<paragraph id="HFB9FE11505B14CA2943D77A2C0FCFD8D"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>ADS–B In</quote> means technology that receives and processes Automatic Dependent Surveillance–Broadcast (ADS–B) transmissions that are broadcast in accordance with parts 91.225 and 91.227 of title 14, Code of Federal Regulations, and other aviation advisory information from ground stations, including Traffic Information Service–Broadcast (TIS–B) and Automatic Dependent Surveillance–Rebroadcast (ADS–R).</text></paragraph> <paragraph id="H7074E242B2484A3885DF1E3E25D95FF3" commented="no"><enum>(2)</enum><text>The term <quote>ADS–B Out</quote> has the meaning given such term in part 91.227 of title 14, Code of Federal Regulations.</text></paragraph> 
<paragraph id="H13E24D0010D541D388282007AD4D1D1C"><enum>(3)</enum><text>The term <quote>air traffic control services</quote> means services used for the monitoring, directing, control, and guidance of aircraft or flows of aircraft and for the safe conduct of flight, including communications, navigation, and surveillance services and the provision of aeronautical information.</text></paragraph> <paragraph id="HF9888CC2107745B0988A64EAE7F1C5DF"><enum>(4)</enum><text>The term <quote>appropriate congressional committees</quote> means the congressional defense committees, the Committee on Transportation and Infrastructure of the House of Representatives, and the Committee on Commerce, Science, and Transportation of the Senate.</text></paragraph> 
<paragraph id="H7D1F5745564F4A4A8EF39349A48FAC5B" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">The term <quote>Class B Mode C veil</quote> means any location described in part 91.225(d)(2) of title 14, Code of Federal Regulations.</text></paragraph> <paragraph id="HCF10AAC6A34B4FE1A2A26A296C9F228D"><enum>(6)</enum><text display-inline="yes-display-inline">The term <quote>collision prevention technology</quote> means technology that—</text> 
<subparagraph id="HB34F8C05BF604765A79268ED454645BF"><enum>(A)</enum><text display-inline="yes-display-inline">has ADS–B In;</text></subparagraph> <subparagraph id="H3505D2D666D44836AB883131E85F2355"><enum>(B)</enum><text display-inline="yes-display-inline">uses ADS–B data; and</text></subparagraph> 
<subparagraph id="H3EF29E1CCEC44298BC0331AECE2AD974"><enum>(C)</enum><text>provides, and is configured to provide, alerting that is audible to the pilot and flight crew.</text></subparagraph></paragraph> <paragraph id="H59BE12AFF80A484FBC266401719BF8E0"><enum>(7)</enum><text display-inline="yes-display-inline">The term <quote>Department of Defense aircraft</quote> means any aircraft, either manned or unmanned, that is owned, operated, or controlled by the Department of Defense or operated pursuant to a contract entered into by the Department of Defense.</text></paragraph> 
<paragraph id="H8921903049E5463DB3A760EA751BD7F3"><enum>(8)</enum><text>The term <quote>historical flight data</quote>—</text> <subparagraph id="H3023F8D7C62D492E9AF92EF259BEB9CB"><enum>(A)</enum><text display-inline="yes-display-inline">means data derived from Department of Defense or external sources regarding the actual flights taken by relevant Department of Defense aircraft, such as flight paths, altitudes, and other flight characteristics, that would provide a point of comparison to evaluate planned flights or review prior flights for adherence to published flight routes or flight plans; and</text></subparagraph> 
<subparagraph id="H542B16FCAD744DF1A11644EB22CBB60D"><enum>(B)</enum><text display-inline="yes-display-inline">does not include notional data generated for planning or training purposes.</text></subparagraph></paragraph> <paragraph id="H002DF50F6B9E4E25AD7EC6736522EDE9"><enum>(9)</enum><text>The term <quote>manned rotary wing aviation safety management system</quote>—</text> 
<subparagraph id="H21102C7101BE4A0084343FA82C08DF2E"><enum>(A)</enum><text>means training, policies and practices related to rotary wing aviation safety; and</text></subparagraph> <subparagraph id="H4DBAC219BC2E4D54B82A4CFEBCD1DB82"><enum>(B)</enum><text>does not refer to equipment installed or carried on aircraft for flight operations.</text></subparagraph></paragraph> 
<paragraph id="HE9C8F384E69F427CA8AB3CA26D380241"><enum>(10)</enum><text>The term <quote>National Capital Region</quote> means—</text> <subparagraph id="H2FD566788A6B416190612930A0EA2E6E"><enum>(A)</enum><text>the geographic area located within the boundaries of—</text> 
<clause id="H888A09896AFC491499FC023476442B66"><enum>(i)</enum><text>the District of Columbia;</text></clause> <clause id="H298E5D6005484D83AFAB548C56E76FC7"><enum>(ii)</enum><text>Montgomery and Prince Georges Counties in the State of Maryland;</text></clause> 
<clause id="H68A33F6CBDD74384BC8BC05E6D7D254C"><enum>(iii)</enum><text>Arlington, Fairfax, Loudoun, and Prince William Counties and the City of Alexandria in the Commonwealth of Virginia; and</text></clause> <clause id="HBD0A2D4CEFC34351B5B66B53A44718F6"><enum>(iv)</enum><text>all cities and other units of government within the geographic areas described in clauses (i) through (iii); or</text></clause></subparagraph> 
<subparagraph id="H5BED398F245C4784BAA1E2BAA4F497F4" commented="no"><enum>(B)</enum><text>the geographic area prescribed for such region in the memorandum of agreement required by <internal-xref idref="H76D6DD0D0B564B8DA3426011990FD773" legis-path="2656.">section 2656</internal-xref> of this title, except that such geographic area may not exceed the boundaries described in clauses (i) through (iv) of subparagraph (A).</text></subparagraph></paragraph> <paragraph id="HECB9B82BB9B04CCBBA2770CFF4CF5220"><enum>(11)</enum><text>The term <quote>sensitive aircraft data</quote> means—</text> 
<subparagraph id="HB2F92757AD114685BBF934BA959DBF54"><enum>(A)</enum><text>Department of Defense aircraft information relating to classified aircraft, aircraft involved in continuity of government operations or nuclear command and control, fighter aircraft, bomber aircraft, special mission aircraft, or unmanned aircraft systems; and</text></subparagraph> <subparagraph id="H741D6840301D409BB360C407C2D5BA66"><enum>(B)</enum><text>other information which, if publicly disclosed or aggregated, would reveal the capabilities of Department of Defense aircraft and could reasonably be expected to cause serious damage to national security.</text></subparagraph></paragraph> 
<paragraph id="HD434308977774676AB90EB0EAD587425"><enum>(12)</enum><text>The term <quote>special mission</quote>—</text> <subparagraph id="HADA6FA51C8A84BBDABB0C2A8136DF3DE"><enum>(A)</enum><text>means any mission of the Department of Defense relating to activities which, if publicly disclosed, could reasonably be expected to cause serious damage to national security; and</text></subparagraph> 
<subparagraph id="H25AE99714FEB4E3493D0CDC990D96BE2"><enum>(B)</enum><text>does not include—</text> <clause id="H8187097252D24ECDACA8C36CE72BEF24"><enum>(i)</enum><text>unclassified flights;</text></clause> 
<clause id="HE99FE5A0DE354117ACC56BE6917677C7"><enum>(ii)</enum><text display-inline="yes-display-inline">flight crew proficiency flights; or</text></clause> <clause id="H948235099BB04A538A1F629553AE47BC"><enum>(iii)</enum><text display-inline="yes-display-inline">the transportation of any Government official other than a head of an executive department (as such term is defined in section 101 of title 5), a member of the Joint Chiefs of Staff, a commander of a combatant command, or any other individual designated by the President for purposes of this paragraph.</text></clause></subparagraph></paragraph> 
<paragraph id="H16137C4BBE6A4B4DA2E0E78511586B58"><enum>(13)</enum><text display-inline="yes-display-inline">The term <quote>special mission aircraft</quote> means a Department of Defense aircraft performing a special mission, either permanently or temporarily.</text></paragraph> <paragraph id="HDBBD28B16D934FC4B76479F544A9E31D"><enum>(14)</enum><text>The term <quote>unmanned aircraft system</quote> has the meaning given such term in section 44801 of title 49.</text></paragraph></section> 
<section id="H76D6DD0D0B564B8DA3426011990FD773" commented="no"><enum>2656.</enum><header>Memorandum of agreement</header> 
<subsection id="HA1E3185F3EBD47BC9809F5E07F9D0412" commented="no"><enum>(a)</enum><header>Memorandum required</header> 
<paragraph id="H1AF074478CF54B4FA5E24818962E7F6C" display-inline="yes-display-inline" commented="no"><enum>(1)</enum><text>Not later than September 30, 2026, the Secretary of Transportation and the Secretary of Defense shall enter into, and jointly submit to the appropriate congressional committees a copy of, a memorandum of agreement that—</text> <subparagraph id="H95326DCDFFB54C60865037AB87BD7FBC" indent="up1" commented="no"><enum>(A)</enum><text>provides that fighter aircraft, bomber aircraft, unmanned aircraft systems, and other special mission aircraft that are not equipped or not yet equipped with collision prevention technologies or ADS–B Out, or successor technologies, will be reasonably accommodated for safe operations in the national airspace system and provided with necessary air traffic control services; and</text></subparagraph> 
<subparagraph id="H273B059F3D6A4374B0B3923EDF3301DD" indent="up1" commented="no"><enum>(B)</enum><text>establishes policies governing the operation of collision prevention technologies and ADS–B Out, or successor technologies, including proper maintenance and routine verification practices for such systems, on Department of Defense aircraft, consistent with this chapter.</text></subparagraph></paragraph> <paragraph id="H176AF1AEAC58432FB6F8DC0D7FFD2BA6" indent="up1" commented="no"><enum>(2)</enum><text>The Secretary of Transportation and the Secretary of Defense, or the designees thereof, shall consult not less frequently than semiannually on any appropriate updates to the memorandum required by this subsection to reflect safe, effective, and modern air traffic identification, air space management, and related equipment.</text></paragraph></subsection> 
<subsection id="HDCB29181A774426CAA7067E23C0715B8" commented="no"><enum>(b)</enum><header>Collision avoidance matters</header> 
<paragraph id="H742977108F9F4D63B93A4309982CDCAE" display-inline="yes-display-inline" commented="no"><enum>(1)</enum><text>The Secretary of Defense shall ensure that the memorandum of agreement required by subsection (a) includes, at a minimum—</text> <subparagraph id="HA8C594EC5AE94CC1A6F9EE94237053AC" indent="up1" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">a requirement that, beginning on a date agreed to and set forth in such memorandum or the date that is one year after the date of the enactment of this section, whichever occurs first, the Secretary of a military department may not authorize any Department of Defense manned rotary wing aircraft to operate a mission in the National Capital Region unless such aircraft is actively transmitting an ADS–B Out broadcast, or successor technology, unless—</text> 
<clause id="H5EA06F610B1A4561B293770A33F56753" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary of the military department, in coordination with the Secretary of Transportation, has conducted a safety risk assessment and implemented mitigations, as appropriate, to ensure safety in the National Capital Region; and</text></clause> <clause id="HFC31A8BB88EE42E6B9017B81E7CAB987" commented="no"><enum>(ii)</enum><text>such aircraft is carrying out a special mission;</text></clause></subparagraph> 
<subparagraph id="H12A55CB1507041DDA01C7A507FE8CB38" indent="up1" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">procedures requiring the use of ADS–B Out as the default practice by Department of Defense manned rotary wing aircraft when operating in the national airspace system, unless such use would affect the operational security of Department of Defense aircraft or special missions;</text></subparagraph> <subparagraph id="H31497BF7881C4F98A0AA64239014A334" indent="up1" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">consistent with <internal-xref idref="HA053F4F100D24DE4A7D9C664A78B72B5" legis-path="2660.(b)">section 2660b</internal-xref> of this title, procedures for ensuring the correct configuration of ADS–B Out and other transponders, including routine intervals for verifying transponder settings and proper operation;</text></subparagraph> 
<subparagraph id="HA806AB0D3B524BC0A6B139C07F705E96" indent="up1" commented="no"><enum>(D)</enum><text>operational procedures to allow flight crews to enable ADS–B Out transmission while in flight in the national airspace system, including in response to air traffic or weather conditions; and</text></subparagraph> <subparagraph id="H16BA63AF6B0E4A8FBEC56D7F9F895E26" indent="up1" commented="no"><enum>(E)</enum><text>provisions to protect sensitive aircraft data from unnecessary disclosure, including by mitigating risks regarding the inadvertent disclosure of such data or information regarding special missions.</text></subparagraph></paragraph> 
<paragraph id="H2E0083EDB7B144BA9871D48DE78C024C" indent="up1" commented="no"><enum>(2)</enum> 
<subparagraph id="HB0314C6CFA2041C0A986D4BDE4A53966" display-inline="yes-display-inline" commented="no"><enum>(A)</enum><text>The Secretary of Defense shall ensure that—</text> <clause id="HD0D5BDE84FA3478D96519FC86E7CAE05" indent="up1" commented="no"><enum>(i)</enum><text>by not later than 180 days after the date on which the Secretary of Defense and the Secretary of Transportation submit to the appropriate congressional committees a copy of the memorandum of agreement required by subsection (a), Department of Defense aircraft that are not fighter aircraft, bomber aircraft, unmanned aircraft systems, or other special mission aircraft, are equipped and operating with an integrated system, federated system, or standalone device that displays traffic information to the pilot and flight crew; and</text></clause> 
<clause id="HF9F41F129346436AA50D900CF7A7A300" indent="up1" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">by not later than December 31, 2031, such Department of Defense aircraft are equipped and operating with an integrated collision prevention technology system.</text></clause></subparagraph> <subparagraph id="H9A7AA5959ECE4D65A8B3326E422A3B36" indent="up1" commented="no"><enum>(B)</enum><text>In carrying out subparagraph (A), the Secretary of Defense shall take into consideration—</text> 
<clause id="H9597396DF5BE4BB29D55F0BDBD74659A" commented="no"><enum>(i)</enum><text>any need to protect the technology or systems described in such subparagraph against man-made electronic interference;</text></clause> <clause id="H9617B07637B94F94ACDBA768EAE8B270" commented="no"><enum>(ii)</enum><text>appropriate mitigations to known security vulnerabilities associated with such technology or systems;</text></clause> 
<clause id="H978886F339D44F3AA7655DBBFCD88549" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">appropriate safeguards for sensitive aircraft data, classified material, equipment, or special missions when aircraft described in such subparagraph are equipped and operating with collision prevention technology; </text></clause> <clause id="H35CE26B8AA5142D789919782C52B4975" commented="no"><enum>(iv)</enum><text>updated guidance, tactics, techniques, procedures, or training with respect to electromagnetic emissions related to such technology and systems; and</text></clause> 
<clause id="H508B1E0995254FD4A29E31641150E113" commented="no"><enum>(v)</enum><text>placement in flight deck, field of view of pilots, and human factors, to ensure such technology is effective, may be readily used, and has minimal risk of unexpected detachment.</text></clause></subparagraph></paragraph> <paragraph id="H0206E669D76E448DB04960A0C767FD1B" indent="up1" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">The Secretary of Defense shall ensure that the Secretary of Transportation receives accurate information regarding the configurations recommended by each military department for each relevant aircraft type while such aircraft operate in the national airspace system.</text></paragraph> 
<paragraph id="H21230E3F1F024BB2BCB5D7B00A4F3817" indent="up1" commented="no"><enum>(4)</enum><text>In implementing the memorandum of agreement required by subsection (a), the Secretary of Defense, or the Secretary of a military department, may exempt from relevant portions of such memorandum an individual aircraft on a case-by-case basis if such Secretary determines that the aircraft—</text> <subparagraph id="H76AEC316F89444BB9E5145DD797A4FC8" commented="no"><enum>(A)</enum><text>is not airworthy, is otherwise unrepairable, or is not reasonably expected to return to service; </text></subparagraph> 
<subparagraph id="H523B45E5CF2243D395F3BB1128419B41" commented="no"><enum>(B)</enum><text>is an aircraft for which depot-level maintenance or a substantial overhaul of avionics-related equipment, including the installation of collision prevention technology, is scheduled to occur prior to December 31, 2030;</text></subparagraph> <subparagraph id="H386DBC63D7844EE7B9587BB6DAFA3948" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">is scheduled to be retired from service prior to September 30, 2028; or</text></subparagraph> 
<subparagraph id="H15C488CE081642A292FD3CEB8F340433" commented="no"><enum>(D)</enum><text>is an unpowered aircraft not suitable for collision prevention technology due to airframe limitations, including gliders used for pilot instruction.</text></subparagraph></paragraph></subsection> <subsection id="HE850011FFEB7480FB9FA35DD686097C6" commented="no"><enum>(c)</enum><header>Notification requirement</header><text>The Secretary of Defense shall provide to the Secretary of Transportation notification of any aircraft the Secretary of Defense designates as a special mission aircraft operating within the United States (as such term is defined in section 1.1 of title 14, Code of Federal Regulations), for purposes of this chapter. Such notification may identify such aircraft by type, model, series, or another means agreed to in the memorandum of agreement required by subsection (a).</text></subsection> 
<subsection id="H46B326CB006C473381F21364213DAE03" commented="no"><enum>(d)</enum><header>Collision prevention technology equipage</header><text>In implementing a memorandum of agreement pursuant to this section or any other provision of law, to protect the operational security of Department of Defense aircraft, the Secretary of Defense shall retain the sole control over the determination of which specific collision prevention technology is appropriate for installation and operation in any such aircraft.</text></subsection></section> <section id="H4AF84E14F8C34A04891AB257C339BBB4" commented="no"><enum>2657.</enum><header>Required risk assessment and mitigation for special missions</header> <subsection id="H00C80FD39B984C71BEE16009B0E7071F" commented="no"><enum>(a)</enum><header>Risk assessment</header><text display-inline="yes-display-inline">The Secretary of each military department, in coordination with the Secretary of Transportation, shall conduct a risk assessment, and recommend and implement, as appropriate, mitigations as a result of such assessment, to ensure safety in the national airspace system for each type of planned or anticipated special mission of a manned rotary wing aircraft of such military department that would involve operations occurring in whole or in part within a Class B Mode C veil airspace. </text></subsection> 
<subsection id="H738E9FDBE7B242B082C0345E9EADCDF7" commented="no"><enum>(b)</enum><header>Implementation</header><text display-inline="yes-display-inline">The requirement under subsection (a) shall be carried out in a manner mutually agreed to by the Secretary of Defense and the Secretary of Transportation in the memorandum of agreement required by <internal-xref idref="H76D6DD0D0B564B8DA3426011990FD773" legis-path="2656.">section 2656</internal-xref> of this title. </text></subsection> <subsection id="H4B14549993144032A5CE49E2B92D34FE" commented="no"><enum>(c)</enum><header>Initial report</header> <paragraph id="HE7B0DE8842634AAD8494EE20E9E57251" display-inline="yes-display-inline" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Not later than one year after the date on which the Secretary of Defense and the Secretary of Transportation submit to the appropriate congressional committees a copy of the memorandum of agreement required by <internal-xref idref="H76D6DD0D0B564B8DA3426011990FD773" legis-path="2656.">section 2656</internal-xref> of this title, the Secretary of Defense shall submit to the congressional defense committees a report on the types of special mission activities assessed, and any mitigation recommended or implemented, pursuant to subsection (a). Such report shall include, for each month during the 12-month period preceding the date of the submission of the report, the actual number of special mission flights flown with ADS–B Out turned off, in whole or in part, within a Class B Mode C veil airspace, disaggregated by special mission activity.</text></paragraph> 
<paragraph id="H3C8ED9CC3BE64CB3848EE9949F83DE61" indent="up1" commented="no"><enum>(2)</enum><text>The report under paragraph (1) shall be submitted in unclassified form, but may include a classified annex.</text></paragraph></subsection> <subsection id="H706C842C39064984BC64A0AB97F6C85C"><enum>(d)</enum><header>Subsequent report</header> <paragraph id="H2ACFC5791A054A579450872AA0454E26" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">Not later than one year after the date of the submission of the report under subsection (c), the Secretary of Defense shall submit to the congressional defense committees a report that includes, for each month during the 12-month period preceding the date of the submission of the report, the actual number of special mission flights that the Secretary of Defense has flown with ADS–B Out turned off, in whole or in part, within a Class B Mode C veil airspace, disaggregated by special mission activity.</text></paragraph> 
<paragraph id="H6E5ED951CFD3428F8056B0D97B0F714B" indent="up1"><enum>(2)</enum><text>The report under paragraph (1) shall be submitted in unclassified form, but may include a classified annex.</text></paragraph></subsection></section> <section id="H97390C4843804AEDA9B5A6F6FFA87372"><enum>2658.</enum><header>Manned rotary wing aviation safety management system</header> <subsection id="H4FA2538E36C34A9D8592B94D2F421EDC"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">The Secretary of Defense shall ensure that, by not later than March 1, 2027, the Secretary of each military department has established a robust manned rotary wing aviation safety management system, or updated an existing such system, to provide for—</text> 
<paragraph id="HA9DF7BD689694FC48BF6538DEB9DB855"><enum>(1)</enum><text>responsibilities with respect to such system that are clearly delineated from other occupational safety responsibilities;</text></paragraph> <paragraph id="H9857893D2F134113863F4DB01E65834D"><enum>(2)</enum><text display-inline="yes-display-inline">staffing and other resources required for the operation of such system; and</text></paragraph> 
<paragraph id="H54F83B0E361B468D88C7CAD49DE88073"><enum>(3)</enum><text>the implementation of such system in a manner that is functionally integrated with relevant units.</text></paragraph></subsection> <subsection id="H68E6A471E55941B8A1CE15F8A94230C0"><enum>(b)</enum><header>Qualification protections</header><text display-inline="yes-display-inline">The Secretary shall ensure that the implementation of a manned rotary wing aviation safety management system required under subsection (a) does not preclude an individual assigned manned rotary wing aviation safety management system duties from maintaining appropriate qualifications, flying hours, professional military education, or other activities required for career advancement on the basis of being assigned such duties.</text></subsection> 
<subsection id="HC79559831AEB41D3BCB99C6DEC26C3BD"><enum>(c)</enum><header>Aviator survey</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this section, the Secretary shall carry out a survey of rotary aircraft flight crews across the Department of Defense to identify operationally relevant and responsive flight safety reporting systems. Such survey shall include the collection of information regarding—</text> <paragraph id="HFA7823C942EC4CFEB5716D69760EAF25"><enum>(1)</enum><text>barriers to the use of such systems perceived by pilots;</text></paragraph> 
<paragraph id="HF125D99618F8456CB036C88BD9AEA9A9"><enum>(2)</enum><text>responsive reporting methods for identifying and collecting important safety reporting;</text></paragraph> <paragraph id="HC9A7906456AD4AB0937E7100CC7DEA64"><enum>(3)</enum><text>systems for collecting relevant safety reporting that may be used in conjunction with historical flight data to provide insights that may be used in carrying out <internal-xref idref="H57791AA6372B40ACB19D89137AB2964F" legis-path="2660.">section 2660</internal-xref> of this title;</text></paragraph> 
<paragraph id="H3C2DD478F9274A1B95760A6301E459DC"><enum>(4)</enum><text>options for reporting safety incidents, including encounters with civil air traffic operating in the national airspace system, without retaliation, judgment, or undue consequence;</text></paragraph> <paragraph id="HD24AF40901524933958210ACBB29DA5A"><enum>(5)</enum><text>preserving reports of persistent issues with communications, either incoming or outgoing, with air traffic controllers or other aircraft in controlled airspace; and</text></paragraph> 
<paragraph id="H4EA3B67E0C214942B2A08E713EEDD079"><enum>(6)</enum><text>integrating improved flight safety reporting into current operations.</text></paragraph></subsection> <subsection id="H6F66DF6D267948E48CAD51BDCDFEB3DB" commented="no"><enum>(d)</enum><header>Reports</header><text>Not later than 90 days after the date on which the survey under subsection (c) is completed, and on a semiannual basis thereafter until December 31, 2031, the Secretary shall submit to the congressional defense committees a report containing—</text> 
