Prohibition and notification on investments relating to covered national security transactions.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H81C5E24820E8433184B8F451D5044B3E"><enum>3.</enum><header>Priorities and allocations</header><text display-inline="no-display-inline">Title I of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4511">50 U.S.C. 4511 et seq.</external-xref>) is amended—</text><paragraph id="H2877A18918484666BA962820816C29C7"><enum>(1)</enum><text>in section 101—</text><subparagraph id="H4E3652E66A7546B99AB77E1A3BAF5C48"><enum>(A)</enum><text>by striking <quote>he</quote> each place such term appears and inserting <quote>the President</quote>; </text></subparagraph><subparagraph id="H13BD1010DFD544819494E90C1D21C811"><enum>(B)</enum><text>in subsection (a), by striking <quote>or appropriate</quote> each place such term appears;</text></subparagraph><subparagraph id="H198A0AADADD64807B5F6DCBFCD5F215B"><enum>(C)</enum><text>in subsection (b)—</text><clause id="H0E79D5D0FFFC417DAF1F2F385A522BD8"><enum>(i)</enum><text>by striking <quote>The powers</quote> and inserting <quote>(1) The powers</quote></text></clause><clause id="HD6CDA3682B9247A68E9024DDEAF94605"><enum>(ii)</enum><text>by striking <quote>unless the President finds (1) that such</quote> and inserting the following:</text><quoted-block style="OLC" id="H6423D6EC04BF443B9D971A28F0967683" display-inline="yes-display-inline" changed="added" reported-display-style="italic" committee-id="HBA00"><text>unless—</text><subparagraph id="H8843FE2E65594EDF953AFC589C789E5A" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">the President finds that—</text><clause id="HFF2A49E2FDD141838FAB36DFD9B1649E"><enum>(i)</enum><text>such</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="H38497973D4CF469E87599E9733C6793E"><enum>(iii)</enum><text>by striking <quote>defense, and (2) that</quote> and inserting the following:</text><quoted-block style="OLC" id="H0E514E7395D1441FB6D442E47F7E19FE" display-inline="yes-display-inline" changed="added" reported-display-style="italic" committee-id="HBA00"><text>defense; and</text><clause id="H2254307825EA47A1B0E817B7C763CDEC" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">that</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="HC6853F2093FA4295AD2E6BA4B84B7F28"><enum>(iv)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause id="H019934AD378647F1877FBD3BE20D2D6F"><enum>(v)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HF4A52A02844548368B413B941B0DCB38" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HBA00"><subparagraph id="HF9DFB8D28D7742A6A9F10231D5766266" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">the powers are used to address—</text><clause id="H85366EC966E148AEA3B7CB5C7B56DE1D"><enum>(i)</enum><text display-inline="yes-display-inline">a national emergency declared by the President;</text></clause><clause id="H40C79CF038104F6595A1EB00F55ADB5D"><enum>(ii)</enum><text>a natural disaster declared by the President pursuant to the Robert T. Stafford Disaster Relief and Emergency Assistance Act; or</text></clause><clause id="HE8EC3D9E9836452A91CEACB687CF3708"><enum>(iii)</enum><text>a public health emergency, as determined by the Secretary of Health and Human Services pursuant to section 319 of the Public Health Service Act.</text></clause></subparagraph><paragraph id="H3CE6B6A6D0A647FE97B4285E6EF1B4CE" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The powers described in this section may not be used to control the general distribution of any material in the civilian market for a period exceeding 1 year, except that the President may extend such 1-year period for up to 180 days upon reporting to Congress, on a non-delegable basis, that the extension is essential to meet national defense requirements.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H992F3331ABF04CFD8E006E2ADC7F192E"><enum>(D)</enum><text>in subsection (c)—</text><clause id="H8653660CC7AD4777AE18B82E1BE68BEA"><enum>(i)</enum><text>in paragraph (1), by striking <quote>Notwithstanding any other provision of this Act, the</quote> and inserting <quote>The</quote>; and</text></clause><clause id="H7530698B681A4E55B831983D3CFBB634"><enum>(ii)</enum><text>in paragraph (3), by striking <quote>President</quote> and inserting <quote>Executive Director of the Defense Production Act Committee</quote>; and</text></clause></subparagraph><subparagraph id="HDBDC39FD239548FA9128A7A22C1A0A94"><enum>(E)</enum><text>in subsection (d)—</text><clause id="H43904A85E2BF425CAC2D448178915A2F"><enum>(i)</enum><text display-inline="yes-display-inline">strike <quote>section shall</quote> and all that follows through <quote>issue, and annually review and update whenever appropriate,</quote> and insert the following:</text><quoted-block style="OLC" id="H788E8FF7AE63413B8FCFBB404A2950C0" display-inline="yes-display-inline" changed="added" reported-display-style="italic" committee-id="HBA00"><text>section, in consultation with the Defense Production Act Committee—</text><paragraph id="H7F4AB68386964ADAACF9949D32ED2996"><enum>(1)</enum><text display-inline="yes-display-inline">shall—</text><subparagraph id="HFBFF2A1E9E444383866100109CC76709"><enum>(A)</enum><text>issue and, whenever appropriate, revise</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="HCE4CABB83EA94551B9378D092EC381AA"><enum>(ii)</enum><text>by redesignating paragraph (2) as subparagraph (B), and adjusting the margin of such subparagraph accordingly;</text></clause><clause id="H42DA098237FC46D1A16290A7C4A4901A"><enum>(iii)</enum><text>in subparagraph (B), as so redesignated, by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause id="HB49FB574C72A46DD9199176501E63D0B"><enum>(iv)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HD6A87CB7D8AC47F1B5EDC68A5FE02CC0" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HBA00"><paragraph id="H50A628BB5E334793B6586D42391CF8AC"><enum>(2)</enum><text display-inline="yes-display-inline">may waive or revise relevant regulations for the purpose of expediting the procurement of critical technologies (as defined under section 316(a)) or critical minerals subject to the priorities and allocations.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="HFA4B85BFB3694BF2938EB54AF8E8AC32"><enum>(2)</enum><text display-inline="yes-display-inline">in section 102—</text><subparagraph id="H883ADA660E654E06AB5FC6A9AAA20557"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>he</quote> each place such term appears and inserting <quote>the President</quote>; and</text></subparagraph><subparagraph id="HF2966ACAC01344ECA5301BE9E897CA6C"><enum>(B)</enum><text>by striking <quote>sections 101 and 704 of this Act</quote> and inserting <quote>sections 101 and 304</quote>;</text></subparagraph></paragraph><paragraph id="HE4D5CCD2CF5047FAA83594523496649D"><enum>(3)</enum><text>in section 103, by striking <quote>$10,000</quote> and inserting <quote>$100,000</quote>; </text></paragraph><paragraph id="H5E49B74A1D3D44719E4732654F6B79D8" commented="no"><enum>(4)</enum><text>by redesignating section 107 as section 204 and transferring such section so as to appear after section 303; and</text></paragraph><paragraph id="H9A32CA0C7F55440F9903F8068B8AA4EE" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">by redesignating section 108 as section 207 and transferring such section so as to appear after section 305.</text></paragraph></section><section id="HE07641C2A8744D7AA5DE722F3EEC07EC"><enum>4.</enum><header>Expansion of productive capacity and supply</header><text display-inline="no-display-inline">The Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4501">50 U.S.C. 4501 et seq.</external-xref>) is amended—</text><paragraph id="HED7085B8459C41AA99C0ADC5CF948EBA"><enum>(1)</enum><text>by redesignating title III as title II;</text></paragraph><paragraph id="H38B0E8F3666B4BD2BBE66AAEC1D5E948"><enum>(2)</enum><text>by redesignating sections 301, 302, 303, 304, and 305 as sections 201, 202, 203, 205, and 206, respectively;</text></paragraph><paragraph id="H595E1A67EE5F4930BAD49DEC450256AA"><enum>(3)</enum><text>in section 201, as so redesignated—</text><subparagraph id="H6E06E2B753C8403CB6B377DFEF565041"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text level="section" style="OLC">PRESIDENTIAL AUTHORIZATION FOR THE NATIONAL DEFENSE</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Loan guarantees</header-in-text></quote>;</text></subparagraph><subparagraph id="H1ADC28FB5E644851B527E6CB9BD0DE0F"><enum>(B)</enum><text>in subsection (a)—</text><clause id="HF62C265DB47B48548C653C82C3B2D8FF"><enum>(i)</enum><text>in paragraph (1), by inserting <quote>, with the concurrence of the Fund manager of the Defense Production Act Fund,</quote> before <quote>to provide</quote>; and</text></subparagraph><subparagraph id="H0C2E7A8563C3458B81070DC644AAB026"><enum>(C)</enum><text>be deemed perfected upon attachment; and</text></subparagraph></paragraph><paragraph id="HC2C691ED7D584A0DB46A797C5DBC2F15"><enum>(4)</enum><text>in the event that the loan recipient defaults on the repayment of the loan, any portion of such repayment that is not satisfied from the collateral described in paragraph (3) shall have priority in payment over all other unsecured claims.