applicability</header><text>Except as otherwise provided in this Act, the provisions of chapters 2 through 6 of title II of the Trade Act of 1974, as in effect on June 30, 2021, and as amended by this Act, shall—</text><paragraph id="HAFE1D6E6119B43CE8230EE45CCE1A0FC"><enum>(1)</enum><text>take effect on the date of the enactment of this Act; and</text></paragraph><paragraph id="HFEAC8D88B64F49229BF6DEECF5053F90"><enum>(2)</enum><text>apply with respect to petitions for certification filed under chapter 2, 3, 4, or 6 of title II of the Trade Act of 1974 on or after such date of enactment.</text></paragraph></subsection><subsection id="H4797F1EE48674267B9D25ADA53F23089"><enum>(b)</enum><header>Reference</header><text>Except as otherwise provided in this Act, whenever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a provision of chapters 2 through 6 of title II of the Trade Act of 1974, the reference shall be considered to be made to a provision of any such chapter, as in effect on June 30, 2021.</text></subsection><subsection id="H6EEFE8C67FD642508EC8DA73FF0C6A65"><enum>(c)</enum><header>Repeal of snapback</header><text>Section 406 of the Trade Adjustment Assistance Reauthorization Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/27">Public Law 114–27</external-xref>) is repealed.</text></subsection></section><title id="HEFB2213048BB4766BD9D83DE60FC1EA1"><enum>I</enum><header>Trade Adjustment Assistance for Workers</header><section id="H025879C0CB9A4C5E93FE9DC9E54310EA"><enum>101.</enum><header>Filing petitions</header><text display-inline="no-display-inline">Section 221(a)(1) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2271">19 U.S.C. 2271(a)(1)</external-xref>) is amended—</text><paragraph id="H4003204F671D4CC7ABCBDE76C8BEDFCA"><enum>(1)</enum><text>by amending subparagraph (A) to read as follows:</text><quoted-block id="H58128AAA5E8542B39A4D983170F4195C" style="OLC"><subparagraph id="H766903E375A649219E151BCF0A1D4C05" indent="up1"><enum>(A)</enum><text>One or more workers in the group of workers.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H1CB4BA8A045F4E0994E91287E4BE6A27"><enum>(2)</enum><text>in subparagraph (C), by striking <quote>or a State dislocated worker unit</quote> and inserting <quote>a State dislocated worker unit, or workforce intermediaries, including labor-management organizations that carry out re-employment and training services</quote>.</text></paragraph></section><section id="H8E36B79A6AA34F0B8EB10AAADEA55243"><enum>102.</enum><header>Group eligibility requirements</header><subsection id="HB45B590AACBB4FCCB65A379712584204"><enum>(a)</enum><header>In general</header><text>Section 222(a)(2) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2272">19 U.S.C. 2272(a)(2)</external-xref>) is amended—</text><paragraph id="H85769294BF834559A15B717ADF255F71"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph id="HDCA5FB390F254670829696722917C75B"><enum>(A)</enum><text>in clause (i), by inserting <quote>, failed to increase, or will decrease absolutely due to a scheduled or imminently anticipated long-term decrease in or reallocation of the production capacity of the firm</quote> after <quote>absolutely</quote>; and</text></subparagraph><subparagraph id="HE2BAAA3BA3E44252851A2271DB077C72"><enum>(B)</enum><text>in clause (iii)—</text><clause id="H2DFB454422344361989CE0F78CB93439"><enum>(i)</enum><text>by striking <quote>to the decline</quote> and inserting <quote>to any decline or absence of increase</quote>; and</text></clause><clause id="H09F235355E2B457D9129AFF5259DE368"><enum>(ii)</enum><text>by striking <quote>or</quote> at the end;</text></clause></subparagraph></paragraph><paragraph id="HEC30FADA6F4D42AF9D3F54FBC6FBCDA9"><enum>(2)</enum><text>in subparagraph (B)(ii), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="HB6AEADA887FF45C7BD27247C15119974"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="HEF2D5F02B13B4F559B1EBA33134F22A2" style="OLC"><subparagraph id="H9816C669775D4ABBB18A8028D5FC2ACD" indent="up1"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="H443FFE4562FD41ED8E6885DB2C8C3754"><enum>(i)</enum><text>the sales or production, or both, of such firm have decreased;</text></clause><clause id="HE99206079ABF44BAA221C2407B2E4CA6"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H25210C2B7DBA408AB55B24AFA4A607AD"><enum>(I)</enum><text>exports of articles produced or services supplied by such workers’ firm have decreased; or</text></subclause><subclause id="H829D14161AE84FB39EA82558E0D26DA8"><enum>(II)</enum><text>imports of articles or services necessary for the production of articles or services supplied by such firm have decreased; and</text></subclause></clause><clause id="H2AD1BAA37CF14CADB3FF6E3BBDB35521"><enum>(iii)</enum><text>the decrease in exports or imports described in clause (ii) contributed to such workers’ separation or threat of separation and to the decline in the sales or production of such firm.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HBB92B90D86484F188213D78D5EF0981D"><enum>(b)</enum><header>Repeal</header><text>Section 222 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2272">19 U.S.C. 2272</external-xref>) is amended—</text><paragraph id="H02B81CCAD7ED4581A948D02E32C30535"><enum>(1)</enum><text>in subsections (a) and (b), by striking <quote>importantly</quote> each place it appears; and</text></paragraph><paragraph id="H3C119BB2182D464CB9569B8A3A98F432"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="H9DD88D46926D47F2A5FA3EAEE983A7AC"><enum>(A)</enum><text>by striking paragraph (1); and</text></subparagraph><subparagraph id="HC918D9C3119B43199A169DB9897D5787"><enum>(B)</enum><text>by redesignating paragraphs (2) through (4) as paragraphs (1) through (3), respectively.</text></subparagraph></paragraph></subsection><subsection id="HFD38C547286D411FBD5BBB6FFE2ACED2"><enum>(c)</enum><header>Eligibility of staffed workers and teleworkers</header><text>Section 222 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2272">19 U.S.C. 2272</external-xref>), as amended by subsection (b), is further amended by adding at the end the following:</text><quoted-block id="H51BD3FF0167144AD9652050935B3FF1E" style="OLC"><subsection id="H3FF50ADF2EE9463EB6A3A48FAD668A5B"><enum>(f)</enum><header>Treatment of staffed workers and teleworkers</header><paragraph id="HF265ADE4B6AB411CB8193B9F7A24596F"><enum>(1)</enum><header>In general</header><text>For purposes of subsection (a), workers in a firm include staffed workers and teleworkers.</text></paragraph><paragraph id="H691C72E1B48E486F8303B65DAF647745"><enum>(2)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="HA9559AB7C8AD4951AB60A0E823576FE3"><enum>(A)</enum><header>Staffed worker</header><text>The term <term>staffed worker</term> means a worker who performs work under the operational control of a firm that is the subject of a petition filed under section 221, even if the worker is directly employed by another firm.</text></subparagraph><subparagraph id="H71798B926BDF4544B93365D6F9891A9B"><enum>(B)</enum><header>Teleworker</header><text>The term <term>teleworker</term> means a worker who works remotely but who reports to the location listed for a firm in a petition filed under section 221.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H8AF26A2034844196ACF6206BC270C563"><enum>103.</enum><header>Application of determinations of eligibility to workers employed by successors-in-interest</header><text display-inline="no-display-inline">Section 223 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2273">19 U.S.C. 2273</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HCFA8BB93DD684924A2B0516DABAFD594" style="OLC"><subsection id="HCDF4D21079084FBAA6D4C32F0A0E9A17"><enum>(f)</enum><header>Treatment of workers of successors-in-Interest</header><text>If the Secretary certifies a group of workers of a firm as eligible to apply for adjustment assistance under this chapter, a worker of a successor-in-interest to that firm shall be covered by the certification to the same extent as a worker of that firm.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H4149ABE204B94B21B2D8A2049E409D5A"><enum>104.</enum><header>Provision of benefit information to workers</header><text display-inline="no-display-inline">Section 225 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2275">19 U.S.C. 2275</external-xref>) is amended—</text><paragraph id="HBC9E35F63DAE4B199BCDAA89DDA32B9C"><enum>(1)</enum><text>in subsection (a), by inserting after the second sentence the following new sentence: <quote>The Secretary shall make every effort to provide such information and assistance to workers in their native language.</quote>; and</text></paragraph><paragraph id="H0DC4A6ADA983477DB2A22CBB2FD65323"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="H27DB799F199C4DEA93BF94CB7ED4EEDF"><enum>(A)</enum><text>by redesignating paragraph (2) as paragraph (3);</text></subparagraph><subparagraph id="HF9302DC39C23468F84A5297D1542E3EA"><enum>(B)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block id="HD52BDE6B3A13473DAF10B99B84B7ED76" style="OLC"><paragraph id="H0184FBAF6B2D4EAB8988A32936E65DE8"><enum>(2)</enum><text>The Secretary shall provide a second notice to a worker described in paragraph (1) before the worker has exhausted all rights to any unemployment insurance to which the worker is entitled (other than additional compensation described in section 231(a)(3)(B) funded by a State and not reimbursed from Federal funds).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HEA308702CE8047AEA9E78CDB5495987C"><enum>(C)</enum><text>in paragraph (3), as redesignated by paragraph (2), by striking <quote>newspapers of general circulation</quote> and inserting <quote>appropriate print or digital outlets</quote>; and</text></subparagraph><subparagraph id="H7D8C9C8EF0074CC8A995AAC8F0C4AF27"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block id="H5F256BAB8BD543BBAEDFD80C2359E668" style="OLC"><paragraph id="HCE1140DBC0C64C9BBA16A7298F8A6486"><enum>(4)</enum><text>For purposes of providing sustained outreach regarding the benefits available under this chapter to workers covered by a certification made under this subchapter, the Secretary may take any necessary actions, including the following:</text><subparagraph id="H1ECADE541C5B45D79FB3DFEA7D79156E"><enum>(A)</enum><text>Collecting the email addresses and telephone numbers of such workers from the employers of such workers to provide sustained outreach to such workers.</text></subparagraph><subparagraph id="H3148301133B34A65B9CFBD8E59BC0251"><enum>(B)</enum><text>Partnering with the certified or recognized union, a community-based worker organization, or other duly authorized representatives of such workers.</text></subparagraph><subparagraph id="H93BB64F9DF5145E8B3C231178B996CF2"><enum>(C)</enum><text>Hiring peer support workers to perform sustained outreach to other workers covered by that certification.</text></subparagraph><subparagraph id="H1C649AEAB84F4D0A945F52BEF435923D"><enum>(D)</enum><text>Using advertising methods and public information campaigns, including social media, in addition to notice published in print or digital outlets under paragraph (3).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="HEAFCB4018A47447FA42D7D099A2F0F42"><enum>105.</enum><header>Qualifying requirements for workers</header><subsection id="HAFD55D1F6E7644B891B2AA3889C93CE9"><enum>(a)</enum><header>Modification of conditions</header><paragraph id="HB7DD861BE5894C95ADE08436369543D0"><enum>(1)</enum><header>In general</header><text>Section 231(a) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2291">19 U.S.C. 2291(a)</external-xref>) is amended—</text><subparagraph id="H0AE0384A8F714B7181CE1DB2335EA7C9"><enum>(A)</enum><text>by striking paragraph (2);</text></subparagraph><subparagraph id="H7C199C505EE04083B8881B4EE3B46AEC"><enum>(B)</enum><text>by redesignating paragraphs (3), (4), and (5) as paragraphs (2), (3), and (4), respectively; or</text></clause><clause id="HF18DE58D579949D191115B64806B435D"><enum>(ii)</enum><text>a private pension sponsored by an employer or labor organization.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HD21986448E824A8297DA80F7E38E045C"><enum>106.