<section id="HF0779326C6144491B4EF68A055049F71" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Getting Rich in Congress Act</short-title></quote>.</text></section> <section id="H4DE3A18F14534ED2B6ADC5FC7F3A7E8D"><enum>2.</enum><header>Restrictions on trade of covered investments</header> <subsection id="H13D3735226674F9990A7ABDC5DB4B1AD"><enum>(a)</enum><header>Restrictions</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/131">Chapter 131</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text>

<subchapter id="HCD76E86AF2384B3B9B8820107482AA56"><enum>IV</enum><header>Restrictions on trade of covered investments</header>
<section id="H9CA1EBE901404FF29ECA40A846C94A22"><enum>13151.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter:</text> <paragraph id="HE3577DD0F7684D97B87C09B676137678" display-inline="no-display-inline"><enum>(1)</enum><header>Commodity</header><text>The term <term>commodity</term>—</text>
<subparagraph id="H3744CE40106A4122BF749D5C0DBC873F"><enum>(A)</enum><text>has the meaning given the term in section 1a of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1a">7 U.S.C. 1a</external-xref>); and</text></subparagraph> <subparagraph id="HC0F2F3CFA170475BB2003BD91CFDE8BC"><enum>(B)</enum><text>does not include a precious metal (as defined in section 1027.100 of title 31, Code of Federal Regulations).</text></subparagraph></paragraph>
<paragraph id="H2B6EB2CD93E247EE92117EF455CAF709"><enum>(2)</enum><header>Covered individual</header><text display-inline="yes-display-inline">The term <term>covered individual</term> means any of the following:</text> <subparagraph id="H2F87AC5B756445BBBF06DAA50EC0A29B" commented="no"><enum>(A)</enum><text>A Member of Congress as defined in section 13101.</text></subparagraph>
<subparagraph id="H21B0CA34C1ED413DAB582C7DE7B6F70D"><enum>(B)</enum><text>The President.</text></subparagraph> <subparagraph id="H31DF61B58F0A43E7B26B635C82B1A522"><enum>(C)</enum><text>The Vice President.</text></subparagraph>
<subparagraph id="HD7708C51925D47B4A03955B8D5274E95"><enum>(D)</enum><text display-inline="yes-display-inline">A candidate (as defined in section 301 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30101">52 U.S.C. 30101</external-xref>)) for nomination for election or for election to the office of President, Vice President, or Senator or Representative in, or Delegate or Resident Commissioner to, Congress, beginning on the date the candidate designates or redesignates a political committee (as required in section 302(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/30102">52 U.S.C. 30102(e)</external-xref>)), and ending on the earlier of—</text> <clause id="HDFE697BF83864226A4C70EDFA22213C5"><enum>(i)</enum><text>the date the candidate announces the suspension of the candidate’s campaign for such nomination or office;</text></clause>
<clause id="H7D7161ED08374990942207D27356D25C"><enum>(ii)</enum><text>the date the candidate withdraws from the election or concedes the election for such nomination or office; or</text></clause> <clause id="H4F1EFFE6930247398F1785A8A95397BF"><enum>(iii)</enum><text>the date the oath of office for such office is given to the candidate.</text></clause></subparagraph>
<subparagraph id="H1E551B710FBA4C1E9FE62BBE70F0BAE8" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">A dependent child (as that term is defined in section 13101) or a spouse an individual described in subparagraph (A) through (D) of this paragraph.</text></subparagraph></paragraph> <paragraph id="H9885FEB5C081425C9A949860EC873BB7"><enum>(3)</enum><header>Covered investment</header><text>The term <term>covered investment</term>—</text>
<subparagraph id="H10841D316E7040809822A6FE176A3117"><enum>(A)</enum><text display-inline="yes-display-inline">means an investment in a digital asset, a security, a commodity, a future, or any comparable economic interest acquired through synthetic means, such as the use of a derivative, including an option, warrant, or other similar means; and</text></subparagraph> <subparagraph id="H9A4F69197D364606B5971DDB11D65341"><enum>(B)</enum><text>does not include—</text>
<clause id="H4AB29E601A394379A786F349C76E8682"><enum>(i)</enum><text display-inline="yes-display-inline">a widely held investment fund that is diversified and publicly traded on a national or regional stock exchange;</text></clause> <clause id="HCD1A58F106494FEC82B51A1429D7EE42"><enum>(ii)</enum><text>a United States Treasury bill, note, or bond;</text></clause>