<paragraph id="H7389E4B6E75F4C79B5DC093081E5A985" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">an outline of the funding and personnel resources necessary to implement the requirements under subsection (a), and appropriate findings from the survey under subsection (c), with respect to each military department;</text></paragraph> <paragraph id="H2E9CBB0E91904ABEA6683D9D1C117DB1" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">an outline of the safety functions, practices, training, and reporting required under each manned rotary wing aviation safety management system established or updated under subsection (a);</text></paragraph> 
<paragraph id="H39FA3B0800B54C799C2A5064AC134FBD" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">an assessment of which military department practices most closely align to the best practicable solutions identified pursuant to the findings from the survey under subsection (c); </text></paragraph> <paragraph id="HD65B09A59B954696AD9725F7893E3349" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">a plan to implement the requirements under subsection (a) and appropriate findings from the survey under subsection (c); and</text></paragraph> 
<paragraph id="HDDB4016B80784EE293CB185E9C844F14" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">a plan to ensure active duty units and National Guard units receive the same benefits from an improved manned rotary wing aviation safety management system.</text></paragraph></subsection> <subsection id="HD8364C43CDC949D0B76CC2C2E9840B3D"><enum>(e)</enum><header>Comptroller General review</header> <paragraph id="H32FEDDA21C2B4A9DB44BDEE66144AF7B" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct a review of the efficacy of the manned rotary wing aviation safety management systems established or updated pursuant to subsection (a). Such review shall include—</text> 
<subparagraph id="H8FF80BF329ED4F109730B616A6473575" indent="up1"><enum>(A)</enum><text>an assessment of the extent to which the Secretary has implemented the requirements under subsection (a);</text></subparagraph> <subparagraph id="H2F38EA03A856439FA2756AD33C3AEEC0" indent="up1"><enum>(B)</enum><text>an assessment of the extent to which the Secretary has developed an approach to identify and mitigate any risks in implementing subsection (a); and</text></subparagraph> 
<subparagraph id="HAC621CE30FBC4ED5B24E7E5EF1B77BC0" indent="up1"><enum>(C)</enum><text>any other matters the Comptroller General determines are relevant.</text></subparagraph></paragraph> <paragraph id="H89AB8875DFE3482F8E0F320E055D1D0D" indent="up1"><enum>(2)</enum><text>Not later than September 1, 2027, the Comptroller General shall provide to the congressional defense committees a briefing on the preliminary findings of the review required under paragraph (1). The Comptroller General shall provide to such committees the final results of such review in a mutually agreed upon format and timeframe. </text></paragraph></subsection></section> 
<section id="HA59A4794DC7146788DCD2B86020B1D35"><enum>2659.</enum><header>Initial and recurring training on highly congested airspace</header> 
<subsection id="H39BF873127204A5FAE2F697C8A4C6597"><enum>(a)</enum><header>Required training</header><text display-inline="yes-display-inline">The Secretary of Defense shall ensure that, by not later than March 1, 2027, flight crews for Department of Defense manned rotary wing aircraft operating in the national airspace system receive appropriate initial and recurring training regarding fixed-wing operations within Class B Mode C veil airspace routinely encountered in the course of operations from the assigned duty station of the flight crew. Such training shall include training on approach and departure paths, runway configurations, and the interaction of those traffic flows with published helicopter routes.</text></subsection> <subsection id="HFA148FC2687E40188B9C4D45227C8BE1"><enum>(b)</enum><header>Use of historical flight data</header><text>In developing the training described in subsection (a), the Secretary shall consider historical flight data from Department of Defense manned rotary wing aircraft operating in the associated airspace.</text></subsection> 
<subsection id="HF2DA87EE386B45ADBEF7C2B7D97A9828"><enum>(c)</enum><header>Report</header><text>Not later than March 1, 2027, the Secretary shall submit to the congressional defense committees a report containing a description of how each military department has implemented the training requirements under subsection (a) and how the Secretary has ensured consistency with respect to such implementation across the military departments.</text></subsection></section> <section id="H57791AA6372B40ACB19D89137AB2964F"><enum>2660.</enum><header>Flight data monitoring improvements</header> <subsection id="H4BAEDD04DBFB4E87B84306D8E4BDA232"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than one year after the date of enactment of this section, the Secretary of Defense shall develop and implement standards across the military departments to ensure that Department of Defense manned rotary wing aircraft operations in the national airspace system, and associated training, routes, and activities, are informed by accurate recorded flight data to—</text> 
<paragraph id="H4B7725ABCC184F42B1C92D84AFE6C515"><enum>(1)</enum><text>monitor operational patterns;</text></paragraph> <paragraph id="H2AD7501B30EA4169BB6957E6E7B1D378"><enum>(2)</enum><text>identify operational safety risks; and</text></paragraph> 
<paragraph id="H865F452143BB4983A44825FFCB475DDA"><enum>(3)</enum><text>support the development and implementation of effective risk controls for missions in the national airspace system.</text></paragraph></subsection> <subsection id="HA053F4F100D24DE4A7D9C664A78B72B5"><enum>(b)</enum><header>Data use</header><text>In carrying out subsection (a), the Secretary shall—</text> 
<paragraph id="H9A83F32633F041F889A77C427D6EB130"><enum>(1)</enum><text>seek to use—</text> <subparagraph id="HC2348E3697EB4977895E21C473C2C1F8"><enum>(A)</enum><text>existing data sets and tools to allow for convenient and expeditious use of such data at the lowest possible level; and</text></subparagraph> 
<subparagraph id="H8D92D09A6FF543549B06291838E338EE"><enum>(B)</enum><text>systems that allow for flight data to be evaluated for accuracy on a recurrent basis; and</text></subparagraph></paragraph> <paragraph id="H51E10C627BF1483CBE18E358E3C55638"><enum>(2)</enum><text display-inline="yes-display-inline">conduct a review, and establish procedures based on the results of such review, to ensure flight data is evaluated for accuracy at an appropriate organizational level and on a recurrent basis.</text></paragraph></subsection> 
<subsection id="H9E13F569C3B14CD584749EBC5FFC5412"><enum>(c)</enum><header>Implementation updates</header><text display-inline="yes-display-inline">The Secretary shall provide to the congressional defense committees updates on—</text> <paragraph id="H25E6EE198DF443068D530260465FE4B0"><enum>(1)</enum><text>the implementation of this section; and</text></paragraph> 
<paragraph id="HA07589884D5044AA94E0A722B397C8CE"><enum>(2)</enum><text>the incorporation of the standards developed and data collected pursuant to this section into the manned rotary wing aviation safety management systems required under <internal-xref idref="H97390C4843804AEDA9B5A6F6FFA87372" legis-path="2658.">section 2658</internal-xref> of this title.</text></paragraph></subsection> <subsection id="H7F63B60D9C0C4C508FE6FB7B69867E6B"><enum>(d)</enum><header>Data sharing</header> <paragraph id="HA06E70D52CC747CAAC5BB9D8EBFA0016" display-inline="yes-display-inline"><enum>(1)</enum><text>The Secretary of Defense shall—</text> 
<subparagraph id="H37AEA311375B4CC895CD094FBE84BF08" indent="up1"><enum>(A)</enum><text>conduct a review across the military departments to identify flight data that may be readily shared with the Secretary of Transportation; and</text></subparagraph> <subparagraph id="H4369985C0DDA435992961CD4DF78000F" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">implement a process to share safety data with the Secretary of Transportation.</text></subparagraph></paragraph> 
<paragraph id="H21BB9551E24E4BF1A9B2F9928560938B" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">To the extent the Secretary of Defense determines necessary, data shared pursuant to paragraph (1) may be de-identified.</text></paragraph></subsection></section> <section id="H9D6602FE846649658802B031B2CDFDDB" commented="no"><enum>2660a.</enum><header>Barometric altimeters</header> <subsection id="H14DEE621E2364242B72F0AD08DCA2B7A" commented="no"><enum>(a)</enum><header>Manuals</header><text display-inline="yes-display-inline">The Secretary of Defense shall promptly update, and maintain, appropriate manuals of the Department of Defense for manned rotary wing aircraft, to provide clear guidance regarding—</text> 
<paragraph id="H73349C2C237D4231A64050EFCF27DADA" commented="no"><enum>(1)</enum><text>the expected standard margin of error for barometric altimeters for each class of such aircraft; and</text></paragraph> <paragraph id="H8AB9E2930A1645A8998E4EA2A99F2B80" commented="no"><enum>(2)</enum><text>the total potential error resulting from additional aircraft equipment with respect to an otherwise airworthy barometric altimeter, including increased position error associated with external stores support system configurations.</text></paragraph></subsection> 
<subsection id="H2C7AEEA53FF34A199DDEC0757717D4B4"><enum>(b)</enum><header>Incorporation of data</header><text display-inline="yes-display-inline">In updating the manuals under subsection (a), the Secretary shall incorporate observations derived from external data sources, including historical flight data monitoring from external sources, to better understand the total potential error of barometric altimeters in various aircraft configurations.</text></subsection> <subsection id="H5C9E2F24395B44F9B6F50E5FD922DCE9"><enum>(c)</enum><header>Training</header><text display-inline="yes-display-inline">Not later than 30 days after the date on which the Secretary updates the manuals under subsection (a), the Secretary shall require appropriate refresher training for the crew of any aircraft subject to such an updated manual.</text></subsection></section> 
<section id="H4832DF667DDA4C25A4D1AEF404264521" commented="no"><enum>2660b.</enum><header>Transponder maintenance</header> 
<subsection id="H53366F5917A040B5BB4927664421E2D7" commented="no"><enum>(a)</enum><header>Required intervals</header><text display-inline="yes-display-inline">The Secretary of each military department shall establish routine intervals for verifying the correct configuration and function of ADS–B Out transponders, and related equipment, for aircraft of such military department required to use such transponders. Such intervals may not be less frequent than once every 90 days.</text></subsection> <subsection id="HEB69A131668E46A5B27AA53715D940E3" commented="no"><enum>(b)</enum><header>Reports</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the submission of the budget of the President under section 1105(a) of title 31 for fiscal years 2028 through 2033, the Secretary of each military department shall submit to the congressional defense committees a report that details the following:</text> 
<paragraph id="H4A5D24C4F87B40EAAA0C85539D6B929D" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Compliance across such military department with respect to the required maintenance intervals established under subsection (a).</text></paragraph> <paragraph id="HD63B914EA1D74A19846145B7327A67E7" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">The total number of instances, disaggregated by military installation, in which an ADS–B Out transponder was not serviced in accordance with the applicable maintenance interval established under subsection (a).</text></paragraph> 
<paragraph id="H7C98D9F56FC14370AC4281D8B488B04A" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">Any additional personnel, resources, or equipment required to simplify or otherwise improve maintenance requirements associated with carrying out this section.</text></paragraph></subsection></section> <section id="H20637E56B0C44B5494B0C40F5FF28826"><enum>2660c.</enum><header>Notifications and reports on certain near-miss events in National Capital Region</header> <subsection id="H935E9EF37F86492EB85B4AFA7FB10703"><enum>(a)</enum><header>Notifications</header><text display-inline="yes-display-inline">Not later than one week after the date on which a covered near-miss event occurs, the Secretary of Defense shall submit to the Committees on Armed Services of the House of Representatives and the Senate a notification of such event.</text></subsection> 
<subsection id="H9BBC7CA10C8D4FABB2E70BC7A9ADE18C"><enum>(b)</enum><header>Establishment of associated definition</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this section, the Secretary, in coordination with a working group determined appropriate by the Secretary, shall establish a definition of the term <quote>close proximity encounter</quote> for purposes of this section.</text></subsection> <subsection id="HB32D0223AEF341289AA0E36C5B3FA0F8"><enum>(c)</enum><header>Reports</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which the definition under subsection (b) is established, on a biannual basis thereafter for the following two-year period, and not less frequently than annually thereafter, the Secretary of Defense shall submit to the Committees on Armed Services of the House of Representatives and the Senate a report containing, with respect to the period covered by the report—</text> 
<paragraph id="HCFCD5769EB164E79AF6B8EAB776906F2"><enum>(1)</enum><text display-inline="yes-display-inline">an identification of the number of covered near-miss events that occurred during such period;</text></paragraph> <paragraph id="H6B7D4AF79CD8400D98FEFE295733FB0F"><enum>(2)</enum><text>for each such event, an identification of any cause of such event;</text></paragraph> 
<paragraph id="H3202A2C84CA946DAAE3311BE5007C0B9"><enum>(3)</enum><text>a description any modification to relevant standard operating procedures or other policies of the Department of Defense issued, or planned to be issued, to address such events; and</text></paragraph> <paragraph id="HA482CF9C5C514540A3C7011011460626"><enum>(4)</enum><text>a description of the status of implementation of any such modification.</text></paragraph></subsection> 
<subsection id="H11C60FF962BF4AB18200B4EFD5830733"><enum>(d)</enum><header>Covered near-miss event defined</header><text display-inline="yes-display-inline">In this section, the term <quote>covered near-miss event</quote> means a close proximity encounter (as such term is defined pursuant to subsection (b)) that—</text> <paragraph id="HF4BACAE5B0AD40D2B79F1B569861C796"><enum>(1)</enum><text>involves at least one Department of Defense aircraft; and</text></paragraph> 
<paragraph id="H616D9136177040A5A975F0B3E9EE90FF"><enum>(2)</enum><text>occurs in the National Capital Region.</text></paragraph></subsection></section> <section id="HA5C03F710B0244ECB86237E8B91C84B6"><enum>2660d.</enum><header>Reports on individuals designated for purposes of special mission exclusion</header> <subsection id="H8BEDA0C2EDDE43EBA5D0943860AA5772"><enum>(a)</enum><header>Reports</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this section, and on an annual basis thereafter, the President shall submit to the Committees on Armed Services of the House of Representatives and the Senate a report containing, with respect to the preceding year—</text> 
<paragraph id="H3B8863B2FB684758840C843B2A0C9553"><enum>(1)</enum><text>an identification of any individual designated by the President for purposes of section 2655(12)(B)(iii) of this title; and</text></paragraph> <paragraph id="HFFF8D8AF0A3041679FB399D3F86F5F91"><enum>(2)</enum><text>a description of how often individuals so designated were transported in connection with a mission that, but for such designation, would be considered a special mission.</text></paragraph></subsection> 
<subsection id="HAF276731D3B64FE2BA9BE5D8F8FBB641"><enum>(b)</enum><header>Form</header><text display-inline="yes-display-inline">Each report under subsection (a) shall be submitted in unclassified form, but may contain a classified annex.</text></subsection></section> <section id="H8F4B35E69E34469A9BC0DEE5F3170551"><enum>2660e.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this chapter shall be construed to—</text> 
<paragraph id="HEE6D55B217244DEC986B45E2289F6E76"><enum>(1)</enum><text>vest in the Secretary of Defense any authority of the Secretary of Transportation or the Administrator of the Federal Aviation Administration under title 49 or any other provision of law;</text></paragraph> <paragraph id="HE97144534D90466D8D56450B15696EC5"><enum>(2)</enum><text>vest in the Secretary of Transportation or the Administrator of the Federal Aviation Administration any authority of the Secretary of Defense under this title or any other provision of law;</text></paragraph> 
<paragraph id="H15CCBAE466BA4B9AA9C180BA09C7DE8E"><enum>(3)</enum><text>limit the authority or discretion of the Secretary of Transportation or the Administrator of the Federal Aviation Administration to operate air traffic control services to ensure the safe minimum separation of aircraft in flight and the efficient use of airspace;</text></paragraph> <paragraph id="H73C0C0015D8E4E96A3B0087DABD28FA6"><enum>(4)</enum><text>apply a rule, guidance, plan, carriage requirement, or memorandum established, modified, or reissued pursuant to any other provision of law to any Department of Defense aircraft except through a process established in the memorandum of agreement required by <internal-xref idref="H76D6DD0D0B564B8DA3426011990FD773" legis-path="2656.">section 2656</internal-xref> of this title; or</text></paragraph> 
<paragraph id="H319C9577D2494136A87FD6751518CAD9"><enum>(5)</enum><text display-inline="yes-display-inline">require a Department of Defense aircraft to compromise operational security during a combat operation.</text></paragraph></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HC855B35606F7412986860D0C25F7DFF4"><enum>202.</enum><header>Repeal of prior provision of law on manned rotary wing aircraft safety</header><text display-inline="no-display-inline">Section 2654 of title 10, United States Code, is repealed.</text></section>

<paragraph id="H499924E234F541BFB008D08E6E4BD8D0"><enum>(3)</enum><text>an assessment of potential actions to remediate such degradation.</text></paragraph></subsection> <subsection id="HE72B269B6E0642D09DC9A59D276239DF"><enum>(b)</enum><header>Plan</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which the Secretary submits to the congressional defense committees a copy of the memorandum under section 2656 of title 10, United States Code, as added by <internal-xref idref="H8A8943DC01C64675BED8F12965ACBF8B" legis-path="201.">section 201</internal-xref> of this title, the Secretary shall submit to the congressional defense committees a plan to leverage major avionics upgrades or depot-level maintenance associated with the installation or provision of collision prevention technology to upgrade communications systems in Department of Defense aircraft (particularly with respect to manned rotary wing aircraft), for the purpose of improving the clarity and reliability of transmissions to and from such aircraft.</text></subsection>

<paragraph id="HE6142FA95BAD48C8BDE24418633275A2"><enum>(3)</enum><text>This tragedy represents the deadliest aviation disaster in the United States since the crash of American Airlines Flight 587 in 2001 and the first fatal major commercial passenger flight accident in the United States since Colgan Air Flight 3407 in 2009.</text></paragraph> <paragraph id="H62666C1177824774A742DABC5B1AAE0D"><enum>(4)</enum><text>Passengers aboard Flight 5342 included American citizens from across the country and international travelers, among them championship figure skaters and coaches returning from competition, military servicemembers, and families traveling for personal and professional reasons, each of whom is mourned by loved ones.</text></paragraph> 
<paragraph id="H10CC621350AD47C3B7F1A3D60EE0AA2F"><enum>(5)</enum><text>Crewmembers aboard Flight 5342 served their passengers with professionalism and dedication and the three United States Army soldiers aboard Priority Air Transport 25 gave their lives in service to this Nation.</text></paragraph> <paragraph id="H622206673B6B4A1D871AE07B7DDE1A96"><enum>(6)</enum><text>Emergency responders from Alexandria City Fire Department, Alexandria Police Department, Ann Arundel Fire Department, Arlington County Fire &amp; Rescue, Arlington County Office of Emergency Management, Arlington Police Department, Baltimore City Fire Department, Baltimore Police, Charles County Fire and Rescue, DC Fire Department &amp; EMS, DC Metropolitan Police Department, Fairfax City Fire &amp; Rescue, Fairfax County Fire &amp; Rescue Department, Federal Aviation Administration, Federal Bureau of Investigation, Maryland Natural Resources Police, Maryland State Police, Metropolitan Police Department, Montgomery County Fire and Rescue, Metropolitan Washington Airports Authority (MWAA) Fire &amp; Rescue, MWAA Police, NCR-Incident Management Team, Office of Chief Medical Examiner of the District of Columbia, Prince George's County Fire &amp; Rescue, Prince William Fire &amp; Rescue, U.S. Air Force, U.S. Army, U.S. Army Corps of Engineers, U.S. Coast Guard, U.S. Navy Supervisor of Salvage and Diving, Virginia Department of Emergency Management, Virginia State Police, and other local, state, and Federal agencies conducted heroic rescue and recovery operations in frigid, dangerous conditions—including near-freezing water temperatures and strong winds—working tirelessly to recover all 67 victims and reunite them with their loved ones.</text></paragraph> 
<paragraph id="H3BC8C620CECB4201AD2EBEC46EF3CAEF"><enum>(7)</enum><text>The National Transportation Safety Board (NTSB) immediately launched a full investigation and, on March 7, 2025, issued urgent safety recommendations to prohibit operations on Helicopter Route 4 during simultaneous runway operations, which the Department of Transportation and Federal Aviation Administration promptly implemented.</text></paragraph> <paragraph id="H52CEFCBAE8F54A03A528E441187B582E"><enum>(8)</enum><text>The NTSB held a public meeting on January 27, 2026, where the NTSB determined that the probable cause of the accident was the FAA’s placement of a helicopter route in close proximity to a runway approach path; their failure to regularly review and evaluate helicopter routes and available data, and their failure to act on recommendations to mitigate the risk of a midair collision near DCA; as well as the air traffic system’s overreliance on visual separation in order to promote efficient traffic flow without consideration for the limitations of the see-and-avoid concept.</text></paragraph> 
<paragraph id="HE6CCDF210EA14FD5812ACAE39317C972"><enum>(9)</enum><text>The NTSB determined that the lack of effective pilot-applied visual separation by the helicopter crew, the tower team’s loss of situation awareness and degraded performance due to the high workload of the combined helicopter and local control positions and the absence of a risk assessment process to identify and mitigate real-time operational risk factors, and the Army’s failure to ensure pilots were aware of the effects of error tolerances on barometric altimeters in their helicopters, were also causal to the collision.</text></paragraph> <paragraph id="HD1BFE6E294D74CABBBDDBF01CF040BE5"><enum>(10)</enum><text>The NTSB further determined that contributing factors included the limitations of the traffic awareness and collision alerting systems on both aircraft, which precluded effective alerting of the impending collision to the flight crews; an unsustainable airport arrival rate, increasing traffic volume with a changing fleet mix, and airline scheduling practices at DCA, which regularly strained the DCA air traffic control tower workforce and degraded safety over time; the Army’s lack of a fully implemented safety management system, which should have identified and addressed hazards associated with altitude exceedances on the Washington, DC, helicopter routes; the FAA’s failure across multiple organizations to implement previous NTSB recommendations, including Automatic Dependent Surveillance–Broadcast In, and to follow and fully integrate its established safety management system, which should have led to several organizational and operational changes based on previously identified risks that were known to management; and the absence of effective data sharing and analysis among the FAA, aircraft operators, and other relevant organizations.</text></paragraph> 
<paragraph id="H3AC5546C7315416EB1CDC6FC2EF49D4E"><enum>(11)</enum><text>The NTSB on January 27, 2026, adopted 74 findings and issued 50 safety recommendations to the Department of Transportation, the FAA, the United States Army, the Department of Defense Policy Board on Federal Aviation, the inspector general of the Department of Transportation, and RTCA Program Management Committee to prevent similar accidents in the future.</text></paragraph> <paragraph id="H6EB681A03C024AD981982799A7441ABD"><enum>(12)</enum><text>The families of the victims have demonstrated extraordinary courage and dignity in their grief, and have called for accountability and systemic reform so that no other family will endure such loss.</text></paragraph> 
<paragraph id="HF705BD5471BF4F0F8F8008EAE482BF79"><enum>(13)</enum><text>Congress remains committed to ensuring that the aviation system of the United States achieves the highest possible standard of safety, and that the lessons of this tragedy are fully learned and acted upon.</text></paragraph></subsection> <subsection id="HBCF287CEC0F345519D1FFACDBA72074E"><enum>(b)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text> 
