C299501C0B09288" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Truman Scholarship Clean House Act</short-title></quote>.</text></section> <section id="H20D9EFB7CB804267BB705E8C4C177567"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 3 of the Harry S Truman Memorial Scholarship Act (<external-xref legal-doc="usc" parsable-cite="usc/20/2002">20 U.S.C. 2002</external-xref>) is amended—</text> 
<paragraph id="HCE50C973915B4B8CA0EC93EB2B3DEA55"><enum>(1)</enum><text>by redesignating paragraphs (1) through (6) as paragraphs (2) through (7), respectively; and</text></paragraph> <paragraph id="H1E7B7B6F527145EC870E1E1A768D19B4"><enum>(2)</enum><text>by inserting before paragraph (2), as so redesignated, the following:</text> 
<quoted-block style="OLC" id="H78E8C12188BD4FD48CA5BB08B8C8CAAB" display-inline="no-display-inline"> 
<paragraph id="H4D8B443A7C264BAD86232CF6C25B4BD4"><enum>(1)</enum><text><quote>affiliated with</quote>, when used with respect to an individual’s relationship to a certain political party, means that the individual—</text> <subparagraph id="H095E21D7500641B1A3C17D968560EA55"><enum>(A)</enum><text>is a registered member of that political party;</text></subparagraph> 
<subparagraph id="H384377C7589C44DCA7122CBCFA561717"><enum>(B)</enum><text display-inline="yes-display-inline">is a current or former holder of elected public office from that political party;</text></subparagraph> <subparagraph id="H1AEC5C377D484D23A482499AFAD74FA7"><enum>(C)</enum><text display-inline="yes-display-inline">is a current or former candidate for public office from that political party;</text></subparagraph> 
<subparagraph id="H0E45C0CA891B4651B6FD442C81D9517E"><enum>(D)</enum><text>is a current or former political appointee associated with that political party;</text></subparagraph> <subparagraph id="HF5ED57860A094A789CB37D2A4F70DC69"><enum>(E)</enum><text display-inline="yes-display-inline">is a current staffer of—</text> 
<clause id="HBCC561BD906F4505B598CCA96F6DEF11"><enum>(i)</enum><text>a holder of elected public office from that political party;</text></clause> <clause id="HE9AA59D2FDF24AE4A615960F69ABBA7E"><enum>(ii)</enum><text>a candidate of that political party; or</text></clause> 
<clause id="HFE3BEF28A93C4E13931975173C0A6682"><enum>(iii)</enum><text>a fundraising organization for such members or candidates; or</text></clause></subparagraph> <subparagraph id="HB72A0DEB37A449469A62C9A437ED73A1"><enum>(F)</enum><text display-inline="yes-display-inline">is a current or former judicial appointee nominated or otherwise selected by a holder of elected public office from that political party.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H173F04D5A75F482F86B80F74F6D991B3"><enum>3.</enum><header>Harry S Truman Scholarship Foundation</header> 
<subsection id="HC11AD6BC67C947958CD36F3CFC1FC039"><enum>(a)</enum><header>Board of Trustees</header><text>Section 5 of the Harry S Truman Memorial Scholarship Act (<external-xref legal-doc="usc" parsable-cite="usc/20/2004">20 U.S.C. 2004</external-xref>) is amended—</text> <paragraph id="H4E5F76667B95429B97CC5C377D063502"><enum>(1)</enum><text>in subsection (b)—</text> 
<subparagraph id="H85F0C8C1AB674A71AADE51B3AAA2522C"><enum>(A)</enum><text>in paragraph (1), by striking <quote>The Board shall be composed of</quote> and all that follows through the end of subparagraph (D); and</text></subparagraph> <subparagraph id="H56F2E5D3E8484A9FA19333A136EFD30B"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> 
<quoted-block style="OLC" id="H8C1A238B78A44F0598A9F1EAC389A93F" display-inline="no-display-inline"> 
<paragraph id="H7780C669BD71408BAEEADF55EA91A468" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Board shall be composed of 13 members, as follows:</text> <subparagraph id="H7A06BF9815F5453B97CEEB65CB75F0B6"><enum>(A)</enum><text display-inline="yes-display-inline">One member appointed by the Speaker of the House of Representatives.</text></subparagraph> 
<subparagraph id="H39E5DE7A4A7A456B923076A9A3CCCA7E"><enum>(B)</enum><text>One member appointed by the minority leader of the House of Representatives.</text></subparagraph> <subparagraph id="HDFFC1A3D3F6C4214B1B1168FFBA84A1C"><enum>(C)</enum><text display-inline="yes-display-inline">One member appointed by the majority leader of the Senate.</text></subparagraph> 
