which was referred to the <committee-name committee-id="HED00">Committee on Education and Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Elementary and Secondary Education Act of 1965 to exclude certain instructional approaches from comprehensive literacy instruction, to prioritize certain funds to promote the use of evidence-based literacy instruction and supports aligned to the science of reading, and for other purposes.</official-title></form><legis-body id="H0AEE2DA19F9447D0A6A9D259290FA26C" style="OLC"><section id="H3AA8FA9B87E94AB6942B7F59108F1191" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Science of Reading Act of 2026</short-title></quote>.</text></section><section id="H66EEB7A19F7846599900F6E5DC47CA31" commented="no"><enum>2.</enum><header>Promoting reading instruction aligned to science of reading</header><subsection id="HD99AF96817784E07A5BE387919623F57" commented="no"><enum>(a)</enum><header>Comprehensive literacy instruction</header><text display-inline="yes-display-inline">Section 2221(b) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6641">20 U.S.C. 6641(b)</external-xref>) is amended—</text><paragraph id="H2810F71CE8634AA1B72B374D4BE79156"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="H6387665EFEAD4A69A4C87E29E31A4BB8" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (K), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="H0D7E5CD856CE454988AC1FD5F3C7F0F4"><enum>(B)</enum><text>in subparagraph (L), by striking the period and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H429B2EBDC5284A4699BF43F1F02CE481"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HBCA24EA636AD4A0F9C192E9DB93EE1B4"><subparagraph id="H1078A35730014BF4A57A486E49D83C58"><enum>(M)</enum><text display-inline="yes-display-inline">does not include the use of a three-cueing model. </text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H647415972E4848179BD28ED7F1EFFCF7"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H1E9513DC4FE949DCAF66D2F59840CDD7" display-inline="no-display-inline"><paragraph id="HFAFB1FF125FD405DAA3D0951BCD3D41D" commented="no"><enum>(4)</enum><header>Science of reading</header><text display-inline="yes-display-inline">The term <term>science of reading</term> means an interdisciplinary body of evidence-based research about reading and issues related to reading and writing that—</text><subparagraph id="H5463FE4441BD480ABEFFB3F50565AA0D" commented="no"><enum>(A)</enum><text>identifies instruction in phonemic awareness, phonics, vocabulary, fluency, comprehension, and writing as essential components to skilled reading;</text></subparagraph><subparagraph id="HE5B9AEF75E1D43DC8D1C215B383C22F3"><enum>(B)</enum><text>demonstrates the importance of background knowledge, oral language, the connection between reading and writing, and strong writing instruction;</text></subparagraph><subparagraph id="HC99E3FD99B9545398F4DE4A32D0F9BFF" commented="no"><enum>(C)</enum><text>explains why some students have difficulty with reading and writing; and</text></subparagraph><subparagraph id="HAAFF6466CC14431CAFEEDD3FE9B433F4" commented="no"><enum>(D)</enum><text>does not use a three-cueing model.</text></subparagraph></paragraph><paragraph id="H19D2CA4396D546D282133E8FBF1987CA"><enum>(5)</enum><header>Three-cueing model</header><text>The term <term>three-cueing model</term> means an instructional approach or model that—</text><subparagraph id="H90914BBA223B4174B7A9383B81AA1C09"><enum>(A)</enum><text>uses meaning drawn from context, pictures, or syntax as the primary basis for teaching word recognition (commonly referred to as <quote>meaning, structure and syntax, and visual cues</quote> or <quote>MSV</quote>); or</text></subparagraph><subparagraph id="H7B317822C3D44DA9B22B7D0A1DFEF269"><enum>(B)</enum><text>teaches visual memory as the primary basis for word recognition.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H7E1AE277A29741488365211C4B5CD493"><enum>(b)</enum><header>State applications for comprehensive literacy State development grants</header><text>Section 2222(d)(2) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6642">20 U.S.C. 6642(d)(2)</external-xref>) is amended by inserting at the end—</text><quoted-block id="H413F3CCA34894643B64ED7AF5D0C639B" style="OLC"><subparagraph id="HD05F2CF29D8F45B5A00FC36BD8C11C1D"><enum>(F)</enum><text>A description of the extent to which the State comprehensive literacy instruction plan is aligned to the science of reading.