<paragraph id="H36A6985DADF7409BAEE9465C3C1636DC"><enum>(1)</enum><text display-inline="yes-display-inline">Congress mourns the loss of all 67 lives taken in the midair collision near Ronald Reagan Washington National Airport on January 29, 2025, and extends its deepest condolences to the families, friends, and communities of all those who perished;</text></paragraph> <paragraph id="H780C6D802B2648F4825A07D9E7D9323E"><enum>(2)</enum><text display-inline="yes-display-inline">Congress honors the four crew members of American Airlines Flight 5342 who served their passengers with professionalism and dedication;</text></paragraph> 
<paragraph id="HF244282BBB3541CD8AA6E627AFD51FB1"><enum>(3)</enum><text display-inline="yes-display-inline">Congress honors the three United States Army soldiers aboard Priority Air Transport 25, who gave their lives in service to this nation;</text></paragraph> <paragraph id="HAB2F26CCB0A248DCB86DAEF91F9346ED"><enum>(4)</enum><text display-inline="yes-display-inline">Congress honors the passengers of Flight 5342, including the figure skaters and coaches of the United States figure skating community and all other individuals whose lives, achievements, and contributions to their families and communities are irreplaceable;</text></paragraph> 
<paragraph id="H467ACDABAA764876852B7A1B84F77D5E"><enum>(5)</enum><text display-inline="yes-display-inline">Congress commends the first responders who worked with valor and dedication under dangerous conditions to conduct rescue and recovery operations in the Potomac River;</text></paragraph> <paragraph id="HDA3C749DCF4C4B36921400CFDD05B71C"><enum>(6)</enum><text display-inline="yes-display-inline">Congress affirms its full support for the National Transportation Safety Board, its mission of independent accident investigation, and the integrity of its investigative process, and herein the ALERT Act responds to all of the 50 recommendations to prevent a similar tragedy from reoccurring;</text></paragraph> 
<paragraph id="H968BD2577A3246278174F888A9FAFA7F"><enum>(7)</enum><text display-inline="yes-display-inline">Congress further commits to conducting rigorous oversight to ensure accountability for implementing these safety recommendations and ensuring the systemic failures that contributed to this disaster are fully addressed; and</text></paragraph> <paragraph id="H3098CC3778E642B897D2CB95590F92A9"><enum>(8)</enum><text display-inline="yes-display-inline">Congress pledges, on behalf of the American people, that the 67 lives lost on January 29, 2025, will not be forgotten, and that their memory will be honored by this Nation's commitment to an aviation system that is worthy of the trust placed in it by every passenger who boards an aircraft in the United States. </text></paragraph></subsection></section> 
<title id="HD0F89B45D6A040C4B62FA6E88E73C668"><enum>I</enum><header>Civil Aviation Matters</header> 
<section id="HF5FF276139F04CE0B75CE13A0F5E6B98"><enum>101.</enum><header>Airborne Collision Avoidance System Xa inhibit altitude</header> 
<subsection id="HF1418634949E453881E68275D85F39E3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator shall complete an evaluation of the hazards and safety benefits of decreasing the traffic advisory and resolution advisory inhibit altitudes in Airborne Collision Avoidance System Xa (hereinafter referred to as <quote>ACAS Xa</quote>) to enable improved alerting throughout more of the flight maneuvering envelope of an aircraft than is required under the RTCA minimum operational performance standards for the Airborne Collision Avoidance System (DO–385A, issued June 22, 2023).</text></subsection> <subsection id="HCDA75A9AA73742E89972D28EA38149DF"><enum>(b)</enum><header>Consultation</header><text>In conducting the evaluation under subsection (a), the Administrator shall consult with representatives of the following:</text> 
<paragraph id="HF915FCE77E424BFA9BE7B02FBFBA8E6A"><enum>(1)</enum><text display-inline="yes-display-inline">Air carriers operating under part 121 of title 14, Code of Federal Regulations, including regional air carriers and air carriers with a low-cost or ultra-low-cost business model.</text></paragraph> <paragraph id="HB248E1A4979448728E5096F1FF942621"><enum>(2)</enum><text>Air carriers operating under part 135 of title 14, Code of Federal Regulations.</text></paragraph>

<subsection id="HB2FEC11307EC4B1EB33B98C7204DB9FF"><enum>(c)</enum><header>Considerations</header><text>In conducting the evaluation under subsection (a), the Administrator shall consider, at a minimum—</text> <paragraph id="HA45D6E05F8C648F9A5D161DB822EA278"><enum>(1)</enum><text>safety benefits to the public, including reductions in the probability of midair and near-midair collisions;</text></paragraph> 
<paragraph id="H59085B91B9BE4CC98497738049BDA922"><enum>(2)</enum><text>the benefits and risks to the ability of pilots and air traffic controllers to ensure operational safety;</text></paragraph> <paragraph id="HED36EF63F57245CFB0CFF3D52CCD7F8F"><enum>(3)</enum><text>false, misleading, or potentially overlapping alerts or resolution advisories;</text></paragraph> 
<paragraph id="H96991F59A2C34D8ABF7459A02CE6790F"><enum>(4)</enum><text>technological advances in software logic to limit nuisance or false alerts;</text></paragraph> <paragraph id="H4A5C6D835A644233AC6A31ABC0203E15"><enum>(5)</enum><text display-inline="yes-display-inline">air traffic control procedures and the impact of such procedures on pilots and air traffic controllers during critical phases of flight;</text></paragraph> 
<paragraph id="H16222965AEB94EB3B3E59ADA5A1F311E"><enum>(6)</enum><text>training requirements for pilots and air traffic controllers;</text></paragraph> <paragraph id="HD0F6075539E542E8A63D89908BCA49FE"><enum>(7)</enum><text display-inline="yes-display-inline">to the greatest extent practicable, human factors, including products by working groups related to human factors in aviation safety;</text></paragraph> 
<paragraph id="HB7E62A8967E14E1DA3367EF622299900"><enum>(8)</enum><text display-inline="yes-display-inline">research and simulations of reduced resolution advisory inhibit altitudes conducted by the National Transportation Safety Board pursuant to Aviation Investigation Report AIR–26–02 adopted on January 27, 2026; and</text></paragraph> <paragraph id="H9387AEBEB8F34C458339652DA3E04A8B"><enum>(9)</enum><text>any other considerations the Administrator determines appropriate.</text></paragraph></subsection></section> 
<section id="H7B05CA593BCD432894CE6D8E4A10953E"><enum>102.</enum><header>Airborne Collision Avoidance System upgrades</header> 
<subsection id="H2C4EFC450DE24F7FAF8409A6477D15A7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 45 days after the date of enactment of this Act, the Administrator shall establish an aviation rulemaking committee (in this section referred to as the <quote>Committee</quote>) to review and develop findings and recommendations to require selected aircraft to be equipped and operating with ACAS Xa that is—</text> <paragraph id="H9BD1B4505BAB451C8DF0207A2A5F448D"><enum>(1)</enum><text>integrated and uses both ADS–B In and transponder interrogations, as required under the RTCA minimum operational performance standards for the Airborne Collision Avoidance System (DO–385A, issued June 22, 2023); and</text></paragraph> 
<paragraph id="H935900984B354C189EDF0F96CFADA769"><enum>(2)</enum><text>is configured to provide visual and audible alerting to the pilot and flight crew.</text></paragraph></subsection> <subsection id="HF8EDA556CDB745EF8464E148565AB9D9"><enum>(b)</enum><header>Composition</header><text>The Committee shall consist of members appointed by the Administrator, including representatives of—</text> 
<paragraph id="H4A42CC41479349DBB6EE2100C2DFE99C"><enum>(1)</enum><text display-inline="yes-display-inline">air carriers operating under part 121 of title 14, Code of Federal Regulations, including regional air carriers and air carriers with a low-cost or ultra-low-cost business model;</text></paragraph> <paragraph id="H06347EABB7234E72A5935FF0D1D4FAB5"><enum>(2)</enum><text>air carriers operating under part 135 of title 14, Code of Federal Regulations;</text></paragraph> 
<paragraph id="H15C61BF289574DB294CE3A19CA0C6578"><enum>(3)</enum><text>air carriers operating under subpart K of part 91 of title 14, Code of Federal Regulations;</text></paragraph> <paragraph id="H027599016DEE44959A9FC7D9E07942BF"><enum>(4)</enum><text>business aviation operators;</text></paragraph>

<paragraph id="HA92D7509FE3C498F80B1FC89E2B6FAB0"><enum>(9)</enum><text>avionics manufacturers;</text></paragraph> <paragraph id="H172F3303508943FF822C71489EB24331"><enum>(10)</enum><text>supplemental type certificate holders;</text></paragraph> 
<paragraph id="HD1E1853C2095487CBBF907274EEA9B33"><enum>(11)</enum><text>modification service providers;</text></paragraph> <paragraph id="H181DB69D5E934C5FA1E42055C9350C60"><enum>(12)</enum><text>exclusive bargaining representatives of air traffic controllers certified under section 7111 of title 5, United States Code;</text></paragraph> 
<paragraph id="H1F69D8A5BD35431493BF3DE9371E1CB3"><enum>(13)</enum><text display-inline="yes-display-inline">the certified bargaining representative of aviation safety inspectors and engineers for the Federal Aviation Administration;</text></paragraph> <paragraph id="HD3C916B6524A4EF2A99C2D9188633577"><enum>(14)</enum><text>organizations representing certified collective bargaining representatives of airline pilots;</text></paragraph> 
<paragraph id="H9FD6EBDB8FA644428C151788997656EA"><enum>(15)</enum><text>aviation safety experts with specific knowledge of human factors or human factors experts with specific knowledge of aviation safety;</text></paragraph> <paragraph id="H80468D59547C4BCE938F784C7082E289"><enum>(16)</enum><text display-inline="yes-display-inline">research institutions with relevant aviation safety or human factors subject matter expertise;</text></paragraph> 
<paragraph id="HFD2859A6EEC24DEA811366FDA64C1D61"><enum>(17)</enum><text>a representative from the National Transportation Safety Board with subject matter expertise as an observer; and </text></paragraph> <paragraph id="H10420EAE54B64A88BFB6F64A2175BD8F"><enum>(18)</enum><text>any other stakeholders the Administrator determines appropriate.</text></paragraph></subsection> 
<subsection id="HC5EDA9BFCD8B4F848BCEA709020A4B3B" display-inline="no-display-inline"><enum>(c)</enum><header>Considerations</header><text>In developing the findings and recommendations under subsection (a), the Committee shall consider—</text> <paragraph id="H84B9341ED5E540CBA2F4858AF3CCC695"><enum>(1)</enum><text display-inline="yes-display-inline">the anticipated certification timeline for ACAS Xa equipment given the technical complexity and requisite procedures for approval;</text></paragraph> 
<paragraph id="H8D89FBACDA754AB4BCDA3F654486B1A6"><enum>(2)</enum><text>the feasibility of using the Line Replaceable Units of existing collision avoidance systems in such aircraft;</text></paragraph> <paragraph id="HB001C5AA4C5B4B96854A2FE73970563D"><enum>(3)</enum><text>the feasibility of using existing antennas of existing collisions avoidance systems in such aircraft; </text></paragraph> 
<paragraph id="HA766B8969FCB4283A73A605533EBA986"><enum>(4)</enum><text display-inline="yes-display-inline">the commercial availability of all necessary components associated with integrated ACAS Xa;</text></paragraph> <paragraph id="HF9EB2CE0BBE74DEBB54C319008280F6E"><enum>(5)</enum><text>actions the Administrator can take to prioritize the certification and installation of integrated ACAS Xa;</text></paragraph> 
<paragraph id="HD3C9D793173B491B9EF38F5B391D4317"><enum>(6)</enum><text display-inline="yes-display-inline">related changes that may be required for the operating rules and training necessary for air traffic controllers, pilots, and others;</text></paragraph> <paragraph id="HB76B74A2C44A455CB528D989C673F06E"><enum>(7)</enum><text display-inline="yes-display-inline">harmonization of global standards associated with collision avoidance systems; and</text></paragraph> 
<paragraph id="H79E3077CDFF840A4B1C520137AD8C0E8"><enum>(8)</enum><text>any other considerations the Committee or the Administrator determines appropriate.</text></paragraph></subsection> <subsection id="H5BE61704FA7F48DE99C2FA11FD875EBD"><enum>(d)</enum><header>Report</header><text>Not later than 1 year after the date of establishment of the Committee, the Committee shall submit to the Administrator and the appropriate committees of Congress a report containing the findings and recommendations of the Committee.</text></subsection> 
<subsection id="H6BB31EA1AD324FFC80B58DAC03E20102"><enum>(e)</enum><header>Rulemaking</header> 
<paragraph id="H9113C0DD277D47188EC8A497365F7737"><enum>(1)</enum><header>In general</header><text>Not later than 18 months after the submission of the report under subsection (d) or 32 months after the date of enactment of this Act (whichever is earlier), the Administrator shall issue a notice of proposed rulemaking to prohibit persons from operating selected aircraft unless such aircraft are equipped and operating with ACAS Xa that—</text> <subparagraph id="H36CFF05A1B9A4D0D93AF678BB5CE9A31"><enum>(A)</enum><text display-inline="yes-display-inline">is integrated and uses both ADS–B In and transponder interrogations, as required under the RTCA minimum operational performance standards for the Airborne Collision Avoidance System (DO–385A, issued June 22, 2023); and</text></subparagraph> 
<subparagraph id="H9792EAB9A10B4C24B6B5E57BDEAF748F"><enum>(B)</enum><text>provides visual and audible alerting to the pilot and flight crew.</text></subparagraph></paragraph> <paragraph id="H87D776919D414C779969D7B5BAAF2995"><enum>(2)</enum><header>Contents</header><text>The notice of proposed rulemaking described in paragraph (1) shall include, at a minimum—</text> 
<subparagraph id="H13135B1215274A0DABE3DACC09B46DE8"><enum>(A)</enum><text>appropriate guidance for certification of ACAS Xa;</text></subparagraph> <subparagraph id="HF2C702CCCB25499089CC968AAA201577"><enum>(B)</enum><text display-inline="yes-display-inline">a deadline, not to exceed December 31, 2031, for any newly manufactured selected aircraft to be equipped with ACAS Xa that reflects various aircraft types, appropriate maintenance cycles, and required updates to appropriate guidance after certification of ACAS Xa;</text></subparagraph> 
<subparagraph id="HF9BA033BCB5F45CFBFAFD47E0FA7D718"><enum>(C)</enum><text>a deadline, not to exceed December 31, 2031, for existing selected aircraft to be retrofit with ACAS Xa that reflects various aircraft types, appropriate maintenance cycles, and required updates to appropriate guidance after certification of ACAS Xa;</text></subparagraph> <subparagraph id="H52F7C5ACCACD402E8683A6E4D03B3987"><enum>(D)</enum><text>if the new minimal operating performance standards promulgated under subsection (f) require an upgrade of software, an upgrade of hardware, or additional training, a deadline for selected aircraft to be upgraded, not to exceed December 31, 2033; and</text></subparagraph> 
<subparagraph id="HF91EFA4B0FDF47219115678F5BC465BE"><enum>(E)</enum><text>a process by which the Administrator may extend the deadlines specified in subparagraphs (B) and (C), not to exceed a period of 2 years, provided that the Administrator provides a report to the appropriate committees of Congress within 14 days of taking such action, with the reasons justifying such action and an assurance that safety will not be compromised by the delay.</text></subparagraph></paragraph> <paragraph id="H37F6ED0B74D7429892A0FF06FB8CF1FE"><enum>(3)</enum><header>Final rule</header><text display-inline="yes-display-inline">Not later than 1 year after the issuance of the notice of proposed rulemaking required under paragraph (1)(A), the Administrator shall issue a final rule to carry out the requirements of this section.</text></paragraph></subsection> 
<subsection id="H8F8F3C4F78E14E2881E82186F8D98CDE"><enum>(f)</enum><header>Modification of minimal operating performance standards</header><text>Not later than 30 days after the issuance of a final rule under subsection (e), the Administrator shall work with the appropriate standards-setting organization to update the minimal operation standards for ACAS Xa to—</text> <paragraph id="H789ADA72139941F9A9AF41936F31D4B6"><enum>(1)</enum><text>if the evaluation conducted pursuant to section 101 determines that inhibit altitudes can be safely decreased, safely decrease the inhibit altitude in accordance with the results of such evaluation;</text></paragraph> 
<paragraph id="H155B7F7395F64AF7ADFCD8175A6FDFAC"><enum>(2)</enum><text>update traffic advisory aural alert standards to include clock position, relative altitude, range, and vertical tendency; and</text></paragraph> <paragraph id="HF35A39A33B0D44B88E63572691EEA267"><enum>(3)</enum><text>integrate directional traffic symbols into visual displays.</text></paragraph></subsection> 
<subsection id="HAB40B0CB9F034A968085293C22A091FD"><enum>(g)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">The Administrator shall provide technical assistance for facilitating equipage across the entire fleet of affected aircraft, including, as appropriate, guidance under part 26 of title 14, Code of Federal Regulations, to provide support for affected aircraft operators in complying with the requirements of this section.</text></subsection> <subsection id="H02CF1F9BD25446ACA0E982ACB413BD78"><enum>(h)</enum><header>Selected aircraft defined</header><text display-inline="yes-display-inline">In this section, the term <term>selected aircraft</term> means aircraft that are required to be equipped with traffic alert and collision avoidance systems as required in sections 121.356, 135.180, and 91.1045 of title 14, Code of Federal Regulations.</text></subsection></section> 
<section id="HEFD233FC88464137936D7284E313BB04"><enum>103.</enum><header>Airborne collision avoidance systems for rotorcraft</header> 
<subsection id="H05BDB9FA6F91475EB035D6F83804CA96"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than December 31, 2026, the Administrator shall take necessary action with the appropriate standards-setting organization to finalize and publish minimum operational performance standards for the collision avoidance system known as <quote>Airborne Collision Avoidance System Xr</quote> (in this section referred to as <quote>ACAS Xr</quote>) that uses both ADS–B In and a second independent source of target aircraft data, such as transponder interrogations.</text></subsection> <subsection id="H4F3F84EC58544319AF7A7CB27EC51F33"><enum>(b)</enum><header>ACAS Xr aviation rulemaking committee</header> <paragraph id="H31B10E6F7E664168BD5FFFA848D82446"><enum>(1)</enum><header>Establishment</header><text>Not later than 30 days after the date on which the appropriate standards-setting organization publishes minimal operational performance standards for ACAS Xr under subsection (a), or January 31, 2027, (whichever is earlier), the Administrator shall establish an aviation rulemaking committee (in this section referred to as the <quote>Committee</quote>) to review and develop findings and recommendations to require selected rotorcraft and selected powered-lift aircraft be equipped and operating with ACAS Xr that has ADS–B In and is configured to provide visual and audible alerting to the pilot and flight crew.</text></paragraph> 
<paragraph id="H68B2F09DEB3E494183CFB3DA3979D98E"><enum>(2)</enum><header>Composition</header><text>The Committee shall consist of members appointed by the Administrator, including representatives of—</text> <subparagraph id="HD3293354BAC249F9BCE394D0FFAE4384"><enum>(A)</enum><text>rotorcraft operating under part 135 of title 14, Code of Federal Regulations;</text></subparagraph> 
<subparagraph id="H53711F68F741422C821D3B0D09D298D0"><enum>(B)</enum><text>rotorcraft operating under part 91 of title 14, Code of Federal Regulations;</text></subparagraph> <subparagraph id="H3D1BDEA15A3549EBA32E88C8BC38B26C"><enum>(C)</enum><text>rotorcraft manufacturers;</text></subparagraph> 
<subparagraph id="H54305884D9BE4830B4395F4C71A2EB5C"><enum>(D)</enum><text>an organization representing rotorcraft operators and pilots;</text></subparagraph> <subparagraph id="HB48F6B669B0D40739508B9C3862937BB"><enum>(E)</enum><text>an organization representing rotorcraft air medical services;</text></subparagraph> 
<subparagraph id="H08B90B2DA6B24898813224FDB385AD15"><enum>(F)</enum><text>general aviation aircraft manufacturers;</text></subparagraph> <subparagraph id="HB47C19B6C90242AAADF9C8873D50FBF7"><enum>(G)</enum><text>powered-lift aircraft operators and manufacturers;</text></subparagraph> 
<subparagraph id="H2AE0125196244E0680C05BF0442624F4"><enum>(H)</enum><text>avionics manufacturers;</text></subparagraph> <subparagraph id="H3383B5074497480589C6CE0FD03E2886"><enum>(I)</enum><text>supplemental type certificate holders;</text></subparagraph> 
<subparagraph id="H92291B1C790042DD896597D1971797F9"><enum>(J)</enum><text>modification service providers;</text></subparagraph> <subparagraph id="H33F54010EAB2489F82AFDA7D20DC133F"><enum>(K)</enum><text>exclusive bargaining representatives of air traffic controllers certified under section 7111 of title 5, United States Code;</text></subparagraph> 
<subparagraph id="HE1EAA6E968974558916422A9B884CDBC"><enum>(L)</enum><text display-inline="yes-display-inline">the certified bargaining representative of aviation safety inspectors and engineers for the FAA;</text></subparagraph> <subparagraph id="HE0D299F205604F1DB5DD4783013FB3F8"><enum>(M)</enum><text>aviation safety experts with specific knowledge of human factors or human factors experts with specific knowledge of aviation safety;</text></subparagraph> 
<subparagraph id="HD6D78435B1F649EABEA1EA8592E4F24B"><enum>(N)</enum><text>a career representative from the National Transportation Safety Board with subject matter expertise as an observer; and</text></subparagraph> <subparagraph id="H59F09CD09929424F876B72D4E1513DE4"><enum>(O)</enum><text>any other stakeholders the Administrator determines appropriate.</text></subparagraph></paragraph> 
<paragraph id="HAA1C81DD62EC47BA97A5B562FE17B6CC"><enum>(3)</enum><header>Considerations</header><text>In developing the findings and recommendations required under paragraph (1), the Committee shall consider—</text> <subparagraph id="H4CA35449D718459BACDD91E16EB8C78F"><enum>(A)</enum><text display-inline="yes-display-inline">any anticipated modifications to the minimum operational performance standards of ACAS Xr that are required by subsection (c)(1)(B);</text></subparagraph> 
<subparagraph id="HC7D002843A404B09A4663019FAD15810"><enum>(B)</enum><text display-inline="yes-display-inline">the anticipated certification timeline for ACAS Xr equipment given the technical complexity and requisite procedures for approval;</text></subparagraph> <subparagraph id="H69A3909E25D147AD92D5883BD3E30AE2"><enum>(C)</enum><text display-inline="yes-display-inline">a projected deadline for equipping newly manufactured selected rotorcraft and selected powered-lift aircraft with ACAS Xr that considers—</text> 
<clause id="H0812CEA3129040F29FD39D3EC1E8F00D"><enum>(i)</enum><text>the safety benefits of ACAS Xr;</text></clause> <clause id="H0D46B8336F744C3689C22AB51A46D230"><enum>(ii)</enum><text display-inline="yes-display-inline">the anticipated timeline needed for the FAA to approve the installation of ACAS Xr on various rotorcraft and powered-lift aircraft or for various operations; </text></clause> 
<clause id="H1313634E84C245DBA9ED9684F3278876"><enum>(iii)</enum><text display-inline="yes-display-inline">the commercial availability of the necessary components associated with ACAS Xr; and</text></clause> <clause id="H2DBD0D13C130484E895DE0481D680683"><enum>(iv)</enum><text display-inline="yes-display-inline">the operational and technical considerations associated with installing ACAS Xr on newly manufactured selected rotorcraft and selected powered-lift aircraft;</text></clause></subparagraph> 
<subparagraph id="HB80EE9B9CDB74B9AB47D89A3669979DF"><enum>(D)</enum><text>a projected deadline to retrofit selected rotorcraft and selected powered-lifted aircraft with ACAS Xr that considers—</text> <clause id="H66364923890C4C1BB087501F4CEDBCD8"><enum>(i)</enum><text>the safety benefits of ACAS Xr;</text></clause> 
<clause id="H875AC255A052431F9420E77D1A9F9F4E"><enum>(ii)</enum><text>the feasibility of using existing antennas of existing collision prevention systems equipped in selected rotorcraft and selected powered-lift aircraft;</text></clause> <clause id="H16B61EA7946D45D99A5C5D30BADF876F"><enum>(iii)</enum><text display-inline="yes-display-inline">the feasibility and cost associated with retrofitting selected rotorcraft and selected powered-lift aircraft not equipped with existing collision avoidance systems; </text></clause> 
<clause id="H41A17CEFC4B34CD4868DE21DEE1A4CF4"><enum>(iv)</enum><text display-inline="yes-display-inline">the commercial availability of the necessary components associated with ACAS Xr; and</text></clause> <clause id="H7102B29C97224D32B5B9701BAB6D24BA"><enum>(v)</enum><text>the operational and technical considerations associated with retrofitting selected rotorcraft and selected powered-lift aircraft; </text></clause></subparagraph> 
<subparagraph id="HE9280762F3E040BEABF0B3FAA07426BF"><enum>(E)</enum><text>actions that the Administrator can take to prioritize the certification and installation of ACAS Xr;</text></subparagraph> <subparagraph id="H6D73FE08F2474919B4329DF8D1D19147"><enum>(F)</enum><text>the interaction of ACAS Xr with existing collision prevention technologies;</text></subparagraph> 
<subparagraph id="H59578CA78DBE4A348FB2C9B0FF8AAD6D"><enum>(G)</enum><text>the efficacy of ACAS Xr in low-altitude and high-density airspace environments;</text></subparagraph> <subparagraph id="H05E3676A403D4927BC3D9FABFF730371"><enum>(H)</enum><text>any available safety data assessing the effectiveness of ACAS Xr in reducing midair collision risk;</text></subparagraph> 