<clause id="H9D4DCB41EC7347ABAC7E0688C17978FE"><enum>(iii)</enum><text>a State or municipal government bill, note, or bond; or</text></clause> <clause id="HE01D3EBF2B754C09920B3A1C42BF6A5A"><enum>(iv)</enum><text>any compensation received by the spouse or dependent child of a covered official from their employer.</text></clause></subparagraph></paragraph>
<paragraph id="H8B74C247F11549E3B77A0E1E9EC074A6"><enum>(4)</enum><header>Digital asset</header><text display-inline="yes-display-inline">The term <term>digital asset</term> has the meaning given the term in <external-xref legal-doc="usc" parsable-cite="usc/26/6045">section 6045(g)(3)(D)</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/6045">26 U.S.C. 6045(g)(3)(D)</external-xref>).</text></paragraph> <paragraph id="HC33839C827B444D1A619CC651EDCB20B"><enum>(5)</enum><header>Diversified</header><text display-inline="yes-display-inline">The term <term>diversified</term>, with respect to an investment fund, means such fund does not have a stated policy of concentrating its investments in any industry, business, single country other than the United States, or bonds of a single State within the United States except for the State in which the Member of Congress resides.</text></paragraph>
<paragraph id="H8E0F02ACC8EF4FC499A28FA741514751" display-inline="no-display-inline"><enum>(6)</enum><header>Future</header><text>The term <term>future</term> means a financial contract obligating the buyer to purchase an asset or the seller to sell an asset, such as a physical commodity or a financial investment, at a predetermined future date and price.</text></paragraph> <paragraph id="HB60DAB600B4346D6B71E54009901FE5B" display-inline="no-display-inline"><enum>(7)</enum><header>Security</header><text>The term <term>security</term> has the meaning given the term in section 3(a) of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78c">15 U.S.C. 78c(a)</external-xref>).</text></paragraph>
<paragraph id="H33AC73EE03464C1D9B4B4D619C70B04B"><enum>(8)</enum><header>Supervising ethics office</header><text>The term <term>supervising ethics office</term> has the meaning given that term in section 13101.</text></paragraph></section> <section id="H23ECA315FFD9400E8875A95E33C4BD45"><enum>13152.</enum><header>Trade of covered investments</header> <subsection id="H44DE66D4A73149EF9C3D6F19DBD4272A" display-inline="no-display-inline"><enum>(a)</enum><header>Conduct</header><text display-inline="yes-display-inline">Except as described in subsection (b), no covered individual may, directly or indirectly, buy or sell a covered investment, unless such covered investment is located in a qualified blind trust.</text></subsection>
<subsection id="H8DFFC9074A7B40BF89455FBA6826DC6A"><enum>(b)</enum><header>Occupational exception</header><text display-inline="yes-display-inline">A covered individual described in section 13151(2)(C) may buy or sell any covered investment if such covered investment is not owned by a covered individual and if such trade is performed as a function of the primary occupation of the spouse or dependent child.</text></subsection> <subsection id="HD8074BD9038F487BB759845AEA3B573E"><enum>(c)</enum><header>Disclosure</header><text>A covered individual shall provide information or materials on a quarterly basis to the supervising ethics office to ensure that the covered individual is in compliance with the provisions of this subchapter.</text></subsection></section>
<section id="HEE8B724F5DD84268B203CAB2F32FC6F7"><enum>13153.</enum><header>Penalties</header>
<subsection id="HC186F5B6810545139B05021E82633222" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A violation of the restrictions on trading or ownership of covered investments in section 13152 shall be handled as follows:</text> <paragraph id="H78808B55D7CB4534AD37DF2D58B413FF" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">With respect to a violation by any individual described in any of subparagraphs (A) through (C) of section 13151(2), at the direction of the supervising ethics office, payment into the Treasury in an amount equal to the sum of—</text>
