R. 7699</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20260225">February 25, 2026</action-date><action-desc><sponsor name-id="J000301">Mr. Johnson of South Dakota</sponsor> (for himself and <cosponsor name-id="B001298">Mr. Bacon</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committee on <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To ensure that Federal laws that enable Federal, State, and local law enforcement agencies to access firearms apply equally to Tribal law enforcement agencies.</official-title></form><legis-body id="H03E344C6795747D4A511CB40025CDBBD" style="OLC"><section id="H82AF0F16A3274B9494F2D51CC033F6AD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tribal Police Department Parity Act</short-title></quote>.</text></section><section id="HB7F9D02426C747D9BA35D09CB5A58C79"><enum>2.</enum><header>Tribal law enforcement access to firearms</header><subsection id="HB6D7DA404C0B4DF2A6C1B3A5EFBD6564"><enum>(a)</enum><header>Amendments to title <enum-in-header>18</enum-in-header>, United States Code</header><paragraph id="H8C573EF15F9C4B88A3C66A8C78BA777C"><enum>(1)</enum><header>Transfer and possession of post-1986 machineguns</header><text display-inline="yes-display-inline">Section 922(o)(2)(A) of title 18, United States Code, is amended—</text><subparagraph id="HB877D76A04B746C69090A724C6CA4DA5"><enum>(A)</enum><text>by striking <quote>or a State, or</quote> and inserting <quote>, a State or</quote>; and</text></subparagraph><subparagraph id="H27A02AFF4D764212BE71FB2FFEA45523"><enum>(B)</enum><text>by inserting before <quote>; or</quote> the following: <quote>, or an Indian Tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)) or any department or agency thereof</quote>.</text></subparagraph></paragraph><paragraph id="H488B2E8D12174A108BA289F229EFD149"><enum>(2)</enum><header>Transportation, shipment, receipt, possession, and importation of firearms and ammunition</header><text>Section 925(a)(1) of such title is amended—</text><subparagraph id="HE1BD42B9A1EA4D75B0D29338AB2A1C2B"><enum>(A)</enum><text>by striking <quote>or any State</quote> and inserting <quote>, any State</quote>; and</text></subparagraph><subparagraph id="HDBD24ECB076D4A0AA06E7E6E24C1DB81"><enum>(B)</enum><text>by inserting before the period at the end the following: <quote>, or any Indian Tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)) or any department or agency thereof</quote>.</text></subparagraph></paragraph></subsection><subsection id="HD2AFF2337A4B4532B61F0CF8FF064CE8"><enum>(b)</enum><header>Amendments to Internal Revenue Code of <enum-in-header>1986</enum-in-header></header><paragraph id="H8115F158617845DB9115192E6DE353AD"><enum>(1)</enum><header>Transfer tax exemption</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/5853">Section 5853(a)</external-xref> of the Internal Revenue Code of 1986 is amended by inserting <quote>, Indian Tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>))</quote> after <quote>any State</quote>.</text></paragraph><paragraph id="HB61FB02A416D442492C359E5C2DD2206"><enum>(2)</enum><header>Making tax exemption</header><text>Section 5853(b) of such Code is amended by inserting <quote>, Indian Tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>))</quote> after <quote>any State</quote>.</text></paragraph><paragraph id="HA83AB740B8BC4B24A9A82358E1B99999"><enum>(3)</enum><header>Effective date</header><text>The amendments made by this subsection shall apply to any firearm transferred or made after the date of enactment of this Act.</text></paragraph></subsection></section></legis-body></bill>