<subparagraph id="HD3C3C7E4CFC84FBDA162DBAABC2AB040"><enum>(I)</enum><text display-inline="yes-display-inline">related training for air traffic controllers, pilots, and others;</text></subparagraph> <subparagraph id="H91CA106959C44F1A8A7E7CC6975320DE"><enum>(J)</enum><text display-inline="yes-display-inline">National Transportation Safety Board Aviation Investigation Report AIR–26–02 adopted on January 27, 2026; and</text></subparagraph> 
<subparagraph id="H049BB7ABD87B4322B3D363B8B5A351C2"><enum>(K)</enum><text>any other considerations the Committee determines appropriate.</text></subparagraph></paragraph> <paragraph id="H2CA43B3FCBB6456F92A71091556005E8"><enum>(4)</enum><header>Report</header><text>Not later than 1 year after the establishment of the Committee, the Committee shall submit to the Administrator and the appropriate committees of Congress a report on the findings and the recommendations developed by the Committee under this subsection.</text></paragraph></subsection> 
<subsection id="H2CE4568917C041DBB08CAFDBD8945786"><enum>(c)</enum><header>Rulemaking and modification of minimal operating performance standards</header> 
<paragraph id="HFCE014C67D0848ED864A351E38DF5CAD"><enum>(1)</enum><header>In general</header><text>Not later than 18 months after the submission of the report required under subsection (b)(4), or 24 months after the date of enactment of this Act (whichever is earlier), the Administrator shall—</text> <subparagraph id="HE2BB249F6EB045C18B2B47F228F32588"><enum>(A)</enum><text>issue a notice of proposed rulemaking to prohibit persons from operating selected rotorcraft and selected powered-lift aircraft unless such rotorcraft or powered-lift aircraft are equipped and operating with ACAS Xr that uses both ADS–B In and transponder interrogations, as required under the minimum operational performance standards as required under subsection (a); and</text></subparagraph> 
<subparagraph id="H6ACB33BC3F7A412F8EE4EAD5825113DC"><enum>(B)</enum><text display-inline="yes-display-inline">take necessary actions with the appropriate standards-setting organization to modify the minimal operational performance standards for ACAS Xr to—</text> <clause id="H85ECB564336B4991A04BB1329F693D9A"><enum>(i)</enum><text>update traffic advisory aural alert standards to include clock position, relative altitude, range and vertical tendency; and</text></clause> 
<clause id="HA1E44AFCC6824E769036CE06003C4689"><enum>(ii)</enum><text>integrate directional traffic symbols into visual displays.</text></clause></subparagraph></paragraph> <paragraph id="H43FA74BBD2DC45EBB533FB7E5827CF67"><enum>(2)</enum><header>Contents</header><text>The notice of proposed rulemaking required under paragraph (1)(A) shall include, at a minimum—</text> 
<subparagraph id="H0C14D91D5C1E4B39901A97BF0D40B2B0"><enum>(A)</enum><text>appropriate guidance for the certification of ACAS Xr systems;</text></subparagraph> <subparagraph id="H7BC10BEFD90841938CA1FAA7771779BC"><enum>(B)</enum><text>defined standards for the modifications to such systems described in paragraph (1)(B);</text></subparagraph> 
<subparagraph id="H5465715765074C59BEB465EB54EBBE9C"><enum>(C)</enum><text display-inline="yes-display-inline">a deadline for any newly manufactured selected rotorcraft and selected powered-lift aircraft to be equipped with ACAS Xr, considering the findings and recommendations developed pursuant to subsection (b); </text></subparagraph> <subparagraph id="H4617B432E64F422C943C90220EB83F4E"><enum>(D)</enum><text>a deadline for selected rotorcraft and selected powered-lift aircraft to be retrofit with ACAS Xr, considering the findings and recommendations developed pursuant to subsection (b); and</text></subparagraph> 
<subparagraph id="HC0E281528C9E45A182B7DA5DB612354B"><enum>(E)</enum><text display-inline="yes-display-inline">a deadline for selected rotorcraft and selected powered-lift aircraft to be equipped with collision prevention technology pursuant to section 104, not to exceed December 31, 2031.</text></subparagraph></paragraph> <paragraph id="H65E5CF0D9676439FB2573E9B8E4BAE3C"><enum>(3)</enum><header>Final rule</header><text>Not later than 18 months after the issuance of a notice of proposed rulemaking under paragraph (1)(A), the Administrator shall issue a final rule associated with such proposed rulemaking.</text></paragraph></subsection> 
<subsection id="HA93563C638C34D32852C5489889FD3E8"><enum>(d)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">The Administrator shall provide technical assistance to facilitating equipage across the entire fleet of affected aircraft to provide support for selected rotorcraft operators and selected powered-lift aircraft operators in complying with the requirements of this section.</text></subsection> <subsection id="HA240ED7CED5E47EF80AAD2ADA3EBFC87"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> 
<paragraph id="HAF856935AA2448B08AA4908B69F23BA6"><enum>(1)</enum><header>Selected rotorcraft</header><text>The term <term>selected rotorcraft</term> means a non-military rotorcraft operating in Class B airspace.</text></paragraph> <paragraph id="HDC1251F341DB4EEFAA1D2BDEB95A42ED"><enum>(2)</enum><header>Powered-lift aircraft</header><text>The term <term>powered-lift aircraft</term> has the meaning given the term <term>powered-lift</term> in section 1.1 of title 14, Code of Federal Regulations.</text></paragraph> 
<paragraph id="H965521A2B66843F9B0C609B86CD35C83"><enum>(3)</enum><header>Selected powered-lift aircraft</header><text display-inline="yes-display-inline">The term <term>selected powered-lift aircraft</term> means a non-military powered-lift aircraft operating in Class B airspace.</text></paragraph></subsection></section> <section id="H5044DA86DB664799930F76B3E24E8A70"><enum>104.</enum><header>Collision prevention systems</header> <subsection id="HDFD3A6F879654E0DBEAB3B49CB464B7C"><enum>(a)</enum><header>Final rule</header><text>Not later than 2 years after the date of enactment of this Act, the Administrator shall issue a final rule with an effective date not later than December 31, 2031, to require covered aircraft to be equipped and operating with collision prevention technology.</text></subsection> 
<subsection id="H2CE29C3C876C4751B64E4262342346E8"><enum>(b)</enum><header>Consultation</header><text>In developing the final rule under subsection (a), the Administrator shall consult with the following:</text> <paragraph id="H2B4FE7994FB54848B4C71B90871CC791"><enum>(1)</enum><text>Air carriers operating under part 135 of title 14, Code of Federal Regulations.</text></paragraph>

<paragraph id="HC2C316FEEDB9439AA325063B6FEA11D3"><enum>(1)</enum><text>the safety benefits of collision prevention technologies;</text></paragraph> <paragraph id="H3089B2DD480540E68FE46EED45ADDFBF"><enum>(2)</enum><text>relevant regulations, guidance, and policies for traffic awareness and traffic advisory technology that uses ADS–B In;</text></paragraph> 
<paragraph id="H038F6D64759C429D937D00C656F75D1C"><enum>(3)</enum><text>ways in which ADS–B In software applications can be used as of the date of enactment of this Act;</text></paragraph> <paragraph id="H9A138185A6744358B2554C22F85720CA"><enum>(4)</enum><text display-inline="yes-display-inline">software in existence on the date of enactment of this Act, and reasonably projected thereafter, that can predict aircraft movements, display surrounding traffic, and provide visual and audible traffic advisories;</text></paragraph> 
<paragraph id="HEBFAE33E07D6427A93284A3FFC099DCF"><enum>(5)</enum><text display-inline="yes-display-inline">the margin of error and accuracy of software described in paragraph (4);</text></paragraph> <paragraph id="H998AD68D38E34682B0AC8818DEFF137A"><enum>(6)</enum><text display-inline="yes-display-inline">the safety benefits of software described in paragraph (4) in preventing conflicts with both aircraft and ground vehicles on airport surfaces;</text></paragraph> 
<paragraph id="HB4A11332A9FB4BFF9E9FC05081932C52"><enum>(7)</enum><text display-inline="yes-display-inline">the safety benefits of software described in paragraph (4) in informing pilots or flight crews of operational risks, including encounters with forecasted severe weather using flight information services broadcast (FIS–B); </text></paragraph> <paragraph id="H56598043D7E64CD0BF8974FA3D925FA6"><enum>(8)</enum><text>the effort of the Administrator to modernize the air traffic control system, including timelines, technologies being incorporated, changes to operational rules, and training requirements;</text></paragraph> 
<paragraph id="H3DDFC75109A94C8DA26C290321B00613"><enum>(9)</enum><text display-inline="yes-display-inline">the role of air traffic controllers in ensuring aircraft separation, including the need for additional training to air traffic controllers given the requirements of this section;</text></paragraph> <paragraph id="H08B2CC7D970940C39107C71B200B093A"><enum>(10)</enum><text>the necessity of certification for implementing collision prevention technology based on type of aircraft and operation; </text></paragraph> 
<paragraph id="HFD7132B3A61D47D6BA86F20C1C49D3AF"><enum>(11)</enum><text display-inline="yes-display-inline">the capacity of the aerospace supply chain to manufacture necessary equipment;</text></paragraph> <paragraph id="HD9FACBAB0C254560BEDB58173AF36C4D"><enum>(12)</enum><text display-inline="yes-display-inline">the use of existing air traffic control deviation authorization tools to implement the requirement in subsection (g)(2);</text></paragraph> 
<paragraph id="H410EA53346F14531B39501C33DEB43EF"><enum>(13)</enum><text display-inline="yes-display-inline">the requirements for the final rule as specified in subsection (d);</text></paragraph> <paragraph id="H0DD64E1A82EA4D36941278E1E722E7B0"><enum>(14)</enum><text display-inline="yes-display-inline">if available at the time of consideration, the results of the studies on ADS–B Out equipage and development of low-cost voluntary ADS–B as required by sections 808 and 810 of FAA Reauthorization Act of 2024 (<external-xref legal-doc="public-law" parsable-cite="pl/118/63">Public Law 118–63</external-xref>); and</text></paragraph> 
<paragraph id="H4F5B9670C73D47BAB4D567C45616097B"><enum>(15)</enum><text>any other considerations the Administrator determines appropriate.</text></paragraph></subsection> <subsection id="H9A828A46E27144D08DF2181D282B75C6"><enum>(d)</enum><header>Requirements for final rule</header><text>In issuing the final rule required under subsection (a), the Administrator shall—</text> 
<paragraph id="H92B4C3B64CBF4EB3B603A91AE4DEB695"><enum>(1)</enum><text>establish performance requirements for equipping collision prevention technology that, as determined by the Administrator, are appropriate for the covered aircraft and the operations, including the operating environment;</text></paragraph> <paragraph id="HDBC3C44CCEA744BAB24AB3CDC9C1EC60"><enum>(2)</enum><text>in establishing the performance requirements described in paragraph (1)—</text> 
<subparagraph id="HEDAAE14E761D48C78935B1591B237D89"><enum>(A)</enum><text>require such technology be configured to provide visual and audible alerting to the pilot and flight crew;</text></subparagraph> <subparagraph id="HC87FF9821790451CA29E7790F82D7E0F"><enum>(B)</enum><text display-inline="yes-display-inline">consider the field of view of the pilots, human factors, and, if applicable, mounting method of such technology, to ensure that such technology can be readily utilized and has minimal risk of unexpected detachment;</text></subparagraph> 
<subparagraph id="H9BACDE44DAD54AD99C008EA0C743B67F"><enum>(C)</enum><text>consider the reliability and resiliency of alerts in environments where inputs or signals, including GPS, can be jammed or spoofed; and</text></subparagraph> <subparagraph id="H78BEFC609DC340A49F3F25330C63F5B8"><enum>(D)</enum><text display-inline="yes-display-inline">consider the utilization of existing antenna locations or the placement of new antenna used to receive and, if applicable, transmit, data used in collision prevention technology;</text></subparagraph></paragraph> 
<paragraph id="H4CC831A559D94F64AA614B65D01FB97C"><enum>(3)</enum><text>identify existing or issue additional relevant guidance or technical standard orders to carry out the requirements of this section; and</text></paragraph> <paragraph id="HF8DDA453536E437AAD1E24657DFD92FA"><enum>(4)</enum><text display-inline="yes-display-inline">establish an effective date not later than December 31, 2031, for equipping the covered aircraft with technology described in subsection (a) that reflects various aircraft types, appropriate maintenance cycles, and required updates to appropriate guidance for such technology after certification of such technologies.</text></paragraph></subsection> 
<subsection id="H51EC32EBB17D4A4588740E51CD15D778"><enum>(e)</enum><header>Equivalent level of safety</header><text display-inline="yes-display-inline">In issuing the final rule required under this section, the Administrator shall allow for the use of any collision prevention technology (including technology that uses portable ADS–B In receivers or other equipment that displays on an existing or future portable device, electronic flight bag, or panel mounted display) available for use at the time of the effective date established in subsection (d)(4), if the Administrator determines it provides an equivalent level of safety as the requirements of the final rule issued pursuant to subsection (a).</text></subsection> <subsection id="HA39A3D48A5D14A5B951B122322ACE5E8"><enum>(f)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">The Administrator shall provide technical assistance to facilitating equipage across the entire fleet of affected aircraft to provide support for affected aircraft operators in complying with the requirements of this section.</text></subsection> 
<subsection id="H66BA0B506D644E04ABA7D0E20E22F65D"><enum>(g)</enum><header>Covered aircraft defined</header><text>In this section, the term <term>covered aircraft</term>—</text> <paragraph id="HC613C9619BE5413DA3647B54771F556B"><enum>(1)</enum><text display-inline="yes-display-inline">means any non-military aircraft, except a selected aircraft as defined in section 102, that is required to be equipped with ADS–B Out under section 91.225 of title 14, Code of Federal Regulations; and</text></paragraph> 
<paragraph id="HC39FC569DC674CCBACA3ADD0DBB8F251" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">excludes aircraft that have a limited category special airworthiness certificate or an experimental airworthiness certificate, provided the pilot of such aircraft is authorized to deviate from the requirements of this section by air traffic control in the same manner ADS–B Out deviations are approved under section 91.225(g) of title 14, Code of Federal Regulations.</text></paragraph></subsection></section> <section id="HBFA3E572379C4712A60F71A8CB1BDC8B"><enum>105.</enum><header>Prohibition on certain use of ADS–B data</header> <subsection id="H6E28325F45654711A54ECFCD1A241DE9"><enum>(a)</enum><header>In general</header> <paragraph id="H1EDA27A598054F968BEBE9AA9ADF40C3"><enum>(1)</enum><header>Limitation on use of data</header><text display-inline="yes-display-inline">Data from Automatic Dependent Surveillance–Broadcast may not be used by any person, governmental agency, or other entity to identify aircraft for the purpose of obtaining revenue from the owner or operator of such aircraft, without the consent of such owner or operator.</text></paragraph> 
<paragraph id="H16FA9CB1E7A94427BFAD90BEF622BEE9"><enum>(2)</enum><header>Use of data by air traffic controller</header><text display-inline="yes-display-inline">Automatic Dependent Surveillance–Broadcast data may be used to assist air traffic controllers in tracking aircraft and improving air traffic safety and efficiency.</text></paragraph></subsection> <subsection id="HB800B714499E4367AE75BDBFBA6EBD92"><enum>(b)</enum><header>Limit on use of ADS–B data</header><text display-inline="yes-display-inline">Section 46101(c)(1) of title 49, United States Code, is amended by striking <quote>the Administrator of the Federal Aviation Administration may not</quote> and inserting <quote>neither the Administrator of the Federal Aviation Administration nor any other Federal, State, local, territorial, or Tribal official may</quote>.</text></subsection></section> 
<section id="H72F6140613E340C6957C0C626855ACB4"><enum>106.</enum><header>Rulemaking accountability</header> 
<subsection id="HEAF39111C9CC435CAA7E04B2E91A44BF"><enum>(a)</enum><header>Public dashboard</header><text display-inline="yes-display-inline">The Secretary shall establish, maintain, and make available, on a publicly available website of the Department of Transportation, a dashboard that displays, for the rulemakings required in sections 102, 103, and 104—</text> <paragraph id="HB3DC306551F44198A90EC728AC302EB1"><enum>(1)</enum><text>dates of publication and links to the minimum operating performance standards referenced by and developed pursuant to such sections;</text></paragraph> 
<paragraph id="HD3B930BE6D0C4B94A159B7F733BD5967"><enum>(2)</enum><text>the date of establishment, membership roster, and tasking memoranda (or similar document) for rulemaking committees established pursuant to such sections;</text></paragraph> <paragraph id="H51B7103CF0FF47738C353EC1A196D25E"><enum>(3)</enum><text>deadlines and actual dates for the submission for all required rulemaking committee reports to the Administrator or Congress;</text></paragraph> 
<paragraph id="HD7EA238E536C4006B2962E499FC80F00"><enum>(4)</enum><text>publication dates of and a link to any—</text> <subparagraph id="HD7541D62FB6444F5A2E0992A4353EF1B" display-inline="no-display-inline"><enum>(A)</enum><text>advanced notice of proposed rulemakings published pursuant to such sections;</text></subparagraph> 
<subparagraph id="H27D9D18A797C4875A850811B12D89CFD"><enum>(B)</enum><text>notice of proposed rulemakings published pursuant to such sections; and</text></subparagraph> <subparagraph id="H4BE8158CA51B452FBD98BC445B9BBCE6"><enum>(C)</enum><text>revised notice of proposed rulemakings published pursuant to rulemakings described in subparagraphs (A) and (B);</text></subparagraph></paragraph> 
<paragraph id="H6A353CA4DBCC4F5FAA587C327DAD8597"><enum>(5)</enum><text>the opening and closing of public comment periods and a link to public comments;</text></paragraph> <paragraph id="HE2CA53FDE13F4F9CA50B8A83F7F56733"><enum>(6)</enum><text>the publication of and a link to any final rule issued pursuant to such sections;</text></paragraph> 
<paragraph id="H28E0941F3EE84384811135DA2088572B"><enum>(7)</enum><text>all associated official correspondence with the National Transportation Safety Board regarding related safety recommendations; and</text></paragraph> <paragraph id="HCF5460B6263E46FFB7230787A6B67CBA"><enum>(8)</enum><text>any additional information the Secretary determines will increase transparency without delaying the publication of a final rule.</text></paragraph></subsection> 
<subsection id="H039247DFF29B4370AF7A711DE49F905D"><enum>(b)</enum><header>Congressional and family briefing</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, and every 180 days thereafter until the final rules required pursuant to sections 102, 103, and 104 are issued, the Administrator shall brief the appropriate committees of Congress and the families of the victims of the midair collision referenced in National Transportation Safety Board Aviation Investigation Report AIR–26–02 adopted on January 27, 2026 on the progress in issuing such final rules.</text></subsection> <subsection id="H0AD913E0C33447FCA9189147E334A4B3"><enum>(c)</enum><header>Congressional oversight in case of failure to meet deadlines</header> <paragraph id="HE5034779F4A847D0B3C24B562AC46A84"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If the Administrator fails to meet any rulemaking deadline established in sections 102, 103, and 104, the Administrator shall brief the appropriate committees of Congress in person not later than 4 weeks after the date on which such deadline is not met.</text></paragraph> 
<paragraph id="H0680D641B29A4D038DC327CAA7CF7CB7"><enum>(2)</enum><header>Deadline for initial outreach and coordination</header><text display-inline="yes-display-inline">Not later than 4 days after the date described in paragraph (1), the Administrator shall begin initial outreach to and coordination with the appropriate committees of Congress to arrange and organize logistics of the briefing required under paragraph (1).</text></paragraph> <paragraph id="H6A1ACFB1E5A94781A8BFD423EC9BF3D6"><enum>(3)</enum><header>Format and time of briefing</header><text>The briefing required under paragraph (1) shall be in a format and at a time to be determined by the appropriate committees of Congress. </text></paragraph></subsection></section> 
<section id="HD8E0EC203AE848D38D73149816188E1E"><enum>107.</enum><header>Time-on-position limits</header> 
<subsection id="HBA1B00C956DE4A88BF2130DD80DDFC0E"><enum>(a)</enum><header>Time-on-position limits</header> 
<paragraph id="H461BC6FD299F4CEE94B0745CD17ACEAE"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator, in coordination with organizations representing air traffic controller managers and supervisors, shall establish time-on-position limits for operations supervisory personnel.</text></paragraph> <paragraph id="HE0CA59E7D3FB496AAE78F430025F03DB"><enum>(2)</enum><header>Considerations</header><text>In developing the limits described in paragraph (1), the Administrator shall—</text> 
<subparagraph id="H1914F02609914BF3AF0C8F8783EAA130"><enum>(A)</enum><text display-inline="yes-display-inline">evaluate appropriate time-on-position limits for operations supervisory personnel, prioritizing the evaluation of such limits at Ronald Reagan Washington National Airport and other air traffic facilities with high volumes of mixed rotorcraft and airplane traffic;</text></subparagraph> <subparagraph id="HE9BDDEC5D1E540C0A98EBE8B570CDBCD"><enum>(B)</enum><text display-inline="yes-display-inline">establish such limits for Air Traffic Organization operations supervisory personnel at Ronald Reagan Washington National Airport and other air traffic facilities with high volumes of mixed helicopter and airplane traffic;</text></subparagraph> 
<subparagraph id="H7C26983D94F74D989CB47D4F3570A714"><enum>(C)</enum><text display-inline="yes-display-inline">develop guidance for district and facility-level management to adapt such limits to account for their own staffing and local standard operating procedures;</text></subparagraph> <subparagraph id="H8F1C3EF6EDAB4C849CE78839A0B644F6"><enum>(D)</enum><text>consider the operational needs and staffing levels of the air traffic facilities described in the previous subparagraphs to ensure effective oversight and monitoring of safety critical operations;</text></subparagraph> 
<subparagraph id="HC57E525A8FA74EF9898F8F8848D9064F"><enum>(E)</enum><text display-inline="yes-display-inline">consider air traffic control specialists performing watch supervision in the controller-in-charge position; </text></subparagraph> <subparagraph id="HD3DEEEE3470448FB914E77F66B857216"><enum>(F)</enum><text>consider requirements of FAA Order JO 7210.3EE, titled <quote>Facility Operation and Administration</quote>, issued on February 20, 2025, or any successor document, and FAA Order JO 7110.65BB, titled <quote>Air Traffic Control</quote>, issued on February 20, 2025, or any successor document; </text></subparagraph> 
<subparagraph id="H86F8C821D6B54621BDF98F98C504B003"><enum>(G)</enum><text>consider data, reports, and best practices pertaining to human factors; and</text></subparagraph> <subparagraph id="H4E9FD67FB2EA43EDAE40A57E13B761CF"><enum>(H)</enum><text>consider any other items determined appropriate by the Administrator.</text></subparagraph></paragraph> 
<paragraph id="HC0FBCAE7425D463EBF6FC9BA3C964BCF"><enum>(3)</enum><header>Consultation</header><text display-inline="yes-display-inline">The Administrator may consult with the exclusive bargaining representative of air traffic controllers certified under section 7111 of title 5, United States Code. </text></paragraph></subsection> <subsection id="HDAA8C66862364D81BED39A1C20B88B6D"><enum>(b)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to interfere with any agreement between a governmental agency and the exclusive bargaining representative of air traffic controllers certified under section 7111 of title 5, United States Code, section 7106(a) of title 5, United States Code, or section 40122 of title 49, United States Code.</text></subsection> 
<subsection id="H787906D750C94064826F966686DC7071"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HC833757A60254E68A62356053547074E"><enum>(1)</enum><header>Controller-in-charge</header><text display-inline="yes-display-inline">The term <term>controller-in-charge</term> means the bargaining unit air traffic control specialist responsible for providing watch supervision for the continuous operation of an air traffic control facility or area in any case in which operations supervisory personnel are not available.</text></paragraph> 
<paragraph id="H49575AD683F142C894197FDA3B2B3C65"><enum>(2)</enum><header>Operational oversight</header><text>The term <term>operational oversight</term> means the duty of the individual in charge of the operation to effectively lead and manage the delivery of air traffic services by maintaining intentional engagement, situational awareness, and accountability within the area of supervision.</text></paragraph> <paragraph id="H67E2CFD3F5A74F3CA40CEE04D3712EFB"><enum>(3)</enum><header>Operations supervisory personnel</header><text>The term <term>operations supervisory personnel</term> means managerial personnel responsible for the direct supervision of air traffic control operational personnel.</text></paragraph></subsection></section> 