<subparagraph id="H78549A25100E4CE2B690E3BB502A963F" commented="no"><enum>(A)</enum><text>the profits of any transaction that violates the provisions of this subchapter; and</text></subparagraph> <subparagraph id="H9B24FA3B10C84D5EBE6ED84684411F67" commented="no"><enum>(B)</enum><text>if determined applicable and appropriate by the supervising ethics office, an amount equal to three times the value of the covered investment at issue.</text></subparagraph></paragraph>
<paragraph id="H052FB20757B548A5804412AEF55DE874" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">With respect to any individual described in subparagraph (D) or (E) of section 13151(2), the Attorney General shall assess a civil penalty in an amount equal to the sum of—</text> <subparagraph id="HB6E45B0D56C34E3C9933879E232F668B" commented="no"><enum>(A)</enum><text>the profits of any transaction that violates the provisions of this subchapter; and</text></subparagraph>
<subparagraph id="HE725477DE49E4327B8F12BFE3D3473C9" commented="no"><enum>(B)</enum><text>if determined applicable and appropriate by the Attorney General, an amount equal to three times the value of the covered investment at issue.</text></subparagraph></paragraph></subsection> <subsection id="HFAFA0311261042EF9B2FCD3C03963B1B"><enum>(b)</enum><header>Payment restrictions</header><text display-inline="yes-display-inline">A Member of Congress or candidate may not pay any of the penalties under this section by using amounts from the following sources:</text>
<paragraph id="H9620D0603B2E40939519FE9BE3EFFE2B"><enum>(1)</enum><text>The Members’ Representational Allowance.</text></paragraph> <paragraph id="H1C82B0B2D8244292AF50A6BFE916CAB1"><enum>(2)</enum><text display-inline="yes-display-inline">The Senators’ Official Personnel and Office Expense Account.</text></paragraph>
<paragraph id="HBFEDEFE2D88C4079A07585834E8686D3"><enum>(3)</enum><text display-inline="yes-display-inline">Any contribution (as defined in section 301(8) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30101">52 U.S.C. 30101(8)</external-xref>)) accepted as a candidate, or any other donation received as support for activities of the individual as a holder of Federal office.</text></paragraph></subsection> <subsection id="H3B8DF3B5C8F1469BA79473F95B572116"><enum>(c)</enum><header>Publication</header><text>Each supervising ethics office shall publish on a publicly available website a description of—</text>
<paragraph id="H6F4D83C0F83940D098CFB168C8E8B0B6"><enum>(1)</enum><text>each violation of this subchapter as determined by the supervising ethics office; and</text></paragraph> <paragraph id="HB679C00892064332AED0346CED21A194"><enum>(2)</enum><text>the penalty assessed by the supervising ethics office with respect to each violation under paragraph (1).</text></paragraph></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H25F41BF9128B4032B69989CE999C96E4"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for such chapter 131 is amended by adding at the end the following:</text> <toc regeneration="no-regeneration"> <toc-entry level="subchapter">Subchapter IV—Restrictions on Trade of Covered Investments</toc-entry> <toc-entry level="section">13151. Definitions.</toc-entry> <toc-entry level="section">13152. Trade of covered investments.</toc-entry> <toc-entry level="section">13153. Penalties.</toc-entry></toc></subsection></section> <section id="H2FA5A7DDDC904A0D9B668DA4F37009EA" section-type="subsequent-section"><enum>3.</enum><header>Lifetime ban on former Members of Congress and individuals appointed to advice and consent positions from lobbying on behalf of foreign countries of concern</header><text display-inline="no-display-inline">Section 207 of title 18, United States Code, is amended by adding at the end the following:</text>
<quoted-block style="USC" id="H32C5FCEED5BC4F78A2612A09DFB18A1A" display-inline="no-display-inline">
<subsection id="H275293CE40464412ADB6EFE0AB200DC3"><enum>(m)</enum><header>Restrictions relating to foreign countries of concern</header>
<paragraph id="H0ADA9F0881CB491D89D736B9098AA6CD"><enum>(1)</enum><header>In general</header><text>Any person who is a Member of the House of Representatives, a Senator, or was appointed to a position by the President, by and with the advice and consent of the Senate, and who knowingly, at any point after that person leaves office—</text> <subparagraph id="H83B66F313AEE46B7B16E25F8DE6C5F39"><enum>(A)</enum><text display-inline="yes-display-inline">represents a foreign country of concern before any officer or employee of the United States Government with the intent to influence a decision of such officer or employee in carrying out his or her official duties, or</text></subparagraph>