<subparagraph id="H51060F09696D48B28559FC4440A639C9"><enum>(D)</enum><text display-inline="yes-display-inline">One member appointed by the minority leader of the Senate.</text></subparagraph> <subparagraph id="H0C71A1F27D84437D827825C96EB58415"><enum>(E)</enum><text display-inline="yes-display-inline">Eight members, not more than four of whom may be affiliated with the same political party at the time of appointment, to be appointed by the President with the advice and consent of the Senate. </text></subparagraph> 
<subparagraph id="HB83B2F1DDDBA4D78AF640232B4644B06"><enum>(F)</enum><text display-inline="yes-display-inline">The Secretary of Education or the Secretary’s designee, who shall serve ex officio as a member of the Board, but shall not be eligible to serve as Chairperson.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H589D69A5A7884610BAACE0DF07B79734"><enum>(2)</enum><text>by amending subsection (c) to read as follows:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H1903DEABFDFA47FDB05E82E677EA8213"> 
<subsection id="H66726636919D4ADA822938E6B0B743C4"><enum>(c)</enum> 
<paragraph id="H3B1226C876934B728F0DCB28F6C74DF5" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">Except as provided in paragraph (2), the term of office of each member of the Board (other than Secretary of Education or the Secretary’s designee serving ex officio) shall be six years.</text></paragraph> <paragraph id="H12E8A34037D2496695911CDCCFBFB02D" display-inline="no-display-inline" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">As designated by the President at the time of appointment, of the members first appointed under subsection (b)(2)(E) after the date of enactment of this paragraph—</text> 
<subparagraph id="HAD2A2AAE44B944C5B122EDF2A0DBD078"><enum>(A)</enum><text display-inline="yes-display-inline">three shall be appointed for terms of two years;</text></subparagraph> <subparagraph id="HA0F705ADCF1E49D0A4E395B4055065C6"><enum>(B)</enum><text>three shall be appointed for terms of four years; and</text></subparagraph> 
<subparagraph id="HBFF2350C4C284D8AAFD10EFCC7868E4D"><enum>(C)</enum><text>two shall be appointed for terms of six years.</text></subparagraph></paragraph> <paragraph id="H7AD58C25A1824419BD89E179414570C2" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Any member of the Board appointed to fill a vacancy shall serve for the remainder of the term for which the member’s predecessor was appointed, and shall be appointed in the same manner as the original appointment for that vacancy was made.</text></paragraph> 
<paragraph id="HF78B9510BA654FE7B81F555B1A3D1A64" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">No member of the Board (other than the Secretary of Education or the Secretary’s designee serving ex officio) may serve more than two six-year terms, regardless of whether the terms are consecutive. A member described in subparagraph (A) or (B) of paragraph (2) who serves an initial term of less than six years, may serve up to two additional six-year terms following the expiration of such member’s initial term.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H511D807A4A2948A5BBBA17E2B9AB211D"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="H601F881916BA42FB8DA608B3E3E353FE" display-inline="no-display-inline"> 
<subsection id="H255A97A19EFD427595D06E6A2EA2AD64"><enum>(e)</enum><text display-inline="yes-display-inline">Seven members of the Board shall constitute a quorum.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H06B05D6204C14C0AB2BEDD71A09F6FA0"><enum>(b)</enum><header>Transition and Implementation</header> <paragraph id="H3E7C82381C10471AB25081DD256DFA77"><enum> (1)</enum><header>Dissolution of existing Board of Trustees</header><text display-inline="yes-display-inline">Effective on the date that is 90 days after the date of enactment of this Act, the Board of Trustees of the Harry S Truman Scholarship Foundation (as established under section 5 of the Harry S Truman Memorial Scholarship Act (<external-xref legal-doc="usc" parsable-cite="usc/20/2004">20 U.S.C. 2004</external-xref>)) is dissolved and all members of the Board are terminated.</text></paragraph> 
<paragraph id="H30B7C1455A3949A7A6E0D64FA6B1A27A"><enum>(2)</enum><header>Appointment of new members</header><text display-inline="yes-display-inline">As soon as practicable after the effective date specified in paragraph (1), new members shall be appointed to the Board of Trustees of the Harry S Truman Scholarship Foundation in accordance with section 5 of the Harry S Truman Memorial Scholarship Act (<external-xref legal-doc="usc" parsable-cite="usc/20/2004">20 U.S.C. 2004</external-xref>), as amended by subsection (a).<italic></italic></text></paragraph></subsection></section> <section id="H58A30EA76D3245ABB6F0FF2761C2C76A"><enum>4.</enum><header>Selection of Truman Scholars</header><text display-inline="no-display-inline">Section 7 of the Harry S Truman Memorial Scholarship Act (<external-xref legal-doc="usc" parsable-cite="usc/20/2006">20 U.S.C. 2006</external-xref>) is amended—</text> 
