<official-title display="yes">To modernize section 477 of part E of title IV of the Social Security Act to improve connections to housing, expand education and training opportunities, and modernize services to improve outcomes for foster youth transitioning into adulthood.</official-title>

<section id="H7F0847EDE44245D6896BE56317580F85" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fostering the Future Act</short-title></quote>.</text></section> <section id="HA31C9F0903CE4A75BCE90F2D0883C396" display-inline="no-display-inline"><enum>2.</enum><header>Expansion of education and workforce training opportunities for youth who have experienced foster care</header><text display-inline="no-display-inline">Section 477 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677</external-xref>) is amended—</text> 
<paragraph id="H331A0000FB39402A9B98E4437651C45A"><enum>(1)</enum><text>in subsection (a)(5), by striking <quote>aged out of foster care</quote> and inserting <quote>experienced foster care at age 14 or older</quote>;</text></paragraph> <paragraph id="HA67B82C5655A46A2AE138D11D575BC02" display-inline="no-display-inline"><enum>(2)</enum><text>in subsection (h)(2), by striking <quote>age out of foster care</quote> and inserting <quote>experience foster care at age 14 or older</quote>;</text></paragraph> 
<paragraph id="HA340E46C82D049868958BCA8A0B4B56E"><enum>(3)</enum><text>in each of subsections (a)(6) and (i)(2), by striking <quote>16</quote> and inserting <quote>14</quote>;</text></paragraph> <paragraph id="HA3BE7FBD662F43D5953CB81A69B4869C"><enum>(4)</enum><text>in subsection (i)(3), by striking <quote>in no event may a youth participate in the program for more than 5 years (whether or not consecutive)</quote> and inserting <quote>may not allow a youth to participate in the program for more than 5 years (or, in the case of a youth who was involved in a remedial education activity referred to in paragraph (4)(B), for more than 6 years), whether or not consecutive</quote>;</text></paragraph> 
<paragraph id="H1CA3A3F8E3BC4D62BBDEBAD56CB13B61"><enum>(5)</enum><text>in subsection (i)(4)—</text> <subparagraph id="H555F9DEAB92A4D26B549DCE27D35BBF9"><enum>(A)</enum><text>by amending subparagraph (A) to read as follows:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HCCF385E27A3C4EEFADD5A71DDDB48592"> 
<subparagraph id="HB77BA40533264384809AB261FCCE3831"><enum>(A)</enum><text>may be available for the cost of attendance—</text> <clause id="H1AC2E2C0427D428CAA1EAA3494BF405E"><enum>(i)</enum><text>at an institution of higher education, as defined in section 102 of the Higher Education Act of 1965, including a community college or postsecondary vocational institution; or</text></clause> 
<clause id="HAE0C48943FA545AABAD5A612A0098716"><enum>(ii)</enum><text display-inline="yes-display-inline">at a short-term training program that is eligible for the Workforce Pell program under section 401(k), as described in section 481(b)(3) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1088">20 U.S.C. 1088(b)(3)</external-xref>), as added by section 83002(b) of <external-xref legal-doc="public-law" parsable-cite="pl/119/21">Public Law 119–21</external-xref>;</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph id="HEB461FD0EFFC4A0DBAA12CB804C58998"><enum>(B)</enum><text>by redesignating subparagraph (B) as subparagraph (C); and</text></subparagraph> 
<subparagraph id="HE42DA7EE9A4146B3A60BD9CC4B830409"><enum>(C)</enum><text>by inserting after subparagraph (A), as so amended, the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H7C4D1FADAF984F6AB58082E7CDE26ABC"> <subparagraph id="H6721873EECE946E89BA87ADE9D0CC76A"><enum>(B)</enum><text display-inline="yes-display-inline">may be available for costs—</text> 
<clause id="H68BA6452A6784127ACDDF055866674C3"><enum>(i)</enum><text display-inline="yes-display-inline">associated with participation in an apprenticeship program;</text></clause> <clause id="HEA97DC72EE2D4B489D4447EAF5BD72D6"><enum>(ii)</enum><text>to obtain a general equivalency degree; or</text></clause> 
<clause id="H97BC949C125A419B990554A5770BEE39"><enum>(iii)</enum><text>to receive remedial education; and</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H951264262CA24553A9A97E4095FD0514"><enum>(6)</enum><text>in subsection (i), by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H4EE265A9256344638A626CEB561B7A0B"> 
<paragraph id="HBC854BE3621F4F9AA67508318AA1A8F3"><enum>(7)</enum><text display-inline="yes-display-inline">In this section, the term <term>remedial education</term> means education or skill training needed to support obtaining a high school diploma or qualifying for postsecondary education, training, or an apprenticeship that is—</text> <subparagraph id="H7BFE426524184CC9A2571683E72378C1"><enum>(A)</enum><text>not already available through the school district of the student or another free local, State, or Federal program; and</text></subparagraph> 
