which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Meat Inspection Act to allow interstate shipment of meat and meat food products inspected and passed under qualifying State programs.</official-title></form><legis-body id="H85B7E99EC5264686A4A966E0178F9AAA" style="OLC"><section id="HB2F5022EF6D94564B459327A8B6CB9DA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Meat Freedom Act</short-title></quote>.</text></section><section id="HCD9EB22BD6744730AC2F76FA86F7A1C4"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="HCE5C44DBF3DC4C2692B1A183095AD42B"><enum>(1)</enum><text display-inline="yes-display-inline">State meat inspection programs are authorized under section 301 of the Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/661">21 U.S.C. 661</external-xref>) if the Secretary of Agriculture determines that such programs impose requirements <quote>at least equal to</quote> those imposed under Federal inspection.</text></paragraph><paragraph id="H115374D1031044E0A7A6BAB79BDD8808"><enum>(2)</enum><text>Ranchers and small-scale meat producers operating under compliant State inspection programs are currently limited in their ability to access interstate markets.</text></paragraph><paragraph id="HBC9DDCDBA8F64D09BE3420D1FCA2AB2B"><enum>(3)</enum><text>Allowing interstate shipment of meat and meat food products inspected under qualifying State programs will—</text><subparagraph id="H63B222EEA16E44ABA94BB1A4AD63A7FF"><enum>(A)</enum><text>expand market access for small and mid-sized ranchers;</text></subparagraph><subparagraph id="HD1FCB652477C4EC8AE8CDFFECA913CB6"><enum>(B)</enum><text>increase competition in meat processing;</text></subparagraph><subparagraph id="H18C046653AD64A009E62229B1F99DDAF"><enum>(C)</enum><text>strengthen domestic food supply resilience; and</text></subparagraph><subparagraph id="HAF50FD14B72043BC8028D2A05F8E96D1"><enum>(D)</enum><text>maintain food safety standards equivalent to Federal inspection.</text></subparagraph></paragraph></section><section id="HB1EEADB664854C55ABC7DAFBB449AB22"><enum>3.</enum><header>Interstate shipment of State-inspected meat</header><subsection id="H6ED4D575D6E94E12BE4D256A8BD3342B"><enum>(a)</enum><header>Amendments</header><text display-inline="yes-display-inline">Section 301(a)(1) of the Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/661">21 U.S.C. 661(a)(1)</external-xref>) is amended—</text><paragraph id="HC98947C119A94340B8AEB7C4C2749DA4"><enum>(1)</enum><text>by striking <quote>solely for distribution within such State</quote>; and</text></paragraph><paragraph id="HF00CDA5324084A3998E4FDD922E805F4"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" id="HD214187DF64D4E0382C4507E4CC950DC" display-inline="yes-display-inline"><text>Meat or meat food products may be shipped, transported, offered for sale, or sold in interstate commerce if such meat or meat food products were inspected and passed under such a State meat inspection law, provided that—</text><subparagraph id="H547882AFF66949FDA16CE58C38BA74B5"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary has determined on or after the date that is 36 months before such shipment, transportation, offering for sale, or sale that the State meat inspection law meets the requirements of the previous sentence;</text></subparagraph><subparagraph id="H42F35C785D524E6D9E7A65204E4A3137"><enum>(B)</enum><text display-inline="yes-display-inline">the establishment that produced the meat or meat food products has complied, with respect to such meat or meat food products, with all applicable requirements of such State meat inspection law;</text></subparagraph><subparagraph id="HFCCD680CC4044056AE7235CB35C9D64E"><enum>(C)</enum><text display-inline="yes-display-inline">the meat or meat food product bears labeling indicating that it was inspected and passed under a State meat inspection program for interstate shipment, transportation, and sale; and</text></subparagraph><subparagraph id="H4CC6AE7753CF4454A5B51DFB3A4256AA"><enum>(D)</enum><text>the State that enacted such meat inspection law has agreed to submit to periodic audits by the Secretary.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H881B2E2ABFFE40C6AA84BD74561BFAFA"><enum>(b)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Secretary of Agriculture shall promulgate regulations to implement the amendments made by subsection (a).</text></subsection></section></legis-body></bill>