<subparagraph id="HDF738F233802491BA645CA89D8FE5F20"><enum>(B)</enum><text display-inline="yes-display-inline">aids or advises a foreign country of concern with the intent to influence a decision of any officer or employee of the United States Government, in carrying out his or her official duties,</text></subparagraph><continuation-text continuation-text-level="paragraph">shall be punished as provided in section 216 of this title.</continuation-text></paragraph> <paragraph id="HAFAA79DFBEA0478AB1A83813D5158D8C"><enum>(2)</enum><header>Foreign country of concern defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>foreign country of concern</term> means the People’s Republic of China, the Democratic People’s Republic of Korea, the Russian Federation, the Islamic Republic of Iran, or any other country determined to be a country of concern by the Secretary of State.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H37A3F3009B7840D9B4BA609BE8E44F08" section-type="subsequent-section"><enum>4.</enum><header>Registration of spouses of senior Federal officials and disclosures relating to lobbying activities</header>
<subsection id="HD0B74C5FCF594B76A44EAFE28D04F56E"><enum>(a)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that spouses of high-ranking officials—</text> <paragraph id="HF73358F45E62481CB0191740D0559D62"><enum>(1)</enum><text display-inline="yes-display-inline">are afforded unique privileges of access to numerous government officials due to their close personal relationship with a high-ranking official;</text></paragraph>
<paragraph id="HA51CCD3F3C1246BFBEC6EE60A432CDD3"><enum>(2)</enum><text display-inline="yes-display-inline">often have the ability to influence a policy decision made by a government official to benefit an individual of their choosing, including themselves, or a private entity;</text></paragraph> <paragraph id="H2A03E70E780F4AB19AFA8BB9D8F5989A"><enum>(3)</enum><text display-inline="yes-display-inline">are not covered under the Lobbying Disclosure Act, creating loopholes ripe for exploitation for nefarious purposes, including self-enrichment; and</text></paragraph>
<paragraph id="HD49F8EDDFCE64B108E3C2BFC7BA06C59"><enum>(4)</enum><text display-inline="yes-display-inline">must be held to a higher level of scrutiny to prevent abuse of or the appearance of abuse of their close proximity to high-ranking officials.</text></paragraph></subsection> <subsection id="HC2CECAEBD1F54359851D88B5693959E9"><enum>(b)</enum><header>In general</header> <paragraph id="H4CEA1B3A8CDD49B0B8AEE60F5215F0E9"><enum>(1)</enum><header>Registration</header> <subparagraph id="H7706C3761C22438D801A6B1C94993035"><enum>(A)</enum><header>Current officials</header><text display-inline="yes-display-inline">Not later than 45 days after the date that guidance is issued under subsection (d), a spouse of any individual who is a covered Federal official on such date shall register with the Secretary of the Senate and Clerk of the House of Representatives.</text></subparagraph>
<subparagraph id="H88EE31D71AD148F0999FFEAA129FCE4E"><enum>(B)</enum><header>Future officials</header><text>Not later than 45 days after the date that an individual begins service as a covered Federal official after the date that such guidance is issued, the spouse of such official shall register with the Secretary and Clerk.</text></subparagraph></paragraph> <paragraph id="HFA8FDB1C5D3E47D099BC8E03F2B43F9A"><enum>(2)</enum><header>Exemption</header><text display-inline="yes-display-inline">A spouse shall be exempt from this section if the spouse has registered, or is registered, with the Secretary and the Clerk in accordance with section 4 of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1603">2 U.S.C. 1603</external-xref>).</text></paragraph>
<paragraph id="H1C24613AC1F54D21BEEC4216887AD323"><enum>(3)</enum><header>Termination</header><text>An individual who is a spouse of a covered Federal official shall not be subject to the requirements of this section beginning on the date that is one year after—</text> <subparagraph id="HF53DD86E07D049FD9256BB5C1EB0BD67"><enum>(A)</enum><text>the date the applicable Federal official is no longer a covered Federal official; or</text></subparagraph>