<subparagraph id="H37BB915BB0FB4AA08B41CFB1EB92D376"><enum>(B)</enum><text>is provided by an instructor with credentials relevant to the subject area of instruction, as determined by the State.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H90F204AEA8BE455A9733AD92BF321F06" display-inline="no-display-inline"><enum>3.</enum><header>Increase in maximum education and training voucher amount and provision of greater support for foster youth pursuing postsecondary education</header> <subsection id="H0FCAE99FA57549D19B8EC0A38801D38A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 477(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677(i)</external-xref>) is amended—</text> 
<paragraph id="H204177262FCD4C9CA03C7A7727929F4A"><enum>(1)</enum><text>in paragraph (3)—</text> <subparagraph id="HC999E3B7CEFB480B8506C804563103BF"><enum>(A)</enum><text>by striking <quote>that program</quote> and inserting <quote>that education or training program, (except that the State may establish a grace period to allow a youth to continue participation in activities described in paragraph (4)(A), after an assessment and consultation with the youth, if the State determines that reasonable circumstances warrant the grace period)</quote>; and</text></subparagraph> 
<subparagraph id="H13776A434CB3476C9320B43DCA07912A"><enum>(B)</enum><text>by striking <quote>the program</quote> and inserting <quote>the voucher program</quote>; and</text></subparagraph></paragraph> <paragraph id="H0CA88F5C72C1477CB95C44F3B471AAAC"><enum>(2)</enum><text>in paragraph (4)(C) (as so redesignated by section 2(5)(C) of this Act), by striking <quote>$5,000</quote> and inserting <quote>$12,000</quote>.</text></paragraph></subsection> 
<subsection id="H3C5AF5B7118447349A00F871F3D0C58E"><enum>(b)</enum><header>Guidance</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services, in consultation with youth who have experienced foster care, shall develop and issue model guidance to States and jurisdictions receiving allotments under section 477(c) of the Social Security Act for implementation of the amendment made by subsection (a)(1) of this section.</text></subsection></section> <section id="H535A09B8AB74491C9FA42F881E534990" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header>Improving accessibility and youth awareness of education and training vouchers</header> <subsection id="H018065EAC38B40ACA5E6B41443C2A1E8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 477(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677(i)</external-xref>), as amended by section 2(6) of this Act, is amended by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H2986D0BB8A4245FDB7FD51A9D7508B20"> 
<paragraph id="HFECC3471E67C44E0B93B982D3F46025D"><enum>(8)</enum><text display-inline="yes-display-inline">The State shall make reasonable efforts to ensure that eligible youth are aware of potential benefits provided under this subsection, including by coordinating with programs funded under subsection (h)(1).</text></paragraph> <paragraph id="HECF0F4CDC2F049DA9F48CA8EE9BDC949"><enum>(9)</enum><text display-inline="yes-display-inline">The program shall include a simplified, user-tested, and standard form for youth to use to apply for vouchers under the program, using standard terminology, that is easily accessible and available electronically.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HBBB305AA5865461A82EBE27FEDFC36A0"><enum>(b)</enum><header>Use of funds</header><text>Section 477(d)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677(d)(1)</external-xref>) is amended to read as follows:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H6600794CDE9D4DB0AF4A430E8749CC22"> <paragraph id="HBE122A11F7A24811A9B32C51E8627166"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A State to which an amount is paid from its allotment under subsection (c)(1) may use the amount in any manner that is reasonably calculated to accomplish the purposes of this section, including outreach related to subsection (i)(8). A State to which an amount is paid from its allotment under subsection (c)(3) may use the amount for any purpose related to the program described in subsection (i)(8).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HCE374250B44F4EC8811DD4880C16A52E" display-inline="no-display-inline"><enum>5.</enum><header>Improving access to housing for foster youth</header><text display-inline="no-display-inline">Section 477 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677</external-xref>) is amended—</text> <paragraph id="H1F8633DF15304E25974EA8503F717A08"><enum>(1)</enum><text>in subsection (a)(1)—</text> 