</enum><header>Modification to trade readjustment allowances</header><text display-inline="no-display-inline">Section 233 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2293">19 U.S.C. 2293</external-xref>) is amended—</text><paragraph id="H5A6ADFB579C1448A90412B0A6936B7DD"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H6AFE53848E994BB4B12F34C2974D8CB7"><enum>(A)</enum><text>in paragraph (2), by inserting after <quote>104-week period</quote> the following: <quote>(or, in the case of an adversely affected worker who requires a program of prerequisite education or remedial education (as described in section 236(a)(5)(D)) in order to complete training approved for the worker under section 236, the 130-week period)</quote>;</text></subparagraph><subparagraph id="H9053B32B65484767A3E49A711CB8FA7A"><enum>(B)</enum><text>in paragraph (3), by striking <quote>65 additional weeks in the 78-week period</quote> and inserting <quote>78 additional weeks in the 91-week period</quote>; and</text></paragraph><paragraph id="H7E05C90DF6C546A5A7314D4C02451D28"><enum>(3)</enum><text>by amending subsection (f) to read as follows:</text><quoted-block id="H3ADF593D686F4BE8A59EC994F5F39428" style="OLC"><subsection id="HEF4606D14C044C3F8E0CECAF2068ACB5"><enum>(f)</enum><header>Payment of trade readjustment allowances To complete training</header><text>Notwithstanding any other provision of this section, in order to assist an adversely affected worker to complete training approved for the worker under section 236 that includes a program of prerequisite education or remedial education (as described in section 236(a)(5)(D)), and in accordance with regulations prescribed by the Secretary, payments may be made as trade readjustment allowances for up to 26 additional weeks in the 26-week period that follows the last week of entitlement to trade readjustment allowances otherwise payable under this chapter.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H41ECAF68B0E74F8892D47486FD0404E9"><enum>107.</enum><header>Automatic extension of trade readjustment allowances</header><subsection id="H208857B8340945AD9089F89656BB5E68"><enum>(a)</enum><header>In general</header><text>Part I of subchapter B of chapter 2 of title II of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2291">19 U.S.C. 2291 et seq.</external-xref>) is amended by inserting after section 233 the following new section:</text><quoted-block id="H23E964C405E24863A5C1F88F4FFEF320" style="OLC"><section id="HFBC314F1592140129E538D040E511900"><enum>233A.</enum><header>Automatic extension of trade readjustment allowances</header><subsection id="H507249BEE23842E3980DB6F9428F1E91"><enum>(a)</enum><header>In general</header><text>Notwithstanding the limitations under section 233(a), the Secretary shall extend the period during which trade readjustment allowances are payable to an adversely affected worker who completes training approved under section 236 by the Secretary during a period of heightened unemployment with respect to the State in which such worker seeks benefits, for the shorter of—</text><paragraph id="H61AB2BA2B5644478BB361ED650E24EFB"><enum>(1)</enum><text>the 26-week period beginning on the date of completion of such training; or</text></paragraph><paragraph id="H4185413910E64D5780F64E0367A287A9"><enum>(2)</enum><text>the period ending on the date on which the adversely affected worker secures employment.</text></paragraph></subsection><subsection id="HEC264D721D024E459CF9772A233856BD"><enum>(b)</enum><header>Job search required</header><text>A worker shall only be eligible for an extension under subsection (a) if the worker is complying with the job search requirements associated with unemployment insurance in the applicable State.</text></subsection><subsection id="H3E390B2B5EFC48BDA683DC0F24C758BB"><enum>(c)</enum><header>Period of heightened unemployment defined</header><text>In this section, the term <term>period of heightened unemployment</term> with respect to a State means a 90-day period during which, in the determination of the Secretary, either of the following average rates equals or exceeds 5.5 percent:</text><paragraph id="H767C42B4698E432182D2A25945506B99"><enum>(1)</enum><text>The average rate of total unemployment in such State (seasonally adjusted) for the period consisting of the most recent 3-month period for which data for all States are published before the close of such period.</text></paragraph><paragraph id="H19A53DA1690F4335AFACB113C8859EF7"><enum>(2)</enum><text>The average rate of total unemployment in all States (seasonally adjusted) for the period consisting of the most recent 3-month period for which data for all States are published before the close of such period.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3E6D8049C02345EF899EEDF6AC2C31BC"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for the Trade Act of 1974 is amended by inserting after the item relating to section 233 the following:</text><quoted-block id="H3DE6717C297B4A4180C8E5F83CA56472" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 233A. Automatic extension of trade readjustment allowances.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H307190E28F044505B8446448364FCBE8" commented="no"><enum>108.</enum><header>Employment and case management services</header><text display-inline="no-display-inline">Section 235 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2295">19 U.S.C. 2295</external-xref>) is amended—</text><paragraph id="HF16EFEE28C894C6AA4D3E42E95D6F755" commented="no"><enum>(1)</enum><text>in paragraph (3)—</text><subparagraph id="H7A102A58D7F14947A5278C6F04527F3B" commented="no"><enum>(A)</enum><text>by inserting after <quote>regional areas</quote> the following: <quote>(including information about registered apprenticeship programs, on-the-job training opportunities, and other work-based learning opportunities)</quote>; and</text></subparagraph><subparagraph id="H37C49D3A14674712A8572F80F7FB817F" commented="no"><enum>(B)</enum><text>by inserting after <quote>suitable training</quote> the following: <quote>, information regarding the track record of a training provider’s ability to successfully place participants into suitable employment</quote>;</text></subparagraph></paragraph><paragraph id="H79B93F18797746E08398AA1215D3713E" commented="no"><enum>(2)</enum><text>by redesignating paragraph (8) as paragraph (10); and</text></paragraph><paragraph id="H87914472280B41AE98D88899A657465A" commented="no"><enum>(3)</enum><text>by inserting after paragraph (7) the following:</text><quoted-block id="H800749B0E8B045A89F8DE5CFBB66A22A" style="OLC"><paragraph id="H1F1BDF7CE6BB44E59D2AAA16F836B497" commented="no"><enum>(8)</enum><text>Information related to direct job placement, including facilitating the extent to which employers within the community commit to employing workers who would benefit from the employment and case management services under this section.</text></paragraph><paragraph id="HCBB6C821D931419A9650AE87266E0D50" commented="no"><enum>(9)</enum><text>Sustained outreach to groups of workers likely to be certified as eligible for adjustment assistance under this chapter and members of certified worker groups who have not yet applied for or been enrolled in benefits or services under this chapter, especially such groups and members from underserved communities.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HB7C6CF72056547BA959E15C629259604"><enum>109.</enum><header>Training</header><text display-inline="no-display-inline">Section 236 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2296">19 U.S.C. 2296</external-xref>) is amended—</text><paragraph id="HA01B802D3B6148FDAEEAB7922A7D8930"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H2451FC26CCFA4A698234336250D59620"><enum>(A)</enum><text>in paragraph (1)(D), by inserting <quote>, with a demonstrated ability to place participants into employment</quote> before the comma at the end;</text></subparagraph><subparagraph id="HB01630C83DCB407581265AF663C7FD72"><enum>(B)</enum><text>in paragraph (3), by adding at the end before the period the following: <quote>, except that every effort shall be made to ensure that employment opportunities are available upon the completion of training</quote>; and</text></subparagraph><subparagraph id="H6794A385953746078733522FB303B49C"><enum>(C)</enum><text>in paragraph (5)—</text><clause id="H2F34D82B0DA344169A6A7B32C4C3DAE6"><enum>(i)</enum><text>in subparagraph (G), by striking <quote>, and</quote> and inserting a comma;</text></clause><clause id="H154DC132652546A38BE37AE631D841F6"><enum>(ii)</enum><text>in subparagraph (H)(ii), by striking the period at the end and inserting <quote>, and</quote>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="H989A03F4CAE94E70A0CD13F9EACB1415"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="HDC0F3720AC6949179B2380507B2BF28C" style="OLC"><subsection id="H4E9209653A2E4DBFAA48B9660368C94F"><enum>(h)</enum><header>Reimbursement for out-of-Pocket training expenses</header><text>If the Secretary approves training for a worker under paragraph (1) of subsection (a), the Secretary may reimburse the worker for out-of-pocket expenses relating to the training program described in paragraph (5) of that subsection that were incurred by the worker on and after the date of the worker’s total or partial separation and before the date on which the certification of eligibility under section 222 that covers the worker is issued.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H6D7C61F664BA41AF8D5A6D825203BA85"><enum>110.</enum><header>Job search, relocation, and child and other dependent care allowances</header><subsection id="H93C9F8425C8644F0ADD2EE16BACE8984"><enum>(a)</enum><header>Job search allowances</header><text>Section 237 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2297">19 U.S.C. 2297</external-xref>) is amended—</text><paragraph id="H3F677D91A95543FCB9084179EC59A8B1"><enum>(1)</enum><text>in subsection (a)(1), by striking <quote>may use funds made available to the State to carry out sections 235 through 238</quote> and inserting <quote>shall use, from funds made available to the State to carry out sections 235 through 238A, such amounts as may be necessary</quote>;</text></paragraph><paragraph id="HB7C105F103E44F849CB56019D73A865F"><enum>(2)</enum><text>in subsection (a)(2), in the matter preceding subparagraph (A), by striking <quote>may grant</quote> and inserting <quote>shall grant</quote>; and</text></paragraph><paragraph id="H9AAD71A866D948D8B1B1C38A0EFEB499"><enum>(3)</enum><text>in subsection (b)—</text><subparagraph id="H773B8773E1844805A0CE6604B4373B1D"><enum>(A)</enum><text>in paragraph (1), by striking <quote>not more than 90 percent</quote> and inserting <quote>100 percent</quote>;</text></subparagraph><subparagraph id="H3A777E960A4F4EB592639294CA38C87B"><enum>(B)</enum><text>in paragraph (2), by striking <quote>$1,250</quote> and inserting <quote>$2,000 (subject to adjustment under paragraph (4))</quote>; and</text></subparagraph><subparagraph id="HE95E50BBBA7B4777AB45D24EA1444AB6"><enum>(C)</enum><text>by adding at the end the following;</text><quoted-block id="H2BF86A6BCFCE48AA9AD861DB9C3DE696" style="OLC"><paragraph id="H1E6FE310D65945B2B58C0ED0249801D5"><enum>(4)</enum><header>Adjustment of maximum allowance limitation for inflation</header><subparagraph id="H014C15D8313E4079831DFDC392E5A8C3"><enum>(A)</enum><header>In general</header><text>The Secretary of Labor shall adjust the maximum allowance limitation under paragraph (2) on the date that is 30 days after the date of the enactment of this paragraph, and at the beginning of each fiscal year thereafter, to reflect the percentage (if any) of the increase in the average of the Consumer Price Index for the preceding 12-month period compared to the Consumer Price Index for fiscal year 2025.</text></subparagraph><subparagraph id="H79A2310B31B143268140BABCA2C87611"><enum>(B)</enum><header>Special rules for calculation of adjustment</header><text>In making an adjustment under subparagraph (A), the Secretary—</text><clause id="H4AD96237A21841FF9FAE66BF81355915"><enum>(i)</enum><text>shall round the amount of any increase in the Consumer Price Index to the nearest dollar; and</text></clause><clause id="H26A6414606334705A996E837D098A165"><enum>(ii)</enum><text>may ignore any such increase of less than 1 percent.</text></clause></subparagraph><subparagraph id="H25B42DFE767B4D7CB6F7C0D1FFE198D2"><enum>(C)</enum><header>Consumer Price Index defined</header><text>For purposes of this paragraph, the term <term>Consumer Price Index</term> means the Consumer Price Index for All Urban Consumers published by the Bureau of Labor Statistics of the Department of Labor.