</text></paragraph><after-quoted-block>; and</text></item></subclause><subclause id="H4FB4AF29A70142B992FAA986E6F93F68"><enum>(III)</enum><text>by striking subparagraph (C); and</text></subclause></clause><clause id="HE14E2158E312474C85972BDEFD4D9631"><enum>(iv)</enum><text>by striking paragraph (7) and inserting the following:</text><quoted-block style="OLC" id="H145E1AA5893649AE885E855B55E6DD99" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HBA00"><paragraph id="H7AF03165D7734F6F8AD701565C5D5F71"><enum>(7)</enum><header>Limitations on equity investments</header><text display-inline="yes-display-inline">The equity shares of an entity may not be acquired under this section if such acquisition would result in the Government holding, in the aggregate, 15 percent or more of the equity shares of the entity.</text></paragraph><paragraph id="H03591A671B884657A4B94BC4128CC9ED"><enum>(8)</enum><header>Report on equity investments</header><text display-inline="yes-display-inline">The Defense Production Act Committee shall include, in each annual report of the Committee required under section 317(d)—</text><subparagraph id="H96AFD049B48942FC819C678015DB2F36"><enum>(A)</enum><text display-inline="yes-display-inline">a description of any equity held by the Government pursuant to the authorities of this Act;</text></subparagraph><subparagraph id="HDBD90D511A1B45149A3792375C0D9F37"><enum>(B)</enum><text>the rationale for, and valuation of, any such holding, including—</text><clause id="HCBEDCAFC8F2C4637B32212C752752CF1"><enum>(i)</enum><text>the expected contribution of the holding to the objectives of this Act; and</text></clause><clause id="HA9CE9038B93645FB9B5FB5BE59183100"><enum>(ii)</enum><text>the estimated gain or loss in value of the holding since the preceding report.</text></clause></subparagraph></paragraph><paragraph id="H0C3F804010D04B779978C647496221CA"><enum>(9)</enum><header>Acquisition and liquidation</header><text display-inline="yes-display-inline">A member of the Defense Production Act Committee described under section 317(b)(1)(A)—</text><subparagraph id="H4B9F82696BD749E4A5420FEB5F6D6C43" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">may make an equity investment in an entity under this section only after the Fund manager of the Defense Production Act Fund reports to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives that the entity is unable to obtain additional equity investment from private sources on commercially reasonable terms;</text></subparagraph><subparagraph id="HBA7A55F39CDF4E249598F8D392616D4F"><enum>(B)</enum><text display-inline="yes-display-inline">shall, with respect to each equity investment made in an entity by the member under this section, transmit to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives—</text><clause id="HD91008B5222842C6BAC32DF7224A8EAB"><enum>(i)</enum><text display-inline="yes-display-inline">not later than 10 days after making the equity investment, copies of all relevant documents concerning the terms of the investment, including any governance rights or contractual obligations; and</text></clause><clause id="HCBB6296EF93C4017B567FBC2ECC63153"><enum>(ii)</enum><text>a certification that the equity investment advances the objectives of this Act, with a detailed explanation of the reasons therefor; and</text></clause></subparagraph><subparagraph id="H710DFF4A443B476A8D702967012FBCFC"><enum>(C)</enum><text>shall seek to sell and liquidate any equity support for an entity provided under this section as soon as commercially feasible, commensurate with other similar investors in the entity, taking into consideration the national security interests of the United States.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H256E09641CBF4B98B317F5663D33C50E"><enum>(C)</enum><text>by redesignating subsections (b) through (g) as subsections (c) through (h), respectively;</text></subparagraph><subparagraph id="HDEFCC1CEFC7F486B97FFBCE8B30C4500"><enum>(D)</enum><text>by inserting after subsection (a) the following:</text><quoted-block style="OLC" id="H7B192E59E9BE4CC596D7B2C60628B3CC" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HBA00"><subsection id="HBE6FAD7D0A9340879FF5D430202766A2"><enum>(b)</enum><header>Critical minerals resilience</header><paragraph id="H90A4269B855A4DA3829F026A8DE0720C"><enum>(1)</enum><header>Critical Minerals Resilience Initiative</header><text display-inline="yes-display-inline">There is established the Critical Minerals Resilience Initiative, under which a member of the Defense Production Act Committee described under section 317(b)(1)(A), in consultation with the Executive Director of the Defense Production Act Committee and the Fund manager of the Defense Production Act Fund, may make grants, purchases, and commitments to purchase involving an entity in the United States, a member country of the North Atlantic Treaty Organization, or a major non-NATO ally, to—</text><subparagraph id="H86D0845D835F4270953F8A8CFB1C5532"><enum>(A)</enum><text display-inline="yes-display-inline">ensure that the mining or processing of critical and strategic materials is not dominated by a foreign adversary; and</text></subparagraph><subparagraph id="H84281521B517420BBE19A27BC61783A2"><enum>(B)</enum><text>provide for offtake agreements, price floors, or incentives in order to ensure the viability of mines or processing facilities for critical and strategic materials outside the control of a foreign adversary.</text></subparagraph></paragraph><paragraph id="H84C0ED9F887143FBAF175ED9F2584D90"><enum>(2)</enum><header>Cooperation among entities</header><text display-inline="yes-display-inline">To the extent practicable, the Defense Production Act Committee shall develop a process to encourage cooperation among, and manage potential conflicts between—</text><subparagraph id="HA0B5DA792E7D4A2C85C62CEB71A8918B"><enum>(A)</enum><text>entities that are domestic sources, and the countries where they are located; and</text></subparagraph><subparagraph id="H264616E75D504386BE4A4AE191F6BA14"><enum>(B)</enum><text>for the purpose of carrying out the Critical Minerals Resilience Initiative, countries involved in the Initiative.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H28ECBE4D37674C808FD54A36AF2F9C41"><enum>(E)</enum><text>in subsection (c), as so redesignated, by striking <quote>not more than 10 years</quote> and inserting <quote>more than 10 years</quote></text></subparagraph><subparagraph id="H253C354CF1F64A25B3F1D7A2D34856C7"><enum>(F)</enum><text>in subsection (d), as so redesignated—</text><clause id="HF51E434775EE4EA58239E4065AAAE3D7"><enum>(i)</enum><text>in paragraph (1)(A), by striking <quote>necessary to carry out the objectives of this title</quote> and inserting <quote>essential for national defense requirements</quote>;</text></clause><clause id="HC706976A23C043A0AE1205208C15B0C4"><enum>(ii)</enum><text>in paragraph (2)—</text><subclause id="HB4F1F2EA29F6452DBEF16934CC07E1EB"><enum>(I)</enum><text>by striking <quote>President may make provision for subsidy payments</quote> and inserting <quote>President, in consultation with the Executive Director of the Defense Production Act Committee and the Fund manager of the Defense Production Act Fund, may make provision for subsidy payments, for a period not to exceed 1 year,</quote>; and</text></subclause><subclause id="H08A3E51D897B4097AC8EED7EE285E84C"><enum>(II)</enum><text>by striking <quote>President determines</quote> and inserting <quote>Fund manager determines</quote>; and</text></subclause></clause><clause id="HA4596A859D664185A2C3779A36D45B1B"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H16F4AA32F9D54F3C9AB9D65E53C8325E" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HBA00"><paragraph id="H50866A504B224F86B265E865EE634207"><enum>(3)</enum><header>Renewal of subsidy</header><text display-inline="yes-display-inline">The President may renew subsidy payments authorized under paragraph (2) for up to 180 days after submitting a report to the Committee on Financial Services of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate that—</text><subparagraph id="H218ED63BF5504307B0365BDB1039E2B5"><enum>(A)</enum><text>certifies that the subsidy payment is the most efficient means to ensure objectives described under paragraph (2); and</text></subparagraph><subparagraph id="HD7B1AE55C6D64DFC80818A12AC3A2FA5"><enum>(B)</enum><text>explains why market conditions do not allow for the achievement of the objectives.