<section id="H23E95F0773AC46C688EA4B818B0E2855"><enum>108.</enum><header>Controller threat and error management training</header> 
<subsection id="H1B25A85CE83945C7BCE1AED830477873"><enum>(a)</enum><header>In general</header><text>Not later than 9 months after the date of enactment of this Act, the Administrator shall, in coordination with the exclusive bargaining representative of air traffic controllers certified under section 7111 of title 5, United States Code, develop and implement initial, recurrent, and refresher training for air traffic controllers on threat and error management that is instructor-led and scenario-based. </text></subsection> <subsection id="HF9288C1254CB4E508D6036540DFD5274"><enum>(b)</enum><header>Consultation</header><text>In developing the training under subsection (a), the Administrator shall consult with representatives of—</text> 
<paragraph id="H106441E3645742529D1622C9F7B91A70"><enum>(1)</enum><text>organizations representing air traffic control managers and operations supervisors;</text></paragraph> <paragraph id="H3F3A2EBD6386487D9BDA04A93C678C0D"><enum>(2)</enum><text>aviation safety experts with specific knowledge of—</text> 
<subparagraph id="H0257E11A26F546A18813D6BA8378C322"><enum>(A)</enum><text display-inline="yes-display-inline">human factors and human decision making in realistic operational settings; and</text></subparagraph> <subparagraph id="H4503DD20FC554F5B8536EF89688B8AC9"><enum>(B)</enum><text>threat and error management best practices and policies; and</text></subparagraph></paragraph> 
<paragraph id="H1F5153EA99A345B79CB214B9902FD03E"><enum>(3)</enum><text>a career representative from the National Transportation Safety Board with subject matter expertise as an observer.</text></paragraph></subsection> <subsection id="HB876865F74754093A29C38CD737E86F9"><enum>(c)</enum><header>Considerations</header><text>In developing the training described in subsection (a), the Administrator shall consider, at a minimum—</text> 
<paragraph id="H5470828377EC477EB356378AC2E6B97B"><enum>(1)</enum><text display-inline="yes-display-inline">the findings and recommendations of the National Transportation Safety Board, including as contained in the final aviation investigation report, AIR–26–02, adopted on January 27, 2026, such as—</text> <subparagraph id="HE7CD0599D43044F8A5548CA7E0795DE4"><enum>(A)</enum><text>training controllers to continuously monitor their environment to more quickly and accurately identify threats; </text></subparagraph> 
<subparagraph id="H663A68582DCB400B88BC7490504EEFEE"><enum>(B)</enum><text>promoting team communication to ensure that communications are clear, timely, and assertive; </text></subparagraph> <subparagraph id="H097D03FD3E8E442298C9E885B5C9BAF9"><enum>(C)</enum><text>emphasizing effective scanning habits; </text></subparagraph> 
<subparagraph id="H3BA55FC2A7CF4A61A0AD1DB8782F8AC0"><enum>(D)</enum><text>recognizing patterns in the development of adverse events; and </text></subparagraph> <subparagraph id="H50C8F4EA6C3D44B59CE95E357C028FB8"><enum>(E)</enum><text>enhanced decision making under stress by developing habits that balance procedural compliance with problem-solving; </text></subparagraph></paragraph> 
<paragraph id="H07EC38BB79A4426E8752D0F5A978FDFF"><enum>(2)</enum><text>the requirements of—</text> <subparagraph id="H7510AD1F36DF46C291C3D85946A25242"><enum>(A)</enum><text>FAA Order JO 3120.4S, titled <quote>Air Traffic Technical Training</quote>, issued on August 28, 2024;</text></subparagraph> 
<subparagraph id="H0EE631E45DE94650A7979DB826810419"><enum>(B)</enum><text>FAA Order JO 7210.3EE, titled <quote>Facility Operation and Administration</quote>, issued on February 20, 2025;</text></subparagraph> <subparagraph id="H23B73691B013403D80C5A5D15A121BB3"><enum>(C)</enum><text>FAA Order JO 7110.65BB, titled <quote>Air Traffic Control</quote>, issued on February 20, 2025; and</text></subparagraph> 
<subparagraph id="HA9CE73164EBD44029C4A797BC1320DBD"><enum>(D)</enum><text>other relevant air traffic control standards, guidance, and policies;</text></subparagraph></paragraph> <paragraph id="H51BE8053198242BD8B634A41624F5354"><enum>(3)</enum><text>the frequency of the recurrent and refresher training described in subsection (a) and whether frequency should be increased for air traffic controllers in facilities managing high-complexity or high-volume airspace;</text></paragraph> 
<paragraph id="HB8533745B7454520AACE5241E80EF262"><enum>(4)</enum><text display-inline="yes-display-inline">data, reports, and peer-reviewed studies on human factors and threat and error management best practices;</text></paragraph> <paragraph id="H818282AF1BE0450A81CF06751179B193"><enum>(5)</enum><text display-inline="yes-display-inline">the appropriate use of tower simulator systems and other advanced training technologies to supplement the recurrent training described in subsection (a), including the use of data analytics from such systems and technologies to individualize instruction;</text></paragraph> 
<paragraph id="H7CD7C0A6884E47F985A51AABCD521CAF"><enum>(6)</enum><text display-inline="yes-display-inline">the use of data analytics to identify systemic gaps in the recurrent and refresher training described in subsection (a) and to dynamically enhance training curriculum and techniques;</text></paragraph> <paragraph id="HB93E6CBFEE8A400683F52212F6BCC5F5"><enum>(7)</enum><text>data gathered from aviation safety reporting programs; and</text></paragraph> 
<paragraph id="HFAD97AF0F48649DDA691E63408A3AF3E"><enum>(8)</enum><text>any other item determined appropriate by the Administrator.</text></paragraph></subsection> <subsection id="H947BD3AF46F7415C8901BE5A33B28045"><enum>(d)</enum><header>Implementation</header><text>Not later than 90 days after the development of the training under subsection (a), the Administrator shall revise the orders of the FAA described in subsection (c)(2), or any successor documents, and any corresponding policy or guidance materials, to reflect the requirements of this section.</text></subsection> 
<subsection id="H88035BFA1A314426962129174648D078"><enum>(e)</enum><header>Briefing to Congress</header><text>Not later than 1 year after the training requirements under this section and section 109 are established, the Administrator shall brief the appropriate committees of Congress on the implementation of such training and any potential recommendations for improvements.</text></subsection> <subsection id="H79115D11B80A46E09A6CD88430AD4B21"><enum>(f)</enum><header>Threat and error management defined</header><text>In this section, the term <term>threat and error management</term> has the meaning described in chapter 6 of the Risk Management Handbook (FAA H–8083–2A) or any successor document.</text></subsection></section> 
<section id="H09C9508F95AB41D1B6E62B2D768B1AC8"><enum>109.</enum><header>Controller visual separation training</header> 
<subsection id="HFB4EDD3C486C4EACADE57485ADBADE40"><enum>(a)</enum><header>In general</header><text>Not later than 270 days after the date of enactment of this Act, the Administrator shall, in coordination with the exclusive bargaining representative of air traffic controllers certified under section 7111 of title 5, United States Code, develop and implement initial, recurrent, and refresher training for air traffic controllers on tower-applied and pilot-applied visual separation procedures that is instructor-led and scenario-based.</text></subsection> <subsection id="HB0D96822770F48DEA98233D3A0F1335E"><enum>(b)</enum><header>Consultation</header><text>In developing and implementing the training required under subsection (a), the Administrator shall consult with representatives of—</text> 
<paragraph id="H9447271416E843E1831EE05BC43C079C"><enum>(1)</enum><text>the certified bargaining representative of aviation safety inspectors and engineers for the FAA;</text></paragraph> <paragraph id="H264C1A505F5F48A098C7EED9C956453C"><enum>(2)</enum><text>organizations representing certified collective bargaining representatives of airline pilots;</text></paragraph> 
<paragraph id="HE2FD1D99DADF4E888B7F32EDFCAFF8FF"><enum>(3)</enum><text>organizations representing air traffic control managers and supervisors;</text></paragraph> <paragraph id="H5C99DC98DD6C435E939CA51C2A0C313C"><enum>(4)</enum><text>organizations representing general aviation pilots; and</text></paragraph> 
<paragraph id="H94E56E82ED964FA8B0F61F6FB3130C30"><enum>(5)</enum><text>aviation safety experts with specific knowledge of—</text> <subparagraph id="HC3434221BD40495A9D9497FD088A03E9"><enum>(A)</enum><text>human factors and human decision making in realistic operational settings; and</text></subparagraph> 
<subparagraph id="HE832F56E8AB84F6FB6BFD0B2E3550046"><enum>(B)</enum><text>tower-applied and pilot-applied visual separation procedures and regulations.</text></subparagraph></paragraph></subsection> <subsection id="H5FA2F61AF4344A49BB1C937D6F187B84"><enum>(c)</enum><header>Considerations</header><text>In developing the training under subsection (a), the Administrator shall consider, at a minimum—</text> 
<paragraph id="H7A8796A5E05F43FD87209ECEA9A6687D"><enum>(1)</enum><text>the findings and recommendations made by the National Transportation Safety Board, including as contained in the final aviation investigation report, AIR–26–02, adopted on January 27, 2026;</text></paragraph> <paragraph id="H45F62773EE2642419A5CCDF08D26B3D6"><enum>(2)</enum><text>the requirements of—</text> 
<subparagraph id="HD227A9926F614B56BDB0A730C12546E0"><enum>(A)</enum><text>FAA Order JO 3120.4S, titled <quote>Air Traffic Technical Training</quote>, issued on August 28, 2024;</text></subparagraph> <subparagraph id="HF60308BFA8F04B208145B94002AB8E13"><enum>(B)</enum><text>FAA Order JO 7210.3EE, titled <quote>Facility Operation and Administration</quote>, issued on February 20, 2025;</text></subparagraph> 
<subparagraph id="H8435EB0BCC1C4F99B4856FABD2A51C04"><enum>(C)</enum><text>FAA Order JO 7110.65BB, titled <quote>Air Traffic Control</quote>, issued on February 20, 2025; and</text></subparagraph> <subparagraph id="H8D69F152D8BB47088CC8166A5F7394C0"><enum>(D)</enum><text>other relevant air traffic control standards, guidance, and policies;</text></subparagraph></paragraph> 
<paragraph id="H009A3A5048FC41618DE08E0CC984D862" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">the frequency of the recurrent and refresher training described in subsection (a), including—</text> <subparagraph id="HA3735688FE3B4791941CB54027C95D0F"><enum>(A)</enum><text display-inline="yes-display-inline">whether such frequency should be increased for air traffic controllers in facilities managing high-complexity or high-volume airspace; and</text></subparagraph> 
<subparagraph id="H2AE4CD200259440697B2E5343B59FC9D"><enum>(B)</enum><text>the need for advance training and guidance ahead of any changes to FAA visual separation policies;</text></subparagraph></paragraph> <paragraph id="H416FFB73077043E881555D03B3337520"><enum>(4)</enum><text>the appropriate use of tower simulator systems and other advanced training technologies to supplement the recurrent and refresher training described in subsection (a), including the use of data analytics from such systems and technologies to individualize instruction;</text></paragraph> 
<paragraph id="H7FCB2CB9B2EC4B2C99C4183A1E76B989"><enum>(5)</enum><text>the use of data analytics to identify systemic gaps in the recurrent and refresher training described in subsection (a) and to dynamically enhance training curriculum and techniques;</text></paragraph> <paragraph id="HA6CC1D78AA484785B0D158D9B63EC4B7"><enum>(6)</enum><text>data gathered from aviation safety reporting programs; and</text></paragraph> 
<paragraph id="H5CE13DEA9A6948FAAD366D529C156225"><enum>(7)</enum><text>any other item determined appropriate by the Administrator.</text></paragraph></subsection> <subsection id="HFDC6EBF36B7943EFB0C5705496B404EE"><enum>(d)</enum><header>Implementation</header><text display-inline="yes-display-inline">Not later than 90 days after the development of the training under subsection (a), the Administrator shall revise the orders of the FAA described in subparagraph (c)(2), or any successor documents, and any corresponding policy or guidance materials, to reflect the requirements of this section.</text></subsection></section> 
<section id="H5072DB020E6743559C538D81EB34EE09"><enum>110.</enum><header>Safety risk assessment tool</header> 
<subsection id="HE72B514AE4564FE283C8787821C5BA2B"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall develop a safety risk assessment tool for use by air traffic controllers, including by supervisory air traffic control personnel, to assist in airspace risk identification, mitigation, and operational decision making.</text></subsection> <subsection id="H8013065CAFB941C08E2EAAFA9CC1B62B"><enum>(b)</enum><header>Considerations</header><text>In carrying out subsection (a), the Administrator shall consider, at a minimum—</text> 
<paragraph id="H9D4F318021634B8D985CD5DBC07A60F8"><enum>(1)</enum><text>the development of a safety risk assessment tool capable of supporting air traffic controllers in—</text> <subparagraph id="HE154FA4B2B1A42D999B2EFB00406C006"><enum>(A)</enum><text>identifying safety risks;</text></subparagraph> 
<subparagraph id="H32FEBE4F8B534353AF0A3A995727D350"><enum>(B)</enum><text>analyzing the impact of and prioritizing such risks; and</text></subparagraph> <subparagraph id="H5BB7B523A1AC4180A0E51EF6AB02CEB1"><enum>(C)</enum><text>developing strategies to reduce or eliminate such risks in real time;</text></subparagraph></paragraph> 
<paragraph id="HB296643D61004BDB9271CC07EEBD4CD5"><enum>(2)</enum><text>data, reports, studies, and best practices on threat and error management;</text></paragraph> <paragraph id="H96985A87066847EAB0608E9BD999820C"><enum>(3)</enum><text>findings and recommendations of the—</text> 
<subparagraph id="HC9385133E3734977B76977B8E705D67B"><enum>(A)</enum><text display-inline="yes-display-inline">National Transportation Safety Board, including as contained in the final aviation investigation report, AIR–26–02, adopted on January 27, 2026;</text></subparagraph> <subparagraph id="H51BD871C6C004BF6B8DF1B85FA296865"><enum>(B)</enum><text display-inline="yes-display-inline">National Airspace System Safety Review Team as contained in the final report titled <quote>Discussion and Recommendations to Address Risk in the National Airspace System</quote>, issued on November 15, 2023; and</text></subparagraph> 
<subparagraph id="HFA723F72F7AC4179B2F673BCC9CEE2A5"><enum>(C)</enum><text display-inline="yes-display-inline">frontline manager workload study authorized under section 412 of the FAA Reauthorization Act of 2024 (<external-xref legal-doc="public-law" parsable-cite="pl/118/63">Public Law 118–63</external-xref>);</text></subparagraph></paragraph> <paragraph id="H713326F36C314C489DADEC11C4A9059B"><enum>(4)</enum><text>air traffic facility type and staffing level;</text></paragraph> 
<paragraph id="H1A83B227544E4645B5221865FA4DB07C"><enum>(5)</enum><text>risk assessment guidance, policies, and regulations of the Administration in place prior to the date of enactment of this Act;</text></paragraph> <paragraph id="H7D35C4A5A8224E1F95B881FD026EAD24"><enum>(6)</enum><text>data gathered from aviation safety reporting programs;</text></paragraph> 
<paragraph id="HD6B41FC5E97F42C9B21D435A9FCCD5F4"><enum>(7)</enum><text>best practices or similar relevant risk assessment tools and methods used by foreign civil aviation authorities;</text></paragraph> <paragraph id="H91F8B79CD4CC49B0BA2CC04A284B948A"><enum>(8)</enum><text display-inline="yes-display-inline">the feasibility of leveraging commercially available products or technologies that may be utilized to develop such tool;</text></paragraph> 
<paragraph id="H6623C17CC50741418D606E80F085F2F6"><enum>(9)</enum><text>benefits of incorporating such tool into a Common Automation Platform; and</text></paragraph> <paragraph id="H685BAA79467D4907B0361688E2DB8714"><enum>(10)</enum><text>any other factors determined relevant by the Administrator.</text></paragraph></subsection> 
<subsection id="H7D18A40BB6F747ABAA173401646ABD08"><enum>(c)</enum><header>Coordination</header><text>In developing the safety risk assessment tool under subsection (a), the Administrator shall coordinate with—</text> <paragraph id="HADE562875AF34F36A4C199270E967817"><enum>(1)</enum><text>organizations representing air traffic control supervisors and managers;</text></paragraph> 
<paragraph id="H0187C467C4784EDBBC88C3866D03BD1C"><enum>(2)</enum><text>the exclusive bargaining representative of air traffic controllers certified under section 7111 of title 5, United States Code;</text></paragraph> <paragraph id="H9D9CF76DCCF6433796EAA4B6786BCADC"><enum>(3)</enum><text>aviation safety experts with specific knowledge of threat and error management;</text></paragraph> 
<paragraph id="H550F29D28FB14096A878DF9ADDE93BA5"><enum>(4)</enum><text display-inline="yes-display-inline">aviation safety experts with specific knowledge of human factors and human decision making in realistic operational settings; </text></paragraph> <paragraph id="HCD33792E550A448DABB29B51FEAEBF5E" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">organizations representing operators of Federal contract towers pursuant to section 47124 of title 49, United States Code; and </text></paragraph> 
<paragraph id="H082A0CCA4C9C4AA78A573CFD5DBF6ED7"><enum>(6)</enum><text>any other stakeholders determined relevant by the Administrator.</text></paragraph></subsection> <subsection id="H9C2AC2D4056345FF8AE59017F285B26C"><enum>(d)</enum><header>Briefing to Congress</header><text>Not later than 18 months after the date of enactment of this Act, the Administrator shall brief the appropriate committees of Congress on—</text> 
<paragraph id="H3CB144EF1A6B467AB5C0C82757FB281A"><enum>(1)</enum><text>the development of the safety risk assessment tool required under this section and recommendations for implementation;</text></paragraph> <paragraph id="HC2F397A71C3D4A7B92CB3855B223D2E6"><enum>(2)</enum><text>the progress of implementation described in subsection (e); and</text></paragraph> 
<paragraph id="H4A98A70047A342619D0E8364228864BE"><enum>(3)</enum><text>any recommendations to improve the deployment of the safety risk assessment tool.</text></paragraph></subsection> <subsection id="H9EDE6F6100BF480B96B6D077F9EA6626"><enum>(e)</enum><header>Implementation</header><text>The Administrator shall deploy the safety risk assessment tool developed under this section at—</text> 
<paragraph id="HBD9E3ECB49564EA49D5E788C762EC28A"><enum>(1)</enum><text display-inline="yes-display-inline"> the Ronald Reagan Washington National Airport air traffic control tower, not later than 1 year after the development of the safety risk assessment tool;</text></paragraph> <paragraph id="H4ECCD1816C4C4F43AEEA047231D234C2"><enum>(2)</enum><text>air traffic control facilities with high volumes of mixed rotorcraft and airplane traffic not later than 18 months after the development of the safety risk assessment tool; and</text></paragraph> 
<paragraph id="H387489A6E1274C53877F55120F023D6B"><enum>(3)</enum><text>any remaining air traffic control facilities not later than 2 years after the development of the safety risk assessment tool.</text></paragraph></subsection> <subsection id="HC4AB3A5BCB624B49BA39DE50D56C384F"><enum>(f)</enum><header>Threat and error management defined</header><text>In this section, the term <term>threat and error management</term> has the meaning described in chapter 6 of the Risk Management Handbook (FAA H–8083–2A) or any successor document.</text></subsection></section> 
<section id="H3B249BAF4E684E90970E7FEA64E11446"><enum>111.</enum><header>Operational rates at Ronald Reagan Washington National Airport</header> 
<subsection id="H7B010240733E415F813BB53BB58B6DDE"><enum>(a)</enum><header>In general</header><text>Not later than 30 days after the date of enactment of this Act, the Administrator shall initiate an assessment of the aircraft arrival rate at Ronald Reagan Washington National Airport.</text></subsection> <subsection id="HA80C538287374035B9DDF6EA50FEA307"><enum>(b)</enum><header>Considerations</header><text>In conducting the assessment described in subsection (a), the Administrator shall consider—</text> 
<paragraph id="H33536F85DC28440590FA5348EDEAF91A"><enum>(1)</enum><text>airspace complexity;</text></paragraph> <paragraph id="H7DC7E7F9296947D09DF87B7516957E3B"><enum>(2)</enum><text>airfield limitations;</text></paragraph> 
<paragraph id="HCEF7B17BB98449B3A8977055262F7A73"><enum>(3)</enum><text>mixed-fleet operations;</text></paragraph> <paragraph id="HA117B45575C44E32A1000B2387F6CEE6"><enum>(4)</enum><text>traffic volume;</text></paragraph> 
<paragraph id="H8BED477641CE4EC9B8F312804EF46352"><enum>(5)</enum><text>air carrier scheduling practices;</text></paragraph> <paragraph id="HAE39B216E03F4F23815246A7EF2F2464"><enum>(6)</enum><text>the operational capacity of such airport;</text></paragraph> 
<paragraph id="H6D958D787E074117B840A7524CC066FE"><enum>(7)</enum><text>the current hourly instrument flight rules allocation practice at such airport;</text></paragraph> <paragraph id="H718A99A30F4F4018BFC6FB76BCFBCD5D"><enum>(8)</enum><text>expertise provided by the Air Traffic Organization; and</text></paragraph> 
<paragraph id="HFD6EE3D7E51E49DDBC77CFD303BA5AE6"><enum>(9)</enum><text>any other considerations the Administrator determines appropriate.</text></paragraph></subsection> <subsection id="H0681DA263B7C4CC38C728A3FB449F69D"><enum>(c)</enum><header>Completion of assessment</header><text>Not later than 180 days after the Administrator initiates the assessment under subsection (a), the Administrator shall complete and submit to the appropriate committees of Congress such assessment, including any related findings and recommendations.</text></subsection> 
<subsection id="H71544AFD2BD8437DA6FB707C143C87D7"><enum>(d)</enum><header>Rulemaking</header><text>Not later than 30 days after completing the assessment pursuant to subsection (c), and taking such assessment into account, the Administrator shall initiate a rulemaking proceeding to update subpart K of part 93 of title 14, Code of Federal Regulations, to require allocated instrument flight rules operations at Ronald Reagan Washington National Airport to be prescribed in periods not greater than 30 minutes to ensure such airport does not exceed safe capacity.</text></subsection> <subsection id="HB0D7C08AEFB3428BA3FEF6AB17745412"><enum>(e)</enum><header>Consultation</header><text>In conducting the rulemaking required under subsection (d), the Administrator shall consult with the following:</text> 
<paragraph id="H1F319D5B3AAE4906B7495191E4FD59A1"><enum>(1)</enum><text>Any air carrier operating under part 121 of title 14, Code of Federal Regulations, with scheduled operations at Ronald Reagan Washington National Airport, including regional air carriers and low-cost and ultra-low-cost air carriers.</text></paragraph> <paragraph id="H55649256910E46B8890E7E038EC327BE" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">Air carriers operating under parts 91, including subpart K, and 135 of title 14, Code of Federal Regulations, authorized to conduct non-scheduled operations at Ronald Reagan Washington National Airport.</text></paragraph> 
<paragraph id="H3FE855BD4EA3456BB1BC0F891A37D994"><enum>(3)</enum><text>The exclusive bargaining representatives of air traffic controllers certified under section 7111 of title 5, United Sates Code.</text></paragraph> <paragraph id="HE4969910E4EC4F48B4065BF74AB59E29"><enum>(4)</enum><text>The Metropolitan Washington Airports Authority.</text></paragraph> 
<paragraph id="HEB60813CEDD24246BF00E70975116548"><enum>(5)</enum><text>Any other stakeholders the Administrator determines appropriate.</text></paragraph></subsection></section> <section id="HC605C92CF2E24CBDACEA25982D4BBBE4" section-type="subsequent-section"><enum>112.</enum><header>Time-based flow management</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator shall implement operational use of the time-based flow management system at Potomac Consolidated Terminal Radar Approach Control and associated air traffic control towers.</text></section> 
<section id="HB144723DA6D04E3C94A3772987183C81" section-type="subsequent-section"><enum>113.</enum><header>Air traffic control facility levels</header> 
<subsection id="H140ECD0F79334C13A47B15C265AB3966"><enum>(a)</enum><header>Review of air traffic control facility level criteria</header> 
<paragraph id="H0F66B5A10B10436C8ED110A3FBB1B3CE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator and the exclusive bargaining representative of air traffic controllers certified under section 7111 of title 5, United States Code, (in this section referred to as the <quote>Parties</quote>) may, at their joint election, review and advise, as agreed to, the criteria and procedures used to assess, determine, and validate the facility pay levels of air traffic control facilities.</text></paragraph> <paragraph id="HAC154DFA734C4259A187956717ABA21F"><enum>(2)</enum><header>Considerations</header><text>In conducting a review under paragraph (1), the Parties may consider—</text> 
<subparagraph id="HE8B47E4CFCA54A36A139E21F3EAD69E1"><enum>(A)</enum><text display-inline="yes-display-inline">the many variables that may affect the difficulty and complexity of air traffic control work, including technological advancements, aviation industry trends, and the modification or extension of air traffic control services;</text></subparagraph> <subparagraph id="HB95602ECFC4F4033BD46700B752E6CC9"><enum>(B)</enum><text>weights and add-ons used to calculate the traffic count index and other related formulas for air traffic control facilities; and</text></subparagraph> 