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HBEB7830FDE454835BF2619535EE0C5C9"><enum>(b)</enum><header>Relocation allowances</header><text>Section 238 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2298">19 U.S.C. 2298</external-xref>) is amended—</text><paragraph id="H7BB398BD754540C5B7EA73E736D82A05"><enum>(1)</enum><text>in subsection (a)(1), by striking <quote>may use funds made available to the State to carry out sections 235 through 238</quote> and inserting <quote>shall use, from funds made available to the State to carry out sections 235 through 238A, such amounts as may be necessary</quote>;</text></paragraph><paragraph id="HFE319EFFD123416E81D653E3D23B3F0A"><enum>(2)</enum><text>in subsection (a)(2), in the matter preceding subparagraph (A), by striking <quote>may be granted</quote> and inserting <quote>shall be granted</quote>;</text></paragraph><paragraph id="HFE4E9509DACA43328B76A61F77D19471"><enum>(3)</enum><text>in subsection (b)—</text><subparagraph id="H1FE91B894C2D405EBA90606926C56CFB"><enum>(A)</enum><text>in paragraph (1), by striking <quote>not more than 90 percent</quote> and inserting <quote>100 percent</quote>; and</text></subparagraph><subparagraph id="HDA7CCA887A964E4E874F3C10579EE85C"><enum>(B)</enum><text>may ignore any such increase of less than 1 percent.</text></subparagraph></paragraph><paragraph id="HD8E959008C514D468C1BDB0EC23D8AF3"><enum>(3)</enum><header>Consumer Price Index defined</header><text>For purposes of this subsection, the term <term>Consumer Price Index</term> means the Consumer Price Index for All Urban Consumers published by the Bureau of Labor Statistics of the Department of Labor.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H75DDA514CE054CAAA19453B77C2EEEDF"><enum>(c)</enum><header>Child and other dependent care allowances</header><paragraph id="H4D22EF0833584296B1A46EEFE87E555D"><enum>(1)</enum><header>In general</header><text>Part II of subchapter B of chapter 2 of title II of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2295">19 U.S.C. 2295 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H5B6141546A96431C971ED41F78361BC3" style="OLC"><section id="H05946F05E92B47DF98B26384244FA301"><enum>238A.</enum><header>Child and other dependent care allowances</header><subsection id="H697240D66575429F87E94FD97DC7C7B9"><enum>(a)</enum><header>Child and other dependent care allowances authorized</header><paragraph id="HBCB9FBF1B2E941EB8BF25D592EF3F4EF"><enum>(1)</enum><header>In general</header><text>Each State shall use, from funds made available to the State to carry out sections 235 through 238A, such amounts as may be necessary to allow an adversely affected worker covered by a certification issued under subchapter A of this chapter to file an application for a child and other dependent care allowance with the Secretary, and the Secretary may grant the child care allowance, subject to the terms and conditions of this section.</text></paragraph><paragraph id="HACBDBB660D844AB0899719F2F0EF75F1"><enum>(2)</enum><header>Conditions for granting allowance</header><text>A child and other dependent care allowance shall be granted if the allowance will assist an adversely affected worker to attend training or seek suitable employment, by providing for the care of one or more of the minor dependents of the worker.</text></paragraph></subsection><subsection id="HBC9BC88FD5304F4FB0F32E0BD88D636B"><enum>(b)</enum><header>Amount of allowance</header><text>Any child and other dependent care allowance granted to a worker under subsection (a) shall not exceed $2,000 per minor dependent per year.</text></subsection><subsection id="HE750E0BBAE7D42A3A407BD2AA65D4605"><enum>(c)</enum><header>Adjustment of maximum allowance limitation for inflation</header><paragraph id="H6B1276C089E34BBC9E3B82F9EAB188EF"><enum>(1)</enum><header>In general</header><text>The Secretary of Labor shall adjust the maximum allowance limitation under subsection (b) on the date that is 30 days after the date of the enactment of this subsection, and at the beginning of each fiscal year thereafter, to reflect the percentage (if any) of the increase in the average of the Consumer Price Index for the preceding 12-month period compared to the Consumer Price Index for fiscal year 2025.</text></paragraph><paragraph id="H24EF5C92DA7546F88B24968913514006"><enum>(2)</enum><header>Special rules for calculation of adjustment</header><text>In making an adjustment under paragraph (1), the Secretary—</text><subparagraph id="H744548FF721A4C698D2EC6C3C076B0D2"><enum>(A)</enum><text>shall round the amount of any increase in the Consumer Price Index to the nearest dollar; a career path;</text></subparagraph><subparagraph id="H5E21A3F878B4417F8C2CD77844D7B907"><enum>(C)</enum><text>assist workers from underserved communities to establish a work history, demonstrate success in the workplace, and develop the skills that lead to entry into and retention in unsubsidized employment; and</text></subparagraph><subparagraph id="H599911B26CA544FCA8D66DFACE719EF3"><enum>(D)</enum><text>adequately serve individuals who face the greatest barriers to employment, including people with low incomes, people of color, immigrants, persons with disabilities, and formerly incarcerated individuals.</text></subparagraph></paragraph><paragraph id="H003E1C9266E74A8EBA698CB5616FD03D"><enum>(3)</enum><text>Each cooperating State agency shall facilitate joint cooperation between training programs, representatives of workers, employers, and communities, especially in underserved rural and urban regions, to ensure a fair and engaging workplace that balances the priorities and well-being of workers with the needs of businesses.</text></paragraph><paragraph id="H0649DA1C1D8E4BE99003D1D2871699FC"><enum>(4)</enum><text>Each cooperating State agency shall seek, including through agreements and training programs described in this subsection, to ensure the reemployment of adversely affected workers upon completion of training as described in section 236.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HAC513AF6FE904E348081F0C05B039604"><enum>(b)</enum><header>Administration</header><text>Section 239(g) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2311">19 other Federal programs</quote> and inserting <quote>support services are needed beyond what this chapter can provide, make arrangements to coordinate such services available through other Federal programs</quote>; and</text></paragraph><paragraph id="HB08E8116D5BB421BB2CDFDB1668DF0C7"><enum>(8)</enum><text>by adding at the end the following:</text><quoted-block id="HF8BF50FCA3024188BC65BA3084F09198"><enum>(c)</enum><header>Staffing</header><text>Section 239 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2311">19 U.S.C. 2311</external-xref>) is amended by striking subsection (k) and inserting the following:</text><quoted-block id="H2C119327C2B74603BB8D2B2FB498B287" style="OLC"><subsection id="H390493D2B56141C385D8D3FEC3FD05A4"><enum>(k)</enum><header>Staffing</header><text>An agreement entered into under this section shall provide that the cooperating State or cooperating State agency shall require that any individual engaged in functions (other than functions that are not inherently governmental) to carry out the trade adjustment assistance program under this chapter shall be a State employee covered by a merit system of personnel administration.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HF99128B978E04396B05B8BFD96AB7096"><enum>112.</enum><header>Reemployment trade adjustment assistance program</header><text display-inline="no-display-inline">Section 246(a) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2318">19 U.S.C. 2318(a)</external-xref>) is amended—</text><paragraph id="H5138587143D1464BB5E6616BA7CDF215"><enum>(1)</enum><text>in paragraph (3)(B)(ii), by striking <quote>$50,000</quote> and inserting <quote>$70,000 (subject to adjustment under paragraph (8))</quote>;</text></paragraph><paragraph id="HC14F7E6432444654968C7EE4BFB33A1C"><enum>(2)</enum><text>in paragraph (5)(B)(i), by striking <quote>$10,000</quote> and inserting <quote>$20,000 (subject to adjustment under paragraph inflation</header><subparagraph id="HBE996513F9D24E0090B0A2F3E1C4C94C"><enum>(A)</enum><header>In general</header><text>The Secretary of Labor shall adjust the salary limitation under paragraph (3)(B)(ii) and the amount under paragraph (5)(B)(i) on the date that is 30 days after the date of the enactment of this paragraph, and at the beginning of each fiscal year thereafter, to reflect the percentage (if any) of the increase in the average of the Consumer Price Index for the preceding 12-month period compared to the Consumer Price Index for fiscal year 2025.</text></subparagraph><subparagraph id="HECE2A2BDF43F490BA8117D5EE191A987"><enum>(B)</enum><header>Special rules for calculation of adjustment</header><text>In making an adjustment under subparagraph (A), the Secretary—</text><clause id="H3CB914FC2ED6462A8E5EDA35EDD4A192"><enum>(i)</enum><text>shall round the amount of any increase in the Consumer Price Index to the nearest dollar; and</text></clause><clause id="H647BEE2CDC094556AF62555018306E1D"><enum>(ii)</enum><text>may ignore any such increase of less than 1 percent.</text></clause></subparagraph><subparagraph id="H1BE3AA67B69745E09B2A9A157ADAC68C"><enum>(b)</enum><header>Group eligibility requirements</header><text>Section 222 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2272">19 U.S.C. 2272</external-xref>), as amended by subsections (b) and (c) of section 102, is further amended—</text><paragraph id="HF4C67AC479C741A1BC7E6034BDC92AAC"><enum>(1)</enum><text>by redesignating subsections (c), (d), (e), and (f) as subsections (d), (e), (f), and (g), respectively;</text></paragraph><paragraph id="H2FB9E67F4457444F818C9D21A87A339B"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text><quoted-block id="H46FBF936870F41C982DCE34694E816DB" style="OLC"><subsection id="H761AB1E2A40F4455A45877849ABC3135"><enum>(c)</enum><header>Adversely affected workers in public agencies</header><text>A group of workers in a public agency shall be certified by the Secretary as eligible to apply for adjustment assistance under this chapter pursuant to a petition filed under section 221 if the Secretary determines that—</text><paragraph id="H3CCD4E06ADA94783A50998EF49EDF011"><enum>(1)</enum><text>a significant number or proportion of the workers in the public agency have become totally or partially separated, or are threatened to become totally or partially separated;</text></paragraph><paragraph id="H4197736409B64BC8B230C951F3FF3302"><enum>(2)</enum><text>the public agency has acquired from a foreign country services like or directly competitive with services which are supplied by such agency; and</text></paragraph><paragraph id="H6AC25F894C0A4E8880D18D370348AFC5"><enum>(3)</enum><text>the acquisition of services described in paragraph (2) contributed to such workers’ separation or threat of separation.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H1A4841DB95974EDF8D13D06268CF48D7"><enum>(3)</enum><text>in subsection (d) (as redesignated), by adding at the end the following:</text><quoted-block id="H45F14EA1632E441DA96EF4D651B53669" style="OLC"><paragraph 247 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2319">19 U.S.C. 2319</external-xref>), as amended by section 113(a), is further amended by adding at the end the following:</text><quoted-block id="H080FC50DC83C46D5A37D823EAC51CCB7" style="OLC"><paragraph id="HA0B1C3D1B815420E9D2C736DDD3E31FA"><enum>(21)</enum><text>The term <term>underserved community</term> means a community with populations sharing a particular characteristic that have been systematically denied a full opportunity to participate in aspects of economic, social, or civic life, such as Black, Latino, and Indigenous and Native American persons, Asian Americans and Pacific Islanders, other persons of color, members of other minority communities, persons with disabilities, persons who live in rural areas, and other populations otherwise adversely affected by persistent poverty or inequality.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H94D4E5B440394868B1B5BD3E509A16CB"><enum>115.</enum><header>Requirements for certain territories</header><text display-inline="no-display-inline">Section 248 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2320">19 U.S.C. 2320</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HE913C96461804D6183492C889A22B14C" style="OLC"><subsection id="HAE9FA46880794089BFB9CCB974BBC3DD"><enum>(c)</enum><header>Requirements for certain territories</header><text>The Secretary shall establish such requirements as may be necessary and appropriate to modify the requirements of this chapter, including requirements relating to eligibility for trade readjustment allowances and limitations on administrative expenditures, to address the particular circumstances of Guam, the Virgin Islands of the United States, American Samoa, and the Commonwealth of the Northern Mariana Islands in implementing and carrying out this chapter.