      <enum>1.</enum>
      <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Healthy Hair Act</short-title></quote>.</text>
    </section>

      <enum>2.</enum>
      <header>Hair straightening or smoothing products containing formaldehyde considered
        adulterated</header>
      <subsection id="H23A8DF8DBCCB4CA38E96B1FE52BB21FB">
        <enum>(a)</enum>
        <header>In general</header>
 <text display-inline="yes-display-inline">Section 601 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/361">21 U.S.C. 361</external-xref>) is amended by adding at the end the following:</text>

          <subsection id="HF1E75BEA000E4ADCA2751939C0FE4376">
            <enum>(h)</enum>
 <text display-inline="yes-display-inline">If it is a hair straightening or hair smoothing product (including a keratin treatment) and it contains any amount of formaldehyde or any formaldehyde releasing substance.</text>

        <enum>(b)</enum>
        <header>Hair straightening or hair smoothing product defined</header>
 <text display-inline="yes-display-inline">Section 604 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/364">21 U.S.C. 364</external-xref>) is amended by adding at the end the following:</text>

            <enum>(6)</enum>
            <header>Hair straightening or hair smoothing product</header>
 <text display-inline="yes-display-inline">The term <term>hair straightening or hair smoothing product</term> means a product intended to straighten, relax, smooth, or otherwise alter the texture of hair.</text>
          </paragraph>

      </subsection>
      <subsection id="H4D45BB690A74478A8D9973BE7B1CFEE0">
        <enum>(c)</enum>
        <header>Effective date</header>
 <text display-inline="yes-display-inline">The amendments made by subsection (a) shall apply with respect to cosmetics introduced or delivered for introduction into interstate commerce on or after the date that is 180 days after the date of the enactment of this Act.</text>
      </subsection>
    </section>
    <section id="HE90270C646CC41C6AB67892A5D00DFA1">
      <enum>3.</enum>
      <header>Study on health impacts of exposure to hair straightening or smoothing products
        containing formaldehyde and other substances</header>
      <subsection id="H4115B0BB1CA046F1AC8D06A45252D3E8">
        <enum>(a)</enum>
        <header>In general</header>
 <text display-inline="yes-display-inline">The Commissioner of Food and Drugs, in consultation with the Director of the National Institute for Occupational Safety and Health, shall conduct a study on the short-term and long-term health impacts of exposure to hair straightening or smoothing products containing formaldehyde or formaldehyde releasing substances (or similar chemical agents that the Secretary determines pose comparable health risks), including—</text>
        <paragraph id="H06B732DFD123479280201E2381D751D2">
          <enum>(1)</enum>
 <text>the impacts of such exposure on salon workers; and</text> </paragraph> <paragraph id="H0B269A124F4E45DEB36F1A0C0211513C"> <enum>(2)</enum> <text>the association of such exposure with cancer, respiratory issues, and endocrine disruption.</text>
        </paragraph>
      </subsection>
      <subsection id="H8D6BE08698D04CECBE967B5A97402FAB">
        <enum>(b)</enum>
        <header>Reports to Congress</header>
 <text display-inline="yes-display-inline">The Commissioner of Food and Drugs, in consultation with the Director of the National Institute for Occupational Safety and Health, shall submit to Congress an initial report and a final report that contain—</text>
        <paragraph id="H864181CFD79A4274AE145FAF84B9AF01">
          <enum>(1)</enum>
 <text>the findings of the study under subsection (a); and</text> </paragraph> <paragraph id="HE21093C7029D4C6FAE47E666C482962A"> <enum>(2)</enum> <text display-inline="yes-display-inline">the Commissioner’s recommendations for regulatory action with respect to limiting the health impacts of exposure to hair straightening or smoothing products containing formaldehyde or formaldehyde releasing substances (or similar chemical agents that the Secretary determines pose comparable health risks), enforcement of such actions, and additional research needed to assess such health impacts.</text>
        </paragraph>
      </subsection>
      <subsection id="H40658BBA06B742FF8C1E8915DED7762D">
        <enum>(c)</enum>
        <header>Timing of reports</header>
 <text display-inline="yes-display-inline">The Commissioner of Food and Drugs, in consultation with the Director of the National Institute for Occupational Safety and Health, shall submit—</text>
        <paragraph id="HDB508BC92E5640E2969E5FFE2BD8DED1">
          <enum>(1)</enum>
 <text>the initial report referred to in subsection (b) not later than 1 year after the date of the enactment of this Act; and</text>
        </paragraph>
        <paragraph id="H2A8A6D58CD8F4D5D8AA97E1E803E7AA0">
          <enum>(2)</enum>
 <text>the final report referred to in such subsection not later than 2 years and 2 months after such date of enactment.</text>
        </paragraph>
      </subsection>