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H4E382C1A74B34FE390487619F576CE9C"><enum>(G)</enum><text>in paragraph (1)(C) of subsection (f), as so redesignated, by striking <quote>section 301, 302</quote> and inserting <quote>section 201, 202</quote>; </text></subparagraph><subparagraph id="H2B2C3FC690B5450FA9F8992C2CE6F98E"><enum>(H)</enum><text>in subsection (h), as so redesignated, by striking <quote>make provision</quote> and inserting <quote>exercise the authorities under title I and this title</quote>; and</text></subparagraph><subparagraph id="H19C6BF8F194B4F11A4789EE1D9565097"><enum>(I)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HA1DFD373825F4BCB9CB58954B027D905" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HBA00"><subsection id="HDCF2A77B596046A0B56DA8D490DFBB1D"><enum>(i)</enum><header>Waiver to expedite procurement</header><text display-inline="yes-display-inline">In exercising the authorities under section 201, section 202, or this section, the President may waive or revise relevant regulations for the purpose of expediting—</text><paragraph id="H6003108039C749869485EA825F05C98C"><enum>(1)</enum><text display-inline="yes-display-inline">the procurement of critical technologies (as defined under section 316(a)) or critical minerals; or</text></paragraph><paragraph id="HFE88FBFD72E8404A991AB6C83D24AE90"><enum>(2)</enum><text display-inline="yes-display-inline">the permitting of critical infrastructure required to produce or refine the critical technologies or critical minerals described in paragraph (1).</text></paragraph></subsection><subsection id="H4E569DDCEDAB45FB9DD0AFBD97B9DF83"><enum>(j)</enum><header>Additional requirements</header><paragraph id="H8BDFE796748343FA884FC4B5A1D6C600"><enum>(1)</enum><header>Use of commercially available software</header><text display-inline="yes-display-inline">Software procured using funds appropriated pursuant to this Act shall be commercially available off-the-shelf software, unless no commercially available off-the-shelf software that meets the applicable requirements is available, more cost-effective, or is practicable to procure.</text></paragraph><paragraph id="HF96DFCFDA2AA47D19E851F119A2E483D"><enum>(2)</enum><header>Use of funds for skilled labor</header><subparagraph id="H2701328DBB18459B9146B0A70F101955"><enum>(A)</enum><header>Identification of workforce and skills gaps</header><text display-inline="yes-display-inline">Each Federal agency to which the President has delegated authority under this Act shall identify any workforce gaps or skills gaps that affect the ability of the domestic industrial base to supply the materials and services necessary to satisfy the objectives set forth in section 2(b).</text></subparagraph><subparagraph id="H45B98E986F704C0481EE1C3B3FDD8CAD"><enum>(B)</enum><header>Use of funds</header><text>With respect to an entity receiving financial assistance under title I or this title, the agency making such financial assistance may direct that a portion of the financial assistance be used to recruit, train, place, or retain workers in defense-critical occupations directly related to the activities funded by the assistance, if such entity keeps records of performance standards for workers recruited, trained, placed, or retained using such assistance.</text></subparagraph><subparagraph id="H7A7A8B4E465544D38EB33EB153C704FA"><enum>(C)</enum><header>Information included in annual report</header><text display-inline="yes-display-inline">Each Federal agency to which the President has delegated authority under this Act shall include in the annual report of the Defense Production Act Committee—</text><clause id="HF8CCF2D360C14C5D80486F5364791FA2"><enum>(i)</enum><text>a discussion of the identification required under subparagraph (A) and the authority provided under subparagraph (B); and</text></clause><clause id="HEF175A97090E4E1D967A50489348D64E"><enum>(ii)</enum><text>short-term and long-term recommendations for administrative or legislative action to reduce any workforce gaps or skills gaps identified by the agency, especially through the simulation required under section 206(c), including recommendations on workforce training programs to recruit, train, place, and retain workers in occupations critical to the national defense, including any apprenticeships.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H9504A1C4CE87448D801BE642E81E9830"><enum>(6)</enum><text display-inline="yes-display-inline">in section 204, as redesignated and moved by section 3(4)—</text><subparagraph id="H99A6B4F5FB57404CB554B6A36891991A"><enum>(A)</enum><text>in subsection (a)—</text><clause id="HC7CC972EF2E74A4EAD4F50E73277BE4A"><enum>(i)</enum><text>by striking <quote>title III of this Act or any other provision of law, the President may</quote> and inserting <quote>this title, a member of the Defense Production Act Committee may, in consultation with the Executive Director of the Defense Production Act Committee,</quote>; and</text></clause><clause id="H8320E8A193A148ADBD3F93DA7CF4E171"><enum>(ii)</enum><text>by inserting <quote>essential</quote> before <quote>materials</quote>;</text></clause></subparagraph><subparagraph id="H75E815AFCA21456C8E6B18E5250F891E"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (b)(1), by striking <quote>assure</quote> and inserting <quote>ensure</quote>; and</text></subparagraph><subparagraph id="H2F19368058D24CC3A4189BE191357C6E"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HCB67E6B6639F47DA9B4356E6EF0C34D3" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HBA00"><subsection id="H9EF9B6F306644E75A7A1633456213423"><enum>(c)</enum><header>Waiver to expedite procurement</header><text>The President may waive or revise relevant regulations for the purpose of expediting—</text><paragraph id="HDD24FE753BC745CD83D407CBC967B03B" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the procurement of critical technologies (as defined under section 316(a)) or critical minerals subject to the incentives described in subsection (a); and</text></paragraph><paragraph id="HA936A334A25D4ECCAA7CEBC36A582B3E"><enum>(6)</enum><text>issuing rules and guidance regarding financing activities authorized by this title.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HAB58700324414C0EA03D51BE48CD4C9B"><enum>(H)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HFBF34F6998F4460FAE80EE91DBBF5905" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HBA00"><subsection id="HEE39397C3AAE4CB2984AB51ED9CC8C40" commented="no"><enum>(i)</enum><header>Deferral</header><text display-inline="yes-display-inline">The Executive Director of the Defense Production Act Committee shall defer budget authority involving the Fund for an agency that has repeatedly failed to submit complete reports described under section 206(a).</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HCD15E734482C47BC9C8DD5038E288EC2"><enum>(8)</enum><text>section 206, as so redesignated—</text><subparagraph id="H0A87CBAC60394D0DBE957A9A52A49463"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text level="section" style="OLC">REPORTS ON EXERCISE OF AUTHORITIES</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">DPA strategy</header-in-text></quote>;</text></subparagraph><subparagraph id="HAFD732702D9B44F586D451713CA9616C"><enum>(B)</enum><text>by redesignating subsection (c) as subsection (e);</text></subparagraph><subparagraph id="H67078F01A72C4BEE90FC7AE83BC9A7E2"><enum>(C)</enum><text>by striking subsections (a) and (b) and inserting the following:</text><quoted-block style="OLC" id="H6E25562BBB0F49F69C549C3CF42ACD2D" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HBA00"><subsection id="HFB2CB04A378B408D8D6C01292039EB97"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the effective date of this subsection, and annually thereafter, the head of each agency to which the President has delegated authorities under title I or this title shall submit the report described under subsection (b) to the Executive Director of the Defense Production Act Committee and the Fund manager of the Defense Production Act Fund.</text></subsection><subsection id="H6FF2F4E9477E40FDA151E60D6C630074"><enum>(b)</enum><header>DPA strategy</header><text>A report described under this subsection is a report that includes—</text><paragraph id="H47AAABEAF5F740A6A3386E9CE1606BDE"><enum>(1)</enum><text display-inline="yes-display-inline">an assessment, in consultation with the Defense Production Act Committee and the private sector, of industrial base needs required by the head of the agency to meet the highest priorities arising from national defense requirements, as determined by the President;</text></paragraph><paragraph id="H4DE6500354BA4F238EA7FC48B859A1C9"><enum>(2)</enum><text>a detailed strategy, timeline, and spending plan, in consultation with the Defense Production Act Committee, to deploy the authorities under title I and this title to address the needs identified under paragraph (1);</text></paragraph><paragraph id="H8AA20D387DEC4115855BB7830DDAE3BB"><enum>(3)</enum><text>the results of the most recent simulation described in subsection (c);</text></paragraph><paragraph id="H5329F76F46E54587ADE4E833936D9896"><enum>(4)</enum><text>a comprehensive list of actions (including all priority ratings, the exercise or non-exercise of such ratings and any allocations or financing) taken by the agency pursuant to the authorities since the previous report, and an explanation of how the actions support the strategy described under paragraph (2);</text></paragraph><paragraph id="H104F9CB3913849778E9C4A5D4609F6C1"><enum>(5)</enum><text>any use of authorities under section 308 or section 310 in support of the strategy described under paragraph (2);</text></paragraph><paragraph id="H8823275E9FE4484081DD8131C78D0425"><enum>(6)</enum><text>a description of any waivers exercised pursuant to section 101(d)(2), section 107(c), or section 203(h); and</text></paragraph><paragraph id="H78400EB91D3E48A9A1BAABF30CCBD8B6"><enum>(7)</enum><text>in the case of an action taken pursuant to title I or this title involving a business concern in Canada, the United Kingdom, or Australia, a justification of the necessity of the use of authorities under the applicable title.