<section section-type="section-one" id="HD446D384192F4486977C4D0C05AB944E"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Countering Beijing’s Weaponization of Fentanyl Act</short-title></quote> or the <quote><short-title>CBW Fentanyl Act</short-title></quote>.</text></section> <section id="HF61CF6B1496D4C54A18D0F9CB4A3970F"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">Section 302 of the Chemical and Biological Weapons Control and Warfare Elimination Act of 1991 (<external-xref legal-doc="usc" parsable-cite="usc/22/5601">22 U.S.C. 5601</external-xref>) is amended—</text>
<paragraph id="H15CD80C3F1184EF08B6985C5F3AD421B"><enum>(1)</enum><text>by redesignating paragraphs (2), (3), and (4) as paragraphs (3), (4), and (5), respectively;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H41C06832104A42E0BC720BB7B2C57F8C"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>that use chemical</quote> and inserting the following: “that—</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="H5C9CA644BD24481D86CF22CCB1584321">
<subparagraph id="HEE98F6264E2C472B88479547761FD1CC"><enum>(A)</enum><text display-inline="yes-display-inline">use chemical</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="HD2F0C7EDD81E44BAA3DF5C768666CA4E"><enum>(3)</enum><text>by striking <quote>law or use</quote> and inserting the following: “law;</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="H41A80211ED5A4A1392E988AA9C6C145E">
<subparagraph id="H8372DB13C8DE4EE78E2101D3F9B9E026"><enum>(B)</enum><text>use</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H2DF19358E48C440DBF3C1BAB22F07F99"><enum>(4)</enum><text>by striking <quote>nationals, and to impose</quote> and inserting the following: “nationals; or</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="H90419C229983421E91E95C6491D853FE">
<subparagraph id="HF943C85E5E394288A1EC64F702B7FA67"><enum>(C)</enum><text display-inline="yes-display-inline">commit an act concerning a chemical or biological program that results in injury or damages to another country; and</text></subparagraph> <paragraph id="H3C509A802DD2485D857678DE9E0799F6"> <enum>(2)</enum> <text>to impose</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="H06F7294F099B4FFE9E3D50B587E6C400"><enum>3.</enum><header>Presidential reporting requirements</header><text display-inline="no-display-inline">Section 306 of the Chemical and Biological Weapons Control and Warfare Elimination Act of 1991 (<external-xref legal-doc="usc" parsable-cite="usc/22/5604">22 U.S.C. 5604</external-xref>) is amended—</text> <paragraph commented="no" id="H747C5FF790144D4690BAA72B70D747C8"><enum>(1)</enum><text display-inline="yes-display-inline">in the section heading, by inserting before the period the following: <quote><header-in-text level="section" style="OLC">or acts concerning a chemical or biological program</header-in-text></quote>;</text></paragraph>
<paragraph id="H15774373AA5D4620BEEC819D70C239AA"><enum>(2)</enum><text>in subsection (a)—</text> <subparagraph id="HBB2745D6558A473FAED42962E6905082"><enum>(A)</enum><text>in paragraph (1)—</text>
<clause id="H4C57F93B6D574302B8ADB9DD25CF334A"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>Whenever</quote> and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HC9D436F2CF004B6FABFD33F21E982262"> <subparagraph id="H6139FC3193B44A89AE073FA47729BDCE"><enum>(A)</enum><header>Determination regarding chemical or biological weapons</header><text display-inline="yes-display-inline">Whenever</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause>
<clause id="H866B308E3E674591812666104B81AD62"><enum>(ii)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HE8D19C05EF514E6CAB817FBEF5E518B7"> <subparagraph id="H715EBFF5ADE44423AF9C8B83BB044D12"><enum>(B)</enum><header>Determination regarding chemical or biological program</header><text display-inline="yes-display-inline">Whenever credible information becomes available to the President indicating a substantial possibility that, on or after the date of the enactment of the <short-title>Countering Beijing’s Weaponization of Fentanyl Act</short-title>, an individual who is an official, employee, or agent of a foreign governmental entity has committed a covered act, the President shall, not later than 60 days after the receipt of that information by the President, determine whether the individual committed a covered act. The President shall impose the sanctions described in section 310 with respect to the individual if the President determines that the individual has committed a covered act.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph>