<paragraph id="H8205A183AE67481A9F1C0E94A0278DC7"><enum>(1)</enum><text>in subsection (b)—</text> <subparagraph id="H449E9E05D59441D189A08935CE95302E"><enum>(A)</enum><text>by inserting <quote>the eligibility requirements described in subsection (c) and</quote> before <quote>minimum criteria</quote>; and</text></subparagraph> 
<subparagraph id="H3FB4D46ED8EE47D6A92296AB36D361A0"><enum>(B)</enum><text>by inserting <quote>in accordance with subsection (d)(4)</quote> before the period at the end; </text></subparagraph></paragraph> <paragraph id="HD0404938DC31423B92EF0D277F3FA128"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="H4EAD5902BC4B404F9B9946D3EB2D40B7" display-inline="no-display-inline"> 
<subsection id="HE633D06566104607BB820A2A9FAB6BF6" commented="no"><enum>(c)</enum><text display-inline="yes-display-inline">A student is eligible to be nominated for a scholarship under this Act if such student—</text> <paragraph id="H91CFF16B6252461BB2F4A1EA9E3126D9" commented="no"><enum>(1)</enum><text>is—</text> 
<subparagraph id="H679ED7F47531402BA0994E328BCC46F3" commented="no"><enum>(A)</enum><text>a full-time undergraduate student enrolled at an institution of higher education who will receive a bachelor’s degree in the academic year following the academic year in which the student is applying for a scholarship; or</text></subparagraph> <subparagraph id="HE00D57F0C38B42E48B2EAB97793EA1AC" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">a full-time senior level student from the Commonwealth of Puerto Rico or from The Islands (as defined in section 1801.2(b) of title 45, Code of Federal Regulations (as in effect on the date of the enactment of this subsection));</text></subparagraph></paragraph> 
<paragraph id="HD8A0D2E1C92342C4B522ADEB666AAE59" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">is enrolled in a course of study that qualifies the student for admission to a graduate program leading to a career in public service; </text></paragraph> <paragraph id="H21FD1138D4B14FBA82290A77361C52F6" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">has a demonstrated record of academic excellence; and</text></paragraph> 
<paragraph id="H9B167CC1A6CB47B6993CAEC0336A68C9" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">is a citizen or national of the United States or a permanent resident of the Commonwealth of the Northern Mariana Islands. </text></paragraph></subsection> <subsection id="H77E07CA53EC64A10B2254913C89A04C2"><enum>(d)</enum><text display-inline="yes-display-inline"></text> 
<paragraph id="H4624B037EA7B493A9315752B371E52B4" display-inline="yes-display-inline"><enum>(1)</enum><text>The Foundation shall establish and maintain Regional Review Panels for purposes of carrying out subsection (a).</text></paragraph> <paragraph id="HC95E5651ABBF462697A60DBACA400D4E" indent="up1"><enum>(2)</enum><text>Each Regional Review Panel shall be responsible for selecting scholarship recipients from one or more States assigned to the Panel by the Board.</text></paragraph> 
<paragraph id="H30CE896A41C446EBBB26E8B5D042AB6C" indent="up1"><enum>(3)</enum> 
<subparagraph id="HA81090E1686C4BF6A0E54334E5DEA3FD" display-inline="yes-display-inline"><enum>(A)</enum><text>Each Regional Review Panel shall consist of not fewer than five members, each of whom shall be appointed on an annual basis by an affirmative vote of not less than two-thirds of the members of the Board.</text></subparagraph> <subparagraph id="H6673034DDD1A447DB4E024D6A914BB74" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Not more than half of the members of a Regional Review Panel may be affiliated with the same political party at the time of appointment.</text></subparagraph></paragraph> 
<paragraph id="H1626107E67474077AF7E1776620051AF" indent="up1" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">In selecting students to be scholarship recipients under this Act, each Regional Review Panel—</text> <subparagraph id="H7BB3E3BAF2BF4204A7BDC0611327C74A" indent="up1" commented="no"><enum>(A)</enum><text>shall select students based on—</text> 
<clause id="H5A67E2D17EF04762859FBABAD3C45C0D" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">the extent and quality of community service and government involvement of the student;</text></clause> <clause id="H6804DAE35969456090CE57E4BBC21E10" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">the leadership record of the student;</text></clause> 
