<official-title display="yes">To amend titles 23 and 49, United States Code, to codify and amend certain grant programs under which the Secretary of Transportation may issue grants for use in the provision of passenger ferry services, and for other purposes.</official-title>

<section id="H96F39D07547844478A6AD4DEED1930B6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Enhancement and Revitalization of Reliable Infrastructure for Essential Seaways Act</short-title></quote> or the <quote><short-title>FERRIES Act</short-title></quote>.</text></section> <title id="H14D158CADC38407EB93B44D736DC520D"><enum>I</enum><header>Authorizations</header> <section id="H399122DBFCE24A01A9C4F9AD7A32D0FB"><enum>2.</enum><header>Funding for passenger ferry services grant programs</header> <subsection id="H89890E4E04FA40AAA01642E195CF74B6"><enum>(a)</enum><header>Construction of ferry boats and ferry terminal facilities</header><text display-inline="yes-display-inline">Section 147(h) of title 23, United States Code, is amended by striking paragraphs (1) through (5) and inserting the following:</text>

<paragraph id="HC5E7B72976B145D5B6975B481BE5F2C6"><enum>(5)</enum><text>$168,000,000 for fiscal year 2031.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H7A0F1D6B7CE1438F85EF3DAE097CB4A0" commented="no"><enum>(b)</enum><header>Urban passenger ferry grant program</header> <paragraph id="H6420FC4EA17E4158868BF92E6BF4318F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 5307(h) of title 49, United States Code, is amended by adding at the end the following new paragraph:</text>

<paragraph id="H36466A588E1B490D83377D4FD35E8F6A" commented="no"><enum>(4)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">In addition to funds made available under section 5338 to carry out this section, there is authorized to be appropriated to the Secretary to carry out this subsection $200,000,000 for each of fiscal years 2027 through 2031.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="H327C639AC08047E2BDC6A4C9BB5D8A2A"><enum>(2)</enum><header>Apportionments</header><text>Section 5336(h)(1) of title 49, United States Code, is amended by striking <quote>$30,000,000</quote> and inserting <quote>$100,000,000</quote>. </text></paragraph></subsection>
<subsection id="HCBD1D947190C44B2BA5EB597E31159AE" display-inline="no-display-inline"><enum>(c)</enum><header>Ferry fleet modernization and shipyard job creation grant program</header>
<paragraph id="HABAD70FDCF144FB88FE057F180EFF8F5"><enum>(1)</enum><header>Amendments to IIJA electric or low-emitting ferry pilot program</header><text display-inline="yes-display-inline">Section 71102 of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/23/147">23 U.S.C. 147</external-xref> note) is amended—</text> <subparagraph id="H17583BF3334A4C81852DB2703B8FC998"><enum>(A)</enum><text>by striking the section heading and inserting <quote><header-in-text level="section" style="OLC">Ferry fleet modernization and shipyard job creation grant program</header-in-text></quote>;</text></subparagraph>
<subparagraph id="H34566CC5222F40E2A5585C3D63834EF9"><enum>(B)</enum><text>in subsection (a)—</text> <clause id="H72932C775FD84C2790925AD464C1F66C"><enum>(i)</enum><text>by striking paragraph (3);</text></clause>

                            </clause></subparagraph>
<subparagraph id="H282C62EC6BEE4E69BD0062E81AF0852B"><enum>(C)</enum><text>in subsection (b)—</text> <clause id="H100A1E8D78BE4F5F9EEA558E43897CE5"><enum>(i)</enum><text>by striking <quote>a pilot program to provide grants</quote> and inserting <quote>a grant program under which the Secretary may issues grants to a covered entity</quote>;</text></clause>

<paragraph id="H831DC38FD6F1451F8D3DCA0CD19973B5"><enum>(1)</enum><header>Amendments to IIJA ferry service grants</header><text display-inline="yes-display-inline">Section 71103 of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/23/147">23 U.S.C. 147</external-xref> note) is amended—</text> <subparagraph id="H631CF35CF9CD45329CEB8890E74921DB"><enum>(A)</enum><text>in subsection (a)—</text>
<clause id="H9CB3779A962E4415A7EDCD1A80F33BE3"><enum>(i)</enum><text>in paragraph (2)(B)—</text> <subclause id="H17A2778015C44955A259D97D39508A58"><enum>(I)</enum><text>by striking the period at the end and inserting <quote>; or</quote>; </text></subclause>