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H6B9109E633834FF8BED71A05A0C59883"><enum>116.</enum><header>Subpoena power</header><text display-inline="no-display-inline">Section 249 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2321">19 U.S.C. 2321</external-xref>) is amended—</text><paragraph id="H41F4AD37CC574333A482EBFBC0D2369E"><enum>(1)</enum><text>in subsection (a), by adding at the end the following: <quote>The authority under the preceding sentence includes the authority of States to require, by subpoena, a firm to provide information on workers employed by, or totally or partially separated from, the firm that is necessary to make a determination under this chapter or to provide outreach to workers, including the names and address of workers.</quote>; and</text></paragraph><paragraph id="H740EDFE19FA64A67AD32D397DC6EB386"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="HAE69FED5F9FC4E45BB76D191BA39472A" style="OLC"><subsection id="H587C9687DEDA4037AAF8D1BCC32EEEC0"><enum>(c)</enum><header>Enforcement of subpoenas by states</header><text>A State may enforce compliance with a subpoena issued under subsection (a)—</text><paragraph id="HBF7E70C564E24FACA946CA97482E4F33"><enum>(1)</enum><text>as provided for under State law; and</text></paragraph><paragraph id="HDC713EEA30434D88A7AFE5BDD1118783"><enum>(2)</enum><text>by petitioning an appropriate United States district court for an order requiring compliance with the subpoena.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title><title id="H0E2C27117C654B13B54276C403CA1953"><enum>II</enum><header>Trade adjustment assistance for firms</header><section id="H45C53DD7BCD84111AE6BC7CA97214F1B"><enum>201.</enum><header>Petitions and determinations</header><text display-inline="no-display-inline">Section 251 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2341">19 U.S.C. 2341</external-xref>) is amended—</text><paragraph id="H9B22D1B64C054CF98FAB96F4F8C399D0"><enum>(1)</enum><text>in the second sentence of subsection (a), by striking <quote>Upon</quote> and inserting <quote>Not later than 15 days after</quote>;</text></paragraph><paragraph id="H32E11C5AF98540C09B1FF9994DD615F9"><enum>(2)</enum><text>by amending subsection (c) to read as follows:</text><quoted-block totally or partially separated, or</text></clause><clause id="HC06DEB68C88B4CF7BAD3B2E32DE187D0"><enum>(ii)</enum><text>that—</text><subclause id="H748B97B6C27F4D24AD1E2D7749FB8936"><enum>(I)</enum><text>sales or production, or both, of the firm have decreased absolutely or failed to increase,</text></subclause><subclause id="H53C80B5570BB46619132E9FD7C47E4D5"><enum>(II)</enum><text>sales or production, or both, of an article or service that accounted for not less than 25 percent of the total sales or production of the firm during the 12-month period preceding the most recent 12-month period for which data are available have decreased absolutely or failed to increase,</text></subclause><subclause id="H36E8F600F3E74DEEA3B038D14C5BD4BB"><enum>(III)</enum><text>sales or production, or both, of the firm during the most recent 12-month period for which data are available have decreased or failed to increase compared to—</text><item id="HF663ECA15E3147E19F8C7C1A0508A2C2"><enum>(aa)</enum><text>the average annual sales or production for the firm during the 24-month period preceding that 12-month period, or</text></item><item id="H63FAE29BB1974AE99789EF4E441A19D4"><enum>(bb)</enum><text>the average annual sales or production for the firm during the 36-month period preceding that 12-month period, and</text></item></subclause><subclause id="HA38BCA152A7D4808B9D00D9BC4343B67"><enum>(IV)</enum><text>sales or production, or both, of an article or service that accounted for not less than 25 percent of the total sales or production of the firm during the most recent 12-month period for which data are available have decreased or failed to increase compared to—</text><item id="HB518615507644BD0B72A14AA69E22030"><enum>(aa)</enum><text>the average annual sales or production for the article or service during the 24-month period preceding that 12-month period, or</text></item><item id="H04AFE787AB104F3F901CF726C3CD4D3E"><enum>(bb)</enum><text>the average annual sales or production for the article or service during the 36-month period preceding that 12-month period, and</text></item></subclause></clause></subparagraph><subparagraph id="H796ED5EBCEBD4187B67A06D39D88896C"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H650BC524C04140EF9AEC2B7A5630FA0A"><enum>(i)</enum><text>increases of imports of articles or services like or directly competitive with articles which are produced or services which are supplied by such firm contributed to such total or partial separation, or threat thereof, or to such decline or failure to increase in sales or production, or</text></clause><clause id="H2E069777A5AE442EA71B6A7D84C5A753"><enum>(ii)</enum><text>decreases in exports of articles produced or services supplied by such firm, or imports of articles or services necessary for the production of articles or services supplied by such firm, contributed to such total or partial separation, or threat thereof, or to such decline in sales or production.</text></clause></subparagraph></paragraph><paragraph id="HE85729A6752E427484D681F7D175FADC"><enum>(2)</enum><text>For purposes of paragraph (1)(B):</text><subparagraph id="H00690201DC054C71B9EF12767D522A1A"><enum>(A)</enum><text>Any firm which engages in exploration or drilling for oil or natural gas shall be considered to be a firm producing oil or natural gas.</text></subparagraph><subparagraph id="H389CD3FA96E54525B2B050E6A707446F"><enum>(B)</enum><text>Any firm that engages in exploration or drilling for oil or natural gas, or otherwise produces oil or natural gas, shall be considered to be producing articles directly competitive with imports of oil and with imports of natural gas.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H49C192F125FE4E56A756F00F40B7A7A6"><enum>(3)</enum><text>in subsection (d)—</text><subparagraph id="HB74614F956044EB889AAC75189B5363B"><enum>(A)</enum><text>by striking <quote>this section,</quote> and inserting <quote>this section.</quote>; and</text></subparagraph><subparagraph id="H5B25D3807B844390AC96E1FA0FE3EFC4"><enum>(B)</enum><text>by striking <quote>but in any event</quote> and all that follows and inserting the following: <quote>If the Secretary does not make a determination with respect to a petition within 55 days after the date on which an investigation is initiated under subsection (a) with respect to the petition, the Secretary shall be deemed to have certified the firm as eligible to apply for adjustment assistance under this chapter.</quote>.</text></subparagraph></paragraph></section><section id="HAD15A4E184424D46AA3E36F3FDFD98BB"><enum>202.</enum><header>Approval of adjustment proposals</header><text display-inline="no-display-inline">Section 252 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2342">19 U.S.C. 2342</external-xref>) is amended—</text><paragraph id="HDE8B3232FFEB449B91D4D6C2C3DE5C98"><enum>(1)</enum><text>in the second sentence of subsection (a), by adding at the end before the period the following: <quote>and an assessment of the potential employment outcomes of such proposal</quote>;</text></paragraph><paragraph id="H6E3F1F55E21647D9BAA907ACE1AB44C9"><enum>(2)</enum><text>in subsection (b)(1)(B), by striking <quote>gives adequate consideration to</quote> and inserting <quote>is in</quote>;</text></paragraph><paragraph id="H5EC54A8C38FE421083F75E8249C115AF"><enum>(3)</enum><text>by redesignating subsection (c) as subsection (d); and</text></paragraph><paragraph id="H6EF4108427494CF896145C150F173D93"><enum>(4)</enum><text>by inserting after subsection (b) the following:</text><quoted-block id="H823E5548B8F84276A2471601D9DEFF1B" style="OLC"><subsection id="HDC77B4576EE34CC1A74FE27DC56CFF75"><enum>(c)</enum><header>Amount of assistance</header><paragraph id="H1EBEFDCB639E4607A615C625A5479CF9"><enum>(1)</enum><header>In general</header><text>A firm may receive adjustment assistance under this chapter with respect to the firm’s economic adjustment proposal in an amount not to exceed $300,000, subject to adjustment under paragraph (2) and the matching requirement under paragraph (3).</text></paragraph><paragraph id="H265EE2F6F8984CF98149094364004276"><enum>(2)</enum><header>Adjustment of assistance limitation for inflation</header><subparagraph id="H6380EEFE9C8F4E59A72F76B1D9B88526"><enum>(A)</enum><header>In general</header><text>The Secretary of Commerce shall adjust the technical assistance limitation under paragraph (1) on the date that is 30 days after the date of the enactment of this paragraph, and at the beginning of each fiscal year thereafter, to reflect the percentage (if any) of the increase in the average of the Consumer Price Index for the preceding 12-month period compared to the Consumer Price Index for fiscal year 2025.</text></subparagraph><subparagraph id="HF5424ED454F343638C46E4975B68BA21"><enum>(B)</enum><header>Special rules for calculation of adjustment</header><text>In making an adjustment under subparagraph (A), the Secretary—</text><clause id="H4486D7B35037427E9D58E222C865CA57"><enum>(i)</enum><text>shall round the amount of any increase in the Consumer Price Index to the nearest dollar; and</text></clause><clause id="H3F4B0E71AA9E4112AA5D267FBCAE2C10"><enum>(ii)</enum><text>may ignore any such increase of less than 1 percent.</text></clause></subparagraph><subparagraph id="H55E8466205944464A199F74D9B93CCA7"><enum>(C)</enum><header>Consumer Price Index defined</header><text>For purposes of this paragraph, the term <term>Consumer Price Index</term> means the Consumer Price Index for All Urban Consumers published by the Bureau of Labor Statistics of the Department of Labor.</text></subparagraph></paragraph><paragraph id="H43607251726A4967B46006C96EA20222"><enum>(3)</enum><header>Matching requirement</header><text>A firm may receive adjustment assistance under this chapter only if the firm provides matching funds in an amount equal to the amount of adjustment assistance received under paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H4619539E60C74F6898F86F3EFF2EF83F"><enum>203.</enum><header>Technical assistance</header><text display-inline="no-display-inline">Section 253(a)(3) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2343">19 U.S.C. 2343(a)(3)</external-xref>) is amended by adding at the end before the period the following: <quote>, including assistance to provide skills training programs to employees of the firm</quote>.</text></section><section id="HDCB9E0EC69034B11AA7C30668448BBC1"><enum>204.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 259 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2351">19 U.S.C. 2351</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H6677103EAC084CE9BB5E1D71B3450CC2" style="OLC"><paragraph id="H46D513B613EB411EA312BBD42DE279F9"><enum>(3)</enum><header>Underserved community</header><text>The term <term>underserved community</term> has the meaning given that term in section 247.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H8F77337E05F54F10A57C6739EB0381D0"><enum>205.</enum><header>Plan for sustained outreach to potentially eligible firms</header><subsection id="HF7638F0CD3A7465B85F889B9C4CE8759"><enum>(a)</enum><header>In general</header><text>Chapter 3 of title II of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2341">19 U.S.C. 2341 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HCCC27E26F6AA46E9B9698AC991F8E9FD" style="OLC"><section id="HE87F0375D84C427EAC367EB4BF41C332"><enum>263.</enum><header>Plan for sustained outreach to potentially eligible firms</header><subsection id="H10203D543A7A421A8123CA9A5C481710"><enum>(a)</enum><header>In general</header><text>The Secretary shall develop a plan to provide sustained outreach to firms that may be eligible for adjustment assistance under this chapter.</text></subsection><subsection id="H2F9C8EE1C7C74E6C8A2736E0CA30B13E"><enum>(b)</enum><header>Matters To be included</header><text>The plan required by paragraph (1) shall include the following:</text><paragraph id="H776E24D562444D08B760E92534BE10D9"><enum>(1)</enum><text>Outreach to the United States International Trade Commission and to such firms in industries with increased imports identified in the Commission’s annual report regarding the operation of the trade agreements program under section 163(c).