<subparagraph id="H3A445F747FA145F6A9A5D474DD3E9287"><enum>(A)</enum><text>by striking <quote>and preventive</quote> and inserting <quote>preventive</quote>; and</text></subparagraph> <subparagraph id="H7CF09FA9B15244EAB695CF46E7AF25CD"><enum>(B)</enum><text>by inserting <quote>, and access to housing for youth age 18 or older</quote> before the semicolon;</text></subparagraph></paragraph> 
<paragraph id="H46157A716BF94C1B9809C4F656072D0B"><enum>(2)</enum><text>in subsection (a)(4), by inserting <quote>current and</quote> before <quote>former</quote>;</text></paragraph> <paragraph id="H2385D162864347E797C33CCBC93A66E6"><enum>(3)</enum><text>in subsection (b)(2)(D), by inserting <quote>, including by collaborating with public housing agencies that administer Federal housing programs serving foster youth under section 8(x)(2)(B) of the United States Housing Act of 1937 and receive funding to partner with public child welfare agencies to serve youth who have experienced foster care</quote> before the period;</text></paragraph> 
<paragraph id="HB38EC655070B48DB9B9D8328637AC72B"><enum>(4)</enum><text>in subsection (b)(3)(B), by striking <quote>not more than 30 percent of the amounts paid to the State from its allotment under subsection (c) for a fiscal year</quote> and inserting <quote>an average of not more than 30 percent of the amounts paid to the State from its allotment under subsection (c) for the 5 fiscal years covered by the application submitted by the State pursuant to paragraph (1) of this subsection</quote>;</text></paragraph> <paragraph id="H7E4D118EE4664D57B4D99FC66BF6BF18"><enum>(5)</enum><text>in subsection (d), by adding at the end the following:</text> 
<quoted-block style="OLC" id="H1E0FCE348D4A4CA386D6127EF9250EF9" display-inline="no-display-inline"> 
<paragraph id="HF1AD1DCA559E4C999EB92D947B835E87"><enum>(6)</enum><header>Housing supportive services</header> 
<subparagraph id="H800B719475174C189A2A4BA969DBD088"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A State may use amounts from its allotment under subsection (c) to provide supportive services to assist eligible youth who experienced foster care to obtain or retain suitable housing.</text></subparagraph> <subparagraph id="HC8BA2756DF40496F9AFCAFA0E9A837EA"><enum>(B)</enum><header>Definitions</header> <clause id="H5189411A586140C6AE904D52BB3B64F8"><enum>(i)</enum><header>Eligible youth</header><text display-inline="yes-display-inline">In this subsection, the term <term>eligible youth</term> means an individual who receives assistance provided under section 8(x) of the United States Housing Act of 1937.</text></clause> 
<clause id="HB11C51A224154E2BB44E5F6216F70B15"><enum>(ii)</enum><header>Supportive services</header><text>The term <term>supportive services</term> may include—</text> <subclause id="HB1772C5D071B43B6AEA82AC2B0B26B0E"><enum>(I)</enum><text>basic life skills information and counseling on financial literacy, use of credit, and money management;</text></subclause> 
<subclause id="HA5ACBAE14B0C43AD943C878439BBC818"><enum>(II)</enum><text>counseling on rental lease contracts and assistance with rental insurance; and</text></subclause> <subclause id="H7E82CD363DF647138EAA1B65F3273754"><enum>(III)</enum><text display-inline="yes-display-inline">assistance with security deposits, utility connection fees, moving costs, and other fees associated with establishing tenancy.</text></subclause></clause></subparagraph> 
<subparagraph id="H9262D36D37654644A0EF2848D2EF532D"><enum>(C)</enum><header>Exception</header><text>Expenditures in accordance with this paragraph shall not be considered expenditures for room and board for purposes of subsection (b)(3)(B).</text></subparagraph> <subparagraph id="HB6239682AFAF4AA6A81EBCBAB1CB1A67"><enum>(D)</enum><header>Aligning age eligibility</header><text>Notwithstanding subsection (b)(3)(A)(ii), a State may use funds from its allotment under subsection (c) to provide supportive services to eligible youth who have not attained 26 years of age for the purpose of supporting continued access to housing.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H4BA7AC4F56C14F059883E902D4677FC9"><enum>(6)</enum><text>in subsection (g)(1), by inserting <quote>access to housing,</quote> before <quote>and personal</quote>.</text></paragraph></section> <section id="H97B344A66DB0415298AD72D7079CA34E"><enum>6.</enum><header>Joint agency guidance</header> <subsection id="HDCE400FD4739488FBB66E1EE39F0E236"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Within 1 year after the date of the enactment of this Act, the Secretary of Health and Human Services and the Secretary of Housing and Urban Development, shall develop and issue joint guidance to State public child welfare agencies and public housing authorities to improve alignment and coordination of housing supportive services provided under section 477 of the Social Security Act and housing assistance provided under section 8(x) of the United States Housing Act of 1937.</text></subsection> 