<subparagraph id="HC4A73AC5A6AC4F3AA357090AB775CED3"><enum>(B)</enum><text>in paragraph (2)—</text> <clause id="HBFFD1F3E2F0646B4827FE9748831A849"> <enum>(i)</enum> <text display-inline="yes-display-inline">by redesignating subparagraphs (A) through (E) as clauses (i) through (v), respectively, and by moving such clauses, as so redesignated, 2 ems to the right;</text> </clause>
<clause id="HFF037775A4E8425391AF756E16138CB9"><enum>(ii)</enum><text>by striking <quote>In making the determination under paragraph (1)</quote> and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H4912B59A5DA14F4989414E4109F43038"> <subparagraph id="H5FAFDAB746274C97A481F5631A45CC3B"><enum>(A)</enum><header>Considerations regarding chemical or biological weapons</header><text display-inline="yes-display-inline">In making the determination under paragraph (1)(A)</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause>
<clause id="H78EECBC0ECF84EFB9D3D74967A039A45"><enum>(iii)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H8ADC45D3E031495FB517123FC009DCCC"> <subparagraph id="HEF1AE04775034F029BC7E9D2DCB9640B"><enum>(B)</enum><header>Considerations regarding chemical or biological program</header><text display-inline="yes-display-inline">In making a determination under paragraph (1)(B) with respect to whether an individual who is an official, employee, or agent of a foreign governmental entity has committed a covered act, the President shall consider the following:</text>
<clause id="H636E90EDD8EA4856841F68E425C8FF3D"><enum>(i)</enum><text display-inline="yes-display-inline">Physical and circumstantial evidence available relevant to the possibility that the individual committed a covered act. </text></clause> <clause id="H3DC84111FFFC4848841541F543FC41D6"><enum>(ii)</enum><text>Whether evidence exists that the chemical or biological program associated with the covered act has a civilian or military purpose or application. </text></clause>
<clause id="HC28B5B66A48C4D7F9D769251EB93E949"><enum>(iii)</enum><text display-inline="yes-display-inline">Whether the foreign governmental entity attempted to conceal or withhold information regarding the covered act from a relevant international organization or the government of a foreign country other than the foreign country most closely associated with the entity.</text></clause> <clause id="H0AB5D0FE58824A7B839A2137A5E670E6" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">Whether, and to what extent, the foreign governmental entity and the government of the foreign country most closely associated with the foreign governmental entity have voluntarily disclosed substantive information regarding the covered act to relevant international organizations. </text></clause>
<clause id="H5AFEF88F2F1241C6BD8ABF666AD27C88"><enum>(v)</enum><text display-inline="yes-display-inline">Whether, and to what extent, the government of that country is compliant with the obligations of the country under each covered treaty.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> <subparagraph id="H1763622BB04349C4986A707BCAEF3590"><enum>(C)</enum><text>in paragraph (3)—</text>

<clause id="H35C87C4282AD456EAA7F74F9F22E0152"><enum>(ii)</enum><text>by striking <quote>If the determination is</quote> and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H30EE7DA942064C379706D345A3A734AC"> <subparagraph id="H92208F2453064447AAFA50F6EB5858CF"><enum>(B)</enum><header>Report requirements</header> <clause id="HE19920BA3429405DA94A3A9432B7EFD6"><enum>(i)</enum><header>Requirements for chemical or biological weapons determination</header><text>If the determination is a determination under paragraph (1)(A)</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause>