<clause id="HA3AA951FB03748D3BC0EECC9FC2BA184" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">the academic performance of the student, including with respect to and writing and analytical skills; and</text></clause> <clause id="H973D5B246D1F4A0D940DE7F1C6047550" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">the suitability and appropriateness of the student’s proposed graduate program of study for a career in public service; </text></clause></subparagraph> 
<subparagraph id="H8FACFA1783144F0281F7B091270F9B57" indent="up1" commented="no"><enum>(B)</enum><text>shall not select any student who—</text> <clause id="H8325E456A2984DEE81C3226E18B09535" commented="no"><enum>(i)</enum><text>served as a leader, officer, director, or organizer of a student organization recognized by the institution of higher education at which the student is enrolled at time of an incident or conduct that led to the suspension or expulsion of such organization from such institution;</text></clause> 
<clause id="H624F5EE9DFD84BA0B23B453F784507E1" commented="no"><enum>(ii)</enum><text>has been suspended or expelled by an institution of higher education due to a violation of such institution’s code of conduct or other disciplinary action by such institution; or</text></clause> <clause id="H54C94C65729745DB84140C1E2E8BEEC5" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">has been convicted by any Federal, State, or local court of competent jurisdiction of a felony; and</text></clause></subparagraph> 
<subparagraph id="H3FA13B0780674DE0AA6211FE97BBF5C6" indent="up1" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">may not disfavor or otherwise apply adverse considerations to a student because the student intends to pursue a particular type of graduate degree, including with respect to a Master of Business Administration degree or Doctor of Medicine degree.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="HA5D378FEC82848FC9448CB2D7E3D0370" commented="no"><enum>5.</enum><header>Termination of scholarship</header><text display-inline="no-display-inline">Section 9 of the Harry S Truman Memorial Scholarship Act (<external-xref legal-doc="usc" parsable-cite="usc/20/2008">20 U.S.C. 2008</external-xref>) is amended—</text> 
<paragraph id="H0B7119FCD4BD485FB037D2AA6EBD0F14" commented="no"><enum>(1)</enum><text>in subsection (a), by inserting <quote>in accordance with subsection (c) and</quote> after <quote>provided in this Act</quote>; and</text></paragraph> <paragraph id="H9690122F87824F1D8B1B92F172418ADA" commented="no"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="H41F5AD612EC045C7B8A82ABEB25F7C2E" display-inline="no-display-inline"> 
<subsection id="H97876EE3D28146FF85DA1C6764686BCC" commented="no"><enum>(c)</enum> 
<paragraph id="H917E50BB32E645EFB641BBB7217301E7" display-inline="yes-display-inline" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">In accordance with paragraph (2), a student awarded a scholarship under the provisions of this Act may not continue to receive the payments provided in this Act if, at any point after the date on which the scholarship is received, the student—</text> <subparagraph id="H1E6E62C0CCC94EDFA409A853DF5C72C9" indent="up1" commented="no"><enum>(A)</enum><text>with respect to a report or request required by the Foundation—</text> 
<clause id="H1527066C65DB4608B4B011B01D342F2B" commented="no"><enum>(i)</enum><text>fails to submit such a report or request; or</text></clause> <clause id="HE36590C2CD07444681CBD8472BBF75AD" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">provides false, misleading, or materially incomplete information on any such report or request;</text></clause></subparagraph> 
<subparagraph id="HFFA6F371F6D24DCBA57C502B3990EB8C" indent="up1" commented="no"><enum>(B)</enum><text>fails to begin use of the scholarship within four years of the date of receipt of a bachelor’s degree, unless granted an extension in writing by the Foundation;</text></subparagraph> <subparagraph id="H9DC4592116EA48A192CD48CB8BB8A872" indent="up1" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">serves as a leader, officer, director, or organizer of a student organization recognized by the institution of higher education at which the student is enrolled at time of an incident or conduct that leads to the suspension or expulsion of such organization from such institution;</text></subparagraph> 