<subparagraph id="HD9EA5FF2ADFE43DA81048E3EEF3F070F"><enum>(B)</enum><text>the individual is no longer the spouse of a covered Federal official.</text></subparagraph></paragraph></subsection> <subsection id="HFB2CF5C5B0B244B1AB4973C181045722"><enum>(c)</enum><header>Disclosure</header> <paragraph id="H2A28CDDD7DA5496CB6011D20A994C221"><enum>(1)</enum><header>In general</header><text>Not later than 20 days after the end of each 3-month period beginning on the first day of January, April, July, and October of each year in which a spouse is registered pursuant to subsection (b), the spouse shall disclose any covered advocacy activities during such quarterly period.</text></paragraph>
<paragraph id="H84F06052A24F46C48FF70577904268D1"><enum>(2)</enum><header>Contents of report</header><text>Each quarterly report filed under paragraph (1) shall contain—</text> <subparagraph id="H36EDA160444B4D4B901E208630EC7B75"><enum>(A)</enum><text>the name of the spouse, the name of the client which received such covered advocacy activities, and any changes or updates to the information provided in the initial registration;</text></subparagraph>
<subparagraph id="H48225289D4D94259A22A754614127926"><enum>(B)</enum><text>for each general issue in which the spouse engaged in covered advocacy activities on behalf of the client during the quarterly period—</text> <clause id="H1AB25036826F4A4DAF2A88D36365F135"><enum>(i)</enum><text>a list of the specific issues upon which spouse engaged in covered advocacy activities, including, to the maximum extent practicable, a list of bill numbers and references to specific executive branch actions;</text></clause>
<clause id="H48D429FAF1B04D0C9D63BEDCDDFCAE3D"><enum>(ii)</enum><text>a statement to the Houses of Congress and the Federal agencies contacted by spouse on behalf of the client; and</text></clause> <clause id="HBC97C3BDC14E4C428C4B41E22B69A596"><enum>(iii)</enum><text>a description of the interest, if any, of any foreign entity in such covered advocacy activities;</text></clause></subparagraph>
<subparagraph id="H6FB6E4413BD44C249CBD297438FD4366"><enum>(C)</enum><text>an estimate of any such expenses incurred in connection with covered advocacy activities during the quarterly period; and</text></subparagraph> <subparagraph id="H3E1FA8B3EE6F47038318762378BA75F3"><enum>(D)</enum><text>for each client, immediately after listing the client, an identification of whether the client—</text>
<clause id="H3E0DC5B12F3946A1A88018412864CCA0"><enum>(i)</enum><text display-inline="yes-display-inline">had an interest before a covered executive branch official (as that term is defined in section 3 of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1602">2 U.S.C. 1602</external-xref>));</text></clause> <clause id="HC4915668EBB6431A850055257945882D"><enum>(ii)</enum><text>had an interest before a covered legislative branch official (as that term is defined in such section 3); and</text></clause>
<clause id="HAA9C7488FB2B455BA2ED7FC377FE00AC"><enum>(iii)</enum><text>if the registrant is a spouse of a Member of Congress, if such client has operations within the congressional district represented by such Member.</text></clause></subparagraph></paragraph> <paragraph id="HAAF61EEFE9724380AD6C28387DE5DAF7"><enum>(3)</enum><header>Electronic filing required</header><text display-inline="yes-display-inline">A report required to be filed under this section shall be filed in electronic form, in addition to any other form that the Secretary of the Senate or the Clerk of the House of Representatives may require.</text></paragraph>
<paragraph id="HCDFB71D527FD49DA9F0C84DB6126954C"><enum>(4)</enum><header>Public disclosure</header><text display-inline="yes-display-inline">The Secretary or the Clerk shall make available for public inspection and copying at reasonable times the registrations and reports filed under this section and make such report available for public inspection over the internet as soon as practicable after the report is filed.</text></paragraph></subsection> <subsection id="HF82ACB6B48AF4979A99E9085DE4707D8"><enum>(d)</enum><header>Guidance</header><text>Not later than 180 days after the date of the enactment of this section, the Secretary of the Senate and the Clerk of the House of Representatives shall issue guidance on the implementation of this section. Such guidance shall provide for the following:</text>
