<section id="H490FF7EDB70F4468859F98A7EA7DB9DC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Second Chance Mental Health Access Act of 2026</short-title></quote>.</text></section> <section id="H05C2A96645D845688D964D9C5F773BE2"><enum>2.</enum><header>Requiring coverage of 12 mental health telehealth visits per calendar year for certain previously incarcerated individuals under the Medicaid program</header> <subsection id="H601AB9C7041943B482F8A7A5E1490525"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1902(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)</external-xref>) is amended—</text> 
<paragraph id="H3DE9E1411F02425697B18463B842ABCD"><enum>(1)</enum><text>in paragraph (88), by striking <quote>and</quote> at the end;</text></paragraph> <paragraph id="H4D80D9858EE7446FBA9154E4D73CEA9D"><enum>(2)</enum><text>in paragraph (89), by striking the period and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="HE7AD69A5894649D5AB64796B47B06C8C"><enum>(3)</enum><text>by inserting after paragraph (89) the following new paragraph:</text> <quoted-block style="OLC" id="HED04F42316BC42EE92473C4FD62B5883" display-inline="no-display-inline"> <paragraph id="H1FFBF050FCB94D20971DE1EEC8454B2E"><enum>(90)</enum><text display-inline="yes-display-inline">provide, in the case of an individual enrolled under the State plan (or waiver of such plan) who is subject to home confinement pursuant to judicial process and who was incarcerated in a public institution immediately prior to such home confinement, for coverage of 12 mental health visits furnished via telehealth during each calendar year occurring during the period of such confinement.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HBD8D2E3B621B4BD6855A68C9632F8E58"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply with respect to individuals released from a public institution on or after the date of the enactment of this Act.</text> </subsection></section> </legis-body></bill>