</text></paragraph></subsection><subsection id="HD196A594ECCF44C2A194DABD6D733984"><enum>(c)</enum><header>Strategy simulation</header><text display-inline="yes-display-inline">At least once every 5 years, the Defense Production Act Committee shall conduct a discussion-based simulation (commonly known as a <quote>table-top exercise</quote>) to determine the resources needed and the best use of the authorities under title I and this title to implement the strategy described in subsection (b)(2) contained in the most recent report required under subsection (a).</text></subsection><subsection id="H3ED33D585E144B2086798012953974E0"><enum>(d)</enum><header>Strategy on securing supply chains essential to national defense</header><text display-inline="yes-display-inline">The head of any relevant agency, as determined by the President, shall, in the first report submitted under subsection (a) after the date of enactment of this subsection, include in such report the following:</text><paragraph id="H83FC852EB96B42798C0AC45B0C7C9BC4"><enum>(1)</enum><text display-inline="yes-display-inline">A detailed plan to ensure the supply of the following, to the extent necessary for national defense:</text><subparagraph id="H8A10DEACEA2B4EC989CB924580A5BCBC"><enum>(A)</enum><text>Medical materials (including drugs, devices, and biological products (as that term is defined in section 351 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262</external-xref>)) to diagnose, cure, mitigate, treat, or prevent disease).</text></subparagraph><subparagraph id="H1100D0136671431AB104D7D8E948F0DD"><enum>(B)</enum><text display-inline="yes-display-inline">Critical minerals.</text></subparagraph><subparagraph id="H638C9C9BFF8846DDBF101267BC02611D"><enum>(C)</enum><text>Naval shipbuilding capacity, materials, and components.</text></subparagraph></paragraph><paragraph id="HC640D95BCB0744959C37FBC8F896F8C0"><enum>(2)</enum><text>An analysis of vulnerabilities to existing supply chains for the materials, minerals, and capacity described in paragraph (1).</text></paragraph><paragraph id="H9A59990CB5254D40B6F80507F1EE2A98"><enum>(3)</enum><text display-inline="yes-display-inline">Any authorities provided by this Act to be used by the agency to ensure that essential components of such supply chains are not under the control of a foreign adversary.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H2FD277240B5B4EDE81CC6C1046A5133A"><enum>(D)</enum><text>in paragraph (2) of subsection (e), as so redesignated, by striking <quote>section 702(7)(B)(ii)(II)(bb)</quote> and inserting <quote>section 302(7)(B)(ii)(II)(bb)</quote>; and</text></subparagraph></paragraph><paragraph id="HB99BC7C31DA34EBD8B43DA0C63BD85CC"><enum>(9)</enum><text>in section 207, as redesignated and moved by section 3(5)—</text><subparagraph id="H6CD9679C4079417C9BF87D6A4F01F8FB"><enum>(A)</enum><text>in subsection (a), by inserting <quote>, to the extent required for national defense purposes,</quote> after <quote>President shall</quote>; and</text></subparagraph><subparagraph id="H4A568301ED6443F081576EBBB0977A7C"><enum>(B)</enum><text>in subsection (b)—</text><clause id="H5C9D3F2961E5450F98BA0F5F3629C06F"><enum>(i)</enum><text>in paragraph (1)—</text><subclause id="HE33C3456C1574DCFA66254D1D89C2852"><enum>(I)</enum><text>by striking <quote>title III</quote> and inserting <quote>this title</quote>; and</text></subclause></clause></subparagraph></paragraph><paragraph id="H45A8BE204B564992A42902A01154BB08"><enum>(10)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H92229D11A0774A6CAC135EAF117286C9" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HBA00"><section id="H628C4B76C95C4BE992D51742703CF451"><enum>208.</enum><header>Prohibition on discrimination based on energy source</header><text display-inline="no-display-inline">In using the authorities under this title, the President may not deny financial support pursuant to sections 201, 202, 203, or 204, other than for the production of energy, based on the energy source involved in the exploration, development, production, utilization, transportation, or sale of energy.</text></section><section id="H38D88F864C6540C5BBF942CA5C2149D4"><enum>209.</enum><header>Limitation on eligibility for assistance</header><subsection id="H0A5D0A157FFF4E0098B78D75E18E8406"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act or any other Act, a covered entity is not eligible for assistance authorized under this title.</text></subsection><subsection id="HF3A182EB647A4F839CE33F70C5C616BE"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HFD349093096541758E15841FBC6EE25D"><enum>(1)</enum><header>Covered entity</header><text>The term <quote>covered entity</quote> means an entity in which a covered individual directly or indirectly holds a significant interest. For the purpose of determining whether an entity is a covered entity, if securities of the entity are owned, controlled, or held by 2 or more individuals who are related as described in paragraph (2), such securities shall be aggregated.</text></paragraph><paragraph id="HD494DDEF71344C90B653C6B48E54B473"><enum>(2)</enum><header>Covered individual</header><text>The term <quote>covered individual</quote> means—</text><subparagraph id="HB4EDEC06FE1F4EB2A10E558B72B375A8"><enum>(A)</enum><text>the President, the Vice President, or a member of the Defense Production Act Committee; and</text></subparagraph><subparagraph id="HE69BF0327D1349C6878F3F89981B1F93"><enum>(B)</enum><text>the spouse, child, son-in-law, or daughter-in-law of an individual described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="HAF308FE6459A4189868B7E81B8E711C5"><enum>(3)</enum><header>Equity interest</header><text>The term <quote>equity interest</quote> means—</text><subparagraph id="HF0E110483E8B4EC3A9E0EB9393B18C27"><enum>(A)</enum><text>a share in an entity, without regard to whether the share is—</text><clause id="H1D3B8790C06C457A8FD493F795533E2A"><enum>(i)</enum><text>transferable; or</text></clause><clause id="H67F1132546A74D349582E8D3583A41F7"><enum>(ii)</enum><text>classified as stock or anything similar;</text></clause></subparagraph><subparagraph id="H35F0CF633BA84FF194BD43B4B2EF4A6A"><enum>(B)</enum><text>a capital or profit interest in a limited liability company or partnership; and</text></subparagraph><subparagraph id="HE5E9A9057C2946FC8F531D0528583D89"><enum>(C)</enum><text>a warrant or right (other than a right to convert) to purchase, sell, or subscribe to a share or interest described in subparagraph (A) or (B), respectively.</text></subparagraph></paragraph><paragraph id="HE1C49661FEA34CA589BAD7809658D9B3"><enum>(4)</enum><header>Significant interest</header><text display-inline="yes-display-inline">The term <quote>significant interest</quote> means owning, controlling, or holding not less than 20 percent, by vote or value, of the outstanding amount of any class of equity interest in an entity.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H6DE60D8024824D3CAF777FF3113F5700"><enum>5.</enum><header>General provisions</header><text display-inline="no-display-inline">The Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4501">50 U.S.C. 4501 et seq.</external-xref>) is amended—</text><paragraph id="HBDD4A1585AD640DC9F7213A8993DEB68"><enum>(1)</enum><text>by redesignating title VII as title III;</text></paragraph><paragraph id="HD87473F08A6A450C8EAC7527154153A3"><enum>(2)</enum><text>by striking section 714 and 723;</text></paragraph><paragraph id="H41B69B45809B4A4583B4A42C91B80AA6"><enum>(3)</enum><text>by redesignating sections 701 through 711 as sections 301 through 311, respectively;</text></paragraph><paragraph id="H3E8AA09AC3DD4C8799BCF5BA3A5A83EC"><enum>(4)</enum><text>by redesignating section 713 as section 312;</text></paragraph><paragraph id="HF94A9A8768734D59B98C12E8E41EEB24"><enum>(5)</enum><text>by redesignating section 715 as section 313;</text></paragraph><paragraph id="H758F10166DCF4285B3E2B82BBA96D992"><enum>(6)</enum><text>by redesignating section 717 as section 315;</text></paragraph><paragraph id="HC6051D8027D94ACB8C9DE650CA9370A0"><enum>(7)</enum><text>by redesignating sections 721 and 722 as sections 316 and 317, respectively;</text></paragraph><paragraph id="HFE15D80960BA4957BE34B390B64096B4"><enum>(8)</enum><text>in section 301, as so redesignated, in subsection (e), by inserting <quote>and consistent with national defense requirements</quote> after <quote>practicable</quote>;</text></paragraph><paragraph id="H4D68D7802FDE47BEAE69CD51CCF95EEE"><enum>(9)</enum><text>in section 302, as so redesignated—</text><subparagraph id="HCF6C9E4302C447198C8B3DE608C14811"><enum>(A)</enum><text>in paragraph (7)(B), by striking <quote>title III</quote> each