</text></paragraph><paragraph id="H9497EA3027644ED6BAA2BD6373208735"><enum>(2)</enum><text>Outreach to such firms in the service sector.</text></paragraph><paragraph id="H6919D271E94845A09DA522E8D0C0C2CE"><enum>(3)</enum><text>Outreach to such firms that are small businesses.</text></paragraph><paragraph id="H039F607EF94E4442964CC26E11CE42EC"><enum>(4)</enum><text>Outreach to such firms that are minority-or women-owned firms.</text></paragraph><paragraph id="H1617AD864A4A427487989A60CECE7FC5"><enum>(5)</enum><text>Outreach to such firms that employ a majority or a substantial percentage of workers from underserved communities.</text></paragraph></subsection><subsection id="H9AA04627C0544BA7B9AF3C9FDDFD4B60"><enum>(c)</enum><header>Updates</header><text>The Secretary shall update the plan required under this section on an annual basis.</text></subsection><subsection id="H16CF8A46D1E14500A97E90C21B8E8D9F"><enum>(d)</enum><header>Submission to Congress</header><text>The Secretary shall submit the plan and each update to the plan required under this section to Congress.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H042FE3E8F2144C9280F74670A45B02DB"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for the Trade Act of 1974 is amended by inserting after the item relating to section 262 the following new item:</text><quoted-block id="H6A864C49A60449788F8274217742C83E" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 263. Plan for sustained outreach to potentially eligible firms.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></title><title id="HE19D1982FD624C169BE312FA110724AB"><enum>III</enum><header>Trade Adjustment Assistance for Communities and Community Colleges</header><section id="H2220D3FCDB8B4E2ABA658E7951F6EC54"><enum>301.</enum><header>Trade adjustment assistance for communities</header><subsection id="H032337406BAB47BA9EEE21E4721FBB7D"><enum>(a)</enum><header>In general</header><text>Chapter 4 of title II of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2371">19 U.S.C. 2371 et seq.</external-xref>) is amended—</text><paragraph id="H00882C85ED0B4640856EF35300E7B0A2"><enum>(1)</enum><text>by inserting after the chapter heading the following: <quote>subchapter B—Trade Adjustment Assistance for Community Colleges and Career Training</quote>;</text></paragraph><paragraph id="H217F61E2159B4EA894E2C5F9ED233BB5"><enum>(2)</enum><text>by redesignating sections 271 and 272 as sections 279 and 279A, respectively; and</text></paragraph><paragraph id="H61667B216E0C4F38986037913DCC9ECA"><enum>(3)</enum><text>by inserting before subchapter B (as designated by paragraph (1)) the following:</text><quoted-block id="H3A0E87BC99894AA99D67EEB517BB388F" style="OLC" display-inline="yes-display-inline"><text>subchapter A—Trade Adjustment Assistance for Communities</text><section id="HAFBF01C67B6A4EB3A30DE083B3DE2D16"><enum>271.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter:</text><paragraph id="H10020371954C41A283DF836AC685E7C3"><enum>(1)</enum><header>Agricultural commodity producer</header><text>The term <term>agricultural commodity producer</term> has the meaning given that term in section 291.</text></paragraph><paragraph id="HB132ED855572472C8AFA628533F8AFFC"><enum>(2)</enum><header>Community</header><text>The term <term>community</term> means—</text><subparagraph id="HB92C83EE8A4141E0BCFAD7DD4D6E85BA"><enum>(A)</enum><text>a city or other political subdivision of a State, including a special purpose unit of a State or local government engaged in economic or infrastructure development activities, or a consortium of political subdivisions;</text></subparagraph><subparagraph id="HEC8DDD3C750941B6850F9F637CBEF45C"><enum>(B)</enum><text>an Economic Development District designated by the Economic Development Administration of the Department of Commerce; or</text></subparagraph><subparagraph id="H5A3896F811414255A37AA2F384D72E75"><enum>(C)</enum><text>an Indian Tribe.</text></subparagraph></paragraph><paragraph id="H55C81A05876E478F99F3F473D894FBA4"><enum>(3)</enum><header>Eligible community</header><text>The term <term>eligible community</term> means a community that is impacted by trade under section 273(a)(2) and is determined to be eligible for assistance under this subchapter.</text></paragraph><paragraph id="H24CD56C85DB445929F18878399352B45"><enum>(4)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="H9A554FE47D25445B97C2205F080D97B4"><enum>(A)</enum><text>an eligible community;</text></subparagraph><subparagraph id="H5623B20484AD45C1B60DD9111BD013F8"><enum>(B)</enum><text>an institution of higher education or a consortium of institutions of higher education; or</text></subparagraph><subparagraph id="H802335872DE547918688A2FF9A628567"><enum>(C)</enum><text>a public or private nonprofit organization or association acting in cooperation with officials of a political subdivision of a State.</text></subparagraph></paragraph><paragraph id="HCEA619DC79074E478B31FAD3CEB033DD"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce.</text></paragraph><paragraph id="H73D1AD09488B46F8A3F3BDFB85FB0E15"><enum>(5)</enum><header>Underserved community</header><text>The term <term>underserved community</term> has the meaning given that term in section 247.</text></paragraph></section><section id="H9D7F23E6DFF74763B19CBB04FEF84F51"><enum>272.</enum><header>Establishment of trade adjustment assistance for communities program</header><text display-inline="no-display-inline">The Secretary, acting through the Assistant Secretary for Economic Development, shall, not later than 180 days after the date of enactment of this subchapter, establish a program to provide communities impacted by trade with assistance in accordance with the requirements of this subchapter.</text></section><section id="HC5C292DAFDB948F29D3C567E4042C998"><enum>273.</enum><header>Eligibility; notification of eligibility</header><subsection id="H49F4BDD8558344E499E5C55E6CF70E29"><enum>(a)</enum><header>Eligibility</header><paragraph id="H8F5CEB77B26E4974A5313F3136379004"><enum>(1)</enum><header>In general</header><text>A community shall be eligible for assistance under this subchapter if the community is a community impacted by trade under paragraph (2).</text></paragraph><paragraph id="H29CD6AF0F0574CE0ACB1E19416962C3C"><enum>(2)</enum><header>Community impacted by trade</header><text>A community is impacted by trade if it meets each of the following requirements:</text><subparagraph id="H21303D05F49541348880A9D978AEA7F9"><enum>(A)</enum><text>One or more of the following certifications are made with respect to the community:</text><clause id="H761F6A61F7654F2088BA6E4FF065C2A1"><enum>(i)</enum><text>By the Secretary of Labor, that a group of workers located in the community is eligible to apply for assistance under section 223.</text></clause><clause id="H5252C9E6913D42D29AECB30741382611"><enum>(ii)</enum><text>By the Secretary of Commerce, that a firm located in the community is eligible to apply for adjustment assistance under section 251.</text></clause><clause id="HDA3D4B2B192E4DD49A6DBC570D9081E4"><enum>(iii)</enum><text>By the Secretary of Agriculture, that a group of agricultural commodity producers located in the community is eligible to apply for adjustment assistance under section 293.</text></clause></subparagraph><subparagraph id="H1D97EF6E531347FF8DD49D848350D6F2"><enum>(B)</enum><text>The community—</text><clause id="H7CB5F90AB2884067AECC99E924B13C74"><enum>(i)</enum><text>applies for assistance not later than 180 days after the date on which the most recent certification described in subparagraph (A) is made; or</text></clause><clause id="HC3D1193D1DEB46D4A36F012AB6CFFCCE"><enum>(ii)</enum><text>in the case of a community with respect to which one or more such certifications were made on or after January 1, 1994, and before the date of the enactment of this subchapter, applies for assistance not later than September 30, 2029.</text></clause></subparagraph><subparagraph id="HC14BA5BD8358442DA57D8B2F54E38D86"><enum>(C)</enum><text>The community—</text><clause id="H6ECA5043719041F7B55FB71A7F5A9C5B"><enum>(i)</enum><text>has a per capita income of 80 percent or less of the national average;</text></clause><clause id="HAE932740F93D44EB8981BDE96B250DF4"><enum>(ii)</enum><text>has an unemployment rate that is, for the most recent 24-month period for which data are available, at least 1 percent greater than the national average unemployment rate; or</text></clause><clause id="H4880CBDF279C4A50AC109583A016CC82"><enum>(iii)</enum><text>is significantly affected by a loss of, or threat to, the jobs associated with any certification described in subparagraph (A), or the community is undergoing transition of its economic base as a result of changing trade patterns, as determined by the Secretary.</text></clause></subparagraph></paragraph></subsection><subsection id="H4B5BA51E7F9C44DE9F381B3BE492CED6"><enum>(b)</enum><header>Notification of eligibility</header><text>If one or more certifications described in subsection (a)(2)(A) are made with respect to a community, the applicable Secretary with respect to such certification shall concurrently notify the Governor of the State in which the community is located of the ability of the community to apply for assistance under this section.</text></subsection></section><section id="HDBD1DC2D861144DE8477399836222587"><enum>274.</enum><header>Grants to eligible communities</header><subsection id="H43432C0969584224950E4DA5D7DD5DD5"><enum>(a)</enum><header>In general</header><text>The Secretary may—</text><paragraph id="H97264387647C4D159E7D0BD7EFB528F5"><enum>(1)</enum><text>upon the application of an eligible community, award a grant under this section to the community to assist in developing or updating a strategic plan that meets the requirements of section 275; or</text></paragraph><paragraph id="HED2699C751BE415E902E9B1B799D2C47"><enum>(2)</enum><text>upon the application of an eligible entity, award an implementation grant under this section to the entity to assist in implementing projects included in a strategic plan that meets the requirements of section 275.</text></paragraph></subsection><subsection id="H92AE048382DC43B083CC5D96C23620EA"><enum>(b)</enum><header>Special provisions</header><paragraph id="H7ECDBF9740604D71B9F649251BB4F630"><enum>(1)</enum><header>Revolving loan fund grants</header><subparagraph id="H85C47CD7D2BB499B8776EC719240E5B1"><enum>(A)</enum><header>In general</header><text>The Secretary shall maintain the proper operation and financial integrity of revolving loan funds established by eligible entities with assistance under this section.</text></subparagraph><subparagraph id="HA8CDDB6545B246508D442672E5E2992C"><enum>(B)</enum><header>Efficient administration</header><text>The Secretary may—</text><clause id="H81C22444AC5A4D52868441B3109AE23F"><enum>(i)</enum><text>at the request of an eligible entity, amend and consolidate grant agreements governing revolving loan funds to provide flexibility with respect to lending areas and borrower criteria; and</text></clause><clause id="HBACB3CEB55214F4294005084C64223DD"><enum>(ii)</enum><text>assign or transfer assets of a revolving loan fund to a third party for the purpose of liquidation, and the third party may retain assets of the fund to defray costs related to liquidation.</text></clause></subparagraph><subparagraph id="HCFE723AAA5E24A5CB871E0E41FF42BB7"><enum>(C)</enum><header>Treatment of actions</header><text>An action taken by the Secretary under this subsection with respect to a revolving loan fund shall not constitute a new obligation if all grant funds associated with the original grant award have been disbursed to the recipient.</text></subparagraph></paragraph><paragraph id="HE47CDF7031184010A2AF428092EBF038"><enum>(2)</enum><header>Use of funds in projects constructed under project cost</header><subparagraph id="H49923BD6B5FE420290B777E9ADE515DF"><enum>(A)</enum><header>In general</header><text>In the case of a grant for a construction project under this section, if the Secretary determines, before closeout of the project, that the cost of the project, based on the designs and specifications that were the basis of the grant, has decreased because of decreases in costs, the Secretary may approve the use of the excess funds (or a portion of the excess funds) to improve the project.