committee-id="HHM00">Committee on Homeland Security</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Homeland Security Act of 2002 to prohibit the Secretary of Homeland Security from obligating or expending Federal funds for the acquisition of, or utilizing, full-body restraints, and for other purposes.</official-title></form><legis-body id="HF236500229A84F7A9B13215B8C463673" style="OLC"><section id="H56823AA8339C40968CE3DC28A749CC7D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Full-Body Restraint Prohibition Act</short-title></quote>.</text></section><section id="HF1811F0C4F734991B81DEE37A753CFC6"><enum>2.</enum><header>Prohibitions on the Department of Homeland Security with respect to full-body restraints</header><subsection id="H211AEDC222104A4D9E960147D0096EF8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title VII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/341">6 U.S.C. 341 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block style="OLC" id="HCBE89F79453941F0982387E959C3E53C" display-inline="no-display-inline"><section id="H0AFC63BDB3824D1B88AE6DDE005BD4F4"><enum>714.</enum><header>Prohibitions with respect to full-body restraints</header><subsection id="HCCFC3D0E11164D8BA1B4D78DF55D94B6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may not—</text><paragraph id="HA9250630FE0D482797CB130CD0C8ADA2"><enum>(1)</enum><text>obligate or expend Federal funds for the acquisition of, or</text></paragraph><paragraph id="H8312D2F8294F4817B0BD949C5C96AA07"><enum>(2)</enum><text>utilize,</text></paragraph><continuation-text continuation-text-level="subsection">a full-body restraint.</continuation-text></subsection><subsection id="HF87AFC096C8B490D803E388B76DF3FA2"><enum>(b)</enum><header>Saving provision</header><text display-inline="yes-display-inline">The prohibition under subsection (a)(1) does not apply with respect to a contract or other similar type agreement entered into on or before the date of the enactment of this section.</text></subsection><subsection id="HCA500EB97E3548B8B1CE218C34D64EED" commented="no"><enum>(c)</enum><header>Federal service</header><text>If an officer or employee of the Department in the course of employment with the Department—</text><paragraph id="H5FECD36D20AF42E6950D83816044E8BD" commented="no"><enum>(1)</enum><text>violates a prohibition under subsection (a), or</text></paragraph><paragraph id="H4FE983C85C884DF2B5A6D0C3EC5CEF37" commented="no"><enum>(2)</enum><text>deceives Congress or departmental leadership, as described in section 454, on a matter related to such prohibition,</text></paragraph><continuation-text continuation-text-level="subsection" commented="no">the Secretary, through the employee discipline and adverse action programs referred to in section 704(b)(10), shall remove such officer or employee, as the case may be, from Federal service.</continuation-text></subsection><subsection id="HF4C0CE51DE094A9DA81CB19666D88F0F"><enum>(d)</enum><header>Reports</header><paragraph id="H87D293B19A4944239B006171C675278F"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this section and quarterly thereafter, the Secretary shall submit to the Committee on Homeland Security and the Committee on the Judiciary of the House of Representatives and the Committee on Homeland Security and Governmental Affairs and the Committee on the Judiciary of the Senate a report that includes the following:</text><subparagraph id="H29F35167C96A44DB94EA757D2F6F4583"><enum>(A)</enum><text>Information relating to departmental compliance with the prohibitions under subsection (a).</text></subparagraph><subparagraph id="H25A5987C5684434AADD97C457919269E"><enum>(B)</enum><text>An accounting of the full-body restraints, if any, in the possession of the Department.</text></subparagraph></paragraph><paragraph id="H79A316720E2347769A9E71CE53EC8DC7"><enum>(2)</enum><header>Contents</header><text>If the prohibition under subsection (a)(2) is violated, the applicable report under paragraph (1) shall include, to the extent practicable, the following with respect to such violation:</text><subparagraph id="H0537E92BE911447AB0780BAFAD4D232A"><enum>(A)</enum><text>An identification of the following:</text><clause id="H2EDE9DEAE1AF457781E3E7F25ED68D50"><enum>(i)</enum><text>The individual with respect to whom personnel of the Department utilized a full-body restraint.</text></clause><clause id="H97D4E95ED5CF4A0C90EAAD649A2BDA8C"><enum>(ii)</enum><text>If applicable, each field office to which such personnel are assigned or deployed, as the case may be.</text></clause></subparagraph><subparagraph id="HC2662B28DF3848008B21DBABFB4E4CB1"><enum>(B)</enum><text>Information relating to the following:</text><clause id="H96501C483A3544E9A720F4927877668A"><enum>(i)</enum><text>The reason for such utilization.</text></clause><clause id="H4233243FCF5F49F2864FDC8C48F96663"><enum>(ii)</enum><text>The age, sex, race, and ethnicity of such individual.</text></clause><clause id="H415A6D61CC054B63A0FBC299A0471E0E"><enum>(iii)</enum><text>The period of time for which such restraint was so utilized.</text></clause><clause id="H144162EEFD3D4EA9942C2369EB840437"><enum>(iv)</enum><text>The citizenship or immigration status of such individual.</text></clause><clause id="HCD363DC2ED0B475D8B222BF6A9B46CF1" commented="no"><enum>(v)</enum><text>Whether such individual was injured in the course of being placed in such restraint.</text></clause><clause id="H52F402CAC17D4319A088C73221190571" commented="no"><enum>(vi)</enum><text>Whether subsequent to such placement such individual was injured as a result of such utilization.</text></clause><clause id="H6AD28374D56341108D838486E86629D4"><enum>(vii)</enum><text>The component of the Department through which such utilization was carried out.</text></clause><clause id="H2281A3D192574F0B98175697C52A5A80"><enum>(viii)</enum><text>The location at which, or the transportation route on which, such utilization was carried out.</text></clause><clause id="H67F8E712A13D43219710938423572E9F"><enum>(ix)</enum><text>The language access services, if any, available to such individual immediately before and during such utilization.</text></clause></subparagraph><subparagraph id="HC4F6A0F328FF4F488C5ED780F4281CC0"><enum>(C)</enum><text display-inline="yes-display-inline">An identification of the officer or employee of the Department who is responsible for such utilization.</text></subparagraph><subparagraph id="H645E3A90723B47C6AA6569BB03D1C159"><enum>(D)</enum><text>Information relating to the following:</text><clause id="H305640A4601040BDAC0BE46B1E00C008"><enum>(i)</enum><text>Whether such officer or employee, as the case may be, during such utilization was a doctor, nurse, or other health professional, qualified to determine whether such utilization would injure such individual.</text></clause><clause id="H36C2BD49813441DC90CB11489E96B0C6"><enum>(ii)</enum><text>If clause (i) is answered in the affirmative, such qualifications.</text></clause></subparagraph></paragraph></subsection><subsection id="H8F36F428CEF84D99ACDE4C6744CFC84E"> <enum>(e)</enum> <header>Full-Body restraints defined</header> <text>In this section, the term <term>full-body restraints</term> means four-point and five-point restraints that immobilize an individual.</text>
 </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE3D848C1686447D487D5DABD8DD2CAAC"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents in section 1(b) of the Homeland Security Act of 2002 is amended by inserting after the item relating to section 713 the following new item:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HCB929F369818434391E61E88C8254371"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 714.
