R. 755</legis-num><current-chamber display="yes">IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260304">March 4, 2026</action-date><action-desc>Received; read twice and placed on the calendar</action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend the Energy Act of 2020 to harmonize the lists of critical minerals and critical materials, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC" id="H0A3C22D9DF9B41D39D60AE549CBE1AC2"><section id="H05875BCDE76F421A872CEB77EE65C9F0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Critical Mineral Consistency Act of 2025</short-title></quote>.</text></section><section id="H90669AB77F5C4DCC81264E63D970C1A8"><enum>2.</enum><header>Critical minerals and materials list</header><text display-inline="no-display-inline">Section 7002 of the Energy Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/30/1606">30 U.S.C. 1606</external-xref>) is amended—</text><paragraph id="H4D07546AA73043F09DA8F79FEB29C2F7"><enum>(1)</enum><text>in subsection (c)(4)(C), by inserting <quote>minerals or materials</quote> after <quote>critical</quote>;</text></paragraph><paragraph id="H21885AC241EA4832A3E1BD25683AE36C"><enum>(2)</enum><text>by redesignating subsection (o) as subsection (p); and</text></paragraph><paragraph id="H73F71BCA363F4EEBB5A48541A8C67634"><enum>(3)</enum><text>by inserting after subsection (n) the following:</text><quoted-block style="OLC" id="H16E2689F37BD479E81FCEDC8D9C8B27A" display-inline="no-display-inline"><subsection id="H7AC79C17335346ABA73217832DD8ADB5"><enum>(o)</enum><header>Critical minerals and materials list</header><paragraph id="H9097EE271F964AE28F3DFEE8015F5542"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 45 days after the date of enactment of the Critical Mineral Consistency Act of 2025, the Secretary shall publish a Critical Minerals and Materials List, which shall include—</text><subparagraph id="HFEDBC9C737284FF99AFAA08498204850"><enum>(A)</enum><text>any critical mineral designated by the Secretary under subsection (c); and</text></subparagraph><subparagraph id="HD9D999886CE541959DAE95B459BE4786"><enum>(B)</enum><text>any non-fuel mineral, element, substance, or material that the Secretary of Energy has determined to be a critical material under subsection (a)(2) as of that date of enactment.</text></subparagraph></paragraph><paragraph id="H13ADAF8E4E11455DB6D161DD5C9F9C24"><enum>(2)</enum><header>Updates</header><text>The Secretary shall update the Critical Minerals and Materials List published under paragraph (1)—</text><subparagraph id="HB8E1D342235744A5A2D1B3EF5B8A5810"><enum>(A)</enum><text>not later than 45 days after the date on which the Secretary updates a critical mineral designation under subsection (c); and</text></subparagraph><subparagraph id="H37271523C2B549C4BF58DB25DE669FA6"><enum>(B)</enum><text>not later than 45 days after the date on which the Secretary of Energy updates a critical material designation under subsection (a)(2).</text></subparagraph></paragraph><paragraph id="H3EBC9AC849D84FEF93B642897C091923"><enum>(3)</enum><header>Publication alignment</header><text>To the maximum extent practicable, the Secretary and the Secretary of Energy shall coordinate when updates to the Critical Minerals and Materials List may be required under paragraph (2).</text></paragraph><paragraph id="H32F13926CE43432BA94EC432CC168EBB"><enum>(4)</enum><header>Administration</header><text>For the purposes of administering programs involving critical minerals or critical materials, the Secretary, the Secretary of Energy, and the heads of other Federal departments and agencies where such department or agency has incorporated by reference the definition of <quote>critical mineral</quote> or <quote>critical material</quote> from this section, as applicable, shall use the most recently published version of the Critical Minerals and Materials List published under paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body><attestation><attestation-group><attestation-date date="20260303" chamber="House">Passed the House of Representatives March 3, 2026.</attestation-date><attestor display="yes">Kevin F.