place such term appears in a heading or text, and inserting <quote>title II</quote>; and</text></subparagraph><subparagraph id="H6A5DD28182364AD394342CF1756B6F84"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HEEB09A5D25444BA880774DF624D317C1" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HBA00"><subsection id="H53295AB77D1A4CADBD32BB2CA3655EF7"><enum>(b)</enum><header>Outreach representative during a public health emergency</header><paragraph id="H9DAEEE06B50640659822F6C2FF4F1787"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Consistent with the authorities in this title, the Administrator of the Federal Emergency Management Agency, in consultation with the Secretary of Health and Human Services, may designate or appoint, pursuant to subsection (a), an individual to be known as the <quote>Outreach Representative</quote> for the period of a public health emergency. Such individual shall—</text><subparagraph id="H4C1F02C02F104C6ABA5B97AA6E7FE76B"><enum>(A)</enum><text>be appointed from among individuals with substantial experience in the production or distribution of medical supplies or equipment; and</text></subparagraph><subparagraph id="H54D47567EACA49618CCBAAAA7102D3B1"><enum>(B)</enum><text>act as the Government-wide single point of contact during the public health emergency for outreach to manufacturing companies and their suppliers who may be interested in producing medical supplies or equipment.</text></subparagraph></paragraph><paragraph id="H3E7CC751FCF84EE7855EF4911A4D9CF3"><enum>(2)</enum><header>Encouraging partnerships</header><text>During the period of a public health emergency, the Outreach Representative shall seek to develop partnerships between companies, in coordination with any overall coordinator appointed by the President to oversee the response to the public health emergency, including through the exercise of the authorities delegated by the President under section 308.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H178C401510CF4DDF9013654A0F2BBD23"><enum>(11)</enum><text display-inline="yes-display-inline">in section 304, as so redesignated—</text><subparagraph id="H8A8FBA28D98A4BE78F452E6F0721F3BA"><enum>(A)</enum><text>by striking <quote>(a) <header-in-text level="section" style="OLC">In general</header-in-text>.—</quote>;</text></subparagraph><subparagraph id="H3E58AB1C62564BA48A9B368D555332C1"><enum>(B)</enum><text>by striking <quote>section 709 and subsection (b), the President may prescribe</quote> and inserting <quote>section 309 and subsection (b), the President, not later than 360 days after the date of enactment of the DPA Modernization Act of 2026, shall issue</quote>; and</text></subparagraph><subparagraph id="HC0C5D9AF198F486EA5E350D518ACD656"><enum>(C)</enum><text>by striking subsection (b);</text></subparagraph></paragraph><paragraph id="H490A018366E546C4AFA544199A8F02B0"><enum>(12)</enum><text>in section 305, as so redesignated—</text><subparagraph id="H98FC9AE1F6B048BEA65F82EB8588797D"><enum>(A)</enum><text>in subsection (a)—</text><clause id="HC1567F451B46475A952C3A373FE8D066"><enum>(i)</enum><text>by striking <quote>or appropriate, in his discretion,</quote>; and</text></clause><clause id="H610BBBB944D74C44AEA02E56007619A2"><enum>(ii)</enum><text>by striking <quote>in order</quote> and inserting <quote>essential</quote>;</text></clause></subparagraph><subparagraph id="HACC7C9E946C947D186628FB9391E71D8"><enum>(B)</enum><text>in subsection (c), by striking <quote>$10,000</quote> and inserting <quote>$100,000</quote>;</text></subparagraph><subparagraph id="HFF72A4A1C65C47DCACC7E7D706AE50CC"><enum>(C)</enum><text display-inline="yes-display-inline">in subsection (d), by striking <quote>$10,000</quote> and inserting <quote>$100,000</quote>; and</text></subparagraph><subparagraph id="HEC4CCABC65AB47AE818465ACB3A82582"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HDCE803547F814C6E9792D0371DF333A1" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HBA00"><subsection id="H9038873BFE474862B4A5F7DB60E353A0"><enum>(f)</enum><text display-inline="yes-display-inline">The authority of the President under this section may not be used to obtain sensitive personally identifiable information. and</text></subparagraph><subparagraph id="H33E47B4220EA43E7BA43A2BCC0EF1DAA"><enum>(C)</enum><text>by striking <quote>$117,000,000 for each of fiscal years 2020 through 2024 to carry out title III</quote> and inserting <quote>$5,000,000 for each of fiscal years 2026 through 2031 to the Executive Director of the Defense Production Act Committee and the Fund manager of the Defense Production Act Fund to carry out this Act</quote>;</text></subparagraph></paragraph><paragraph id="H59C3BBB49E844DC08634D2ECB1359ADA"><enum>(18)</enum><text>by inserting after section 313, as so redesignated, the following:</text><quoted-block style="OLC" id="H66B9D18AA9B04D928860E74FE9A68281" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HBA00"><section id="H4C257E000FB0478FAD2C6901206F4EBF"><enum>314.</enum><header>National Defense Executive Reserve</header><subsection id="H1F2C728D7568431F81F80F52530356A6"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The President shall establish a National Defense Executive Reserve (in this section referred to as the <quote>Reserve</quote>).</text></subsection><subsection id="H7E41C82B7E6D42B789981CE8ED95FC3B"><enum>(b)</enum><header>Purpose</header><text>The purpose of the Reserve shall be to improve the preparedness of the Federal Government for national defense emergencies by allowing private persons with unique expertise to volunteer, be trained for, and be temporarily employed in Federal positions within any of the Federal agencies that has established a Reserve unit under subsection (c) that may be necessary during periods of national defense emergency, as determined by the President.</text></subsection><subsection id="H277858C13BE449888568CF4EB89381CE"><enum>(c)</enum><header>Reserve units</header><paragraph id="H8D2811695C754238B0CD4A1C1AE2B492"><enum>(1)</enum><header>In general</header><text>The President shall require the heads of each of the following agencies to establish a unit of the Reserve within the applicable agency:</text><subparagraph id="HA7AE7524432245949B4E7178496D2F56"><enum>(A)</enum><text>The Department of Commerce.</text></subparagraph><subparagraph id="HB115A92A3F0241759474F654D1B1AF6C"><enum>(B)</enum><text>The Department of Defense.</text></subparagraph><subparagraph id="HC5F17B29CE5C40F781BD1D0BAB2579CD"><enum>(C)</enum><text>The Department of Homeland Security.</text></subparagraph><subparagraph id="H126BB9DAC59247B5B6BB69B9F7F2990C"><enum>(D)</enum><text>Such other agencies as the President determines appropriate.</text></subparagraph></paragraph><paragraph id="H03FA0E0BFC5D4B42A6653CD4722A6FFA"><enum>(2)</enum><header>Activities of Reserve units</header><text>Activities of such Reserve units within each agency shall be aligned with the contents of the reports required under—</text><subparagraph id="HE48868F8453544679460E983A298D3D7"><enum>(A)</enum><text display-inline="yes-display-inline">section 203(j)(2)(C), related to workforce and skills gaps;</text></subparagraph><subparagraph id="HA816C60D8C734F778B9E3BA67B6F4659"><enum>(B)</enum><text>section 206(b), related to overall strategy;</text></subparagraph><subparagraph id="HCEA45D3EEFAC4E68B84E3073C4F182F6"><enum>(C)</enum><text display-inline="yes-display-inline">section 206(d), related to the strategy on securing supply chains essential to national defense; and</text></subparagraph><subparagraph id="HD3F9C9CF4961469593EEE37538834570"><enum>(D)</enum><text display-inline="yes-display-inline">section 317(h)(1), the report from the Subcommittee on Emerging Technology.</text></subparagraph></paragraph><paragraph id="HBAE0B9F2EDA544FC9B46D700B35883AF"><enum>(3)</enum><header>Deadline</header><text>The units of the Reserve within the agencies described under subparagraphs (A), (B), and (C) shall be established not later than 180 days after the issuance of the final rules required under subsection (f).</text></paragraph></subsection><subsection id="HC2660A85EE104F8485CE045ECAAD7BAF"><enum>(d)</enum><header>Training</header><text>The President may, without activating the Reserve, allow for periodic training and exercises to prepare the Reserve for duty during an activation.