<section id="HC01B81FF609C486483DB7C05B0F37E23" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bridges And Safety Infrastructure for Community Success Act</short-title></quote> or the <quote><short-title>BASICS Act</short-title></quote>.</text> </section> 
<section id="H27AB7B6D7C9C4C84A1FBD18980663FFD"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="HB1F870EB02CD47369AE309718D01F25D"><enum>(1)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Transportation.</text></paragraph> 
<paragraph id="HDA97B2D0173244D0B03FB0DF8C542D6C">
                <enum>(2)</enum>
                <header>Metropolitan planning organization</header>
 <text>The term <quote>Metropolitan planning organization</quote> has the meaning given such term in section 134 of title 23, United States Code.</text>
            </paragraph> 
<paragraph id="H351EFC61E90548B887D345121C894B63"><enum>(3)</enum><header>Urbanized area</header><text>The term <quote>urbanized area</quote> has the meaning given such term in section 134 of title 23, United States Code.</text></paragraph> <paragraph id="H2F2C641DB9D44035BA7AC97D04E01E8C"><enum>(4)</enum><header>Off-system bridge</header><text>The term <quote>off-system bridge</quote> means a highway bridge or low water crossing (as defined by the Secretary) located on a public road, other than a bridge or low water crossing (as defined by the Secretary) on a Federal-aid highway.</text></paragraph> 
<paragraph id="H5CCBBE49706C4A9D97C3EFB53F606658"><enum>(5)</enum><header>Regional transportation planning organization</header><text>The term <quote>regional transportation planning organization</quote> means the policy board of an organization established as the result of a designation under section 135(m) of title 23, United States Code.</text></paragraph></section> <section id="HA5E3C9DDF483470BBB1E643A6B94ABCC"><enum>3.</enum><header>Apportionment</header><text display-inline="no-display-inline">Section 104 of title 23, United States Code, is amended—</text> 
<paragraph id="H1C9724577DE94C0BB495D4677CB199C3"><enum>(1)</enum><text>in subsection (b)(1) by—</text> <subparagraph id="H42F6862ED0534EBB94FD57051FCE03E8"><enum>(A)</enum><text>striking <quote>paragraphs (4), (5), and (6)</quote> and inserting <quote>(paragraphs (4), (5), (9), and (10))</quote>; and</text></subparagraph>

<subparagraph id="HF60B0496821F44798DB180F92B94DE73"><enum>(B)</enum><text>The total amount for metropolitan planning for all States each fiscal year shall be 2.5 percent of the amount remaining after distributing amounts under paragraphs (4), (5), (9) and (10).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="HF8DB88ED99A04ED3B1104B0C67639FC6"> <enum>(7)</enum> <text>by adding the following at the end:</text>

            <enum>(9)</enum>
            <header>Strengthening bridges formula program</header>
            <subparagraph id="H99AD19F781614EA79805976C75B81F26">
              <enum>(A)</enum>
              <header>In general</header>
 <text>For the strengthening bridges formula program under section 180, the Secretary shall set aside from the base apportionment determined for a State under subsection (c) an amount determined for the State under subparagraphs (B) and (C).</text>
            </subparagraph>
            <subparagraph id="H47327A0AB86D43ABBB4FFF3E234877D7">
              <enum>(B)</enum>
              <header>Total amount</header>
 <text>The total amount set aside for the strengthening bridges formula program for all States shall be $5,500,000,000 for each fiscal year between 2027 and 2031.</text>
            </subparagraph>
            <subparagraph id="H7FD2DFBB1E2B4D7CA5FE02866F4C1335">
              <enum>(C)</enum>
              <header>State share</header>
 <text>Notwithstanding subparagraph (D), for each fiscal year, after the setting aside funds as required by section 180(e), the Secretary shall distribute among the States the remaining amount for the strengthening bridges formula program under subparagraph (B) so that each State receives the amount equal to the proportion that—</text>

