which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Specialty Crops Competitiveness Act of 2004 to require the Secretary of Agriculture to establish a pilot program to provide recovery payments to producers of seasonal and perishable crops that experience low prices caused by imports, and for other purposes.</official-title></form><legis-body id="H1B22AFF20B764C2EBA2E77DB8A3A8518" style="OLC"><section section-type="section-one" id="H7AF0763D1C8448189B914F10F156F4A9"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Our Produce Act</short-title></quote>.</text></section><section id="H802DC67A8FC54093A7187F48D928C2A6"><enum>2.</enum><header>Seasonal and perishable crop loss pilot program</header><text display-inline="no-display-inline">The Specialty Crops Competitiveness Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/465">Public Law 108–465</external-xref>; 118 Stat. 3882) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H8B921BF08CD24D07AF9D1A93156A7803"><enum>(1)</enum><text>by striking <quote>Secretary of Agriculture</quote> each place it appears and inserting <quote>Secretary</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1787F220B1E1463AA3BE09C9225CB063"><enum>(2)</enum><text>in section 3 (<external-xref legal-doc="usc" parsable-cite="usc/7/1621">7 U.S.C. 1621</external-xref> note)—</text><subparagraph commented="no" display-inline="no-display-inline" id="H7EC3825FBE34418D93F8FD5669D75CC0"><enum>(A)</enum><text>in paragraph (3), by striking <quote>(3) The term</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3D514E0B91A44723A7A14C95A91F8899"><paragraph commented="no" display-inline="no-display-inline" id="H0BDD5F25DB52415BB678AA97F78B485A"><enum>(4)</enum><header>State department of agriculture</header><text>The term</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6C9F96786ECD44118BC3EC54BEB6325F"><enum>(B)</enum><text>in paragraph (2), by striking <quote>(2) The term</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3198F38083BF4761A61826AF8E3FDC4A"><paragraph commented="no" display-inline="no-display-inline" id="HA47CFC0392064209A0A692DF6897ACBC"><enum>(3)</enum><header>State</header><text>The term</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3642304355FD4C6FB8AA16B6E87ADDB5"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H086C540262604F3881D6D3472662BCF8"><title id="HAA140B16C5CE4AD29813F24DD72AC45B"><enum>V</enum><header>Seasonal and perishable crop programs</header><section id="H580BD8A29554479D8FFDDFAE2B9181C2"><enum>501.</enum><header>Seasonal and perishable crop loss pilot program</header><subsection id="H4D765EEE6FB447F6AB9BE44F890C7F82"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H6EE2E064D149443587842DD2D2E7AF4D"><enum>(1)</enum><header>Effective price</header><text>The term <term>effective price</term>, with respect to a seasonal and perishable crop for a marketing year, means the national average market price for that seasonal and perishable crop during the seasonal marketing window for the seasonal and perishable crop.</text></paragraph><paragraph id="HD2D0359F6B774C698989A93C3C15C409"><enum>(2)</enum><header>Reference price</header><text>The term <term>reference price</term>, with respect to a seasonal and perishable crop for a marketing year, means the average of the national average market prices received by all producers of the seasonal and perishable crop during the seasonal marketing window for the seasonal and perishable crop for the most recent 5-year period of marketing seasons, excluding—</text><subparagraph commented="no" display-inline="no-display-inline" id="HF0CE2BC00EC24D57B191FA3E5E66C006"><enum>(A)</enum><text display-inline="yes-display-inline">the marketing season during that period with the highest national average market price; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H600D3B4990834410A00D864B2A9D7F75"><enum>(B)</enum><text>the marketing season during that period with the lowest national average market price.</text></subparagraph></paragraph><paragraph id="HAE19A39045EE43048F521407D2E3D3A2"><enum>(3)</enum><header>Seasonal and perishable crop</header><text>The term <term>seasonal and perishable crop</term> means an asparagus, bell pepper, blueberry, cucumber, or squash crop that is—</text><subparagraph id="HC732907379854C7DAEECF404E96CEDC8"><enum>(A)</enum><text>marketed in raw form for consumption without further processing; and</text></subparagraph><subparagraph id="H75C9D7B3B7114959AA58F1B6070364DC"><enum>(B)</enum><text>as determined by the Secretary, normally marketed not later than 4 weeks after harvesting.</text></subparagraph></paragraph><paragraph id="H6ADC153700D342F0A15077EF513C43FB"><enum>(4)</enum><header>Seasonal marketing window</header><text>The term <term>seasonal marketing window</term> means the timeframe during a marketing year, as determined by the Secretary—</text><subparagraph commented="no" display-inline="no-display-inline" id="HDDAF5C413FDF463DB3260DC8A94F6552"><enum>(A)</enum><text display-inline="yes-display-inline">during which a crop is normally marketed within a specific geographical region of the United States; and</text></subparagraph><subparagraph id="HAF1A144C311D434AB01A85C812A48103"><enum>(B)</enum><text>that concludes on the date that is not later than 4 weeks after the last day on which the crop is normally harvested.