</text></subsection><subsection id="H3044DFA6F5944388B4180A9AAF0A9828"><enum>(e)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than 360 days after the date of enactment of this section, the Director of the Office of Personnel Management, in consultation with the Secretary of Commerce, the Secretary of Defense, and the Secretary of Homeland Security, shall issue rules, in accordance with section 553 of title 5, United States Code, to provide—</text><paragraph id="HC930F176ABBC4711BFF82B9D5303F5A5"><enum>(1)</enum><text>criteria for determining the number of positions in and organization of Reserve units;</text></paragraph><paragraph id="HEC439E70EF7644F29E8DDACECFD9B7E6"><enum>(2)</enum><text>criteria for determining the appropriate level of seniority and job classifications of Reserve positions;</text></paragraph><paragraph id="HA66C2E8ABECD44BBB7323B9CE876CE7B"><enum>(3)</enum><text>the advertisement of the Reserve to the public to generate interest in volunteers;</text></paragraph><paragraph id="H0699738947404560B4CD58190E6F02D4"><enum>(4)</enum><text>the selection of individuals for the Reserve and the job assignment process;</text></paragraph><paragraph id="HBFBB4E76BCC94C5387A44A30597FE807"><enum>(5)</enum><text>the appointment authorities to be used by the head of an agency during an activation of the applicable Reserve unit;</text></paragraph><paragraph id="H21D8C8239761438FB3E74148147CF38D"><enum>(6)</enum><text>the appropriate levels of compensation for private individuals for service in the Reserve, dependent on the qualifications and expected roles of the individuals;</text></paragraph><paragraph id="H9DBF72EE9CAF40F795BF74C9F88F8156"><enum>(7)</enum><text>the appropriate levels of compensation for private individuals for service in the Reserve for additional expenses, such as travel and accommodation, to fulfill the responsibilities in the Reserve, including during training and exercise;</text></paragraph><paragraph id="HED23C528E85E4A5B850A4530C94ACF2F"><enum>(8)</enum><text>additional incentives to be provided to private individuals to encourage participation in the Reserve;</text></paragraph><paragraph id="H408280481BFB49E2B9CEB9CD7F791973"><enum>(9)</enum><text>whether and how to issue security clearances to individuals selected to serve in the Reserve, both prior to and during activation;</text></paragraph><paragraph id="H3713553C9E56494F969F2B316DEBF772"><enum>(10)</enum><text>the frequency and content of training and exercises for the Reserve;</text></paragraph><paragraph id="HA46C44DB2E704B9A861482A6E67D7D30"><enum>(11)</enum><text>the appropriate interaction between permanent Government employees and individuals in the Reserve during training, exercises, and activations of the Reserve;</text></paragraph><paragraph id="H684C2C2BE24D490BB8719B5A5925E84A"><enum>(12)</enum><text>the appointment of permanent Government employees to manage the Reserve for each agency with a Reserve unit, both prior to and during activation;</text></paragraph><paragraph id="H3CB3A78479A848168A5621E0CCEE3FFF"><enum>(13)</enum><text>practices to ensure that ethics and conflict-of-interest standards are implemented and maintained throughout the activities of the Reserve; and</text></paragraph><paragraph id="HC26835BE487241C2B4D79C6964C954EF"><enum>(14)</enum><text>all other matters necessary to effectively manage the Reserve, as determined by the Director of the Office of Personnel Management.</text></paragraph></subsection><subsection id="H9C07464FAF744F1C88B0D21634DDD25B"><enum>(f)</enum><header>Additional guidance</header><text display-inline="yes-display-inline">The Director of the Office of Personnel Management may issue any additional internal guidance as the Director of the Office of Personnel determines is necessary to supplement the rules issued under subsection (e).</text></subsection><subsection id="HEEACA3455FB9447698C27D5106E12D82"><enum>(g)</enum><header>Employment protection</header><text>For purposes of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/43">chapter 43</external-xref> of title 38, United States Code, an individual absent from a position of employment due to an appointment into service in the Reserve shall be subject to the same employment and reemployment protections as are provided under such chapter for an individual absent from a position of employment due to an appointment into service in the Federal Emergency Management Agency as intermittent personnel under section 306(b)(1) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act.</text></subsection></section><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H3D39D842EBD94AF7A9DD35741CE0D3D7"><enum>(19)</enum><text>in section 315, as so redesignated—</text><subparagraph id="H87DF8A480CF04C638F995217B5E19340"><enum>(A)</enum><text>in subsection (a)—</text><clause id="HC96266AC0A5443558E5084BADF044A8E"><enum>(i)</enum><text>by striking <quote>title III, and title VII (except sections 707, 708, and 721)</quote> and inserting <quote>title II, and title III (except sections 307, 308, and 316)</quote> ;</text></clause><clause id="H894BC87844D24E1B9D8FC614B1607822"><enum>(ii)</enum><text>by striking <quote>2026</quote> and inserting <quote>2031</quote>; and </text></subparagraph><subparagraph id="H4EDD5ED4EDB341D2BA5B626B515752CB"><enum>(C)</enum><text>by striking subsection (d);</text></subparagraph></paragraph><paragraph id="H136A9830D67B4CBE95321675C477C65E"><enum>(20)</enum><text display-inline="yes-display-inline">in section 316, as so redesignated—</text><subparagraph id="H4DDB605B0C364A4190F759D120B43E47"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)(4)(C)(i)(II), by striking <quote>in <quote>urbanized areas</quote>, as</quote> and inserting <quote>in an <quote>urbanized area</quote>, or equivalent term, as</quote>;</text></subparagraph><subparagraph id="HE6319A0031E343DEA77E8F95299EE683"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><clause id="H84EB9EAB7EC345219EDC50B4B92F8A13"><enum>(i)</enum><text display-inline="yes-display-inline">in paragraph (1), by adding at the end the following:</text><quoted-block style="OLC" id="HDC2E28AD8A0543D79F1369973A9FA355" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HBA00"><subparagraph id="H49E3409AB1814F7EB3B64316A4C1DBC8"><enum>(I)</enum><header>Consideration of certain agricultural land transactions</header><clause id="H4D1B5400B74B474F8D3DFCE4FC42FFB0"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">After receiving notification from the Secretary of Agriculture of a reportable agricultural land transaction, the Committee shall determine—</text><subclause id="HA22D8F264B2940BF90380B127E2DCF28"><enum>(I)</enum><text>whether the transaction is a covered transaction; and</text></subclause><subclause id="H3127AFBA8F27487B857243478F1997EA"><enum>(II)</enum><text>if the Committee determines that the transaction is a covered transaction, whether the Committee should initiate a review pursuant to subparagraph (D), or take another action authorized under this section, with respect to the reportable agricultural land transaction.</text></subclause></clause><clause id="H6EC4456F73414608976299543AA70BBF"><enum>(ii)</enum><header>Reportable agricultural land transaction.</header><text>In this subparagraph, the term <quote>reportable agricultural land transaction</quote> means a transaction—</text><subclause id="HFE3452AD27734574AC63D8EA5045E6BA"><enum>(I)</enum><text>that the Secretary of Agriculture has reason to believe is a covered transaction, based on information from or in cooperation with the intelligence community;</text></subclause><subclause id="H693DD22EDCC24BD7AE482ABB1F156FDF"><enum>(II)</enum><text>that involves the acquisition of an interest in agricultural land by a foreign person of the People’s Republic of China, the Democratic People’s Republic of Korea, the Russian Federation, or the Islamic Republic of Iran; and</text></subclause><subclause id="HA8929FDEB6C043D6B3CF811C0E741BB5"><enum>(III)</enum><text>with respect to which a person is required to submit a report to the Secretary of Agriculture under section 2(a) of the Agricultural Foreign Investment Disclosure Act of 1978.</text></subclause></clause><clause id="H389C7877A5DF4EAC9124EABCF5715595"><enum>(iii)</enum><header>Sunset</header><text>The requirements under this subparagraph shall terminate, with respect to a foreign person of the respective foreign country, on the date that the People’s Republic of China, the Democratic People’s Republic of Korea, the Russian Federation, or the Islamic Republic of Iran, as the case may be, is removed from the list of foreign adversaries in section 791.4 of title 15, Code of Federal Regulations.