                <enum>(i)</enum>
 <text>the total cost of replacing or rehabilitating all bridges classified in poor condition in such State; bears to</text>
              </clause>
              <clause id="H4AA4B786746E497E8624F36D98D308AB">
                <enum>(ii)</enum>
 <text>the total cost of replacing or rehabilitating all bridges classified in poor condition in all States.</text>
              </clause>
            </subparagraph>
            <subparagraph id="HDC58FD03E8F44DB6B978713403BA6268">
              <enum>(D)</enum>
              <header>Determination of costs</header>
 <text>For purposes of subparagraph (C), the Secretary shall determine replacement and rehabilitation costs based on the average unit costs of bridges from 2021 through 2024, as submitted by States to the Federal Highway Administration as required by section 144(b)(5).</text>
            </subparagraph>
            <subparagraph id="HB43AE7D52E3C4935B17E060363706079">
              <enum>(E)</enum>
              <header>Minimum amount</header>
 <text>The minimum amount that the Secretary apportions to a State in a fiscal year under this program shall be $45,000,000.</text>
            </subparagraph>
          </paragraph>
          <paragraph id="HDC506D7052CF43658FC353A395927B05">
            <enum>(10)</enum>
            <header>Regional transportation planning</header>
            <subparagraph id="H1C2F01049E51421D995F57738AB676AE">
              <enum>(A)</enum>
              <header>In general</header>
 <text>To carry out section 135(n) of this title, an amount determined for the State under subparagraphs (C) of this subsection.</text>
            </subparagraph>
            <subparagraph id="HD0BDF40EB69E4C9C93E9711166CD3AE8">
              <enum>(B)</enum>
              <header>Total amount</header>
 <text>The total amount to carry out section 135(n) of this title for all States shall be $150,000,000 for each fiscal year between 2027 and 2031.</text>
            </subparagraph>
            <subparagraph id="H68035CA43735451FBCE05B08366380E7">
              <enum>(C)</enum>
              <header>Distribution among the States</header>
 <text>For each fiscal year, the Secretary shall distribute the amounts authorized to carry out section 135(n) of this title among the States in the same proportion as the amount distributed to the State share under subsection (b) of this section.</text>
            </subparagraph>
            <subparagraph id="H56B125F969C64841A036A43C00B91465">
              <enum>(D)</enum>
              <header>Administration</header>
 <text>Up to 5 percent of the amounts provided to each State may be used by the State to administer this program.</text>
            </subparagraph>
          </paragraph>

        </quoted-block>
      </paragraph></section> 
<section id="HB620F6153AAA417EBB815E7199393113"><enum>4.</enum><header>Surface transportation block grant program</header><text display-inline="no-display-inline">Section 133(d)(3) of title 23, United States Code, is amended by inserting after paragraph (B) the following:</text>

<subparagraph id="H705D1E432C81414F8DB74F21A4B3AE51"><enum>(C)</enum><header>Consultation with local governments</header><text>For purposes of clauses (iii) and (iv) of paragraph (1)(A), before obligating funding attributed to an area with a population of less than 50,000 that is not represented by a regional transportation planning organization, a State shall consult with local governments in that area and may partner with nonpartisan, statewide organizations representing local governments and their elected leaders in order to facilitate such consultation.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HD123EB56AC3A4212878ABBF800F6C5F0"><enum>5.</enum><header>Bridge formula program</header> <subsection id="H7EFD075705214AE9B470FBEBADDFD335"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">Chapter 1</external-xref> of title 23, United States Code, is amended by adding at the end the following:</text>