</text></subparagraph></paragraph></subsection><subsection id="HCE9CF7D465D745C4B495F0DF86EE0803"><enum>(b)</enum><header>Establishment of pilot program</header><paragraph id="HA754D84407C3419E886A3E0DACE95E6B"><enum>(1)</enum><header>In general</header><text>Beginning with marketing year 2025, the Secretary shall establish a pilot program under which the Secretary shall provide annual crop loss payments to producers of seasonal and perishable crops located in any geographical region described in paragraph (2) in accordance with this section, if the Secretary determines that, during the applicable marketing year—</text><subparagraph id="HA79D3ADAD11F4199B3BCF22836AF39AB"><enum>(A)</enum><text>the effective price of the seasonal and perishable crop is less than the reference price of that seasonal and perishable crop; and</text></subparagraph><subparagraph id="H74E080F51ED94A0AB1C2AE626E43ACDF"><enum>(B)</enum><text>the crop loss described in subparagraph (A) is caused by imports of the applicable seasonal and perishable crop.</text></subparagraph></paragraph><paragraph id="H8E13E2649B584E28822345BFF6FE1973"><enum>(2)</enum><header>Description of geographical regions</header><text>A geographical region referred to in paragraph (1) is a geographical region of the United States in which a seasonal and perishable crop is grown within a seasonal marketing window during which a harvest and shipment of the seasonal and perishable crop occurs, as determined by the Secretary.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H728EF2EAAABF4D8EB9B763D0AA3A07D6"><enum>(c)</enum><header>Eligibility</header><paragraph commented="no" display-inline="no-display-inline" id="H22BC0FCCD71947D19A0D9DC35A4C60BD"><enum>(1)</enum><header>Application</header><text>To be eligible to receive a payment under the pilot program under this section, a producer of 1 or more seasonal and perishable crops shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including the information described in paragraph (2).</text></paragraph><paragraph id="H0B0D8CF97D85499F815CE666D5033A58"><enum>(2)</enum><header>Requirement</header><text>No producer may be eligible to receive a payment under the pilot program under this section unless the producer—</text><subparagraph id="H77955772099943CEB9447B3BB98A95DC"><enum>(A)</enum><text>has an average adjusted gross income of less than $5,000,000 for the 3 tax years preceding the most recent tax year; and</text></subparagraph><subparagraph id="H7AC2B50F58B14173849053E0612237BA"><enum>(B)</enum><text>derives at least 75 percent of the adjusted gross income of the producer from farming, ranching, or forestry, as determined by the Secretary. </text></subparagraph></paragraph></subsection><subsection id="H48CC165C35724E87930624287681B4CC"><enum>(d)</enum><header>Payment amount</header><text>The amount of a payment provided under the pilot program under this section shall be equal to the product obtained by multiplying—</text><paragraph id="H6190876BFC2B4C62B4604DCAAC0FD239"><enum>(1)</enum><text>the payment rate for the marketing year for which the payment is provided with respect to the applicable seasonal and perishable crop under subsection (e); and</text></paragraph><paragraph id="HEFE5427D23D7418393B58F007879644F"><enum>(2)</enum><text>the average production during the 5 most recent marketing years of the seasonal and perishable crop by the producer during the seasonal marketing window, excluding—</text><subparagraph commented="no" display-inline="no-display-inline" id="H48E6D8E0E1B24362AC7C8B67E4536F6C"><enum>(A)</enum><text display-inline="yes-display-inline">the marketing year during that period with the highest production; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5F59730B6DFB4957BE8FD4B22997CE82"><enum>(B)</enum><text>the marketing year during that period with the lowest production.</text></subparagraph></paragraph></subsection><subsection id="H63F7CEA5214B4619B62DA3719ECE6C38"><enum>(e)</enum><header>Payment rate</header><text>The rate of a payment provided under the pilot program under this section shall be equal to the difference between—</text><paragraph id="HED11C6DF82764C47B384F1CB309BAB71"><enum>(1)</enum><text>the reference price of the applicable seasonal and perishable crop; and</text></paragraph><paragraph id="HE475BAB474E04E5D9DFA7802CC1FF718"><enum>(2)</enum><text>the effective price of that seasonal and perishable crop.</text></paragraph></subsection><subsection id="H136F153B6F9E4E7DB1753A4B93CAF6F1"><enum>(f)</enum><header>Sunset</header><text>The pilot program under this section shall terminate on the date that is 5 years after the date of enactment of the <short-title>Protecting Our Produce Act</short-title>.</text></subsection><subsection id="H79C19C60B026459293046427DC21CBCF" commented="no"><enum>(g)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to carry out the pilot program under this section $200,000,000 for each fiscal year that begins after the date of the enactment of the <short-title>Protecting Our Produce Act</short-title> and before the date described in subsection (f).</text></subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
