<section id="HEC507F97D32B41C8B7DD966B3968432D" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Weather Safety Board Act</short-title></quote>.</text></section> 
<section id="H6B6BFBCA4FE74068885FD1A4FB69D536"><enum>2.</enum><header>National Weather Safety Board</header> 
<subsection id="H4B05A684FC594B80BE980577BEF939BC"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, there shall be established as an independent entity a safety board to be known as the <quote>National Weather Safety Board</quote> (in this section referred to as the <quote>Safety Board</quote>).</text> </subsection> <subsection id="H4CAFFB06EFC1470681752B9F4814636B"><enum>(b)</enum><header>Membership</header> <paragraph id="HDF52908142084E41917D23CFC0A5F8EE"><enum>(1)</enum><header>Appointment</header><text>The Safety Board shall be composed of not fewer than 7 members appointed by the President, by and with the advice and consent of the Senate. Not more than 4 members may be appointed from the same political party.</text></paragraph> 
<paragraph id="HBC4103C4501547C9BEF89F73E5473982"><enum>(2)</enum><header>Candidate list</header><text>The Administrator of the National Oceanic and Atmospheric Administration and the Secretary of Homeland Security shall jointly submit to the President a list of candidates for consideration for appointment to the Safety Board under paragraph (1). Such candidates shall have professional backgrounds in any of the following:</text> <subparagraph id="H7C5884E6B6994B63930327AFC259B94E"><enum>(A)</enum><text>Atmospheric and hydrological sciences.</text></subparagraph> 
<subparagraph id="HB28A28C92DB047FAAF096AA1AE756D8C"><enum>(B)</enum><text>Commercial meteorological sciences.</text></subparagraph> <subparagraph id="HB9392BBB3A034D4C86E7906358F25AB2"><enum>(C)</enum><text>Social sciences.</text></subparagraph> 
<subparagraph id="H14970F3B309649139B1DD600F7CDC2F9" commented="no"><enum>(D)</enum><text>Academia.</text></subparagraph> <subparagraph id="HF6AD77D71FAC4282BBCC25CBE5B18B79" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">Emergency management administration and operations.</text></subparagraph></paragraph> 
<paragraph id="HE6CD22D327F24175BD2576C5E83AA1AD" commented="no"><enum>(3)</enum><header>Terms</header> 
<subparagraph id="H94A85F8EE4E944F0AF8ACBECE4155424" commented="no"><enum>(A)</enum><header>In general</header><text>The term of office of each member of the Safety Board shall be 5 years.</text></subparagraph> <subparagraph id="HE39A2CFA67E14944A42BE2FBC5479861" commented="no"><enum>(B)</enum><header>Vacancies</header><text>Any member appointed to fill a vacancy occurring before the expiration of the term for which the member’s predecessor was appointed shall be appointed only for the remainder of that term. A member may serve after the expiration of that member’s term until a successor is appointed in accordance with this subsection.</text></subparagraph> 
<subparagraph id="H3EF06A7183E64461A72E20BFA032EEC2" commented="no"><enum>(C)</enum><header>Removal</header><text>The President may only remove a member for neglect of duty or malfeasance in office.</text></subparagraph></paragraph> <paragraph id="H345EC04FFB454F1394EBFE16C7B8E78E" commented="no"><enum>(4)</enum><header>Quorum</header><text>Five members of the Safety Board shall constitute a quorum.</text> </paragraph></subsection> 
<subsection id="HC0E87C0FC5024B638DDF702E8A43A58A" commented="no"><enum>(c)</enum><header>Offices</header><text display-inline="yes-display-inline">The Safety Board shall establish offices as necessary to carry out investigations under subsection (d).</text></subsection> <subsection id="HA8F9CC7340FE473F8958708E572230B6"><enum>(d)</enum><header>Investigation of covered major disasters</header> <paragraph id="H16BC3A05599C4A2C82C25E20F144283D" commented="no"><enum>(1)</enum><header>System development</header> <subparagraph id="H221DA6477F4A46EFB2E30E037F7D7859" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 120 days after the establishment of the Safety Board, the Safety Board shall develop a system, in coordination with the Chief of Engineers, the Secretary of Homeland Security, the Federal Communications Commission, the Administrator of the National Oceanic and Atmospheric Administration, and the Director of National Weather Service, to provide information described in subparagraph (B) to members of the Safety Board regarding a covered major disaster before a vote is held pursuant to paragraph (2).</text></subparagraph> 