<section id="H3D89EACE3BBC4207840B4FB7EFC76542"><enum>180.</enum><header>Strengthening bridges formula program</header> 
<subsection id="HA7EE290B45754E8DA11AA0A5D56E4D69"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish a program in accordance with this section to provide funding for bridge projects.</text></subsection> <subsection id="H4FD5F16B048244168789DC6B230D1888"><enum>(b)</enum><header>Eligible uses</header><text>Funds apportioned to a State under this section may be obligated for the construction, replacement, rehabilitation, preservation, and protection of highway bridges on public roads.</text></subsection> 
<subsection id="HAFB25EDD460B4C87B0AE08F2C88F651C"><enum>(c)</enum><header>Suballocation of apportioned funds</header> 
<paragraph id="H6B2C89F0661043F5A57B19272B6187CC"><enum>(1)</enum><header>Calculation</header><text>Of the funds apportioned to a State under section 104(b)(9) (after the set aside of funds under subsection (e)), the State shall obligate—</text> <subparagraph id="H87FA6C0E9A99432AB88B2BACCC5A37A0"><enum>(A)</enum><text>25 percent in the following areas in proportion to their relative shares of the population of the State—</text> 
<clause id="H9B10739B76214D15B4152A8CD92D201F"><enum>(i)</enum><text>in urbanized areas of the State with an urbanized population of over 200,000;</text></clause> <clause id="H5E43C3DE8B434ED6A8CD6C3CCB4DE87C"><enum>(ii)</enum><text>in urbanized areas of the State with an urbanized population of not less than 50,000 and not more than 200,000;</text></clause> 
<clause id="H30D84A25481F47B3839626D8667F8142"><enum>(iii)</enum><text>in urban areas of the State with a population of not less than 5,000 and not more than 49,999; and</text></clause> <clause id="H932A0DD3D57246BABA2260FBC4FB6C59"><enum>(iv)</enum><text>in other areas of the State with a population less than 5,000; and</text></clause></subparagraph> 
<subparagraph id="HFDAB7575AF51498683D243DF3E560935"><enum>(B)</enum><text>the remainder may be obligated in any area of the State.</text></subparagraph></paragraph> <paragraph id="HE39EEE43F3074C978449BC37D402E644"><enum>(2)</enum><header>Treatment of funds</header><text>Funds made available to carry out this section shall be administered as if apportioned under Section 104(e) and Section 104(i) of Title 23, United States Code (as amended).</text></paragraph> 
<paragraph id="H0C9AD37FB8C54644BEF96D647ADD1C6A"><enum>(3)</enum><header>Project selection</header><text>A State shall only obligate funding under this section for—</text> <subparagraph id="H52DF9AEBBE5F468EB72D785A8779EFB7"><enum>(A)</enum><text>in areas of more than 50,000, projects that have been included on the Transportation Improvement Program for the metropolitan planning organization representing that area;</text></subparagraph> 
<subparagraph id="H6DA0E32D9D824B9BBBF77172E2122F39"><enum>(B)</enum><text>in areas under 50,000 that are covered by a regional transportation planning organization, projects that are identified in cooperation with said regional transportation planning organization; and</text></subparagraph> <subparagraph id="HA5FEB5A0A01F44E495987AC2EA7FA4A4"><enum>(C)</enum><text>in areas under 50,000 that are not covered by a regional transportation planning organization, projects that are selected in consultation with local governments in that area.</text></subparagraph></paragraph> 
<paragraph id="HACDFC3955A2345748D729CDAC2008344"><enum>(4)</enum><text>In order to facilitate better consultation with local governments to identify eligible projects, the State may work with nonpartisan, statewide organizations representing units of local government and their elected officials.</text></paragraph></subsection> <subsection id="HDD133797DC5B41C980E1C2F9D74D0F89"><enum>(d)</enum><header>Applicability of planning requirements</header><text>Programming and expenditure of funds for projects under this section shall be consistent with sections 134 and 135 of title 23, United States Code.</text></subsection> 
<subsection id="H225CA3F4D8FD4C8192F5DC5D50C504CC"><enum>(e)</enum><header>Set asides</header><text>The Secretary shall set aside—</text> <paragraph id="H18796E32100F4CD79458D3DABACE458F"><enum>(1)</enum><text>3 percent of the funds available for this program in each fiscal year to carry out section 202(d) of title 23, United States Code; and</text></paragraph> 
<paragraph id="H0817F6059A4746F8B26F2BEDACB4CE0F"><enum>(2)</enum><text>up to one-half of 1 percent of the amounts made available for this program for the administration and operations of the Federal Highway Administration.</text></paragraph></subsection> <subsection id="HF7678C2DA88A47298CDF90DA6566B39A"><enum>(f)</enum><header>Cost share</header> <paragraph id="HBD5F0D19D351470C9C1C8879A7F94819"><enum>(1)</enum><header>In general</header><text>For funds made available from this program, the Federal share shall be determined in accordance with section 120 of title 23, United States Code.</text></paragraph> 
<paragraph id="HD786EFE6AF6E43F58412DF511A73F9B3"><enum>(2)</enum><header>Local, off-system bridge</header><text>For funding for a project used on an off-system bridge that is owned by a local government or Tribe, the Federal share shall be 100 percent.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H2D9D6D4526FE4EBB8CD07546812A5A37"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, is amended by adding at the end the following:</text>

