<section id="H5614C3D030384FAFADDA53CD6AB27200" section-type="section-one"><enum>1.</enum><header>Transfer of Department of Homeland Security funds</header> 
<subsection id="H58BD3CDD8D0C41ADABA04172C35D9D35"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), during a lapse in appropriations with respect to the Department of Homeland Security, the Secretary of Homeland Security may transfer to other accounts of the Department of Homeland Security—</text> <paragraph id="H582EEC2E9C354DE08D7923A17C07C381"><enum>(1)</enum><text display-inline="yes-display-inline">any unobligated funds appropriated under section 90005 or 90007 of <external-xref legal-doc="public-law" parsable-cite="pl/119/21">Public Law 119–21</external-xref> (commonly known as the <quote>One Big Beautiful Bill Act</quote>); and</text></paragraph> 
<paragraph id="H60E0FB5FF6DD4E67BD6C8FBC64A3D63F"><enum>(2)</enum><text display-inline="yes-display-inline">any unobligated funds appropriated or otherwise made available under <external-xref legal-doc="public-law" parsable-cite="pl/119/21">Public Law 119–21</external-xref> (commonly known as the <quote>One Big Beautiful Bill Act</quote>) for U.S. Immigration and Customs Enforcement or U.S. Customs and Border Protection.</text></paragraph></subsection> <subsection id="HD320BEC66920401DB9A21E73202EF944"><enum>(b)</enum><header>Prohibited transfers</header><text>The Secretary of Homeland Security may not exercise the authority provided under subsection (a) to transfer funds to any account of—</text> 
<paragraph id="HC82429D4239146EA8D767E87BBB5947A"><enum>(1)</enum><text>the Office of the Secretary and Executive Management;</text></paragraph> <paragraph id="HC2363280C8AC47CD9D000691DFA9BE3D"><enum>(2)</enum><text>U.S. Immigration and Customs Enforcement; or</text></paragraph> 
<paragraph id="H94BAC3D81E45463DBD5D49885544FF4F"><enum>(3)</enum><text>U.S. Customs and Border Protection.</text></paragraph></subsection> <subsection id="H52BC19EB982C47D9AE076B7764C458D6"><enum>(c)</enum><header>Prohibition on hiring</header><text>The Secretary of Homeland Security may not use any funds transferred under subsection (a) to appoint any individual to a vacant position within the Department of Homeland Security.</text></subsection></section>