<paragraph id="H6A8ADE64F83749768AFA20E9C53AE66E"><enum>(1)</enum><text display-inline="yes-display-inline">Guidance and assistance on the registration and reporting requirements of this section and common standards, rules, and procedures for compliance with this section.</text></paragraph> <paragraph id="H9983CE4E0BAD4EE89D871EC4A0C8DD2D"><enum>(2)</enum><text>Relevant administrative procedures to allow electronic filing of any registration or reporting required under this section and public disclosure of such electronic filings.</text></paragraph>
<paragraph id="H60D5326437DD4984A9DBDF39C3E7235E"><enum>(3)</enum><text>Procedures for—</text> <subparagraph id="HB5EC8B28C09A4110BD99A07A2B10BEDC"><enum>(A)</enum><text>reviewing and verifying the accuracy, completeness, and timeliness of registration and reports;</text></subparagraph>
<subparagraph id="H178E3356C189446EA80ACD9C56E9DEBB"><enum>(B)</enum><text display-inline="yes-display-inline">notifying (in writing) any spouse of a covered Federal official that the spouse may be in noncompliance with this section; and</text></subparagraph> <subparagraph id="H5B8D98A0E10240F89B3B27A5036AECB3"><enum>(C)</enum><text display-inline="yes-display-inline">notifying the United States Attorney for the District of Columbia that a spouse may be in noncompliance with this section if the spouse has been notified under subparagraph (B) and has failed to provide an appropriate response within the 60-day period after such notice.</text></subparagraph></paragraph>
<paragraph id="HC1E149DE1D2044FE9AB00DEF5AC58EB2"><enum>(4)</enum><text>Any other requirements necessary to carry out this section.</text></paragraph></subsection> <subsection id="HF973319C20C3454B8387A55CD195AB87"><enum>(e)</enum><header>Penalties</header> <paragraph id="HAF49CAA903F649269891E019418A55B1"><enum>(1)</enum><header>Civil penalty</header><text>Whoever knowingly fails to—</text>
<subparagraph id="HED382E743A344332AD2CD13B7A298921"><enum>(A)</enum><text display-inline="yes-display-inline">remedy a defective registration within 60 days after notice of notice of such a defect by the Secretary of the Senate or the Clerk of the House of Representatives; or</text></subparagraph> <subparagraph id="H46F04B92AA2F485AB0F7DF41231DD433"><enum>(B)</enum><text display-inline="yes-display-inline">comply with any other provision of this section;</text></subparagraph><continuation-text continuation-text-level="paragraph">shall, upon proof of such knowing violation by a preponderance of the evidence, be subject to a civil fine of not more than $200,000, depending on the extent and gravity of the violation.</continuation-text></paragraph>
<paragraph id="HB3B888ABF19940579796183E9ACD3056"><enum>(2)</enum><header>Criminal penalty</header><text display-inline="yes-display-inline">Whoever knowingly and corruptly fails to comply with any provision of this section shall be imprisoned for not more than 5 years or fined under title 18, United States Code, or both.</text></paragraph></subsection> <subsection id="HBB67E0394DCB4315ABA6FB26C4E53E91"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text>
<paragraph id="HE1B4089C3F8F45719B419618783A3424"><enum>(1)</enum><text>the term <term>covered advocacy activity</term> means any support provided to or work on behalf of a client for the preferred outcome of a client, including legislative or executive branch actions, which is done outside of reasonable advocacy work, such as—</text> <subparagraph id="H435DF527A46B4E5F810BBFC8F3ABF190"><enum>(A)</enum><text>any utilization of contacts made available due to the service of the covered Federal official;</text></subparagraph>
<subparagraph id="H6858E43107BA43488F2A7F38927288A4"><enum>(B)</enum><text>any support provided to or work on behalf of a client completed by the spouse over 2 or more quarterly periods; and</text></subparagraph> <subparagraph id="H518134CE5D10456AB1607A5678239E8D"><enum>(C)</enum><text display-inline="yes-display-inline">any activity that qualifies as a lobbying contact (as that term is defined in section 3 of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1602">2 U.S.C. 1602</external-xref>)); and</text></subparagraph></paragraph>