<subparagraph id="HBB8CDB5C711C431287B29388E387AE47"><enum>(B)</enum><text>in subsection (b) by striking <quote>establish a program to</quote> and all that follows through the period at the end and inserting <quote>maintain a program under which the Secretary may provide competitive grants to States for the provision of a basic essential ferry service in rural areas.</quote>;</text></subparagraph> <subparagraph id="HF424FE8FE34945DB92425560689067DF"><enum>(C)</enum><text display-inline="yes-display-inline">in subsection (e) by striking <quote>under section 5336 or 5337 of title 49, United States Code,</quote> and inserting <quote>under section 5336 (other than subsection (h)(1) of such section) or 5337</quote>; </text></subparagraph>
<subparagraph id="H7C6270E0211F411C8FD8A3EB397AAE33"><enum>(D)</enum><text>in subsection (f)—</text> <clause id="HD5D782AF4DF0485DBAB5896390ED3868"><enum>(i)</enum><text>by striking the subsection heading and inserting <quote><header-in-text level="subsection" style="OLC">Authorization of appropriations</header-in-text></quote>; and</text></clause>
<clause id="HBF91B0D8E9EF4D3EA1BC82810F140423"><enum>(ii)</enum><text>by striking <quote>$200,000,000</quote> and all that follows through the period at the end and inserting <quote>$300,000,000 for each fiscal years 2027 through 2031, of which $100,000,000 shall be derived from the Highway Trust Fund (other than the Mass Transit Account).</quote>;</text></clause></subparagraph> <subparagraph id="HB393B5623B884F129552DA8377929C8B"><enum>(E)</enum><text display-inline="yes-display-inline">by redesignating subsections (f) and (g) as subsections (g) and (h), respectively; and</text></subparagraph>
<subparagraph id="H454E57AAFFCE472DAFEBC7B2684D27A8"><enum>(F)</enum><text>by inserting after subsection (e) the following: </text> <quoted-block style="USC" id="HA308CFCFD558493987CDA4E03693DFA0" display-inline="no-display-inline"> <subsection id="HDC4FEFC235864282874869F87FE79418"><enum>(f)</enum><header>Proportion of funds</header><text display-inline="yes-display-inline">In carrying out the program under this section, the Secretary shall ensure that not less than 80 percent of the funds made available to eligible services under this section are provided to eligible services described in subsection (a)(2)(B)(i). </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>

to carry out the construction of ferry boats and ferry terminal facilities program under section 147 of title 23, United States Code: <italic>Provided</italic>, That $100,000,000, to remain available until expended, shall be made available for fiscal year 2027, $100,000,000, to remain available until expended, shall be made available for fiscal year 2028, $100,000,000, to remain available until expended, shall be made available for fiscal year 2029, $100,000,000, to remain available until expended, shall be made available for fiscal year 2030, and $100,000,000, to remain available until expended, shall be made available for fiscal year 2031: <italic>Provided further</italic>, That amounts made available under this heading in this Act shall be administered as if made available under section 147 of title 23, United States Code: <italic>Provided further</italic>, That the amounts made available under this heading in this Act shall be derived from the general fund of the Treasury, shall be in addition to any other amounts made available for such purpose, and shall not affect the distribution or amount of funds provided in any Act making annual appropriations: <italic>Provided further</italic>, That up to 1.5 percent of the amounts made available under this heading in this Act in each of fiscal years 2027 through 2031 shall be for operations and administrations of the Federal Highway Administration: <italic>Provided further</italic>, That the amounts made available under this heading in this Act shall not be subject to any limitation on obligations for Federal-aid highways or highway safety construction programs set forth in any Act making annual appropriations.</text></appropriations-small><appropriations-intermediate id="HD62FE4E877084F3E903D96684AC51586"><header>Federal Transit Administration</header></appropriations-intermediate><appropriations-small id="H5F4218B2D7BA43F2962DB8526770B4C9"><header>transit infrastructure grants</header><text display-inline="no-display-inline">For an additional amount for <quote>Transit Infrastructure Grants</quote>, $1,250,000,000, to remain available until expended, to carry out the passenger ferry grants program under section 5307(h) of title 49, United States Code: <italic>Provided</italic>, That $250,000,000, to remain available until expended, shall be made available for fiscal year 2027, $250,000,000, to remain available until expended, shall be made available for fiscal year 2028, $250,000,000, to remain available until expended, shall be made available for fiscal year 2029, $250,000,000, to remain available until expended, shall be made available for fiscal year 2030, and $250,000,000, to remain available until expended, shall be made available for fiscal year 2031: <italic>Provided further</italic>, That the amounts made available under this heading in this Act shall be derived from the general fund of the Treasury, shall be in addition to any other amounts made available for such purpose, and shall not affect the distribution of funds provided in any Act making annual appropriations: <italic>Provided further</italic>, That the amounts made available under this heading in this Act shall not be subject to any limitation on obligations for the Federal Public Transportation Assistance Program set forth in any Act making annual appropriations: <italic>Provided further</italic>, That not more than two percent of the amounts made available under this heading in this Act shall be available for administrative and oversight expenses as authorized under section 5334 and section 5338(c) of title 49, United States Code, and shall be in addition to any other appropriations for such expended, shall be made available for fiscal year 2028, $250,000,000, to remain available until expended, shall be made available for fiscal year 2029, $250,000,000, to remain available until expended, shall be made available for fiscal year 2030, and $250,000,000, to remain available until expended, shall be made available for fiscal year 2031: <italic>Provided further</italic>, That amounts made available under this heading in this Act shall be derived from the general fund of the Treasury: <italic>Provided further</italic>, That amounts made available under this heading in this Act shall not be subject to any limitation on obligations for the Federal Public Transportation Assistance Program set forth in any Act making annual appropriations: <italic>Provided further</italic>, to any limitation on obligations for transit programs set forth in any Act making annual appropriations: <italic>Provided further</italic>, That not more than two percent of the amounts made available