</text></subparagraph><subparagraph id="H87305D66E29B475D9D1E9CC377A8D726"><enum>(B)</enum><header>Other uses of excess funds</header><text>Any amount of excess funds remaining after application of subparagraph (A) may be used by the Secretary for providing assistance under this section.</text></subparagraph></paragraph></subsection><subsection id="H66253C81485A4D9C9663D809748B8D30"><enum>(c)</enum><header>Coordination</header><text>If an eligible institution (as such term is defined in section 279) located in an eligible community is seeking a grant under section 279 at the same time the community is seeking an implementation grant under subsection (a)—</text><paragraph id="HFCA7E48C62EF4385A44147C58A377A57"><enum>(1)</enum><text>the Secretary, upon receipt of such information from the Secretary of Labor as required under section 279(e), shall notify the community that the institution is seeking a grant under section 279; and</text></paragraph><paragraph id="HE73D6E87D41045CEBAA7CC1FF8A239A7"><enum>(2)</enum><text>the community shall provide to the Secretary, in coordination with the institution, a description of how the community will integrate projects included in the strategic plan with the specific project for which the institution submits the grant proposal under section 279.</text></paragraph></subsection><subsection id="H03759B2649A040769C1330D581C4BC14"><enum>(d)</enum><header>Limitation</header><text>The total amount of grants awarded with respect to an eligible community under this section for fiscal years 2027 through 2031 may not exceed $25,000,000.</text></subsection><subsection id="HACA66EC351DE4D05A2D8B54068FB27A9"><enum>(e)</enum><header>Priority</header><text>The Secretary shall, in awarding grants under this section, provide higher levels of funding with respect to eligible communities that have a history of economic distress and long-term unemployment, as determined by the Secretary.</text></subsection><subsection id="H40F2639A742C44D2B90786C1F53190C7"><enum>(f)</enum><header>Geographic diversity</header><paragraph id="HAAB2B0E8B7534B368EC54598CFD8E6DB"><enum>(1)</enum><header>In general</header><text>The Secretary shall, in awarding grants under this section, ensure that grants are awarded with respect to eligible communities from geographically diverse areas.</text></paragraph><paragraph id="HD92931992B3F4EB5A045082B2F4448D8"><enum>(2)</enum><header>Geographic region requirement</header><text>The Secretary shall, in meeting the requirement under paragraph (1), award a grant under this section for each of the fiscal years 2027 through 2031 to at least one eligible community located in each geographic region for which regional offices of the Economic Development Administration of the Department of Commerce are responsible, to the extent that the Secretary receives an application from at least one eligible community in each such geographic region.</text></paragraph></subsection></section><section id="H8FA907F3C5484C20828F1F1EEC1BF593"><enum>275.</enum><header>Strategic plans</header><subsection id="H10C9BE73760A44DE827452566EC9D4AD"><enum>(a)</enum><header>In general</header><text>A strategic plan meets the requirements of this section if—</text><paragraph id="H3FFD28AB7B8F4D5E96F07480C6E87974"><enum>(1)</enum><text>the consultation requirements of subsection (b) are met with respect to the development of the plan;</text></paragraph><paragraph id="H71609B4C9D034F3B81E2B4977133E113"><enum>(2)</enum><text>the plan meets the requirements of subsection (c); and</text></paragraph><paragraph id="H462E62EF949B45E7B361944FC6122A65"><enum>(3)</enum><text>the plan is approved in accordance with the requirements of subsection (d).</text></paragraph></subsection><subsection id="H68D982D8D5AD439C947CA176E84AD1D6"><enum>(b)</enum><header>Consultation</header><paragraph id="HC5C415A77B834ED5BFD215BD674EC0D9"><enum>(1)</enum><header>In general</header><text>To the extent practicable, an eligible community shall consult with the entities described in paragraph (2) in developing the strategic plan.</text></paragraph><paragraph id="H6178CE5CE64B43E3A23889FA7F69F006"><enum>(2)</enum><header>Entities described</header><text>The entities described in this paragraph are public and private entities located in or serving the eligible community, including—</text><subparagraph id="H7B286F3B77D64FC8A52FB70D51F44A09"><enum>(A)</enum><text>local, county, or State government agencies;</text></subparagraph><subparagraph id="H2E75795080774F1DA2D1AA4CF783B2A9"><enum>(B)</enum><text>firms, including small- and medium-sized firms;</text></subparagraph><subparagraph id="H64317CBB55E8461F9DC421FCE5E8CF29"><enum>(C)</enum><text>local workforce investment boards;</text></subparagraph><subparagraph id="HC485A82A1F144B6BBFB3C0F123CD4778"><enum>(D)</enum><text>labor organizations, including State labor federations and labor-management initiatives, representing workers in the community;</text></subparagraph><subparagraph id="H973BFCBB0F2C45D68BE8BA1C21DFE3A9"><enum>(E)</enum><text>educational institutions, local educational agencies, and other training providers; and</text></subparagraph><subparagraph id="HACAF1A494CCF4BB7A68BCF5B6ADFAE72"><enum>(F)</enum><text>local civil rights organizations and community-based organizations, including organizations representing underserved communities.</text></subparagraph></paragraph></subsection><subsection id="H9FC312F55DC048F6A10E6966EB6E8714"><enum>(c)</enum><header>Contents</header><text>The strategic plan may contain, as applicable to the community, the following:</text><paragraph id="HD1A274CB3B9841AD848BEE95003072BB"><enum>(1)</enum><text>A description and analysis of the capacity of the eligible community to achieve economic adjustment to the impact of trade.</text></paragraph><paragraph id="H3775D45A7DF94837AA7EC8726026F098"><enum>(2)</enum><text>An analysis of the economic development challenges and opportunities facing the community, including the strengths and weaknesses of the economy of the community.</text></paragraph><paragraph id="HB357BEF65FC74301BC37B535EE3AE37D"><enum>(3)</enum><text>An assessment of—</text><subparagraph id="H1D3A541DF0ED4EDB90952B75FEC1550F"><enum>(A)</enum><text>the commitment of the community to carry out the strategic plan on a long-term basis;</text></subparagraph><subparagraph id="H471CE1A93AB14BDC9FC0B58A0C4BC597"><enum>(B)</enum><text>the participation and input of members of the community who are dislocated from employment due to the impact of trade; and</text></subparagraph><subparagraph id="HC0C16172333445909615238406856526"><enum>(C)</enum><text>the extent to which underserved communities have been impacted by trade.</text></subparagraph></paragraph><paragraph id="H04262644BA6D4C5699981B3B6897EC95"><enum>(4)</enum><text>A description of how underserved communities will benefit from the strategic plan.</text></paragraph><paragraph id="HEB24B5DB37B648B082AF0D84F46C0F8D"><enum>(5)</enum><text>A description of the role of the entities described in subsection (b)(2) in developing the strategic plan.</text></paragraph><paragraph id="H18F4C5B171944B0BB787EF24C7874653"><enum>(6)</enum><text>A description of projects under the strategic plan to facilitate the community’s economic adjustment to the impact of trade, including projects to—</text><subparagraph id="HB747A38AB6494909A26C7CB053BEB2D1"><enum>(A)</enum><text>develop public facilities, public services, jobs, and businesses (including establishing a revolving loan fund);</text></subparagraph><subparagraph id="H47C9DD81F40E4653B73A665133F9CF4C"><enum>(B)</enum><text>provide for planning and technical assistance;</text></subparagraph><subparagraph id="HE24E41A528BC40969B9EB0B1E6025C97"><enum>(C)</enum><text>provide for training;</text></subparagraph><subparagraph id="H0B3D5203BE2A4DCD8D7B7992325DB6F8"><enum>(D)</enum><text>provide for the demolition of vacant or abandoned commercial, industrial, or residential property;</text></subparagraph><subparagraph id="H3B2817058EF44040A876FBB57F1C60E6"><enum>(E)</enum><text>redevelop brownfields;</text></subparagraph><subparagraph id="HA602699556F24DC598F999F344944E50"><enum>(F)</enum><text>establish or support land banks;</text></subparagraph><subparagraph id="HD136042CB0C84A3CAF7E55ED6C6855A6"><enum>(G)</enum><text>support energy conservation; and</text></subparagraph><subparagraph id="H0BF2E71197E240DCA1EB689CA2C22958"><enum>(H)</enum><text>support historic preservation.</text></subparagraph></paragraph><paragraph id="H78395A2D5FA644578F18BC2CDFCBAD4C"><enum>(7)</enum><text>A strategy for continuing the community’s economic adjustment to the impact of trade after the completion of such projects.</text></paragraph><paragraph id="H10EB8C533C4E4BD496651320E82835D2"><enum>(8)</enum><text>A description of the educational and training programs and the potential employment opportunities available to workers in the community, including for workers under the age of 25, and the future employment needs of the community.</text></paragraph><paragraph id="HDC88FBCC7C1F471B917B4ED328F2F95F"><enum>(9)</enum><text>An assessment of—</text><subparagraph id="H99F61280FC3D489882EB8815BB8D8D48"><enum>(A)</enum><text>the cost of implementing the strategic plan; and</text></subparagraph><subparagraph id="HAC686FE8C6AF418596D39697BCDF1C80"><enum>(B)</enum><text>the timing of funding required by the community to implement the strategic plan.</text></subparagraph></paragraph><paragraph id="H6A132EF33EC546A58A45722DF65597A3"><enum>(10)</enum><text>A description of the methods of financing to be used to implement the strategic plan, including—</text><subparagraph id="H165EA2127E8E4A43B95474BAB9184303"><enum>(A)</enum><text>an implementation grant received under section 274 or under other authorities;</text></subparagraph><subparagraph id="H6F92CC3268A3486EB8B81B006C04B911"><enum>(B)</enum><text>a loan, including the establishment of a revolving loan fund; or</text></subparagraph><subparagraph id="HD46439953D214109A6667B3706C77149"><enum>(C)</enum><text>other types of financing.</text></subparagraph></paragraph><paragraph id="HCCFE51F63D604CDE872DA2BD9EDFD12D"><enum>(11)</enum><text>An assessment of how the community will address unemployment among agricultural commodity producers, if applicable.</text></paragraph></subsection><subsection id="HF9072C1945D14C30B8670BA007DA1122"><enum>(d)</enum><header>Approval; CEDS equivalent</header><paragraph id="H9C03F869CE2440278446F5905DE08188"><enum>(1)</enum><header>Approval</header><text>The Secretary shall approve the strategic plan developed by an eligible community under this section if the Secretary determines that the strategic plan meets the requirements of this section.</text></paragraph><paragraph id="H6F1864BB15D14BBAB5ACEE5A475011F9"><enum>(2)</enum><header>CEDS or equivalent</header><text>The Secretary may deem an eligible community’s Comprehensive Economic Development Strategy that substantially meets the requirements of this section to be an approved strategic plan for purposes of this subchapter.</text></paragraph></subsection><subsection id="H04E87E15275F4A26A5FAD1C272629E34"><enum>(e)</enum><header>Allocation</header><text>Of the funds appropriated to carry out this chapter for each of the fiscal years 2027 through 2031, the Secretary may make available not more than $50,000,000 to award grants under section 274(a)(1).</text></subsection></section><section id="H326D0754A7A54D93A1319DC038266F94"><enum>276.</enum><header>Coordination of Federal response and other additional technical assistance</header><subsection id="H2EDAF9398FFF4A1AB2BA8CB1F5999BFB"><enum>(a)</enum><header>In general</header><text>The Secretary shall coordinate the Federal response with respect to an eligible community that is awarded an implementation grant under section 274(a)(2) to implement the community’s strategic plan that meets the requirements of section 275 by—</text><paragraph id="H1EB2564E89E14EC19CAA051538A52FD6"><enum>(1)</enum><text>identifying and consulting, as appropriate, with any other Federal, State, regional, or local government agency;</text></paragraph><paragraph id="H5C708D39F4D94F939AF90ED309EA36C7"><enum>(2)</enum><text>assisting the community to access assistance from other available Federal sources as necessary to fulfill the community’s strategic plan developed under section 275; and</text></paragraph><paragraph id="HE8DEF5D5AC084B358FFFDEF21F01BF12"><enum>(3)</enum><text>ensuring that such assistance is provided in a targeted, integrated manner.