<paragraph id="HE5F2882257254AB7A95C715F30113E2E"><enum>(2)</enum><text>the term <term>covered Federal official</term> means a—</text> <subparagraph id="H905A2EE3BCC94572A12421F036448A5D"><enum>(A)</enum><text display-inline="yes-display-inline">a Senator or a Representative in, or Delegate or Resident Commissioner to, the Congress; and</text></subparagraph>
<subparagraph id="HC44E3944507A405EA89DE68F03C9415F"><enum>(B)</enum><text display-inline="yes-display-inline">any individual occupying a position in the Federal Government for which appointment is required to be made by the President, by and with the advice and consent of the Senate.</text></subparagraph></paragraph></subsection></section> <section id="HCC57F28C67764A07BEE686E3BB1452EA"><enum>5.</enum><header>Prohibition with respect to serving on corporate boards for Members of Congress or spouses of Members of Congress</header> <subsection id="H4BE6CCF83DD44A2F84F81F0C85D20AC2"><enum>(a)</enum><header>Prohibition</header><text>Except as provided under <internal-xref idref="H412BE750BC3045E1B9AF060C3F512149" legis-path="2.(b)">subsection (b)</internal-xref>, a Member of Congress or the spouse of a Member of Congress may not serve as an officer or member of any board of any for-profit association, corporation, or other similar for-profit entity.</text></subsection>
<subsection id="H412BE750BC3045E1B9AF060C3F512149"><enum>(b)</enum><header>Exception</header>
<paragraph id="H75E253DA69744079818404FA6BB19900"><enum>(1)</enum><header>In general</header><text>If the spouse of a Member of Congress serves as an officer or member of any board of an entity described in <internal-xref idref="H4BE6CCF83DD44A2F84F81F0C85D20AC2" legis-path="5.(a)">subsection (a)</internal-xref> prior to the date of the enactment of this Act or prior to the date that the individual’s spouse began serving as a Member of Congress, the spouse—</text> <subparagraph id="H809CC77F895C4FCCAB7EBCA55FD7B6BF"><enum>(A)</enum><text display-inline="yes-display-inline">may serve out the reminder of the duration of the board term held as of the date of the enactment of this Act, which may include as an officer of such board;</text></subparagraph>
<subparagraph id="HD50CF791BCE74A85A6E38732CF4C411F"><enum>(B)</enum><text>may not seek an officer position during the term described in <internal-xref idref="H809CC77F895C4FCCAB7EBCA55FD7B6BF" legis-path="5.(b)(1)(A)">subparagraph (A)</internal-xref>; and</text></subparagraph> <subparagraph id="H933732AABD994534884EDAAD42DE54E5"><enum>(C)</enum><text>may not serve out an additional board term, including as an officer, after the conclusion of the term described in <internal-xref idref="H809CC77F895C4FCCAB7EBCA55FD7B6BF" legis-path="5.(b)(1)(A)">subparagraph (A)</internal-xref> for as long as their respective spouse serves as a Member of Congress.</text></subparagraph></paragraph>
<paragraph id="HA1DB49343BF24473835B79595BF3BDAD"><enum>(2)</enum><header>Disclosure requirements</header>
<subparagraph id="H04B74FEAF86B49109AEA4F23AA1AEEC9"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If the spouse of a Member of Congress continues to serve on a board pursuant to <internal-xref idref="H75E253DA69744079818404FA6BB19900" legis-path="2.(b)(1)">paragraph (1)</internal-xref>, the spouse shall submit a report to the Secretary of the Senate and the Clerk of the House of Representatives disclosing such service not later than 20 days after the end of the quarterly period beginning on the first day of January, April, July, and October of each year.</text></subparagraph> <subparagraph id="H2F20F8A907D04758BA2C67C5463BEDA4"><enum>(B)</enum><header>Report</header><text>The report required under <internal-xref idref="H04B74FEAF86B49109AEA4F23AA1AEEC9" legis-path="2.(b)(2)(A)">subparagraph (A)</internal-xref> shall include the following:</text>
<clause id="HF4D3E90563344D8F814862AB360B0C15"><enum>(i)</enum><text>The details of the individual’s service as an officer or member of any board of any for-profit association, corporation, or other entity.</text></clause> <clause id="HD3F04370C5454B67942EF81BEF3D7A56"><enum>(ii)</enum><text display-inline="yes-display-inline">A description of any lobbying activity carried out by the for-profit association, corporation, or other entity during that quarter, and if the spouse engaged in such activity.</text></clause></subparagraph>
