R. 7726</legis-num><current-chamber display="yes">IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260604">June 4, 2026</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend the Child Care and Development Block Grant Act of 1990 to withhold funds from noncompliant States under such Act.</official-title></form><legis-body id="H206688795BC744EDA8E49B9D087E1E26" style="OLC"><section id="HADA4CC37BBA24D08B11EBF2101AD762C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Child Care Scams Act of 2026</short-title></quote>.</text></section><section id="HD866ED5433B84EC2AC9DF90387736981" section-type="subsequent-section"><enum>2.</enum><header>Strengthening the authority to withhold funds for fraud</header><text display-inline="no-display-inline">Section 658I(b)(2)(B) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858g">42 U.S.C. 9858g(b)(2)</external-xref>) is amended by striking <quote>Secretary may</quote> and inserting <quote>Secretary shall</quote>.</text></section><section id="HB4AE5DA0A1AC43C186ADBB9DD592D4D7" section-type="subsequent-section"><enum>3.</enum><header>Program integrity and accountability</header><text display-inline="no-display-inline">Section 658E(c)(2) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858c">42 U.S.C. 9858c(c)(2)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HF867F44C48B3430C9DB1BC6EF62575E2" display-inline="no-display-inline"><subparagraph id="H0202B6F65AF74F49BF077D211C9A8C15"><enum>(W)</enum><header>program integrity and accountability</header><text display-inline="yes-display-inline">The plan shall include a description of—</text><clause id="HAE1F378142644BBB80AFA723BF4F10AD"><enum>(i)</enum><text>the State's internal controls to ensure program integrity and accountability;</text></clause><clause id="H791BA7C3A4BA422FBEDE7B025CD1551E"><enum>(ii)</enum><text>the processes in place—</text><subclause id="H8020B48DED4B48968DF7F2E52EF7F853"><enum>(I)</enum><text>to investigate and recover fraudulent payments; and</text></subclause><subclause id="H26F89BDAE6474C218C819A3FEB93BCA2"><enum>(II)</enum><text>to impose sanctions on clients or providers in response to fraud; and</text></subclause></clause><clause id="HEBB98076F88644F7A933178CFC5718C9"><enum>(iii)</enum><text>the procedures in place to document and verify eligibility.</text></clause><continuation-text continuation-text-level="subparagraph">Such description shall include how the State utilizes data within and across other State and local agencies that have oversight of child care providers that serve children who receive assistance under this subchapter.</continuation-text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H5486F45B67974A769CDB1875C00F9E54" display-inline="no-display-inline"><enum>4.</enum><header>Preventing fraud in the child care and development block grant program</header><text display-inline="no-display-inline">Section 658I(b) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858g">42 U.S.C. 9858g(b)</external-xref>) is amended—</text><paragraph id="HC5CC12255D764392924B85177EAF9D6F"><enum>(1)</enum><text>by redesignating paragraph (3) as paragraph (4); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0F7E46704D8A48DB8C4A30FE26E226E1"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (2) the following:</text><quoted-block id="HF7D225F19D1C46F0A21D58751456FBDE" display-inline="no-display-inline" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="H02CCDD22702041AF9B4B421D8AE75394"><enum>(3)</enum><header>Determination of fraud</header><subparagraph id="HC9203637F96C4E0D955175074B9E93F2" commented="no"><enum>(A)</enum><header>Investigation</header><text display-inline="yes-display-inline">The Secretary shall investigate fraud with respect to financial assistance available under this subchapter. </text></subparagraph><subparagraph id="HD722A92F7F494A4BAA505FF8636731A1"><enum>(B)</enum><header>Debarment</header><text display-inline="yes-display-inline">In the case that the Secretary makes, or finds that there has been, a final determination of fraud against a child care provider that received financial assistance available under this subchapter, the Secretary shall permanently debar such child care provider from receiving such financial assistance.</text></subparagraph><subparagraph id="HDFF4400913B34346B340A56366A6CBD4" display-inline="no-display-inline"><enum>(C)</enum><header>Providers debarred from Child and Adult Care Food Program</header><text display-inline="yes-display-inline">In the case that a child care provider has been debarred from participating in the Child and Adult Care Food Program under section 17 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766</external-xref>) in accordance with subsection (d)(5)(E)(i) of such section, the Secretary shall permanently debar such child care provider from receiving financial assistance under this subchapter.