<section id="H13C474BD12CC4894AE76ED537695901F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Criminals’ Loss of Eligibility and Assistance Networks Act</short-title></quote> or the <quote><short-title>CLEAN Act</short-title></quote>.</text></section> <section id="HCD3F58406FB64A6289904E291D586861"><enum>2.</enum><header>Sex offenders ineligible for refundable credit for coverage under a qualified health plan</header> <subsection id="H6CC4123B8CF644889920B5881EF7A098"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/36B">Section 36B(c)(1)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="H330A02E4EA0A4D4BA767A0EEB734CAC9"><enum>(F)</enum><header>Denial of credit to sex offenders</header><text display-inline="yes-display-inline">No credit shall be allowed under this section to any individual if such individual (or the individual’s spouse, in the case of a joint return) is a sex offender (as defined in section 111 of the Adam Walsh Child Protection and Safety Act of 2006) as of the last day of the taxable year.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H109C35C3A473471482B085EDD3CE9FD2"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply to taxable years ending after the date of the enactment of this Act.</text></subsection></section> 
<section id="H27D42C66364D4C03BB1688682F2F1E84" section-type="subsequent-section"><enum>3.</enum><header>Sex offenders ineligible for Federally funded medical assistance under Medicaid</header> 
<subsection id="H56DDC4DF038E48B1B1701ED69001A1F0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1903(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(i)</external-xref>) is amended—</text> <paragraph id="H1D01CE17EFE4466C9C5C86D23E8CAC8A"><enum>(1)</enum><text>in paragraph (26), by striking <quote>or</quote> at the end;</text></paragraph> 
<paragraph id="H5CAD7DB719864A2EBA13ABC2B8DCFB6B"><enum>(2)</enum><text>in paragraph (27), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph> <paragraph id="H76CCDF481AED478C8F8B90FEDEFB2B8B"><enum>(3)</enum><text>by inserting after paragraph (27) the following:</text>

<paragraph id="H9776F2DD344B4D82869E816895DD1AE8"><enum>(28)</enum><text display-inline="yes-display-inline">with respect to any amounts expended for medical assistance for an individual who is a sex offender (as defined in section 111 of the Adam Walsh Child Protection and Safety Act of 2006).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HA023A78A133A49D28927C11E03D378B6"> <enum>(b)</enum> <header>States not required To furnish medical assistance</header> <text display-inline="yes-display-inline">Section 1902(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)</external-xref>) is amended by adding at the end the following:</text>

            >Notwithstanding paragraph (10) or any other provision of this subsection, a State may
            elect not to make medical assistance available to an individual described in section
            1903(i)(28).</quoted-block-continuation-text>

      </subsection> 
<subsection id="HE0C1EB5D6038471E97B1FC9F308F9697"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to individuals enrolled or reenrolled under a State plan (or waiver of such plan) under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1936">42 U.S.C. 1936 et seq.</external-xref>) on or after the date of the enactment of this Act.</text></subsection></section> </legis-body></bill>
