R. 7721</legis-num><associated-doc role="report" display="yes">[Report No. 119–587]</associated-doc><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20260226">February 26, 2026</action-date><action-desc><sponsor name-id="G000576">Mr. Grothman</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Workforce</committee-name></action-desc></action><action display="yes"><action-date date="20260406">April 6, 2026</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction><action-instruction>For text of introduced bill, see copy of bill as introduced on February 26, 2026</action-instruction><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Child Care and Development Block Grant Act of 1990 to implement an improper payment threshold under such Act.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HED00" reported-display-style="italic" id="H050E0A85A9D84B06A1C1B1CF06EF9F15"><section id="HEE4D54B18355408D944F131007C368FB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Combating Regulatory Abuse, Closing Known Deficiencies, and Overseeing Waste Nationwide Act of 2026</short-title></quote> or the <quote><short-title>CRACKDOWN Act of 2026</short-title></quote>.</text></section><section id="HFBDB7C64896044FDB6594E53C60D932B" section-type="subsequent-section"><enum>2.</enum><header>Improper payment rate requiring corrective action plan; conditional ineligibility</header><text display-inline="no-display-inline">Section 658J of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858h">42 U.S.C. 9858h</external-xref>) is amended—</text><paragraph id="HBC10C927B9874F3DAFE4650DD50B827C"><enum>(1)</enum><text>by redesignating subsection (c) as subsection (e), and</text></paragraph><paragraph id="H30DD49104820453EA1CF1AE26F8184D0"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text><quoted-block style="OLC" id="H61EAB01D54BA4E04A485F4A0838143A9" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HED00"><subsection id="H4CD4F8D71A8E4168803275E5D911AC07"><enum>(c)</enum><header>improper payment threshold requiring corrective action plan</header><text display-inline="yes-display-inline">If for a fiscal year the improper payment rate of a State is more than 5 percent of the aggregate amount of payments made to carry out this subchapter by such State for such fiscal year, then such State shall submit to the Secretary—</text><paragraph id="H6781760F774A4BD19C465D51BE420842"><enum>(1)</enum><text>for review and approval a corrective action plan to reduce such rate to not more than 5 percent for each subsequent fiscal year; and</text></paragraph><paragraph id="H13CA03E2D0884402A2916288E98F4D21"><enum>(2)</enum><text display-inline="yes-display-inline">such reports as the Secretary may require to show that such State is complying with the requirements of such plan as approved by the Secretary.</text></paragraph></subsection><subsection id="H939C01F5135140CD8507BBC2E72E4F1A"><enum>(d)</enum><header>Conditional ineligibility</header><text display-inline="yes-display-inline">If for each of 2 consecutive fiscal years the improper payment rate of a State determined under this section is more 5 percent, then such State shall be ineligible to receive funds under this subchapter unless such State demonstrates to the satisfaction of the Secretary that such State for the next fiscal year will—</text><paragraph id="H8210698EF56C4CCB95680F21725EC9DC"><enum>(1)</enum><text display-inline="yes-display-inline">reduce such improper payment rate to not more than 5 percent for the next fiscal year; or</text></paragraph><paragraph id="H634015A69B094CBFA94FC146ABE91631"><enum>(2)</enum><text>make significant progress to comply with the corrective action plan approved under subsection (c).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body><endorsement display="yes"><action-date>April 6, 2026</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