<subsection id="HDEF7A10DDD9C4355A5BFB62BDF036BF6"><enum>(b)</enum><header>Contents</header><text>The joint guidance shall include the following:</text> <paragraph id="H82A7003DA4214C71B9939588AD0AEB0E"><enum>(1)</enum><text>Clarification and alignment of Federal policies to improve access to housing for youth who have experienced foster care, including youth who are in independent living arrangements while in extended foster care.</text></paragraph> 
<paragraph id="H5BDAC222AC574CBFA215EA0127642502"><enum>(2)</enum><text display-inline="yes-display-inline">Guidance on State use of funds provided under section 477 of the Social Security Act for supportive services (as defined in subsection (d)(6) of such section) to improve access to housing programs administered by the Department of Housing and Urban Development.</text></paragraph> <paragraph id="H59F0C86CED5C463CB7AB51CEDB9163A8"><enum>(3)</enum><text>Best practices for building partnerships between public child welfare agencies and public housing authorities, including ways to improve access to supportive services.</text></paragraph> 
<paragraph id="H25C19C1A52344B209F5498FC411BC94B"><enum>(4)</enum><text>Additional information the Secretaries deem necessary to effectively coordinate Federal programs serving current and former foster youth.</text></paragraph></subsection> <subsection id="H85FF69DF1FAB49D6B6A87C19187F6D2D" commented="no"><enum>(c)</enum><header>Production</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall designate an official of the Department of Health and Human Services to lead development of the joint guidance in collaboration with the Department of Housing and Urban Development.</text></subsection></section> 
<section id="H450DF5293F464392A831CD8FFBB21809"><enum>7.</enum><header>Report to Congress</header><text display-inline="no-display-inline">Within 3 years after the date of the enactment of this Act, the Secretary of Health and Human Services, in consultation with the Secretary of Housing and Urban Development shall submit to the Committee on Ways and Means and the Committee on Financial Services of the House of Representatives, and the Committee on Finance and the Committee on Banking, Housing, and Urban Affairs of the Senate a report that sets forth—</text> <paragraph id="H020901C2B7DA4780A5F5DA3022F8E3F4"><enum>(1)</enum><text>aggregate data on the number of eligible youth who have experienced foster care who are receiving Federal housing assistance;</text></paragraph> 
<paragraph id="H3CFCF9C79CE945D6BE42A5B86C4CE89B"><enum>(2)</enum><text>a description of the outcomes for the youth, including the extent to which youth are able to access stable housing and rates of homelessness;</text></paragraph> <paragraph id="H019D0FA6D91B4A1EB24A738F87C1D945"><enum>(3)</enum><text display-inline="yes-display-inline">the findings from any evaluations of State programs conducted pursuant to section 477(g)(1) of the Social Security Act; and</text></paragraph> 
<paragraph id="H0A7FC9A4A245455CBA64118297E833E0"><enum>(4)</enum><text>statutory recommendations for improving coordination between public child welfare agencies and Federal housing programs.</text></paragraph></section> <section id="H16FE0D4A9E9F455D93D4317F794D1416"><enum>8.</enum><header>Legal consulting and access under the John H. Chafee Foster Care Program for Successful Transition to Adulthood</header><text display-inline="no-display-inline">Section 477 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677</external-xref>) is amended—</text> 
<paragraph id="H51DA08D415BD47EC8E86BF35C24D11CE"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(4), by inserting <quote>legal counseling access,</quote> after <quote>education,</quote>; and</text></paragraph> <paragraph id="H1BEC55D0166943DFAFFDF1E0ACA49981"><enum>(2)</enum><text>in subsection (b)(3), by adding at the end the following:</text> 
<quoted-block style="OLC" id="HAB91142FBB1140E2BE4706CC7F8CC22F" display-inline="no-display-inline"> 