<section id="H88781A910A5B433DB9B333E593A24625"><enum>6.</enum><header>Highway safety improvement program</header> 
<subsection id="H093779FB5E1F46C3A26167EDA6C4A849">
        <enum>(a)</enum>
        <header>Local safety set-Aside</header>
 <text>Section 148 of title 23, United States Code, is amended by—</text> <paragraph id="H5EEEF71ED2EE4096811D8CD1A1C9ED66"> <enum>(1)</enum> <text>redesignating subsections (d), (e), (f), (g), (h), (i), (j), (k), and (l) as subsections (e), (f), (g), (h), (i), (j), (k), (l), and (m), respectively;</text>
        </paragraph>
        <paragraph id="HC8556FF049BF4DB09EFE8B93DB80E0DB">
          <enum>(2)</enum>
 <text>inserting after subsection (c) the following:</text> <quoted-block id="HCC3DAFA848E34506AA51FDDBBD2C620A" style="USC"> <subsection id="H1E8FD7065FDD46DD9889A5AF37BE9907"> <enum>(d)</enum> <header>Allocations of apportioned funds based on population</header> <paragraph id="H13C0F409E549464C9BD325DA8DABB682"> <enum>(1)</enum> <header>Calculation</header> <text>Of the funds apportioned to a State under section 104(b)(3)—</text>
                <subparagraph id="HF201C8F2B48C43D781BD776195D345AD">
                  <enum>(A)</enum>
 <text>25 percent for each of fiscal years 2027 through 2031 shall be obligated under this section, in proportion to their relative shares of the population of the State—</text>
                  <clause id="HEE59EAB0353543498BC01592425F4F8D">
                    <enum>(i)</enum>
 <text>in urbanized areas of the State with an urbanized area population of over 200,000;</text>
                  </clause>
                  <clause id="HE8BD32F729C44A2984C42258A6453108">
                    <enum>(ii)</enum>
 <text>in urbanized areas of the State with an urbanized area population of not less than 50,000 and not more than 200,000;</text>
                  </clause>
                  <clause id="H8AA2D71B5B7C4B8FB7464882B951890D">
                    <enum>(iii)</enum>
 <text>in urban areas of the State with a population not less than 5,000 and not more than 49,999; and</text>
                  </clause>
                  <clause id="H5DD2A453BF604301ADD31FA031D4ECB5">
                    <enum>(iv)</enum>
 <text>in other areas of the State with a population less than 5,000; and</text> </clause> </subparagraph> <subparagraph id="HF1CBC6DF7AE5436D90ED119F7B23A3B0"> <enum>(B)</enum> <text>the remainder may be obligated in any area of the State.</text>
                </subparagraph>
              </paragraph>
              <paragraph id="HE8E0C283ABE143FD875A982AC6A8BE23">
                <enum>(2)</enum>
                <header>Project selection</header>
 <text>A State shall only obligate funding under this section for—</text> </paragraph> </subsection> <subparagraph id="H4129E454505D4A96BBB4093B923EAB9B"> <enum>(A)</enum> <text>in areas of more than 50,000, projects that have been included on the Transportation Improvement Program for the metropolitan planning organization representing that area;</text>
            </subparagraph>
            <subparagraph id="H874C30055891430CA2D7580B3F0F5670">
              <enum>(B)</enum>
 <text>in areas under 50,000 that are covered by a regional transportation planning organization, projects that are identified in cooperation with said regional transportation planning organization; and</text>
            </subparagraph>
            <subparagraph id="H81FD2DC649E5449DACCCF605498D7590">
              <enum>(C)</enum>
 <text display-inline="yes-display-inline">in areas under 50,000 that are not covered by a regional transportation planning organization, projects that are selected in consultation with local governments in that area.</text>
            </subparagraph>
            <paragraph id="HAED3E6A0E6E049108F452B1762F39400">
              <enum>(3)</enum>
              <header>Consultation</header>

 <text>Section 148(a)(4) of title 23, United States Code, is amended by inserting after subparagraph (xxix) the following:</text>

 <text>in paragraph (a) by replacing <quote>subject to subsection (b)</quote> with <quote>subject to subsections (b) and (c)</quote>;</text>

<paragraph id="H78FF32A11D184FED8F123A51A4B53CF9"><enum>(2)</enum><header>Open and fair competition</header><text>Only after the Secretary has certified that the State has held an open and fair competition for the funds under 104(b)(3) shall a State be able to transfer them under subsection (a) of this section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H10EB1219A40D41E2A3D22A94F3A6284C"><enum>8.</enum><header>Project selection</header><text display-inline="no-display-inline">It is the sense of Congress that—</text>