<clause id="H309481F066634330BC4DC997988D4A6B"><enum>(iii)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H74AAB57A0A4D42E2A8837DCA557CCED5"> <clause id="HA9FFC56D7B614E46AC2B639D60625F75"><enum>(ii)</enum><header>Requirements for chemical or biological program determination</header><text display-inline="yes-display-inline">If the determination is a determination under paragraph (1)(B) that an individual has committed a covered act, the report shall specify the sanctions to be imposed pursuant to section 310.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph>
<paragraph id="HF85873C16C6C48D28BBBC10849B0E238"><enum>(3)</enum><text>in subsection (b)—</text> <subparagraph id="HDBC7A3B2F7DB468DBAB57CC9C172A6CB"><enum>(A)</enum><text>in paragraph (1)—</text>
<clause id="H58E1974A3EB54C34827D2C352CD1713B"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>whether a particular</quote> and inserting the following: “whether—</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H99C3A23D6E874659A0B4E64C5CD62167"> <subparagraph id="H7FFC41A586D6494B9E59780965CAC598"><enum>(A)</enum><text display-inline="yes-display-inline">a particular</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause>
<clause id="HB248BACF845B465CB0CAABD8B1710045"><enum>(ii)</enum><text>by striking the period and inserting the following: “; or</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H2BFBE1C8EE4A41F1A4BBDB35F375E4C7"> <subparagraph id="H9BE5515AB3EB4A74AA30E9D6C32B3182"><enum>(B)</enum><text display-inline="yes-display-inline">a particular individual, on or after the date of the enactment of the <short-title>Countering Beijing’s Weaponization of Fentanyl Act</short-title>, has committed a covered act.</text></subparagraph> <after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph>
<subparagraph id="H65B4D7F38DCE41BE8C806F833520A287"><enum>(B)</enum><text>in paragraph (2)—</text> <clause id="H5B9E281C316A467782022108611931C5"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>Not later</quote> and inserting the following:</text>

This report</quote> and inserting the following: “nationals; or</text>

<clause id="H656413C32B044515A3263765AF08B6B8"><enum>(ii)</enum><text display-inline="yes-display-inline">the specified individual, on or after the date of the enactment of the <short-title>Countering Beijing’s Weaponization of Fentanyl Act</short-title>, has committed a covered act.</text></clause> <subparagraph id="H944AC917C589437283B84FAC5F736242"> <enum>(B)</enum> <header>Report contents</header> <text>Each report provided under this paragraph</text> </subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause>
<clause id="H1668ACD11BC44C60BFD9A0E223A0087F"><enum>(iv)</enum><text>by striking <quote>subsection (a)(2)</quote> and inserting <quote>subparagraph (A) or (B) of subsection (a)(2), as applicable</quote>.</text></clause></subparagraph></paragraph></section> <section id="H3B551F7F1FA046FFB18E3770D4953D9C"><enum>4.</enum><header>Required sanctions on foreign countries in response to certain acts concerning chemical or biological program</header><text display-inline="no-display-inline">The Chemical and Biological Weapons Control and Warfare Elimination Act of 1991 (<external-xref legal-doc="usc" parsable-cite="usc/22/5601">22 U.S.C. 5601 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="H25FECBC526604FA99CC9DDEF0A2E6DD7"><enum>310.</enum><header>Sanctions on foreign countries in response to acts concerning chemical or biological programs</header>
<subsection id="HF589C66E2FA94673B276FB47A446BDF7"><enum>(a)</enum><header>Initial sanctions</header><text display-inline="yes-display-inline">If the President makes a determination pursuant to section 306(a)(1)(B) with respect to an individual who is an official, employee, or agent of a foreign governmental entity, the President shall, not later than 30 days of making the determination, impose the following sanctions with respect to the foreign country most closely associated with that entity:</text> <paragraph id="HBFC6263224CD49BF99B001C1A5F04142"><enum>(1)</enum><text display-inline="yes-display-inline">Suspension of all scientific cooperative programs and agreements between the United States and that country.</text></paragraph>
<paragraph id="H10ABA0F55AC74D1CA0F7712E391B0445"><enum>(2)</enum><text>A prohibition on the export, reexport, or in-country transfer of items classified under Category 1 or Category 2 of the Commerce Control List to or in that country.</text></paragraph> <paragraph id="HCBFBD9F36D4B4201ADD5AE0FC94F3B43"><enum>(3)</enum><text>A prohibition on the procurement of, or entry into a contract to procure, a good or service from a person operating in the chemical or biological sectors of the economy of that country.</text></paragraph></subsection>
