<section id="H2A8512CCF9A94B2BB11BB94320084CF2" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Event Contract Enforcement Act</short-title></quote>.</text></section> 
<section id="H525EF2C2CA844E7D8C88D755CD08503C"><enum>2.</enum><header>Prohibition on event contracts contrary to the public interest</header> 
<subsection id="HB16D4C1DE554472794FCBC2E21A21E8C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 5c(c)(5)(C) of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/7a-2">7 U.S.C. 7a–2(c)(5)(C)</external-xref>) is amended—</text> <paragraph id="H0C9A2FFC7DAA4AAE8F346EB6052953F9"><enum>(1)</enum><text>by striking clauses (i) and (ii) and inserting the following:</text> 
<quoted-block style="OLC" id="H6E18B6B37FDD4F72A620EBE3F754AF2D" display-inline="no-display-inline"> 
<clause id="HD9A554B001714C56AB6025921BEB9DE8"><enum>(i)</enum><header>Event contracts</header><text display-inline="yes-display-inline">Subject to clause (ii), it shall be unlawful to list or make available for trading on or through a registered entity an agreement, contract, transaction, or swap in an excluded commodity that is based on an occurrence, the extent of an occurrence, or a contingency (other than a change in the price, rate, value, or level of a commodity described in section 1a(19)(i)) in relation to—</text> <subclause id="H2A8DB1C19BAB41E1A4DF6587CE6A5D34"> <enum>(I)</enum> <text>activity that is unlawful under Federal or State law;</text> </subclause> 
<subclause id="HC977E37D9D464E1A85F291C52002C01F"> <enum>(II)</enum> <text>terrorism;</text> </subclause> <subclause id="HD0ECA8426CC74036A223BFE3D55B5535"> <enum>(III)</enum> <text>assassination;</text> </subclause> 
<subclause id="HEF9C986A87B842A387129ED05C04352A"> <enum>(IV)</enum> <text>war;</text> </subclause> <subclause id="H85AE6F3A83374DBE8455AB36971DF4CD"> <enum>(V)</enum> <text>gaming;</text></subclause> 
<subclause id="HD2935163156C48399EB45C2227BA3FB7" display-inline="no-display-inline"><enum>(VI)</enum><text>the result of any vote in an election (as defined in section 301 of the Federal Election Campaign Act of 1971) held under Federal, State, or local law, including a ballot initiative or referendum;</text></subclause> <subclause id="HBD20D31EA7BE4EC083D97F426AA7B9E2"><enum>(VII)</enum><text display-inline="yes-display-inline">conduct by or in any level or branch of the Federal Government or of any State or local government, including by or in any instrumentality or by any personnel of any level or branch of any such government; or</text></subclause> 
<subclause id="H092253916CA74DE09713666B674FAFBB"> <enum>(VIII)</enum> <text>other similar activity determined by the Commission, by rule or regulation, to be contrary to the public interest.</text></subclause></clause> <clause id="HB40FE5A43C164E70A4067BA1586C724C"><enum>(ii)</enum><header>Exemption</header><text display-inline="yes-display-inline">Clause (i)(V) shall not apply with respect to conduct in a State if the law of the State expressly exempts conduct in the State from the application of such clause.</text> </clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HB46A00B6EA054922808A3FE438CD0406"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H461AFD5985B04C7295D2531F47916E87" display-inline="no-display-inline"> <clause id="H3F24D1BB4DCC4124B3B1A00EB406E0C7"><enum>(v)</enum><header>Gaming defined</header><text display-inline="yes-display-inline">In clause (i), the term <term>gaming</term> means any aspect of a live, simulated, or virtual physical or mental challenge or game of chance.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection id="HCE44C61CEF2F4BBDA887566D35C7A7D4"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect on the date that is 180 days after the date of the enactment of this Act.</text> </subsection></section> </legis-body></bill>