<subparagraph id="HBC02584C91224574A2F812E5A8568D69" commented="no"><enum>(B)</enum><header>Information described</header><text>The information described in this subparagraph is the following:</text> <clause id="H41F9AADDAEFD42F29202DD111641B4B5" commented="no"><enum>(i)</enum><text>The number of people impacted by a covered major disaster referred to in subparagraph (A).</text></clause> 
<clause id="H7CE324C14B3342B286F3DEFE0776A06F" commented="no"><enum>(ii)</enum><text>The severity of such disaster.</text></clause> <clause id="HC2BAAD4A5BEA4099BF51BC6651FF0F3F" commented="no"><enum>(iii)</enum><text>The economic impact of such disaster.</text> </clause></subparagraph></paragraph> 
<paragraph id="HB98A39974FCC4F4EA11A8DC762CB8AA8"><enum>(2)</enum><header>Procedure</header><text display-inline="yes-display-inline">Not later than 14 days after the date on which a severe weather event is declared to be a covered major disaster, the Safety Board shall conduct a vote to determine whether to investigate such disaster. Such vote shall be based on the information provided pursuant to paragraph (1). The Safety Board may so investigate such a disaster only if a quorum of the members present and voting vote in the affirmative.</text></paragraph> <paragraph id="H1391364FC73B4AE39C33286789FA7B0B"><enum>(3)</enum><header>Entities investigated</header> <subparagraph id="H27106548CF364584966C899CC15FF29A"><enum>(A)</enum><header>In general</header><text>If the Safety Board votes in the affirmative to investigate a covered major disaster pursuant to paragraph (2), the Safety Board shall carry out the following:</text> 
<clause id="HE6F5BE74F5A9420694A4911018ED7239"><enum>(i)</enum><text>Investigate, with respect to such disaster, the preparedness for and response to such disaster of the entities specified in subparagraph (C), as the Safety Board determines relevant.</text></clause> <clause id="HEE2FDF42981C45E087BC7441E97328D8"><enum>(ii)</enum><text display-inline="yes-display-inline">Review, with respect to such disaster, the following:</text> 
<subclause id="HE9C6963BFB954F378D07B9F8A161B77B"><enum>(I)</enum><text display-inline="yes-display-inline">Any determinations made by such entities as a result of weather forecasts or warnings to protect life and property.</text></subclause> <subclause id="HF0582B7BE0C6472792F2E8A8E2D6AFD1"><enum>(II)</enum><text>Whether such determinations were sufficient.</text></subclause></clause> </subparagraph> 
<subparagraph id="HDE3C08CDF3FD468FA1EA3AEED0A8521A"><enum>(B)</enum><header>Compliance</header><text>Upon request of the Safety Board, an entity specified in subparagraph (C) subject to an investigation conducted pursuant to this subsection, shall provide to the Safety Board any data or information the Safety Board determines necessary to aid in such investigation.</text></subparagraph> <subparagraph id="H128775AEA0504BB4A43A9D1F3289D657"><enum>(C)</enum><header>Entities specified</header><text>An entity specified in this subparagraph is any of the following, as the Safety Board determines relevant:</text> 
<clause id="HE8E055801C7E43AC92FDF51886A6D7F2"><enum>(i)</enum><text display-inline="yes-display-inline">The Army Corps of Engineers.</text></clause> <clause id="HDC3B7222C022428D8CD61FC761B48933"><enum>(ii)</enum><text>The Department of Homeland Security, including the Federal Emergency Management Agency.</text></clause> 
<clause id="H84325B9F6958439AADFCBEAB7B70D3DD"><enum>(iii)</enum><text>The Federal Communications Commission.</text></clause> <clause id="HE993E14B0A0A4E35AFAF7EFA2C475B2F"><enum>(iv)</enum><text display-inline="yes-display-inline">The National Oceanic and Atmospheric Administration.</text></clause> 
<clause id="H805D3FB0A916464680A334AEA666CF10"><enum>(v)</enum><text display-inline="yes-display-inline">The National Weather Service.</text></clause></subparagraph></paragraph> <paragraph id="H25F029C386F7479E82D05360407DDBD9"><enum>(4)</enum><header>Subpoena authority</header><text display-inline="yes-display-inline">The Safety Board may issue a subpoena, enforceable in a Federal district court, to obtain testimony or evidence related to an investigation conducted pursuant to this subsection.</text></paragraph> </subsection> 