<subsection id="HCAA843357D914A0CAA6201FD6E0F1E5E"><enum>(b)</enum><header>Intermediate application of sanctions</header>
<paragraph id="H8BEB44A6208045A69A4B1FC290140EDE"><enum>(1)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 120 days after making a determination pursuant to section 306(a)(1)(B) with respect to an individual who is an official, employee, or agent of a foreign governmental entity, the President shall submit to the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate a report that states whether—</text> <subparagraph id="HCF38531D9D0F4C37979FB0081545DCA0"><enum>(A)</enum><text display-inline="yes-display-inline">the foreign governmental entity or the government of the foreign country most closely associated with that entity—</text>
<clause commented="no" display-inline="no-display-inline" id="HFFC1C3CBCAE949BB8410E883773E46D2"><enum>(i)</enum><text display-inline="yes-display-inline">has adequately addressed the covered act that was the basis for the determination;</text></clause> <clause id="H2CB6DA86E0764E8F93A8F80360290EBD"><enum>(ii)</enum><text>has voluntarily provided substantive information regarding the covered act to the United States Government and relevant international organizations; and</text></clause>
<clause id="H6298BD0D943642F6B20D990A40AB78C2"><enum>(iii)</enum><text>has developed or is developing measures to prevent the commission of covered acts in the future; and</text></clause></subparagraph> <subparagraph id="HD24A3E9DF86047E7AA9DF4DCFB1EB95C"><enum>(B)</enum><text display-inline="yes-display-inline">the government of that country is compliant with the obligations of the country under each covered treaty.</text></subparagraph></paragraph>
<paragraph id="HBCE727C173814C9589087FEFE43AD6B0"><enum>(2)</enum><header>Sanctions required</header><text display-inline="yes-display-inline">If the report required by paragraph (1) states that any action described in paragraph (1) has not been taken by the foreign governmental entity or the government of the foreign country, as applicable, the President shall impose not fewer than 2 of the following sanctions with respect to the foreign country:</text> <subparagraph id="HEEFAFDD123464733942CCADC4E5CA46F"><enum>(A)</enum><text>Termination of assistance provided to the country pursuant to the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151">22 U.S.C. 2151 et seq.</external-xref>), except for urgent humanitarian assistance, food, or other agricultural commodities or products.</text></subparagraph>
<subparagraph id="H84596F80D4BE446C9B5D2129811F19A3"><enum>(B)</enum><text display-inline="yes-display-inline">A prohibition on the export, reexport, or in-country transfer of items controlled under the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4801">50 U.S.C. 4801 et seq.</external-xref>) to or in the country, including items controlled for reasons related to the national security interests of the United States under the Export Administration Regulations, except that such prohibition shall not apply to a transaction subject to the reporting requirements of title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/413">50 U.S.C. 413 et seq.</external-xref>).</text></subparagraph> <subparagraph id="HE6610EC0AFAF4B738690C9F1D6A97D05"><enum>(C)</enum><text>A prohibition on the issuance of a license for the export, reexport, or retransfer of an item on the United States Munitions List (established pursuant to section 38 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2778">22 U.S.C. 2778</external-xref>)) if the license includes the country as a party.</text></subparagraph></paragraph>
<paragraph id="H607F13F1A4124F168F162EA2CEBFABFF"><enum>(3)</enum><header>Additional sanctions authorized</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H895344ED71604FAFAFB541D97EBF6A65"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The President may order the United States Government not to issue a license or grant a specific permission or authority under a provision of law described in subparagraph (B) to export a good or service to a foreign country subject to sanctions imposed under paragraph (2).</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H1E40151CA96E4FF4B4EEC27D50C0CCF0"><enum>(B)</enum><header>Provisions of law described</header><text display-inline="yes-display-inline">The provisions of law described in this subparagraph are the following:</text>