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="H3FAEBA59D247417D9F1BA42D85A99564"><enum>(ii)</enum><text>in paragraph (3)—</text><subclause id="H9C19F54E5CBC4BE9A94950ED6FB15105"><enum>(I)</enum><text>in subparagraph (A), by striking <quote>Upon completion of</quote> and inserting <quote>Not later than the seventh day of the month following the month in which the Committee completed</quote>; and</text></subclause><subclause id="HA78099505B224D97BB985E3B280E32BC"><enum>(II)</enum><text display-inline="yes-display-inline">in subparagraph (C)(i)—</text><item id="H6C0C239BB58241D8BB5FDE68F4D72C6E"><enum>(aa)</enum><text>by striking <quote>shall be submitted to the members</quote> and inserting <quote>shall be submitted in a searchable, machine-readable format to the members</quote>;</text></item><item id="H8367203F8DB84EB5BAB8A27069E75C02"><enum>(bb)</enum><text>in subclause (II), by striking <quote>and</quote> at the end;</text></item><item id="H218F1753168F4281B80850519DF7104F"><enum>(cc)</enum><text>by redesignating subclause (III) as subclause (IV); and</text></item><item id="H14925BBB49204D58A8A0EA7DF4F27AE4"><enum>(dd)</enum><text>by inserting after subclause (II) the following:</text><quoted-block style="OLC" id="HE3CCE29E45844419BE588DB57A346D1E" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HBA00"><subclause id="H4659687A927C43DFB6C9777E752AF48B"><enum>(III)</enum><text display-inline="yes-display-inline">the date on which the transaction was accepted by the Committee and the date on which transaction parties were notified of the completion by the Committee of the Committee’s review of the transaction pursuant to subsection (b)(6); and</text></subclause><after-quoted-block>;</after-quoted-block></quoted-block></item></subclause></clause></subparagraph><subparagraph id="H9500F19C894C48C39B714C8A9ED9F8B9"><enum>(C)</enum><text>in subsection (d)(4)(A), by striking <quote>assets as a result</quote> and inserting <quote>assets or in real estate in the United States as a result</quote>;</text></subparagraph><subparagraph id="H9DC918D30E2E491A91012BC0366A3AEE"><enum>(D)</enum><text>in subsection (k), by adding at the end the following:</text><quoted-block style="OLC" id="H1BCEF935892A4ACAB0564E3F4E2AD960" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HBA00"><paragraph id="H45A7419592C14ADDBB781327FFC7ACAB"><enum>(8)</enum><header>Inclusion of the Secretary of Agriculture</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall be a member of the Committee with respect to a covered transaction that involves—</text><subparagraph id="HC00417F0EFA941EBA1F1CD7AD6FB3A32"><enum>(A)</enum><text>agricultural land;</text></subparagraph><subparagraph id="H58B0EDFD1998440D9F7EC1B6C7FC46B1"><enum>(B)</enum><text>agriculture biotechnology; or</text></subparagraph><subparagraph id="HAD31C46ECABE4D00963255FC59C9F39E"><enum>(C)</enum><text>the agriculture industry, including agricultural transportation, storage, and processing.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HC840190076154EB89CDAEF971A941220"><enum>(E)</enum><text>in subsection (l)(3)(D), by striking <quote>section 706(b)</quote> and inserting <quote>section 306(b)</quote>;</text></subparagraph><subparagraph id="H7C56BE0CAAE647A493DF4BFE3DADF2CF"><enum>(F)</enum><text>in subsection (o)—</text><clause id="H99DCBB19413E4860ADDCD7545FEA1E86"><enum>(i)</enum><text>in paragraph (1), by striking <quote>March 31</quote> and inserting <quote>September 30</quote>; and</text></paragraph><paragraph id="H6E2662D607204DCBB8A1997B5951B602"><enum>(4)</enum><text>is subject to appropriate information security, confidentiality, and classification requirements.</text></paragraph></subsection><subsection id="H544B758DE90A4DAA896A37028C58F433"><enum>(f)</enum><header>Toolkit and online resources site</header><paragraph id="HDB5380995ACF41608B7F3A163DFFDBBF"><enum>(1)</enum><header>In general</header><text>Not later than 365 days after the date of the enactment of this subsection, the Committee shall develop a toolkit and an online <quote>one-stop shop</quote> that allows Federal agencies to share information and resources with interested persons regarding the use of authorities under this Act (other than authorities under section 316 or title IV), including the following:</text><subparagraph id="H9DA488E4015A415BB0F182ECA581E809"><enum>(A)</enum><text>The process for solicitations under such authorities, including information on submitting offers and receiving assistance.</text></subparagraph><subparagraph id="H20E4C890D01147C69FA98A843E154ED3"><enum>(B)</enum><text display-inline="yes-display-inline">Opportunities under such authorities for business concerns, including small business concerns (as defined under section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>)), to participate in contracts and other funding mechanisms allowed such authorities.</text></subparagraph><subparagraph id="HC3113F05C62D45CBA28BA60FDB58EFA1"><enum>(C)</enum><text>A searchable description of awards, including an identification of the awardee and any priority rating for such award, made using such authorities.</text></subparagraph><subparagraph id="H7D573C9BFC1D4BBCA962C517F2A719E9"><enum>(D)</enum><text>A description of any voluntary agreements and executive reserves established, consistent with such authorities, including an identification of the parties engaged in each activity and the goals and terms of such activity, as the Committee determines appropriate.</text></subparagraph><subparagraph id="H13F9E782127B47ACB759E6C257335472"><enum>(E)</enum><text>The contact information for an individual at each Federal agency to which the President may delegate such authorities.</text></subparagraph></paragraph><paragraph id="H1CF9F7F85A9B4A32B8780CB2876AAB4A"><enum>(2)</enum><header>Outreach</header><text display-inline="yes-display-inline">Not later than 365 days after the development of the toolkit required in paragraph (1), and every 6 months thereafter, the Committee shall develop a plan for each Federal agency to which the President has delegated authorities under this Act (other than authorities under section 316 or title IV) to conduct outreach activities to educate the private sector about the commercial opportunities available under such authorities.</text></paragraph></subsection><subsection id="H696924E967934F57A9D82762FBE7AE3D"><enum>(g)</enum><header>Meetings</header><text display-inline="yes-display-inline">The Committee shall meet at least twice per year. The Chairperson of the Committee may convene such other meetings as the Chairperson determines necessary.</text></subsection><subsection id="H4703B748BE4C4D2E8429D44BF53024C8"><enum>(h)</enum><header>Subcommittees</header><paragraph id="HCAEFAA45A078496CA01F813FEE6C25A6"><enum>(1)</enum><header>Emerging technology subcommittee</header><subparagraph id="H54218F5493CF4FBE8DC5D0633EF0FE53"><enum>(A)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established within the Committee a Subcommittee on Emerging Technology.</text></subparagraph><subparagraph id="H75C22DA5A1CC47E58A17FAC12049396A"><enum>(B)</enum><header>Activities</header><text display-inline="yes-display-inline">The Subcommittee on Emerging Technology shall analyze—</text><clause id="HD6A8D60C66BD40818532071EF2E8DC58"><enum>(i)</enum><text>the effects or potential benefits of covered technology on activities determined essential to the national defense; and</text></clause><clause id="HCC2A0EB4624047B4B2E233C8F4E8C422"><enum>(ii)</enum><text>how covered technology can be used within a single industry or Federal agency, or across industries and Federal agencies, to improve efficiencies, encourage innovation, and address supply chain gaps</text></clause></subparagraph><subparagraph id="H746F1D68E0A74651804AF0764227DE65"><enum>(C)</enum><header>Report elements</header><text display-inline="yes-display-inline">The Subcommittee on Emerging Technology shall include, in the annual report of the Defense Production Act Committee, the analysis required under subparagraph (B)(ii), including a description of how covered technology can be used within a single industry or Federal agency, or across industries and Federal agencies, to improve efficiencies, conserve resources, and address supply chain gaps, in support of national defense priorities.</text></subparagraph><subparagraph id="H0860D3744DCE4E54B2C4014368554F5E"><enum>(D)</enum><header>Covered technology</header><text>For purposes of this paragraph, the Subcommittee shall establish a definition for the term <quote>covered technology</quote> and, in establishing such definition, shall consider including technologies in the fields of—</text><clause id="H1A5CB4DE22B445C48DE76A77B837177B"><enum>(i)</enum><text display-inline="yes-display-inline">artificial intelligence and robotics;</text></clause><clause id="H361922BB00DA486F9BFD6222AB4A9ED9"><enum>(ii)</enum><text>biotechnology;</text></clause><clause id="H91ED930F7D6149FD86BA7133986A64CB"><enum>(iii)</enum><text>cryptography and quantum computing;</text></clause><clause id="H04ED224423D446D591B7893409BD29AB"><enum>(iv)</enum><text>materials science;</text></clause><clause id="H8AAC408E739E42C4A79971B31DC11111"><enum>(v)</enum><text>semiconductors; and</text></clause><clause id="HA576C2065ECB46EDBB31413EB515FDE5"><enum>(vi)</enum><text>space.</text></clause></subparagraph></paragraph><paragraph id="H8D6B753F2FEC47CA81E1686BA76DA6FE"><enum>(2)</enum><header>General subcommittee authority</header><text>The Executive Director may establish and convene such additional subcommittees of the Committee as the Executive Director determines appropriate to improve coordination among member agencies of the Committee regarding particular activities authorized under this Act.</text></paragraph></subsection><subsection id="HD0BB9BE274EF4F8E9C860A3D34492751"><enum>(i)</enum><header>Fraud risk management in transactions under this Act</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this subsection, the Defense Production Act Committee shall—</text><paragraph id="H472F6C1E3CBF442C84C849BFEA458D80"><enum>(1)</enum><text>establish and implement processes and procedures consistent with leading practices in the Fraud Risk Framework established by the Government Accountability Office to combat fraud in transactions undertaken under this Act;</text></paragraph><paragraph id="H0D772D2DE10D4FC994537FA816DB5A08"><enum>(2)</enum><text>train personnel about the standards and practices established and implemented under paragraph (1); and</text></paragraph><paragraph id="HBC0CD900A0B440D694CE8F40BBAF13E7"><enum>(3)</enum><text>designate a point of contact within the Defense Production Act Committee to be responsible for managing issues relating to fraud, including coordinating with agencies to review fraud-related issues.