<subparagraph id="H64221F0EC9144205ACD1075EA6163499"><enum>(L)</enum><text display-inline="yes-display-inline">A certification by the chief executive officer of the State that the relevant case planning and other processes employed by the State take into consideration certain legal issues affecting housing, education, entry into employment, and family connections of current and former foster youth and the efforts required to address the issues, including with respect to State court records, legal recognition of family relationships, and matters relating to custody and permanency.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H9B5911934399456E92F141844ADE8C5A"><enum>9.</enum><header>Ensuring expectant and parenting youth have access to services provided through the Maternal, Infant, and Early Childhood Home Visiting Program</header> <subsection id="H23C1EF4CEA17476388706DFC84004C06"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">Section 477(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677(a)</external-xref>) is amended—</text> 
<paragraph id="HE26D0C895BA747C7B34DFB6A42C8646D"><enum>(1)</enum><text>in paragraph (6), by striking <quote>and</quote>;</text></paragraph> <paragraph id="HF8F783CEB8EF4ED481AFC30973C9BEC1"><enum>(2)</enum><text>in paragraph (7), by striking the period and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="HF526AB0BDAC74F52AE95DAF3989C6F3C"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HDE551BA19C9544EC9F68A363B879A8B1"> <paragraph id="HA222FA58CF604FF085AFDCFE53381553"><enum>(8)</enum><text display-inline="yes-display-inline">to connect foster youth in eligible families (as such term is defined in section 511) who receive services under this part with evidence-based home visiting and support services provided under section 511.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HAD395F4F8EAF427895FB3687CFF6E44B"><enum>(b)</enum><header>Applications</header><text>Section 477(b)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677(b)(3)</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H3FE94F3A454B42B29EB7A736EF86D96D"> <subparagraph id="HCE7BF786344149AF921FB6E237AD78B9"><enum>(M)</enum><text display-inline="yes-display-inline">A certification by the chief executive officer of the State that the State has processes in place to ensure that a youth participating in the program under this section who is in an eligible family (as such term is defined in section 511) is provided with information regarding evidence-based home visiting and support services provided in the State under section 511.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H27CE433206AC4B4A8DF503D30651F13C"><enum>10.</enum><header>Tailored case management and resource coordination services for parenting and expectant youth who have experienced foster care</header><text display-inline="no-display-inline">Section 477(d)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677(d)(1)</external-xref>) is amended to read as follows:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H22E2D91BE1C04C08848D1268A74BFF26"> <paragraph id="H99AED25E5AB14A169F6B59B747B8DD52"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A State to which an amount is paid from its allotment under subsection (c)(1) may use the amount—</text> 
<subparagraph id="HCDFA7D1723A74208BC8A57E4EAD7BCC5"><enum>(A)</enum><text display-inline="yes-display-inline">to provide tailored case management and resource coordination services to youth otherwise eligible for services under the State program under this section who are expectant or parenting; or</text></subparagraph> <subparagraph id="H63BBDF93C5464CD0B73D1D24032A999D"><enum>(B)</enum><text>in any manner that is reasonably calculated to accomplish the purposes of this section.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H76C0A4AF225A40E29176CE361CB27CA5"><enum>11.</enum><header>Updating the purposes of the John H. Chafee Foster Care Program for Successful Transition to Adulthood</header> 
<subsection id="H76D15DFD72884B888828830B01E7CF46"><enum>(a)</enum><header>Updating of purposes</header><text display-inline="yes-display-inline">Section 477(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677(a)</external-xref>), as amended by section 9(a)(3) of this Act, is amended—</text> <paragraph id="H7F96C45F7419416581D4D4822475A10E"><enum>(1)</enum><text>by striking paragraph (2);</text></paragraph> 
<paragraph id="H306C2DB77A504E46BD9A586D6E9BCE75"><enum>(2)</enum><text>by redesignating paragraphs (1) and (3) through (8) as paragraphs (3) through (9), respectively; and</text></paragraph> <paragraph id="HD335A24CC38C45139E4C948316657797"><enum>(3)</enum><text>by inserting after <quote>conducted—</quote> the following:</text> 
<quoted-block style="OLC" id="H0BF57C3A412940AAA37BB5AA56D8D2AC" display-inline="no-display-inline"> 