<subparagraph id="HF8A5B8244B1C4C98A73C1015A0AAA799"><enum>(C)</enum><text>whether new weights and add-ons should be incorporated into such formulas to more accurately reflect the air traffic density and complexity of the facility operations.</text></subparagraph></paragraph></subsection> <subsection id="HA8DA024CC45540BFB17FAB3E61B22848"><enum>(b)</enum><header>Reassessment of air traffic control facility levels</header> <paragraph id="H88E701F6E5094A95AD6979864B625DE9"><enum>(1)</enum><header>Limitation</header><text display-inline="yes-display-inline">No changes to facility pay levels due to data source changes may be implemented until negotiations pursuant to the collective bargaining agreement of the Parties and title 49, United States Code, have been completed. </text></paragraph> 
<paragraph id="H7B7F991D1DD44C63B556444115B97A41"><enum>(2)</enum><header>Application of standard</header><text display-inline="yes-display-inline">Upon completion of a review conducted under subsection (a) and related negotiations pursuant to the collective bargaining agreement of the Parties and title 49, United States Code, the Parties shall apply the standard in accordance with any agreements made pursuant to this section at—</text> <subparagraph id="H1C5857B2B4BA4F3B8E0C87AB34CFBA9F"><enum>(A)</enum><text>the Ronald Reagan Washington National Airport; and</text></subparagraph> 
<subparagraph id="HB4B464F51DB3477A94BF7FE114C8D80D"><enum>(B)</enum><text display-inline="yes-display-inline">all other air traffic control facilities, prioritizing facilities with high volumes of mixed rotorcraft and airplane traffic.</text></subparagraph></paragraph></subsection> <subsection id="HA3B4A9CEDD8740BCA4232E8017803C97"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to interfere with any agreement between a governmental agency and the exclusive bargaining representative of air traffic controllers certified under section 7111 of title 5, United States Code, or section 40122 of title 49, United States Code.</text></subsection></section> 
<section id="H84C8C2F99DAF4B7F96427976823E20E1"><enum>114.</enum><header>Working group to evaluate shared frequency around Ronald Reagan Washington National Airport</header> 
<subsection id="HFCC8D1E6E1A34F7BBC2EDBDF69A24823"><enum>(a)</enum><header>In general</header><text>Not later than 3 months after the date of enactment of this Act, the Administrator shall convene a working group (in this section referred to as the <quote>Working Group</quote>) to conduct a comprehensive evaluation of the safety benefits and risks of requiring all aircraft to use the same communications frequency during any period in which helicopter and local air traffic control positions are combined in the Ronald Reagan Washington National Airport air traffic control tower.</text></subsection> <subsection id="H025092E4733745ACB9F6593D3CD020CC"><enum>(b)</enum><header>Members</header><text>The Working Group convened under subsection (a) shall be comprised of representatives of—</text> 
<paragraph id="HE665115E33C34255B723B369B3131B3D"><enum>(1)</enum><text>the exclusive bargaining representatives of air traffic controllers certified under section 7111 of title 5, United States Code;</text></paragraph> <paragraph id="H945EA945E4C846F6A5CC55A42D1B1537"><enum>(2)</enum><text>the organization representing air traffic control operational supervisors and managers;</text></paragraph> 
<paragraph id="H8EEBB969A6294966B255619083D735BB"><enum>(3)</enum><text>not fewer than 3 separate organizations representing the certified collective bargaining representatives of pilots operating under part 121 of title 14, Code of Federal Regulations;</text></paragraph> <paragraph id="HB70E9B83396D42F8BCBC6C55A27187F5"><enum>(4)</enum><text>air medical services;</text></paragraph> 
<paragraph id="H66AA4EFF74924F2494CFCB3A88852925"><enum>(5)</enum><text>an organization representing helicopter aviation operators and pilots;</text></paragraph> <paragraph id="H188B54D762E94186B8DF2721B732809F"><enum>(6)</enum><text>an organization representing business aviation operators and pilots;</text></paragraph> 
<paragraph id="H563089C1B19547E6B5E7E534AE3E1AE7"><enum>(7)</enum><text display-inline="yes-display-inline">air carriers operating under part 121 of title 14, United States Code;</text></paragraph> <paragraph id="HF2DFA01FACFE453C8ECFC44241E56327"><enum>(8)</enum><text>an individual that has expertise in an operational or academic discipline that is relevant to the analysis of human factors in aviation, which may include air carrier operations, line pilot expertise, air traffic control, linguistics, human-machine integration, general aviation operations, and organizational behavior and culture;</text></paragraph> 
<paragraph id="HA3100C413A36439ABE0F54AEB26E71B9"><enum>(9)</enum><text>the FAA, provided the representative has expertise on flight operations in the area described in subsection (a);</text></paragraph> <paragraph id="H59C4187CD78043CA8197D6971E268D95"><enum>(10)</enum><text>the Department of Defense, provided the representative has expertise on Department of Defense flight operations in the area described in subsection (a);</text></paragraph> 
<paragraph id="H0D39A933170F46469069CA2D76886492"><enum>(11)</enum><text>the Coast Guard, provided the representative has expertise on Coast Guard flight operations in the area described in subsection (a);</text></paragraph> <paragraph id="H249AE150A8F248F9852947CE4A17C77C"><enum>(12)</enum><text>the National Transportation Safety Board; and</text></paragraph> 
<paragraph id="HED99F92CE93E4080A8C3475E760A7CBF"><enum>(13)</enum><text display-inline="yes-display-inline">other organizations or agencies as determined necessary by the Administrator.</text></paragraph></subsection> <subsection id="HAF00BBCAF454406CA4B1060BC8FDCA19"><enum>(c)</enum><header>Local operator preference</header><text>The members described in paragraphs (3), (4), (5), (6), and (7) of subsection (b) shall be, or represent, individuals who operate in the Washington, DC Metropolitan Area Special Flight Rules Area, as defined in subpart V of part 93 of title 14, Code of Federal Regulations. </text></subsection> 
<subsection id="H71720325F2EC4A69B1A1C16D5B75FB69"><enum>(d)</enum><header>Government representatives</header><text display-inline="yes-display-inline">The members described in paragraphs (11), (12), (13), (14), and, in the case of a representative chosen by the Administrator that is from a governmental agency, (15) of subsection (b)—</text> <paragraph id="H2418E80290804020B2FF13F93273E473"><enum>(1)</enum><text display-inline="yes-display-inline">may not be political appointees; and</text></paragraph> 
<paragraph id="HE33AE5731D5F4D42A55572FBD868FF75"><enum>(2)</enum><text>shall be nonvoting members of the Working Group.</text></paragraph></subsection> <subsection id="H3F9800605F0647389B994E19DA983870"><enum>(e)</enum><header>Duration</header> <paragraph id="H4036CC7C020946B78A6A7BF2E4DD17CE"><enum>(1)</enum><header>In general</header><text>Members of the Working Group shall be appointed for the duration of the Working Group.</text></paragraph> 
<paragraph id="HF1622FA698A447B39760D14E858DBD1D"><enum>(2)</enum><header>Length of existence</header> 
<subparagraph id="HA96D8009A2A340538FA1851B273BCD1D"><enum>(A)</enum><header>In general</header><text>The Working Group shall have an initial duration of 1 year.</text></subparagraph> <subparagraph id="H6585F2E15A3B42D9818ED75874A73FA7"><enum>(B)</enum><header>Optional extension</header><text>The Administrator may extend the duration of the Working Group for an additional period of up to 1 year.</text></subparagraph></paragraph></subsection> 
<subsection id="HA349ABEE685D4E0B9EE2CA060C452EDD"><enum>(f)</enum><header>Considerations</header><text>In conducting the comprehensive evaluation under subsection (a), the Working Group shall, at minimum, consider—</text> <paragraph id="H95507F30592345119AABD8E45FB00E7C"><enum>(1)</enum><text>the benefits or detriments to pilot and air traffic controller situation awareness;</text></paragraph> 
<paragraph id="H5251F2187F134E63B641F2460F2AEB04"><enum>(2)</enum><text>to the greatest extent possible, the human factors that would impact pilot and air traffic controller situation awareness;</text></paragraph> <paragraph id="H8695032791E94D4FAD4203E3EDE8CB7D"><enum>(3)</enum><text>to the greatest extent possible, the human factors that would impact pilot and air traffic controllers during critical phases of flight;</text></paragraph> 
<paragraph id="HC723C21FE5EC4AEC955D0733D95420BC"><enum>(4)</enum><text>existing products by other working groups related to human factors in aviation safety;</text></paragraph> <paragraph id="H91DFB90C6B024EA8A772CD2A79330E61"><enum>(5)</enum><text>pilot training requirements;</text></paragraph> 
<paragraph id="H1563DA869BFF473B8B062D0F540E607A"><enum>(6)</enum><text>air traffic controller training requirements;</text></paragraph> <paragraph id="HD5C70D77086A4C3885B85C65A22FC32C"><enum>(7)</enum><text>if any, technological limitations or challenges that would impede aircraft from using the same communications frequency;</text></paragraph> 
<paragraph id="H2704BB8F397B4CB5A776E7BB51EE7D9E"><enum>(8)</enum><text display-inline="yes-display-inline">the potential for overlapping, conflicting, and simultaneous communication transmissions, prior to and after any improvements made as a result of the assessment conducted pursuant to section 115;</text></paragraph> <paragraph id="HE7A9A7FD49F44991AEC302423E268126"><enum>(9)</enum><text>the potential for misdirected, missed, or stepped on communications if requiring all aircraft to use the same communication frequency;</text></paragraph> 
<paragraph id="H68CC69D165CF45968261A37172A9476F"><enum>(10)</enum><text display-inline="yes-display-inline">National Transportation Safety Board recommendations pertaining to miscommunications on crowded frequencies, including relevant recommendations included in the National Transportation Safety Board Aviation Investigation Report AIR–26–02 adopted on January 27, 2026; and</text></paragraph> <paragraph id="HA23AC89C7B214F7C88C967F97978C27A"><enum>(11)</enum><text>solicited feedback from air carriers operating under part 121 and part 135 of title 14, Code of Federal Regulations, and general aviation operators under part 91 of title 14, Code of Federal Regulations.</text></paragraph></subsection> 
<subsection id="H283F5760CEA34449AB7F357BF09B9BDC"><enum>(g)</enum><header>Report</header><text>Not later than 6 months after the conclusion of the Working Group, the Working Group shall submit to the Administrator and the appropriate committees of Congress a report on the findings and recommendations resulting from the activities carried out under this section.</text></subsection> <subsection id="HB27B1B8505BD4631AE273049F0CADA65"><enum>(h)</enum><header>Implementation</header><text>Not later than 6 months after receiving recommendations outlined in the report under subsection (g), the Administrator shall operationally validate such recommendations and may take such action, as appropriate, to implement such recommendations.</text></subsection></section> 
<section id="HDCCC8E405F9943BC88959392504BB5B5" section-type="subsequent-section"><enum>115.</enum><header>Anti-blocking technology</header> 
<subsection id="HC526D8B3B7B24FF6BFE3E5F10E20D089"><enum>(a)</enum><header>Assessment</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, the Administrator shall initiate an assessment on the feasibility, maturity, hazards, and safety benefits of technology that serves to alert air traffic controllers or flight crews to instances of potentially blocked transmissions when simultaneous broadcasting occurs.</text></subsection> <subsection id="H584AF9091B85498B932EF71330EC3267"><enum>(b)</enum><header>Considerations</header><text>In conducting the assessment under subsection (a), the Administrator shall, at minimum, consider—</text> 
<paragraph id="H86B5CD245B4342FB8CB84A6084498BE3"><enum>(1)</enum><text>technologies currently in use domestically and internationally that alert an air traffic controller or flight crew to instances in which radio transmissions may have been blocked;</text></paragraph> <paragraph id="H6EC51CBDC59F4AF8896B19F58DD0C1F6"><enum>(2)</enum><text>the technical standards written for, and associated with, the use of such technologies identified under paragraph (1);</text></paragraph> 
<paragraph id="H8A2A2B938E244A979F6C9A4EEEF1A711"><enum>(3)</enum><text display-inline="yes-display-inline">existing and proposed technologies not in use that could alert an air traffic controller or flight crew to instances in which radio transmissions may have been blocked;</text></paragraph> <paragraph id="H3EAFB213E77E41AAAFDD60C0070EA825"><enum>(4)</enum><text display-inline="yes-display-inline">the technical standards that would be needed to implement the technologies identified under paragraph (3);</text></paragraph> 
<paragraph id="H485C32B2E74E44978EBB951E4178DB7C"><enum>(5)</enum><text>the potential benefits and enhanced awareness that the adoption of such technologies would provide;</text></paragraph> <paragraph id="H45868CCEDDA1484AA436C762F5B573A3"><enum>(6)</enum><text>the technological limitations associated with such technologies;</text></paragraph> 
<paragraph id="H288D6C728A5244448D95890C7BA1E531"><enum>(7)</enum><text display-inline="yes-display-inline">air traffic controller training requirements;</text></paragraph> <paragraph id="H6A0EA8CA814F4571BD4B80D06E530D1C"><enum>(8)</enum><text display-inline="yes-display-inline">the effort of the FAA to modernize the air traffic control system, including timelines, the incorporation of new technologies, and planned training; and</text></paragraph> 
<paragraph id="H728F4290BEAA40578C9763951E8B6697"><enum>(9)</enum><text display-inline="yes-display-inline">any benefits and detriments to air traffic controller situational awareness, including availability of information, nuisance alerts, and human factors.</text></paragraph></subsection> <subsection id="HF3BE159FDE094AEF9967C3A47AA46789"><enum>(c)</enum><header>Consultation</header><text>In conducting the assessment under subsection (a), the Administrator shall consult with stakeholders or standards organizations, including—</text> 
<paragraph id="H40D32084FD7D45E7B905E1D6A554C847"><enum>(1)</enum><text display-inline="yes-display-inline">the exclusive bargaining representatives of air traffic controllers certified under section 7111 of title 5, United States Code;</text></paragraph> <paragraph id="HF1B10A2EF1134426A36528446CF1E1F5"><enum>(2)</enum><text>the organization representing air traffic control operational supervisors and managers;</text></paragraph> 
<paragraph id="HACA33193676441459F2EB2E563C8540C"><enum>(3)</enum><text>the certified bargaining representative of aviation safety inspectors and engineers for the FAA;</text></paragraph> <paragraph id="H08F6C96DD93348A7B9A68992414AEEF6"><enum>(4)</enum><text>an organization representing manufacturers of air traffic management systems, equipment and technologies;</text></paragraph> 
<paragraph id="HC26C8F99BAA348DB9EB199C173275501"><enum>(5)</enum><text>an organization representing helicopter aviation operators and pilots;</text></paragraph> <paragraph id="H8281F2F540F7430AAA74DB708DB0FC8F"><enum>(6)</enum><text>an organization representing general aviation operators and pilots; and</text></paragraph> 
<paragraph id="H8F4C132DFE0E4AB8ACAAB26E9B7A7184"><enum>(7)</enum><text>any other organization or agency the Administrator determines appropriate.</text></paragraph></subsection> <subsection id="H2418C5FFDC454D1DB9C0D7D42DFBF3CE"><enum>(d)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator shall submit to the appropriate committees of Congress a report on the results of the assessment under subsection (a) that includes—</text> 
<paragraph id="H6D42DE9FECC94C5EAC1D2D53C32F284B"><enum>(1)</enum><text>a list of technologies identified by the Administrator serving the purpose described in subsection (a);</text></paragraph> <paragraph id="H6186E65317614173B0FED6E4C91685F1"><enum>(2)</enum><text display-inline="yes-display-inline">a list of technologies the Administrator proposes that could serve the purpose described in subsection (a);</text></paragraph> 
<paragraph id="HEC4E714C3CA04EE5B5205BD55BDD602F"><enum>(3)</enum><text>results of simulations and testing; and</text></paragraph> <paragraph id="H98673861CBB74DA7A8C2C0BEB717A8F1"><enum>(4)</enum><text>a plan to implement the technologies listed under paragraphs (1) and (2) if the assessment under subsection (a) finds such technology can be safely implemented, including—</text> 
<subparagraph id="HD52C07B58A7E4E9EA7191FCED581DF91"><enum>(A)</enum><text>the scope of potential upgrades;</text></subparagraph> <subparagraph id="HF8508645E6144FBDB665FF2337CD8FC4"><enum>(B)</enum><text>predicted costs;</text></subparagraph> 
<subparagraph id="HC050247DFC9C4AA3B1A7E8F5A5C9B630"><enum>(C)</enum><text>a projected timeline; and</text></subparagraph> <subparagraph id="H33CFEFC1A95C4BEF965DFF2BD9171B83"><enum>(D)</enum><text>how the potential upgrades to facilities and equipment within the scope of subparagraph (A) would be prioritized.</text></subparagraph></paragraph></subsection></section> 
<section id="H6ED04618916E47ADA278A431FD4549DC"><enum>116.</enum><header>Task force to identify improvements to air traffic controller conflict alert system</header> 
<subsection id="HD2FD865B881D4220B17E7376C7DA4A25"><enum>(a)</enum><header>In general</header><text>Not later than 3 months after the date of enactment of this Act, the Administrator shall convene a task force (in this section referred to as the <quote>Task Force</quote>) to develop a framework detailing the priorities, goals, timeline, and recommendations to implement improvements to the conflict alert system to provide more salient and meaningful alerts to air traffic controllers based on the severity of the conflict triggering the alert.</text></subsection> <subsection id="HEE5DB0D989B0428E930900FEF59C2E6C"><enum>(b)</enum><header>Members</header><text>The Task Force convened under subsection (a) shall be comprised of representatives of—</text> 
<paragraph id="H5A3D2BC22516433B82427FFFBCD065E8"><enum>(1)</enum><text>the exclusive bargaining representatives of air traffic controllers certified under section 7111 of title 5, United States Code;</text></paragraph> <paragraph id="H728E77D08E3246CB9F840F18E380970C"><enum>(2)</enum><text>the organization representing air traffic control operational supervisors and managers;</text></paragraph> 
<paragraph id="H3AF20BC8F4EC4E808B69FF0E39759CEB"><enum>(3)</enum><text display-inline="yes-display-inline">the organization representing operators under the Contract Tower Program established under section 47124 of title 49, United States Code;</text></paragraph> <paragraph id="H404AC433DF964B968AD8FF2011C151FD"><enum>(4)</enum><text>the certified bargaining representative of aviation safety inspectors and engineers for the FAA;</text></paragraph> 
<paragraph id="HB01C5B473D40465F9481CECCD77588F9"><enum>(5)</enum><text display-inline="yes-display-inline">individuals with expertise in the human factors of alert design and related impacts on human performance; </text></paragraph> <paragraph id="H2E509D8B1374492E926A34D25815BF0E"><enum>(6)</enum><text>individuals with expertise in an operational or academic discipline that is relevant to the analysis of human factors in aviation, which may include air carrier operations, line pilot expertise, air traffic control, linguistics, human-machine integration, general aviation operations, and organizational behavior and culture;</text></paragraph> 
<paragraph id="H65B1B561755B40DEA6C6B717C1E9658F"><enum>(7)</enum><text>the FAA, including the Air Traffic Organization and the Office of Finance and Management, provided such representative has expertise on equipment procurement; and</text></paragraph> <paragraph id="H62212907A77241B29ED80C083DD7CD2D"><enum>(8)</enum><text display-inline="yes-display-inline">other organizations or agencies as determined necessary by the Administrator.</text></paragraph></subsection> 
<subsection id="HDADD52062D5848A99B0161D52174BC89"><enum>(c)</enum><header>Voting</header><text display-inline="yes-display-inline">The members described in paragraphs (3), (6), and, in the case of a representative chosen by the Administrator that is from a governmental agency, (7) of subsection (b) shall be nonvoting members of the Task Force.</text></subsection> <subsection id="H13620E23D9E94E2D80EBB15C5221043A"><enum>(d)</enum><header>Duration</header> <paragraph id="HE362A67CE58C4BB59D4F162CBE9EB4E9"><enum>(1)</enum><header>In general</header><text>Members of the Task Force shall be appointed for the duration of the Task Force.</text></paragraph> 
<paragraph id="HDCFE941CCC76480AB8412EBAB642DE57"><enum>(2)</enum><header>Length of existence</header> 
<subparagraph id="HD564E374125E48F5801B490BD8358A80"><enum>(A)</enum><header>In general</header><text>The Task Force shall have an initial duration of 1 year.</text></subparagraph> <subparagraph id="H00B77FA1E61544B2A7FA7A33E6A4890B"><enum>(B)</enum><header>Optional extension</header><text>The Administrator may extend the duration of the Task Force for an additional period of up to 6 months.</text></subparagraph></paragraph></subsection> 
<subsection id="H10BA52AAFFD548A485D2E2021D3952AC"><enum>(e)</enum><header>Considerations</header><text>In developing the framework under subsection (a), the Task Force shall, at minimum, consider—</text> <paragraph id="H6A6636F4047D4BF7AEAA8489629C0DCA"><enum>(1)</enum><text>the benefits and detriments to air traffic controller situational awareness, including availability of information, nuisance and false alerts, and human factors;</text></paragraph> 
<paragraph id="H37667E1EAA26406481818AB79A1A5EEB"><enum>(2)</enum><text display-inline="yes-display-inline">opportunities and challenges of consolidating numerous systems and underlying data sources into a single display, including through the deployment of the Enterprise-Information Display System;</text></paragraph> <paragraph id="HDDB68A8F3EBA451C991D7E4633C317B8"><enum>(3)</enum><text>existing products by other working groups related to human factors in aviation safety;</text></paragraph> 
<paragraph id="HFEFD23E49DDA4F469369FFD27229B8ED"><enum>(4)</enum><text>air traffic controller training requirements;</text></paragraph> <paragraph id="H7739E8525B27408B9ECD8C310AD7C0F3"><enum>(5)</enum><text>advances in available technology not being utilized as of the date on which the Task Force is convened;</text></paragraph> 
<paragraph id="H982C32D3FC7F46D9AD5F8F9B8CACCC55"><enum>(6)</enum><text>technological limitations;</text></paragraph> <paragraph id="H9BB449055CC54386A46C1334CC86D84D"><enum>(7)</enum><text>National Transportation Safety Board recommendations pertaining to air traffic controller alerts, distractions, and loss of focus;</text></paragraph> 
<paragraph id="H726689289F0B4A5EAC0BC8F59E5C4026"><enum>(8)</enum><text>the effort of the FAA to modernize the air traffic control system, including timelines, new technologies being incorporated, and planned training; and</text></paragraph> <paragraph id="HBA312BB243764DFF954DFB50B7A8659C"><enum>(9)</enum><text display-inline="yes-display-inline">solicited feedback from equipment manufacturers and entities involved with the air traffic control modernization effort of the Administrator.</text></paragraph></subsection> 
<subsection id="H8EFCDEE6136244D1AE92432A8F1FF122"><enum>(f)</enum><header>Report</header><text>Not later than 4 months after the conclusion of the Task Force, the Task Force shall submit to the Administrator and the appropriate committees of Congress a report that includes the framework developed as a result of the activities carried out under subsection (a).</text></subsection> <subsection id="H6DA80B36AE4243FC96A18B89C5111ED0"><enum>(g)</enum><header>Implementation plan</header> <paragraph id="H6F3939A4A7504AA199A6E3DFD659AE65"><enum>(1)</enum><header>In general</header><text>Not later than 8 months after receiving the framework outlined in the report under subsection (f), the Administrator shall finalize and submit to the appropriate committees of Congress a plan (in this section referred to as the <quote>Plan</quote>) to implement such framework.</text></paragraph> 
<paragraph id="H8C2F22C86F5D4424BDD69354C7D6D466"><enum>(2)</enum><header>Contents</header><text>Such Plan shall include, as appropriate—</text> <subparagraph id="HC31B30CF88D14DF199F978FE1A86F0F8"><enum>(A)</enum><text>specific training requirements for air traffic controllers, as detailed in—</text> 
<clause id="H20C3F8F500FF4A309A0911606E34BEDC"><enum>(i)</enum><text>FAA Order JO 3120.4S, titled <quote>Air Traffic Technical Training</quote>, issued on August 28, 2024;</text></clause> <clause id="H1F1F3488D9E0411C87F770A1A8C4CC37"><enum>(ii)</enum><text>FAA Order JO 7210.3EE, titled <quote>Facility Operation and Administration</quote>, issued on February 20, 2025; and</text></clause> 
<clause id="HF7CFACC0954A412F92F2D5C8B0A21E60"><enum>(iii)</enum><text>any successor or other relevant documents or guidance; and</text></clause></subparagraph> <subparagraph id="H9491E01A89E24F7AA9CE69A773A6B3C3"><enum>(B)</enum><text>a publicly available prioritized list of airports enumerating the order in which they will receive such upgrades.</text></subparagraph></paragraph> 
<paragraph id="H5307DA8019494D3292663C7EA6A5F340"><enum>(3)</enum><header>Time limit</header><text>The Plan may not contain a timeline of implementation that exceeds 2 years.</text></paragraph></subsection> <subsection id="HF29C9AE656A647DDBB6109934B00B685"><enum>(h)</enum><header>Implementation</header><text>The Administrator shall immediately begin implementing the Plan upon the submission of such Plan under subsection (g)(1) to the appropriate committees of Congress.</text></subsection> 
