<section id="H8E97EC2436EE4B3B87451FACE21BD1C9" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting All Personal Effects and Records from Seizure Act of 2026</short-title></quote> or the <quote><short-title>PAPERS Act of 2026</short-title></quote>.</text></section> 
<section id="H6D328B8F87404939A40193284E7BCBD6"><enum>2.</enum><header>Return of documents after release from Department of Homeland Security custody</header> 
<subsection id="H4502016E0FA3412E8A7DA4BD670FF7F9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter 4 of title II of the Immigration and Nationality Act is amended by inserting after section 236A the following:</text> <quoted-block style="OLC" id="HAFC2EAA6BEA64FE08D3C0F589BE06636" display-inline="no-display-inline"> <section id="HFB3BFD9259134B2D987E9B590FD3C710"><enum>236B.</enum><header>Return of documents after release from custody</header> <subsection id="HB78E9042AE1C4BCEAEEE08B87830D3E0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), upon releasing any individual from custody under this Act, the Secretary of Homeland Security shall return to such individual each covered document taken from the individual while in the custody of the Department of Homeland Security.</text></subsection> 
<subsection id="H809744C60B9C4D698157726749E1529B"><enum>(b)</enum><header>Exception</header><text>The Secretary may retain a covered document only if—</text> <paragraph id="H67C0CAA6BF4B4E55A84BD3E7EC9F49B2"><enum>(1)</enum><text>the document is determined to be fraudulent;</text></paragraph> 
<paragraph id="HF7674232CF6348F085AFA2E88D5195DE"><enum>(2)</enum><text>the document is contraband or evidence in a pending criminal proceeding; or</text></paragraph> <paragraph id="H9C89695EA3B543E6968137F6BE4BADA2"><enum>(3)</enum><text>the individual is no longer legally entitled to possess the document under Federal law.</text></paragraph></subsection> 
<subsection id="H8039AB0B8EE84B0490EB69D0B137680A"><enum>(c)</enum><header>Certified copies</header><text>If a covered document is retained pursuant to subsection (b), the Secretary shall provide the individual with a written explanation of the applicable exception and a certified copy of the document, unless prohibited by law.</text></subsection> <subsection id="HB7A52EE6E12B4E779488CF4154504D94"><enum>(d)</enum><header>Covered document</header><text>For purposes of this section, the term <term>covered document</term> includes an original passport, permanent resident card, employment authorization document, birth certificate, driver’s license, social security card, and any other similar government-issued document.</text></subsection> 
<subsection id="HE8B74587963A4D66B70C0F9FD0C7C2B3"><enum>(e)</enum><header>No operational exception</header><text>Operational convenience or an anticipated future immigration enforcement action does not constitute grounds to retain a document after releasing an individual from custody under this Act.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HE9AE7C47AE1D42E6983B5C8C0F201B75"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents of the Immigration and Nationality Act is amended by inserting after the item related to section 236A the following:</text>
