Based on the results of such review, the Secretary shall designate as high risk a State that has—</text><paragraph id="H294631F6AF0248D8A1692DE58EE57264"><enum>(1)</enum><text>a high level of unresolved or repeated adverse audit findings submitted under subsection (b);</text></paragraph><paragraph id="H874472B8FA5142E7B85C4B9082B1541F"><enum>(2)</enum><text>a high level of unresolved issues under, or repeated performance failures to carry out, corrective action plans submitted by such State under section 659J(c); or</text></paragraph><paragraph id="H96EE8D439A51432DA5F7378C17229EC8"><enum>(3)</enum><text>unresolved or repeat findings of noncompliance with the State plan approved under section 658E(c).</text></paragraph></subsection><subsection id="HCA24F253E54240AB9CB199B2528831DA"><enum>(d)</enum><header>Required additional monitoring</header><text display-inline="yes-display-inline">If a State is designated as high risk under subsection (a), then the performance of such State shall be subject to additional monitoring, as determined by the Secretary.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body><endorsement display="yes"><action-date>April 6, 2026</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