<subsection id="HDF5DB593FE684E21862AE5A5467FC04A"><enum>(i)</enum><header>Briefings to Congress</header><text display-inline="yes-display-inline">Not later than 6 months after the submission of the Plan to the appropriate committees of Congress under subsection (g)(1), and every 6 months thereafter until the full implementation of the Plan, the Administrator shall brief the appropriate committees of Congress on the progress of implementation.</text></subsection></section> <section id="H48C91DA631904DF1831EC7E29A7E82EC"><enum>117.</enum><header>Postaccident and postincident drug and alcohol testing</header> <subsection id="H027DC2CFEE4247C694144080FE6FA981"><enum>(a)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">The Administrator shall abide by DOT Order 3910.1D, titled <quote>Drug and Alcohol-Free Departmental Workplace Program</quote> (or any successor document) to ensure appropriate postaccident and postincident drug and alcohol testing.</text></subsection> 
<subsection id="HD25C46B454FB40C59CEA18CE670C530B"><enum>(b)</enum><header>Revision of procedures</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator shall revise procedures of the Air Traffic Organization to ensure an appropriate on-site supervisor makes each postaccident and postincident drug and alcohol testing determination in a timely manner based on an assessment of such supervisor of whether the event meets testing criteria and which controllers had duties pertaining to the involved aircraft without need to wait for investigation or approval.</text></subsection> <subsection id="H152397A52E204FBA8C375B61D5E892E8"><enum>(c)</enum><header>Training</header> <paragraph id="H3A17E69348B942D0A393D683DC3654CA"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator shall incorporate training on the revised postaccident and postincident drug and alcohol testing determination procedure described in subsection (b) for all staff of the Air Traffic Organization who have responsibilities under such procedure.</text></paragraph> 
<paragraph id="HD4221F8EFD544794A5600FD4DCAB8345"><enum>(2)</enum><header>Requirements</header><text>The training described under this subsection shall, at a minimum—</text> <subparagraph id="H0C6C0A888EBE4A18AF7751A4BE4555DB"><enum>(A)</enum><text>be administered during initial training, and annually thereafter; and</text></subparagraph> 
<subparagraph id="H9DEE56FECB5E4A15B10B59321607C5C5"><enum>(B)</enum><text>include a postlearning knowledge assessment.</text></subparagraph></paragraph></subsection> <subsection id="H5DCA981E7A8B4D5499FC84FFFB95409E"><enum>(d)</enum><header>Review</header> <paragraph id="H513AA3052CD34E5C83FF1D56A452D155"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Secretary shall conduct a review of the ability of each FAA-operated air traffic control facility to routinely accomplish the required postaccident and postincident drug and alcohol testing within the Secretary’s specified timeframes of within 2 hours for alcohol testing and within 4 hours for drug testing.</text></paragraph> 
<paragraph id="HA7519635F3F94A8782CE49413492CA8C"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">The review described under this subsection shall, at a minimum, require each FAA-operated air traffic control facility to conduct a demonstration to establish the time that would be required for urine and breath evidence collection to begin if testing were unexpectedly needed during a time with the lowest routinely anticipated level of resource availability for testing.</text></paragraph> <paragraph id="HC8E923169CC542FD88BF4DE0DD2DDA30"><enum>(3)</enum><header>Remediation</header><text display-inline="yes-display-inline">After each review under paragraph (1), the Administrator shall work with the Secretary to mitigate identified barriers to timely postaccident and postincident drug and alcohol testing, and to remediate the performance of each facility for which the demonstration under paragraph (2) indicated inability to meet required timeframes for postaccident drug or alcohol testing.</text></paragraph> 
<paragraph id="H3978CBDEC79540A99C6864B4D66DB4DC"><enum>(4)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 3 months after each review under paragraph (1), the Secretary shall submit to the appropriate committees of Congress a report detailing the results of the review, including facilities in need of remediation, progress at facilities previously identified for remediation, and planned approaches to remediation.</text></paragraph></subsection></section> <section id="H88B66E20E84142918832CB6193CB8C20" section-type="subsequent-section"><enum>118.</enum><header>Further modifications to Ronald Reagan Washington National Airport area helicopter routes</header> <subsection id="H61D108B2609C41F3A52AA643202ACAD1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Administrator shall evaluate, via the safety risk management process in accordance with FAA Order JO 8040.4C, titled <quote>Safety Risk Management Policy</quote> (or any successor document), charted helicopter routes in the vicinity of Ronald Reagan Washington National Airport.</text></subsection> 
<subsection id="H13BD899E7F4843869B8E39C7C75C4119"><enum>(b)</enum><header>Revisions to deconflict traffic</header><text display-inline="yes-display-inline">Upon the completion of each route evaluation under subsection (a), the Administrator shall immediately, as necessary, revise such route to ensure that the route and routes utilized by fixed-wing aircraft—</text> <paragraph id="HC5FF489466CB412AABCEB3590AA1F4B3"><enum>(1)</enum><text>are safely deconflicted physically at all times; or</text></paragraph> 
<paragraph id="H0265882F96EC4DFEB54048AC716AB3CF"><enum>(2)</enum><text>have operating procedures that require positive control from the controller to ensure safe deconfliction during operations.</text></paragraph></subsection> <subsection id="H735A8F0B65744196BF8F615A86421B8B"><enum>(c)</enum><header>Safety review requirements</header><text>In carrying out the route revisions required under subsection (b), the Administrator shall conduct a safety risk management review, as necessary, for any helicopter route changes, in accordance with FAA Order 8040.4C, titled <quote>Safety Risk Management Policy</quote> (or any successor document).</text></subsection> 
<subsection id="HFB5B0C6A58F54CAB916E6E5280FA6988"><enum>(d)</enum><header>Report</header><text>Not later than 120 days after the Administrator completes all the evaluations and subsequent route revisions required under this section, the Administrator shall submit to the appropriate committees of Congress a report containing—</text> <paragraph id="H045A157CFBFE4B64925F61BA6FA4AC8E"><enum>(1)</enum><text>the results of the evaluations required under subsection (a);</text></paragraph> 
<paragraph id="HC449417D942B47B8A2223C935A50D729"><enum>(2)</enum><text display-inline="yes-display-inline">the route revisions required under subsection (b), including an explanation for such revisions; and</text></paragraph> <paragraph id="H7F0AFC92D3044CD5A2E1DCCBEAB8245F"><enum>(3)</enum><text>the safety risk management review documentation developed as a result of the review conducted under subsection (c).</text></paragraph></subsection></section> 
<section id="HF89F7C6663B94F12867581670150E436" section-type="subsequent-section"><enum>119.</enum><header>Requiring vertical separation near airports during critical phases of flight</header> 
<subsection id="H5B93FE2CE0F54937B65EAB30645F4245"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), the Administrator shall ensure that each segment of a helicopter route contains, in the appropriate helicopter route chart, recommended flight altitudes, including altitude ceilings and floors, in a manner consistent with FAA Order JO 7210.3EE, titled <quote>Facility Operation and Administration</quote> (or any successor document).</text></subsection> <subsection id="H0A89126845184FC5A5DBFB7A8181EAC1"><enum>(b)</enum><header>Consideration of vertical separation in route criteria</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the Administrator shall amend FAA Order JO 7210.3EE, titled <quote>Facility Operation and Administration</quote> (or any successor document), to add minimum vertical separation requirements to the criteria for the helicopter route chart program.</text></subsection> 
<subsection id="H8837C33C83E0476890E36E9FF7999305"><enum>(c)</enum><header>Charting minimum separation near airports</header> 
<paragraph id="H599A28D635974984BC917F231EAF0618"><enum>(1)</enum><header>In general</header><text>The Administrator shall ensure that any helicopter chart that represents an area near an airport clearly conveys to an operator the segments of such helicopter routes in the vicinity of such airport.</text></paragraph> <paragraph id="H85DA5E50D003404EB4A1DEA0AB9F7C28"><enum>(2)</enum><header>Content requirements</header><text>At minimum, each such chart shall clearly convey for each of the segments, the recommended flight altitudes, including altitude ceilings and floors, and any necessary instructions, to convey minimum separation, in accordance with FAA Order JO 7110.65BB, titled <quote>Air Traffic Control</quote> (or any successor document), between—</text> 
<subparagraph id="HFCC84881DA1F436EAE3ED7CACD303264"><enum>(A)</enum><text>a helicopter or powered-lift aircraft utilizing such segment; and</text></subparagraph> <subparagraph id="H06519F22C5594F8DA078522C17493982"><enum>(B)</enum><text>a fixed-wing aircraft operating at or near such airport during critical phases of flight.</text></subparagraph></paragraph></subsection> 
<subsection id="HA56AC128BF104D529E92F3EDDC6766C6"><enum>(d)</enum><header>Update policy</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Administrator shall update FAA Order JO 7210.3EE, titled <quote>Facility Operation and Administration</quote> (or any successor document), to account for any additional changes made by this section.</text></subsection> <subsection id="H47930C5A28C044958CE160196E38206F"><enum>(e)</enum><header>Annual review</header><text>The Administrator shall ensure that any changes made to Helicopter Route Charts as a result of this section are assessed on an annual basis as part of the annual review described in section 120.</text></subsection></section> 
<section id="H26C1F32F94014407BE4D57BF95027DEE" section-type="subsequent-section"><enum>120.</enum><header>Helicopter Route Chart annual review</header> 
<subsection id="H0787EBAE0DD146FDBAC230921084DD9F"><enum>(a)</enum><header>Criteria review</header> 
<paragraph id="H3D3D02DABF414AF8A6C1A53DA5C4CFC4"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, and annually thereafter, the Administrator shall initiate a review of the criteria for annual reviews of helicopter routes as required pursuant to FAA Order JO 7210.3EE, titled <quote>Facility Operation and Administration</quote> (or any successor document).</text></paragraph> <paragraph id="HCCE099F1F5294205BF56A20677A3189A"><enum>(2)</enum><header>Update of criteria</header><text>After each annual criteria review under paragraph (1), the Administrator shall update the criteria based on such review and publish the updated criteria on a publicly available website of the FAA.</text></paragraph> 
<paragraph id="H0C99F114E2C148BA8A616686F77336FC"><enum>(3)</enum><header>Changes to route reviews</header><text>After any change is made to FAA Order JO 7210.3EE, titled <quote>Facility Operation and Administration</quote> (or any successor document) pursuant to section 119(d), the Administrator shall update the criteria for annual reviews of helicopter routes to reflect such change.</text></paragraph></subsection> <subsection id="HFE0626991185482886B194E0837C296F"><enum>(b)</enum><header>Publication</header><text>The Administrator shall publish, on a publicly available website of the FAA, the date on which the annual review for each Helicopter Route Chart has been most recently completed, as required pursuant to FAA Order JO 7210.3EE, titled <quote>Facility Operation and Administration</quote> (or any successor document).</text></subsection> 
<subsection id="H2A12537CEA2448ADA86C4B69643D0CF5"><enum>(c)</enum><header>Report</header><text>Not later than December 31, 2026, and December 31 of each year thereafter, the Administrator shall submit to the appropriate committees of Congress a report containing, at a minimum, the following information:</text> <paragraph id="HDEBF1D44AE2640AA940EE4D0C57CA2AD"><enum>(1)</enum><text>A summary of changes, if applicable, made to each Helicopter Route Chart, including—</text> 
<subparagraph id="HF96F01AF49664D66A13D87F5FFCA282B"><enum>(A)</enum><text>changes, additions, or deletions to designated helicopter routes;</text></subparagraph> <subparagraph id="H5891526E137C456AAB28DC49499D2606"><enum>(B)</enum><text>changes in instrument flight rules routes;</text></subparagraph> 
<subparagraph id="HFC660043F4BB4690B82378CA9EE30999"><enum>(C)</enum><text>additions or deletions of visual checkpoints; and</text></subparagraph> <subparagraph id="H2DB8A12C49E74B9AA591AFFB7111B97B"><enum>(D)</enum><text>rationale or safety data to justify any changes described in subparagraphs (A) through (C).</text></subparagraph></paragraph> 
<paragraph id="H65980E37C32D45468F23E9FDF21741C2"><enum>(2)</enum><text display-inline="yes-display-inline">The safety risk management documentation completed in accordance with FAA Order JO 8040.4C, titled <quote>Safety Risk Management Policy</quote> (or any successor document).</text></paragraph> <paragraph id="H71458410C7D943379DCBA2B2F0BF1BF9"><enum>(3)</enum><text>A summary of any advanced consultation between the Administrator and impacted helicopter and fixed-wing operators in planning the safety risk management process.</text></paragraph> 
<paragraph id="H1F30ECBEB49C4B6490CD4CCAB9CE3B33"><enum>(4)</enum><text display-inline="yes-display-inline">A certification that the designated recommended route altitudes and flight ceilings and floors ensure helicopters maintain minimum separation, in accordance with FAA Order 7110.65BB, titled <quote>Air Traffic Control</quote> (or any successor document), with fixed-wing aircraft operating along airport approach and departure paths.</text></paragraph></subsection> <subsection id="HA1D1DD732C8F4CF392531EA1794E6AB6"><enum>(d)</enum><header>Failure To submit</header> <paragraph id="H6ACD5199A3D845B4A0A7952D68E4ABBB"><enum>(1)</enum><header>In general</header><text>If the Administrator fails to submit an annual report required under subsection (b) on or before the date on which such report is required to be submitted, the Chief Operating Officer of the Air Traffic Organization shall brief the appropriate committees of Congress in person not later than 4 weeks after such date.</text></paragraph> 
<paragraph id="H5A6156B64DD24B6CA0721323080126E7"><enum>(2)</enum><header>Deadline for initial outreach and coordination</header><text>Not later than 4 days after such date, the FAA shall begin initial outreach to and coordination with the appropriate committees of Congress to arrange and organize logistics of the briefing required under paragraph (1).</text></paragraph> <paragraph id="H96928D3D2CEC4650B4DC77AB89A6FAEB"><enum>(3)</enum><header>Format and time of briefing</header><text>The briefing required under paragraph (1) shall be in a format and at a time to be determined by such committees.</text></paragraph></subsection></section> 
<section id="HBA674B48CC7A4790AB42423DB65FD02E"><enum>121.</enum><header>Visual charts</header> 
<subsection id="H80768E41E1E64347B38D8F14B73530C9"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, the Administrator shall initiate a study on incorporating the lateral location and published altitudes of helicopter routes into all instrument and visual approach and departure procedures for airports to provide situation awareness to fixed-wing operators of the risk of helicopter traffic operating in the vicinity of such operators.</text></subsection> <subsection id="H44909041A1E94E2B8E4D400E41A26699"><enum>(b)</enum><header>Consultation</header><text>In carrying out subsection (a), the Administrator shall consult with relevant stakeholders, including—</text> 
<paragraph id="HD41F3EC26B104A18B4279913079F271F"><enum>(1)</enum><text>air carriers;</text></paragraph> <paragraph id="HBF74301B15D8456FACC38769AC694F60"><enum>(2)</enum><text>an organization representing helicopter operators and pilots;</text></paragraph> 
<paragraph id="HD5FDA51CA0C64311AE822C2614E87F98"><enum>(3)</enum><text>an organization representing general aviation operators and pilots;</text></paragraph> <paragraph id="H71B32978BE184043AC3ECC2B73F07F4B"><enum>(4)</enum><text display-inline="yes-display-inline">an organization representing business aviation operators and pilots;</text></paragraph> 
<paragraph id="H1B3E25125F4442FEB030A3D1FFB1356E"><enum>(5)</enum><text display-inline="yes-display-inline">an organization representing emergency air medical services;</text></paragraph> <paragraph id="HA630FECAB04E4889A691FB1A3C41A0F2"><enum>(6)</enum><text>representatives of the Department of Defense and United States Coast Guard who are not political appointees;</text></paragraph> 
<paragraph id="H38417C8C55C245B4BF3B462CC6FB9180"><enum>(7)</enum><text display-inline="yes-display-inline">not fewer than 3 separate organizations representing certified collective bargaining representatives of airline pilots operating under part 121 of title 14, Code of Federal Regulations;</text></paragraph> <paragraph id="H9A611769F4A645A8AC706C7C10630105"><enum>(8)</enum><text>the certified exclusive bargaining representatives of air traffic controllers certified under section 7111 of title 5, United States Code; and</text></paragraph> 
<paragraph id="HC0EF9D6D20594E1785B2D736548C1FB3"><enum>(9)</enum><text display-inline="yes-display-inline">an individual that has expertise in an operational or academic discipline that is relevant to the analysis of human factors in aviation, including air carrier operations, line pilot expertise, air traffic control, linguistics, human-machine integration, general aviation operations, and organizational behavior and culture.</text></paragraph></subsection> <subsection id="H6EDF630C701B4A41813066A7284B1EFB"><enum>(c)</enum><header>Considerations</header><text>In carrying out subsection (a), the Administrator shall consider the—</text> 
<paragraph id="H070F12DEB15D4F54AB39943362415F6E"><enum>(1)</enum><text>spacing and legibility of information on charts;</text></paragraph> <paragraph id="HAEAE50FA31274D06BBDA3002A4C81990"><enum>(2)</enum><text>workload of flight crews at lower altitudes and during critical phases of flight;</text></paragraph> 
<paragraph id="HAA8E5430B08F46D585C8B77D9DE68B10"><enum>(3)</enum><text display-inline="yes-display-inline">feasibility and decipherability of layered information on digital charts;</text></paragraph> <paragraph id="H0B7856FE5BEB42CCA6D6BFED25FA048E"><enum>(4)</enum><text display-inline="yes-display-inline">current best practices for pilots when landing at or departing from airports with high volume helicopter traffic but that do not have charted helicopter routes; and</text></paragraph> 
<paragraph id="H695DA53F827E4CB2B4ED620FDEEB8DBB" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">human factors involved with approach and departure procedures.</text></paragraph></subsection> <subsection id="HC9AD4AB7C2F440A9887965EDE80459B5"><enum>(d)</enum><header>Implementation</header><text>Not later than 1 year after initiating the study under subsection (a), the Administrator shall make any revisions necessary to—</text> 
<paragraph id="H15E797418A584307B5BCF6E9223892C9"><enum>(1)</enum><text>Terminal Procedures Publications to include charted helicopter routes to provide appropriate situational awareness to fixed-wing operators; and</text></paragraph> <paragraph id="H08A3C0B8ED604E58A2F7A69A5462F0C1"><enum>(2)</enum><text>Helicopter Route Charts to include airport approach and departure paths to provide appropriate situational awareness to helicopter operators.</text></paragraph></subsection> 
<subsection id="H0A71743BA19643FD821F12D5CDDE7C5B"><enum>(e)</enum><header>Congressional briefing</header><text display-inline="yes-display-inline">If the Administrator makes revisions under subsection (d), the Administrator shall brief the appropriate committees of Congress on such revisions not later than 60 days after making such revisions.</text></subsection></section> <section id="H13B630FCC92B454FA5D0AF4B515DF98C"><enum>122.</enum><header>Close proximity encounters</header> <subsection id="HA0F15057774F40DABC73F1FFD9C27149"><enum>(a)</enum><header>In general</header><text>Not later than 60 days after the date of enactment of this Act, the Administrator shall establish a working group to make recommendations on—</text> 
<paragraph id="HA4D066ECD3CF40839815FCDDC3FD0DED"><enum>(1)</enum><text display-inline="yes-display-inline">an objective definition of close proximity encounters;</text></paragraph> <paragraph id="HD46003E825094C73B7F192A4C523F376"><enum>(2)</enum><text>associated parameters that can be used to monitor the prevalence of such encounters and identify areas of potential traffic conflict for safety assurance and safety risk management for such encounters; and</text></paragraph> 
<paragraph id="H7EC9BECA4FAE4265B40652074C229F54"><enum>(3)</enum><text>making publicly available aggregated information about all such encounters, including date and location.</text></paragraph></subsection> <subsection id="H9AFADBF42DAD458F8F6A1C30D2BF4A8F"><enum>(b)</enum><header>Considerations</header><text>In carrying out subsection (a), the working group shall consider—</text> 
<paragraph id="H5B945A8A722144178A6482C1FCCD46B1"><enum>(1)</enum><text display-inline="yes-display-inline">existing airborne separation rules and required loss of airborne separation reporting requirements;</text></paragraph> <paragraph id="HB471D1DD6BCD4EC5AD7E7DC3E277D019"><enum>(2)</enum><text>the development of a definition of, and associated parameters for, close proximity encounter events;</text></paragraph> 
<paragraph id="HC74521602F954F12A522E078672ACB49"><enum>(3)</enum><text>data gathered from aviation safety reporting systems and reports, including the Aviation Safety Information Analysis and Sharing Program, the Aviation Safety Action Program, the Performance Data Analysis and Reporting System, the Aviation Risk Identification and Assessment (<quote>ARIA</quote>) system, preliminary ARIA reports, the Air Traffic Safety Action Program, the Aviation Safety Reporting System, the Near Midair Collision System, mandatory occurrence reports, and other relevant systems and reports;</text></paragraph> <paragraph id="HC10E514BBC534A4EBAE43C345F190909"><enum>(4)</enum><text display-inline="yes-display-inline">National Transportation Safety Board aviation investigation report AIR–26–02, adopted on January 27, 2026;</text></paragraph> 
<paragraph id="H9B987326D0FE46FCA66EDF2721D876F3"><enum>(5)</enum><text>FAA risk assessment guidance, policies, and regulations in place prior to the date of enactment of this Act;</text></paragraph> <paragraph id="H95818D9084A64CC689B85F20A15BE868"><enum>(6)</enum><text>best practices or similar relevant risk assessment tools and methods used by foreign civil aviation authorities; and</text></paragraph> 
<paragraph id="H3050C11666144D3B84078596285A8078"><enum>(7)</enum><text>any other factors determined relevant by the working group.</text></paragraph></subsection> <subsection id="HB29C58E1A2BB463087D5516F2CB10B21"><enum>(c)</enum><header>Membership</header><text>The working group shall consist of the following:</text> 
<paragraph id="HCDEB5B0D73F94B7CAE503E4FCD673233"><enum>(1)</enum><header>Appointed members</header><text>The following members appointed by the Administrator:</text> <subparagraph id="H51D71CF5B0DC413D8EF2EC04ABDDC22D"><enum>(A)</enum><text>2 representatives of the National Aeronautics and Space Administration with expertise in safety data.</text></subparagraph> 
<subparagraph id="H46B5010CEA984D5784E92D8A248CF960"><enum>(B)</enum><text>5 appropriately qualified representatives of aviation labor organizations (designated by the applicable represented organization), including—</text> <clause id="HBC45A2B7156246DC89C2F925AE35CDE4"><enum>(i)</enum><text>organizations representing certified collective bargaining representatives of airline pilots;</text></clause> 
<clause id="H8C3A3FA7287F4610871FEE20983B5788"><enum>(ii)</enum><text display-inline="yes-display-inline">the exclusive bargaining representatives of FAA air traffic controllers certified under section 7111 of title 5, United States Code;</text></clause> <clause id="HC4E0BA1875B74333A15D48105DDDFBB1"><enum>(iii)</enum><text display-inline="yes-display-inline">organizations representing helicopter operators and pilots, including law enforcement and air ambulance operators; and</text></clause> 
<clause id="HA2EC505C554547168776230D4C724412"><enum>(iv)</enum><text display-inline="yes-display-inline">organizations representing general aviation operators and pilots.</text></clause></subparagraph> <subparagraph id="H8371540299794234839EE07AF863ECE6"><enum>(C)</enum><text>Not fewer than 5 independent subject matter experts in safety management systems and safety data who—</text> 
<clause id="H959E0BEE3562417990A91051E01537AD"><enum>(i)</enum><text>have not served as a political appointee in the Administration; and</text></clause> <clause id="HF52240887376409A8D8C388FEEE7EED9"><enum>(ii)</enum><text>have a minimum of 10 years of relevant applied experience.</text></clause></subparagraph> 
<subparagraph id="HA277D0602ADE42BFB2ADC45147D4DC99"><enum>(D)</enum><text>2 air carrier employees whose job responsibilities include administration of a safety management system.</text></subparagraph> <subparagraph id="H7D8E6118E7EA4CAFA4B58B95FAB2956C"><enum>(E)</enum><text>2 individuals representing holders of a certificate issued under part 21 of title 14, Code of Federal Regulations, whose job responsibilities include administration of a safety management system.</text></subparagraph> 
<subparagraph id="HA36CA1B1F4EC418585275DA07A3F2246"><enum>(F)</enum><text display-inline="yes-display-inline">2 other representatives from the aerospace industry that do not meet the criteria described in subparagraph (D) or (E) and who have expertise in safety assurance or safety risk or whose job responsibilities include administration of a safety management system.</text></subparagraph> <subparagraph id="H7A07C01F67634C0E8DBFBA10D436E5E9"><enum>(G)</enum><text>A career representative from the National Transportation Safety Board with subject matter expertise, as a nonvoting member.</text></subparagraph></paragraph> 