</text></paragraph></subsection><subsection id="HD349020A640645038957CE98C1BDF273"><enum>(b)</enum><header>Transfer of funds</header><paragraph id="H4176D30FF05C40D9B6B834B217B9C4D7"><enum>(1)</enum><header>Transfer of funds to other Federal agencies</header><text>Subject to paragraph (3), funds appropriated to carry out this chapter may be transferred between Federal agencies, if the funds are used for the purposes for which the funds are specifically appropriated.</text></paragraph><paragraph id="H383A95624FA24973A5A3DB687B6418A3"><enum>(2)</enum><header>Transfer of funds from other Federal agencies</header><subparagraph id="HB8C4DC77C04F4974AF2C26BD03E04E91"><enum>(A)</enum><header>In general</header><text>Subject to paragraph (3) and subparagraph (B), for the purposes of this chapter, the Secretary may accept transfers of funds from other Federal agencies if the funds are used for the purposes for which (and in accordance with the terms under which) the funds are specifically appropriated.</text></subparagraph><subparagraph id="HB32A05E5BDBD474AAD1010A5F5958822"><enum>(B)</enum><header>Use of funds</header><text>The transferred funds—</text><clause id="HFD44531F83354619860BEFB84DDC354A"><enum>(i)</enum><text>shall remain available until expended; and</text></clause><clause id="HFFD1A3DC411B4A208A26470DE596F0B1"><enum>(ii)</enum><text>may, to the extent necessary to carry out this chapter, be transferred to and merged by the Secretary with the appropriations for salaries and expenses.</text></clause></subparagraph></paragraph><paragraph id="H2963A80CCD7F45109CC55FF6C3FA3819"><enum>(3)</enum><header>Availability</header><text>The transfer authorities provided by this subsection shall not apply with respect to amounts made available by an appropriations Act.</text></paragraph></subsection><subsection id="H445EFAA17DF844029E56DBCE9285DDF3"><enum>(c)</enum><header>Additional technical assistance</header><text>In addition to the coordination and assistance described in subsection (a), the Secretary shall provide technical assistance for communities—</text><paragraph id="H05D4CD3BF72343FB8AFD59487CA70B1C"><enum>(1)</enum><text>to identify significant impediments to economic development that result from the impact of trade on the community, including in the course of developing a strategic plan under section 275; and</text></paragraph><paragraph id="H67822FEAF67E435982344CDE1D3B3EDB"><enum>(2)</enum><text>to access assistance under other available sources, including State, local, territorial, or private sources, to implement projects that diversify and strengthen the economy in the community.</text></paragraph></subsection></section><section id="H1B0B390EEAAF4275A21D44B1E6A76B27"><enum>277.</enum><header>General provisions</header><subsection id="HA4E493A912864C54A709685E82A1DF17"><enum>(a)</enum><header>Regulations</header><paragraph id="HE4D92897718746FCB6F6870F85303001"><enum>(1)</enum><header>In general</header><text>The Secretary shall, subject to paragraph (3), promulgate such regulations as may be necessary to carry out this subchapter, including with respect to—</text><subparagraph id="HB0E6A9DF6F3E4BB5A07637237B7B9F56"><enum>(A)</enum><text>administering the awarding of grants under section 274, including establishing guidelines for the submission and evaluation of grant applications under such section; and</text></subparagraph><subparagraph id="H8D2B6F1EF7EB4586B22868C4D53EB2F3"><enum>(B)</enum><text>establishing guidelines for the evaluation of strategic plans developed to meet the requirements of section 275.</text></subparagraph></paragraph><paragraph id="HD56095E8DD454D3684853946E3B804A5"><enum>(2)</enum><header>Consultations</header><text>The Secretary shall consult with the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate not later than 90 days prior to promulgating any final rule or regulation under this subsection.</text></paragraph><paragraph id="H098958578A514A2FBD1094B96DC7995B"><enum>(3)</enum><header>Relationship to existing regulations</header><text>The Secretary, to the maximum extent practicable, shall—</text><subparagraph id="H8A14EDA3963C4F279A247890F7F83150"><enum>(A)</enum><text>rely on and apply regulations promulgated to carry out other economic development programs of the Department of Commerce in carrying out this subchapter; and</text></subparagraph><subparagraph id="H00546C9BE33C4AB5BBBC96CBE1B073FB"><enum>(B)</enum><text>provide guidance regarding the manner and extent to which such other economic development programs relate to this subchapter.</text></subparagraph></paragraph></subsection><subsection id="H3937B54A7D9B497C9139244E28AAF3DD"><enum>(b)</enum><header>Resources</header><text>The Secretary shall allocate such resources as may be necessary to provide sufficiently individualized assistance to each eligible community that receives a grant under section 274(a) or seeks technical assistance under section 276(c) to develop and implement a strategic plan that meets the requirements of section 275.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB3E8304D1DA04CDEA88E0D74E2CF7220"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for the Trade Act of 1974 is amended by striking the items relating to chapter 4 of title II and inserting the following:</text><quoted-block id="H03C65F23F3574EE8A790F15215DE0A62" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="chapter">CHAPTER 4—TRADE ADJUSTMENT ASSISTANCE FOR COMMUNITIES</toc-entry><toc-entry level="chapter">SUBCHAPTER A—TRADE ADJUSTMENT ASSISTANCE FOR COMMUNITIES</toc-entry><toc-entry level="section">Sec. 271. and</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="H886C9DBA6C784A6EB6A2ABF3203B3880"><enum>(4)</enum><text>In subsection (d), by striking <quote>eligible institution</quote> each place it appears and inserting <quote>eligible entity</quote>.</text></paragraph><paragraph id="HA675890C7617428AAD94CC08DFB5208C"><enum>(5)</enum><text>By redesignating subsection (e) as subsection (h) and inserting after subsection (d) the following:</text><quoted-block id="HBD3E97CFFEA84391B4633EE7BFF47392" style="OLC"><subsection id="H506CC3C9B84B40A6888149D6AB2B3791"><enum>(e)</enum><header>Use of funds</header><paragraph id="H5A1821F081844EDC8DDD2E4133686F7F"><enum>(1)</enum><header>In general</header><text>An eligible entity shall use a grant awarded under this section to establish and scale career training programs, including career and technical education programs, and career pathways and supports for students participating in such programs.</text></paragraph><paragraph id="HEEECC16C73A04451AC16D76E842D5003"><enum>(2)</enum><header>Student support and emergency services</header><text>Not less than 15 percent of the amount of a grant awarded to an eligible entity under this section shall be used to carry out student support services, which may include the following:</text><subparagraph id="H88662F33B5A44AAB96312BC300F8AEF7"><enum>(A)</enum><text>Supportive services, including childcare, transportation, mental health services, or substance use disorder prevention and treatment, assistance in obtaining health insurance coverage, housing, and other benefits, as appropriate.</text></subparagraph><subparagraph id="HFC9D1989409C42F8950E5ABDF02C87A9"><enum>(B)</enum><text>Connecting students to State or Federal means-tested benefits programs.</text></subparagraph><subparagraph id="H07AAE95842854D67993430905609C899"><enum>(C)</enum><text>The provision of direct financial assistance to help students facing financial hardships that may impact enrollment in or completion of a program supported by such funds.</text></subparagraph><subparagraph id="H548E259359F6494D8E26E5206E97DB4F"><enum>(D)</enum><text>Navigation, coaching, mentorship, and case management services, including providing information and outreach to the population described in subparagraph (C) to take part in such a program.</text></subparagraph><subparagraph id="HAD73BED614394494AC89B738A6287E2A"><enum>(E)</enum><text>Providing access to necessary supplies, materials, technological devices, or required equipment, and other supports necessary to participate in such a program.</text></subparagraph></paragraph></subsection><subsection id="H593537988613487BBCD304430023F392"><enum>(f)</enum><header>Plan for outreach to underserved communities</header><paragraph id="H03128E8A59364A1093BB14398E508224"><enum>(1)</enum><header>In general</header><text>In awarding grants under this section, the Secretary shall—</text><subparagraph id="H8E09D50FB94D4FAB82262B6AD019A643"><enum>(A)</enum><text>ensure that eligible institutions effectively serve individuals from underserved communities; and</text></clause><clause id="HDB26F50324FE4443913C23574852D118" indent="up1"><enum>(ii)</enum><text>the decrease in such exports contributed to the decrease in the national average price, quantity of production, or value of production of, or cash receipts for, the agricultural commodity, as described in paragraph (1).</text></clause></subparagraph><after-quoted-block>; and</text></clause><clause id="HCE83A11BE131492ABE732D252D9CCBEF"><enum>(ii)</enum><text>by striking <quote>2021</quote> and inserting <quote>2033</quote>; and</text></clause></subparagraph><subparagraph id="H178930162E9145FE838EF3843B46B270"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block id="H2C88365CA99E4875B3CB18F50B59FD25" style="OLC"><subsection id="HA5B3C3AECEF64511A906269E426218ED"><enum>(c)</enum><header>Reservation by the secretary</header><text>Of the funds appropriated to carry out this chapter for any fiscal year, the Secretary of Agriculture may not reserve more than 5 percent for technical assistance, pilots and demonstrations, and the evaluation of activities carried out under this chapter.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section><section id="HF04E0D42BD7F465381F8B0A1D9F37A0D"><enum>502.</enum><header>Applicability of trade adjustment assistance provisions</header><subsection id="H3923B8DAAEF246BC92D9DC99DDA734AD"><enum>(a)</enum><header>Workers certified before date of enactment</header><paragraph id="H7E23FE39FFCF4D968D8354C823D4472C"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraphs (2) and (3), a worker certified as eligible for adjustment assistance under section 222 of the Trade Act of 1974 before the date of the enactment of this Act shall be eligible, on and after such date of enactment, to receive benefits only under the provisions of chapter 2 of title II of the Trade Act of 1974, as in effect on such date of enactment, or as such provisions may be amended after such date of enactment.</text></paragraph><paragraph id="HD348D16D22AE4730AB8778A668CFA32C"><enum>(2)</enum><header>Computation of maximum benefits</header><text>Benefits received by a worker described in paragraph (1) under chapter 2 of title II of the Trade Act of 1974 before the date of the enactment of this Act shall be included in any determination of the maximum benefits for which the worker is eligible under the provisions of chapter 2 of title II of the Trade Act of 1974, as in effect on the date of the enactment of this Act, or as such provisions may be amended after such date of enactment.</text></paragraph><paragraph id="H103C7E5B4D78427BA8B0D1BD6F3987C3"><enum>(3)</enum><header>Authority to make adjustments to benefits</header><text>For the 90-day period beginning on the date of the enactment of this Act, the Secretary is authorized to make any adjustments to benefits to workers described in paragraph (1) that the Secretary determines to be necessary and appropriate in applying and administering the provisions of chapter 2 of title II of the Trade Act of 1974, as in effect on the date of the enactment of this Act, or as such provisions may be amended after such date of enactment, in a manner that ensures parity of treatment between the benefits of such workers and the benefits of workers certified after such date of enactment.</text></paragraph></subsection><subsection id="HC2073261DA48437E91786691BB51F9AF"><enum>(b)</enum><header>Workers not certified pursuant to certain petitions filed before date of enactment</header><paragraph id="H9443BCDE412040AA871B8AAF9C178ADE"><enum>(1)</enum><header>Certifications of workers not certified before date of enactment</header><subparagraph id="H41182FE095F84D5E91F885AEAC4BEF47"><enum>(A)</enum><header>Criteria if a determination has not been made</header><text>If, as of the date of the enactment of this Act, the Secretary of Labor has not made a determination with respect to whether to certify a group of workers as eligible to apply for adjustment assistance under section 222 of the Trade Act of 1974 pursuant to a petition described in subparagraph (C), the Secretary shall make that determination based on the requirements of section 222 of the Trade Act of 1974, as in effect on such date of enactment.