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HEECDCE79E84746B19BE83B77396E067D" commented="no"><enum>(c)</enum><header>Comprehensive literacy state development grant priority</header><text display-inline="yes-display-inline">Section 2222(e) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6642">20 U.S.C. 6642(e)</external-xref>) is amended by striking the period at the end and inserting <quote>, that are aligned to the science of reading.</quote>.</text></subsection><subsection id="H080DC3C767EA44CAA8AAB97CAF678E3E" commented="no"><enum>(d)</enum><header>Comprehensive literacy state development subgrant priority</header><paragraph id="H19AF4CAE478B458A8A48C255CA062BF6" commented="no"><enum>(1)</enum><header>Birth through kindergarten entry</header><text display-inline="yes-display-inline">Section 2223(c) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6643">20 U.S.C. 6643(c)</external-xref>) is amended—</text><subparagraph id="H96EB400C2B7E43D6AD436D3E93B4324B" commented="no"><enum>(A)</enum><text>by striking <quote>grants</quote> and inserting <quote>subgrants</quote>;</text></subparagraph><subparagraph id="H89D1464DDDED4A828EE831ACCF1BF032" commented="no"><enum>(B)</enum><text>by striking <quote>grant</quote> and inserting <quote>subgrant</quote>; and</text></subparagraph><subparagraph id="H168CB8934B584C8EA533BFC243BCF4E2" commented="no"><enum>(C)</enum><text>by striking the period at the end and inserting <quote>, that are aligned to the science of reading.</quote>.</text></subparagraph></paragraph><paragraph id="HE8CB669BBF1742489F849F0575DFBB88" display-inline="no-display-inline" commented="no"><enum>(2)</enum><header>Kindergarten through grade 12</header><text display-inline="yes-display-inline">Section 2224(b) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6644">20 U.S.C. 6644(b)</external-xref>) is amended—</text><subparagraph id="HF0A4AA4D22B14763A646E5C85FA6FEA7" commented="no"><enum>(A)</enum><text>by striking <quote>grants</quote> and inserting <quote>subgrants</quote>; and</text></subparagraph><subparagraph id="H4BA1BD82C1344F6E92A0AF35B7639C63"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>that are aligned to the science of reading.</quote>.</text></subparagraph></paragraph></subsection></section><section id="HAD3C8B36EB694848860A6ABB00983163"><enum>3.</enum><header>General provisions</header><subsection id="H5F38B65F18114582BA91EBFFD65C4234"><enum>(a)</enum><header>Applicability</header><text>This Act and the amendments made by this Act shall apply with respect to funds awarded under the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6301">20 U.S.C. 6301</external-xref> note et seq.) on or after the date of the enactment of this Act.</text></subsection><subsection id="H9813BC63C6A441C58BB449B3A667D71B"><enum>(b)</enum><header>Rules of construction</header><text display-inline="yes-display-inline">Nothing in this Act or the amendments made by this Act shall be construed to—</text><paragraph id="H19D93395A8A44A6BAB9AC86ECECB6871" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">limit or alter the rights, protections, and individualized instructional requirements under the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1400">20 U.S.C. 1400 et seq.</external-xref>), section 504 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794">29 U.S.C. 794</external-xref>), or the Americans with Disabilities Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>); or</text></paragraph><paragraph id="H2A86BA1C409C4509AC4D83C2509B1D8D"><enum>(2)</enum><text>authorize any officer or employee of the Federal Government to mandate, direct, or control a State, local educational agency, or school’s specific instructional content, academic standards and assessments, curricula, or program of instruction.</text></paragraph></subsection></section></legis-body></bill>