<subparagraph id="H58282E3C869145F3B1AA2085F67B9ABA" indent="up1" commented="no"><enum>(D)</enum><text>is suspended or expelled by the institution of higher education at which the student is enrolled due to a violation of the institution’s code of conduct or other disciplinary action by the institution; or</text></subparagraph> <subparagraph id="H17A01DF9A2864CBBAA883D781BCFFA39" indent="up1" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">is convicted by any Federal, State, or local court of competent jurisdiction of a felony.</text></subparagraph></paragraph> 
<paragraph id="HF5625D4DE07943A682C979DE41CBD628" indent="up1"><enum>(2)</enum> 
<subparagraph id="H3A9A23D55A904276931DE945E3D078E6" display-inline="yes-display-inline"><enum>(A)</enum><text>The Foundation may not stop the payments provided in this Act without first affording the student—</text> <clause id="HFB8A15478818462BBE4A7D60D7B47911" indent="up1"><enum>(i)</enum><text>reasonable notice, which shall include the reason for stopping such payments identified under subsection (a) or subsection (c)(1) and any additional relevant information, as determined by the Foundation; and</text></clause> 
<clause id="H45D342BDE84047B6A5998467724F1D6A" indent="up1"><enum>(ii)</enum><text>opportunity for a hearing.</text></clause></subparagraph> <subparagraph id="H85F192A437F647C4BB86FA1C1309F22D" indent="up1"><enum>(B)</enum><text>If the Foundation, after reasonable notice and opportunity for hearing, finds that a student does not meet the conditions of receiving payment in accordance with subsection (a) or subsection (c)(1), the Foundation shall—</text> 
<clause id="H36C68628938A41BE8CC1F6FDD1EBE304"><enum>(i)</enum><text>stop the payments provided in this Act for such student; and</text></clause> <clause id="H301F8306F8514813BFD5F759B676586F"><enum>(ii)</enum><text display-inline="yes-display-inline">provide written notice to such student, which shall include the reason for stopping such payments identified under subsection (a) or subsection (c)(1) and any additional relevant information, as determined by the Foundation.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H8983011B4F1F40029E0CC2AB98C5B05B" commented="no"><enum>(d)</enum><text display-inline="yes-display-inline">A student whose payments are stopped pursuant to subsection (a) or subsection (c)(1) or an individual who fails to be employed in public service for three out of the first seven years of employment following completion of the graduate degree for which the individual used such payments shall repay to the Foundation an amount equal to the sum of—</text> <paragraph id="H0AF5C0570E1B449B8B7738B084173BBB" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">the total amount of payments provided in this Act to such student; and</text></paragraph> 
<paragraph id="H88930692FE944D37A898ED906E9E1AB0" commented="no"><enum>(2)</enum><text>interest at the rate of 6 percent per annum on the total amount described in paragraph (1).</text></paragraph></subsection> <subsection id="H7371436A6C6642C18AF1F14ED6A03320" commented="no"><enum>(e)</enum><text display-inline="yes-display-inline">The Foundation shall ensure all scholarship recipients are notified of the conditions that apply to receiving payments provided in this Act as described in this section, prior to the date of the first such payment.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H9C174A9119DE494896190A9B9528B90A"><enum>6.</enum><header>Executive Secretary of Foundation</header> 
<subsection id="H9745483EEA574BF9A406668A8F85CF7D"><enum>(a)</enum><header>In general</header><text>Section 12 of the Harry S Truman Memorial Scholarship Act (<external-xref legal-doc="usc" parsable-cite="usc/20/2011">20 U.S.C. 2011</external-xref>) is amended—</text> <paragraph id="H313E9EDEC49C4DA5ADAC071C1DEC6133"><enum>(1)</enum><text>in subsection (a), by striking <quote>who shall be appointed by the Board</quote> and inserting <quote>who shall be appointed by an affirmative vote of not less than two-thirds of the members of the Board</quote>; and</text></paragraph> 