<subparagraph id="HF6FF3A4E216241D9A9CDE8A7636AD54A"><enum>(C)</enum><header>Public disclosure</header><text>The Secretary of the Senate or the Clerk of the House of Representatives, as the case may be, shall publicly disclose on their electronic website in a timely fashion any such report filed under <internal-xref idref="H04B74FEAF86B49109AEA4F23AA1AEEC9" legis-path="2.(b)(2)(A)">subparagraph (A)</internal-xref>.</text></subparagraph></paragraph></subsection> <subsection id="HAFDF8D3F2C59438CA89D3A826393F743"><enum>(c)</enum><header>Member of Congress defined</header><text display-inline="yes-display-inline">In this section, the term <term>Member of Congress</term> means a Senator or Representative in, or Delegate or Resident Commissioner to, the Congress.</text></subsection></section>
<section display-inline="no-display-inline" section-type="subsequent-section" id="HB205E8C582D7425484F80AA919102443"><enum>6.</enum><header>Disclosure requirements with respect to gifts received by spouse of Members of Congress</header>
<subsection id="H67D803718AE145F99FDE10D55874B6A7"><enum>(a)</enum><header>Requirements with respect to House of Representatives</header><text display-inline="yes-display-inline">Clause 5 of rule XXV of the Rules of the House of Representatives is amended—</text> <paragraph id="HAFD27DE07A584E2D8674E03A6981A43E"><enum>(1)</enum><text>in paragraph (c)—</text>
<subparagraph id="HF78B4BC281024CF387C657D09548AA01"><enum>(A)</enum><text>in subparagraph (1)(A), by inserting <quote>, including a covered relative,</quote> after <quote>or employee of the House</quote>;</text></subparagraph> <subparagraph id="H23DD46E804CD4B1AA69EBE812C219D52"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (2), by inserting <quote>, including a covered relative,</quote> after <quote>or employee of the House</quote>; and</text></subparagraph>
<subparagraph id="H007816ADE4DA4DD3BF1290F90FD877E8"><enum>(C)</enum><text display-inline="yes-display-inline">in subparagraph (3), by inserting <quote>, including a covered relative,</quote> after <quote>or employee of the House</quote>;</text></subparagraph></paragraph> <paragraph id="H36F89E7F7570451BAE2BF9EA37579B8A"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (d), by inserting <quote>, including a covered relative,</quote> after <quote>or employee of the House</quote>;</text></paragraph>
<paragraph id="HCB82B3B742984125A0B58B8041C2988F"><enum>(3)</enum><text>in paragraph (e)—</text> <subparagraph id="H417B646F014A4979B60D9CDC8B056D21"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (1), by inserting <quote>, including a covered relative,</quote> after <quote>or employee of the House</quote>;</text></subparagraph>

<subparagraph id="H55260B4396C648438630F8D5E6B4E7FE"><enum>(D)</enum><text display-inline="yes-display-inline">in subparagraph (4), by inserting <quote>, including a covered relative,</quote> after <quote>or employees of the House</quote>;</text></subparagraph></paragraph> <paragraph id="H877F5A9EA53845599DB5CB0958433773" display-inline="no-display-inline"><enum>(4)</enum><text>in paragraph (f)—</text>

<subparagraph id="H5566A31B45BE4A888609811446879AB6"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text> <quoted-block style="OLC" id="H97FB801F57E9431D8FAE828D530E687A" display-inline="no-display-inline"> <rules-subparagraph id="H92BE13ACFFDA464CB1D1D93F54EFD875"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>covered relative</term> means an individual who is legally married to a Member, Delegate, or Resident Commissioner, but does not include such an individual if the individual is a lobbyist registered under the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1601">2 U.S.C. 1601 et seq.</external-xref>).</text></rules-subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection>
<subsection id="H44D28B83018B4915BBB922C6199C88CC"><enum>(b)</enum><header>Application to Senate</header><text display-inline="yes-display-inline">For purposes of rule XXXV of the Standing Rules of the Senate, the requirements under paragraphs 2(c), 2(d), 2(e), 4(a), and 4(b) of such rule, including the information required to be disclosed under such paragraphs, shall apply to and include, as the case may be, an individual who is legally married to a Member of the Senate, but does not apply to or include such an individual if the individual is a lobbyist registered under the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1601">2 U.S.C. 1601 et seq.</external-xref>).</text></subsection></section> </legis-body> </bill>