<paragraph id="HF71C4D336C52453CB8F1DE3C7656FD56"><enum>(1)</enum><text display-inline="yes-display-inline">to help children who have experienced foster care at age 14 or older to develop and maintain sustained, supportive relationships with adults (including kin or fictive kin who are not serving as placement), mentors, and peers (including peers who have experienced foster care), with a goal of providing multiple and varied paths to reduce isolation and ensuring that the youth develop lifelong connections and support networks;</text></paragraph> <paragraph id="H7D49AACE956F4431A5A2C56173A1737F"><enum>(2)</enum><text display-inline="yes-display-inline">to support youth still in foster care who have experienced foster care at age 14 or older in exercising the rights referred to in section 475A to participate in developing their permanency plan and receive written information about available services and steps the agency is taking to support the plan, as well as to facilitate pre- and post-permanency peer support, mentoring, connections with kin, and referrals to additional appropriate programs and services to help youth achieve their permanency goals;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HC2A2791404AA4048B303343AAB98AD4D"><enum>(b)</enum><header>Guidance</header><text display-inline="yes-display-inline">Within 1 year after the date of the enactment of this Act and after consulting with youth with lived experience in foster care, the Secretary of Health and Human Services shall issue guidance to States and Tribal child welfare agencies regarding the purposes set forth in paragraphs (1) and (2) of section 477(a) of the Social Security Act, that includes, at a minimum—</text> <paragraph id="HEBBD1F1416D34E15BCABB5AEEDFC59C1"><enum>(1)</enum><text>examples of services and support eligible for Federal funding under part B of title IV of such Act, under part E of such title as part of completing and following the case plan requirements provided for in section 475A of such Act, or under section 477 of such Act, including individual youth support, family support, and peer support to engage youth during reunification, guardianship, or adoption proceedings;</text></paragraph> 
<paragraph id="HABBB4EE5B45D4A98B7B9D8E140831C3F"><enum>(2)</enum><text>best practices for facilitating peer support, mentoring, and the development and maintenance of lifelong connections, including practices that support sibling, tribal, and community connections, including minimum qualifications and training for persons providing mentoring and peer support;</text></paragraph> <paragraph id="H1F21766852804B61A2ECBEF2BE0B73F8"><enum>(3)</enum><text>standards of outreach to and notification of eligible youth, including youth with a planned permanent living arrangement, to ensure referrals to appropriate programs and services; and</text></paragraph> 
<paragraph id="H2E0E9C5AF52B49479CA7CA6E8A78ED8F"><enum>(4)</enum><text>protocols for documentation of support and relationship-building activities under section 477 of such Act that are required by section 475A of such Act to be included in a child's case plan, sufficient to permit review under the case review system described in section 475(5) of such Act.</text></paragraph></subsection></section> <section id="H1BA8901238E547F895F8F2D78F19AEFB"><enum>12.</enum><header>Effective date</header> <subsection id="H565483F5EB864F27BA7C9DA89952600B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as otherwise provided in this Act, this Act and the amendments made by this Act shall take effect on the date that is 1 year after the date of the enactment of this Act.</text></subsection> 
<subsection id="HC9E8CB389D0C4FB9A078B16B5C7D826E"><enum>(b)</enum><header>Delayed permitted if State legislation required</header><text display-inline="yes-display-inline">If the Secretary of Health and Human Services determines that State legislation (other than legislation appropriating funds) is required in order for a State plan under section 477 of the Social Security Act to meet the additional requirements imposed by the amendments made by sections 5(3), 5(4), 8(2), and 9(b) of this Act, the plan shall not be regarded as failing to meet any of the additional requirements before the 1st day of the 1st calendar quarter beginning after the first regular session of the State legislature that begins after the date of the enactment of this Act. For purposes of the preceding sentence, if the State has a 2-year legislative session, each year of the session is deemed to be a separate regular session of the State legislature.</text></subsection></section> </legis-body> <attestation><attestation-group><attestation-date date="20260519" chamber="House">Passed the House of Representatives May 19, 2026.</attestation-date><attestor display="no">Kevin F.