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5A156827A9294847ABCB638FB72CDE67"><enum>(D)</enum><header>Final determination of fraud definition</header><text>In this paragraph, the term <term>final determination of fraud</term> means a determination reached in an administrative order or as part of a judicial decision, for which any rights to review or appeal have been exhausted or waived, that a child care provider—</text><clause commented="no" display-inline="no-display-inline" id="H821E2DF2C05B4C949EDE56DF9FE5F134"><enum>(i)</enum><text display-inline="yes-display-inline">knowingly submitted a false statement or documentation to obtain financial assistance available under this subchapter;</text></clause><clause commented="no" display-inline="no-display-inline" id="H87073F48013043449171192374E6FC41"><enum>(ii)</enum><text display-inline="yes-display-inline">misrepresented ownership of, enrollment at, attendance at, or services provided through a program of child care services, or the eligibility of the provider to provide such services, to obtain such financial assistance;</text></clause><clause commented="no" display-inline="no-display-inline" id="H3CB13084B1574CFAACDE66740EE4ACF4"><enum>(iii)</enum><text display-inline="yes-display-inline">to obtain such financial assistance, operated without the State licensing described in section 658E(c)(2)(F) and without receiving an exception to such licensing;</text></clause><clause commented="no" display-inline="no-display-inline" id="H11004DD4EC1946CD987D53B525B06CE7"><enum>(iv)</enum><text display-inline="yes-display-inline">made a knowing and improper expenditure of such financial assistance; or</text></clause><clause id="H20CDBD6D90B34795864EA9299BA849B0"><enum>(v)</enum><text display-inline="yes-display-inline">engaged in any other conduct related to such financial assistance that constituted fraud under Federal or State law.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HFC9FDB424FF443B7A28F751DD7477132" section-type="subsequent-section"><enum>5.</enum><header>Improper payment rate requiring corrective action plan; conditional ineligibility</header><text display-inline="no-display-inline">Section 658J of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858h">42 U.S.C. 9858h</external-xref>) is amended—</text><paragraph id="H2FCE0C6D85074F38836DAAB85F521680"><enum>(1)</enum><text>by redesignating subsection (c) as subsection (e); and</text></paragraph><paragraph id="HF027D23A9E1F4CAF8C5E9EC8F688B01D"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text><quoted-block style="OLC" id="H3A07D7340EDD4DA79D58C5B35777ECD8" display-inline="no-display-inline"><subsection id="HEC333FED05AB434D8490B69D7D0F893D"><enum>(c)</enum><header>improper payment threshold requiring corrective action plan</header><text display-inline="yes-display-inline">If for a fiscal year the improper payment rate of a State is more than 5 percent of the aggregate amount of payments made to carry out this subchapter by such State for such fiscal year, then such State shall submit to the Secretary—</text><paragraph id="HA2757D2E3CCB4F81AAF51F59759A1B7C"><enum>(1)</enum><text>for review and approval a corrective action plan to reduce such rate to not more than 5 percent for each subsequent fiscal year; and</text></paragraph><paragraph id="H8956C49DEA4C4FB2A828D558299828F6"><enum>(2)</enum><text display-inline="yes-display-inline">such reports as the Secretary may require to show that such State is complying with the requirements of such plan as approved by the Secretary.</text></paragraph></subsection><subsection id="H5F8F520792B44CBABE22B2EEB523ADFA"><enum>(d)</enum><header>Conditional ineligibility</header><text display-inline="yes-display-inline">If for each of 2 consecutive fiscal years the improper payment rate of a State determined under this section is more 5 percent, then such State shall be ineligible to receive funds under this subchapter unless such State demonstrates to the satisfaction of the Secretary that such State for the next fiscal year will—</text><paragraph id="H2A01B99EB1444831A0CD1EE70BF44566"><enum>(1)</enum><text display-inline="yes-display-inline">reduce such improper payment rate to not more than 5 percent for the next fiscal year; or</text></paragraph><paragraph id="HFC0DE53C453245BE8C415549701CA616"><enum>(2)</enum><text>make significant progress to comply with the corrective action plan approved under subsection (c).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H469770B8BA5C4609BB8075A88116F766" section-type="subsequent-section"><enum>6.</enum><header>Cyclical monitoring of State performance</header><text display-inline="no-display-inline">Section 658K of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858i">42 U.S.C. 9858i</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="H7ED59CC9030440CDA66DED9F72C60FBC" display-inline="no-display-inline"><subsection id="H808A4CADCD4B4D8085B732080A8FDF94"><enum>(c)</enum><header>Periodic monitoring by the Secretary</header><text>At 3-year intervals, the Secretary shall conduct a comprehensive review of the performance of each State that receives assistance under this subchapter. Based on the results of such review, the Secretary shall designate as high risk a State that has—</text><paragraph id="H821DB2EF9C30422FBB985256C631BB1D"><enum>(1)</enum><text>a high level of unresolved or repeated adverse audit findings submitted under subsection (b);</text></paragraph><paragraph id="H612891ED1DAF4B3EAAF063FA635852DA"><enum>(2)</enum><text>a high level of unresolved issues under, or repeated performance failures to carry out, corrective action plans submitted by such State under section 659J(c); or</text></paragraph><paragraph id="HC43CFA455D0B4BE088536625C7746A5D"><enum>(3)</enum><text>unresolved or repeat findings of noncompliance with the State plan approved under section 658E(c).