<clause id="HE12D42EBD9EA4E659D2710E113E2DA71"><enum>(i)</enum><text>The Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4801">50 U.S.C. 4801 et seq.</external-xref>).</text></clause> <clause id="H5F2B8B71603A4D179F96421F289D0515"><enum>(ii)</enum><text>The Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2751">22 U.S.C. 2751 et seq.</external-xref>).</text></clause>
<clause id="HB930F35A65F440A391C8A8AD46FA7229"><enum>(iii)</enum><text>The Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2011">42 U.S.C. 2011 et seq.</external-xref>).</text></clause> <clause id="H5A59239514D9409BB230EBB2A719E532"><enum>(iv)</enum><text>Any other statute that requires the prior review and approval of the United States Government as a condition for the export of goods or services.</text></clause></subparagraph></paragraph></subsection>
<subsection id="H9F2D5BA6AE2F43CDA1E8C7C86FEDAD64"><enum>(c)</enum><header>Final application of sanctions</header>
<paragraph id="HB2304A370378451BB741FEE117CA2AFF"><enum>(1)</enum><header>Presidential determination</header><text display-inline="yes-display-inline">Not later than 210 days after making a determination pursuant to section 306(a)(1)(B) with respect to an individual who is an official, employee, or agent of a foreign governmental entity, the President shall submit to the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate a report that states whether—</text> <subparagraph id="HF77F6B4378264801A896B029389A2FA5"><enum>(A)</enum><text display-inline="yes-display-inline">the foreign governmental entity or the government of the foreign country most closely associated with that entity—</text>
<clause commented="no" display-inline="no-display-inline" id="H31FCB4395C1844BBAB491DA7C96D2142"><enum>(i)</enum><text display-inline="yes-display-inline">has adequately addressed the covered act that was the basis for the determination;</text></clause> <clause id="H2DDC1AA80C204E1A83AC88102652D2D1"><enum>(ii)</enum><text>has voluntarily provided substantive information regarding the covered act to the United States Government and relevant international organizations; and</text></clause>
<clause id="H42D4DD12EADA42AAA522D320B2B1D4F4"><enum>(iii)</enum><text>has developed or is developing measures to prevent the commission of covered acts in the future; and</text></clause></subparagraph> <subparagraph id="H9ED98689313249CEB4DED206A763DB57"><enum>(B)</enum><text display-inline="yes-display-inline">the government of the country is compliant with the obligations of the country under each covered treaty.</text></subparagraph></paragraph>
<paragraph id="HA3F75FECF33C46FA8E176668C84A818A"><enum>(2)</enum><header>Effect of determination</header><text display-inline="yes-display-inline">If the report required by paragraph (1) states that any action described in paragraph (1) has not been taken by the foreign governmental entity or the government of the foreign country, as applicable, the President shall prohibit any transaction that—</text> <subparagraph id="HC4D5B12675494272A55ACB800AC0FBF4"><enum>(A)</enum><text display-inline="yes-display-inline">is—</text>
<clause id="H1FADBD40B4D9447AB7637D24287AB24D"><enum>(i)</enum><text>in foreign commerce; or</text></clause> <clause id="HC32557A39CA645A39B291FB597A56153"><enum>(ii)</enum><text>a transfer of credit or payment by, through, or to a financial institution;</text></clause></subparagraph>
<subparagraph id="H56DB318683164C34B6BBB2B6047C7C9C"><enum>(B)</enum><text display-inline="yes-display-inline">is subject to the jurisdiction of the United States; and</text></subparagraph> <subparagraph id="HB8CCA31C869A4F9DBFA8C31BE4949B0D"><enum>(C)</enum><text display-inline="yes-display-inline">involves a financial interest of the country.</text></subparagraph></paragraph></subsection>
