R. 7892</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20260312">March 12, 2026</action-date><action-desc><sponsor name-id="O000086">Mr. Owens</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Higher Education Act of 1965 to require to the Secretary of Education to use an identity fraud detection system to review each FAFSA to determine whether the FAFSA presents a reasonable suspicion of identity fraud.</official-title></form><legis-body id="H8B9DD181375C484685D2DD25C63395EA" style="OLC"><section id="HE3B8F2B6B1064EF8B745C83F42FF82F6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Aid for Ghost Students Act of 2026</short-title></quote>.</text></section><section id="H72342707A8C74F5FAACD99D9F1B6B3C9"><enum>2.</enum><header>Identity fraud detection system</header><subsection id="HBF0C2F1F40BC4AC3A45335174A515F84"><enum>(a)</enum><header>Identity fraud detection system</header><text display-inline="yes-display-inline">Section 483 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1090">20 U.S.C. 1090</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H29DA42F4EE21402996197242C14FAE68" style="OLC"><subsection id="H1CC30AD05E644AD1AF202A3E9ACCC77D"><enum>(e)</enum><header>Identity fraud detection system</header><paragraph id="H4BE45897C05C456489D6447C193E15A1"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to or in conjunction with other verification processes carried out under this title, the Secretary shall use an identity fraud detection system to review each application submitted under this section on or after October 1, 2026, to determine whether the application presents a reasonable suspicion of identity fraud. If the Secretary determines that such an application presents a reasonable suspicion of identity fraud, the Secretary shall carry out notifications in accordance with <internal-xref idref="H1CC30AD05E644AD1AF202A3E9ACCC77D" legis-path="(e)(4)">paragraph (2)</internal-xref>.</text></paragraph><paragraph id="HAF0EA99836AF43F88148CD242D44F96A"><enum>(2)</enum><header>Notification of reasonable suspicion of identity fraud</header><text>If the Secretary determines that an application submitted under this section presents a reasonable suspicion of identity fraud, the Secretary shall—</text><subparagraph id="H7F40A8EE7EE6461FBA9C6D6337EC4020" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">provide the applicant with notice—</text><clause id="H71546379A82F4617A2B1DB7B1CFAF352" commented="no"><enum>(i)</enum><text>of such determination and the basis for such determination;</text></clause><clause id="H7F3FE1B73FFD4AA897AC4CA0CC31EC4E" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">that the information described in <internal-xref idref="H1CC30AD05E644AD1AF202A3E9ACCC77D" legis-path="(e)(4)(C)">subparagraph (B)</internal-xref> will be transmitted to each institution of higher education designated by the applicant in the application; and</text></clause><clause id="HFC3B95D1C6F24784833A65CFB8506AAA" commented="no"><enum>(iii)</enum><text>that the applicant is subject to additional identity verification requirements in accordance with section 487(a)(15); and</text></clause></subparagraph><subparagraph id="HB419361AE28F4660ADE9B1B8DB72B1B9"><enum>(B)</enum><text>transmit to each institution designated by the applicant in the application, a notice—</text><clause id="HBC63C381CBE74A88982F73EAAE509C2A"><enum>(i)</enum><text display-inline="yes-display-inline">that such application presents a reasonable suspicion of identity fraud; and</text></clause><clause id="HD5F0E0C935D94E2FA723721C70D4F761"><enum>(ii)</enum><text display-inline="yes-display-inline">that the applicant is subject to identity verification requirements to be carried out by the institution in accordance with section 487(a)(15)(B), before the institution may disburse Federal financial aid under this title to such applicant.</text></clause></subparagraph></paragraph><paragraph id="H5E6BB3C294A54E84A7E8211529D53549" commented="no"><enum>(3)</enum><header>Congressional notices and report</header><subparagraph id="H6008BBDB0D9340ECBEFB8E108FE42CD9" commented="no"><enum>(A)</enum><header>Notices</header><text>The Secretary shall submit to the authorizing committees—</text><clause id="H34F20D4DE71A44C0AA739D6E6A32D8D6"><enum>(i)</enum><text>not later than November 1, 2026, a written description of the identity fraud detection system required under this subsection; and</text></clause><clause id="HFCC4E5B1F3554A68BC8771E17D362AE4"><enum>(ii)</enum><text>not later than 30 days after implementing any substantial change to such system, a written description and rationale for such change.</text></clause></subparagraph><subparagraph id="H33B3F5BEF9CF4814999DFF48DE334B1E" commented="no"><enum>(B)</enum><header>Annual evaluation and report</header><text display-inline="yes-display-inline">Not later than October 1, 2027, and annually thereafter, the Secretary shall conduct an evaluation of the effectiveness of the identity fraud detection system carried out under this subsection, and submit to the authorizing committees a report on the use and effectiveness of such system.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H16BC2874669D4F4AAD5A8930346313FD"><enum>(b)</enum><header>Additional verification requirements</header><paragraph id="H44C93E8E11104FB7948040119111AD07"><enum>(1)</enum><header>Amendment</header><text>Section 487(a)(15) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1094">20 U.S.C. 1094(a)(15)</external-xref>) is amended—</text><subparagraph id="H1075BBE4FD414A97A14487CC153CCB31"><enum>(A)</enum><text>by striking <quote><header-in-text level="paragraph" style="OLC">(15)</header-in-text> The institution acknowledges</quote> and inserting <quote><header-in-text level="paragraph" style="OLC">(15)</header-in-text><header-in-text level="subparagraph" style="OLC">(A)</header-in-text> The institution acknowledges</quote>; and</text></subparagraph><subparagraph id="HC5CCDEC70A8B40728C0869C8D8FAF8D5"><enum>(B)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="H01405B9077224D76A109849BD7B5E980" display-inline="no-display-inline"><subparagraph id="H556C6C5AE9BC4B53A4AED034E728DD21"><enum>(B)</enum><text display-inline="yes-display-inline">Beginning on October 1, 2026, the institution will not disburse Federal financial aid under this title to an applicant whose application under section 483 presents a reasonable suspicion of identity fraud under section 483(e), unless the institution, in accordance with procedures established by the Secretary—</text><clause id="HF52A321C65EC4B91B8E44E111B3F0F98"><enum>(i)</enum><text>determines that a reasonable suspicion of identity fraud is not present by confirming the identity of such applicant using in-person verification or live, synchronous audiovisual verification;</text></clause><clause id="HF71BAEFA45774B62B619C7986AAC09DB" commented="no"><enum>(ii)</enum><text>notifies the Secretary that the identity of the applicant has been verified; and</text></clause><clause id="H2C87C5E9A8E44351AFF407ED16DD4150"><enum>(iii)</enum><text>maintains a record of such identity verification.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HDAB514EC9FF54C3287CB20E60583C2C1"><enum>(2)</enum><header>Institutional verification procedures</header><text display-inline="yes-display-inline">Not later than October 1, 2026, the Secretary of Education shall establish guidelines with respect to identity verification procedures to be carried out by institutions of higher education under subparagraph (B) of section 487(a)(15) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1094">20 U.S.C. 1094(a)(15)</external-xref>), as amended by paragraph (1).</text></paragraph></subsection></section></legis-body></bill>