</text></paragraph></subsection><subsection id="H04F51A3D6CB14F30AFEA9F55F7D0EFEA"><enum>(d)</enum><header>Required additional monitoring</header><text display-inline="yes-display-inline">If a State is designated as high risk under subsection (a), then the performance of such State shall be subject to additional monitoring, as determined by the Secretary.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H31816E2528E54422ACB2710BC18FC97A" display-inline="no-display-inline" section-type="subsequent-section"><enum>7.</enum><header>Preventing fraud in the child and adult care food program</header><text display-inline="no-display-inline">Section 17(d)(5) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766(d)(5)</external-xref>) is amended—</text><paragraph id="HC6D81B34EED54EC2914E357004696B64"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (E) as subparagraph (F); and</text></paragraph><paragraph id="HA6A87A0DCC78449D8807F93987EC6E8D"><enum>(2)</enum><text>by inserting after subparagraph (D) the following:</text><quoted-block style="OLC" id="H3149AEBDC2A942BE815D98EF67AB20C0" display-inline="no-display-inline"><subparagraph id="H9F12AEF8147D441CB4AE59DB7BD41A49"><enum>(E)</enum><header>Termination due to fraud</header><clause id="H1286DC82B8794D70B37D2F606323C8C3"><enum>(i)</enum><header>Debarment</header><text display-inline="yes-display-inline">In the case that the participation of an institution or family or group day care home under the program is terminated due to a final determination of fraud, the Secretary shall permanently debar such institution or family or group day care home from participating in the program.</text></clause><clause id="HD2DDFC783F6346BBBDADC69BC9A897D0"><enum>(ii)</enum><header>Providers debarred from Child Care and Development Block Grant program</header><text display-inline="yes-display-inline">In the case that an institution or family or group day care home has been debarred from receiving financial assistance under the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9857">42 U.S.C. 9857 et seq.</external-xref>) in accordance with section 658I(b)(3)(B) of such Act, the Secretary shall permanently debar such institution or family or group day care home from participating in the program.</text></clause><clause id="H4B6AB540D2514076A8C1AE0AEAC36ADC"><enum>(iii)</enum><header>Final determination of fraud definition</header><text display-inline="yes-display-inline">In this subparagraph, the term <term>final determination of fraud</term> means a determination reached in accordance with the procedures and requirements of this section, for which any rights to review or appeal have been exhausted or waived, that an institution or family or group day care home—</text><subclause id="H115D4A7EB1414611829326C58BB93E66" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">knowingly submitted a false statement or documentation to obtain funds disbursed under subsection (f)(1)(A);</text></subclause><subclause id="HB197749A49BB47B58AC684942488FA9D" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">misrepresented ownership, enrollment, attendance, or services in connection with the operation of the program by such institution or family or group day care home, or the eligibility of such institution or family or group day care home to operate the program, to obtain such funds;</text></subclause><subclause id="HB8185355C5C944D5B62332EF8CC1C74E" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">made a knowing and improper expenditure of such funds; or</text></subclause><subclause id="HFD1EA46128804353B105CD032B9941E0"><enum>(IV)</enum><text>engaged in any other conduct related to such funds that constituted fraud under Federal or State law.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H7C0CDE69E90C496C973020A177340EDB" section-type="subsequent-section"><enum>8.</enum><header>Eliminating authority to waive sanctions</header><text display-inline="no-display-inline">Section 658I(c) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858lg">42 U.S.C. 9858lg(c)</external-xref>) is amended—</text><paragraph id="H9397E80800E741FDA7F156BE0C005652"><enum>(1)</enum><text>in paragraph (1) by striking <quote>or sanctions imposed upon a State in accordance with subsection (b)(2)</quote>;</text></paragraph><paragraph id="H4578ED56A71F4EF3A08B07035D2BC3D4"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text><subparagraph id="HF29DF7DCFD2C4E22AF384159B5B42C4B"><enum>(A)</enum><text>in subparagraph (A) by striking <quote>sanction or</quote>; and</text></subparagraph><subparagraph id="H620586C2553F4DF18A7A4095ABA81A48"><enum>(B)</enum><text>in subparagraph (B) by striking <quote>sanction or</quote>;</text></subparagraph></paragraph><paragraph id="HB9F2EB4BD36244C6A41D3A1774AA6EDE"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (3) striking <quote>sanction or</quote>; and</text></paragraph><paragraph id="HED750E437E9F47478B9A83B3C5CDA41A"><enum>(4)</enum><text>in paragraph (7) by striking <quote>sanction(s) or</quote>.</text></paragraph></section><section id="H721A5A4B275743F99D73A917F636BA5B"><enum>9.