<subsection id="H3E40DE24C61E4C58B6552AE5DE2DF66C"><enum>(d)</enum><header>Termination of sanctions</header><text display-inline="yes-display-inline">The President shall terminate each sanction imposed with respect to a foreign country pursuant to this section if, on or after the date that is 1 year after the first date on which the sanction was imposed, the President certifies to Congress that—</text> <paragraph id="HC86E7AD57A7E4075B57D9F887C15438E"><enum>(1)</enum><text display-inline="yes-display-inline">the government of the country, or the foreign governmental entity of which the individual who committed the covered act that was the basis for the imposition of such sanctions was an official, employee, or agent—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HC7B0E9A5CBFF4B6487F70EBAA559CE53"><enum>(A)</enum><text display-inline="yes-display-inline">has adequately addressed the act;</text></subparagraph> <subparagraph id="H82F29C0E01E542C59FF960685A0FB400"><enum>(B)</enum><text display-inline="yes-display-inline">has made or is making restitution to persons harmed by the covered act, including United States nationals;</text></subparagraph>
<subparagraph id="H8F18F749BFEF44DE8CF89886F9A32202"><enum>(C)</enum><text>has voluntarily provided substantive information regarding the covered act to the United States Government and relevant international organizations; and</text></subparagraph> <subparagraph id="HC8190CDD93E64B2FBF1987448D6F4D46"><enum>(D)</enum><text>has developed or is developing measures to prevent the commission of covered acts in the future; and</text></subparagraph></paragraph>
<paragraph id="H9BD5F25FFCAA46D38D2198FCE2A7D376"><enum>(2)</enum><text display-inline="yes-display-inline">the government of the country is compliant with the obligations of the country under each covered treaty.</text></paragraph></subsection> <subsection id="HC1BC3FCBDE2A427EB67FC906DDDA76BD"><enum>(e)</enum><header>Waiver</header> <paragraph id="HC06437F5BF1949C294C777A5D4745D02"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The President may, for periods of not more than 180 days, waive the imposition of sanctions required under this section if the President certifies to the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate that the waiver is vital to the national security interests of the United States.</text></paragraph>
<paragraph id="HD4B87E26B4274613AA24D4D52D8E3452"><enum>(2)</enum><header>Sunset</header><text>The President may not exercise the authority described in paragraph (1) on or after the date that is 5 years after the date of the enactment of the <short-title>Countering Beijing’s Weaponization of Fentanyl Act</short-title>.</text></paragraph></subsection></section> <section id="HAA884DCDF1B849FA8E4CE0CDB0C01F09"><enum>311.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
<paragraph id="H28559B9896974EC09BA3C40CA93FD65B"><enum>(1)</enum><header>Chemical or biological program</header><text>The term <term>chemical or biological program</term> means a program to produce, develop, or distribute—</text> <subparagraph id="HFA7E9B679F78441099AC2FB8837868F6"><enum>(A)</enum><text>a chemical or biological weapon;</text></subparagraph>
<subparagraph id="H1F225931F2D54235A9FA7CF5B8C067BF"><enum>(B)</enum><text display-inline="yes-display-inline">benzylfentanyl;</text></subparagraph> <subparagraph id="H297B4AC4D4264CF89FC28101DD176D22"><enum>(C)</enum><text display-inline="yes-display-inline">4-anilinopiperidine; or</text></subparagraph>
<subparagraph id="H7FBD4845735E45ABAF9985335955B7E0"><enum>(D)</enum><text>norfentanyl precursors.</text></subparagraph></paragraph> <paragraph id="H00F1DCFC5F2946E8A9259DB2DB593099"><enum>(2)</enum><header>Commerce Control List</header><text display-inline="yes-display-inline">The term <term>Commerce Control List</term> means the list maintained by the Bureau of Industry and Security of the Department of Commerce and set forth in Supplement No. 1 to part 774 of the Export Administration Regulations.</text></paragraph>
<paragraph id="H367A23348BC9437DA3F14B88A963380C"><enum>(3)</enum><header>Covered act</header><text display-inline="yes-display-inline">The term <term>covered act</term> means an act by an individual who is an official, employee, or agent of a foreign governmental entity, if—</text> <subparagraph id="H2FB931BE5DCD4936AF372B259C6348DD"><enum>(A)</enum><text display-inline="yes-display-inline">the individual knew or should have known that the act would result in injury or damages to a foreign country other than the foreign country most closely associated with that entity; and</text></subparagraph>