<subsection id="H08C1C52C4BDE421FBDCE1955A919E298"><enum>(e)</enum><header>Reports</header> 
<paragraph id="H4991229BBFC542A388BEDEA078299288"><enum>(1)</enum><header>Preliminary report</header><text display-inline="yes-display-inline">Not later than 90 days after the conclusion of a covered major disaster, the Safety Board shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Science, Space, and Technology of the House of Representatives, and, upon request, the President, a preliminary report relating to an investigation conducted pursuant to subsection (d) regarding such disaster.</text></paragraph> <paragraph id="H56FA467F4F5449A684B6C3E297BC4C1A"><enum>(2)</enum><header>Final report</header><text display-inline="yes-display-inline">Not later than 20 months after the date on which the Safety Board begins an investigation under subsection (d), the Safety Board shall submit to the Committee on Commerce, Science, Transportation of the Senate and the Committee on Science, Space, and Technology of the House of Representatives, and, upon request, the President, a report that includes the following:</text> 
<subparagraph id="HF99C81DC078A45C6BF23D1ED52B7955A"><enum>(A)</enum><text>A summary of the findings of such investigation.</text></subparagraph> <subparagraph id="H21B805CD6ACF4CBF963998735CB3E712"><enum>(B)</enum><text display-inline="yes-display-inline">Based on such findings, any recommendations for each entity specified in subsection (d)(3)(C) investigated in accordance with such investigation to improve preparedness for and response to covered major disasters.</text></subparagraph></paragraph></subsection> 
<subsection id="H03B05D28AD3E4E2CA6F9C405075773D0"><enum>(f)</enum><header>Public availability</header><text>The Safety Board shall develop, update, and make publicly available on a website of the Safety Board the following information:</text> <paragraph id="HDD033C1427FA411E8CD5FCB6BC17DF88"><enum>(1)</enum><text>The recommendations included in a report submitted under subsection (e)(2)(B).</text></paragraph> 
<paragraph id="H7A6D839B175F42C28B02B762BEA18A5C" commented="no"><enum>(2)</enum><text>The entity specified in subsection (d)(3)(C) with respect to which each such recommendation was made.</text></paragraph> <paragraph id="H6F6A087252AC42D38D33AF2BC966D382" commented="no"><enum>(3)</enum><text>Whether each such entity has implemented each such recommendation.</text> </paragraph></subsection> 
<subsection id="H4D30566D232E4EB483DB92E04A452E11"><enum>(g)</enum><header>Termination</header><text>The Safety Board shall terminate on the date that is 5 years after the date on which the final member of the Safety Board is confirmed by the Senate.</text> </subsection> <subsection id="HFE693459A4E34E19BE27FBA3BBF96B81" commented="no"><enum>(h)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> 
<paragraph id="H1007B0E1CD194678911B2CFD294DF1BE" commented="no"><enum>(1)</enum><header>Covered major disaster</header><text>The term <quote>covered major disaster</quote> means any of the following:</text> <subparagraph id="H025ECAA599E64C4DAF54AB9FD95DC17F"><enum>(A)</enum><text>A severe weather event that is declared under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>) to be a major disaster.</text></subparagraph> 
<subparagraph id="H07257C19309D4D0B907442F9AE233C08"><enum>(B)</enum><text>A severe weather event that results in any of the following:</text> <clause id="HBBECD630C80C4FEB910EA68D522801C4"><enum>(i)</enum><text>At least 10 fatalities.</text></clause> 
<clause id="HBE29420950054F1B834D6F02490EB32F"><enum>(ii)</enum><text>At least 100 injuries.</text></clause> <clause id="H207D1ED906DD47F7801FA415D65ECF63"><enum>(iii)</enum><text>Rapid-onset mass-casualties, as determined by the Safety Board.</text></clause> </subparagraph> </paragraph> 
<paragraph id="H05F2A911327C42668B11597C65482062" commented="no"><enum>(2)</enum><header>Severe weather event</header><text>The term <quote>severe weather event</quote> means a hurricane, tropical storm, flood, tornado, winter weather event, extreme cold event, or tsunami.</text> </paragraph></subsection> </section> </legis-body></bill>