</text></paragraph></subsection><subsection id="H7F028F1FF8B5404EB50B361EFE8E491A"><enum>(j)</enum><header>Testimony</header><text display-inline="yes-display-inline">The following persons, or their designees, shall provide testimony to the Committee on Financial Services of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate not later than 90 days following submission of the report described under subsection (d):</text><paragraph id="H2ECDC8FEAB0B4CA7B219A4F334E6EDDD"><enum>(1)</enum><text>The Executive Director.</text></paragraph><paragraph id="HE16CE377F6EB4FD2831E7FCF8DA872B2"><enum>(2)</enum><text>Upon request of either such committee, the head of any Federal agency to which the President has delegated authority under this Act.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="H62C41C39771A46A3A8A0EB6BA8D5226D"><enum>6.</enum><header>Prohibition and notification on investments relating to covered national security transaction</header><text display-inline="no-display-inline">The Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4501">50 U.S.C. 4501 et seq.</external-xref>) is amended—</text><paragraph id="H49BCEF74738E49F1AF262BA663FB66D9"><enum>(1)</enum><text>by redesignating title VIII as title IV;</text></paragraph><paragraph id="H9AE199F222ED49F3B8F3749E0BA6A71D"><enum>(2)</enum><text>by redesignating sections 801 through 809 as sections 401 through 409, respectively;</text></paragraph><paragraph id="HBD866F9DB4C24A7C9365B52F8CF8B39E"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (e)(1) of section 401, as so redesignated, by striking <quote>section 709</quote> and inserting <quote>section 309</quote>; and</text></subparagraph><subparagraph id="HFDEE4DD9F2B3419A84F4DE51E8D9D947"><enum>(C)</enum><text>provide legislative recommendations, including amendments to the DPA, to address procurement of DPA-related long-lead items and the stockpiling of such items. </text></subparagraph></paragraph><paragraph id="H0D93CE6F880C49C99CBCABA292796570"><enum>(3)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="HA867C7E6713B485AA63620962410B7B2"><enum>(A)</enum><header>DPA</header><text display-inline="yes-display-inline">The term <quote>DPA</quote> means the Defense Production Act of 1950.</text></subparagraph><subparagraph id="HAA4FA415D2294D2E880064AF1B5DD8BC"><enum>(B)</enum><header>DPA agency</header><text display-inline="yes-display-inline">The term <quote>DPA agency</quote> means a Federal agency to which the President has delegated authority under the DPA.</text></subparagraph><subparagraph id="HED2E8980CE554F7BBC16216E82B3252C"><enum>(C)</enum><header>Long-lead item</header><text display-inline="yes-display-inline">The term <quote>long-lead item</quote> means components of a system or piece of equipment for which the times to design and fabricate are the longest, and therefore, to which an early commitment of funds may be desirable to complete the system by the earliest possible.</text></subparagraph></paragraph></subsection><subsection id="HDD1DCAF35A3C4F97A7882474842F3B4A"><enum>(b)</enum><header>GAO report on the Defense Production Act Committee</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act, the Comptroller General of the United States shall issue a report to the Committee on Financial Services of the House of Representatives and the Committee on Banking, Housing and Urban Affairs of the Senate that includes—</text><paragraph id="H5D7C3071F31A4D1FB6D8C595050FB43C"><enum>(1)</enum><text>an assessment of the quality of coordination and planning for the effective use of the authorities provided under section 317 of the Defense Production Act of 1950;</text></paragraph><paragraph id="H77FEC33157724B7CADED396B3B207D3C"><enum>(2)</enum><text>an identification of authorities and requirements provided for under Section 317 the Defense Production Act of 1950 that may call for greater use or compliance by the Defense Production Act Committee; and</text></paragraph><paragraph id="HFBA22EAB38DD41478B9994142C33AFBA"><enum>(3)</enum><text>any other recommendations relating to how the Defense Production Act Committee could improve the Committee’s coordination and planning.</text></paragraph></subsection><subsection id="H5BD9C0A2B44E40BC832C220E3178EC2C"><enum>(c)</enum><header>Subcommittee on Emerging Technology report on potential strategic reserve of biological inputs</header><text display-inline="yes-display-inline">The Subcommittee on Emerging Technology of the Defense Production Act Committee shall, not later than 18 months after the date of the enactment of this Act, submit to Congress an evaluation of the potential benefits and drawbacks, and any resources required, in establishing a strategic reserve of critical biomanufacturing essential to national defense activities under the Defense Production Act of 1950.</text></subsection></section><section id="H815045ED492B4F92AE6F60906468C7DA"><enum>8.</enum><header>Conforming amendments</header><subsection id="HADB3ABDCE9DE42C5A2644D96D46F7422"><enum>(a)</enum><header>ADVANCE Act of 2024</header><text display-inline="yes-display-inline">Section 301(d) of division B of the ADVANCE Act of 2024 (<external-xref legal-doc="usc" parsable-cite="usc/42/2133">42 U.S.C. 2133</external-xref> note) is amended by striking <quote>section 712</quote> and inserting <quote>section 316</quote>.</text></subsection><subsection id="HE8FFB30A381B40138D021368755BA3D0"><enum>(b)</enum><header>American Homeownership and Economic Opportunity Act of 2000</header><text display-inline="yes-display-inline">Section 1102 of the American Homeownership and Economic Opportunity Act of 2000 (<external-xref legal-doc="public-law" parsable-cite="pl/106/569">Public Law 106–569</external-xref>) is amended by striking paragraph (2).</text></subsection><subsection id="H5C8445226E894B6AA173307EEB474544"><enum>(c)</enum><header>Energy Policy and Conservation Act</header><text display-inline="yes-display-inline">Section 252(h) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6272">42 U.S.C. 6272(h)</external-xref>) is amended by striking <quote>Section 708</quote> and inserting <quote>Section 308</quote>. </text></subsection><subsection id="HD91C7903C60F422ABBEC9D5D7B7BA0F2"><enum>(d)</enum><header>Further Consolidated Appropriations Act, 2020</header><text display-inline="yes-display-inline">Section 402(c) of the Further Consolidated Appropriations Act, 2020 (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635</external-xref> note) is amended by striking <quote>section 721(a)(6)(A)</quote> and inserting <quote>section 316(a)(6)(A)</quote>. </text></subsection><subsection id="H4C125064F58442D3A916351970143971"><enum>(e)</enum><header>National Defense Authorization Act for Fiscal Years 1988 and 1989 </header><text display-inline="yes-display-inline">Section 272 of the National Defense Authorization Act for Fiscal Years 1988 and 1989 (<external-xref legal-doc="usc" parsable-cite="usc/15/4602">15 U.S.C. 4602(c)</external-xref>) is amended by striking <quote>section 719 of the Defense Production Act of 1950 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2168">50 U.S.C. App. 2168</external-xref>),</quote>. </text></subsection><subsection id="HF773AA74AB384775B33973976CCB7702"><enum>(f)</enum><header>National Defense Authorization Act for Fiscal Year 2020</header><text display-inline="yes-display-inline">Section 847(e) of the National Defense Authorization Act for Fiscal Year 2020 is amended by striking <quote>section 721</quote> and inserting <quote>section 316</quote>. </text></subsection><subsection id="H4950D8178BEF43A8851A23956F851CE8"><enum>(g)</enum><header>National Defense Authorization Act for Fiscal Year 2022</header><text display-inline="yes-display-inline">Effective on the date of enactment of the National Defense Authorization Act for Fiscal Year 2022, section 1702(k)(4) of such Act is amended by striking <quote>Defense Production Act</quote> and inserting <quote>Defense Production Act of 1950</quote>. </text></subsection><subsection id="H5D8231FBB46240AFBC284DA92507E749"><enum>(h)</enum><header>Title 10, United States Code</header><text display-inline="yes-display-inline">Section 4891(b)(1) of title 10, United States Code, is amended by striking <quote>If the Secretary of Defense is acting as a designee of the President under section 721(a) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565(a)</external-xref>) and if the Secretary determines</quote> and inserting <quote>If the Committee on Foreign Investment in the United States determines, under section 316 of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565</external-xref>),</quote>.</text></subsection><subsection id="HD43B90A698A14DDF86D7427282919BBB"><enum>(i)</enum><header>William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021</header><text display-inline="yes-display-inline">Section 848(b)(2)(C) of the William M.