<paragraph id="H39E48D237ABC4A9BB8300B9B7B8021D7"><enum>(2)</enum><header>Advisory members</header><text>In addition to the appointed members described in paragraph (1), the working group shall be advised by up to 5 employees of the Administration, at least 3 of whom shall be subject matter experts in implementing safety assurance and safety risk management.</text></paragraph></subsection> <subsection id="H87800591BC9C4842B1E96E33B2BCBF65"><enum>(d)</enum><header>Implementation</header><text display-inline="yes-display-inline">Not later than 30 days after the working group develops recommendations under subsection (a), the Administrator shall make publicly available a report containing the recommendations and describing how the Administrator will implement such recommendations.</text></subsection></section> 
<section id="H6157589B41764EF19A122629864ACFED" section-type="subsequent-section"><enum>123.</enum><header>Notification of close proximity encounters and analysis of data</header> 
<subsection id="H54EF7B970D46447EAA3905D665760DEE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator, in accordance with the mandatory occurrence reporting requirements in FAA Order JO 7210.632A, titled <quote>Air Traffic Organization Occurrence Reporting</quote> (or any successor document), FAA Order 8020.11D, titled <quote>Aircraft Accident and Incident Notification, Investigation, and Reporting</quote> (or any successor document), and FAA Advisory Circular AC 90–120, titled <quote>Operational Use of Airborne Collision Avoidance Systems</quote> (or any successor document), shall establish a process to—</text> <paragraph id="H84950F61049A457CA0B37D9059CE2154"><enum>(1)</enum><text>notify, with respect to each event, parties involved with—</text> 
<subparagraph id="HE1432B67023349968B1D3871EB06F28C"><enum>(A)</enum><text>a near midair collision event;</text></subparagraph> <subparagraph id="H76D2835A8F8546C39A23D6450C09D45D"><enum>(B)</enum><text>a traffic collision avoidance system resolution advisory event;</text></subparagraph> 
<subparagraph id="HAF91544C743A44CCAB58FB6D15D28651"><enum>(C)</enum><text>a close proximity encounter, as defined pursuant to section 122; and</text></subparagraph> <subparagraph id="HC36C17D4BE6B4FAD967C26A9660B2045"><enum>(D)</enum><text>any other events, as determined by the Administrator; and</text></subparagraph></paragraph> 
<paragraph id="HDA2311F4213B4C7FB73029659F377E2A"><enum>(2)</enum><text>provide deidentified event data to the Aviation Safety Information Analysis and Sharing program.</text></paragraph></subsection> <subsection id="H7A7CFE251EFC4C89B39784C94BBF3B1A"><enum>(b)</enum><header>Requirements</header><text>In establishing the process under subsection (a), the Administrator shall—</text> 
<paragraph id="HC4D96C1A3A374754AD7F8577FFA8BD9B"><enum>(1)</enum><text>establish a database that tracks the details of events described in subsection (a)(1);</text></paragraph> <paragraph id="H8467750E28AF4C1FA69EE25B9CCD8657"><enum>(2)</enum><text>continuously monitor and review such database to identify areas of potential traffic conflict for safety assurance and safety risk management;</text></paragraph> 
<paragraph id="H9E9A05FE4BAB41EF9EABE0AD7E06F9C7"><enum>(3)</enum><text>ensure timeliness of notifications to the parties described in subsection (a)(1) so that relevant data remains available before meaningful safety analysis, reporting, or corrective action is no longer practicable;</text></paragraph> <paragraph id="H8528E1F6CA6247D49CF6DF9320B23CE3"><enum>(4)</enum><text display-inline="yes-display-inline">consider informing, with deidentified or aggregated data, other frequent operators of events described in subsection (a)(1); and</text></paragraph> 
<paragraph id="H4C2B030B071F4D0C9426D18DD4303AD8"><enum>(5)</enum><text>consider the practicality and usefulness of notification requirements for—</text> <subparagraph id="H46520B994A474C4A935D37840D3BDDAD"><enum>(A)</enum><text>airport surface loss of separation;</text></subparagraph> 
<subparagraph id="H8CBB9FCBC2974E43935613A488AA562E"><enum>(B)</enum><text>loss of separation with terrain or obstacles;</text></subparagraph> <subparagraph id="H731CAE25FAF2486687D7350CD8F203E5"><enum>(C)</enum><text>airborne loss of separation; and</text></subparagraph> 
<subparagraph id="HE734BFDB8C7A4624916088FB4A828DE7" commented="no"><enum>(D)</enum><text>any other close proximity encounters as determined by the Administrator.</text></subparagraph></paragraph></subsection> <subsection id="HDCDD8851A6BC44A383B32D6D2729DF36"><enum>(c)</enum><header>Consultation</header><text>In establishing the process under subsection (a), the Administrator shall consult with—</text> 
<paragraph id="HF14169495AF845A69F15EFF979964C2D"><enum>(1)</enum><text display-inline="yes-display-inline">air carriers operating under part 121 of title 14, Code of Federal Regulations;</text></paragraph> <paragraph id="H3721A691A5234644AADC1722D68A1DD1"><enum>(2)</enum><text>air carriers operating under part 135 of title 14, Code of Federal Regulations;</text></paragraph> 
<paragraph id="HAFDD3DACC02B4F3B88E9CE7EC083AD4D"><enum>(3)</enum><text>air carriers operating under part 91 of title 14, Code of Federal Regulations;</text></paragraph> <paragraph id="HB665C760E57E4FA98651F755121500CA"><enum>(4)</enum><text display-inline="yes-display-inline">organizations representing helicopter aviation operators and pilots;</text></paragraph> 
<paragraph id="H78E22C7A32BD410D903AAC00A6B7BCAC"><enum>(5)</enum><text>organizations representing the general aviation community;</text></paragraph> <paragraph id="H07CC9475F0464966A51851B59198E951"><enum>(6)</enum><text>organizations representing business aviation operators;</text></paragraph> 
<paragraph id="HB590B2E9063A42F58049F0A0B6862138"><enum>(7)</enum><text>organizations representing experimental aircraft operators;</text></paragraph> <paragraph id="H03C53247EAC445C3AE53656999E9F60E"><enum>(8)</enum><text>organizations representing powered-lift operators;</text></paragraph> 
<paragraph id="H57D299CE39CB421E97CF026B4CBE09B8"><enum>(9)</enum><text>organizations representing certified collective bargaining representatives of airline pilots;</text></paragraph> <paragraph id="H1A1D2351B2D9462189B05D8B1153F0D2"><enum>(10)</enum><text>the certified exclusive bargaining representatives of air traffic controllers of the Administration certified under section 7111 of title 5, United States Code;</text></paragraph> 
<paragraph id="H34EC02B992FE45948C3AFA49F949F1E3"><enum>(11)</enum><text>FAA subject matter experts, including aviation safety inspectors; and</text></paragraph> <paragraph id="H332EB82656C8463A933DAE05AE401D67"><enum>(12)</enum><text>other aviation safety experts determined appropriate by the Administrator.</text></paragraph></subsection> 
<subsection id="H894980A355B64BD7846480FEC1759890"><enum>(d)</enum><header>Briefing</header><text>Not later than 30 days after establishing the process required under subsection (a), the Administrator shall brief the appropriate committees of Congress on the implementation of this section.</text></subsection> <subsection id="HB8A881A1B8264E7C88BB3C490158FD2B"><enum>(e)</enum><header>Report</header><text>Not later than 1 year after establishing the process required under subsection (a), and annually thereafter, the Administrator shall submit to the appropriate committees of Congress a report containing—</text> 
<paragraph id="HB3F4D2DD69BC40D69F1C708A41362594"><enum>(1)</enum><text>data on number and location of—</text> <subparagraph id="H7706CF810B3F4EC8BF32C2EED67F03CB"><enum>(A)</enum><text display-inline="yes-display-inline">near midair collision events; </text></subparagraph> 
<subparagraph id="HD82BB255CEB64242B370E54938FF629E"><enum>(B)</enum><text>traffic collision avoidance system resolution advisory events; and </text></subparagraph> <subparagraph id="H8C4DD413041A49F7992B774DC2FBC1B7"><enum>(C)</enum><text>close proximity encounters, as defined pursuant to section 122;</text></subparagraph></paragraph> 
<paragraph id="HBE36160BF1D148B7B6BBF9ACCC3522F7"><enum>(2)</enum><text>the average time of notification to parties involved in such events;</text></paragraph> <paragraph id="H2D289B0B1F2A4945996370160AAB46DD"><enum>(3)</enum><text>identified locations of concern or other trends; and</text></paragraph> 
<paragraph id="HC9D2E40593C24D769BACD596AEF27CFC"><enum>(4)</enum><text>actions taken to mitigate identified risks and reduce such events.</text></paragraph></subsection> <subsection id="H0C9F781B31C04CC9AC8B44B415727BE7"><enum>(f)</enum><header>Protection of data</header> <paragraph id="H1DB2285FEF124779A77C54B7C2951E46"><enum>(1)</enum><header>In general</header><text>Data collected in response to subsection (a) shall be used solely for safety assurance and safety risk management.</text></paragraph> 
<paragraph id="HB3B59C3C4F14436695DED705A02AF0BC"><enum>(2)</enum><header>Consistency with existing safety programs</header><text display-inline="yes-display-inline">The Administrator shall ensure consistency with existing voluntary safety programs, including the Aviation Safety Action Program, the Aviation Safety Reporting System, the Air Traffic Safety Action Plan, and flight operational quality assurance programs.</text></paragraph></subsection></section> <section id="H1B0E4D8BEAC14EE0BA4840888E0D0877"><enum>124.</enum><header>Safety culture and safety management review</header> <subsection id="H40958ABF001F42C8B8343ED41959C71D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, the inspector general of the Department of Transportation shall initiate an audit of the safety culture and the safety management system of the Air Traffic Organization and the Aviation Safety Management Organization.</text></subsection> 
<subsection id="H92F68C2D188840DCA180F01822C19ED8"><enum>(b)</enum><header>Considerations</header><text>In conducting the audit under subsection (a), the inspector general shall, at a minimum, evaluate—</text> <paragraph id="H3634C85B29014AB291099D551D7F6217"><enum>(1)</enum><text display-inline="yes-display-inline">the safety management system of the Air Traffic Organization and the Aviation Safety Management Organization, including the functions and data sharing activities of such system at all air traffic control facilities;</text></paragraph> 
<paragraph id="H5C77BCD0D44740F19917743327E9B153"><enum>(2)</enum><text>whether such system effectively coordinates safety assurance and safety risk management activities with external stakeholders consistent with FAA requirements for operators under section 5.57 of title 14, Code of Federal Regulations;</text></paragraph> <paragraph id="H68204297FBC546839BBF1A2A0AD2705E"><enum>(3)</enum><text>which data analysis, safety assurance, and risk assessment processes failed to identify and mitigate the risk of potential midair collisions near Ronald Reagan Washington National Airport before January 29, 2025;</text></paragraph> 
<paragraph id="H602868A81C594AAA946494458F83C677"><enum>(4)</enum><text display-inline="yes-display-inline">the failure of the Air Traffic Organization and the Aviation Safety Management Organization to recognize external compliance verification results as indicators of systemic traffic management, volume, and flow issues at Ronald Reagan Washington National Airport for which air traffic controllers were required to compensate to mitigate such issues;</text></paragraph> <paragraph id="H340CCF95FBBC4FBC9F9070F0EF044D52"><enum>(5)</enum><text display-inline="yes-display-inline">the failure of the Air Traffic Organization and the Aviation Safety Management Organization to conduct annual reviews of helicopter route charts as required by FAA Order JO 7210.3EE, titled <quote>Facility Operation and Administration</quote>;</text></paragraph> 
<paragraph id="HB79B7A4C7D5F4AB99D0E217B06575146"><enum>(6)</enum><text display-inline="yes-display-inline">the failure of the Air Traffic Organization and the Aviation Safety Management Organization to understand and implement post-accident and post-incident drug and alcohol testing as required by Department of Transportation Order 3910.1D, titled <quote>Drug and Alcohol-Free Departmental Workplace Program</quote>;</text></paragraph> <paragraph id="H9392E9999A384D7496CA3A2F53C5F2BD"><enum>(7)</enum><text>whether there are fears of retaliation against persons identifying or reporting risks in accordance with the safety management system; and</text></paragraph> 
<paragraph id="H9290D68C62B64212982EE0171E682016"><enum>(8)</enum><text display-inline="yes-display-inline">how the Air Traffic Organization and the Aviation Safety Management Organization have addressed the findings and utilized the Safety Risk Management process in accordance with FAA Order 8040.4C, titled <quote>Safety Risk Management Policy</quote> (or any successor document) in the National Airspace System Helicopter Operations Helicopter Route Analysis of the FAA issued in April 2025.</text></paragraph></subsection> <subsection id="H8FFDD24CC2F54C3C9234C7C6A973FFCA"><enum>(c)</enum><header>Report of the inspector general</header> <paragraph id="H44BC11BA8CC74C36BF6D0F07D15C1F6F"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the inspector general shall submit to the appropriate committees of Congress a report on the audit conducted under subsection (a).</text></paragraph> 
<paragraph id="HE54040933F9A40928B4246374231754F"><enum>(2)</enum><header>Recommendations</header><text display-inline="yes-display-inline">The inspector general shall include in the report submitted under paragraph (1)—</text> <subparagraph id="HC9D372D508A54734A4589C47EBEFA5FA"><enum>(A)</enum><text display-inline="yes-display-inline">recommendations for actions the Secretary should take with respect to the Air Traffic Organization and the Aviation Safety Management Organization to—</text> 
<clause id="HBB5A202C69494D5280F2243D188D778C"><enum>(i)</enum><text>strengthen and adhere to the tenets of the safety management system;</text></clause> <clause id="H2919E76886E344AABC4B20FF8CB8EB06"><enum>(ii)</enum><text display-inline="yes-display-inline">increase transparency in the safety management system process, including by adopting policies that provide assurances to FAA employees that the Air Traffic Organization is addressing any identified safety issues;</text></clause> 
<clause id="H9F9F36F7318B4A1BB12C0DAAC899261A"><enum>(iii)</enum><text>increase data sharing and collaboration with external stakeholders;</text></clause> <clause id="H2C3ABA34E1F447D888CF341AB73107D4"><enum>(iv)</enum><text>protect against retaliation;</text></clause> 
<clause id="H6BC3AB823C9C4345BCEA5BBC5405B2C4"><enum>(v)</enum><text>encourage open, nonpunitive communication; and</text></clause> <clause id="H1E00931BFFB348AC811DC34ABD5A1F84"><enum>(vi)</enum><text display-inline="yes-display-inline">foster a just culture across the Air Traffic Organization and the Aviation Safety Management Organization;</text></clause></subparagraph> 
<subparagraph id="H1504A492C9284D5E9860DA546AC1C7E2"><enum>(B)</enum><text display-inline="yes-display-inline">recommendations for actions the Secretary may take to ensure adequate oversight over the safety management system of the Air Traffic Organization; and</text></subparagraph> <subparagraph id="HE9E8D67EB14E421B84F1201698483094"><enum>(C)</enum><text>any other recommendations the inspector general determines appropriate.</text></subparagraph></paragraph></subsection> 
<subsection id="HB9C51D3E4438411A9AB2825674A08C6B"><enum>(d)</enum><header>Response to recommendations</header><text>Not later than 120 days after submission of the report required under subsection (c)—</text> <paragraph id="HD9C3BB480D564B79B71E0647F62FA5F8"><enum>(1)</enum><text>the Secretary shall respond to any recommendations in such report that are directed at the Department of Transportation or FAA, respectively; and</text></paragraph> 
<paragraph id="H50AEF9DC26634E1AB4C9F4E9374F0C77"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary shall submit to the appropriate committees of Congress a report describing how the Secretary intends to implement such recommendations.</text></paragraph></subsection></section> <section id="HC702D9A83FD443C0AA014614C7460AD2"><enum>125.</enum><header>Documentation of control position combinations</header> <subsection id="HC5747E7A531E4AF2924E31047757980E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator shall review and revise, as appropriate, procedures regarding the documentation of the combination of air traffic control position responsibilities, including each occurrence in which any air traffic control position is combined with any other position, including a local control position, operations supervisor, or controller-in-charge.</text></subsection> 
<subsection id="H7B644946954D46B6B533AA8093031296"><enum>(b)</enum><header>Requirements</header><text>In reviewing and revising the procedures described in subsection (a), the Administrator shall—</text> <paragraph id="H280312EDA97F4EA295E452537745B1F7"><enum>(1)</enum><text display-inline="yes-display-inline">evaluate procedures and guidance regarding the combination of controller position responsibilities described in subsection (a) that are in effect prior to the date of enactment of this Act;</text></paragraph> 
<paragraph id="H6D746F5CBBEB49B88187BE42DBCBC57C"><enum>(2)</enum><text>examine the feasibility of digitizing, or providing an electronic means of, the documentation described in subsection (a);</text></paragraph> <paragraph id="H97FC1111C9E34BBE951EDFF9CD66737E"><enum>(3)</enum><text display-inline="yes-display-inline">require the operations supervisor to periodically review documentation of occurrences of combined control position responsibilities described in subsection (a) and report on deviations from the standard operating procedures to the facility air traffic manager;</text></paragraph> 
<paragraph id="HC527AAA523944AA8985FE3904FD8318F"><enum>(4)</enum><text>consider air traffic facility type and staffing level; and</text></paragraph> <paragraph id="H7AE4745D7BC74787A1F8BD64E69D0CF9"><enum>(5)</enum><text>consult with representatives of—</text> 
<subparagraph id="H1E0D1976738D4B9F8F7C247897A6CC99"><enum>(A)</enum><text>the exclusive bargaining representative of air traffic controllers certified under section 7111 of title 5, United States Code;</text></subparagraph> <subparagraph id="H273514A6465A441EA959E9D36D50395E"><enum>(B)</enum><text>organizations representing air traffic control managers and operational supervisors; and</text></subparagraph> 
<subparagraph id="HF933698492D041E6984049640B795D4B"><enum>(C)</enum><text>aviation safety experts with specific knowledge in information technology.</text></subparagraph></paragraph></subsection> <subsection id="H56976DD89A314C93B8B1EFD9E96E93AE"><enum>(c)</enum><header>Briefing to Congress</header><text>Not later than 1 year after the completion of the review required under subsection (a), the Administrator shall brief the appropriate committees of Congress on implementation of this section.</text></subsection> 
<subsection id="HCEDA07351F5244FDBE41A3243B221E3A"><enum>(d)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section may be construed to interfere with any agreement between a governmental agency and the exclusive bargaining representative of air traffic controllers certified under section 7111 of title 5, United States Code or section 7106(a) of title 5, United States Code.</text></subsection> <subsection id="HAD956567FC7549D6A2ED45FB2B73D6AC"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H5E8535AA3487440DAE26B4EB3441DA53"><enum>(1)</enum><header>Controller-in-charge</header><text>The term <term>controller-in-charge</term> means an air traffic control specialist performing duties of a shift supervisor in accordance with—</text> <subparagraph id="H97507D1DCF3244B8A254FBA4C7F29D32"><enum>(A)</enum><text>FAA Order JO 7210.3EE, titled <quote>Facility Operation and Administration</quote>, issued on February 20, 2025; and</text></subparagraph> 
<subparagraph id="H70242FBAC4B94A179021415786D7EA53"><enum>(B)</enum><text>FAA Order JO 7110.65BB, titled <quote>Air Traffic Control</quote>, issued on February 20, 2025.</text></subparagraph></paragraph> <paragraph id="HC44433A65E3F4400A35458BBE8C1CBC1"><enum>(2)</enum><header>Operations supervisor</header><text>The term <term>operations supervisor</term> means managerial personnel responsible for the direct supervision of air traffic control operational personnel.</text></paragraph></subsection></section> 
<section id="HB67CD89931FF44F6BAE0AB897F700455"><enum>126.</enum><header>Review of miles-in-trail procedures or agreements</header> 
<subsection id="HF12E1BB2AC4D4E50BA6ADF312EF92A6B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the Administrator shall complete a review of the miles-in-trail standards and procedures to determine if such standards provide for a separation of traffic that is appropriate for operational safety.</text></subsection> <subsection id="H2E79B99605D54646A01550538F5274C4"><enum>(b)</enum><header>Considerations</header><text display-inline="yes-display-inline">In conducting the review under subsection (a), the Administrator may consider—</text> 
<paragraph id="H2057644C17374B71B5B4A9F3DB13478A"><enum>(1)</enum><text display-inline="yes-display-inline">the accuracy of the criteria used to determine the miles-in-trail procedures for air traffic control facilities;</text></paragraph> <paragraph id="H547AD3C8159347FDA144CBE0C336161F"><enum>(2)</enum><text>whether additional criteria should be incorporated to more appropriately reflect the traffic volume and operational complexity of air traffic control facilities; and</text></paragraph> 
<paragraph id="HDE06C6A8FFB047E98454719DCDE0BE7C"><enum>(3)</enum><text>the findings and recommendations of the National Transportation Safety Board.</text></paragraph></subsection> <subsection id="H339C72E1B7004AB6A30336640D38B059"><enum>(c)</enum><header>Standards update</header><text display-inline="yes-display-inline">Upon completion of the review conducted under subsection (a), the Administrator shall update the miles-in-trail standards and procedures to ensure such standards and procedures are appropriate for operational safety.</text></subsection> 
<subsection id="H026730AA122F42B68987230DE2B52FC6"><enum>(d)</enum><header>Review of certain facilities</header><text display-inline="yes-display-inline">Not later than 90 days after the completion of the review under subsection (a), the Administrator shall initiate a review of the miles-in-trail procedures or agreements at all air traffic control facilities located within Class B or Class C airspace to ensure such procedures or agreements provide for a separation of traffic that is appropriate for operational safety.</text></subsection> <subsection id="H4E9102C8698842DF854A5CD4D13E7148"><enum>(e)</enum><header>Consultation</header><text>In carrying out the review under subsection (d), the Administrator shall consult with, at minimum—</text> 
<paragraph id="H035F705CA9664641B98C0D95B5478779"><enum>(1)</enum><text>the exclusive bargaining representatives of the air traffic controllers certified under section 7111 of title 5, United States Code;</text></paragraph> <paragraph id="H2732479092D64F58AAD398FB355119DF"><enum>(2)</enum><text display-inline="yes-display-inline">organizations representing air traffic control managers and operations supervisors;</text></paragraph> 
<paragraph id="HF0ABAA7501924104AD20352264EF7AC0"><enum>(3)</enum><text>sponsors and operators of airports with air traffic control facilities described in subsection (d);</text></paragraph> <paragraph id="H9855933D2A9B42A7AD6198ED8AF9DD94"><enum>(4)</enum><text display-inline="yes-display-inline">organizations representing the certified collective bargaining representatives of pilots operating under part 121 of title 14, Code of Federal Regulations; and</text></paragraph> 
<paragraph id="HC7F5969E3D984950BFFA3B6FA7AB737A"><enum>(5)</enum><text display-inline="yes-display-inline">air carriers, business aviation, and general aviation operators with operations at airports with air traffic control facilities described in subsection (d).</text></paragraph></subsection> <subsection id="H956BF46653114268BA6964D93393B26A"><enum>(f)</enum><header>Report</header><text>Not later than 18 months after the date of enactment of this Act, the Administrator shall submit to the appropriate committees of Congress a report that includes—</text> 
<paragraph id="HFBF230D5606E412D9CFDCEFBF6345FB2"><enum>(1)</enum><text>a list of air traffic control facilities identified under subsection (d) as having miles-in-trail procedures or agreements that did not provide for a separation of aircraft traffic appropriate for operational safety; and</text></paragraph> <paragraph id="HA1698C9CE7DD4ECC8289AD730412946E"><enum>(2)</enum><text>steps that the Administrator has taken, or plans to take, to modify the miles-in-trail procedures or agreements at each facility listed under paragraph (1) to ensure such procedures or agreements provide for a separation of traffic that is appropriate for operational safety.</text></paragraph></subsection></section> 
<section id="H52976B4ED8C6453ABA060C616EB22D9F" display-inline="no-display-inline" section-type="subsequent-section"><enum>127.</enum><header>Closure of Helicopter Route 4</header> 
<subsection id="HDA92987927894E3AAA9EB5808CA42520"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Operations on Helicopter Route 4, as such Route existed on January 29, 2025, on the segment located between Hains Point and the Woodrow Wilson Memorial Bridge in the District of Columbia shall be prohibited.</text></subsection> <subsection id="H6DEA6F094171414AAA801F5F9DBE0597"><enum>(b)</enum><header>Segment elimination</header><text>The segment of Helicopter Route 4 described in subsection (a) shall remain eliminated from helicopter charts.</text></subsection></section></title>
