R. 7862</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20260309">March 9, 2026</action-date><action-desc><sponsor name-id="B000668">Mr. Bentz</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the National Flood Insurance Act of 1968 to limit the application of the Endangered Species Act with respect to certain actions under the national flood insurance program, and for other purposes.</official-title></form><legis-body id="H912C559D2B1C4501B1B07EEBE624F2FB" style="OLC"><section id="H798C62B5BC224BC8B0B1CEA198B4BD27" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Flood Insurance Program Clarification Act of 2026</short-title></quote>. </text></section><section id="HB861891FB4314985807F0A667E4161A1"><enum>2.</enum><header>Application of the Endangered Species Act with respect to certain actions under the national flood insurance program</header><text display-inline="no-display-inline">Section 1317 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4024">42 U.S.C. 4024</external-xref>) is amended—</text><paragraph id="H5D4F79A2ADC64FE49013F8FB9C8A150A"><enum>(1)</enum><text>by striking <quote>In</quote> and inserting the following: </text><quoted-block style="OLC" id="H692828D014BA48BD915EF3A34C4D33B3" display-inline="no-display-inline"><subsection id="H5D459CE97F15419EB5C062D900A78DB6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HC09DE3576F804E2393C4229D6B04083F"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H4DE64CEB5D9243D9B822155522492AC4" display-inline="no-display-inline"><subsection id="H53EC64E58C434A159CA87324DE710C87"><enum>(b)</enum><header>Application of Endangered Species Act</header><text display-inline="yes-display-inline">Section 7(a) of the Endangered Species Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536(a)</external-xref>) shall not apply to any actions by the Administrator pursuant to sections 1305(c), 1306, 1360, 1361(c), 1363 of this title, and section 100216 of the Biggert-Waters Flood Insurance Reform Act of 2012.</text></subsection><subsection id="H34848C6B833447C08AE949C2F6D8A85C"><enum>(c)</enum><header>Biological opinions under the Endangered Species Act</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the enactment of this subsection, the Director of the United States Fish and Wildlife Service and the Assistant Administrator for Fisheries shall withdraw any existing biological opinions under section 7(a)(2) of the Endangered Species Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536(a)(2)</external-xref>) that evaluate the impacts of the national flood insurance program. Biological opinions withdrawn under this subsection shall have no effect and shall not be reissued.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H29397B6BC6784B9BBB1A070C8DD3B73B"><enum>3.</enum><header>Criteria for land management and use with respect to the national flood insurance program</header><text display-inline="no-display-inline">Section 1361(c) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4102">42 U.S.C. 4102(c)</external-xref>) is amended by inserting after <quote>local measures which</quote> the following: <quote>are for the sole purpose of protecting property and human health, and</quote>.</text></section></legis-body></bill>