</enum><header>GAO study and report on provider-related fraud</header><subsection id="H6C966E43DC2F4116B16C33D022C129CC"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct a study regarding fraud prevention measures in Federal early childhood education, child care, and child nutrition programs that shall include an analysis of—</text><paragraph id="HA8C321FD2C7F4B9C90F9B1D5DF914FF1"><enum>(1)</enum><text>the effectiveness of procedures and measures to prevent fraud carried out by providers of services under such programs;</text></paragraph><paragraph id="HF2CB54F5FFED4AC1AB970BEE0281C94F"><enum>(2)</enum><text>whether the data the Federal Government receives in connection with such programs (including through audits and reporting requirements) is—</text><subparagraph id="HF49F9E943225480FB42B9C87F2C23033"><enum>(A)</enum><text>sufficient to successfully identify fraud carried out under such programs; and</text></subparagraph><subparagraph id="HA0D924A8C4D948A6A8307466ED592575"><enum>(B)</enum><text>used effectively by the Federal Government to identify potential fraud carried out under such programs; and</text></subparagraph></paragraph><paragraph id="H79F1A15C9CC648DB89BBB3416A744ED6"><enum>(3)</enum><text display-inline="yes-display-inline">with respect to the Child Care and Development Block Grant program established under the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9857">42 U.S.C. 9857 et seq.</external-xref>)—</text><subparagraph id="H4A83F46B227C4A0DAD1C5DB87014ED4A"><enum>(A)</enum><text display-inline="yes-display-inline">the program integrity results for States that have delegated responsibilities related to program management and administration to counties, local municipalities, or other entities; and</text></subparagraph><subparagraph id="H9128D04FC4BB4EF1B64FCDE0C2917534"><enum>(B)</enum><text display-inline="yes-display-inline">whether any corrective action plans have been implemented by States to improve program integrity results, including any measurable outcomes from implementing such a corrective action plan.</text></subparagraph></paragraph></subsection><subsection id="H6052CEB95D704C5F8F0AE38819E00F49"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this section, the Comptroller General of the United States shall submit to the Committee on Education and Workforce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate a report containing—</text><paragraph id="HC1378263BFCC43F6BA769D79F7D52A3F"><enum>(1)</enum><text>the results of the study conducted under subsection (a); and</text></paragraph><paragraph id="H0277049DC0C64BB3AC51F8830A5681DA"><enum>(2)</enum><text display-inline="yes-display-inline">any regulatory or legislative recommendations to improve fraud prevention measures in Federal early childhood education, child care, and child nutrition programs.</text></paragraph></subsection><subsection id="HB7DCE7833F26402BAA2134D2460CB691"><enum>(c)</enum><header>Federal early childhood education, child care, and child nutrition programs defined</header><text>For the purposes of this section, the term <quote>Federal early childhood education, child care, and child nutrition programs</quote> includes—</text><paragraph id="H00C517873FAB4E1F957E9CE5574AB3AC"><enum>(1)</enum><text>Head Start programs (including Early Head Start programs) carried out under the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9831">42 U.S.C. 9831 et seq.</external-xref>);</text></paragraph><paragraph id="HD50ABA9318A54D768FE7F8576A99D088"><enum>(2)</enum><text display-inline="yes-display-inline">the Child and Adult Care Food Program under section 17 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766</external-xref>); and</text></paragraph><paragraph id="HA4352F7998BC407C989241F980E3EFBF"><enum>(3)</enum><text display-inline="yes-display-inline">the Child Care and Development Block Grant program established under the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9857">42 U.S.C. 9857 et seq.</external-xref>).</text></paragraph></subsection></section><section id="H0400622DFAD04C6FB45EE642CEF8541A" section-type="subsequent-section"><enum>10.</enum><header>Fraudulent payments</header><text display-inline="no-display-inline">Section 658J(b) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858h">42 U.S.C. 9858h(b)</external-xref>) is amended—</text><paragraph id="HF7D8149905C44FAB9210237B4D423D0A"><enum>(1)</enum><text>in paragraph (1) by inserting <quote>(including fraudulent payments)</quote> after <quote>overpayments</quote>; and</text></paragraph><paragraph id="HF4528F7E60F944FB8707A7A6417D77F6"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H2D3B3A09F18C47488EEA499567A64242" display-inline="no-display-inline"><paragraph id="HFD2C070433234C329B5349BDED05830B"><enum>(3)</enum><header>Report</header><text display-inline="yes-display-inline">The State shall submit to the Secretary an annual report that identifies the dollar and percentage amount of improper payments made by the State, disaggregated as specified by the Secretary by standardized payment categories (including suspected and verified fraudulent payments, non-fraudulent overpayments, underpayments, and technically improper payments (e.g., system error payments)).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body><attestation><attestation-group><attestation-date date="20260603" chamber="House">Passed the House of Representatives June 3, 2026.</attestation-date><attestor display="yes">Kevin F.