        <enum>(1)</enum>
 <text>States should obligate all funds appropriated under section 133(d)(1)(A), section 148(d)(1)(A), section 175(e), and section 180(c)(1)(A) of title 23, United States Code, of this Act to locally selected projects; and</text>
      </paragraph> 
<paragraph id="H3FD0A1BE95CC414194F9F2E40DA12E93">
        <enum>(2)</enum>
 <text>the Secretary, in partnership with the Administrator of the Federal Highway Administration, should work with States to ensure that the local consultation and coordination processes established under title 23, United States Code, are followed.</text>
      </paragraph></section> 
<section id="H3491BF59FDA848F28C349A1447BEEE5B"><enum>9.</enum><header>Metropolitan planning</header> 
<subsection id="HC4FE5ED7C1AC4BA8A820865AA7E34ECD">
        <enum>(a)</enum>
        <header>Eliminating local match</header>
 <text display-inline="yes-display-inline">Section 120(c) of title 23, United States Code, is amended by adding at the end the following:</text>

            <header>Metropolitan planning funds</header>

        <header>Enhanced planning for faster project delivery</header>

 <text>administrative and overhead costs, general operating expenses, and facilities and infrastructure costs;</text>

                <enum>(4)</enum>
 <text>local technical assistance;</text> </paragraph> <paragraph id="H482273EEB72D4925A0785DA4A7FF5890"> <enum>(5)</enum> <text>housing studies directly linked to transportation;</text>
              </paragraph>
              <paragraph id="H5241EC16369C4EE4AA4EF5D714EB0D79">
                <enum>(6)</enum>
 <text>economic development studies directly linked to transportation; and</text> </paragraph> <paragraph id="H56662C7CA53D4B0696F8FC9D8631E96E"> <enum>(7)</enum> <text>critical data procurement.</text>
              </paragraph>
            </subsection>

                <header>Direct recipient status</header>
 <text>Not less than 180 days after the passage of this Act, the Secretary shall establish a process whereby a metropolitan planning agency may qualify to become direct recipient of Federal funding, such process shall—</text>
                <subparagraph id="H235A6B908959456FB8279020136F2F72">
                  <enum>(A)</enum>
 <text>be restricted to determining the technical and financial capabilities for an metropolitan planning organization to receive and be able to appropriately manage Federal funding and funding requirements; and</text>
                </subparagraph>
                <subparagraph id="HF4B1A3CA9B7A4921B8E54ED74A727725">
                  <enum>(B)</enum>
 <text>occur concurrently to the recertification process through which metropolitan planning organizations have their abilities reconfirmed under this section.</text>
                </subparagraph>
              </paragraph>
              <paragraph id="H81A893BC33EA4B078E0C7EB7332186BA">
                <enum>(3)</enum>
                <header>Suballocation of Federal planning funds</header>
 <text>When the Secretary annually apportions funds to States under section 104(b)(6), the Secretary shall directly sub-allocate obligation authority and all associated responsibilities to metropolitan planning organizations that have become direct recipients for funding allocated under 104(b)(6) of this title or section 5305(g) of title 49, United States Code.</text>
              </paragraph>
            </subsection>

        </paragraph>
      </subsection> 
<subsection id="H89FD155669544758AFF2E6317D42F90F"><enum>(c)</enum><header>Federal transparency</header><text>The Secretary shall give the same access to Federal-aid financial management systems to metropolitan planning organizations that it provides to State Departments of Transportation.</text></subsection></section> <section id="HB0D075C59CBD4CD5895724852B8EC62D"><enum>10.</enum><header>Rural transportation planning</header><text display-inline="no-display-inline">Section 135 of title 23, United States Code, is amended by adding at the end the following:</text>