<paragraph id="H8DD744DA6AD24205BACC44EF853108E4"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H9C0299ECBCA94FE48C57F1E16AC339BF" display-inline="no-display-inline"> <subsection id="HBF2D3D516775454A87EAC7E2D8401033"><enum>(c)</enum><text display-inline="yes-display-inline">The Executive Secretary shall serve a term of 4 years and may be reappointed to up to two additional terms of four years in accordance with subsection (a).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HFDAEBDA2CA474EECBCA8B951B3F91A8F"><enum>(b)</enum><header>Appointment</header><text display-inline="yes-display-inline">Not later than 90 days after a quorum of the members of the Board of Trustees of the Harry S Truman Scholarship Foundation have been appointed in accordance with section 3(b)(2) of this Act, the Board shall appoint an Executive Secretary of the Foundation in accordance with section 12 of the Harry S Truman Memorial Scholarship Act (<external-xref legal-doc="usc" parsable-cite="usc/20/2011">20 U.S.C. 2011</external-xref>), as amended by subsection (a).</text></subsection> <subsection id="HF2B2DA940BCF4B2389C4E6BFAAC0ED1D"><enum>(c)</enum><header>Service of incumbent</header><text display-inline="yes-display-inline">The individual serving as Executive Secretary of the Harry S Truman Scholarship Foundation as of the date of enactment of this Act may only continue serving in such position until the earlier of—</text> 
<paragraph id="H3C5BC9DB1DEB47B4B59ABDBC1A32FAB8"><enum>(1)</enum><text>the date on which the Board of Trustees of the Foundation appoints a new Executive Secretary in accordance with subsection (b); or</text></paragraph> <paragraph id="H856A739299FA4A68A0402C565E430C1E"><enum>(2)</enum><text display-inline="yes-display-inline">the expiration of the 90 day period beginning on the date that a quorum of the members of the Board have been appointed in accordance with section 3(b)(2).</text></paragraph></subsection></section> 
<section id="H7CAE71C8A72246D2A4DE4352016DA5E9"><enum>7.</enum><header>Transparency provisions</header><text display-inline="no-display-inline">Section 13 of the Harry S Truman Memorial Scholarship Act (<external-xref legal-doc="usc" parsable-cite="usc/20/2012">20 U.S.C. 2012</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="H4F7872DE772145FFA4C9A5F72C80C5B5" display-inline="no-display-inline"> <subsection id="H820EEF89D1B8459B9D8EC94E0BB985A3"><enum>(c)</enum> <paragraph id="H353DAE8A499C4D08BB28BADD7102A627" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">The Foundation shall preserve in unaltered format, and make available on a publicly accessible website of the Foundation, the following materials of the Foundation:</text> 
<subparagraph id="H985245F9949145B786F6B94719AC4F61"><enum>(A)</enum><text>Press releases.</text></subparagraph> <subparagraph id="HE69908B6EDC844DD9C715A38D3A0CBF0"><enum>(B)</enum><text>Program announcements.</text></subparagraph> 
<subparagraph id="H786CBFE894504A068419F16DE4515736"><enum>(C)</enum><text>Biographies of scholarship recipients.</text></subparagraph></paragraph> <paragraph id="HB2EA92010D144F3A8D2608EC72BD6307" indent="up1"><enum>(2)</enum><text>The materials described in paragraph (1) may not be deleted, hidden, or password-protected.</text></paragraph> 
<paragraph id="H5DCF544946304305BDD8637C5A761F1B" indent="up1"><enum>(3)</enum><text>Any edits made to the materials described in paragraph (1) after such materials were initially published shall be clearly identified and, in a case in which an edit has been made to such materials, a copy of the original, unaltered materials shall remain available to the public on a website of the Foundation.</text></paragraph> <paragraph id="H27077CBCB6FC44C5AD59A2719E88FD58" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">The requirements of this subsection shall apply to any materials published by the Foundation before, on, or after the date of enactment of this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H46134446D6C94FFD9E90FC2F37E161F3"><enum>8.</enum><header>Effective date and applicability</header> 
<subsection id="H7DF2C268D7E843CB87DBD82D387D9848"><enum>(a)</enum><header>Applicability</header><text display-inline="yes-display-inline">This Act and the amendments made by this Act shall apply only with respect to scholarships awarded under the Harry S Truman Memorial Scholarship Act (<external-xref legal-doc="usc" parsable-cite="usc/20/2002">20 U.S.C. 2002</external-xref>) on or after the date of enactment of this Act.</text></subsection> <subsection id="HE2E932F2B7D44AF5981EA5AD9D46009F"><enum>(b)</enum><header>Treatment of previously awarded scholarships</header><text display-inline="yes-display-inline">Nothing in this Act or the amendments made by this Act shall be construed to invalidate or revoke, or alter the terms and conditions of, a scholarship that was awarded under the Harry S Truman Memorial Scholarship Act (<external-xref legal-doc="usc" parsable-cite="usc/20/2002">20 U.S.C. 2002</external-xref>) before the date of enactment of this Act. The Harry S Truman foundation shall take such steps as may be necessary to continue to fund and administer such previously awarded scholarships.</text></subsection></section>