</text></subparagraph><subparagraph id="HF94FE11B43AB403ABD78BF427D2FC257"><enum>(B)</enum><header>Reconsideration of denials of certifications</header><text>If, before the date of the enactment of this Act, the Secretary made a determination not to certify a group of workers as eligible to apply for adjustment assistance under section 222 of the Trade Act of 1974 pursuant to a petition described in subparagraph (C), the Secretary shall—</text><clause id="H2B9FC648E8A0454BBFAC9164E78663C0"><enum>(i)</enum><text>reconsider that determination; and</text></clause><clause id="HBDD57F5B3BB640FCBFB5DC6D49578C78"><enum>(ii)</enum><text>if the group of workers meets the requirements of section 222 of the Trade Act of 1974, as in effect on such date of enactment, certify the group of workers as eligible to apply for adjustment assistance.</text></clause></subparagraph><subparagraph id="HCBC2913C449A4BDC926EC93AB243A481"><enum>(C)</enum><header>Petition described</header><text>A petition described in this subparagraph is a petition for a certification of eligibility for a group of workers filed under section 221 of the Trade Act of 1974 on or after January 1, 2021, and before the date of the enactment of this Act.</text></subparagraph></paragraph><paragraph id="H09B82EFE6CDC434896BF9C185935DD4C"><enum>(2)</enum><header>Eligibility for benefits</header><subparagraph id="H9B7C362156C649019117F3C3A3E4D95D"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), a worker certified as eligible to apply for adjustment assistance under section 222 of the Trade Act of 1974 pursuant to a petition described in paragraph (1)(C) shall be eligible, on and after the date of the enactment of this Act, to receive benefits only under the provisions of chapter 2 of title II of the Trade Act of 1974, as in effect on such date of enactment, or as such provisions may be amended after such date of enactment.</text></subparagraph><subparagraph id="HB2A06957CF274CFAADCD468A777C1BD8"><enum>(B)</enum><header>Computation of maximum benefits</header><text>Benefits received by a worker described in paragraph (1) under chapter 2 of title II of the Trade Act of 1974 before the date of the enactment of this Act shall be included in any determination of the maximum benefits for which the worker is eligible under the provisions of chapter 2 of title II of the Trade Act of 1974, as in effect on the date of the enactment of this Act, or as such provisions may be amended after such date of enactment.</text></subparagraph></paragraph></subsection><subsection id="H745C2F6BCBD7436FBCEF973183F545E6"><enum>(c)</enum><header>Conforming amendments</header><paragraph id="HA1CF7EDA708444538C9816FAFBCBA652"><enum>(1)</enum><header>Trade Act of 2002</header><text>Section 151 of the Trade Act of 2002 (19 U.S.C. note prec. 2271) is amended by striking subsections (a), (b), and (c).</text></paragraph><paragraph id="HA663699CF70D4AEB843513B9639B5CDB"><enum>(2)</enum><header>Trade and Globalization Adjustment Assistance Act of 2009</header><text>Section 1891 of the Trade and Globalization Adjustment Assistance Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/19/2271">19 U.S.C. 2271</external-xref> note) is repealed.</text></paragraph><paragraph id="H73D4A0E7D92B4CD59D6A8FA1305A93F1"><enum>(3)</enum><header>Trade Adjustment Assistance Extension Act of 2011</header><text>The Trade Adjustment Assistance Extension Act of 2011 is amended—</text><subparagraph id="HB1B811CB1F31490A85508B10FB93A20E"><enum>(A)</enum><text>in section 201 (19 U.S.C. note prec. 2271), by striking subsections (b) and (c); and</text></subparagraph><subparagraph id="HD30F3E0CAE2746339EC368F429A4A5C4"><enum>(B)</enum><text>in section 231(a) (<external-xref legal-doc="usc" parsable-cite="usc/19/2271">19 U.S.C. 2271</external-xref> note), by striking paragraphs (1)(B) and (2).</text></subparagraph></paragraph><paragraph id="H10275798A3D04EF299C098A59EE0BF31"><enum>(4)</enum><header>Trade Adjustment Assistance Reauthorization Act of 2015</header><text>The Trade Adjustment Assistance Reauthorization Act of 2015 is amended—</text><subparagraph id="HCFA6DF8BEAF14E0C842C5EEF3637165E"><enum>(A)</enum><text>in section 402 (19 U.S.C. note prec. 2271), by striking subsections (b) and (c); and</text></subparagraph><subparagraph id="H3DD8D5B1E2FC4A8F9B0999203033D5A2"><enum>(B)</enum><text>in section 405(a)(1) (<external-xref legal-doc="usc" parsable-cite="usc/19/2319">19 U.S.C. 2319(a)(1)</external-xref>), by striking subparagraph (B).</text></subparagraph></paragraph></subsection><subsection id="H7C52EB9D8F5841CC9C202A56873C54F9"><enum>(d)</enum><header>Trade adjustment assistance for firms</header><paragraph id="H94423A0F1CFB465CBCE866641A7AFAEF"><enum>(1)</enum><header>Certification of firms not certified before date of enactment</header><subparagraph id="H197C277897FF4914A5520D62DEB1A4E1"><enum>(A)</enum><header>Criteria if a determination has not been made</header><text>If, as of the date of the enactment of this Act, the Secretary of Commerce has not made a determination with respect to whether to certify a firm as eligible to apply for adjustment assistance under section 251 of the Trade Act of 1974 pursuant to a petition described in subparagraph (C), the Secretary shall make that determination based on the requirements of section 251 of the Trade Act of 1974, as in effect on such date of enactment.</text></subparagraph><subparagraph id="HF66CE065F7B54D29A7A07D1DE725F993"><enum>(B)</enum><header>Reconsideration of denial of certain petitions</header><text>If, before the date of the enactment of this Act, the Secretary made a determination not to certify a firm as eligible to apply for adjustment assistance under section 251 of the Trade Act of 1974 pursuant to a petition described in subparagraph (C), the Secretary shall—</text><clause id="H5CFBF8B892B041D7AF94FF06507BF182"><enum>(i)</enum><text>reconsider that determination; and</text></clause><clause id="H6C2C846FE7ED4EBAAB7DE1984F95E373"><enum>(ii)</enum><text>if the firm meets the requirements of section 251 of the Trade Act of 1974, as in effect on such date of enactment, certify the firm as eligible to apply for adjustment assistance.</text></clause></subparagraph><subparagraph id="HC32A42C9DE1549BFB2DA1AB6D746F2C3"><enum>(C)</enum><header>Petition described</header><text>A petition described in this subparagraph is a petition for a certification of eligibility filed by a firm or its representative under section 251 of the Trade Act of 1974 on or after January 1, 2021, and before the date of the enactment of this Act.</text></subparagraph></paragraph><paragraph id="HCFB3B7D6BC05430D8EDE9E7A6F5DCA01"><enum>(2)</enum><header>Certification of firms that did not submit petitions between January 1, 2021, and date of enactment</header><subparagraph id="H6674711354384CACBDC3D85643AF9A5C"><enum>(A)</enum><header>In general</header><text>The Secretary of Commerce shall certify a firm described in subparagraph (B) as eligible to apply for adjustment assistance under section 251 of the Trade Act of 1974, as in effect on the date of the enactment of this Act, if the firm or its representative files a petition for a certification of eligibility under section 251 of the Trade Act of 1974 not later than 90 days after such date of enactment.</text></subparagraph><subparagraph id="H9823858C7F654FE7BDBF1B5B4D200EEF"><enum>(B)</enum><header>Firm described</header><text>A firm described in this subparagraph is a firm that the Secretary determines would have been certified as eligible to apply for adjustment assistance if—</text><clause id="HEF3FA4E1AC41488FBABE155643850B4E"><enum>(i)</enum><text>the firm or its representative had filed a petition for a certification of eligibility under section 251 of the Trade Act of 1974 on a date during the period beginning on January 1, 2021, and ending on the day before the date of the enactment of this Act; and</text></clause><clause id="H9D59211CD8B44CE38A6B5B336CADDC68"><enum>(ii)</enum><text>the provisions of chapter 3 of title II of the Trade Act of 1974, as in effect on such date of enactment, had been in effect on that date during the period described in clause (i).</text></clause></subparagraph></paragraph></subsection></section></title><title id="H52CA2552F23E4543822AD0EB39230D8A" commented="no"><enum>VI</enum><header>Health Coverage Tax Credit</header><section id="H2EE71F5630204A5F933AB208E00B08F2" commented="no"><enum>601.</enum><header>Permanent credit for health insurance costs</header><subsection id="H71ED4E7C0DAA4429AFD033CCE950F620" commented="no"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/35">Section 35(b)(1)(B)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>, and before January 1, 2022</quote>.</text></subsection><subsection id="HC750016B69A1469995846991B6E77585" commented="no"><enum>(b)</enum><header>Increase in credit percentage</header><text>Section 35(a) of such Code is amended by striking <quote>72.5 percent</quote> and inserting <quote>80 percent</quote>.</text></subsection><subsection id="H7A7401B6A62D4DCFAF71DF6D6998112A" commented="no"><enum>(c)</enum><header>Application of advance payment</header><paragraph id="H94D6E6CE66CC49B9A0A6BF7B5CD0196B" commented="no"><enum>(1)</enum><header>In general</header><text>Section 7527(a) of such Code is amended by striking <quote>Not later than the date that is 1 year after the date of the enactment of the Trade Adjustment Assistance Reauthorization Act of 2015</quote> and inserting <quote>As soon as practicable and not later than 90 days after the date of the enactment of the <short-title>Trade Adjustment Assistance Modernization Act</short-title></quote>.</text></paragraph><paragraph id="HD0C5E1A61F5F4AD0BF43C16A302ABA66" commented="no"><enum>(2)</enum><header>Increase in credit percentage</header><text>Subsections (b) and (e)(1) of section 7527 of such Code are each amended by striking <quote>72.5 percent</quote> and inserting <quote>80 percent</quote>.</text></paragraph><paragraph id="H27D9A2EEC105492BB047C953CB0E6677" commented="no"><enum>(3)</enum><header>Retroactive payments</header><text>Section 7527(e)(1)(A) of such Code is amended by striking <quote>the date that is 1 year after the date of the enactment of the Trade Adjustment Assistance Reauthorization Act of 2015</quote> and inserting <quote>the date of the enactment of the <short-title>Trade Adjustment Assistance Modernization Act</short-title></quote>.</text></paragraph></subsection><subsection id="HA599027744E34FD497DED6A3E67E4909" commented="no"><enum>(d)</enum><header>Effective date</header><paragraph id="H927E216A1DF341C29ECCD28770ABD7B6" commented="no"><enum>(1)</enum><header>In general</header><text>Except as otherwise provided in this subsection, the amendments made by this section shall apply to coverage months beginning after December 31, 2021.</text></paragraph><paragraph id="H821741A37F6C455E833141FAC3450BE0" commented="no"><enum>(2)</enum><header>Application of advance payment</header><text>The amendments made by subsection (c) shall apply to coverage months beginning after the date of the enactment of this Act.</text></paragraph></subsection><subsection id="H7237FB49464C4748942B9E185501281A" commented="no"><enum>(e)</enum><header>Transition rule</header><text>Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/26/35">section 35(g)(11)(B)(i)</external-xref> of the Internal Revenue Code of 1986, an election to apply section 35 of such Code to an eligible coverage month (as defined in section 35(b) of such Code) beginning after December 31, 2021, and before the close of the taxable year which includes the date of the enactment of this Act—</text><paragraph id="HBCC89C3C926F4726966157247FB1010B" commented="no"><enum>(1)</enum><text>may be made at any time on or after such date of enactment and before the later of—</text><subparagraph id="H2945D6D4499C43AAAE4A7921A35E692B" commented="no"><enum>(A)</enum><text>the expiration of the 3-year period of limitation prescribed in section 6511(a) with respect to the taxable year which includes such coverage month, or</text></subparagraph><subparagraph id="H6EDF197864DA4E6B88B539D80496C0BB" commented="no"><enum>(B)</enum><text>such date as the Secretary may provide, and</text></subparagraph></paragraph><paragraph id="HA0FCA32708FB4F05AC8354D7B82B2CD5" commented="no"><enum>(2)</enum><text>may be made on an amended return.</text></paragraph></subsection></section></title></legis-body></bill>