<subsection id="HF66703ABF46C4D53963B663CB421DB98"><enum>(n)</enum><header>Regional transportation planning funding</header> 
<paragraph id="HED4AF0F371CB49AEA5F54DD91618499A">
            <enum>(1)</enum>
            <header>In general</header>
 <text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish a program to provide assistance to States to support regional transportation planning organizations and regional entities responsible for transportation planning or economic development planning in nonmetropolitan areas of the State in carrying out the duties contained in subsection (m) of this section.</text>
          </paragraph> 
<paragraph id="HF790E6ECF3814DAD85DE0EEB9753640D"><enum>(2)</enum><header>Use of funds</header><text>Funds made available to States under section 104(b)(9) of this title shall be utilized to—</text> <subparagraph id="HF321A32C8DCE41F6A15DE57E8EE168C4"> <enum>(A)</enum> <text>provide direct funding to federally designated regional transportation planning organizations to enable them to carry out the duties contained in paragraph (m)(4) of this section; and</text>
            </subparagraph> 
<subparagraph id="H8239D8F46EC940E49F50E7A4221E3886"><enum>(B)</enum><text>undertake activities, including the establishment of State-based pilot programs, to provide assistance to regional entities responsible for transportation planning or economic development planning in nonmetropolitan areas of the State to—</text> <clause id="H65DF2A185C91481C949DB656E42D70D0"> <enum>(i)</enum> <text>increase the organizations understanding of statewide transportation planning requirements;</text>
              </clause> 
<clause id="H23F27835D3864766AD53E4CA3AFD64C8"><enum>(ii)</enum><text>provide technical assistance in building organizational capacity and developing transportation planning expertise necessary to develop multimodal long-range transportation plans;</text></clause> <clause id="H9FAFC12EE3A74E0690E70764A3693EC9"><enum>(iii)</enum><text>strengthening rural partnerships and collaboration;</text></clause> 
<clause id="HA45E8AF3FC95452A916D8A2FE33C45C6"><enum>(iv)</enum><text>enhance project prioritization and delivery;</text></clause> <clause id="H3CC584E10DEA4670B424959B32BC7CF0"><enum>(v)</enum><text>improve the overall statewide transportation planning process and respond to nonmetropolitan needs; and</text></clause> 
<clause id="HA342A2959C0C4A7FACDAE3289B78FEAF"><enum>(vi)</enum><text>secure Federal designation of regional transportation planning organizations.</text></clause></subparagraph></paragraph> <paragraph id="H0954D0E26E564B33A3A2B262954D5A2B"><enum>(3)</enum><header>Eligible recipients</header><text>Funding made available to States under section 104(b)(9) of this title shall be made available to—</text> 
<subparagraph id="HAC5C5F6FD81940C9892B1C7B07880EE9"><enum>(A)</enum><text>regional transportation planning organization organizations as defined under section 134 (b)(5); and</text></subparagraph> <subparagraph id="H24C714BAED154F61BAA872C607C5CBF2"><enum>(B)</enum><text>regional entities responsible for transportation planning or economic development planning in nonmetropolitan areas of the State.</text></subparagraph></paragraph> 
<paragraph id="H9898FE6FA10447C9BF3452A67F3F052E"><enum>(4)</enum><header>Distribution of funds within States</header> 
<subparagraph id="H9475ACAA8BCE4809958E8E60F1563DC7"><enum>(A)</enum><header>In general</header><text>The amounts made available to States to carry out this program under section 104(b)(9) of this title shall be distributed within the State—</text> <clause id="HDB6C60A6EBC04DEE9FFEC2C5DC5C475C"> <enum>(i)</enum> <text>among all federally designated regional transportation planning organization through a formula developed by the State; and</text>
              </clause> 
<clause id="H27ACA28ADBA7403481C019BEADA7B9CE">
                <enum>(ii)</enum>
 <text>to non-federally designated regional entities responsible for transportation planning or economic development planning in nonmetropolitan areas of the State through a grant process allowing regional entities to submit proposals for funding that achieve the objectives of this subsection.</text>
              </clause></subparagraph> 
<subparagraph id="HEF566C155B3C41688807366868613C53"><enum>(B)</enum><header>Secretarial approval</header><text>Both the formula distribution developed by a State under clause (i) of this paragraph and the grant process undertaken by a State under clause (ii) of this paragraph shall be approved by the Secretary.</text></subparagraph> <subparagraph id="H6759B0846AAB4A0F87ED7420F4322CFD"><enum>(C)</enum><header>Minimum allocation</header><text>States receiving funding under this paragraph shall provide each federally designated regional transportation planning organization not less than $300,000 in fiscal years 2027 through 2031 to carry out this subsection.</text></subparagraph></paragraph> 
<paragraph id="H54BDEEB47E134F6A8429B46164568920"><enum>(5)</enum><header>Federal share</header><text>The Federal share payable on activities carried out with funds provided under this program shall be 100 percent.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body></bill>