<subparagraph id="H1B2870F18B0D4821B1B0F6D67CEE63E6"><enum>(B)</enum><text>the act concerns a chemical or biological program that is owned, controlled, or directed by, or subject to the jurisdiction of, that entity.</text></subparagraph></paragraph> <paragraph id="HD12BF1CECBF045D38B7D474D64C7D211" commented="no"><enum>(4)</enum><header>Covered treaty</header><text>The term <term>covered treaty</term> means—</text>
<subparagraph id="HEFB4CCA886404EF8B8CF2C967D823689" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">the Convention on the Prohibition of the Development, Production and Stockpiling of Bacteriological and Toxin Weapons and on Their Destruction, done at Washington, London, and Moscow, April 10, 1972 (commonly referred to as the <quote>Biological Weapons Convention</quote>); and</text></subparagraph> <subparagraph id="HCF0FDF4659C34E099C67A1E36C358A20" commented="no"><enum>(B)</enum><text>the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction, done at Geneva September 3, 1992, and entered into force April 29, 1997 (commonly referred to as the <quote>Chemical Weapons Convention</quote>).</text></subparagraph></paragraph>
<paragraph id="HAB9EEC7536E140AE9AD193D53450C3B0"><enum>(5)</enum><header>Export Administration Regulations</header><text display-inline="yes-display-inline">The term <term>Export Administration Regulations</term> means the regulations set forth in subchapter C of chapter VII of title 15, Code of Federal Regulations (or successor regulations).</text></paragraph> <paragraph id="H7ADBEF3F49DF47D4B7FE452B56A7A79E"><enum>(6)</enum><header>Foreign governmental entity</header><text display-inline="yes-display-inline">The term <term>foreign governmental entity</term> means—</text>
<subparagraph id="H62AE8854C4044B65832460A18E32601A"><enum>(A)</enum><text>the government of a foreign country;</text></subparagraph> <subparagraph id="HFC4B95BF8DF4402EA86938B1DF2F5997"><enum>(B)</enum><text>the government of a political subdivision of a foreign country;</text></subparagraph>
<subparagraph id="HAA3B07ED5D1E47C78F1EF2424A46790B"><enum>(C)</enum><text display-inline="yes-display-inline">an agency or instrumentality of a foreign state, as such term is defined in section 1603(b) of title 28, United States Code;</text></subparagraph> <subparagraph id="H5D879C02EF5249F496D893390335FEB6"><enum>(D)</enum><text>an entity that is directly or indirectly controlled or beneficially owned by a government described in subparagraph (A) or (B);</text></subparagraph>
<subparagraph id="H23F60222B1F7452C9831909EF566C68B"><enum>(E)</enum><text>an entity that acts on behalf of or as an agent of such a government; or</text></subparagraph> <subparagraph id="H57EEFB174BD94106914792808417C152"><enum>(F)</enum><text>an entity that—</text>
<clause id="H9125413F2B2B4161BDD174616DC62862"><enum>(i)</enum><text>receives significant material support from a such a government; and</text></clause> <clause id="H8A47F71E9DAB44A1B812AC4046B33DC7"><enum>(ii)</enum><text>is engaged in—</text>
<subclause id="H8966C9A060B14169A1DBE88F9F3E4BE8"><enum>(I)</enum><text>the provision of commercial services;</text></subclause> <subclause id="HECC8D1FD88FE49EAABC4FF9412818ACA"><enum>(II)</enum><text>shipping;</text></subclause>
<subclause id="H439F4CAD9EF44E0FA020BD933C21A6BB"><enum>(III)</enum><text>manufacturing;</text></subclause> <subclause id="H2D221F9C93244B73913062919F052B28"><enum>(IV)</enum><text>producing; or</text></subclause>
<subclause id="H70A51A9F58094DB1BE9F0B07A2361B0A"><enum>(V)</enum><text>exporting.</text></subclause></clause></subparagraph></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H8B1B083DDBBF4E509E5B0AE7098F8D46"><enum>5.</enum><header>Conforming amendment</header><text display-inline="no-display-inline">Section 307(a) of the Chemical and Biological Weapons Control and Warfare Elimination Act of 1991 (<external-xref legal-doc="usc" parsable-cite="usc/22/5605">22 U.S.C. 5605(a)</external-xref>) is amended, in the matter preceding paragraph (1), by striking <quote>section 306(a)(1)</quote> and inserting <quote>section 306(a)(1)(A)</quote>.</text></section>
